This chapter examines whether the current law with regard to stipulated damages clauses can be justified by reference to a single, or multiple, policy objectives. In the Cavendish case, counsel for Cavendish urged the Supreme Court to abolish the penalty rule. The Supreme Court mainly examined the penalty jurisdiction from a historical and comparative perspective but more briefly canvassed other rationales. The chapter considers all of the ‘justificatory’ arguments discussed in Cavendish and other cases, as well as those advanced in academic writing. It begins by looking at the context of the penalty jurisdiction in the broader law of contract. In other words, the relationship between the penalty jurisdiction and the principle of self-determination, often summarised as the freedom to contract, is discussed.

This editorial focuses on the violation of the jus cogens principle of non-impunity for acts of torture as occurred in the Cestaro v. Italy case, where the perpetrators went unpunished due to the statute of limitations. The Italian Supreme Court failed to apply this principle of global constitutional law. Nor did the ECtHR implement effective remedies against impunity. The author proposes reopening time-barred criminal proceedings as a useful tool against impunity to give full effect to ECtHR jurisprudence supporting the generally recognized principle of the non-applicability of statutory limitations to crimes against humanity.She stresses the need to enhance the effectiveness of the supervisory role of the ECtHR in ensuring the observance of jus cogens human rights principles—of which the ECHR “forms part”—through a unitary approach of courts to the fight against impunity based on an evolutionary interpretation of the Convention, which would provide more effective and integrated protection of such rights.

This Prologue describes three stories concerning Korematsu. The first is told in late 2015 by U.S. judges. It reaches back to the Supreme Court’s 1944 ruling in Korematsu validating the World War II Japanese American removal and incarceration. And it discerns insights, maybe lessons, for America about fundamental freedoms sacrificed in the name of perceived exigency. The second story starts with Justice Jackson’s loaded weapon warning about expanding Korematsu’s principle to new purposes. In 2014, then-Supreme Court justice Antonin Scalia responded to a question about a possible U.S. mass exclusion or roundup of Muslims with a disturbing prophesy. The third story concerns Scalia’s it-could-happen-again prophesy and how the laws fall silent. That story is an amalgam of calls for mass Muslim exclusion and detention by government officials and Republican presidential candidates after the 2015 Paris and San Bernardino attacks—calls that partially coalesced in President Trump’s controversial 2017 exclusion-and-detention executive orders.

The division of legislative powers in the Constitution Act, 1867 is the most important textual expression of the federal principle that is at the heart of the Canadian constitutional order. The judiciary has the responsibility of interpreting these provisions and thus of determining the boundaries of the law-making powers of Canadian legislative bodies. In performing this high-stakes task, the courts have developed a rich jurisprudence that draws on text, history, structure, and principle. In recent decades, the Supreme Court has articulated a “modern” or “co-operative” approach that interprets both federal and provincial legislative powers generously, and tolerates a high degree of overlap and interplay between them. Despite this commitment to maximizing the democratic space available to all Canadian legislatures within their respective areas of jurisdiction, some doctrines developed by the courts have had asymmetric effects that favour the federal Parliament.

Revolution in various forms had been endemic to the Great War. The Paris Peace Conference sought not so much to oppose revolution as to master it in the formation of a new international system. It created the International Labour Organization to institutionalize a transnational approach to labor relations, and thus head off worker unrest as a source of revolution. The Mandate Principle put all mandates at least theoretically on the path to independence, however indefinite the period of tutelage. The Mandate Principle, at least discursively, provided a means of pre-empting anti-colonialism as a source of international instability. The conference also sought to master revolution in successor states. Recognizing Czechoslovakia as a model liberal democracy provided a template ill-suited to recognizing the other successor states. The war between Romania and Hungary in 1919–20 left the Supreme Council with recognition as its only means to control the behavior of successor states.

There is extensive treatment of the rights and duties of both the buyer and the seller, and sale contracts are considered alongside other contracts such as charter parties and letter of credit contracts. The CISG material has been significantly developed in this fourth edition and there is more extensive treatment of such matters as remedies, passing of property, standard form contracts, and the international dealing of commodities. The major developments in the case law are examined, most notably further developments on interpretation and implied terms in the Supreme Court, bunkers litigation, and the implications for the compensatory principle following the Supreme Court decision in Bunge SA v Nidera NV (2015).

The book provides analysis of the principal rules of trust law which control the exercise of powers and discretions by trustees. The primary focus is on the principle known as "the Rule in Re Hastings-Bass", and this is considered alongside the doctrines of fraud on a power and mistake. This is the first book-length treatment focussed on this specific aspect of trust law, and in particular the first on the Rule in Re Hastings-Bass, which is the subject of much professional and academic interest especially following consideration by the Supreme Court in Pitt v Holt and Futter v Futter [2013] UKSC 26. Whilst considering Pitt and the Rule in Re Hastings-Bass alongside mistake and fraud on a power, the book also explains how these doctrines interact, and how the law regulates trustee decision-making as a whole. In League of Arab States, the Belgian Court of Cassation held that the League could not rely on its immunity from jurisdiction before Belgian courts, as, absent parliamentary approval, the Headquarters Agreement between Belgium and the League could not have domestic legal consequences. The Court added that there was no general principle of public international law in the sense of art. 38(1)(c) ICJ Statute to the effect of international organizations enjoying immunity from jurisdiction. This decision is in line with decisions from other jurisdictions, which require a treaty basis for international organization immunity to be successfully invoked. It contrasts however with an earlier decision by the Dutch Supreme Court (Spaans), pursuant to which the immunity of international organizations follows from customary international law.

It discusses the cultural background for the Supreme Court’s adoption of separation of church and state as the controlling constitutional construct and then the popular response to that adoption. This cultural backdrop included a period of heightened tensions between institutional Protestantism and Catholicism, a conflict that did not dissipate until after the election of John F. Kennedy and the reforms of Vatican II. The book then considers the decline of church–state separation as a legal principle and a cultural value, a process that began in the 1960s with the rise of social welfare legislation under the Great Society.

The chapter addresses, first, the ontological issue of whether the interpretation of a constitution is fundamentally different than the construction of statutes. Based on a comparison of the Supreme Court of Canada decisions in constitutional interpretation, especially Charter cases, and the contemporary approach to statutory interpretation, endorsing Driedger’s modern principle, it is argued that a convergence of methodology has occurred. Second, recent developments in the domestic use of international law—that is interlegality—also show commonality in constitutional and statutory interpretation. The hypothesis is that recent case law on the operationalization of international normativity, far from supporting the end of the international/national divide, actually reaffirms the Westphalian paradigm. The contextual argument and the presumption of conformity, as interpretative tools, allow courts to be more flexible, indeed more permissive, in resorting to international law.

Employing the principle of ‘effectiveness’ as its starting point, the chapter conducts a detailed analysis of the rules on State responsibility, focusing in particular on Article 9. It also charts jurisprudence from the US Supreme Court, the US-Mexico General Claims Commission, and the Franco-Italian Conciliation Commission. Finding support for the idea that States may be held responsible for the impersonal acts of armed groups, the chapter explains how this case law may give rise to an argument that armed groups are bound by the international obligations of the State in instances where they control territory. It concludes by explaining how the obligations of armed groups may also originate in the continued rights of the population in the territory under their control.

In light of the compelling empirical connection between hate speech and atrocity, what laws, if any, criminalize the dissemination of such rhetoric? Chapter 2 begins to answer that question by examining international human rights instruments and domestic laws covering speech and violence. It notes there is an inbuilt clash in the principal human rights documents between free expression and freedom from invidious discrimination. Most of the world’s liberal democracies protect dignity against discrimination. The United States does not. The world’s most speech-protective jurisdiction, its Constitution’s First Amendment stipulates that the government may “make no law … abridging the freedom of speech, or of the press.” As the United States plays a prominent role in developing the criminalization of atrocity speech on the global stage, and as its Supreme Court has often held forth on issues of speech liberty, its domestic jurisprudence is a particular focus of this chapter.

The notion of human dignity has in recent years come under attack from sectors of the interdisciplinary and legal academic community as vacuous and of little or no utility in judicial reasoning. This author holds instead that human dignity is the sine qua non of all human life and correlated with certain inviolable human rights that speak to human beings as other than property, as having legal personality and the right to be heard. The notion of human dignity then serves, it is argued here, as essential guidance in judicial reasoning on issues of individual and group fundamental human rights. Neglect in honouring the principle of respect for human dignity in judicial decision-making serves to erode the democratic rule of law and the interests of justice as will be illustrated through examination in particular of the U.S. Supreme Court case of J.C. Hernandez et al v. J. Mesa Jr.

It was characterized by critics as both the supreme intellectual, as well as musical theatrical achievement of the Sondheim–Prince collaborations, and as the most cynical betrayal of the authentic vernacular American tradition of the musical. At a number of levels, both formal and substantive, it is a reflexive exploration of the tension between the national and global conditions of late twentieth-century American cultural identity and ambitions and their relation to the legacy of the Enlightenment origins of American society. The two levels discussed in detail are those of the relations between and modes of representation of the principal characters, and the processes of transition between traditional and modern societies. The chapter argues that the binary structure of the theatrical organization ofPacific Overturesin two sequential parts raises issues of the inevitability of the inversion of progress into tragedy.

The research is a comprehensive study of the legal basis of interaction between local self-government bodies and state and regional authorities in Spain. The author analyzes Spanish regulations of the state and regional levels, decisions of the Constitutional Court of Spain, decisions of the Supreme Court of Spain and research studies of Spanish scientists, which have not been previously examined in the Russian legal doctrine. Decentralized public administration development stages in Spain with regard to the activities of local self-government bodies have been determined and characterized. The author identified the essential characteristics of basic principles and forms of interaction between local self-government bodies and state and regional authorities in Spain. Legal regulation disadvantages which negatively affect protection of the local autonomy principle in Spain have also been revealed. For students, post-graduate students and teachers of law universities and faculties, state and municipal employees, everyone who is interested in current problems of municipal law.

Este livro traz à baila o exame da constitucionalidade, ao longo do tempo, demonstrando sua evolução histórica, bem como a apreciação da constitucionalidade pelos Tribunais de Contas brasileiros sob três óticas: análise intertemporal do controle de constitucionalidade; análise da situação fática atual; e análise de possível entendimento futuro, ante a recente decisão do Supremo Tribunal Federal (MS 35.410-DF) em relação à aplicação da Súmula 347/STF de 1963. A controvérsia instalada reside na problemática em saber se as Cortes de Contas podem realizar a apreciação da constitucionalidade, quando da tramitação de processos e de matérias atinentes às suas competências constitucionais e, em caso afirmativo, quais os limites que devem ser observados, a fim de não usurpação de competência dos poderes constituídos. O estudo deste livro conclui pela necessidade de fortalecimento do papel institucional do Tribunal de Contas na adoção de medidas assecuratórias a boa e regular aplicação de verbas públicas, atribuindo à Colenda Corte de Contas a manutenção da apreciação de leis e atos normativos do Poder Público, no caso concreto e de forma incidental, sendo por certo, não declarar, mas apenas afastar a aplicação das normas tidas por inconstitucionais, em obediência ao princípio da Supremacia da Constituição.

After the 1954 Brown v. Board of Education ruling, no state fought longer or harder to preserve segregated schools than Mississippi. This massive resistance came to a crashing halt in October 1969 when the Supreme Court ruled in Alexander v. Holmes Board of Education that “the obligation of every school district is to terminate dual school systems at once and to operate now and hereafter only unitary schools.” Thirty of the thirty-three Mississippi districts named in the case were ordered to open as desegregated schools after Christmas break. With little guidance from state officials and no formal training or experience in effective school desegregation processes, ordinary people were thrown into extraordinary circumstances. However, their stories have been largely ignored in desegregation literature. This book explores the arduous and complex task of implementing school desegregation. How were bus routes determined? Who lost their position as principal? Who was assigned to what classes? Without losing sight of the important macro forces in precipitating social change, the authors shift attention to how the daily work of “just trying to have school” helped shape the contours of school desegregation in communities still living with the decisions made fifty years ago.

Sovereignty has been variously understood as the given principle of international relations, an institution, a social construct, a performative discourse subject to historical transformation, or a particular practice of power. The “articulations” of sovereignty refer to sovereignty as a practice that is worked on and in turn works with and against other practices. Alongside territory and supreme authority, sovereignty is characterized by the capacity to make and enforce laws. Sovereignty has also been defined in opposition to rights, as the spatiotemporal limits it instantiates are also the limits of rights. Another conceptualization of sovereignty has been revived in international relations, partly in response to the question of exclusions and limits that sovereign practices enacted. In addition, sovereignty is not inextricably tied up with the state but is articulated with heterogeneous and contradictory discourses and practices that create meaning about the international, and has consequences for the kind of community, politics, and agency that are possible. There are three effects of the logic of sovereignty in the international system: the ordering of the domestic and the international, the spatio-temporal limits to politics, and the exclusions from agency. In addition, there are three renditions of the international as a “thick” social space: those of globalization theories, of biopolitics, and of empire.

In 1988, Sandi and Larry Zobrest became agents in the struggle for disability rights when they sued a suburban Tucson, Arizona, school district to obtain public funding for the signed language interpreter their deaf son Jim needed in high school. Such funding would have been unproblematic under the Education for All Handicapped Children Act (later retitled the Individuals with Disabilities Education Act) if Jim went to a public high school, but they were intent on his attending a Roman Catholic school. The law was unclear on the legality of public money assisting students with disabilities to attend religiously affiliated schools, but it had long been a general principle of interpretation of the Establishment Clause of the First Amendment in the U.S. Supreme Court that governments must be cautious about dispensing public resources to religious institutions. Their successful lawsuit represents a classic American clash of rights. This history of the Zobrests’ lawsuit begins well before they went to court. The narrative extends back to Jim’s birth in 1974, a pediatrician’s diagnosis of deafness, and the efforts of his parents, who are not deaf, to seek resources for their son’s education prior to high school. It analyzes their desire to mainstream Jim for preparation for life in the hearing world, not in the Deaf community, and the succession of choices they made to that end.

This book focuses on the law and politics of rights protection in democracies, and in human rights regimes in Europe, the Americas, and Africa. After introducing the basic features of modern constitutions, with their emphasis on rights and judicial review, the authors present a theory of proportionality that explains why constitutional judges embraced it. Proportionality analysis is a highly intrusive mode of judicial supervision: it permits state officials to limit rights, but only when necessary to achieve a sufficiently important public interest. Since the 1950s, virtually every powerful domestic and international court has adopted proportionality as the central method for protecting rights. In doing so, judges positioned themselves to review all important legislative and administrative decisions, and to invalidate them as unconstitutional when they fail the proportionality test. The result has been a massive—and global—transformation of law and politics. The book explicates the concepts of “trusteeship,” the “system of constitutional justice,” the “effectiveness” of rights adjudication, and the “zone of proportionality.” A wide range of case studies analyze: how proportionality has spread, and variation in how it is deployed; the extent to which the U.S. Supreme Court has evolved and resisted similar doctrines; the role of proportionality in building ongoing “constitutional dialogues” with the other branches of government; and the importance of the principle to the courts of regional human rights regimes. While there is variance in the intensity of proportionality-based dialogues, such interactions are today at the heart of governance in the modern constitutional state and beyond.

Should religious people who conscientiously object to facilitating same-sex weddings, and who therefore decline to provide cakes, photography, or other services, be exempted from antidiscrimination laws? This issue has taken on an importance far beyond the tiny number who have made such claims. Gay rights advocates fear that exempting even a few religious dissenters would unleash a devastating wave of discrimination. Conservative Christians fear that the law will treat them like racists and drive them to the margins of American society. Both sides are mistaken. This is not a matter of abstract principle, and none of the constitutional claims work. This is an appropriate occasion for legislative negotiation. This book is the only systematic accounting of the interests that must be balanced in any decent compromise, in terms that both sides can recognize and appreciate. Koppelman explains the basis of antidiscrimination law, including the complex idea of dignitary harm. He shows why even those who do not regard religion as important or valid nonetheless have good reasons to support religious liberty, and why those who regard religion as a value of overriding importance should nonetheless reject the extravagant power over nonbelievers that the Supreme Court has recently embraced. Koppelman also proposes a specific solution to the problem: that religious exemptions be granted only to the few businesses that are willing to announce their compunctions and bear the costs of doing so. His approach makes room for America’s enormous variety of deeply held beliefs and ways of life. It can help reduce the toxic polarization of American politics.

Evangelicalism was the chief factor moulding the theology of most Protestant Dissenting traditions of the nineteenth century, dictating an emphasis on conversions, the cross, the Bible as the supreme source of teaching, and activism which spread the gospel while also relieving the needy. The chapter concentrates on debates about conversion and the cross. It begins by emphasizing that the Enlightenment and above all its principle of rational inquiry was enduringly important to Dissenters. The Enlightenment led some in the Reformed tradition such as Joseph Priestley to question not only creeds but also doctrines central to Christianity, such as the Trinity, while others, such as the Sandemanians, Scotch Baptists, Alexander Campbell’s Restorationists, or the Universalists, privileged the rational exegesis of Scripture over more emotive understandings of faith. In the Calvinist mainstream, though, the Enlightenment created ‘moderate Calvinism’. Beginning with Jonathan Edwards, it emphasized the moral responsibility of the sinner for rejecting the redemption that God had made available and reconciled predestination with the enlightened principle of liberty. As developed by Edwards’s successors, the New England theology became the norm in America and was widely disseminated among British Congregationalists and Baptists. It entailed a judicial or governmental conception of the atonement, in which a just Father was forced to exact the Son’s death for human sinfulness. The argument that this just sacrifice was sufficient to save all broke with the doctrine of the limited atonement and so pushed some higher Calvinists among the Baptists into schism, while, among Presbyterians, Princeton Seminary retained loyal to the doctrine of penal substitution. New England theology was not just resisted but also developed, with ‘New Haven’ theologians such as Nathaniel William Taylor stressing the human component of conversion. If Calvinism became residual in such hands, then Methodists and General and Freewill Baptists had never accepted it. Nonetheless they too gave enlightened accounts of salvation. The chapter dwells on key features of the Enlightenment legacy: a pragmatic attitude to denominational distinctions; an enduring emphasis on the evidences of the Christian faith; sympathy with science, which survived the advent of Darwin; and an optimistic postmillennialism in which material prosperity became the hallmark of the unfolding millennium. Initially challenges to this loose consensus came from premillennial teachers such as Edward Irving or John Nelson Darby, but the most sustained and deep-seated were posed by Romanticism. Romantic theologians such as James Martineau, Horace Bushnell, and Henry Ward Beecher rejected necessarian understandings of the universe and identified faith with interiority. They emphasized the love rather than the justice of God, with some such as the Baptist Samuel Cox embracing universalism. Late nineteenth-century Dissenters followed Anglicans in prioritizing the incarnation over the atonement and experiential over evidential apologetics. One final innovation was the adoption of Albrecht Ritschl’s claim that Jesus had come to found the kingdom of God, which boosted environmental social activism. The shift from Enlightenment to romanticism, which provoked considerable controversy, illustrated how the gospel and culture had been in creative interaction.

O X Simpósio de Geriatria e Gerontologia da LAGG-UFJF e I Simpósio de Saúde do Idoso da UFJF ocorreu nos dias 01 e 02 de Abril de 2022, na modalidade remota pela plataforma Youtube com a carga horária 10h. Reuniu 1.580 participantes inscritos de diferentes regiões do Brasil. Dentre estes, estudantes, profissionais, especialistas, docentes, pesquisadores e pessoas idosas da comunidade usuária de serviços de saúde. Os eventos reunidos foram organizados pelas Ligas Acadêmicas de Geriatria e Gerontologia da Universidade Federal de Juiz de Fora (UFJF), Centro Universitário Presidente Antônio Carlos de Juiz de Fora (UNIPAC-JF) e Faculdade de Ciências Médicas e da Saúde de Juiz de Fora (SUPREMA-JF) e Projeto de Extensão da UFJF “Educação e Promoção do Autocuidado de Idosos e Cuidadores: Abordagem Interprofissional”. O objetivo geral foi agregar áreas de atuação em geriatria e gerontologia em atuação em Juiz de Fora (MG), como liga acadêmica, projeto de extensão, ambulatórios especializados, em torno do tema do envelhecimento humano; saúde do idoso e especificidades da geriatria e gerontologia no contexto da pandemia de COVID-19. Visou em específico, difundir conhecimentos para atualizações e reflexões relativas ao processo de envelhecer saudável; aos cuidados preventivos e restaurativos próprios da geriatria/gerontologia tendo como perspectiva o cenário pós-pandemia. Os temas foram definidos considerando os principais desafios vivenciados pela população idosa no cenário da pandemia, dentre eles o acesso, manuseio de tecnologias de informação; atendimentos remotos; impactos do distanciamento social na saúde física e mental. O conteúdo temático foi apresentado na forma de mesas redondas e palestras e oportunizou, além de discussões qualificadas entre os palestrantes integrantes das mesas redondas, a interlocução entre estes e os participantes. Como estímulo à produção científica, o Simpósio ofereceu a oportunidade de submissão de resumos simples, dos quais dezenove foram apresentados nas modalidades oral e e-pôster. Os mesmos foram submetidos a avaliadores Ad hoc, mestres e doutores especialistas na temática, membros da Comissão Científica do evento, sendo que sete resumos foram premiados e receberam certificado da premiação. Atendiendo al trabajo colaborativo de la Red Interinstitucional -Derecho Procesal y Justicia- y al esfuerzo mancomunado de diferentes maestros que presentan los productos resultados de sus investigaciones, Instituciones de Educación Superior, y al Colegio de Jueces y Fiscales, se presenta para la discusión de la comunidad académica y científica, el libro resultado de investigación titulado Luces y sombras de la constitucionalización en la justicia, socializado en el V Seminario Internacional sobre el Proceso y la Justicia, realizado en Medellín, Colombia, en Plaza Mayor. Se propuso el tema de la constitucionalización, por considerarlo de suma importancia en el derecho procesal y en el mundo jurídico en general, entendiendo que produce efectos directos, desde la juridización con el precedente constitucional, la producción de normas y las transformaciones de las sociedades. Se encontrarán temas de discusión necesarios para la actualidad en la formación jurídica e interdisciplinar de los futuros abogados del país, y para el debate en el mundo operativo del derecho. Entre otros asuntos, se analizan y se presentan reflexiones sobre el reconocimiento de los límites sociológicos, se cuestiona sobre quiénes son los verdaderos formalistas en la teoría de la decisión judicial, quién debe defender 10 la Constitución desde el punto de vista de Schmitt y Kelsen, se habla sobre la tutela colectiva de derechos en las nuevas tendencias procesales, se presentan reflexiones sobre el acceso a la información ambiental y el secreto empresarial, pasando por la promoción del derecho a la convivencia pacífica, la minería en Colombia, el sacrificio de la tutela judicial efectiva, el derecho privado y la sanción penal, la seguridad social y su fundamentalidad, la violación de los derechos humanos en Argentina en las décadas de los 70 y 80 y el abordaje jurídico en la salida democrática, la decisión judicial desde los derechos fundamentales, el análisis sobre la propiedad privada como derecho sin límite, para terminar con las reflexiones frente a la conciliación en la propiedad intelectual desde la constitucionalización en Colombia. Es posiblemente temprano todavía en Colombia para presentar en su totalidad los efectos de la constitucionalización del derecho, ya que se requiere promover su difusión e investigación, por lo tanto, desde la Red, se pretende abrir camino para que progresivamente se continúen los estudios sistemáticos y sistémicos frente a la importancia del tema planteado. Asimismo, se hace una resignificación de la Constitución como la norma de normas y la importancia de los principios y las reglas constitucionales, desde los productos resultados de investigación de cada uno de los autores, en donde se observa que queda atrás la doctrina de Montesquieu, referente a la constitución programática, en donde la norma constitucional debía contar con la ley, desconociendo que la Constitución tiene carácter normativo y más que ley, es considerada como la ley suprema. Se debe comprender que el proceso judicial actualmente, necesita estar humanizado, tal como lo plantea el profesor Devis Echandía, de forma tal que se procure la inmediación del juez con los justiciables, comprendiendo que se trata de actuaciones de personas que juzgan a otras personas, por lo que es tan importante tener en cuenta los derechos fundamentales, de acuerdo a los estudios de gran impacto en Latinoamérica y en el mundo de los profesores Michelle Taruffo y Domingo 11 García Belaúnde se tendría una real constitucionalización de la justicia. Por ello la academia, la investigación y los versados en el conocimiento disciplinar del derecho en Colombia, proponen difundir entre los fines esenciales del Estado–como lo establece la Constitución Política – el predominio de la convivencia pacífica, sin maltratos emocionales, jurídicos, legales o constitucionales, promoviendo la vigencia de un orden justo para todos. En manos de los diferentes operadores jurídicos, abogados defensores, jueces de la República, abogados de los consultorios jurídicos y centros de conciliación, entre otros, se encuentra el entender que las personas no solo entregan sus problemas jurídicos, legales o contractuales, sino que también entregan su confianza, su ser, una vida, un sentir, una vivencia y, por ende, una realidad o un conflicto social; y los operadores jurídicos no podemos ser inferiores a esa expectativa, porque ante todo se debe tener en cuenta lo humano, el ser holístico. La sociedad suplica jueces y operadores jurídicos que obren con sensibilidad y, en este sentido, se plantea la idea de promover, difundir, posicionar e investigar sobre la humanización con la constitucionalización de la justicia. Teniendo en cuenta todo lo anterior, se plantean los nuevos modelos procesales, precisamente en la constitucionalización del derecho procesal, humanizando el proceso judicial para cumplir la función social de interés público, entre otros, el lograr la armonía social, reconociendo ante todo al ser humano.
