Full textParliamentary commissions of enquiry haven't been subject to any thorough study for more than twenty years. Little is known about legal regulations of commissions under the Fifth Republic. The purpose of the thesis is to define the judiciary system of those commissions. To analyze the enquiry power of the chambers, the first part is dedicated to the foundation of enquiry power, which can be understood only in its political and necessarily parliamentary framework. Besides, if the legislator has gradually admitted the possibility of giving commissions of enquiry some prerogatives of legal nature, is this decision suffcient and suitable ? This question brings about another one : indeed, what can we expect such an investigation, with almost legal aspect, and exerted by members of a parliament ? These questions form the subject of a second part. So, the purpose of this study is to point out how the right of enquiry exerted by assemblies is an atypical instrument of parliamentary control, the function of which seems essential today in our institutions

Full textThis PhD dissertation participates in historiographical trends that have been underway for several decades at the crossroads of imperial and colonial European expansion in the early modern period, the history of justice, and the history of knowledge production. It analyses inspections of royal justice and taxation-system in the form of itinerant trials, carried out among the communities of inhabitants in the province of Popayán (southwestern Colombia), between the years 1550s and 1630s. The study aims to reconstruct the contexts and actors involved in these procedures, called "visitas de la tierra", the concrete modalities of travel and social encounters they occasioned, and their practices of information-gathering, by observing and collecting testimonies.On the other hand, it questions the multiple uses of the visitas’ oral and written enactments, within the communities subjected to the trials (colonial towns and parishes, gold-mining districts, Indian encomiendas), as well as in the empire's governmental centers, to which various forms of reports were sent.The aim of the research is to understand better how the "visitas de la tierra" acted both as rituals of negotiation of the colonial order at the local scale of the political bodies established in the northern Andes, and as instruments of knowledge about their territories, the uses of which were exercised at different levels of imperial government

Full textAdmissibility of evidence is one of the most crucial and complicatedissues in the European Union’s area of freedom, security and justice. However, thedifficulties regarding the use of evidence gathered in one Member State inproceedings in another Member State through the mechanisms of judicialcooperation seems to have been underestimated by the European Union legislator,and this despite the success of criminal proceedings with a cross-border characterbeing considered a priority for the last fifteen years. Indeed, the EU’s criminal policyhas been striving for the strengthening of the efficiency of judicial cooperationbetween judicial authorities. This requires the improvement of the instrumentsdedicated to obtaining criminal evidence. Thanks to the principle of mutualrecognition of judicial decisions in criminal matters, based on mutual trust betweenMember States, the differences between and potential incompatibilities of nationalsystems should not be an obstacle to the free circulation of evidence in the EUcriminal justice area.However, this theoretical justification is not sufficient to ensure mutual admissibility ofevidence, as the good administration of evidence remains a national issue, with awide margin of appreciation accorded to the national judge. Furthermore, both thestudy of national procedural norms and the study of the European Union legalframework show deficiencies, requiring a coherent concept for the protection offundamental rights in criminal proceedings at the EU-level. A better and harmonisedprotection of procedural guarantees is the path to ensure the mutual admissibility ofevidence, overcoming national differences
