Cet article analyse les convergences entre le droit international et le constitutionnalisme en matière de protection des droits fondamentaux. Il vise à démontrer comment le principe de la dignité humaine catalyse la construction normative et jurisprudentielle qui place l'être humain au centre de son spectre de protection. La recherche utilise la méthode hypothético-déductive, en partant de la prémisse de l'existence d'une valeur convergente entre les Constitutions et le droit international, ce qui permet de conclure que tant le développement du droit international que du constitutionnalisme ont donné naissance à un organe de protection autonome, dont l'objectif principal est devenu la protection des droits de l'homme afin de permettre l'identification des valeurs universelles à protéger, la principale étant la valeur de la dignité humaine.

Oscillant entre sa qualité de principe fondateur et sa qualité de limite à la liberté religieuse, le respect de la dignité de la personne humaine pose avec acuité le problème du port du foulard islamique dans les établissements scolaires. Il imprègne toute construction juridique entourant la protection de la personne et appelle nécessairement une conciliation entre les droits et libertés qu'il légitime. Parmi elles, la liberté religieuse, élément essentiel de la liberté d'opinion étendue à la liberté de manifester et de pratiquer sa foi, peut être invoquée au nom de la dignité humaine. Or l'extériorisation des convictions religieuses ne saurait nuire à l'ordre public en général, à l'ordre interne des établissements scolaires en particulier. Ainsi, le port du foulard islamique dans l'enceinte de ces établissements, manifestation de la liberté religieuse, doit pouvoir être toléré tant qu'il ne porte pas « atteinte à la dignité [...] de l'élève ou d'autres membres de la communauté éducative » ( Avis du Conseil d'État du 27 novembre 1989 sur le port de signes religieux). L'exercice de la liberté religieuse trouve au sein même du principe qui le fonde une limite qui ne peut être évaluée à la lueur de considérations subjectives. Si la notion même de respect de la dignité humaine renvoie à une valeur absolue et intangible, son individualisation laisse la porte ouverte à toutes les interprétations relatives et évolutives.

La recherche sur les populations permet d’améliorer nos conditions de vie en identifiant les facteurs de risque attribuables aux liens entre l’environnement et certains déterminants socio-sanitaires. Elle nécessite de vastes échantillons qui proviendront souvent de renseignements personnels ou de matériel biologique déjà recueillis. Pour les utiliser, la règle générale veut qu’un consentement individuel soit obtenu. Cependant, dans la pratique, il est souvent impossible d’obtenir un tel consentement sans affecter la qualité et la capacité de généralisation des résultats de recherche. Cette obligation de consentement est fondée sur la primauté de la personne et la dignité humaine, qui ont été intégrées dans le droit des personnes à la fin de la Seconde Guerre mondiale. Ce principe fondamental a également été inséré au coeur de l’encadrement de la recherche scientifique. La philosophie personnaliste en serait à l’origine. Cet article, après avoir établi la provenance philosophique et historique du principe de dignité humaine, tente de rétablir un certain équilibre entre les intérêts individuels et collectifs impliqués dans la recherche populationnelle.

Cet article traite de la responsabilité civile des parents pour les dommages causés au bébé médicament, un enfant né de techniques de procréation assistée. La Constitution fédérale de 1988 énonçait explicitement un certain nombre de principes, notamment le principe de la dignité de la personne humaine, la planification familiale, la responsabilité parentale et l'intérêt supérieur de l'enfant, le tout dans les relations familiales. Tout citoyen a le droit de bénéficier de la planification familiale gratuite. Cependant, il est à prévoir que ni les techniques de reproduction ni le comportement des parents ne causeront de préjudice à la progéniture. Dans la discussion sur les techniques, décrit celles permises par le Conseil fédéral de médecine par le biais de la résolution n. 2168/2017, car il n'y a pas de législation spécifique au Brésil, contrairement à plusieurs pays. Jusqu'à récemment, il était impossible de penser à l'application de l'institut de la responsabilité civile dans les relations familiales, mais il semble que cette idée ait déjà été dépassée et que les tribunaux brésiliens reçoivent de plus en plus ce type de demande. En ce qui concerne les dommages causés par les techniques de procréation assistée, nous pouvons citer les cas de production du médicament pour bébé, générer des fils prémédités avec carence et la production indépendante hétérosexuelle et homosexuelle. Il appartiendra au pouvoir judiciaire de trancher ces questions en tenant compte des principes de la dignité de la personne humaine, de la responsabilité parentale et, en particulier, de la protection intégrale et du meilleur intérêt de l'enfant.

Cet article aborde la question de l'égalité des membres dans l'Église catholique romaine à partir des perspectives de Hannah Arendt sur l'égalité politique. Ces perspectives permettent de voir que la proclamation d'une égalité de dignité ne suffit pas à ébranler un mode de gouvernement autoritaire. L'aménagement institutionnel d'une égalité réelle déborde les pétitions de principe; il engage la dimension politique de l'existence humaine, dimension centrée sur l'exercice public de la parole et la responsabilité commune à l'égard du monde. Le déploiement de cette dimension dans l'Église supposerait une révision du statut théologique du monde et de celui de l'action.

Les nouvelles sectes ne sont pas des groupements religieux comme les autres. Leur organisation et leur fonctionnement mais aussi leurs doctrines, dogmes et préceptes forment une logique particulière à partir de laquelle s'établissent et se développent des pratiques qualifiées de sectaires. Celles-ci sont une menace pour les droits et libertés des personnes — majeures et mineures — qui appartiennent à ce type de groupements. La nocivité des nouvelles sectes pour les adeptes s'oppose ainsi directement à la notion de dignité de la personne. Or, cette notion a acquis une valeur juridique eminente en droit français, à la fois principe à valeur constitutionnelle et composante de l'ordre public. Elle constitue par là même le fondement de la politique de lutte contre les dérives sectaires engagée par les pouvoirs publics. Pour autant, cela ne signifie pas que la protection de la personne contre elle-même soit pleinement assurée. C'est donc la question de l'étendue de la protection de ces personnes qui se pose.

Le principe de base aussi bien de notre droit positif que du droit naturel est celui du respect de l’être humain et de sa dignité. Ce principe, non contesté, constitue le critère d’évaluation du droit. Ce critère permet donc de déterminer la relation de l’être humain au travail, notamment dans le cadre du travail rémunéré où il se trouve à perdre une partie de sa liberté. L’être humain devant toujours être une fin en soi, et jamais un moyen utilisé à d’autres fins, il en découle que « le travail doit être fait pour l’homme et non l’homme pour le travail ». Ce principe une fois posé, permet de vérifier si l’organisation actuelle du monde du travail respecte ce paramètre incontournable. Les faits révèlent que tel n’est pas le cas, en raison de la méconnaissance des obligations personnelles et familiales des travailleurs et de la durée excessive du temps travaillé. Les raisons en sont multiples et généralement peu conscientisées. Si diverses solutions sont envisageables, la seule diminution généralisée de la semaine de travail, bien que souhaitable, ne constitue pas la solution adéquate, puisqu’elle ne solutionne pas l’inadaptabilité du monde du travail aux besoins personnels. Dans la mesure où le non-respect des personnes relève de la rigidité de l’organisation du monde du travail et de l’impossibilité d’adapter ses exigences aux nécessités personnalisées et diverses de la vie de chacun, c’est sur ce point que doit porter l’intervention. Dans la mesure où plusieurs des facteurs s’opposant au libre choix du temps travaillé découlent en fait, directement ou indirectement, du droit, il est possible de corriger cet état de fait en modifiant un certain nombre de règles. Dans un tel domaine, l’intervention du législateur est à la fois une nécessité et une obligation puisque c’est lui, et lui seul, qui peut se situer au-dessus des intérêts divergents des divers intervenants et prévoir les conséquences indirectes à long terme de mesures apparemment favorables, mais en fait nuisibles pour la liberté de choix.

L’art de juger, tout comme ses notions connexes, l’acte de juger ou la faculté de juger, sont au coeur de la pensée juridique dans les traditions tant civilistes que de common law. Il appartient aux juges de réinterpréter l’héritage juridique en confrontant celui-ci aux valeurs et aux principes qui fondent la justice dans la société contemporaine. L’acte de juger devient un acte de culture, une façon de rappeler ou de dénoncer les consensus sociaux afin d’ajuster le droit à la réalité sociale. Par-delà les frontières et les ordres de juridiction s’instaure un dialogue incitant les juges à mettre en oeuvre une sorte de droit mondialisé marqué par la rationalité économique et le respect du principe de la dignité de l’être humain. L’acte de juger, surtout depuis l’avènement des chartes, est devenu un acte politique. Cela exige des juges une ouverture aux nouvelles perspectives sociales, philosophiques et politiques et l’adoption de nouvelles méthodologies à caractère plus sociologique et plus scientifique. Une analyse, sans doute imparfaite et incomplète, de quelques opinions du juge Louis LeBel pendant sa carrière à la Cour suprême du Canada, suggère le regroupement de ses choix méthodologiques sous trois titres principaux : le dialogue des cultures, la rhétorique des droits constitutionnels et l’avenir du droit. La protection des droits collectifs et la recherche d’une nécessaire réconciliation des valeurs communes fondamentales sont, pour le juge LeBel, des éléments essentiels à la survie d’une démocratie fondée sur la primauté du droit.

L'interaction sociale dans la société traditionnelle européenne, comme dans toute société, s'exprime à travers un code implicitement connu des participants. Si l'on accepte l'idée d'Erving Goffman que ces rapports sociaux avec l'engagement des moi de chacun, sont potentiellement dangereux, l'adhésion à un code ou à un rituel, constitue un respect de l'ordre social et protège la dignité des personnes. Le rituel devient alors l'instrument permettant aux individus de s'adapter aux structures sociales de leur milieu.Dans la France méridionale du xviiesiècle, les relations interpersonnelles ainsi codifiées, fournissent un bon exemple du danger potentiel. Le trait essentiel de cette sociabilité est l'extériorité des rapports et un comportement extraverti à l'usage de tous. Chacun, s'imaginant acteur sur l'agora local, tâche de jouer son rôle de manière à apparaître un peu plus important que son statut objectif ne le permet. Il faut tenir la tête haute et prodiguer des bravades, afin de prouver que l'on n'est pas sans importance, tout en restant en deçà des « fanfaronnades » ridicules. Le principe guidant la conduite individuelle, décrit si magistralement par Yves Castan, est d'exiger le maximum de reconnaissance pour soi, tout en accordant le minimum possible à autrui.

Cet article porte sur la notion d’État de droit dans le cadre d’un nouvel ordre international. La notion de droit consacre en quelque sorte sa prédominance générique au sein de l’Europe et tout particulièrement depuis la division physique et idéologique de ce continent. Le droit à la santé soulève quelques questions dans les pays où ce domaine est complètement envahi par les lois et un contexte économique ingrat. Le droit de la santé a été reconnu par la Constitution française en 1946 et désormais on voudrait qu’il soit reconnu comme une obligation par l’État et non seulement comme un simple idéal à réaliser. La Constitution de 1946, au sujet du droit de la santé a pris force constitutionnelle seulement depuis la décision rendue par le Conseil constitutionnel du 16 juillet 1971. D’abord, il faut voir quelle place aura le droit de la santé dans les paramètres constitutionnels en analysant les bases de la Constitution française en parallèle au droit à la protection de la santé, ainsi que le rôle et la place qu’a joués l’histoire dans la reconnaissance de ce droit. En effet, la Révolution de 1789 a affirmé les droits politiques mais a négligé considérablement les droits sociaux. Ce n’est qu’à l’arrivée de la Constitution du 4 novembre 1848 qu’il y eut un certain élargissement et que les droits sociaux ont eu une poussée fulgurante dans la sphère judiciaire. De plus, la question fondamentale sur le droit universel de la personne humaine sera fort importante dans la dénonciation du droit à la santé; plus précisément le caractère récent de la reconnaissance constitutionnelle du droit à la protection de la santé. Il est certes important de prendre en compte ce droit puisqu’il est reconnu et retenu dans le cadre du droit international des droits de l’homme. Alors que le droit à la santé peut être considéré comme un droit autonome et que dans les autres cas il n’est que le corollaire d’un autre droit constitutionnel, il faudra se pencher sur la nature juridique de la protection constitutionnelle de la santé pour en connaître ses tenants et aboutissants. Finalement, il faudra voir quelle sera la portée de la protection de la santé et la protection du corps humain, soit le principe de la dignité de la personne humaine. Nous constaterons que le Conseil constitutionnel a su mener progressivement le droit à la protection de la santé sur le chemin d’une reconnaissance effective notamment en reconnaissant le caractère essentiel du droit de la santé dans la société et ce, en passant par la notion de dignité humaine.

Embora não haja uma legislação específica sobre violências psicológicas no ambiente de trabalho, o judiciário tem apresentado um recente e crescente reconhecimento jurídico do tema, norteando-se, principalmente, por princípios constitucionais e de proteção à saúde do trabalhador. O objetivo deste artigo é demonstrar como tem ocorrido o reconhecimento jurídico da proteção à saúde psicológica no ambiente de trabalho. Résumé Au Portugal, l'intervention de l'État visant les mineurs reste orientée, aujourd'hui encore, par le modèle welfare. Il est toutefois bien connu que la philosophie de base de la protection (où les mesures applicables sont indistinctement destinées à des mineurs en danger et à des mineurs délinquants et visent la protection pour les deux groupes) a été mise en cause de façon généralisée. La nécessité de réforme du système est urgente. Dans ce sens, deux Commissions de réforme ont présenté des projets sur l'intervention tutélaire éducative, sur le régime spécial applicable à des jeunes adultes délinquants et sur la protection des enfants et jeunes en danger. Pour ce qui concerne l'intervention tutélaire éducative (qui vise les mineurs délinquants), on a fixé à 12 ans l'âge minimum requis pour intervenir et à 16 ans l'âge de la majorité pénale. Cette intervention obéit à trois présupposés : la commission d'un fait considéré par la loi comme une infraction ; la nécessité de corriger la personnalité du mineur en rapport avec les normes socio-juridiques telle qu'elle s'est manifestée dans la commission de l'acte; et finalement l'exigence que cette nécessité subsiste au moment de l'application de la mesure. La procédure adopte une orientation où s'allient formalité et consensus, à la recherche d'une efficacité liée à trois notions : celle de la dignité du mineur, celle du temps procédural et celle du besoin d'inter-relation entre exigences d'éducation et nécessités de protection. Quant aux mesures applicables - le principe de leur spécificité s'imposant -, leur énumération est faite avec une certaine flexibilité quant au contenu et aux modalités d'exécution. On crée en outre un régime pénal spécial pour des jeunes âgés de 16 à 21 ans (jeunes adultes). L'idée fondamentale est ici d'éviter l'application de peines de prison à ces jeunes. On a reconnu, toutefois, que cette réforme de la législation de la justice des mineurs doit être précédée d'une revitalisation des réponses au niveau social. C'est dans cette perspective que s'inscrit le projet de politique sur la protection des enfants et jeunes en danger (jusqu'à 18 ans).

Il dibattito sul fine-vita in pediatria negli ultimi tempi ha mostrato di incagliarsi quando viene usato come principio decisionale il cosiddetto best interest del bambino, dato che esso è solitamente invocato sia dai fautori della prosecuzione delle cure sia da quelli della sospensione. Il best interest è un principio troppo elastico per essere usato in maniera semplice e rispettosa della vita e della dignità del paziente in maniera inequivocabile. In questo articolo si propone un protocollo chiamato “pain principle”, che a) misura il livello di sofferenza del soggetto, valuta se questa sia eliminabile, e in caso di dolore insopportabile passa al punto b): la diminuzione dell’intensità e invasività delle cure. Questo protocollo ha il vantaggio di evitare la sofferenza inutile, di ridurre al minimo il soggettivismo delle scelte e di non provocare mai intenzionalmente la morte del paziente, rispettandone al tempo stesso la dignità. ---------- The debate on end-of-life in pediatrics has recently proved to be stranded when the so-called best interest of the child is used as a decision-making principle, since it is usually invoked by both advocates of treatment and those of suspension. The best interest is a principle too elastic to be used in an unequivocal manner. In this article we propose a protocol called “the pain principle”, which imposes to a) measure the level of suffering of the subject, assesses whether this is eliminable, and – in the case of unbearable pain – b): to decrease intensity and invasiveness of care. The pain protocol has the advantage of avoiding unnecessary suffering, of minimizing the subjectivism of choices and of never intentionally causing the patients’ death, respecting their dignity as well.

The comparison shows that the principle of culpability is more closely related to human dignity in German law and that it carries more weight there than in Israeli law. However, the adoption of the Basic Law: Human Dignity and Liberty and the new General Part of the Israeli Criminal Code in the 1990's have increased the role and impact of the principle of culpability in Israeli law.

Human dignity has become one of the central issues in the international discussion of human rights and constitutionalism. It attracted special attention with the celebration of the sixtieth anniversary of the 1948 Universal Declaration of Human Rights adopted by the United Nations and, more recently, scholars have sought to explore human dignity's legal meaning in more theoretical terms, as well as to survey and catalogue its different manifestations across a number of legal systems worldwide. This article contributes to the international debate about human dignity's legal significance by focussing on another dimension, namely the ways in which the concept is understood and used in European constitutionalism, where it has been deployed since the end of World War II and its importance has become undisputed.

Sur le plan des principes, ce sont surtout les notions de nature humaine et de préséance de l’esprit qui s’imposent comme fondements; sur le registre de l’expérience, Thomas de Koninck accorde beaucoup d’importance à la solidarité ainsi qu’à l’hospitalité et à la vulnérabilité. Dans mes remarques, je commente ces choix au regard de la question philosophique de l’universalité des droits, et je montre les liens de la pensée du philosophe avec l’éthique de John Rawls et avec celle de Kant, en particulier pour le concept de fin en soi.

The use of cyber-technologies in times of armed conflict poses serious interpretive challenges, such as what type of cyber operations amount to an ‘attack’ for the purposes of Article 49 of Additional Protocol I. The notion of attack is the cornerstone of the law of targeting, a set of rules that includes the principles of distinction, proportionality and precaution, aimed at limiting the amount of violence that belligerents can lawfully employ on the battlefield. The rationale of these rules is that of increasing the protection of the dignity of the civilian population, which constitutes the main objective of modern international humanitarian law (IHL). In light of these considerations, my article argues that the prevailing interpretation of the notion of attack in the cyber context is too restrictive and cannot adequately protect the civilian population from cyber operations taking place in armed conflict. Consequently, it argues for a human-dignity based interpretation of the notion of ‘violence’ that underlies the notion of attack in the cyber context, going beyond the mere causation of physical violence to include serious psychological violence and serious economic violence as necessary prerequisites to qualify a cyber operation as an ‘attack’. L’utilisation des cybertechnologies en période de conflit armé soulève d’importantes questions d’interprétation, notamment sur le type de cyberopération qui peut être considérée comme une ‘attaque’ au sens de l’article 49 du protocole additionnel I. La notion d’attaque est la pierre angulaire du droit du ciblage, un ensemble de règles comprenant les principes de distinction, de proportionnalité et de précaution, visant à limiter le degré de violence que des belligérants peuvent légalement utiliser sur le champ de bataille. La raison d’être de ces règles est de renforcer la protection de la dignité de la population civile, qui constitue l’objectif principal du DIH moderne. À la lumière de ces considérations, l’article avance que l’interprétation dominante de la notion d’attaque dans le contexte cybernétique est trop restrictive et ne peut pas protéger efficacement la population civile des cyberopérations lors de conflits armés. Par conséquent, l’article plaide pour une interprétation de la notion de ‘violence’, sous-jacente à la notion d’attaque dans le contexte cybernétique, basée sur la dignité humaine, allant au-delà de la seule violence physique pour inclure la violence psychologique grave et la violence économique grave dans les conditions pour qu’une cyberopération puisse être qualifiée d’ ‘attaque’. Het gebruik van cybertechnologieën in tijden van gewapend conflict stelt ons voor serieuze interpretatieve uitdagingen, zoals de vraag welk type cyberoperaties neerkomen op een 'aanval' in de zin van Art. 49 van het Aanvullend Protocol I. Het begrip aanval is de hoeksteen van het recht van doelbestrijding, een geheel van regels dat de beginselen van onderscheid, evenredigheid en voorzorg omvat, en dat tot doel heeft de hoeveelheid geweld te beperken die oorlogvoerende partijen rechtmatig op het slagveld kunnen aanwenden. De grondgedachte achter deze regels is de bescherming van de waardigheid van de burgerbevolking te vergroten, hetgeen de voornaamste doelstelling van het moderne IHR is. In het licht van deze overwegingen betoogt mijn artikel dat de gangbare interpretatie van het begrip aanval in de cybercontext te restrictief is en de burgerbevolking niet adequaat kan beschermen tegen cyberoperaties die plaatsvinden in een gewapend conflict. Bijgevolg wordt gepleit voor een op menselijke waardigheid gebaseerde interpretatie van het begrip ‘geweld’ dat ten grondslag ligt aan het begrip aanval in de cybercontext, waarbij verder wordt gegaan dan het louter veroorzaken van fysiek geweld en ook ernstig psychologisch geweld en ernstig economisch geweld worden beschouwd als noodzakelijke voorwaarden om een cyberoperatie als een ‘aanval’ te kunnen aanduiden. El concepto de ataque es la piedra angular de la ley de selección de objetivos, un conjunto de reglas que incluye los principios de distinción, proporcionalidad y precaución, destinados a limitar la medida de violencia que los beligerantes pueden emplear legalmente en el campo de batalla. La razón fundamental de estas normas es aumentar la protección de la dignidad de la población civil, que constituye el principal objetivo del DIH moderno. A la luz de estas consideraciones, este artículo sostiene que la interpretación predominante del concepto de ataque en el contexto cibernético es demasiado restrictiva y no puede proteger adecuadamente a la población civil frente a las operaciones cibernéticas que tienen lugar en un conflicto armado. La logica di queste regole è quella di aumentare la protezione della dignità della popolazione civile, che costituisce l'obiettivo principale del moderno IHL. Alla luce di queste considerazioni, l'articolo sostiene che l'interpretazione prevalente della nozione di attacco nel contesto informatico sia troppo restrittiva e non possa proteggere adeguatamente la popolazione civile dalle operazioni informatiche che si svolgono in conflitti armati. Il diritto alla tutela della salute, che include l’accesso ai servizi sanitari, è sancito in molte Dichiarazioni e altri documenti normativi a livello internazionale. Il riferimento all’equità è solitamente introdotto per affrontare i vincoli delle risorse disponibili e non eludere la realtà di persistenti diseguaglianze. Il riferimento all’adeguatezza è volto a sottolineare il ruolo delle competenze professionali e della conoscenza e dei progressi scientifici al fine di soddisfare esigenze reali, ma anche di ottimizzare l’utilizzo delle risorse. L’articolo 3 della Convenzione di Oviedo mira a proteggere i diritti umani e la dignità della persona umana e offre ancora un proficuo punto di partenza per continuare a sviluppare alcuni dei più preziosi strumenti concettuali e giuridici fra quelli perfezionati in questi ultimi decenni per affrontare questa sfida: il principio della realizzazione progressiva, che può innescare e rafforzare una dinamica emancipatrice; l’esercizio del bilanciamento di principi, interessi e beni sia nella giurisprudenza delle Corti costituzionali sia nelle politiche di settore; il concetto del contenuto essenziale del diritto ai servizi sanitari. Queste soluzioni si confrontano ora con le applicazioni dei progressi nuovi e senza precedenti della scienza biomedica, come la medicina di precisione. The reference to equity is usually meant to deal with the constraint of available resources and not elude the reality of persisting inequalities. The reference to appropriateness is to underline the role of professional competence and scientific knowledge and progress in order to fit real needs, but also to optimize the use of resources. Article 3 of the Oviedo Convention aims at protecting both human rights and the dignity of the human being and still offers a fruitful starting point to elaborate on some of the most valuable conceptual and juridical tools that have been refined over these last decades to address this challenge: the principle of progressive realization, which can trigger and strengthen an emancipatory dynamic; the exercise of balancing principles, interests and goods both in the case law of Constitutional Courts and in policies; the concept of the core content of the right (entitlement) to health care services. These solutions are now confronted with the applications of new, unprecedented advancements of biomedical science, such as precision medicine. At the same time, the reference by the Convention to the jurisdiction of the Parties (the States) as the institutional framework within which obligations are undertaken needs to be further articulated against the global scope of the commitment to ‘protect’ human dignity and human rights.

Diante dos aspectos metafísicos que guarda em seu bojo, o princípio da dignidade humana abre espaços para críticas sobre a consistência e a coerência do referido princípio no plano legislativo e, notadamente, nos cenários jurisdicionais. Por fim, conclui-se que, enquanto a reputação baseada na dignidade for uma virtude universal, seu conteúdo depende largamente de valores sociais, religiosos e tradicionais de certas comunidades.

Catholic philosophers must therefore defend this principle in service to Catholic theology. One aspect of this defense is how the human person relates to the universe. Is human dignity of a piece with the material universe in which we find ourselves? Or is our dignity alien in kind to such a whole? Or does the truth lie somewhere in between? The metaphysics of creation properly locates the human being in the universe as a part, ordered to the universe’s common good of order and ultimately to God. Human dignity is possible only in a cosmos; that this is concordant with modern scientific cosmology is briefly defended in the conclusion.

Kantian respect for persons is based on the special status and dignity of humanity. There are, however, at least three distinct kinds of interpretation of the principle of respect for the dignity of persons: the contractualist conception, the substantive conception and the direct conception. Contractualist theories are the most common and familiar interpretation. The contractualist assumes that some form of consent or agreement is the crucial factor that is required by respect for persons. The substantive conceptions of dignity, on the other hand, treat the concept of dignity as a substantive value that justifies a deontological conception of respect for persons. A third conception of respect for the dignity of persons, the conception that I favor, focuses directly on the special value of our rational nature. According to this consequentialist conception, we respect the dignity of persons by promoting the flourishing of rational nature.

The principal of human dignity, that respects the dignity of humanity and human dignity is the main foundation of human rights. It is an indicator of the humanity that distinguishes it from all creatures. Human Rights in Islam refer to the set of Islamic laws aimed at preserving the betterment of human in accordance with the nature of humanity for noble survival.This article aims to discuss the whole spectrum of the principle of human dignity in al - Quran al - Karim and the uniqueness of these principles through descriptions of related selected Quranic verses. The main description of the fundamentals of human dignity in this article is extracted from Surah al - Isra ' , verse 70 based on document analysis, through the books of Quranic Exegesis and the references which are related to human rights in Islam. As a result, the study shows that the foundations of human dignity described in this paragraph are interrelated and complement each other . Manifestations of human rights through this human dignity principle are collected within five ( 5 ) items and its privileges declared in al - Quran al - Karim is also exposed to the five ( 5 ) items . This also shows a significant difference compared to the principles of human rights proclaimed in international law or other religions as Islam put the Human Dignity as the main foundation of human rights.

Karamah insaniah, iaitu menghormati martabat keinsanan dan maruah manusia adalah merupakan asas utama dalam hak asasi manusia yang dititikberatkan dalam al-Quran al-Karim. Hak Asasi Manusia (HAM) dalam Islam merujuk kepada himpunan hukum-hukum syarak yang bertujuan untuk memelihara kemaslahatan manusia yang sesuai dengan sifat-sifat kemanusiaannya demi kelangsungan hidup yang mulia. Prinsip karamah insaniah merupakan indikator keinsanan manusia yang membedakannya daripada sekalian makhluk. Artikel ini bertujuan untuk membincangkan secara menyeluruh mengenai karamah insaniah dalam al-Quran al-Karim, dan ciri-ciri keistimewaannya melalui analisis ayat-ayat terpilih yang berkaitan. Huraian utama mengenai asas-asas karamah insaniah oleh Allah s.w.t dalam artikel ini dicerakinkan daripada surah al-Isra’, ayat 70 melalui analisis daripada kitab-kitab tafsir dan rujukan berkaitan HAM dalam Islam. Hasilnya, kajian mendapati bahawa asas-asas karamah insaniah yang dinyatakan dalam ayat ini adalah saling berkait dan melengkapi antara satu sama lain. Manifestasi prinsip karamah insaniah dalam al-Quran al-Karim ini terhimpun dalam lima (5) perkara, dan ciri-ciri keistimewaannya yang dinyatakan dalam al-Quran juga dapat dirumuskan kepada lima (5) perkara. Hal ini membuktikan bahawa prinsip hak-hak asasi manusia dalam Islam adalah yang perbezaannya yang ketara berbanding prinsip hak-hak asasi manusia yang dicanangkan dalam undang-undang antarabangsa mahupun agama lain. Ini kerana, Islam menjadikan karamah insaniah sebagai asas utama HAM.

The article under studies is a complex analysis of the essence of the notion of human dignity” as a system-forming category that comprises the doctrine of the present-day right to social protection. It reveals the basic conceptual approaches to the notion of “human dignity” and regards the latter as an indispensable feature of a social state. Particular emphasis has been laid on the fact that the genesis of the doctrine of human dignity is traditionally associated with the ideas about human rights. It has also become the basis for natural law and universal human rights. Human dignity has a dual nature. It may be regarded as an objective phenomenon, which is common for all individuals (value, principle, the source of human rights, the latters’ essence and objectives), as well as a subjective right or interest of any person. The article distinguishes theological, philosophical and legal approaches to understanding the essence of human dignity. It ascertains that the principle of ensuring respect for human dignity is present in practically all world standards on human rights and is the most essential sample and criterion for assessing the efficiency of any social policy. Human dignity is a significant anthropological and cultural value of every human, the source of his / her right to social protection. In this respect, it is essential to comprehend the legal position of the Constitutional Court of Ukraine concerning the protection of human right to respect for human dignity, as well as to identify the main objective of a social state – to ensure each citizen’s decent standard of living. It has been accentuated that the right to respect for human dignity acquires peculiar system-forming significance within a social state, since the whole range of individual’s social rights relies on it. Person’s decent standard of living completely depends on the implementation of these rights. Within the right to social protection, it is expedient to consider the notion of “human dignity” as a fundamental value that promotes the emergence of all other values; as a basic principle of any law; as an absolute natural law; as the obligation not to encroach upon the dignity of other individuals; as a source of the entire complex of all human rights and freedoms. The article also contains the description of major features of human right to dignity: natural character; inalienability and inviolability; absoluteness; universality; social significance and dependence on socio-historical conditions of society.

The aim of this paper is to show, contra the right-libertarian critique of social justice, that there are good reasons for defending policies of social justice within a free society. In the first part of the paper, we will present two influential right-libertarian critiques of social justice, found in Friedrich Hayek?s Law, Legislation and Liberty and Robert Nozick?s Anarchy, State and Utopia. Based on their approach, policies of social justice are seen as an unjustified infringement on freedoms of individual members of a society. In response to this critique, we will introduce the distincion between formal and factual freedom and argue that the formal principle of freedom defended by Hayek and Nozick does not suffice for the protection of factual freedom of members of a society, because it does not recognize (1) the moral obligation to help those who, without their fault, lack factual freedom to a significant degree, and (2) the legal obligation of the state to protect civic dignity of all members of a society. In the second part of the paper, we offer an interpretation of Kant?s argument on taxation, according to which civic dignity presupposes factual freedom, in order to argue that Kant?s justification of taxation offers good reasons for claiming that the state has the legal obligation to protect factual freedom via the policies of social justice.

The article investigates the understanding of the concept of human dignity in the Catholic social doctrine and secular legal declarations aimed at the protection of personality rights. It is shown that notwithstanding the essential basic prerequisites, the concept of human dignity is foundational for the solution of new social problems. Consequently, human dignity is a basis for a fruitful dialog between the Catholic Church and world in order to create the society of peace, respect and well-being. It is proved that the turn to the systematic use of human right language and the strategies of the protection of human dignity occurred during the Second Vatican Council. This process is a part of the anthropological turn of the Christian religion within the global transformations of religious worldview in the age of late modern and postmodernism. Refreshment of the social teaching of Catholicism occurs within the last encyclical “Fratelli tutti” by the Pope Francis. The principle of the absolute value of human dignity becomes primary for the social teaching of the “Fratelli tutti” encyclical by the Pope Francis. This principle is fully substantiated. The Pope recognize that the absoluteness of human dignity is not obvious for the contemporary social discourse, the personality is more and more reduced to the individual who can be manipulated destroying the natural context of life which for the individual have always been communities. The Pope provides arguments about the dignity of the individual, which are revealed through faith, love, reflection and social dialogue.

An army attacks a neighborhood where the enemy is hiding among civilians. To what extent is the army required to expose its combatants to life-threatening risks in order to spare enemy civilians? This Article seeks to interpret the pertinent standards and rules of international law from the perspective of the principle of human dignity. The human dignity principle informs the interpretation of the law on the conduct of hostilities and provides a built-in mechanism for improving armies' treatment of enemy civilians. It inspires additional remedial and institutional norms that could overcome armies' distrust of each other during the height of battle. The principle of human dignity recognizes a general duty to strive to reduce harm to enemy civilians as well as specific rules against using them as human shields, hostages, or objects for retaliation. This Article concludes that in general there is no requirement to risk combatants to reduce the risk to enemy civilians, although a number of the specific rules do entail the assumption of such risks.

Human dignity is the nature of a human being. It became a modus of human existence, which differentiates humans from other biological species. Human life and human dignity are declared the priority values in international conventions and declarations. Intrinsic character of human dignity was the forerunner for the development of the new multidiscipline named bioethics in the XX century. This article begins with the basics of international regulations in the field of human dignity, definitions, analysis of main characteristics and doctrines of human dignity, inherent values and constitutional values. Further the author stresses the importance of understanding the meaning of inherent human dignity in connection with manipulations with somatic rights. The author concludes that the lack of human life and human dignity evaluation is the main point of the core principle of inherent human dignity based on personal selfawareness. In this regard the article focuses on the statement that human dignity should be an absolute value based on bioethical principles. Then the author goes on to compare constitutional values and human dignity as a value. The research is concluded with the suggestion that inherent human dignity is a base of constitutional values in the particular field of legal relations. In addition, inherent dignity may be the framework of constitutional values.

Abstract In this article are presented situations in which the feeling of dignity of a person is lost or decreases and cannot be restored without professional intervention. This loss is one of the reasons of social exclusion in communities. A person with social issues has no abilities to emphasize her/his own uniqueness and authenticity, s/he stops to progress physically, intellectually and spiritually. In this way these persons enter the field of social worker’s help. In this field of help, one of the main factors in the restoration of human dignity is the social worker her/himself: her/his personality can have a huge influence on his client. The main research question in this study is the following: How should a social worker construct the helping process to help the client to restore her/his human dignity? Research object was the social worker’s help in the process of the restoration of human dignity. Research aim was to reveal the elements of the social worker’s support process that help to restore human dignity. Analysis of the reseach-based conceptual literature was the core method to explore and reveal the answers to research questions. The findings of the analysis highlighted that in situations, when people loose their feeling of dignity within social exclusion then they experience the self-deprecating. In the process of social help a main role is played by social worker’s professional communication with the client: the social worker stimulates the maintenance and restoration of client’s dignity by applying the principle of acting together. This principle is based on moral values, reciprocal responsibility, mutual respect, sincerity, confidentiality and empathy. These components create a trustful environment where, by sustaining client’s free choice and a right of decision, the possibility to achieve client’s openness emerges.
