Full text
Abstract:
The paper deals with the problem of abuse and violence against minors, among which the authors distinguish a special category: orphans and children left without parental care. Approaches to the definition and forms of violence and ill-treatment of minors are described. The psychological causes and consequences of violence and ill-treatment are analyzed. Technologies for providing psychological assistance to child victims of violence and abuse are offered. A significant part of the work is devoted to the consideration of the features of interdepartmental interaction on prevention and timely detection of signs and consequences of abuse and violence against children. The result of such an analysis was the development of a model regulation describing the procedural and legal issues of coordinating such interaction between specialists from different departments in order to protect the interests of minors. The work is addressed to psychologists, teachers, specialists of organizations for children.

Abstract:
In this chapter, we discuss research related to the organizational citizenship behavior (OCB) construct from a cross-cultural perspective and propose a framework to aid in understanding how cultural frames influence the engagement and display of OCB. The terms “intercultural” and “cross-cultural,” as defined in this chapter, are not limited by geographic boundaries and can be used to depict differences in individual values regardless of nationality. In creating such a synthesis, we aim to stimulate a conversation about potential directions for future work at the intersection of these two literatures. Here we explore how the contextual impact of culture and its relation to motivational, metacognitive/cognitive, and behavioral processes in individuals helps us better understand OCB using facets of justice (interactional, procedural, and distributive) as a linking mechanism.

Luis, Ortiz Blanco, ed. EU Competition Procedure. 4th ed. Oxford University Press, 2022. http://dx.doi.org/10.1093/law-ocl/9780198799412.001.0001.

Full text
Abstract:
The fourth edition of this book, a key analytical commentary on the competition procedures of the European Union, provides in-depth coverage of the relevant rules. The book discusses in detail the European Commission's package of regulations and guidelines and their interaction in practice. This edition is fully updated to reflect recent legislative developments with a wealth of recent case law, in particular in relation to merger control and state aid. Consideration is given as to how EC Regulation 1/2003 (antitrust rules) have been applied and the book reviews their enforcement. Coverage also includes discussion of the fining practice of the European Commission and the judicial review of this practice by the Community courts. There is also a new part dedicated to the procedural aspects of arbitration as an efficient alternative means of dispute resolution in the private enforcement of EU competition law claims. As a practical guide to procedure, focusing on the implementation of the regulatory framework by the Commission and the relevant case law of the European courts, this is an indispensable resource for all practitioners involved in competition proceedings before the European Commission and national competition authorities.

Abstract:
This book provides a comprehensive and practically oriented account of EU competition procedure and the European Commission’s role in enforcement, coordination, and policy-making, from the perspective of EU enforcers. It explains the Commission’s approach to each aspect of enforcement: its investigatory practices and powers, interactions with parties under investigation and third parties, compliance with fundamental rights, process by which it adopts decisions, and application of sanctions and remedies for anticompetitive conduct. Publication and judicial review of Commission decisions is also be discussed. In particular, the book provides a complete view of the Commission’s role in enforcement and coordination at the international level. Following the implementation of the Damages Directive, the book examines cooperation between the Commission and national courts, with regard to the increasing role of private enforcement actions. It emphasises the importance of cooperation between the Commission and national competition authorities (NCAs) of the Member States and consider the impact of the forthcoming Directive on empowerment of NCAs (‘ECN+’), as well as the Commission’s engagement with NCAs in third countries and the instruments which facilitate this.

Trevor C, Hartley. Part IV Procedural and Systemic Issues, 23 Choice-of-Court Agreements: Jurisdictional Conflicts. Oxford University Press, 2017. http://dx.doi.org/10.1093/law/9780198729006.003.0023.

Full text
Abstract:
This chapter considers the problems that arise when an exclusive choice-of-court agreement, which is claimed to be valid, designates a court or the courts of one Member State (the ‘designated’ court), and proceedings are brought in another court (the ‘non-designated’ court). The basic aspects of choice-of-court agreements were discussed in Chapter 13. The chapter now deals with the interaction of these rules with the rules concerning <i>lis pendens</i>, the recognition of judgments, and other matters. It concludes that the only legitimate mechanism for ensuring respect for an exclusive choice-of-court agreement within the EU context is that provided by Brussels 2012, Article 31(2); both antisuit injunctions and actions for damages for ‘wrongful’ litigation are contrary to EU law.

Horing, Norman J. Morgenstern. Equations of Motion with Particle–Particle Interactions and Approximations. Oxford University Press, 2018. http://dx.doi.org/10.1093/oso/9780198791942.003.0008.

Full text
Abstract:
Starting with the equation of motion for the field operator ψ(x,t) of an interacting many-particle system, the n-particle Green’s function (Gn) equation of motion is developed, with interparticle interactions generating an infinite chain of equations coupling it to (n+1)- and (n−1)-particle Green’s functions (Gn+1 and Gn−1, respectively). Particularly important are the one-particle Green’s function equation with its coupling to the two-particle Green’s function and the two-particle Green’s function equation with its coupling to the three-particle Green’s function. To develop solutions, it is necessary to introduce non-correlation decoupling procedures involving the Hartree and Hartree-Fock approximations for G2 in the G1 equation; and a similar factorization “ansatz” for G3 in the G2 equation, resulting in the Sum of Ladder Diagrams integral equation for G2, with multiple Born iterates and finite collisional lifetimes. Similar treatment of the G11-equation for the joint propagation of one-electron and one-hole subject to mutual Coulomb attraction leads to bound electron-hole exciton states having a discrete hydrogen like spectrum of energy eigenstates. Its role in single-particle propagation is also discussed in terms of one-electron self-energy Σ‎ and the T-matrix

Full text
Abstract:
The material covered in this book is both broad and highly focused. It is broad in that it covers matters of civil, criminal, administrative, and public law. It is highly focused in that it is intended to act as a practical handbook for litigators; detailed explanations are given of practice, procedure, evidence, and remedies at the expense of general commentary on the non-contentious aspects of financial regulation. The book begins with an overview of the UK financial regulators whilst paying particular attention to the relationships between them and the ways in which those interactions can pose problems for litigators and the firms they represent. It summarizes the authorisation process and its procedures, and considers the authorisation of EEA firms following Brexit with a focus on procedure and the steps necessary for EEA firms to retain their authorisation following the UK’s withdrawal from the EU. The book then deals with the increasingly important topic of investigations and information gathering. The heart of the book covers the various forums in which firms can be challenged for failing to adhere to regulatory standards. Criminal liability is covered in detail across two chapters, as is civil liability, which is followed by a review of individual action by investors and consumers. The book continues with redress, complaints, the Financial Ombudsman Service, and relevant procedure are analysed, with a final chapter providing an overview of the independent methods of challenging regulators, including judicial review and the Financial Services Complaints Commissioner.
