The principled approach to theory building that has been a conspicuous mark of bioethical theory for the past generation has in recent years fallen under considerable critical scrutiny. Although some critics have confined themselves to reordering the dominant principles, others have rejected a principled approach entirely and turned to alternative paradigms. Prominent among critics are antiprin-ciplists, who want to jettison the principle-based approach altogether and adopt a casuistic (case-specific) model, and communitarians, who favor an eclectic model combining features of both the casuistic model and a modified principled approach. Particularly conspicuous in virtually all such critiques is their challenge to the preeminence of the principle of autonomy. Critical barbs have been aimed not only at theories favoring a hierarchical ordering of moral principles that give first place to autonomy, but also at those that include autonomy among a set of ostensibly coequal principles. Though these critics have performed a valued function by displacing bioethical principles from their Olympian perch beyond actual decision-making contexts, some version of the principle of autonomy may, nonetheless, be well worth defending but for very different reasons than those put forward by its supporters.

Abstract:
The article elucidates the inherent nature, structure, and substance of the foundational principles underpinning social protection in Ukraine, especially within the purview of social risk. These principles form the bedrock of the legal mechanisms governing social protection. A salient discovery is that Ukraine's legal mechanism for social protection operates under a dual- principled framework: the primary, universally acknowledged legal principles and the specialized principles, predominantly the principles of social protection. The overarching legal principles serve as cardinal ideas that enable the aforementioned mechanisms to seamlessly integrate and evolve within Ukraine's legal infrastructure. This ensures that there are no inadvertent risks to the prevailing legal framework in general and particularly in the social domain. The principles of social protection are pivotal, guiding the functioning and evolution of the associated legal mechanisms, particularly in alignment with the objectives of social law and, more specifically, the goals of social protection. Two primary facets underscore this prominence. Firstly, these principles provide depth to the overarching legal principles, contextualized within the realm of social protection and the broader social existence of individuals, society, and the state. This context is notably susceptible to the challenges posed by social risks. Secondly, they serve as the foundational tenets of the aforementioned legal mechanism. This underscores their role as core guiding concepts in the formulation, execution, and enhancement of this legal mechanism's operations. The primary special principles of the legal mechanism for social protection, within the context of social risk, encompass the subsequent principles of social protection: the principle of humanistic social justice; the principle of universality and accessibility; the principle of consistency and complexity; the principle of resocialization; the principle of adaptability; the principle of targeted social protection; and the principle of reliability. The article's conclusions consolidate the research findings, emphasizing that the principles of social protection are both a cornerstone of social law and the foundation for the establishment, refinement, and functionality of Ukraine's legal mechanism for social protection. This understanding is paramount when considering the socio-legal phenomenon of social risk.

Legal and bioethical principles. Separation, connection, integrationThis work is intended to establish relationships between legal and bioethical principles especially when bioethical principles complement and enrich legal ones in order to solve a specific case. Prior author’s contributions on bioethical principles as legal topics and legal bioethics creation in terms of a branch of bioethics which studies legal regulations as well as legal implementation and scope of bioethical problems are referred, making a critical reflection on growing and fruitful relationships between bioethics and law. An Interdisciplinary integration proposed in order to realize cooperation between both fields rejecting a separation or mere connection is suggested: «hetero integration», an integrating system produced by development of common and related principles. The article concludes stating that law structure is a «textual» subject not just involve on the writing of the law but capable to be analyzed from a social sense point of view, conferred to different manifestation of this discipline together with several social practices; a path warning by the need to broad theoretical-practical frameworks in order to move towards the interdisciplinarity taking into account bioethics from its foundations.
El objetivo de este trabajo es examinar la relación que existe entre los principios jurídicos y los principios bioéticos, en particular cuando los principios bioéticos enriquecen y complementan los principios jurídicos en la solución del caso concreto. Se acude a aportes anteriores del autor sobre los principios bioéticos como tópicos jurídicos y la creación de la bioética jurídica como rama de la bioética que estudia la regulación jurídica y las proyecciones y aplicaciones jurídicas de la problemática bioética y permite, como se procura aquí, una reflexión crítica sobre las crecientes y fecundas relaciones entre bioética y derecho. Desechada la separación y aun la mera vinculación, se propone una integración interdisciplinaria tendiente a instrumentar la cooperación entre ambos campos: heterointegración, producida por desarrollo de principios comunes y afines. Se concluye que el derecho constituye una materia textual, susceptible de ser analizada desde una perspectiva que no se agota en la mera escritura de la ley, sino que intenta captar la producción de sentido social que se inviste en las diversas manifestaciones de esta disciplina y que abarca distintas prácticas sociales, senda por la que se advierte la necesidad de ampliar los marcos teórico-prácticos para poder transitar la interdisciplinariedad y en la que no debe faltar la bioética desde sus principios

Esta tesis se centra en los desarrollos recientes de la teoría microscopía de la exoelectricidad y sus aplicaciones prácticas con tal de estudiar la respuesta física en sistemas concretos. La exoelectricidad es la propiedad electromecánica de todos los aislantes de desarrollar una respuesta polar a una perturbación uniforme del gradiente de deformación. Una teoría formal de tal efecto se ha establecido recientemente en el marco de la teoría de perturbación del funcional densidad (DFPT). Aun así, para alcanzar una metodología valiosa para la automatización del cálculo de la respuesta exoeléctrica para un cristal genérico, quedan algunos detalles conceptuales y prácticos. Estos están relacionados con las rotaciones locales de la muestra que pueden seguir una perturbación de gradiente de deformación. En esta tesis nos ocuparemos de tal cuestión; la solución se basa en la introducción de una nueva perturbación del cristal, la perturbación métrica, que se define como un fonón acústico descrito en el sistema de referencia que se mueve conjuntamente con los átomos. Después de presentar su implementación formal en el contexto de DFPT y en la aproximación de pseudopotencial separable, emplearemos esta nueva herramienta para calcular el tensor exoeléctrico para materiales seleccionados. A los logros anteriores les sigue una aplicación práctica de la teoría flexoeléctrica a la ingeniería del diseño de dispositivos " exovoltaicos", es decir dispositivos fotovoltaicos cuyos principios fundamentales de trabajo se basan en el efecto exoeléctrico. En la práctica, gracias a la estrecha conexión entre la teoría de la exoelectricitad y y la teoría de los potenciales absolutos de deformaci ón, mostramos cómo se puede calcular el perfil de bandas electrónicas en nanodispositivos doblados utilizando pocos y bien definidos parámetros. Dichos parámetros dependen de las condiciones de contorno electrostático impuesto. Finalmente centraremos nuestra atención en la respuesta polar mostrada por las paredes del dominio (PdD) ferroeelástico en SrTiO3, recientemente detectado. En general, las PdD se consideran una fuente prometedora de efectos físicos inusuales que pueden ser de interés práctico para aplicaciones de dispositivos electrónicos. Para mejorar la aplicabilidad de tales efectos físicos, es imprescindible entender su origen. Inspirados en la teoría de la exoelectricidad, en este trabajo desarrollamos una metodología original para estudiar el caso de las PdD ferroelásticos en SrTiO3, que se basa en la construcción de un modelo energético efectivo, construido en base a calculos de primeros principios, y eso incluyendo los efectos de los acoplamientos entre diferentes distorsiones inhomogeneas del cristal. Se discuten los efectos de cada contribución a la polarización total en las PdD.
This thesis focus on the recent developments of the microscopic exoelectric theory and its practical applications to study the physical response in concrete systems. Flexoelectricity is the electromechanical property of all insulators of developing a polar response to a uniform strain gradient perturbation. A formal theory of such effect has been recently established in the framework of density functional perturbation theory (DFPT). Still, in order to reach a valu- able methodology to facilitate the calculation of the bulk exoelectric response for a generic crystal, some conceptual and practical subtelties remains. They are related with local rotations of the sample that can follow a strain gradient perturbation. In this thesis we will deal with such issue; The solution is based on the introduction of a novel crystal perturbation, the metric perturbation, which is defined as an acoustic phonon described in the reference frame that is co-moving with the atoms. After presenting its formal implementation in the context of the DFPT within the separable pseudopotential approximation, we will employ such new tool to perform extensive calculations of the exoelectric tensor for selected materials. The previous achievements are followed by a practical application of the exoelectric theory to engineering the design of \ exovoltaic" devices, i.e. photovoltaic devices that base their fundamental working principles on the exoelectric effect. In practice, thanks to the close connection between the exoelectric theory and the theory of absolute deformation potentials, we show how the electron band profile of bended nanodevices can be calculated, in a mesoscopic semiclassical framework, using few and well defined parameters. Such parameters vary with respect to the type of electrostatic boundary conditions imposed. Finally, we will focus our attention on the polar response shown by the fer- roelastic domain walls (DWs) in SrTiO3, recently detected. In general, DWs are considered a promising source of unusual physical effects that can be of prac- tical interest for electronic device applications. For improving the applicability of such physical effects it is essential to understand their origin. Inspired by the theory of exoelectricity we develop an original methodology to study the case of the ferrolastic DWs in SrTiO3, which is based on the construction of an effective energy model, full from first principles, and that includes the effects of gradient mediated couplings between different crystal distortions. The effects of each identified contribution to the total polarization at the DWs is discussed.

Abstract:
This thesis challenges some of the current limits to the grounds for judicial review of legislation accepted by most Canadian jurists. More specifically, it makes a common law-based argument in favour of the priority over legislation of principles which are implied from the Imperial Constitution Acts 1867-1982 and which originally derive from the English constitution – namely implied constitutional principles. The argument faces two main interrelated legal objections: Parliamentary sovereignty and the Framers’ intentions. The first objection is rebutted by arguing that Parliamentary sovereignty possesses an ability to change in a way that can incorporate substantive legal limitations. The most prevalent common law-based theories of change to Parliamentary sovereignty suggest that the courts can authoritatively determine if implied constitutional principles can check legislation. The second objection is rebutted by reference to the notion of progressive interpretation as conceived under Hartian and Dworkinian theories of law and adjudication. Under these theories, progressive interpretation is an aspect of the courts’ best overall interpretation of the constitution, which includes implied constitutional principles. Such progressive interpretation can result in these principles constraining legislative authority. Justification of the progressive interpretation of implied constitutional principles can be based on the rule of law from which derive a number of these principles. One plausible conception of the Canadian rule of law is that it rejects the view that implied constitutional principles can prevail when in conflict with legislation. However, the better conception is that, as an attempt to adapt implied constitutional principles to relevant changes in society and to protect their underlying values, the judiciary should interpret these principles as capable of checking legislation to the extent that they form part of the core content of the rule of law. Such a conception and an operation of implied constitutional principles can properly be explained by Hartian or Dworkinian common law-based progressive interpretation of these principles and by their relationship with legislative authority.

Během studií jsme se učili, jak porozumět pravidlům psaní scénáře a jak je aplikovat na tradiční strukturu dramatu. Krom uspořádání do tří aktů existují také alternativní epizodické způsoby konstruování vyprávění s odlišnými pravidly. Přesto řada úspěšných epizodických filmů stojí na tradiční trojaktové stavbě. Mým cílem bylo popsat principy prolínání struktur a zkoumat, jak jsou uplatňovány v režijním zpracování filmů vysoké umělecké kvality. Ve čtyřech současných revisionistických westernech byly nalezeny čtyři možné principy, které je možné uplatnit také při psaní scénářů pro filmy jiných žánrů. Tyto filmy ukazují, jak je možné se vyhnout scenáristickým klišé a zároveň potvrzují, že aktuální sociální témata mohou být zkoumána v rámci žánrových filmů, o které masové publikum stojí.

Abstract:
"The study aimed to identify the degree of availability of governance principles in the schools of the North and South Al Sharqiyah governorates from the point of view of school principals. The researchers used the descriptive analytical method, and the questionnaire as a tool, by applying it to a sample of (100) principals, and the study reached the following results: The degree of availability of governance principles in the schools of North and South Al Sharqiyah governorates was moderate in most of its axes, except for one axis that came to a high degree, so the phrases in all axes varied between weak and medium. Al-Sharqiya came in general with a medium degree, where it was ranked as follows: the principle of integrity with a mean of (2.38), and after that came the axis of the principle of responsibility with a mean of (2.25), and the principle of justice came in the third place with a mean of (2.04), and finally came the pivotal principles of the principle of accountability and the principle of disclosure and transparency with an average of My Account (1.99), and the study confirmed that there are no statistically significant differences in the principles of governance in the schools of North and South Sharqiya governorates, due to the variables (gender, location), and the researchers recommend the need to create a legal culture around the principles of governance and make it easy and clear to access them. "
