Il fenomeno della sottrazione internazionale dei minori consiste nell’illecito allontanamento (o nel mancato rientro) del minore «in violazione dei diritti di affidamento derivanti da una decisione, dalla legge o da un accordo vigente in base alla legislazione dello Stato membro nel quale il minore aveva la sua residenza abituale» da parte di un genitore. Ad esso sono dedicate alcune norme del Regolamento (CE) n. 2201/2003 relativo alla competenza, al riconoscimento e all’esecuzione delle decisioni in materia matrimoniale e in materia di responsabilità genitoriale e le disposizioni della Convenzione dell’Aja del 25 ottobre 1980 sugli aspetti civili della sottrazione internazionale di minori. Tali atti prevedono, oltre ai criteri di definizione delle autorità competenti e alle norme sul riconoscimento ed esecuzione delle decisioni, la creazione di una rete di cooperazione fra gli Stati membri diretta alla risoluzione celere della questione e al perseguimento degli interessi del minore coinvolto. I casi di sottrazione dei minori coinvolgono, inoltre, ulteriori aspetti riguardanti la vita familiare degli stessi, il diritto ad essere ascoltati, la valutazione della loro vulnerabilità, il diritto di mantenere rapporti con entrambi i genitori e il diritto di visita. A ciò si aggiunge l’affermazione dell’obbligo per gli Stati di rispettare il diritto alla vita familiare (artt. 8 CEDU e 7 della Carta dei diritti fondamentali dell’Unione europea) e le pronunce rese dalla Corte europea sulla compatibilità tra gli obblighi scaturenti dalla Convenzione dell’Aja del 1980 e le norme CEDU. La sottrazione internazionale dei minori è, dunque, un fenomeno in cui gli aspetti processuali del diritto internazionale privato si fondono con i principi sottesi all’effettiva ed efficiente cooperazione tra Stati e con la tutela dell’interesse superiore del minore (previsto su scala universale dall’art. 3 della Convenzione Onu sui diritti del fanciullo del 1989), nonché, con il diritto alla vita familiare. Profili che investono il diritto internazionale, europeo e nazionale, condizionando inevitabilmente quest’ultimo e la sfera di esclusiva competenza riservata al legislatore statale. La tutela del minore quale principio preminente rispetto ai diversi interessi coinvolti ha, dunque, una valenza particolarmente incisiva tale da superare le stesse delimitazioni di competenza tra Unione europea e Stati membri, nel senso che gli aspetti processuali atti a garantire il rientro del minore nello Stato di residenza abituale possono condurre nelle singole fattispecie concrete ad un superamento della disciplina nazionale in materia di affidamento. If altruistic surrogacy should be legal in Sweden, laws concerning screening of the parents should be mandatory and adoption should be promoted as an alternative to surrogacy to a larger extent. Both in surrogacy and adoption the best interest of the child should be a priority, but parents regardless of sexuality, income and to some extent age, should qualify as long as they can prove their ability as parents.

Abstract:
As the divorce rate in the United States remains steady at 50%, the last few decades have shown an increase in child custody disputes. Within these litigations, interparental conflict can reach high levels and incite behaviors that wreak havoc on the children who are caught in the middle. When considering custody arrangements, judges and other evaluators use the Best Interest of the Child Standard (BICS), a jurisdictionally-specific framework that examines several factors that contribute to a child’s health and well-being. Parents who allow their resentments to get the better of them sometimes engage in behavior that encourages their child to become alienated from the other parent, known as Parental Alienation (PA) —a form of psychological abuse that can result in emotional and behavioral consequences for the child. While some states investigate components relevant to PA during a BICS evaluation, none include criteria that directly addresses this construct. Therefore, to achieve the intended outcome of BICS, which is to create a custody arrangement that will best meet a child’s needs, recognizing and addressing the presence of PA within a family system is required.

Abstract:
This thesis explores current and historical child custody laws in the State of Arizona and how they have correlated with child development theories. It discusses the impact child development theories have had on Arizona child custody cases. Additionally, it includes an overview of early Arizona Supreme Court cases and the implications it has on the best interest of the child. The thesis also provides insight to problems with Arizona courts and the actors involved with making the decision for the best interest of the child. The investigation demonstrates a disconnection between judicial discretion and the best interest of the child standard. An example from the United States Supreme Court case Troxel v Granville (1999) is reviewed to illustrate how courts discretion, in general, can be misused. Overall, court discretion in Arizona is liberal and the impact it has on child custody decisions can sometimes conflict with the best interest of the child.

Abstract:
Best interests of the child (BIC) is a construct that is central to legal decisions in several areas including parenting matters in the Family Courts, guardianship, child-protection, and adoption. Despite the centrality of the construct, BIC has not been operationalised (Thomson & Molloy, 2001) and there is little agreement about what is considered best for children within social service and legal communities (Banach, 1998). Given that one of the aims of law is to reflect public sentiment (Green, 1996), the current study explored the general public’s conceptualisation of BIC. More specifically, I sought to determine what community members think the term “best interests” means and what factors they believe need to be considered when determining BIC? A qualitative approach was used and data were collected through semi-structured interviews. Participants (n= 19) defined BIC as parents effectively meeting the developmental needs of children to produce healthy young adults, both physiologically and psychologically. A complex hierarchical model was generated from participant responses that outlined the primary developmental needs of children and sets of conditions and parenting practices that elicit these. Despite the indeterminate nature and vagueness of the BIC standard, the findings from the current study suggest that current legislative practices do reflect public sentiment. Results of this research represented an important step towards a more comprehensive understanding of the BIC concept and endorse existing practices of forensic evaluators. Moreover, embedding gathered information in the context of child development and parenting literature appears essential to the utility of forensic psychological assessments. Finally, the model generated highlights the complexity of BIC and the need for practitioners to be aware of interactions that exist between child development and contexts of the home, community, culture and society.

Abstract:
The concept of inter-country adoptions was reintroduced into the South African legal sphere in The Minister of Social Welfare and Population Development v Fitzpatrick 2000 3 SA 422 (CC), where the constitutionality of section 18(4)(f) of the Child Care Act 74 of 1983, which prohibited inter-country adoptions, was successfully challenged. The decision evoked criticism from all around the world, some in favour of inter-country adoptions and others not. In considering this decision, one also has to keep in mind section 28(1)(b) of the Constitution of the Republic of South Africa, 1996 which affords every child the right to family care or parental care, or to appropriate alternative care when removed from the family environment. The aim of this paper is to investigate the inner workings of inter-country adoptions, which are regulated by the Hague Convention on Protection of Children and Co-operation in Respect of Intercountry Adoption of 1993 and, nationally, the Children’s Act 38 of 2005. These findings will then be relayed back to the ‘best interests of the child’ principle to determine whether inter-country adoption is in the best interests of the child, or not.

A presente dissertação traz uma reflexão sobre a aplicação do princípio do melhor interesse nos conflitos interfamiliares de guarda, buscando a sua origem e levantando alguns critérios que possam nortear a sua utilização, uma vez que não há um conceito expresso na legislação. Nosso objetivo foi verificar se o princípio acima mencionado estava ou não sendo considerado nas decisões judiciais oriundas das disputas de guarda entre os genitores, após o divórcio ou a separação. Para efetivá-lo, desenvolvemos um estudo qualitativo de tipo exploratório junto ao Núcleo de Prática Jurídica da PUC/RJ, procedendo à análise de catorze processos de guarda identificados no período de 1997 a junho de 2007. A leitura e análise dos processos evidenciaram que o princípio do melhor interesse ainda não é totalmente considerado pelos operadores do Direito. Nos processos em que há atuação da equipe técnica (assistentes sociais e psicólogos) pode-se perceber uma conduta que explicitamente coloca a criança/adolescente como personagem principal do processo (prioridade absoluta), ouvindo-os sempre (proteção integral) e averiguando de que forma seriam melhor atendidos (melhor interesse). A conduta de juízes e promotores, por outro lado, não se afigurou, nos processos analisados, como algo que demonstrasse a preocupação com a aplicação do princípio do melhor interesse, mas ao contrário a ênfase era no encerramento dos mesmos a partir de um acordo elaborado apenas com os genitores, desconsiderando as peculiaridades do litígio e em especial o bem estar das crianças e adolescentes envolvidos.
The present dissertation brings a reflection on the application of the principle of the best interest of the child in the interfamiliar conflicts of custody, searching its origin and raising some criteria that can guide its use, once there is not an express concept in the legislation. Our main goal was to verify if the referred principle was being considered or not in the decisions of the disputes of guard between the genitors, after the divorce or the separation. In order to accomplish it, we developed a qualitative and exploratory study at the Núcleo de Prática Júridica of the PUC/RJ, in which fourteen proceedings of custody in the period of 1997 until June of 2007 were analyzed. The analysis of these proceedings showed that the principle of the best interest of the child is not yet taken into consideration by some of the Law workers. The proceedings in which the social workers and psychologists participated we noticed that the adolescent/child were seen as the main characters (absolute priority) so they always got the chance to express their opinions (full protection) and therefore offered the means to point out the most suitable way to solve the cases (best interest). On the other hand, the judges and prosecutors of the analyzed proceedings did not seem to be concerned about the principle of the best interest of the child, their greatest concern was to put an end to the lawsuits making a deal with the parents, disregarding the details of the conflicts and the well being of the children and adolescents involved.

While the Best Interest of the Child (BIOC) standard has been used since the 1970’s, alternatives such as the Approximation Rule have recently been proposed to remediate perceived weaknesses in BIOC. This study examines the applicability of the Approximation Rule using cross-sectional data collected from 517 children (age 10-18) of divorced parents using the Co-Parenting Behavior Questionnaire (CBQ). Data for all co-parenting and parenting variables (n = 517) were analyzed to determine relationships by time since divorce and custodial relationship. Physical custody was associated with significant differences in children’s’ ratings of both co-parenting and parenting effectiveness. Results for time since divorce revealed only one significant relationship with all divorcing parents showing significant decreases in ratings of inter-parent conflict over time with the most substantial reductions occurring 5 years after the separation. Findings were then used to measure the accuracy of the assumptions in both the Approximation Rule and in BIOC.

ENGLISH ABSTRACT: The Constitution of the Republic of South Africa entrenches the best interests of the child as being of paramount importance in all matters concerning the child. This commitment to the promotion of the welfare of children is not unique to modern South African law, but is an acknowledged principle of the common law and international child law as well. With such well-established recognition the question, which forms the primary focus of this study, arises whether the principle of the best interests of the child is workable and applicable in real life scenarios where the custody of a child has to be decided. The challenge to the application of the principle in this context is to reach a decision that will protect the parent-child relationship regardless of the marital breakdown. The question is whether the principle allows for and creates an honest awareness of and commitment to the welfare of children that influence decisions in this context or whether courts and decision-makers merely pay lip service to it in order to conceal the haphazard way in which custody is awarded. In order to determine the workability and applicability of the principle, it is necessary to know how the principle has evolved in the South African legal context. Through the examination and analysis of existing literature, international conventions, legislation and case law, a number of different perspectives on the developments in the interpretation and application of the principle are provided. These perspectives culminate in the useful and constructive insight and conclusion that the value of the concept is dependant upon the correct approach to the principle and its characteristics. The defining characteristic of the principle of the best interests of the child is its inherent vagueness and indeterminacy. Though this subjects the principle to serious criticism, this study supports the argument that indeterminacy is in fact essential. It ensures not only the flexibility of the concept, rendering it applicable to the time, cultural sphere and social context and unique circumstances of each case it is applied to, but a holistic approach to the child as individual and family as a unit as well. This holistic approach forms the foundation of the lists of criteria in McCall v McCall 1994 (3) SA 201 (C) and the Children's Bill, thereby establishing the workability and value of the principle for fair and just results in all decisions pertaining to the custody of children.
AFRIKAANSE OPSOMMING:Die Grondwet van die Republiek van Suid-Afrika verskans die beste belange van die kind as van deurslaggewende belang in elke aangeleentheid rakende die kind. Die verbintenis tot die bevordering van die belange van kinders is nie 'n verskynsel uniek aan die moderne Suid-Afrikaanse reg nie, maar is 'n erkende beginsel in beide die gemenereg en die internasionale kinderreg. Met hierdie wyd-verspreide en algemene erkenning ontstaan die vraag, wat dan ook die primêre fokus van hierdie studie vorm, of die beginsel van die beste belang van die kind werkbaar en toepaslik is in ware lewensdramas waar 'n beslissing oor die bewaring van 'n kind gemaak moet word. Die uitdaging vir die toepassing van die beginsels in hierdie konteks is om 'n besluit te neem wat die voortbestaan van die ouer-kindverhouding ten spyte van die verbrokkeling van die huwelik sal verseker. Die vraag is of die beginsel werklik 'n eerlike bewussyn van en verbintenis tot die welstand van kinders skep wat die besluitnemingsproses in hierdie konteks beïnvloed en lei en of howe en besluitnemers bloot die regte lippetaal gebruik om die lukrake manier waarop besluite geneem word te verbloem. Deur die ondersoek en analise van bestaande literatuur, internationale konvensies, wetgewing en hofuitsprake word 'n aantal perspektiewe op ontwikkelinge in die interpretasie en toepassing van die beginsel voorgelê. Hierdie perspektiewe lei tot die betekenisvolle en opbouende gevolgtrekking en insig dat die waarde van die konsep afhang van 'n korrekte benadering tot die beginsel en sy kenmerke. Die hoofkenmerk van die beste belange van die kind beginsel is die inherente vaagheid en ondefinieerbaarheid daarvan. Hoewel dit die beginsel aan ernstige kritiek onderwerp, ondersteun hierdie studie die argument dat die onbepaaldheid in der waarheid noodsaaklik is. Dit verseker nie alleen buigsaamhied, wat toepassing op alle tye in alle kulturele en sosiale omgewings en besondere omstandighede van 'n spesifieke geval moontlik maak nie, maar ook dat 'n holistiese benadering tot die kind as individue en die gesin as eenheid gevolg word. Obiettivo di questa ricerca è indagare il principio dell’interesse del minore, noto anche come best interests of the child. Il principio in esame è una clausola generale il cui contenuto è caratterizzato da un’estrema vaghezza tanto da essere stato definito dalla maggioranza della dottrina come una nozione “magica. La ricerca è divisa in tre parti: una prima parte teorica, una seconda parte di analisi della giurisprudenza sia italiana sia sovranazionale e un’ultima parte riguardante un’indagine empirica che ha coinvolto i giudici in servizio presso i Tribunali per i minorenni italiani. Il primo capitolo di questo lavoro è dedicato all’impianto teorico della tesi in cui si sono approfondite la normativa, il dibattito riguardante i diritti dei bambini, la categoria giuridica della minore età, l’istituto della responsabilità genitoriale, il giudizio di bilanciamento fra diritti e/o interessi e le sue ricadute di tale sul piano della certezza del diritto. Alla luce del quadro teorico approfondito, la prima ipotesi di ricerca vuole verificare se il principio dell’interesse del minore sia uno standard giudiziario da interpretarsi secondo il caso concreto distinguendosi dal concetto di diritti dei minori, oppure se invece sia, nell’interpretazione della giurisprudenza, una mera e retorica clausola di stile. La seconda ipotesi vuole verificare se lo strumento utilizzato dalla giurisprudenza per la determinazione dell’interesse del minore, nonostante le frequenti statuizioni del legislatore che ne afferma la “superiorità” o “preminenza”, sia quello del bilanciamento di diritti o interessi, in quanto nessun diritto da solo può essere assoluto o “tiranno”. Questa tesi intende rispondere alle domande di ricerca attraverso l’analisi delle interpretazioni della giurisprudenza in materia di best interests of the child Il secondo capitolo contiene un’analisi approfondita della giurisprudenza italiana divisa per aree tematiche. In questa parte della ricerca le aree tematiche sono fra loro molto eterogenee ma sono tutte accomunate dalla presenza, quale principio guida, dei best interests of the child. Nel terzo capitolo si è cercato di tracciare un quadro generale delle interpretazioni della Corte di Strasburgo e della Corte di giustizia dell’Unione Europea in relazione ai tratti salienti emersi dalla giurisprudenza italiana. Infine, il quarto capitolo dà conto di un’indagine empirica realizzata mediante un questionario online rivolto ai giudici in servizio presso i Tribunali per i minorenni somministrato tra il 12 marzo e il 12 aprile 2017.
The aim of the research is to investigate the principle of the best interests of the child. That principle is a general clause whose content is characterized by such an extreme vagueness that it was defined by the interpretation as a “magical” concept. The research is divided into three parts. The firts one is theoretical (Chapter 1), the second part is an analysis of both Italian and international law and the last part concerning an empirical investigation that involved Juvenile Court judges in Italy (Chapter 4). According to the analyzed theoretical context, the first hypothesis of research intends to verify if the principle of the best interests is a judiciary standard to be considered related to a real case and to be distinguished from the concept of rights of the child, or if it is instead a simple stylistic clause in the interpretation of the law. The second hypothesis tries to verify if the tool used by the law to determine the interests of the child is actually the balancing of his rights or interests or if the interests of the child, according to frequent statementes of the legislator, are to be considered superior and predominant. This work aims to answer the questions of the research through the analysis of the interpretations of law as regards the best interests of the child.

This mini-dissertation seeks to evaluate the best interests of the child as a separate factor that influences the sentencing of a primary caregiver. When a parent is in conflict with the law, the child stands to be affected sentence that the court may impose on the caregiver. A custodial sentence has the potential of affecting the child’s right to parental care. Therefore, in the event where a custodial sentence is appropriate, alternative care of the child by other persons become a possible option. The author recommends that after applying the principles articulated in S v M and making use of a child impact report; the right of the child to parental care should carry more weight. Thus, courts should duly consider the best interest of the child as an independent factor when negative effects to the child are associated with the sentence. Where appropriate, with either a non-custodial sentence or adequate alternative care (in the case of imprisonment).

Anthropological and demographic studies show that in sub-Sahara Africa a large proportion of non-orphaned children (up to 1/3 in many communities) live with neither parent but often with relatives for a significant part of their childhood. This practice is referred to as child fostering or fosterage. Child fostering is therefore understood in the literature as the transfer, and/or sharing, of parental responsibility of children and young people or simply the movement of children and young people between and within families. The practice is both an age-old and a modern phenomenon which has implications in the daily and future lives of those children involved including their nutrition, health, education, migration and ultimately their best interests. Depending on the context, culture, rationale and families involved in the fostering of a particular child the practice is carried out differently across geographies and sometimes within geographies as a result of which it deserves academic attention. The overarching aim of this study is therefore to explore the cultural conceptualisations and understandings of child fostering and the concept of the child's best interests among the Dagomba of northern Ghana. The study also examines the challenges of existing legislation and policies in Ghana regarding the practice. The study employed a qualitative research approach and involved children and young people, birth and foster parents and professionals who influence policies about children and young people in Ghana. In total, 42 respondents participated in individual interviews. I also used 'spider diagrams' as a supplementary research instrument for children and young people because I considered these child-friendly, fun and culturally appropriate for their ages (See Appendix IX). The emergent themes are explored and discussed in four findings chapters under part four of the thesis. The majority of respondents demonstrated extensive knowledge about child fostering and the concept of the child's best interests. Respondents' critical views and their recommendations for legislation and policy in Ghana are reflected on in the penultimate chapter. Finally, recommendations are made by way of contribution to theory, policy and practice. The research also suggests areas for future research by way of a reflection.

Syftet med vår studie var att att se vilka diskurser som finns kring barnperspektivet bland socionomer verksamma inom barn- och ungdomsenheter. Genom att identifiera diskurser kring detta begrepp var även målet att kunna bidra med ny kunskap kring hur barnperspektivet kommer till utryck och tolkas av utredarna. Vi har använt oss av kvalitativa enkäter med öppna frågor. Enkäterna delades ut till socionomer verksamma inom barn- och ungdomsenheter i åtta kommuner i Sverige. Resultatet har sedan tagits fram med hjälp av diskursanalys. Den valda analysmetoden bygger på Laclau och Mouffes diskursteori. Vi har sedan vidare analyserat vårt resultat utifrån teorier om makt samt med hjälp av tidigare forskning. Vi har utifrån vårt material identifierat tre stycken nodalpunkter, kring vilka diskursen centreras. Detta har vi kunnat göra genom att vi samlat alla utsagor, brutit ner dessa och hittat gemensamma nämnare som i sin tur hjälpt oss att identifiera nodalpunkterna. De funna nodalpunkterna är barnet i fokus, barns perspektiv samt vuxnas ansvar för barns bästa. Nodalpunkterna visar tydligt på vad som anses vara viktigt och därmed hur utredarna talar kring barnperspektivet och dess innehåll. Vi har även sett att utredarna skiljer på begreppen barns bästa respektive barns vilja och att barns vilja ses som en del av barns bästa. De funna nodalpunkterna kan även säga något om både utredarnas syn samt arbete med barns bästa och barns vilja.

Tačiau čia nėra išskiriamos vaikų, kaip specifinės socialinės grupės, reikalingos didesnės apsaugos, teisės. The 1950's Convention of European Council on Human Rights and Fundamental Freedoms establishes a set of rights and fundamental freedoms (the right to life, prohibition of torture, the right to a fair trial, the right to respect for private and family life etc.) applicable to everyone within the jurisdiction of the state that ratified the Convention. Children are a very specific social group, which needs greater protection. However their rights are not distinguished in the Convention. On the basis that the rights enshrined in the ECHR are applicable to „everyone“, it may be maintained that those rights can be applicable to children as well. The author of this work aims to reveal the rights that are guaranteed for children in the context of the article 8 of the ECHR. To this end, particular attention is paid to the jurisprudence of the ECtHR. According to the case law of this Court, it can not only be determined the contents and evolution of specific rights, but also relevant problematic issues for the protection of the rights of a child can be revealed. The purpose of this study was to examine how a selection of social welfare officers based on the principle of the best interest of the child construct a minimum level of the material standard in a home. Another purpose was to examine whether different units with varying socioeconomic prerequisites in the municipality of Stockholm construct this level differently.

The method used in this study was Sociology of Law and two focus groups were used for the gathering of the data. A social constructive theory, a class perspective using concepts of Bourdieu and a perspective of law were used to analyse the material of data.

The results showed that the courses of action varied from enactment and the policies of the municipality of Stockholm, unspecified theories of the development of children, the conception of what is normal and what children needs, the context in which they work, the development of the society and what they estimate that children needs when attending school. The results also showed a difference between the two units concerning the minimum level of the material standard in a home

The Child Act 2001 (Act 611) was Malaysia's response to incorporate the principles of the Convention on the Rights of the Child (CRC) into Malaysian law. The CRC, like all international human rights instruments, is a rights based convention providing for child rights. This thesis is a study of whether the current standards on the best interests of the child principle is sufficiently applied in Malaysia in order to fulfil her obligations under the CRC. In order to answer this question, a deeper understanding of Malaysia's unique socio-legal complexities and background is needed so as to be able to analyse how far Malaysia has fulfilled her obligations. The research utilises a doctrinal and black-letter law approach since the data for analysis were documents and articles on the CRC, the Children Act 1989 and the Child Act 2001. The research methodology chosen is a comparative study England and Malaysia because of the strong historical and legal relationships. The research will use the literature available which is voluminous in England and try to understand the principle as applied in England. This thesis will compare the principle applied in England with that applied in Malaysia. This would include the English and Malaysian civil law (under the relevant Acts), the international law (CRC) and the Islamic Law (Shari`ah). The research will also analyse the principle as applied in England and how it compares to the CRC. This thesis will also show that the best interests of the child principle as envisioned under the CRC is closer to the Shari'ah approach and Malaysia should utilise it as a means to move forward and apply the best interests of the child principle as required under the CRC. Once the application has been done, Malaysia will be able to fulfil her obligations fully under the CRC.

Within the Brazilian strategy to reform out-of-home care services, efforts have been directed to the prioritization of foster care over congregate care. This study draws from the perspective that childhood is socially construed, therefore child protection systems are dependent of notions and ideals of childhood, especially concerning the child deprived of parental care. Interviews with ten professionals involved in the implementation and execution of foster care services in different cities were conducted for this study. Thematic analysis of interviews was triangulated with the contents of National Guidelines for out-of-home care services and legal provisions with the aim of investigating how ideas on children deprived of parental care and their best interests are translated into practice. Three research questions guided the study: (1) how participants perceive the out-of-home care reform and the provisions of rights in different care modalities, especially regarding how children placed in different types of out-of-home care are perceived, (2) how participants view children’s best interests and which practices are believed to secure them and (3) how practitioners’ views relate to the contents of the National Guidelines. Five themes emerged in the analysis: a scientific and legal defense of (1) foster care as the most up to date form of out-of-home care, the prioritization of (2) children’s needs for individualized parental care, that (3) practitioners’ strong discretion is conditioned by foster families’ choices, that (4) institutionalization and group are detrimental to children, and the invocation that (5) children must be onboard. The study concludes that a clearer conceptualization of the rights and bests interests of children deprived of parental is required to better inform the reform of child protection and its practices, where consideration to children’s participation could be extended over acceptance to decisions.

Family reunification for unaccompanied refugee minors is one of the most debatable issues when it comes to deciding whether it should be viewed as a right or it can be justifiable for states to completely prevent it and rather provide it only as a privilege. The discussion in the legal sphere proved that the issue is still problematic in both international and European laws. In this thesis, I have analyzed this issue through assessing the three claims that were provided by the United Kingdom for its negative position on the case. Through the lens of the child’s best interests’ principle, the non-discrimination principle, and the global distributive justice theory, I argued for considering family reunification as a right rather than a privilege. Children should always be treated as children. It cannot be justifiable for states to completely prevent them from being reunited with their families for being refugees.

A great proportion of this epidemic is now found in low- and middle-income countries with higher levels of prevalence, particularly in emerging economies. In sub-Saharan Africa, South Africa ranks high in the prevalence of obesity at all levels. Since the inception of democracy in 1994, the government is yet to overcome the burden of poverty and inequality routed in its apartheid past. Apartheid systematically and unjustly disintegrated and segregated black Africans and people of Colour, denying them access to economic opportunity, thus leaving them on a dependency status. Khayelitsha and Mitchells Plain are the relics of apartheid policies. Obesity and associated diseases are highly correlated with gender dynamics, economic conditions, nutritional status, poverty, and urbanisation. It is increasingly evident that poor urban dwellers, especially women and children are at risk of obesity-related factors such as diabetes, hypertension, and heart diseases. The increasing incidence of obesity especially amongst children is concerning. The prevalence of child poverty is in South Africa is a cause for concern. Over 18.5million children are in South Africa, 64% of which are dependent on CSG. With poverty and inequality affecting millions of households, access to food and quality food has reached crises level. Yet, it is a basic human right that has received little empirical response amongst policymaker in South Africa. The South African food system is complex, poverty is endemic and poor households are most vulnerable to unhealthy eating habits. This research critically analysis the link between food choices, overweight and obesity in adults and children living in urban peripheral communities in Cape Town. The study was designed to interrogate the kinds of food eaten by urban peripheral dwellers, their socioeconomic status and how the policy of the BIC addresses the problem of child obesity in South Africa.

This research aimed to empirically explore the relationship between BMI and food choices of adults and children living in urban peripheries in Cape Town. The study also aimed at evaluating the BIC in urban townships in Cape Town in the context of child obesity, to understand the views of the children and to understand how poor households are ensuring the BIC in relation food access, food availability and child protection from obesity. The study further aimed at comparing the and contrasting the socioeconomic dynamics of the two population to understand the progress and gaps in their economic and health status. Empirical data were collected from households in Khayelitsha and Mitchells Plain using a two-stage sampling technic to identify clusters and households. A sample of about 4300 individuals in 1052 households was sampled. A 24H dietary recall was used to capture food types of the population. The World Health Organisation guidelines for BMI adults and children were applied through the study. A BIC Index was developed to assess the right to food from the views of the child. First, the study found significant differences in the socioeconomic and demographic profiles of the population. Poverty and the risk of falling into poverty were higher in Khayelitsha than in Mitchells Plain. Two-third of the population (65%) of adults we found to be overweight and obese. Overweight and obesity amongst children was 29% and 68% of children reported that they buy food at school or on their way to school. Over 83% children stated that their parents give them money to take to school. There was a significant association between children buying food and parents giving money at X2 91.4643, P<= 0.000. Carbohydrate represents 40% and sugar 35% of food types children eat away from home. In terms of the BIC, 43% of the children

I denna uppsats undersöks begreppet ”barnets bästa” med utgångspunkten att granska vilka olika föreställningar som finns och har funnits kring vad detta innebär. Detta begrepp är inte nytt för vår tid, men det har debatterats mer efter tillkomsten av Förenta Nationernas konvention om barnets rättigheter som antogs 1989. Barnets bästa är dock en social konstruktion och innebörden av begreppet förändras därför ständigt.

Metoden som ligger till grund för denna uppsats är dels en genomgång av litteratur och dels en textanalys av två historiska källmaterial bestående av en proposition från 1924, prop. 1924:150, och en av statens offentliga utredningar från 1997, SOU 1997:116. Genom denna textanalys framkommer både likheter och skillnader mellan samhällets syn på barnets bästa.

Det kan konstateras att föreställningarna kring vad barnets bästa innebär har förändrats sedan början av 1900-talet. Utvecklingen av barnets bästa hänger samman med en mängd faktorer såsom synen på barn, rådande kultur, normer, värderingar, kunskap, ekonomi, politiska idéer, reformer och genusföreställningar. Slutsatsen är att vuxna såg till barnets bästa även i början av 1900-talet, men att begreppet då hade en annan innebörd. Därmed kan det konstateras att barnets bästa har varit, är och förblir ett begrepp i förändring.


In this paper the conception “the best interest of the child” examines with the starting-point to study which different ideas that exists and have existed about what this means. This conception is not new for today, but it has been debated more frequently after the creation of the United Nations Children’s Convention which was accepted in 1989. However, the best interest of the child is a social construction and therefore the meaning of the conception changes constantly.

The method that lays the foundation of this paper is partly an exposition of literature and also a text analysis of two historical sources consisting of a government bill from 1924, prop. 1924:150, and one of the States official reports from 1997, SOU 1997:116. Through this text analysis emerges both similarities and differences between the society’s views on the best interest of the child.

The statement is that the conceptions of what the best interest of the child mean have changed since the beginning of the twentieth century. The development of the best interest of the child is connected to many factors such as the view of the child, existing culture, norms, values, knowledge, economy, political ideas, reforms and gender conceptions. The conclusion is that grown-ups tried to fulfil what was best for the children even in the beginning of the twentieth century, but the conception had a different meaning at the time. Therefore the conclusion is that the best interest of the child has been, is and will be a conception in change.

Sverige ratificerade FN: s konvention om barnets rättigheter i juni 1990 och blev därmed bundet att respektera principerna och bestämmelserna i konventionen. I december 2010 godkände riksdagen den av regeringen föreslagna strategi som ska stärka barnets rättigheter i Sverige och som därmed ersätter den strategi som gällt sedan 1999. Strategin innehåller ett antal principer som bland annat syftar till att ett barnperspektiv ska införlivas i alla beslut och åtgärder som rör barn. Att ha ett barnperspektiv i sin yrkesutövning innebär bland annat att ha barnet i fokus samt att ta reda på hur barnet uppfattar sin situation. Därtill handlar det även om att göra barnkonsekvensanalyser vid beslut som rör barn. I strategin omnämns förutom kommuner och landsting också riksdag, regering och statliga myndigheter som viktiga för genomförandet av konventionen. Socialtjänsten är dessutom den myndighet som ytterst ska bevaka barnets rättigheter genom att utifrån lagstiftning agera till ett barns skydd. Tidigare forskning visar att risken för social och ekonomisk marginalisering ökar avsevärt när människor vräks och att det inte tas någon särskild hänsyn till barn vid vräkningar, vidare talas det inte alls om de barn som riskerar att vara med om att deras hem säljs vid en exekutiv auktion. En vräkning påverkar barnets hela livssituation och kan innebära att barnet måste bryta upp från sitt liv så som det känner det. Innan en vräkning verkställs föreligger en vräkningsprocess där flera aktörer är inblandade, vilka enligt ovan nämnda resonemang är ålagda att ha ett barnperspektiv i sitt yrkesutövande. Vi anser därför att det är viktigt att öka kunskap om hur dessa myndigheter har implementerat barnperspektivet i sitt arbete med vräkningshotade barnfamiljer. Vårt resultat visar att implementeringen av ett barnperspektiv inom socialtjänst, hyresnämnd och kronofogdemyndighet gällande vräkningshotade barnfamiljer av olika anledningar inte har fungerat, något som kan finna sin förklaring i de lagar och riktlinjer som dessa myndigheter främst har att förhålla sig till. Något som också försvårar praktiken är begreppets komplexa och ibland svårtydda innebörd. Vidare pekar resultatet också på att det finns motstridiga intressen gällande vems intressen man främst ska företräda.

Barnets bästa beskrivs av forskare som ett svårdefinierat begrepp. Trots detta är begreppet lagstadgat och ska vara avgörande för alla beslut kring vårdnad, boende och umgänge. Syftet med studien har varit att undersöka Gävle tingsrätts diskussion av barnets bästa i vårdnads-, boende- och umgängesdomar under åren 1992, 2002 och 2012 samt om det skett någon förändring över tid. En form av textanalys användes för att analysera empirin som sedan studerades med socialkonstruktionistisk och rättssociologisk teori. Det mest framträdande resultatet var att tingsrättens diskussion kring barnets bästa oftast skett indirekt, där ingen direkt motivering har gjorts huruvida en viss situation är till barnets bästa eller inte. Emellertid har direkta referenser till begreppet barnets bästa ökat, främst i domarna från år 2012. Resultatet kan antas härröra ur de reformer som gjorts i föräldrabalken år 2006. En annan viktig slutsats vi kommit fram till rör hur barnets bästa alltid verkar vara situationsbundet.
The child's best interest is described by researchers as elusive. Despite this, the concept is statutory and should be essential to decisions regarding custody, residence and contact. The purpose of this study was to inquire Gävle district court's discussion of the child's best interest in custody, residence and contact judgments in 1992, 2002 and 2012, and to study whether the arguing changed over time. Text analysis was applied to analyze data which then was studied by perspectives of socialconstructionism and sociology of law. A prominent result was that the district court's discussion of the child’s best interest is usually made indirectly. However, direct references to the concept of the child’s best interest increased, mainly in the judgments from 2012. This result might derive from the reforms made in the Swedish Parental Code in 2006. Another important conclusion we have come to concern is that the child’s best interest seem to be inconstant.

The views of minority groups who speak on behalf of adopted children in Western countries like Sweden have relevance with regards to enriching the international adoption discourse; and to inform adoption policies in both sending and receiving countries. This study aimed at seeking the views of African immigrants in Sweden on intercountry adoption with the objective of bringing out the meanings they create on the major themes involved to enrich the international adoption debate and to inform policy formation. In all, twenty (20) participants who were grouped into Six (6) focus groups participated. There were mixed opinions on various themes involved. Some of their perspectives were consistent with previous political discourses on adoptions and others were not. These were discussed in the analysis accordingly. Contrary to international conventions, participants showed much relevance to intercountry adoption as against incountry adoption. However, there were predominant views in support of child adoption that is well regulated.

This thesis explores the constitutional right to receive basic education in the language of choice. This fundamental human right imposes a duty on the state to provide children with education in the language of their choice whenever reasonably practicable. It is not a matter of whether the state has to fulfil section 29(2) of the Constitution, but rather how to give effect to this provision. The right to receive basic education in the language of your choice is however, qualified by the specific internal limitation that provides that the right is subject to the condition that provision of education in the preferred language has to be reasonably practicable. Section 36, the limitation clause, is also a measure that can be used to limit this right. The aim of this paper is to contextually interpret the fundamental right to receive education in the language of one’s choice and to weigh up the intent of the provision to the provision’s actual result. All relevant factors will be taken into consideration to examine the possibility of limiting the right to receive instruction in the language of choice to comply with the purpose of education and the best interests of the child.

Syftet med studien var att undersöka utredande socialsekreterares förståelse av och förhållningssätt till principen om barnets bästa. Tidigare forskning visar på att barnets bästa som begrepp är svårdefinierat, att hög arbetsbelastning och tidsbrist kan påverka bedömningar om barnets bästa och att tillit samt en förtroendefull relation mellan socialsekreteraren och barnet kan främja delaktigheten. Resultatet analyserades utifrån Bronfenbrenners utvecklingsekologiska teori och handlingsutrymme som teoretiskt begrepp. Studien har använt sig av en kvalitativ metod bestående av sex semistrukturerade intervjuer. Det empiriska materialet analyserades med hjälp av en tematisk analys för att finna teman. Socialsekreterarna upplever sig ha ett stort handlingsutrymme för att göra egna bedömningar om barnet bästa. Trots att resultatet visade att begreppet var svårt att definiera var socialsekreterarna relativt eniga om hur de förstår barnets bästa och vad de väger in i bedömningen. Resultatet visade även att socialsekreterarna för det mesta hinner träffa barnen vid endast ett tillfälle under utredningsprocessen på grund av hög arbetsbelastning och brist på tid. Verksamhetens ekonomiska förutsättningar visade sig även ha en inverkan på socialsekreterarnas handlingsutrymme när det gäller att bedöma barnets bästa.
The aim of this study was to examine investigative social workers understanding of and approach to the principle of the best interests of the child. Previous research shows that it’s difficult to define the best interests of the child. Research also shows that a high workload and lack of time can affect assessments of the child’s best interests, and that a trusting relationship between the social worker and the child can promote participation. The theoretical background is based on Bronfenbrenner’s developmental ecology theory and room for maneuver as a theoretical concept. A qualitative method has been used and the empirical material was analyzed using a thematic analysis. Social workers feel that they have a large margin of maneuver to make assessments. Although the result showed that the concept was difficult to define, the social workers had a similar understanding on how they understood the concept and what they take in consideration in the assessment. However, the social workers have for the most part only time to meet the children at one point during the investigation process. Financial conditions also turned out to have an impact on their room for maneuver when it comes to assessing the child’s best interests.

Studien har syftat till att undersöka hur socialtjänsten hanterar ärenden rörande barnäktenskap. Detta har uppnåtts genom att studera Socialstyrelsens riktlinjer, metodstöd från utvalda kommuner samt genom att utföra intervjuer med yrkesverksamma inom socialtjänsten som handlägger ärenden som rör barnäktenskap. Den insamlade empirin har analyserats utifrån de teoretiska perspektiven barnets bästa och feministiskt perspektiv. Resultatet av studien visar att de studerade kommunerna enbart har metodstöd för hedersrelaterat våld, men inga upprättade rutiner eller metodstöd för ärenden gällande barnäktenskap. Återkommande är att socialtjänsten saknar struktur och verktyg i hur man bemöter barn som är utsatta för risker förknippade med barnäktenskap. För att barnen ska få det stöd och skydd som de har rätt till behöver socialtjänsten ha specifik kunskap om vad hedersrelaterat våld och barnäktenskap innebär.
The purpose of this study was to examine how the social services are handling cases concerning child marriages. This has been achieved by studying the guidelines of The National Board of Health and Welfare, guidelines formed by selected municipalities and by conducting interviews with professionals who handle cases concerning child marriage. The collected data has been analyzed from the theoretical perspectives: the best interest of the child and a feminist perspective. The results of the study show that the chosen municipalities only have guidelines for honour-related violence, but no established guidelines or routines for cases concerning child marriage. Recurring is that the social services lack structure and tools on how to deal with children who are exposed to risks associated with child marriage. In order for children to receive the support and protection to which they are entitled, the social services need to have specific knowledge of what honour-related violence and child marriage mean.

L'intérêt supérieur de l'enfant est un principe international proclamé à l'article 3-1 de la Convention internationale des droits de l'enfant. L'exercice de l'autorité parentale est dominé par la prise en compte de ce principe.La notion d'intérêt supérieur de l'enfant présente une unité à l'échelle européenne. Contribuent à la préciser des éléments de contenu éclairés par la mise en évidence d'une grille de lecture dégagée à partir de l'analyse de la jurisprudence interne et européenne. En outre, les arrêts de la Cour européenne des droits de l'homme fondent l'émergence d'éléments de caractérisation permanents mais non cumulatifs et parfois s'excluant : le maintien de relations personnelles entre l'enfant et ses père et mère d'une part ; un environnement sain autour de l'enfant, d'autre part. La notion d'intérêt supérieur de l'enfant révèle son autonomie par l'existence de moyens d'appréciation, modalités et modes propres. Cette autonomie se trouve étroitement liée à l'impact qu'offre à la notion sa réception dans les différentes législations européennes. Cette large consécration se trouve confortée par le développement d'un contrôle de conventionnalité révélateur de la véritable nature de l'intérêt supérieur de l'enfant. L'intérêt supérieur de l'enfant constitue désormais une notion clef dans le domaine de l'exercice de l'autorité parentale. Il fonde un nouvel ordre public protecteur de l'enfant à l'échelle européenne. Sa primauté s'impose corrélativement de plus en plus nettement. Surgissent toutefois des conflits entre cet intérêt supérieur et d'autres intérêts ou principes concurrents. In fine, l'unité et l'autonomie de l'intérêt supérieur de l'enfant, désormais notion de droit, devraient asseoir une effective protection de l'enfant en Europe
The child's highest interest is an international principle that has been announced in the 3-1 article of the International Bureau for Children's' Rights. This principle dominates the exercise of the parental authority.The notion of the child's highest interest is seen as a unit at the European scale. It can be clarified thanks to a key to read that has been highlighted from the French and European jurisprudence and which contains some content elements. Besides the appearance of characterization's elements is based on the Human Rights European Court's judgements. Those elements are permanent, non-cumulative and sometimes they can become mutually exclusive such as the maintenance of individual relations between the child and his parents or a healthy environment around the child. The notion of the child's highest interest is autonomous by judgment resources, modes and own methods. This autonomy is slightly linked to the notion's impact in the different European legislations. This large recognition is strengthened by the increase of a conventionality review that reveals the real nature of the child's highest interest. The child's highest interest is from now on part of a key notion in the area of the parental authority's exercise. It creates a new public order that protects the child at the European scale. Its primacy establishes itself more and more clearly. However, some conflicts between the highest interest and other concerted interests and principles suddenly appear. Ultimately, the unit and autonomy of the child's highest interest, which is from now on a law notion, should base an effective protection of the child in Europe

Abstract:
The aim of this study was to examine the District Court´s argumentations about the children´s best interests in rulings regarding custody of children, and to analyse the argumentation from a gender perspective. Rulings from the District Court from 2012 have been the basis for this study and a qualitative method has been used, argumentations analysis. The study shows that cooperative problems between the parents are the main reason why the District Court finds joint custody to be excluded. There are also argumentation regarding parent´s ability to ensure the children’s safety. The presumption of joint custody is known to be emphatic in Swedish law and in those cases the District Court finds it in the best interest of the child for the joint custody to remain, the parents still have problems cooperating but not sufficiently to repeal the importance of both parents in the child´s life. In the rulings leading up to both joint and sole custody conceptions of female and male attributes can be found, and differences regarding what´s considered good and bad attributes. The study shows differences in how we expect women and men to be parents. Conceptions of class- and ethnicity however, are rarer. The analysis also shows views of parenthood as being gender complementary, where the father´s presence is seen as a complement to the mother´s main caring responsibility. Finally, the study shows a guiding from the District Court to the fathers about getting them more involved in their children´s life, and of the importance of the Social Services Custody Report regarding the verdict.

This study in comparative public law analyses if the courts have decided in the best interest of the child when judging for immediate care due to domestic violence. Both Sweden and Norway have transformed the United Nations Convention on the Rights of the Child (CRC) article 3 in parts of their national legislation. The difference between the countries is that Norway in 2003 incorporated CRC as a part of their legal policy, Sweden, on the other hand, has not integrated CRC in their national laws. There is a need for research if and how the local authorities and the courts in the two countries live up to the concept for the best interest of the child. Six court decisions from both countries as well as the development of the national legislation will be analyzed. To achieve our purpose, we will use the comparative and dogmatic legal method. The comparative method will be used when we compare the similarities and differences between their national legal system and the court's judgment for immediate care for the best interest of the child. The dogmatic legal method will be used for defining the current law. The results of this study indicate that Norway has more appropriate laws for the best interest of the child. The difference between the countries is that in Norway the court can decide based on their child specific law. While the courts in Sweden only can decide for the best interest of the child with the interpretation based on the two laws but the code is not just for the child. Despite the differences, both Sweden and Norway have appropriate laws for how the local authorities and the court should promote the best interest of the child. In the future, we hope that it would be easier for the Swedish courts to apply the best interest of the child when CRC has been incorporated into the national legislation.

Abstract:
The purpose of this study was to investigate how family law secretaries in Sweden works with fulfilling the best interests of the child in collaboration talks and how they get children involved in the process. I have performed five semi-constructed interviews with family law secretaries from different municipalities. In order to achieve broader answers to my questions I have chosen to use a qualitative method. This method was also chosen to enable the possibility of follow-up questions. I gathered data from previous research in this area by searching after these keywords; child’s best, collaboration talk, custody, family law, children’s participation in investigations. The collected data was then analyzed with three different theories; Michael Lipsky’s theory about grass root bureaucrats, Svensson, Johansson & Laanemets’ theory about the social worker role and Roger Hart’s participation model.  The participants that were interviewed all stated that it was difficult to fulfill the child’s best as it is an open concept that can be interpreted differently depending on the secretary’s individual knowledge and scope. Among the participants there were some of them that had deeper knowledge concerning the principle of the child’s best. This knowledge had been achieved through further education which ensures higher certainty that the child’s best has been fulfilled, but also raises awareness on when participation of the child in collaboration talk is possible. For those secretaries that are lacking this deeper knowledge in this principle agree that there are difficulties to ensure that the child’s best has been fulfilled. Because of the difference in knowledge there were variances in deciding when it was possible for a child to participate in the collaboration talk. Some of the secretaries thought that it was important to get the children involved in collaboration talks, but some thought that collaboration talks were not a platform for small children to participate in. This means that children are encountered in different ways depending on which family law secretary they meet and in what municipality the collaboration talk is held in.

Delegationsordningen påverkar socialsekreterares handlingsutrymme att leva upp till barnets bästa. Socialsekreterare styrs dagligen i sitt yrkesutövande av politiska beslut som utgörs av lagstiftning. Det politiska landskapet avser att bidra till en demokratisk process med avsikt att leda till likabehandling och rättssäkerhet för att stärka legitimiteten inom välfärden. Samtidigt är individer i behov av individuella lösningar och behovsanpassade insatser, något som lämnar socialsekreterare med ett handlingsutrymme att agera efter egen yrkesprofessionalism i försök att leva upp till barnets bästa. Socialsekreterare lever i ett mellanting mellan dessa två världar där organisationsprofessionalism och yrkesprofessionalism möts. Studiens resultat visar på svårigheter att definiera barnets bästa vilket medför en prövning av socialsekreterarens handlingsutrymme och flexibilitet i varje enskilt fall. Dessutom framgår det av det empiriska materialet att tillit utgör grundval för att handlingsutrymme ska bli önskvärt hos socialsekreterare. På barn- och utredningsenheten där studien utfördes upplever socialsekreterare generellt att de har tillit från ledningen på arbetsplatsen. Däremot framkommer det att delegationsordningen upplevs som ett ekonomiskt styrmedel för att reglera de offentliga utgifterna. Slutligen visar resultatet att socialsekreterare är oense om vem som ska vara yttersta beslutsfattare och efterfrågar expertkunskap i socialnämnden där de tyngsta besluten fattas.
The delegation of authority affects social workers discretion to live up to the best interests of the child. Social workers are affected daily by political decisions. The political landscape contribute to a democratic process with the intention of leading to equal treatment and the rule of law. At the same time, individuals are in need of individual solutions and needsadapted efforts, which leaves the social worker with the discretion to use occupational professionalism in an attempt to live up to the child's best of interests. Social workers act in between two worlds where organisational professionalism and occupational professionalism meet. The results of the study show difficulties in defining the best interests of the child, which challenges the social workers discretion in each single case. Trust is the foundation for making discretion desirable amongst social workers. At the child welfare unit, social workers feel that they have trust from their management. On the other hand, the delegation of authority is perceived as an economic instrument for regulating public expenditure. Finally, the results shows that the social workers disagrees on who should be the ultimate decisionmaker and demand expertise among the politicians in the social committee where the toughest decisions are made.

The child perspective is a complex area primarily because of its many ways of interpretation but also because children are considered to be less competent than adults. Our hypothesis was that adults in court-proceedings make decisions in the child’s place. The aim of this study was to investigate the judicial meaning of the child perspective in “Socialtjänstlagen” (SoL) and “lag om särskilda bestämmelser om vård av unga” (LVU). The purpose was also to explore how the child perspective was presented in rulings from the Public Court according to LVU 3§, in the prerequisite “annat socialt nedbrytande beteende”. The choice of method was based on our main purpose and therefore the legal dogmatic and the qualitative methods were applied. The child perspective in Swedish legislation emphasizes the child’s best interest and the child’s right to be heard. There have been problems recognizing children’s legitimate interests which are one of the reasons why adults are considered to protect those interests by speaking for the child although they may have different interests. The result was that the child’s voice was inadequately asserted in legal processes which indicated that the child perspective wasn’t used as intended according to the law and government bill.

Section 28(2) of the South African Constitution determines that every child has the right to have their best interests considered of paramount importance in all matters concerning them. Section 9 further provides that every person is considered equal before the law and has the right to equal protection and benefit of the law. Several grounds are listed relating to the unfair discrimination of persons, including their sexual orientation. The concept of care is incorporated in the Children's Act, and it entails a comprehensive description of parents' daily life regarding their children and the powers and duties expected to ensure the general protection, well–being and best interests of the child. The study aims to research the legal position when the sexual orientation of a parent is a considering factor in the granting of care, and the extent of which courts can give consideration to that factor. I commence by examining relevant national legislation relating to the concept of care and the best interests of the child standard in the Children's Act to establish how the sexual orientation of a parent is interpreted by courts in the granting of care. I then proceed to examine relevant international and regional documents to determine the relevant rights relating to the interests of children in the granting of care to a parent in divorce proceedings. I then proceed to analyse landmark cases to establish ways in which the approach of the courts regarding homosexuality have changed since the beginning of the new political dispensation in 1994. Finally a conclusion will be reached on the nature and scope of the consideration of a parent's sexual orientation in the granting of care in the South African context.

Esta pesquisa objetivou estudar o princípio do melhor interesse da criança tanto em seu viés teórico quanto prático, na tentativa de se concluir se é possível ou não adotar-se critérios predeterminados para serem seguidos na tomada de decisões em questões envolvendo crianças e adolescentes. Na primeira parte, teórica, estudou-se o conteúdo do melhor interesse, e se poderia ele ser entendido como regra de interpretação, direito fundamental ou princípio. Já a segunda parte, prática, buscou analisar como os tribunais vêm decidindo algumas questões que resvalam no melhor interesse. Para tal, alguns institutos foram selecionados (guarda, adoção, parto anônimo, visitas e educação). A análise da guarda passou pela sua diferenciação entre colocação em família substituta e atribuição a um dos pais em caso de separação. Discutiu-se a possibilidade de atribuição a terceira pessoa e de imposição da modalidade compartilhada. Estudou-se o direito de visitas para o caso de a guarda ter sido atribuída a somente um dos pais. Estendeu-se a pesquisa para a hipótese de garantir-se esse direito a amigos, padrastos, madrastas e padrinhos. A adoção foi estudada nas modalidades à brasileira, intuitu personae e internacional. Ainda, analisou-se a possibilidade de adoção por casal homoafetivo. Embora inexistente no direito brasileiro, o parto anônimo foi analisado para se observar se viável e necessário em nosso ordenamento. Por fim, estudou-se o direito à educação, realçando-se alguns aspectos como a possibilidade de o ensino ser realizado fora de estabelecimentos oficiais, transporte de crianças até suas escolas e a possibilidade de exigirem-se vagas em creches.
This research aimed to study the principle of the best interest of the child, both in theory and in practice, in an attempt to conclude whether it is possible or not to adopt predetermined criteria to be followed in making decisions on issues involving children and adolescents. In the first part, theoretical, the content of the best interest was studied, as well as the possibility of understanding it as a rule of interpretation, fundamental right or principle. The second part, practical, sought to analyze how the courts have been deciding issues involving the best interest. In doing so, some institutes were selected (guardianship, adoption, anonymous childbirth, visits and education). The analysis of the guardianship passed by differentiating between placement in foster family and its assignment to one of the parents in case of separation. The possibility of assigning it to a third person and the imposition of shared custody were discussed. The visitation rights in case when the custody has been awarded to only one parent was studied. The research was extended to the hypothesis of granting this right to friends, stepfathers, stepmothers and godfathers or godmothers. The research studied Brazilian, intuitu personae and international adoptions, as well as the possibility of adoption by homosexual couples. Although non-existing under Brazilian law, the anonymous childbirth was analyzed to observe if it is viable and needed in our system. Finally, the right of education was studied, and aspects such as the possibility of homeschooling, transportation of children to their schools and the requiring of vacancies in childcare facilities were highlighted.

Abstract:

The aim of the study was to examine how child investigators in the police force interpret and apply the notification of preliminary investigation (FuK) and the po-lice act in their child investigative interviews with alleged victims of sexual abuse. Questions at issue were how child investigators relate to FuK 17-19 §§, re-garding child investigative interviews and to FuK 16 § and the police act 3 §, re-garding their co-operation with social services. The theory and method used in this study was Sociology of Law. Qualitative interviews were conducted with eight child investigators, one from each police district in Stockholm. The results of the study conclude that despite special qualifications, child investigators may find themselves in difficulty in receiving or interpreting information from chil-dren, therefore they may need to consult a person with expert knowledge. Fur-thermore the results conclude that all of the child investigators with no exception inform the social services when a report to the police is received. Moreover, the results show that child investigators in general are aware of the legislation and re-late in compliance with it. In conclusion, children are given special treatment in relation to adults, in order to place children on equality with them.

Vi har gjort en kritisk diskursanalys av AC:s (Adoptionscentrum) medlemstidning under perioderna; 1975-1985, 1986-1996, 1997-2006. Frågeställningen lyder: Hur konstitueras diskursen om ”det goda adoptivföräldraskapet” genom AC:s medlemstidning? Vilka är möjlighetsvillkoren och vilka konsekvenser innebär diskursen? Vårt syfte har varit att förstå diskursen om ”det goda adoptivföräldraskapet”. Vi har utgått ifrån socialkonstruktioniskt, poststrukturalistiskt perspektiv och språkfilosofi.

Vårt huvudsakliga resultat har visat sig vara att AC konstituerar diskurser som producerar och reproducerar ett antal normativa föreställningar om föräldraskap, familj och individer som bygger på socialt konstruerade föreställningar om vad som är en ”riktig” familj, bra föräldraegenskaper och barnets bästa. Diskursen ”det goda adoptivföräldraskapet” uppnås genom aktivt medlemskap i adoptionsorganisationen AC. Begreppet ”barnets bästa” har visat sig vara en flytande signifikant för att konstituera olika diskurser som alla handlar om att etablera eller upprätthålla AC som organisation. Genom barnets bästa har AC fått möjlighet att legitimera sina egna verksamhetsområden, styra över vem som är lämplig förälder, vem som får bilda familj och vika barn som är tillgängliga för adoption. Ytterligare resultat har visat på att AC under perioden fått ökad makt genom att förmedlingen av adoptivbarn har övergått till adoptivorganisationerna. Således har statens makt och inflytande fördelats över ytterligare en instans.


Abstract

This essay is a critical discourse analysis on AC’s (Adoption Centre Organisation, Sweden) magazine for members during three periods; 1975-1985, 1986-1996, 1997-2006. Our main question is how discursive statements are made on “the good adoptive parenthood” in this magazine? What possible changeable meanings and truths are given by the discourses? Our aim is to understand the discourse “the good adoptive parenthood”. The theoretical framework consists of knowledge of social constructivism, post structural perspective and philosophy of language.

Our main results are that AC constitutes discourses that produce and reproduce a number of assumptions about parenthood, family and individuals as normative and influenced by social constructed assumptions about what is; a “real” family, a good parenthood or “the child’s best interest”. The discourse of “the good adoptive parenthood” is gained through membership in the adoption organisation AC. The claim of “the child’s best interest” has in this essay being found as a fluent significant to constitute a variety of discourses, which all aim to establish and maintain the organisation. Through the principle of “the child’s best interest”, AC has found a way to legitimate their own fields, to decide who is a suitable parent, who shall form a family, and which child will be available for adoption. Further result shows that AC during the studied period has gained increased legal and governmental power in the field of adoption. As a result, the governmental power and influence in the adoption field has been divided through additional authorities.

The aim of the study was to examine collaboration and professional perspectives on the best interest of the child in regards to working with unaccompanied asylum seeking children. Firstly, our result show that counselling is available for the unaccompanied children from case workers, staff, school counsellors and emergency psychiatric care. All of the participants in this study describe the need for long-term counselling for unaccompanied children, however, providing the long-term counselling is not the primary purpose of the organisations in question. Therefore an additional service-provider working with counselling is a necessity. Secondly, the study explores the participants’ professional perspectives on the best interest of the child. The participating professionals work with the best interest of the child in accordance with their level of education and professional role. At the same time, they stress the fact that time, resources and other factors have an influence on their ability to keep the best interest of the child in focus. Finally, the study addresses collaboration between the service providing organisations. Collaboration does exist, but the participants wish for a development and transparency in the collaboration in order to clarify the responsibilities of each organisation.
Studiens syfte var att undersöka samverkan och professionellas perspektiv på barnets bästa i arbetet med ensamkommande barn genom besvarandet av tre frågeställningar. Den första frågeställningen rör de möjligheter till psykosocialt stöd som finns för ensamkommande barn. Vårt resultat visar att möjligheter finns i form av stöd hos handläggare, personal och skolkurator samt BUPs akutmottagning. Verksamheternas primära syfte är dock inte långsiktigt behandlande stödsamtal, vilket är något som samtliga respondenter anser att många ensamkommande barn är i behov av. Det behövs alltså ytterligare en aktör vars syfte är att arbeta med psykosocialt stöd för dessa barn. Den andra frågeställningen undersöker hur respondenterna ser på begreppet barnets bästa utifrån sitt professionella perspektiv. Samtliga respondenter har uppgett att de arbetar efter bästa förmåga i relation till sin yrkesroll och utbildningsnivå. Respondenterna påtalar samtidigt att tid, resurser och andra omgivningsfaktorer påverkar deras möjligheter att arbeta för barnets bästa. Studiens sista frågeställning berör samverkan mellan de verksamheter som tagit del i studien. Resultatet belyser att samverkan mellan verksamheterna existerar, men att respondenterna önskar en utveckling och transparens i samverkan för att tydliggöra samtligas uppgifter.

Abstract:
The purpose of this qualitative sociological law study is to examine the relationship between the social services and civil court to apprehend if knowledge about the child's best interest is transfered from social workers to the legal system. This have been done by investigating civil court cases concerning custody transition from biological parents to foster parents according to 6 chapter 8 paragraph in the law of parenting, built upon the legal principle of the best interests of the child. Eight cases has been examined by using a method of qualitative text analysis and categorised into five primary categories and three concepts linked to sections of the law. The material has been analysed through a sociological law perspective, social constructionist theory and attachment theory. The study shows that a variety of factors interacts when it comes to determining what’s in the best interest of the child . Moreover, the civil court refers in all eight cases to social services assessments of the child's situation. This suggests that social services have an informal power position when it comes to decisions on custody transition in accordance with the child's best interests.

The purpose of this essay is to create an understanding of how social workers work to ensure that the best interest of the child is achieved in custody disputes. The essay is based on seven semi-structured interviews with practicing social workers working with family law. The gathered material was analyzed using a thematic analysis method. The results of the study show that working with the best interest of the child in mind, using a child´s perspective, is complex and difficult. One of the reasons why it is difficult is that there is no exact definition of what “the best interest of the child” is and how it should be realised by the social worker since the concept should be assessed and applied individually every single time. All of the respondents states that the investigation is imbued by the wellbeing of them say that ultimately the child´s best interest is not what is valued the most in the investigation. The material shows that all the respondents are aware that the children’s perspective should be prominent during the entirety of the investigation. It is a common goal amongst the respondents to always work with the children’s perspective in mind, to ensure the best interest of the child.

Studiens syfte är att undersöka hur familjerättssekreterares tolkar och beaktar barnets bästa i vårdnadstvistutredningar. Studien baseras på nio kvalitativa, semistrukturerade intervjuer. Studien kommer att behandla barnets bästa, föräldraförmåga och risker för barnet. I resultatet framkommer att begreppet “barnets bästa” är svårt att definiera men att familjerättssekreterarna ser till barnets utsatta situation. Forskning och studiens resultat pekar på att barn i vårdnadstvistutredningar är i en utsatt situation och offer för föräldrars konflikt. Resultatet visar att familjerättssekreterare ser att föräldrar i en vårdnadstvist uppvisar bristande föräldraförmåga i jämförelse med föräldrar som inte är i vårdnadstvist och de kan därför inte tillgodose barnets behov av trygghet och stabilitet. I diskussionen kopplas studiens resultat samman med tidigare forskning samt systemteorin och handlingsteorin. Det visar sig att systemteorin kan ses som en utgångspunkt i familjerättssekreterares arbete även om det inte uttrycks som så. Det framkommer att familjerättssekreterare känner en frihet i sitt handlingsutrymme och att de utför målinriktade handlingar.
The study aims to investigate how family secretaries interpret and consider the child's best interests in custody investigations. The study is based on nine qualitative, semi-structured interviews. The study will address the child's best interests, parental ability and risks for the child. The result shows that the term "best interests of the child" is difficult to define, but that the family secretaries look to the child's vulnerable situation. Research and study results indicate that children in child custody disputes are in a vulnerable situation and victims of parental conflict. The result shows that family secretaries see that parents in a custody dispute show a lack of parental ability compared to parents who are not in custody disputes and therefore cannot meet the child's need for security and stability. In the discussion, the results of the study are linked to previous research as well as system theory and action theory. It turns out that the system theory can be seen as a starting point in the work of family secretaries, even if it is not expressed as such. It shows that family secretaries feel freedom in their room for maneuver and that they carry out targeted actions.

I föreliggande studie undersöks hur rättssäkerheten tillämpas och tolkas allmänt för barn som placeras utanför det egna hemmet av socialtjänsten samt hur rättssäkerheten tolkas och tillämpas när det rör barn som är placerade på ideella kvinnojourer. Studien är av rättssociologisk art. Metoden som används i studien är en kombination av rättsdogmatisk metod och samhällsvetenskaplig metod. Detta för att genom den rättsdogmatiska metoden studera lagstiftning och den samhällsvetenskapliga undersöka hur lagen tillämpas i praktiken. Materialet består av texter samt intervju. Teorier om rättssäkerhet används för att skapa en förståelse av materialet (Staaf; Petczenik) Studien visar att det finns brister i den formella rättssäkerheten samt att den materiella rättssäkerheten inte diskuteras över huvudtaget. Studiens resultat visar även att det finns ett glapp mellan rätten och dess tillämpning.
The present study examines how the rule of law is applied and interpreted for children placed outside their home by social services and how the rule of law are interpreted and applied in the case of children placed on non-profit refuges. The study has a sociology of law approach. Methods used in the study are a combination of legal dogmatic and social scientific method. The material consists of texts and one interview. Theories of the rule of law is used to create an understanding of the material (Staaf; Petczenik). The study shows that there are deficiencies in the formal legal rights as well as to the substantive legal rights, that will not be discussed at all. The results of the study shows that there is a gap between the law and its application.
