<p>El mostrar como soporte y horizonte de la acción expresa un mundo unitario hecho a semejanza de la imagen como lugar privilegiado para albergar lo sensible. Esa forma de hacer que se ha instituido casi como la única posible en nuestra contemporaneidad: mostrarlo todo, decirlo todo, porque así ‘nos sentimos’ parte, somos ‘incluidos’. Lejos de la idea benjaminiana que proponía la mostración como una forma de exposición/constatación y relación entre los hechos, hoy el parloteo incansable adorna los hechos que en apariencia se muestran como ‘son’ gracias a la captura, en principio desinteresada, del ojo muerto de la cámara (o de todos los dispositivos que hoy cuentan con una). Pero es en la narración de las vivencias de esos miles de cuerpos que hoy traman los límites de exclusión que perfilan las fronteras deseables de la vida urbana contemporánea, que se constata la buena salud de la estructura de dominación actual y de subsunción de la vida al capital. El presente libro se organiza alrededor de la construcción de entornos como estructuradores de experiencias posibles de vivir la ciudad en la capital cordobesa. Desde allí se observan y analizan los valores que traman una particular vivencia de clase acerca del disfrute, la seguridad, la belleza y la naturaleza que aparecen como marcos deseables de un estado de la sensibilidad social.</p>

This editorial focuses on the violation of the jus cogens principle of non-impunity for acts of torture as occurred in the Cestaro v. Italy case, where the perpetrators went unpunished due to the statute of limitations. The Italian Supreme Court failed to apply this principle of global constitutional law. Nor did the ECtHR implement effective remedies against impunity. The author proposes reopening time-barred criminal proceedings as a useful tool against impunity to give full effect to ECtHR jurisprudence supporting the generally recognized principle of the non-applicability of statutory limitations to crimes against humanity.She stresses the need to enhance the effectiveness of the supervisory role of the ECtHR in ensuring the observance of jus cogens human rights principles—of which the ECHR “forms part”—through a unitary approach of courts to the fight against impunity based on an evolutionary interpretation of the Convention, which would provide more effective and integrated protection of such rights.

Rigid definitions of law and the impossibility of fitting reality into these definitions have prompted lawyers to multiply so-called quasi-institutions. For example, the controversy over delegation of legislative power has led constitutional lawyers to speak about quasi-legislative power, which is power transferred by the legislature to the executive in spite of the principle of separation of powers. Some constitutional lawyers and political scientists have also adopted a rigid definition of the federal principle. Since many federations do not correspond in theory or practice to this definition, the institution of quasi-federation, which is midway between a real Federation and a unitary State, was introduced into the picture. The questions then arise whether the term quasi-federation can serve any practical or academic purpose, and if so, what is the real meaning of quasi-federation? This chapter addresses this question with particular reference to the Federation of India.

L’insieme degli interventi normativi giustinianei viene preso in esame in una trattazione unitaria (ma senza che ciò comporti il sacrificio della trama esegetica – talvolta complessa – dei singoli provvedimenti) volta ad affrontare, dopo gli episodici (benché rilevanti) interventi realizzati dalla cancelleria già all’epoca delle compilazioni, un corpus di norme, essenzialmente riconducibile al periodo della legislazione novellare, che risulta nel suo complesso compatto e omogeneo, sia quanto ai tempi di emanazione (che vanno quasi certamente dal 536 al 542), sia per le linee di politica legislativa, di sostanziale favore, che esprime nei confronti della corporazione degli ἀργυροπρᾶται costantinopolitani. In un contesto in cui non si rinuncia a collocare la legislazione oggetto della ricerca nel quadro politico ed economico del tempo, ne scaturisce un quadro articolato delle svariate attività a loro riconducibili rispetto alle quali, in deroga al diritto comune, tende a configurarsi un diritto marcato da una spiccata specialità, espressione della volontà di un legislatore pronto a sacrificare alle esigenze della corporazione regole e principi consolidati.

Abstract:
This chapter opens by clarifying some main organizational structures within which multilevel public governance takes place. As argued, each organization structure tends to privilege certain interests and this seems to hold as regards ‘upstream’ (policy formulation) processes as well as ‘downstream’ (implementation) processes. Theoretically, the chapter builds on some classic insights from organizational research. Empirically, it draws on studies of international organizations, the European Union, and federal as well as unitary states. The chapter shows how the power of lower-level territories to shape these processes depends on the extent to which organizational structures are arranged according to a territorial principle. In the same vein, higher levels of government tend to strengthen their position when non-territorial principles of specialization prevail.

Exista cadre teoretice si metodologice dezvoltate atat in economie, dar si in sociologie, management, marketing etc. Necorelarea este intrinseca modului in care functioneaza economiile, insa nu exista studii care sa conchida asupra nivelului de dezechilibru care ar putea fi considerat firesc, benign, si care este acel nivel de dezechilibru de la care economia, indivizii (firme sau persoane) sau comunitatile sunt afectate de consecintele negative ale acestuia.

Abstract:
This article examines the notion of ‘symmetry class’, which expresses the relevance of symmetries as an organizational principle. In his 1962 paper The threefold way: algebraic structure of symmetry groups and ensembles in quantum mechanics, Dyson introduced the prime classification of random matrix ensembles based on a quantum mechanical setting with symmetries. He described three types of independent irreducible ensembles: complex Hermitian, real symmetric, and quaternion self-dual. This article first reviews Dyson’s threefold way from a modern perspective before considering a minimal extension of his setting to incorporate the physics of chiral Dirac fermions and disordered superconductors. In this minimally extended setting, Hilbert space is replaced by Fock space equipped with the anti-unitary operation of particle-hole conjugation, and symmetry classes are in one-to-one correspondence with the large families of Riemannian symmetric spaces.

What philosophy governs the European common market today? This chapter examines this question by exploring the doctrinal structure of Article 34 since Cassis de Dijon. It will be argued that after Cassis, the substantive structure of the European market could no longer be presented as a ‘new legal order of international law’. For the principle of mutual recognition ‘breaks’ the backbone of the international model, as each State loses a part of its (internal) sovereignty over its own (internal) market. This loss of sovereignty was first established for national rules relating to product requirements; but the question whether this federal solution equally applied to ‘selling arrangements’ has preoccupied the Court ever since. With Keck, the Court acknowledged the existence of different tests for different categories of measures. How do these three jurisprudential lines interrelate? Two theoretical approaches are discussed: the (old) category approach and a (new) unitary approach.

Con riferimento ai temi della fiducia e della destinazione patrimoniale si avverte l’esigenza, sul piano scientifico, di una sistemazione idonea ad individuare i principi e gli elementi strutturali delle diverse fattispecie. Il sintagma “proprietà fiduciaria” evoca una pluralità di istituti che, ancorché in larga parte omogenei sul piano degli effetti economici e degli interessi concreti, risultano fortemente differenziati nella elaborazione dogmatica e in talune schematizzazioni teoriche. L’innegabile diversa origine degli istituti e la non totale omologazione sul piano effettuale non impediscono però di apprezzare un dato che è, al tempo stesso, sia storico sia evolutivo. Se le differenti culture hanno portato alla creazione di variegati modelli di proprietà nell’interesse altrui, occorre sottolineare come siano in parte comuni gli interessi protetti e gli ingredienti giuridici che ne costituiscono le basi concettuali. Ciò ha reso possibile la contaminazione degli istituti e la creazione di flussi giuridici, di fenomeni di metabolizzazione e reciproca integrazione delle soluzioni normative ed interpretative. Tali generali esigenze di sistemazione hanno portato ad elaborare e sviluppare, nell’ambito del Dipartimento di Scienze Giuridiche dell’Università di Bologna, il progetto di ricerca “Destinazione patrimoniale e causa fiduciaria: un approccio interdisciplinare per una prospettiva ricostruttiva unitaria” conclusosi con il Convegno “Fiducia e destinazione patrimoniale” (2 e 9 ottobre 2020). Nel volume sono raccolte le relazioni presentate al Convegno e rielaborate dagli Autori in forma di articoli.

Historically, research on improvisation has been related to the discovery of non-Western musics, folk music, and jazz, and has depended on the development of recording techniques for its principal kinds of data. The concept of improvisation is not unitary, but includes many vastly different kinds of un-notated music-making, which casts some doubt on the efficacy of the term itself. In the history of Western art music, improvisation was originally ignored or seen as craft rather than art, but since ca. 1980 it has occupied increased attention. The association of improvisation with oral transmission has sometimes been misunderstood. The most successful standard research study has been the comparison of performances based on a single model, for example, raga in India, maqam and dastgah in the Middle East, or a series of chord changes or a tune in jazz. Improvisation as a concept—for example, as a metaphor of freedom—has been important in recent research.

After the 1954 Brown v. Board of Education ruling, no state fought longer or harder to preserve segregated schools than Mississippi. This massive resistance came to a crashing halt in October 1969 when the Supreme Court ruled in Alexander v. Holmes Board of Education that “the obligation of every school district is to terminate dual school systems at once and to operate now and hereafter only unitary schools.” Thirty of the thirty-three Mississippi districts named in the case were ordered to open as desegregated schools after Christmas break. With little guidance from state officials and no formal training or experience in effective school desegregation processes, ordinary people were thrown into extraordinary circumstances. However, their stories have been largely ignored in desegregation literature. This book explores the arduous and complex task of implementing school desegregation. How were bus routes determined? Who lost their position as principal? Who was assigned to what classes? Without losing sight of the important macro forces in precipitating social change, the authors shift attention to how the daily work of “just trying to have school” helped shape the contours of school desegregation in communities still living with the decisions made fifty years ago.

Of all the sub-periods in which European medieval history has been divided over time, the later middle ages is possibly the one on which the burden of past and current grand narratives weighs the most. Its chronological and geopolitical boundaries are in fact shaped by a heavy narrative of decline or transition, and consequently this period is often interpreted through the lenses of previous or following developments, becoming in turn the tail-end of the ‘feudal’, ‘communal’, ‘imperial versus papal’ era or the announcement of modernity. There is therefore an urgent need to revise and rewrite the story of the later Middle Ages, and in order to do so, to forge new critical and technical vocabularies not derived from the study of other periods. By adopting a conscious approach towards temporal and spatial variety, and by breaking the traditional and unitary narrative of decline and transition into one of many changes and continuities, this book charts the principal developments of late medieval Europe while opening up to different political cultures and societies, throwing new light on older concepts, and revealing analogies and differences with other geopolitical contexts. Including maps, illustrations, a detailed chronology and a rich range of reading suggestions, this book aims at providing a first introduction to a very complex, dynamic, and fascinating period for Europe and beyond.

Abstract:
El interés principal del estudio lo constituye la relación entre la espiritualidad, la religiosidad y la orientación religiosa con la salud mental y el bienestar psicológico, en las ciudades de Medellín (Colombia), y Buenos Aires (Argentina). Se estimaron las correlaciones en una muestra de 306 participantes pertenecientes a tres grupos religiosos: pentecostales (trinitarios y unitarios), adventistas y católicos. En la muestra, el 40% fueron hombres y el 60% mujeres, con edades comprendidas entre los 25 y los 80 años (M=41 años). Con el fin de conocer las variables predictoras, tanto para la salud mental como para el bienestar psicológico, se realizó un análisis de regresión múltiple intro y por pasos. Todos los participantes diligenciaron los siguientes instrumentos: cuestionario sociodemográfico, Escala de Bienestar Psicológico de Ryff, test de salud mental de Goldberg GHQ-12, Escala de Espiritualidad y Religiosidad Aspires, y Escala de Orientación Religiosa Age Universal IE. Los resultados determinaron correlación entre la espiritualidad, la religiosidad, la orientación religiosa con la salud mental y el bienestar psicológico. Al realizar el análisis de regresión múltiple, se identifica un modelo que predice el bienestar psicológico, con un R2 del 21.5%. La realización de la oración fue predictor del bienestar psicológico, con una proporción de la varianza β= 0.711, t= 3.175, p= 0.000), junto con la religiosidad intrínseca (β= 0.78, t= 2.719, p= 0.000) y la crisis religiosa (β= -1.79, t= -3.687; p= 0.000), explicando inversamente el bienestar psicológico. En el modelo de salud mental dos variables la explicaron (R2 = 27%), la orientación religiosa intrínseca (β= 0.47, t=6.887, p=000) y la crisis religiosa de manera inversa (β= -0.54, t=- 4.732, p=0.000). El 19% de la muestra poblacional comportaba deterioro de la salud mental. En Colombia se presentaron un mayor bienestar psicológico y religiosidad extrínseca personal. Por país y por denominación religiosa se encontraron algunas leves diferencias.
