Full textIl fenomeno della sottrazione internazionale dei minori consiste nell’illecito allontanamento (o nel mancato rientro) del minore «in violazione dei diritti di affidamento derivanti da una decisione, dalla legge o da un accordo vigente in base alla legislazione dello Stato membro nel quale il minore aveva la sua residenza abituale» da parte di un genitore. Ad esso sono dedicate alcune norme del Regolamento (CE) n. 2201/2003 relativo alla competenza, al riconoscimento e all’esecuzione delle decisioni in materia matrimoniale e in materia di responsabilità genitoriale e le disposizioni della Convenzione dell’Aja del 25 ottobre 1980 sugli aspetti civili della sottrazione internazionale di minori. Tali atti prevedono, oltre ai criteri di definizione delle autorità competenti e alle norme sul riconoscimento ed esecuzione delle decisioni, la creazione di una rete di cooperazione fra gli Stati membri diretta alla risoluzione celere della questione e al perseguimento degli interessi del minore coinvolto. I casi di sottrazione dei minori coinvolgono, inoltre, ulteriori aspetti riguardanti la vita familiare degli stessi, il diritto ad essere ascoltati, la valutazione della loro vulnerabilità, il diritto di mantenere rapporti con entrambi i genitori e il diritto di visita. A ciò si aggiunge l’affermazione dell’obbligo per gli Stati di rispettare il diritto alla vita familiare (artt. 8 CEDU e 7 della Carta dei diritti fondamentali dell’Unione europea) e le pronunce rese dalla Corte europea sulla compatibilità tra gli obblighi scaturenti dalla Convenzione dell’Aja del 1980 e le norme CEDU. La sottrazione internazionale dei minori è, dunque, un fenomeno in cui gli aspetti processuali del diritto internazionale privato si fondono con i principi sottesi all’effettiva ed efficiente cooperazione tra Stati e con la tutela dell’interesse superiore del minore (previsto su scala universale dall’art. 3 della Convenzione Onu sui diritti del fanciullo del 1989), nonché, con il diritto alla vita familiare. Profili che investono il diritto internazionale, europeo e nazionale, condizionando inevitabilmente quest’ultimo e la sfera di esclusiva competenza riservata al legislatore statale. La tutela del minore quale principio preminente rispetto ai diversi interessi coinvolti ha, dunque, una valenza particolarmente incisiva tale da superare le stesse delimitazioni di competenza tra Unione europea e Stati membri, nel senso che gli aspetti processuali atti a garantire il rientro del minore nello Stato di residenza abituale possono condurre nelle singole fattispecie concrete ad un superamento della disciplina nazionale in materia di affidamento. Full textA presente dissertação traz uma reflexão sobre a aplicação do princípio do melhor interesse nos conflitos interfamiliares de guarda, buscando a sua origem e levantando alguns critérios que possam nortear a sua utilização, uma vez que não há um conceito expresso na legislação. Nosso objetivo foi verificar se o princípio acima mencionado estava ou não sendo considerado nas decisões judiciais oriundas das disputas de guarda entre os genitores, após o divórcio ou a separação. Para efetivá-lo, desenvolvemos um estudo qualitativo de tipo exploratório junto ao Núcleo de Prática Jurídica da PUC/RJ, procedendo à análise de catorze processos de guarda identificados no período de 1997 a junho de 2007. A leitura e análise dos processos evidenciaram que o princípio do melhor interesse ainda não é totalmente considerado pelos operadores do Direito. Nos processos em que há atuação da equipe técnica (assistentes sociais e psicólogos) pode-se perceber uma conduta que explicitamente coloca a criança/adolescente como personagem principal do processo (prioridade absoluta), ouvindo-os sempre (proteção integral) e averiguando de que forma seriam melhor atendidos (melhor interesse). A conduta de juízes e promotores, por outro lado, não se afigurou, nos processos analisados, como algo que demonstrasse a preocupação com a aplicação do princípio do melhor interesse, mas ao contrário a ênfase era no encerramento dos mesmos a partir de um acordo elaborado apenas com os genitores, desconsiderando as peculiaridades do litígio e em especial o bem estar das crianças e adolescentes envolvidos.
The present dissertation brings a reflection on the application of the principle of the best interest of the child in the interfamiliar conflicts of custody, searching its origin and raising some criteria that can guide its use, once there is not an express concept in the legislation. Our main goal was to verify if the referred principle was being considered or not in the decisions of the disputes of guard between the genitors, after the divorce or the separation. In order to accomplish it, we developed a qualitative and exploratory study at the Núcleo de Prática Júridica of the PUC/RJ, in which fourteen proceedings of custody in the period of 1997 until June of 2007 were analyzed. The analysis of these proceedings showed that the principle of the best interest of the child is not yet taken into consideration by some of the Law workers. The proceedings in which the social workers and psychologists participated we noticed that the adolescent/child were seen as the main characters (absolute priority) so they always got the chance to express their opinions (full protection) and therefore offered the means to point out the most suitable way to solve the cases (best interest). On the other hand, the judges and prosecutors of the analyzed proceedings did not seem to be concerned about the principle of the best interest of the child, their greatest concern was to put an end to the lawsuits making a deal with the parents, disregarding the details of the conflicts and the well being of the children and adolescents involved.

Full textENGLISH ABSTRACT: The Constitution of the Republic of South Africa entrenches the best interests of the child as being of paramount importance in all matters concerning the child. This commitment to the promotion of the welfare of children is not unique to modern South African law, but is an acknowledged principle of the common law and international child law as well. With such well-established recognition the question, which forms the primary focus of this study, arises whether the principle of the best interests of the child is workable and applicable in real life scenarios where the custody of a child has to be decided. The challenge to the application of the principle in this context is to reach a decision that will protect the parent-child relationship regardless of the marital breakdown. The question is whether the principle allows for and creates an honest awareness of and commitment to the welfare of children that influence decisions in this context or whether courts and decision-makers merely pay lip service to it in order to conceal the haphazard way in which custody is awarded. In order to determine the workability and applicability of the principle, it is necessary to know how the principle has evolved in the South African legal context. Through the examination and analysis of existing literature, international conventions, legislation and case law, a number of different perspectives on the developments in the interpretation and application of the principle are provided. These perspectives culminate in the useful and constructive insight and conclusion that the value of the concept is dependant upon the correct approach to the principle and its characteristics. The defining characteristic of the principle of the best interests of the child is its inherent vagueness and indeterminacy. Though this subjects the principle to serious criticism, this study supports the argument that indeterminacy is in fact essential. It ensures not only the flexibility of the concept, rendering it applicable to the time, cultural sphere and social context and unique circumstances of each case it is applied to, but a holistic approach to the child as individual and family as a unit as well. This holistic approach forms the foundation of the lists of criteria in McCall v McCall 1994 (3) SA 201 (C) and the Children's Bill, thereby establishing the workability and value of the principle for fair and just results in all decisions pertaining to the custody of children.
AFRIKAANSE OPSOMMING:Die Grondwet van die Republiek van Suid-Afrika verskans die beste belange van die kind as van deurslaggewende belang in elke aangeleentheid rakende die kind. Die verbintenis tot die bevordering van die belange van kinders is nie 'n verskynsel uniek aan die moderne Suid-Afrikaanse reg nie, maar is 'n erkende beginsel in beide die gemenereg en die internasionale kinderreg. Met hierdie wyd-verspreide en algemene erkenning ontstaan die vraag, wat dan ook die primêre fokus van hierdie studie vorm, of die beginsel van die beste belang van die kind werkbaar en toepaslik is in ware lewensdramas waar 'n beslissing oor die bewaring van 'n kind gemaak moet word. Die uitdaging vir die toepassing van die beginsels in hierdie konteks is om 'n besluit te neem wat die voortbestaan van die ouer-kindverhouding ten spyte van die verbrokkeling van die huwelik sal verseker. Die vraag is of die beginsel werklik 'n eerlike bewussyn van en verbintenis tot die welstand van kinders skep wat die besluitnemingsproses in hierdie konteks beïnvloed en lei en of howe en besluitnemers bloot die regte lippetaal gebruik om die lukrake manier waarop besluite geneem word te verbloem. Om die werkbaarheid en toepasbaarheid van die beginsel te bepaal is dit nodig om die proses van evolusie van die beginsel in die Suid-Afrikaanse reg onder oënskou te neem. Deur die ondersoek en analise van bestaande literatuur, internationale konvensies, wetgewing en hofuitsprake word 'n aantal perspektiewe op ontwikkelinge in die interpretasie en toepassing van die beginsel voorgelê. Hierdie perspektiewe lei tot die betekenisvolle en opbouende gevolgtrekking en insig dat die waarde van die konsep afhang van 'n korrekte benadering tot die beginsel en sy kenmerke. Die hoofkenmerk van die beste belange van die kind beginsel is die inherente vaagheid en ondefinieerbaarheid daarvan. Hoewel dit die beginsel aan ernstige kritiek onderwerp, ondersteun hierdie studie die argument dat die onbepaaldheid in der waarheid noodsaaklik is. Dit verseker nie alleen buigsaamhied, wat toepassing op alle tye in alle kulturele en sosiale omgewings en besondere omstandighede van 'n spesifieke geval moontlik maak nie, maar ook dat 'n holistiese benadering tot die kind as individue en die gesin as eenheid gevolg word. Hierdie holistiese benadering vorm die grondslag van die lyste van faktore in McCall v McCall 1994 (3) SA 201 (C) en die Wetsontwerp op Kinders 2003 waarmee die werkbaarheid en waarde van die beginsel vir billike en regverdige resultate in alle aangeleenthede rakende die bewaring van kinders verseker kan word.

Full textThe aim of the research is to investigate the principle of the best interests of the child. That principle is a general clause whose content is characterized by such an extreme vagueness that it was defined by the interpretation as a “magical” concept. The research is divided into three parts. The firts one is theoretical (Chapter 1), the second part is an analysis of both Italian and international law and the last part concerning an empirical investigation that involved Juvenile Court judges in Italy (Chapter 4). According to the analyzed theoretical context, the first hypothesis of research intends to verify if the principle of the best interests is a judiciary standard to be considered related to a real case and to be distinguished from the concept of rights of the child, or if it is instead a simple stylistic clause in the interpretation of the law. The second hypothesis tries to verify if the tool used by the law to determine the interests of the child is actually the balancing of his rights or interests or if the interests of the child, according to frequent statementes of the legislator, are to be considered superior and predominant. This work aims to answer the questions of the research through the analysis of the interpretations of law as regards the best interests of the child.

Full textThis mini-dissertation seeks to evaluate the best interests of the child as a separate factor that influences the sentencing of a primary caregiver. When a parent is in conflict with the law, the child stands to be affected sentence that the court may impose on the caregiver. A custodial sentence has the potential of affecting the child’s right to parental care. Therefore, in the event where a custodial sentence is appropriate, alternative care of the child by other persons become a possible option. The author recommends that after applying the principles articulated in S v M and making use of a child impact report; the right of the child to parental care should carry more weight. Thus, courts should duly consider the best interest of the child as an independent factor when negative effects to the child are associated with the sentence. Where appropriate, with either a non-custodial sentence or adequate alternative care (in the case of imprisonment).

Full textThe 1950's Convention of European Council on Human Rights and Fundamental Freedoms establishes a set of rights and fundamental freedoms (the right to life, prohibition of torture, the right to a fair trial, the right to respect for private and family life etc.) applicable to everyone within the jurisdiction of the state that ratified the Convention. Children are a very specific social group, which needs greater protection. However their rights are not distinguished in the Convention. On the basis that the rights enshrined in the ECHR are applicable to „everyone“, it may be maintained that those rights can be applicable to children as well. The author of this work aims to reveal the rights that are guaranteed for children in the context of the article 8 of the ECHR. To this end, particular attention is paid to the jurisprudence of the ECtHR. According to the case law of this Court, it can not only be determined the contents and evolution of specific rights, but also relevant problematic issues for the protection of the rights of a child can be revealed. In the first part of this work the author attempts to define a childhood, to identify both the upper and lower limits of the child's age and the child's legal status. Full textThe purpose of this study was to examine how a selection of social welfare officers based on the principle of the best interest of the child construct a minimum level of the material standard in a home. Another purpose was to examine whether different units with varying socioeconomic prerequisites in the municipality of Stockholm construct this level differently.
The method used in this study was Sociology of Law and two focus groups were used for the gathering of the data. A social constructive theory, a class perspective using concepts of Bourdieu and a perspective of law were used to analyse the material of data.
The results showed that the courses of action varied from enactment and the policies of the municipality of Stockholm, unspecified theories of the development of children, the conception of what is normal and what children needs, the context in which they work, the development of the society and what they estimate that children needs when attending school. The results also showed a difference between the two units concerning the minimum level of the material standard in a home

A great proportion of this epidemic is now found in low- and middle-income countries with higher levels of prevalence, particularly in emerging economies. In sub-Saharan Africa, South Africa ranks high in the prevalence of obesity at all levels. Since the inception of democracy in 1994, the government is yet to overcome the burden of poverty and inequality routed in its apartheid past. Apartheid systematically and unjustly disintegrated and segregated black Africans and people of Colour, denying them access to economic opportunity, thus leaving them on a dependency status. Khayelitsha and Mitchells Plain are the relics of apartheid policies. Obesity and associated diseases are highly correlated with gender dynamics, economic conditions, nutritional status, poverty, and urbanisation. It is increasingly evident that poor urban dwellers, especially women and children are at risk of obesity-related factors such as diabetes, hypertension, and heart diseases. The increasing incidence of obesity especially amongst children is concerning. The prevalence of child poverty is in South Africa is a cause for concern. Over 18.5million children are in South Africa, 64% of which are dependent on CSG. With poverty and inequality affecting millions of households, access to food and quality food has reached crises level. Yet, it is a basic human right that has received little empirical response amongst policymaker in South Africa. The South African food system is complex, poverty is endemic and poor households are most vulnerable to unhealthy eating habits. This research critically analysis the link between food choices, overweight and obesity in adults and children living in urban peripheral communities in Cape Town. The study was designed to interrogate the kinds of food eaten by urban peripheral dwellers, their socioeconomic status and how the policy of the BIC addresses the problem of child obesity in South Africa.

The study further aimed at comparing the and contrasting the socioeconomic dynamics of the two population to understand the progress and gaps in their economic and health status. Empirical data were collected from households in Khayelitsha and Mitchells Plain using a two-stage sampling technic to identify clusters and households. A sample of about 4300 individuals in 1052 households was sampled. A 24H dietary recall was used to capture food types of the population. The World Health Organisation guidelines for BMI adults and children were applied through the study. A BIC Index was developed to assess the right to food from the views of the child. First, the study found significant differences in the socioeconomic and demographic profiles of the population. Poverty and the risk of falling into poverty were higher in Khayelitsha than in Mitchells Plain. Two-third of the population (65%) of adults we found to be overweight and obese. Overweight and obesity amongst children was 29% and 68% of children reported that they buy food at school or on their way to school. Over 83% children stated that their parents give them money to take to school. There was a significant association between children buying food and parents giving money at X2 91.4643, P<= 0.000. Full textI denna uppsats undersöks begreppet ”barnets bästa” med utgångspunkten att granska vilka olika föreställningar som finns och har funnits kring vad detta innebär. Detta begrepp är inte nytt för vår tid, men det har debatterats mer efter tillkomsten av Förenta Nationernas konvention om barnets rättigheter som antogs 1989. Barnets bästa är dock en social konstruktion och innebörden av begreppet förändras därför ständigt.
Metoden som ligger till grund för denna uppsats är dels en genomgång av litteratur och dels en textanalys av två historiska källmaterial bestående av en proposition från 1924, prop. 1924:150, och en av statens offentliga utredningar från 1997, SOU 1997:116. Genom denna textanalys framkommer både likheter och skillnader mellan samhällets syn på barnets bästa.
Det kan konstateras att föreställningarna kring vad barnets bästa innebär har förändrats sedan början av 1900-talet. Utvecklingen av barnets bästa hänger samman med en mängd faktorer såsom synen på barn, rådande kultur, normer, värderingar, kunskap, ekonomi, politiska idéer, reformer och genusföreställningar. Slutsatsen är att vuxna såg till barnets bästa även i början av 1900-talet, men att begreppet då hade en annan innebörd. Därmed kan det konstateras att barnets bästa har varit, är och förblir ett begrepp i förändring.
In this paper the conception “the best interest of the child” examines with the starting-point to study which different ideas that exists and have existed about what this means. This conception is not new for today, but it has been debated more frequently after the creation of the United Nations Children’s Convention which was accepted in 1989. However, the best interest of the child is a social construction and therefore the meaning of the conception changes constantly.
The method that lays the foundation of this paper is partly an exposition of literature and also a text analysis of two historical sources consisting of a government bill from 1924, prop. 1924:150, and one of the States official reports from 1997, SOU 1997:116. Through this text analysis emerges both similarities and differences between the society’s views on the best interest of the child.
The statement is that the conceptions of what the best interest of the child mean have changed since the beginning of the twentieth century. The development of the best interest of the child is connected to many factors such as the view of the child, existing culture, norms, values, knowledge, economy, political ideas, reforms and gender conceptions. The conclusion is that grown-ups tried to fulfil what was best for the children even in the beginning of the twentieth century, but the conception had a different meaning at the time. Therefore the conclusion is that the best interest of the child has been, is and will be a conception in change.

Full textThe child's best interest is described by researchers as elusive. Despite this, the concept is statutory and should be essential to decisions regarding custody, residence and contact. The purpose of this study was to inquire Gävle district court's discussion of the child's best interest in custody, residence and contact judgments in 1992, 2002 and 2012, and to study whether the arguing changed over time. Text analysis was applied to analyze data which then was studied by perspectives of socialconstructionism and sociology of law. A prominent result was that the district court's discussion of the child’s best interest is usually made indirectly. However, direct references to the concept of the child’s best interest increased, mainly in the judgments from 2012. This result might derive from the reforms made in the Swedish Parental Code in 2006. Another important conclusion we have come to concern is that the child’s best interest seem to be inconstant.

Full textThe aim of this study was to examine investigative social workers understanding of and approach to the principle of the best interests of the child. Previous research shows that it’s difficult to define the best interests of the child. Research also shows that a high workload and lack of time can affect assessments of the child’s best interests, and that a trusting relationship between the social worker and the child can promote participation. The theoretical background is based on Bronfenbrenner’s developmental ecology theory and room for maneuver as a theoretical concept. A qualitative method has been used and the empirical material was analyzed using a thematic analysis. Social workers feel that they have a large margin of maneuver to make assessments. Although the result showed that the concept was difficult to define, the social workers had a similar understanding on how they understood the concept and what they take in consideration in the assessment. However, the social workers have for the most part only time to meet the children at one point during the investigation process. Financial conditions also turned out to have an impact on their room for maneuver when it comes to assessing the child’s best interests.

Full textThe purpose of this study was to examine how the social services are handling cases concerning child marriages. This has been achieved by studying the guidelines of The National Board of Health and Welfare, guidelines formed by selected municipalities and by conducting interviews with professionals who handle cases concerning child marriage. The collected data has been analyzed from the theoretical perspectives: the best interest of the child and a feminist perspective. The results of the study show that the chosen municipalities only have guidelines for honour-related violence, but no established guidelines or routines for cases concerning child marriage. Recurring is that the social services lack structure and tools on how to deal with children who are exposed to risks associated with child marriage. In order for children to receive the support and protection to which they are entitled, the social services need to have specific knowledge of what honour-related violence and child marriage mean.

Full textThe child's highest interest is an international principle that has been announced in the 3-1 article of the International Bureau for Children's' Rights. This principle dominates the exercise of the parental authority.The notion of the child's highest interest is seen as a unit at the European scale. It can be clarified thanks to a key to read that has been highlighted from the French and European jurisprudence and which contains some content elements. Besides the appearance of characterization's elements is based on the Human Rights European Court's judgements. Those elements are permanent, non-cumulative and sometimes they can become mutually exclusive such as the maintenance of individual relations between the child and his parents or a healthy environment around the child. The notion of the child's highest interest is autonomous by judgment resources, modes and own methods. This autonomy is slightly linked to the notion's impact in the different European legislations. This large recognition is strengthened by the increase of a conventionality review that reveals the real nature of the child's highest interest. The child's highest interest is from now on part of a key notion in the area of the parental authority's exercise. It creates a new public order that protects the child at the European scale. Its primacy establishes itself more and more clearly. However, some conflicts between the highest interest and other concerted interests and principles suddenly appear. Ultimately, the unit and autonomy of the child's highest interest, which is from now on a law notion, should base an effective protection of the child in Europe

Full textThe delegation of authority affects social workers discretion to live up to the best interests of the child. Social workers are affected daily by political decisions. The political landscape contribute to a democratic process with the intention of leading to equal treatment and the rule of law. At the same time, individuals are in need of individual solutions and needsadapted efforts, which leaves the social worker with the discretion to use occupational professionalism in an attempt to live up to the child's best of interests. Social workers act in between two worlds where organisational professionalism and occupational professionalism meet. The results of the study show difficulties in defining the best interests of the child, which challenges the social workers discretion in each single case. Trust is the foundation for making discretion desirable amongst social workers. At the child welfare unit, social workers feel that they have trust from their management. On the other hand, the delegation of authority is perceived as an economic instrument for regulating public expenditure. Finally, the results shows that the social workers disagrees on who should be the ultimate decisionmaker and demand expertise among the politicians in the social committee where the toughest decisions are made.

Full textThis research aimed to study the principle of the best interest of the child, both in theory and in practice, in an attempt to conclude whether it is possible or not to adopt predetermined criteria to be followed in making decisions on issues involving children and adolescents. In the first part, theoretical, the content of the best interest was studied, as well as the possibility of understanding it as a rule of interpretation, fundamental right or principle. The second part, practical, sought to analyze how the courts have been deciding issues involving the best interest. In doing so, some institutes were selected (guardianship, adoption, anonymous childbirth, visits and education). The analysis of the guardianship passed by differentiating between placement in foster family and its assignment to one of the parents in case of separation. The possibility of assigning it to a third person and the imposition of shared custody were discussed. The visitation rights in case when the custody has been awarded to only one parent was studied. The research was extended to the hypothesis of granting this right to friends, stepfathers, stepmothers and godfathers or godmothers. The research studied Brazilian, intuitu personae and international adoptions, as well as the possibility of adoption by homosexual couples. Although non-existing under Brazilian law, the anonymous childbirth was analyzed to observe if it is viable and needed in our system. Finally, the right of education was studied, and aspects such as the possibility of homeschooling, transportation of children to their schools and the requiring of vacancies in childcare facilities were highlighted.

Full textThe aim of the study was to examine how child investigators in the police force interpret and apply the notification of preliminary investigation (FuK) and the po-lice act in their child investigative interviews with alleged victims of sexual abuse. Questions at issue were how child investigators relate to FuK 17-19 §§, re-garding child investigative interviews and to FuK 16 § and the police act 3 §, re-garding their co-operation with social services. The theory and method used in this study was Sociology of Law. Qualitative interviews were conducted with eight child investigators, one from each police district in Stockholm. The results of the study conclude that despite special qualifications, child investigators may find themselves in difficulty in receiving or interpreting information from chil-dren, therefore they may need to consult a person with expert knowledge. Fur-thermore the results conclude that all of the child investigators with no exception inform the social services when a report to the police is received. Moreover, the results show that child investigators in general are aware of the legislation and re-late in compliance with it. In conclusion, children are given special treatment in relation to adults, in order to place children on equality with them.

Vi har gjort en kritisk diskursanalys av AC:s (Adoptionscentrum) medlemstidning under perioderna; 1975-1985, 1986-1996, 1997-2006. Frågeställningen lyder: Hur konstitueras diskursen om ”det goda adoptivföräldraskapet” genom AC:s medlemstidning? Vilka är möjlighetsvillkoren och vilka konsekvenser innebär diskursen? Vårt syfte har varit att förstå diskursen om ”det goda adoptivföräldraskapet”. Vi har utgått ifrån socialkonstruktioniskt, poststrukturalistiskt perspektiv och språkfilosofi.
Vårt huvudsakliga resultat har visat sig vara att AC konstituerar diskurser som producerar och reproducerar ett antal normativa föreställningar om föräldraskap, familj och individer som bygger på socialt konstruerade föreställningar om vad som är en ”riktig” familj, bra föräldraegenskaper och barnets bästa. Diskursen ”det goda adoptivföräldraskapet” uppnås genom aktivt medlemskap i adoptionsorganisationen AC. Begreppet ”barnets bästa” har visat sig vara en flytande signifikant för att konstituera olika diskurser som alla handlar om att etablera eller upprätthålla AC som organisation. Genom barnets bästa har AC fått möjlighet att legitimera sina egna verksamhetsområden, styra över vem som är lämplig förälder, vem som får bilda familj och vika barn som är tillgängliga för adoption. Ytterligare resultat har visat på att AC under perioden fått ökad makt genom att förmedlingen av adoptivbarn har övergått till adoptivorganisationerna. Således har statens makt och inflytande fördelats över ytterligare en instans.
Abstract
This essay is a critical discourse analysis on AC’s (Adoption Centre Organisation, Sweden) magazine for members during three periods; 1975-1985, 1986-1996, 1997-2006. Our main question is how discursive statements are made on “the good adoptive parenthood” in this magazine? What possible changeable meanings and truths are given by the discourses? Our aim is to understand the discourse “the good adoptive parenthood”. The theoretical framework consists of knowledge of social constructivism, post structural perspective and philosophy of language.
Our main results are that AC constitutes discourses that produce and reproduce a number of assumptions about parenthood, family and individuals as normative and influenced by social constructed assumptions about what is; a “real” family, a good parenthood or “the child’s best interest”. The discourse of “the good adoptive parenthood” is gained through membership in the adoption organisation AC. The claim of “the child’s best interest” has in this essay being found as a fluent significant to constitute a variety of discourses, which all aim to establish and maintain the organisation. Through the principle of “the child’s best interest”, AC has found a way to legitimate their own fields, to decide who is a suitable parent, who shall form a family, and which child will be available for adoption. Further result shows that AC during the studied period has gained increased legal and governmental power in the field of adoption. As a result, the governmental power and influence in the adoption field has been divided through additional authorities.

Full textStudiens syfte var att undersöka samverkan och professionellas perspektiv på barnets bästa i arbetet med ensamkommande barn genom besvarandet av tre frågeställningar. Den första frågeställningen rör de möjligheter till psykosocialt stöd som finns för ensamkommande barn. Vårt resultat visar att möjligheter finns i form av stöd hos handläggare, personal och skolkurator samt BUPs akutmottagning. Verksamheternas primära syfte är dock inte långsiktigt behandlande stödsamtal, vilket är något som samtliga respondenter anser att många ensamkommande barn är i behov av. Det behövs alltså ytterligare en aktör vars syfte är att arbeta med psykosocialt stöd för dessa barn. Den andra frågeställningen undersöker hur respondenterna ser på begreppet barnets bästa utifrån sitt professionella perspektiv. Samtliga respondenter har uppgett att de arbetar efter bästa förmåga i relation till sin yrkesroll och utbildningsnivå. Respondenterna påtalar samtidigt att tid, resurser och andra omgivningsfaktorer påverkar deras möjligheter att arbeta för barnets bästa. Studiens sista frågeställning berör samverkan mellan de verksamheter som tagit del i studien. Resultatet belyser att samverkan mellan verksamheterna existerar, men att respondenterna önskar en utveckling och transparens i samverkan för att tydliggöra samtligas uppgifter.

Full textThe study aims to investigate how family secretaries interpret and consider the child's best interests in custody investigations. The study is based on nine qualitative, semi-structured interviews. The study will address the child's best interests, parental ability and risks for the child. The result shows that the term "best interests of the child" is difficult to define, but that the family secretaries look to the child's vulnerable situation. Research and study results indicate that children in child custody disputes are in a vulnerable situation and victims of parental conflict. The result shows that family secretaries see that parents in a custody dispute show a lack of parental ability compared to parents who are not in custody disputes and therefore cannot meet the child's need for security and stability. In the discussion, the results of the study are linked to previous research as well as system theory and action theory. It turns out that the system theory can be seen as a starting point in the work of family secretaries, even if it is not expressed as such. It shows that family secretaries feel freedom in their room for maneuver and that they carry out targeted actions.

Full textThe present study examines how the rule of law is applied and interpreted for children placed outside their home by social services and how the rule of law are interpreted and applied in the case of children placed on non-profit refuges. The study has a sociology of law approach. Methods used in the study are a combination of legal dogmatic and social scientific method. The material consists of texts and one interview. Theories of the rule of law is used to create an understanding of the material (Staaf; Petczenik). The study shows that there are deficiencies in the formal legal rights as well as to the substantive legal rights, that will not be discussed at all. The results of the study shows that there is a gap between the law and its application.
