Abstract:
The strict procedural rules that characterize modern administrative law are said to be necessary to sustain the fragile legitimacy of a powerful and constitutionally suspect administrative state. We are likewise told that they are essential to public accountability because they prevent factional interests from capturing agencies. Yet the legitimacy-and-accountability narrative at the heart of administrative law is both overdrawn and harmful. Procedural rules have a role to play in preserving legitimacy and discouraging capture, but they advance those goals more obliquely than is commonly assumed and may exacerbate the very problems they aim to fix. This Article aims to draw into question the administrative lawyer’s instinctive faith in procedure, to reorient discussion to the trade-offs at the heart of any system designed to structure government action, and to soften resistance to a reform agenda that would undo counterproductive procedural rules. Administrative law could achieve more by doing less.

Abstract:
This article discusses certain features of administrative procedures and administrative proceedings when applying the norms of the Administrative Procedural and Procedural Code of the Republic of Kazakhstan dated June 29, 2020 No. 350-VI-ZRK (hereinafter referred to as APPK), which entered into force on July 1, 2021. The purpose of the article is to consider the features of administrative procedures, administrative proceedings and conciliation procedures in resolving public law disputes within the framework of the APC, as well as to analyze certain problematic issues of its application. The study used general scientific, private scientific legal methods of cognition. The authors reviewed and researched the distinctive principles of the implementation of administrative procedures and procedural features of administrative proceedings. With the introduction of the norms of the APC, the procedure for conducting both internal and external administrative procedures by state bodies has been streamlined, as well as administrative proceedings have been separated to resolve public law disputes involving an administrative (state) body or its official. The article touches upon the problems of passive, at the initial stage, application of conciliation procedures in resolving public law disputes by courts. On the example of the existing practice of bringing claims by state regulatory authorities to the court on the application of prohibitive and restrictive measures, it is proposed to transfer the consideration of this category of cases from the Code of Civil Procedure of the Republic of Kazakhstan to the APC, since it follows from public law relations. There is also an unequal position of the parties to a public law dispute in terms of appeal and cassation appeal against judicial acts on disputes of a public law nature under the APC and the Code of Civil Procedure of the Republic of Kazakhstan. At the same time, according to the authors, the introduction of the institute of administrative courts for the consideration of administrative cases and public law disputes should become an effective and efficient means of ensuring the protection of the rights and legitimate interests of citizens and legal entities.

Abstract:
The development of judicial procedures is an indicator of increasing complexity of civil procedure, a clear manifestation of the general pattern – unification and differentiation of civil procedural form. And one of the main tasks of the legislator is to make sure that the objective complexity of the legal space does not lead to complication of the access to judicial protection for interested persons. This thesis, put forward by the author, acts as one of the key ideas of this study and is disclosed in the article in terms of “incomplete” judicial procedures. The “incomplete” judicial procedures, according to the author’s conception, include simplified proceedings, absentee proceeding, court-ordered proceedings and proceedings on insignificant claims. The latter should be understood as proceedings before a justice of the peace in action cases (see clauses 2–5 part 1 of Article 23 of the Civil Procedure Code of the RF). In conclusion it is concluded that the procedural nature of the Russian process, laid down in the codes of the early 20th century, now acquires conceptual importance, which requires a different methodology to solve current legislative problems. The procedures we have considered is a “litmus test” of the methods of justice, which allows us to comprehend the general vector of the further path of civilizational process reform.

Abstract:
Statelessness is a phenomenon that affects every region and almost every country of the world. However, not very many states have mechanisms in place to identify and prevent it, and protect stateless persons. This article ascertains international norms and best practices regarding the establishment and operation of a Statelessness Determination Procedure (‘SDP’), and to apply these to a future SDP in Nigeria. The requirements for an SDP are drawn from conventions, United Nations High Commissioner for Refugees instruments and state practice. In proposing an SDP for Nigeria, in this contribution we strive for the most extensive protection for stateless persons, while taking the particular legal and institutional framework of Nigeria into account. We conclude that Nigeria, and in fact any state, may want to devote particular attention to standards relating to the legality and ‘bindingness’ of the proposed SDP, to procedural access and to procedural guarantees.

One of the major implications of Industry 4.0 will be the application of digital procedures in process industries. Digital procedures are procedures that are accessed through a smart gadget such as a tablet or a phone. However, like paper-based procedures their usability is limited by their access. The issue of accessibility is magnified in tasks such as loading a hopper car with plastic pellets wherein the operators typically place the procedure at a safe distance from the worksite. This drawback can be tackled in the case of digital procedures using artificial intelligence-based voice enabled conversational agent (chatbot). As a part of this study, we have developed a chatbot for assisting digital procedure adherence. The chatbot is trained using the possible set of queries from the operator and text from the digital procedures through deep learning and provides responses using natural language generation. The testing of the chatbot is performed using a simulated conversation with an operator performing the task of loading a hopper car.

The subject of the research is the additional powers of the Chairman of the Supreme Court of the Russian Federation in relation to cassation and supervisory complaints.The purpose of the article is to substantiate the necessity or redundancy of certain additional powers of the Chairman of the Russian Supreme Court taking into account the nature of such powers and the conditions for their application.The methodology. Analysis and synthesis, dialectical method as well as formal legal interpretation of Russian legislative acts and judicial practice of Russian Supreme Court were used.The main results. Since the transformation of the three-tier supervisory proceedings into a system of two cassation and one supervisory instance, as well as the liquidation of the Supreme Arbitration Court, the powers of the Chairman of the Supreme Court of the Russian Federation have spread to a fairly wide range of relations that allow influencing the movement of the case in the cassation and supervisory instance, and on itself initiation of a case in a supervisory instance. Moreover, such activities are far from always regulated by the norms of the law.The Chairman of the Supreme Court of the Russian Federation (or his deputy) currently has leverage over the possibility of considering a case in the cassation instance of the Supreme Court of the Russian Federation (Judicial Collegium of the Supreme Court) and in the supervisory instance (Presidium of the Supreme Court). These possibilities are called control and substitute in the article. Control powers should include: 1) regulation of key deadlines in cassation and supervisory proceedings; 2) interference in the procedure for filtering complaints. The procedure and conditions for the use of these powers are not regulated in the procedural codes. Having such powers in relation to procedural terms, the President of the Supreme Court actually influences the very possibility of initiating a case in a court of cassation or supervisory instance, as well as the duration (and, accordingly, the quality) of the examination of the complaint. The intervention of the Chairman of the Supreme Court of the Russian Federation in the procedure for filtering complaints has a clearly pronounced discretionary nature, moreover, it is selective. It would not be superfluous to point out that such as "order" in itself creates conditions for its abuse both by the participants in the case and by the courts. The substitute authority is the right of the Chairman of the Supreme Court to initiate supervisory proceedings on his own initiative, contrary to the basic rule of civil proceedings based on the principle of discretion (the case is initiated by the person whose rights have been violated). Supervisory proceedings are currently intended to appeal against judicial acts adopted by the Supreme Court of the Russian Federation itself when considering cases in the first, appeal and cassation instances. However, among the objects of appeal there are also acts of the Judicial Collegium of the Supreme Court, applications to which are possible with complaints against acts of any lower courts, with some restrictions on the decisions of justices of the peace (Article 390.4 of the Civil Procedure Code; Article 291.1 of the Arbitration Procedure Court). In this regard, the supervisory authority must continue to be viewed as the final link in the system of reviewing judicial acts. However, the system for reviewing judicial acts is very contradictory. On the one hand, there are a number of strict rules that cut off certain types of judicial acts from appeal; filtering complaints in the second cassation and supervision; establishing special rules for the jurisdiction of complaints. On the other hand, it is possible not to comply with these strict rules and directly contact the Chairman of the Supreme Court of the Russian Federation.This extraordinary power of the Chairman of the Supreme Court of the Russian Federation has been preserved, precisely because the Russian legislator firmly and consistently adheres to the conviction that it is necessary to leave at least one official who is not a party to the case the right to initiate an audit of a judicial act.Conclusions. The extraordinary powers of the Chairman of the Supreme Court are of an extra-procedural nature, at best they are based on the rules of record keeping (instead of the law), are selective and opaque.

The purpose of this article is to highlight the specific procedural obligations of the parties in the civil proceedings. Based on the results of the study, the author identifies the following obligations: use procedural rights in good faith, show respect for the court or other persons involved in the case, inform the court about the change of name, address during the proceedings, disclose evidence, prove the circumstances, to which the person participating in the case refers, provide the required evidence, perform all procedural actions on time, submit procedural documents that meet the requirements of the procedural codes for form and content, notify the court of the reasons for failure to appear at the court session and provide evidence of valid reasons.

Chinese criminal procedural law has recently been undergoing rapid transformation. While the search for ‘truth’, embodied in a confession by the accused, has traditionally dominated the criminal process, efforts are now being made to secure more procedural fairness. This is exemplified by the introduction of rules to render inadmissible at trial confessions extorted from suspects by ill treatment. Unsurprisingly, it has proved difficult to shift the mindsets of the players in the criminal justice process. The new rules have not been fully implemented in many respects and there is still confusion over the criteria to be used by the courts in making decisions about inadmissibility. Further, it has proved difficult to enable defence lawyers to play a more active role in defending their clients and to render it normal for witnesses to testify at trial. This handicaps the drive to secure a better balance between the search for truth and procedural fairness in the Chinese criminal trial.

Abstract:
This review examines some changes introduced by the Federal Law on January 28, 2018, No. 451-FZ, to the Civil Procedure Code, the Arbitration Procedure Code, and the Code of Administrative Procedure of the Russian Federation. The media called the amendment pool “procedural revolution”. It touched many institutions. On the one hand, it promoted unification of the civil process and imposed legal certainty on many issues. On the other hand, it simplified some ordinary procedures. Some of the changes fix the rules formed in judicial practice; others are essentially transitional and imply the need for further refinement. The present research explores the following innovations: modernization of the institute of court competence in the context of the availability of judicial protection, simplification and unification of the procedure for reviewing a challenge to the court, expanding the scope of simplified procedures for reviewing requirements, fixing the rules of continuous appeal in civil and administrative proceedings, etc. The review introduces the upcoming changes to the reader and outlines the author's opinion on the procedural reform. Some changes are characterized as positive, and the author substantiates the need for reform. Meanwhile, some innovations are criticized as they will inevitably lead to restriction of the rights of participants in the procedural relations. The author believes that the innovations of the “procedural revolution” will not lead improve the court system.

Abstract:
Objective: To compare the Duhamel and transanal endorectal pull-through (TERPT) procedures in the treatment of children with Hirschsprung’s disease. Methods: Studies comparing the Duhamel and TERPT procedures were included until 22 July 2023. R software (version 4.3.0) was used to perform the meta-analysis. Results: Ten studies with a sum of 496 patients were included. The length of postoperative hospital stay and incidence of postoperative constipation were longer and higher after the Duhamel procedure than the TERPT procedure (p < 0.0001 and p = 0.0041, respectively). The incidence of postoperative anastomotic stricture was higher after the TERPT procedure than the Duhamel procedure (p = 0.0015). No significant differences were found in the incidence of postoperative fecal continence, fecal incontinence/soiling, anastomotic leak, or ileus between these two procedures. The operation time seemed to be similar for both procedures, but it became longer for the Duhamel procedure than the TERPT procedure after sensitivity analysis. While the incidence of postoperative enterocolitis seemed to be higher after the TERPT procedure, it became similar for both procedures in the subgroup analysis. Conclusions: The Duhamel procedure seems to be associated with a longer length of postoperative hospital stay, a higher incidence of postoperative constipation, and a lower incidence of postoperative anastomotic stricture than the TERPT procedure. However, the effect of these two procedures on the operation time and the incidence of postoperative enterocolitis remains unclear.

Konsenzus kao procedura donošenja odluka kreirana je u cilju ispravljanja mana jednoglasnosti i većinskog glasanja koje su bile dominantne procedure u prva dva perioda razvoja međunarodnih organizacija. Rad analizira široku upotrebu konsenzusa u međunarodnim organizacijama, njegove prednosti i mane kao i proces njegove institucionalizacije. S obzirom na činjenicu da je konsenzus u određenom broju slučajeva neformalni oblik donošenja odluka, u radu se koristi novi institucionalizam kao pristup proučavanja problema. Na taj način se uzimaju u obzir i ishodi koje proizvode i neformalne institucije. Rad daje praktičan doprinos analizom upotrebe konsenzusa kao procedure donošenja odluka u Organizaciji ujedinjenih nacija i Organizaciji za bezbednost i saradnju u Evropi kao primeru organizacije koja koristi konsenzus kao jedinu proceduru donošenja odluka.

Abstract:
The Excised Teat Assay is an in vitro germicidal activity assay for evaluation of bovine teat sanitizers. The rinse procedure of this assay was modified and compared to the standard method. The rinse modification used an ultrasonic cleaner to vibrate the quencher solution to remove bacteria from excised teats after challenge. In alternating trials, bacteria were rinsed from teats by the standard procedure or by the ultrasonic procedure. A 1% iodine based teat sanitizer, a chlorhexidine based teat sanitizer, and a negative control were used in the study. Staphylococcus aureus (ATCC 29740) was used as the challenge organism. No significant differences were obtained by analysis of variance when comparing procedures or in comparing procedures within treatments when an experienced technician conducted the procedure. When an inexperienced technician conducted the procedure, significant differences were obtained between procedures and within treatments when comparing procedures. The modified rinse procedure provided more consistent results than the standard rinse procedure when used by an inexperienced technician.
