Full textAfter outlining the main elements of propositions of the jurists and political philosophers at time of forming the modern state, about the relationship between the individual and the state, between freedom of conscience and authority and between man and society, i come to the conclusion that as much the modern state's pedigree has gone wrong way in conception of the state's secularity, so much a state of occupation ( insofar as it has come from the same pedigree ) did nothing less than worse. This thesis attempts to find in descartes's works the premises of the theoretical construction of what have been colled the "secularized state" (from its essence). If zaire could be inspired by its traditions to set itself up as a "modern state", this would necessarily be compatible with the "freedom of conscience" and not necessarily "secularized"| meanwhile, the secularization of state in today's zaire cofine itself to be a "spiritualist neutrality"

Full textThe respect of aboriginal peoples’ rights over their ancestral territory poses serious challenges for jurists. The challenge is best met by the conclusion of treaties. In Canada, this practice is hindered by the policy of “exchanging” vague rights for clearly defined ones. This policy affronts the aboriginal negotiating party, for whom the process should instead focus on the full recognition of aboriginal rights. The problem is a paradox for the jurist until a historical perspective coupled with a critique of legal thought shows how it results from the encounter between two different conceptions; not only of “aboriginal rights”, but of the very idea of “law”. This encounter is one between legal monism and legal pluralism. Even then, the jurist may feel ill-equipped to address the normative significance of the progressive recognition of the aboriginal juridical order by Canadian and supranational law. The defunct Innu Land Claims Agreement-in-Principle recognized ancestral rights as an expression of aboriginal identity. The Royal Commission on Aboriginal Peoples made “mutual recognition” the touchstone of its recommendations. The centrality of this theme of the “struggle for recognition” suggests that philosophy may provide much-needed guidance. Liberal multiculturalism and the politics of recognition authorize us to pose the hypothesis of a double struggle: for the legal protection of aboriginal legal cultures and for the presumption of their value. Yet, contrary to Charles Taylor, it was not multiculturalism that Axel Honneth had in mind when, at about the same time, he undertook the systematic reactualisation of what passes for a hegelian theme. This thesis presents itself as a philosophical inquiry into a legal problem. It also is a more general inquiry into the relevance of philosophy for the elucidation of legal problems.

Full textBy taking as starting point the famous debates from the 70s and the 80s around the universality of hermeneutics, which had inflamed some of the 20th century greatest thinkers, such as Hans-Georg Gadamer, Jürgen Habermas et Jacques Derrida, this PhD thesis attempts to identify the actual philosophical question behind the hermeneutics’ claim of universality: the time’s hermeneutical intelligibility. I strive to express this intelligibility, which translates the paradoxical articulation of time and being as difference, by proposing an interpretation of two essential “figures” for the thinking of Martin Heidegger and Hans-Georg Gadamer: “the forgetting of being” and “the temporal distance”. More precisely, this interpretation or, as I call it, “figural reading” intends to understand the time’s paradoxical way of engendering the hermeneutical difference, that is: its capacity to generate simultaneously the occultation and the revealing of meaning, its potential to give the surplus of meaning and, at the same time, the finitude of comprehension. As a result of this figural reading, I conclude that the hermeneutics has its worth in interrogating the phenomenon of the difference between understanding and misunderstanding, and more precisely in identifying, as a foregoing condition of this difference’s effectivity, the time’s hermeneutical intelligibility. Finally, the hermeneutical universality reveals its genuine temporal nature: taken as a “productive aspect of the temporality”, it merges into the dynamics “of what is to be understood”
