Abstract:
The history of French law in the early modern period is characterized by gradual unification, rationalization, and centralization. From the fifteenth century, the central authorities started the official registration of customary law, seeking to implement more legal uniformity and security. The homologation process resulted in the publication of doctrinal treatises, in particular about the custom of Paris, which later became the chief legal basis of the 1804 Code civil. Case law also contributed to the consolidation of private law. The sixteenth and seventeenth centuries are marked by the political commitment of the monarchy to codify law in order to achieve legal and procedural unification, assert royal legislation as the main source of law, and contribute to France’s commercial and colonial policy. The great ordinances of Louis XIV and the custom of Paris were indeed transplanted to Canada and Louisiana and therefore became the main expressions of France’s legal expansion.

Abstract:
This chapter examines the law of set-off in France and how the country's bankruptcy law may affect the effectiveness of set-off. In France, set-off has been reaffirmed by specific rules regarding the netting of derivative products or by the EU Directive on Financial Collateral Arrangements (Collateral Directive). Other laws with relevant provisions for set-off include the French Civil Code and the French Monetary and Financial Code. The chapter first provides an overview of set-off between solvent parties, focusing on legal set-off, contractual set-off, enhanced set-off of financial obligations, cash-pooling arrangements, and security interests. It then considers set-off against insolvent parties, taking into account issues relating to automatic stay, fraudulent transfers/suspect period, and set-off of financial obligations after opening of an insolvency procedure. It also discusses the key set-off provisions of the Collateral Directive before concluding with an analysis of the law applicable to set-off in a cross-border context.

Abstract:
There were several reasons why the nunneries found it necessary to hire male music teachers. While in most cases new nuns learned plainchant from the older members of the choir, in certain situations outside expertise was required. Novices also required training in singing their portions of the rituals of clothing and profession, a role often carried out by secular professionals. The nunneries also housed young women resident students, whose studies, in addition to languages and comportment, sometimes included vocal or instrumental music. Teachers for these various purposes included G. B. Volpe, Giovanni Rovetta, Bartolomeo Barbarino, and Francesco Cavalli. All of these activities involved potentially dangerous interactions between the nuns and unrelated men, so the civil and ecclesiastical authorities attempted to maintain close control, if necessary arresting and trying men, including the organist Giovanni Pichi, who violated procedures.
