Full textAs a technical standard, traceability in food and health field has been appropriate by private and institutional actors imparting it, thus, a legal meaning. This progressive way from a normative system to another has been connected to the food and health crisis context in which standardization has shown its limits. On the same way, the legal aspect of traceability has connection with the precautionary principle and presents some issues in a field linked to the risk factor and to the transformation of safety expectations in and by the law. The latter has become a privileged way of risks management, which cannot be limited to a domestic scope ; European and international areas are also concerned due to the fact that traceability - and the question of food and health safety – are interlinked with the free movement of goods. Despite the interest of the new legal norm in the risks management scope, its appropriation by the judge shows that the law has difficulties to take up a technical standard. This institutional actor is referring to this new concept with moderation though the litigation complexity of risks and the increasing technicality of law encouraged a whole appropriation. Therefore, traceability benefits from an imperfect increasing legal meaning in food and health field

Full textFood packaging is highly regulated respect to their use. European regulation CE N ° 10/2011 "Plastic Implement Measures" requires the verification of the safety of packaging on the basis of the precautionary principle. A notion of risk is associated with packaging due to a lack of knowledge of the reactivity of the molecules from the additives used and those specific from plastic. The products of reaction and/or degradation (called neo-formed) are little known or not known.The neo-formed products may occur during the lifetime of use of food packaging, from production to final use by the consumer. As part of this work, we determined the influence of two physical methods for decontamination of surfaces: pulsed light and electron-beams, on polypropylene films specifically formulated for this study.Some molecules such as oligomers (POSH) are specific of polymers. They are already present in the films before treatment and they avoid a good identification of the neo-formed molecules. The use of techniques such as liquid chromatography coupled with gas chromatography (LC-GC) or two-dimensional gas chromatography (GCxGC) is required to separate the oligomers and analyze the films and neo-formed molecules.Only the antioxidant Irgafos 168 among the molecules studied, presented reactivity after Pulsed Light treatment, it was observed the formation of several isomers from the original molecule following oxidation, or after the loss of a tert-butyl group. On the other hand, the Electron-Beam treatment generated several neoformed from all the molecules studied; in addition an increase of the oligomers was quantified.Methodologies used and the neo-formed molecules identified in this work could provide reference tools for the next studies about the effects of decontamination processes

Full textThe food safety concerns are now an important place, both nationally and internationally. This phenomenon is further strengthening under the leadership of successive food crises and the expansion of uncertain risks. The state accordingly shall undertake responsibility for risk management such as risk assessment, risk prevention, and prompt response to crisis at all stages of production, distribution and sales of food. In this context, the precautionary principle provides a mechanism for determining risk management measures or other actions to ensure the higher standard of health protection. This article, through reviewing the cases and studies in France on the precautionary principle and the control over it, aims to help better understand the principle and actively introduce it to Korea. In addition, this article presents suggestive points through a comparative study of the system and food law between France and Korea, possible improvements to implement an effective food risk management

Full textReceptive to the global management for sustainable development promoted by Agenda 21, the law of the sea founds a juridical order and a huge environmental competitiveness regulation that surpasses the environmental exception of the WTO: the universal necessity of precaution in risk management protects the marine environment. Also bound by the main objective of sustainability, the EC promotes stability and democratic governance by objectives through its global and pregnant juridical order. The EC can use the law of the sea in the areas it encompasses to strengthen European identity by integrating any object concerned by the sea and its law. Through a cybernetic frame, the integrated management of coastal zones (water, environment, fishery, navigation) may contribute to a coherent control of decentralised public policies. Full textWithin companies of social economy, the relationship between the corporation and its members is a special and unique one. This specificity derives its strength from the altruistic and ethical mind of the solidarity sector. It also draws its strength from human and financial principles that prevail in this kind of companies. Therefore, we could confirm that the guidingprinciple that most affects this relationship is that of a dual quality. This latter allows the association of the member to the social affairs of the company making it, in addition to that, actively participating throughout the process. However, this particular relationship is threatened by several factors. Some are internal and related to operating rules as well as the persistent problems in the financing of the abovementioned companies. The other factors are external and more linked to liberalism and to the globalization of trade and particularly the European policy based on free competition in the market versus capitalist societies that keep on attacking the companies of social economy for the sake of trivializing and getting rid of them

Full textUne remise en cause de cette approche est manifeste depuis le déclenchement de la crise de la " Vache folle " en mars 1996. Crise de prime abord conjoncturelle, elle a eu de nombreuses implications notamment quant au mode d'appréhension de tout le secteur alimentaire, dont elle invite à revisiter le statut juridique.
Largement réorganisé, celui-ci tend à devenir le cadre d'une action cohérente grâce à la consécration de la notion de chaîne alimentaire et au développement d'instruments adaptés à la gestion des risques. De plus, la poursuite de l'objectif de sécurité alimentaire oriente désormais toute l'action communautaire fondée sur les principes de précaution et de prévention. Ces nouvelles orientations devront être pleinement articulées avec les exigences des accords multilatéraux conclus dans le cadre de l'OMC et, par ailleurs, elles confortent, peu à peu, les droits à la protection de la santé et à l'information reconnus aux consommateurs. Faudrait-il au-delà leur reconnaître un droit fondamental à la sécurité ?

Full textPharmaceutical companies are progressively adopting and introducing the Process Analytical Technology (PAT) concept to control and ensure in real-time product quality in development and manufacturing. PAT is a key component of the Quality-by-Design (QbD) framework promoted by the regulatory authorities, aiming the building of product quality based on both a strong scientific background and a quality risk management approach.An analytical method based on near infrared (NIR) spectroscopy was developed as a PAT tool to control on-line an API (active pharmaceutical ingredient) crystallization. During this process the API and residual solvent contents need to be precisely determined to reach a predefined seeding point. An original methodology based on the QbD principles was applied to conduct the development and validation of the NIR method and to ensure that it is fitted for its intended use. Partial least squares (PLS) models were developed and optimized through chemometrics tools in order to quantify the 2 analytes of interest. The method was fully validated according to the official requirements using the accuracy profile approach. Besides, a real-time process monitoring was added to the validation phase to prove and document that the method is fitted for purpose.Implementation of this method as an in-process control at industrial plant from the launch of this new pharmaceutical process will enable automatic control of the crystallization step in order to ensure a predefined quality level of the API. Other valuable benefits are expected such as reduction of the process time, and suppression of a difficult sampling and tedious off-line analyzes
