In response to the 9/11 attacks and continuing threats of mass-casualty terrorism, the United States has adopted a new security strategy that emphasizes anticipatory actions including preventive war. Prevention, undertaken in the absence of an act of aggression or an imminent threat, is prohibited by modern conceptions of just war and international law. Many critics of the strategy fear that any legitimization of preventive war would endanger international stability. But an examination of the relevant ethical issues from the perspective of just war doctrine reveals contradictions within a blanket prohibition of preventive war. Preventive "strategic interventions" against illiberal regimes-states that correlate with the threats of terrorism and weapons of mass destruction-parallel humanitarian interventions in that they have an ethical basis in the relationship between human rights and the right of state sovereignty. A widely-accepted minimum standard of human rights, incorporated into new international institutions and/or an explicit revision of the definition of just war, could serve as an ethical boundary for both preventive wars and humanitarian interventions. The formal qualification of prevention and its merger with humanitarian goals could bring enhanced international legitimacy and support to preventive actions by the United States and its allies.

This Senior Thesis in Environmental Analysis seeks to explore the ways in which certain food-oriented programs for incarcerated women and women on parole critically resist the Prison Industrial Complex and the Industrial Food System by securing social and ecological equity through the acquisition of food justice. It focuses on three case studies: the Crossroads’ Meatless Mondays program, Fallen Fruit from Rising Women: A Crossroads Social Enterprise, and Cultivating Dreams Prison Garden Project: An Organic Garden for Women in Prison. Each project utilizes food as a tool to build community, provide valuable skill sets of cooking and gardening, and educate women about the social, environmental and political implications of the Industrial Food System. Overall, the goal of this thesis is to prove the necessity of food justice programs in the criminal justice system in counteracting the disenfranchisement of certain populations that are continuously discriminated against in the industrialized systems of prison and food.

Abstract:
The main argument of this thesis is that the penitentiary crisis in Venezuela is brought about an inept criminal justice system whose functioning (or lack thereof) further exacerbates overcrowding in penitentiary facilities as well as violates the most basic human rights. More elaborately, I argue that the unintentional (mis)use of pre-trial preventive detention, one of the consequences of the inept criminal justice system, further exacerbates the overcrowding in prisons and creates serious human rights implications. The purpose of this study is to establish a connection between the penitentiary crisis in Venezuela, with a focus on pre-trial preventive detention, and the larger criminal justice system failure in the country. The data source and data gathering technique for the thesis consists of a content analysis and a secondary literature review. Since the theoretical framework of the project is international human rights, instruments from the United Nations and the Organization of American States are used. Reports from non-governmental organizations like Amnesty International, Human Rights Watch, and Observatorio Venezolano de Prisiones provide the data to conduct the analysis which is specific to pre-trial preventive detention in Venezuela. These reports are produced on a yearly basis and will help to compliment the data obtained from government sources, mainly the Venezuelan Ombudsman's office. The findings of the thesis support the argument that contrary to common belief, the (mis)use of pre-trial preventive detention in Venezuela is in fact mainly accidental, it is not systematic in the sense that it is not targeting a particular group of people due to their political affiliation and/or beliefs. Furthermore, I prove that Venezuelan penitentiary facilities are overcrowded due to the (mis)use of pre-trial preventive detention. Immediate recommendations for the Venezuelan state include re-categorizing the penal population in Venezuela as well as diminishing the use of deprivation of liberty, specifically pre-trial preventive detention.

A jurisdicionalização das demandas sociais e políticas acontece nas sociedades democráticas ocidentais a partir do segundo pós-guerra. Tal fenômeno encontra-se estampado nas causas submetidas ao julgamento dos desembargadores do Tribunal de Justiça do Estado do Rio Grande do Sul, que versam sobre o aborto preventivo. Nas referidas demandas, o magistrado é instado a se pronunciar sobre tema de grande relevância social, muitas vezes em face da omissão da lei, valendo-se de conceitos de outras áreas do conhecimento para amparar o seu julgamento. Questiona-se de que forma as suas convicções pessoais, filosóficas, religiosas e, de formação, influenciam, ou não, nestas decisões. A perda da autoridade é apontada como uma das causas da jurisdicionalização, tendo em vista que nas sociedades tradicionais o conselheiro espiritual, o chefe de família, o médico ou o sacerdote, decidiam questões vinculadas à tomada de decisões éticas, religiosas e políticas. Os juízes, frente à perda de autoridade das magistraturas sociais, se comportam como últimos guardiões da democracia em nossas sociedades contemporâneas. O trabalho demonstra de que forma os desembargadores gaúchos, enquanto atores sociais, interpretam este papel, esclarecendo a existência, ou não, de algum desconforto ao tomarem tais decisões. O lugar em que é cumprido seu papel é aquele próprio de uma estrutura burocrática do Estado racional, com as consequências que decorrem de tal situação. A decisão judicial e a decisão médica, ainda que possuindo semelhanças, se diferenciam, porquanto esta última se funda em uma relação de confiança, enquanto a outra gera uma desconfiança. O trabalho comprova que nas demandas que versam sobre o aborto preventivo surge a temática da lógica dos problemas do corpo, que aflige o cidadão contemporâneo, em sua crise de identidade. Neste contexto, a sociedade de hoje não requer tão somente o conselho do sacerdote ou a prescrição do médico de família, mas também a decisão do magistrado, que deve pronunciar-se quando ocorrerem dúvidas a respeito desse assunto.
The jurisdictionalization of the social and political pleas happens in the western democratic societies from the second post-war period on. Such phenomenon is clear in the causes submitted to the Court judges’ trial of the Rio Grande do Sul State Court of Justice, that deals with preventive abortion. In the above mentioned pleas, the magistrate is urged to assert about a theme of great social importance, many times due to the law omission, using other areas knowledge concepts to support their trial. It is questioned in what way the magistrate personal, philosophical, religious and of formation convictions influence or not, on these decisions. The loss of authority is pointed as one of the causes of the jurisdictionalization , having in mind that in the traditional families, the spiritual counselor, the family head, the doctor or the priest, used to decide the issues linked to the ethical, religious and political decisions. The judges, considering the loss of authority of the social magistracies, behave as the last democracy guardians in our contemporary societies. This study demonstrates in what way the Rio Grande do Sul magistrates, as social actors, interpret this role, clarifying the existence or not of some discomfort in taking that decisions. The place where the magistrates fulfill their role is the own bureaucratic structure of the rational State, with the consequences that result from this situation. The judicial decision and the medical decision, although having similarities, differentiate themselves , inasmuch as the latter is established in a reliable relation, whereas the other generates a distrust. This research proves that in the pleas that deals with preventive abortion it emerges the theme of the reasoning of the body problems, that afflicts the contemporary citizen, in his/her identity crisis.In this context, today’s society not only needs the advice of the priest or a prescription of a doctor of the family, but also the decision of the magistrate, who should express his/her opinion when doubts occur about this matter.

In this scenario, this PhD thesis proposes a comparative study on preventive counter-terrorism measures targeted on suspected terrorists within a human rights’ approach, in the searching of the “sustainable prevention”. After the study of Italian preventive counter-terrorism law from different perspectives, a small "field research" and the analysis of the UK counter-terrorism system, the Author uses the proportionality principle to suggest some corrective mechanisms for a more sustainable balance between freedom and security.

Abstract:
Den mänskliga rättigheten till en rättvis rättegång utgör en grundpelare i en rättsstat och regleras i såväl artikel 6 EKMR som 2 kap. 11 § 2 st. RF. Rätten till en rättvis rättegång i enlighet med både EKMR och RF tar sikte på att en rättegång dels ska genomföras inom skälig tid, dels att rättegången ska genomföras inför en oavhängig och opartisk domstol. För att rättigheten ska uppfyllas i enlighet med EKMR och RF, föreligger vägledning samt principer utformade av Europadomstolen som måste beaktas vid bedömningen om en rättegång bedrivits rättvis eller inte. Rätten till en rättvis rättegång kan omfatta flera olika element, varav ett av elementen är tillfredsställande handläggning. För att en rättegång ska uppfylla sitt syfte, krävs att rättegången genomförs under sådana former att parterna kan följa det som sker under förfarandet. Till bedömningen om en rättvis rättegång genomförts ska dessutom målets karaktär tas i beaktandet. Detta innebär att mål som förutsätter särskild skyndsam handläggning, till exempel ungdomsmål, särskilt måste uppfylla kraven i artikel 6.1 EKMR. Då barn anses utgöra en särskilt utsatt grupp krävs det speciellt skydd i syfte att värna om deras rättigheter. I BK stadgas barns rättigheter och konventionen är tillämplig på alla individer under 18 år. De stater som ratificerat BK måste således respektera konventionen och rapportera vilka åtaganden som vidtagits för att efterleva den. Barns rättighet att komma till tals och uttrycka sina åsikter tillfaller alla barn under 18 år och innebär att såväl domstolar som andra beslutsfattande organ måste anpassas i avsikt att inkludera barnen. Det kan till exempel handla om särskilda förberedelser för barn innan en rättegång och att anamma ett barnrättsperspektiv i syfte att genomsyra verksamheterna med en förankring i BK. Inom nationell rätt föreligger ett skyndsamhetskrav i ärenden som rör unga lagöverträdare och en allmänt vedertagen princip är att tiden mellan samhällets reaktioner och den unga lagöverträdarens brott bör vara så kort som möjlig. Samhällets inställning gentemot unga lagöverträdare ska även vara konsekvent och tydlig samt ska handläggningen av pedagogiska skäl bedrivas skyndsamt. I en rapport från Brå och i en granskning från Riksrevisionen har det framgått att det förekommer svårigheter i att leva upp till det lagstadgade skyndsamhetskravet för handläggning av ungdomsärenden i 4 § LUL. Riksrevisionen fann att den totala handläggningstiden är alltför långdragen. Polisen drar ut på tiden vid förundersökningen, åklagaren tar lång tid på sig att fatta beslut i åtalsfrågan och TR överskrider tidsfristen genom långdragna mål. Utöver det redovisade, förlängs handläggningstiderna ytterligare genom att socialtjänsten tar lång tid på sig att författa sina yttranden till TR. Europakommissionen har uttalat att i de fall en ung person är brottsmisstänkt, ska denna behandlas utifrån hans eller hennes ålder och mognad. Domstolsförfarandet måste således anpassas i avsikt att trygga den unges möjlighet att förstå och delta i rättegången. Om en ung person inte förstår förfarandet medför det att han eller hon inte kommer vara tillräckligt delaktig under rättegången, vilket påverkar den unges rätt att göra sin röst hörd och komma till tals i enlighet med BK. Unga lagöverträdare särbehandlas inom straff- och processrätt i förhoppning om att motverka att ungdomar identifierar sig som kriminella samt därigenom dras till ett umgänge med andra kriminella personer. Det finns även förhoppningar om att rättsprocessen ska fungera som en markör med en preventiv verkan. Brottmålsrättegångar är dock i huvudsak utformade av vuxna och för vuxna. Barn och unga brottsmisstänkta är således föremål för samma rättsprocess som vuxna utan någon faktisk anpassning efter deras ålder samt mognad. Under år 2002 gjorde Brå en utvärdering av reformen för påföljdssystemet beträffande unga lagöverträdare som trädde i kraft år 1999. Utvärderingen utmynnade i en rapport där Brå intervjuade sju ungdomar om deras upplevelser kring rättegången. Brå uppmärksammade särskilt två uppfattningar genom att lyssna till ungdomarna. De unga anförde att de inte alltid kände sig införstådda på hela förfarandet och på vad som sades samt att de inte ansåg sig komma till tals i tillräcklig stor omfattning. Uppsatsen undersöker huruvida unga lagöverträdares upplevelser av rättegångar kan anses vara stridande mot rätten till en rättvis rättegång och når slutsatsen att unga lagöverträdare inte får sin rätt till rättvis rättegång helt tillgodosedd. Rättigheten, som består av kriterierna skälig tid och oavhängig samt opartisk domstol, kan med anledning av bristerna som konstaterats i uppsatsen anses vara kränkt. Den oskäliga handläggningstiden i kombination med risk för att domare skapar sig förutfattade meningar om de unga tilltalade, kan anses strida mot rätten till en rättvis rättegång i enlighet med såväl EKMR som RF. I uppsatsen undersöks även domstolens möjlighet att förmedla de fundamentala straffrättsprinciperna till unga lagöverträdare i avsikt att åstadkomma en preventiv effekt mot ungdomskriminalitet. Till följd av att rättegångarna i huvudsak är utformade efter en vuxen person, blir slutsatsen att domstolen inte kan förmedla de fundamentala straffrättsprinciperna till unga lagöverträdare i tillräckligt hög utsträckning. Avsaknaden på ett barn- och ungdomsperspektiv under rättegångar kan därmed hindra att den preventiva straffrättsliga effekten gentemot ungdomskriminalitet vinner slagkraft. Det krävs att straffrätten uppfattas som trovärdig för att domstolen ska kunna uppnå en preventiv effekt gentemot ungdomskriminalitet; domstolens agerande och behandling av unga lagöverträdare är således en avgörande faktor i hur straffrätten uppfattas. De ungas upplevelser av rättegångar kan därmed indikera på att domstolen inte till fullo lyckas förmedla de fundamentala straffrättsprinciperna. I fråga om vilken effekt som unga lagöverträdares upplevelser av rätt rättegångar kan medföra, dras slutsatsen att en stor risk för stigmatisering och fortsatt brottsbenägenhet föreligger. Genom att försumma de ungas rättigheter under en rättegång, förblir risken stor att de lämnar rättssalen utan någon påverkan på deras framtida beteende. Sammantaget avrundas uppsatsens slutsats med att framhålla att det krävs mer forskning beträffande ungas upplevelser av rättegångar inom ramen för rätten till en rättvis rättegång. Mer forskning skulle resultera i en vidare inblick i den problematik som det nyliga nämnda innebär. Denna forskning bör vara väsentlig då det behandlar unga individer och deras framtid.
The human right to a fair trial is a cornerstone in a constitutional state and is regulated in both article 6 of the ECHR and in RF, the Swedish constitution chapter 2, paragraph 11, section 2. The right to a fair trial according to both the ECHR and RF requires that a public trial is to be held within a reasonable time and that the trial is to be held before an independent and impartial court. In order for the right to be met in accordance with the ECHR and RF, there are guidelines and principles formulated by the European Court of Human Rights, which must be taken into consideration when assessing whether a trial has been held fairly or not. In order for a trial to be assessed as fair, the minimum guarantees in Article 6.3 ECMR must be met. The right to a fair trial includes several different elements; one of the elements is fair dealing. In order for a trial to fulfill its purpose, it is required that the trial is held in such a way that the parties can follow what is happening during the proceedings. In the assessment of a fair trial, the type of the trial has to be taken into consideration. This means that trials that require special urgent procedures, such as trials concerning juvenile offenders, must especially meet the requirements of article 6 of the ECHR. Children are considered a particularly vulnerable group and are therefore in need for special protection in order to guard their rights. The UN Convention on the Rights of the Child (the Child Convention) regulates children's rights and applies to all individuals under the age of 18. The states that have ratified the Child Convention, must respect the Convention and give an account of the commitments that have been made to comply with it. A child’s right to speak and express its views applies to all children and means that both courts and other decision-making intuitions must be adapted for the purpose of including the children. This could for example include special preparations for children. According to Swedish national law there is an urgency requirement in cases involving juvenile offenders and the time between reactions from society and the juvenile’s crime should be as short as possible. Both a report from Brå and a review by Riksrevisionen, has shown that there are difficulties in complying with the urgency requirement for dealing with youth cases in 4 § in LUL. The European Commission has stated that in cases where a young person is suspected of a crime, the trail should be adapted according to his or her age and maturity. The court procedure must therefore be adapted in order to ensure the young person's ability to understand and participate in the trial. If a young person does not understand the procedure, he or she will not be involved during the trial, which affects the right of the young person to have his hear voice heard and speak in accordance with the Child Convention. Young offenders are treated differently in criminal and procedural law in the hope of preventing young people from identifying themselves as criminals. Criminal proceedings are however, mainly designed by adults and for adults. Children and juvenile offenders and victims of crime are therefore subject to the same legal process as adults without any actual adaptation. In 2002, Brå interviewed seven young people about their experiences of the trial. Attention was drawn to two perceptions by listening to the young people. The young people said that they did not always feel fully aware of the whole procedure and what was said and that they did not consider themselves being heard during the proceedings. This essay investigates whether juvenile offenders’ experiences of their trials can be regarded as conflicting with the right to a fair trial. The essay reaches the conclusion that juvenile offenders do not get their right to a fair trial fully met. The right consisting of the criteria of reasonable time and independent and impartial court may, as a result of the faults found in the essay, be considered to be violated. The unreasonable processing time combined with the risk that judges create prejudiced opinions about the young offenders can be considered to conflict with the right to a fair trial in accordance with both the ECHR and RF. The essay also studies the Court's ability to communicate the fundamental principles of justice to juvenile offenders in order to achieve a preventive effect against juvenile crime. The conclusion is that the trials are mainly designed for adults, which can result in difficulties for the court in communicating the fundamental criminal justice principles to juvenile offenders. The neglect of a child and youth perspective during trial may therefore prevent the preventive criminal justice effect against juvenile crime. Concerning the effect of trial for juvenile offenders, the conclusion is that there is a high risk of stigmatization and continued crime. By neglecting the rights of the young people during a trial, the risk remains high that they leave the courtroom without any effect on their future behavior. All in all, the essay finds that more research is needed on the experiences of juvenile offenders in the context of the right to a fair trial. More research would result in a larger insight into the problem.

Abstract:
This thesis is made up of three papers. The first is a systematic literature review investigating the effectiveness of restorative justice interventions on reducing the reoffending rate of young people. The review consists of nine studies, the majority of which (N=8) found that there was no significant difference between the impact of restorative justice interventions, and other interventions targeting young offenders, on the rate of reoffending. One study found that restorative justice interventions had a significant positive effect at a three-year follow-up period. Following this, recommendations were made for future research. This included the exploration of the views of restorative justice Case Managers as to what factors are important in enabling restorative justice interventions to prevent young people reoffending. The second paper is a bridging document which explains how key decisions throughout the process of completing this piece of work were made, and makes explicit the journey from the Systematic Review to the Research Project. This includes the focus of the research, methodology, method and analysis. The bridging document also explores the areas of ontology, epistemology, reflexivity and ethical issues. The third paper describes a piece of empirical research. In line with recommendations in the Systematic Review, the views of restorative justice Case Managers from a Youth Justice Service were explored regarding the factors that they considered important in delivering a restorative justice intervention that is successful in reducing reoffending. A group interview was used to elicit the views of the Case Managers. Through applying a thematic analysis to the data, six themes emerged; learning, community, enabling change, a holistic approach, professional skill and overcoming systemic barriers. A model is proposed to highlight the relationship between dialogic space and the six themes identified through analysis, in supporting the competence, autonomy and relatedness of young people as conceptualised in self-determination theory. It was concluded that Educational Psychologists have an important role to play in supporting services to develop and deliver interventions with positive outcomes for children and young people. The benefits and limitations of using a group interview are discussed. Implications for the practice of Educational Psychologists, and suggestions for further research, are explored.

O presente trabalho estuda a aplicação prática de prisões preventivas, medida processual penal tratada como excepcional pela própria Constituição, mas que vem se tornando cada vez mais usual e recorrente. A fim de explicar o porquê de a exceção estar virando a regra, juristas e acadêmicos já apontam para problemas como falta de um prazo legal para a duração, ampla margem interpretativa dos fundamentos legais, bem como questões mais arraigadas de seletividade dos órgãos ligados à justiça criminal. A partir destes estudos, conjugados com uma revisão bibliográfica sobre a sociologia do crime e do desvio, aliados às discussões sobre o atual modelo de proibicionismo que resulta na política de “guerra às drogas”, o trabalho promove o estudo de 155 ações penais referentes ao crime de tráfico de drogas, distribuídas a uma das Varas Criminais da Justiça Estadual da comarca de Juiz de Fora – MG, num lapso temporal de dois anos, compreendidos entre as datas de 01/01/2014 e 31/12/2015. Os dados quantitativos e qualitativos extraídos destes processos foram interpretados com enfoque na questão da prisão preventiva e seu efeito no fluxo processual. Na sequência, seleciona-se 83 sentenças das quais se passa a analisar, tendo-se por base a teory of sentencing, as fundamentações para condenar, as penas utilizadas pelo magistrado dentre outros fatores, que permitem constatar um alto índice de condenações e uma predileção por penas privativas de liberdade, confirmando-se na prática a lógica da punição. Finalizase com o estudo de um caso modelo, do qual se observa em pormenores, desde a abordagem policial que resulta na prisão em flagrante, perpassando-se por sua conversão em preventiva até a posterior condenação, as correlações entre os órgãos de justiça criminal e a lógica de um processo de tráfico de drogas, onde se aliam dois dos principais gargalos do encarceramento.
The present work studies the practice of pre-trial detention, that should be exceptional, but has being usual. To explain the reason of being the rule, lawyers and specialists point to questions like lack of legal deadline, wide margin about legal grounds and questions like the selectivity of criminal justice. From these studies, with a literature review about sociology’s crime and deviance, allied to discussions about the actual model of prohibitionism that results in the public policy of war on drugs, this work promotes the study of 155 criminal actions linked to drug trafficking in a criminal court of State Justice in a city county, in a period between January of 2014 and December of 2015. The quantitative and qualitative data extracted from these cases were interpreted with focus on pre-trial detention and the effects on the process flow. In sequence, 83 were selected and analyzed by the theory of sentencing, the grounds of condemnation, the penalty used by the magistrate and other factors that allow us to verify an high index of condemnations and a preference to custodial sentences which confirms the punishment logical. We finished with a model of case study where were observed, in details, since the police approach that results in detention in the act, passing by conversion to pre-trial detention until the final condemnation, the correlations between criminal justice and the logic in a process of drug trafficking where two of the most important problems of incarceration are allied.

The purpose of this study is to provide a critical analysis of current trafficking prevention measures by combining a theoretical emphasis on human rights with an empirical, lived-experience research approach. Empirical evidence is used to illuminate the relevance, appropriateness and potential power of the human rights based approach to trafficking prevention. I start with the fact that existing literature places trafficking within the migration, criminal justice, and women's rights discourse. There are also several attempts to place trafficking within a wider human rights debate but this approach has not been fully explored, especially within the prevention framework. Introduction: Renewed efforts for controlling criminality in Sweden are demanded by the Swedish Government. Restorative justice conferences (RJC), in Sweden known as mediation, can be described as a meeting mediated by a trained facilitator in which the offender and the victim of a crime meets, sometimes together with their friends and family. RJC aims to promote the offender to take responsibility for his or her actions and repair the damage the victim has suffered. Research on RJC shows promising results in regard of reduced recidivism and increased victim benefits. No Swedish publication studying public opinion on RJC has been found. The theoretical framework of reintegrative shaming stated that a community that offer reintegration is essential for successful crime prevention. Aim: To measure the level of RJC support held by a Swedish community sample in regard of different offender and offence characteristics. Method: Participants were recruited at a Swedish authority located in nine different cities (n = 192) and surveyed using an online questionnaire. The questionnaire was based on two scales measuring benefits of restorative justice and support for participation in restorative justice derived from a previous study. Results: The respondents had an overall positive attitude toward RJC. No respondent demographic was associated with the total level of restorative justice support although differences were found when using age and gender as independent variables. Respondents were more positive of RJC for juvenile offenders and non-violent crime. Discussion: A discussion regarding the public support for RJC in relation to offender recidivism is provided established on reintegrative shaming and previous empirical evidence. Concluding arguments for RJC to be extended in a wider context in the Swedish penalty system are presented.

Abstract:
This study examined how restorative justice programs impact the probability of recidivism among juvenile offenders. It compared juveniles who completed restorative justice programs versus juveniles who were released with warning from the courts. Both groups were compared to determine if restorative justice juveniles outcomes differed based on recidivism. Logistic regression showed that restorative justice programs had statistically significant increased odds of recidivating when compared to juveniles released with a warning. However, when the groups of restorative justice were disaggregated, only the adjudicated juveniles were statistically significant. Survival time analysis showed that restorative justice juveniles have longer survival times of recidivism when compared to juveniles released with a warning. Suggestions for further research and analysis are discussed with respect to the current results.

O caminho percorrido neste trabalho teve como ponto de partida a exposição dos marcos teóricos do liberalismo clássico e da criminologia positivista, responsáveis pela construção do discurso jurídico-penal que legitima o poder de punir do Estado e da ideologia da defesa social, a qual, em suma, sustenta ser o direito penal uma reação ao comportamento de uma minoria desviante e proteção aos interesses da maioria; ou seja, o crime como um mal e a pena como resposta, remédio, que o Estado está legitimado a ministrar seja como retribuição, seja como contra-estímulo, para restauração da ordem. Ato contínuo, expus como pesquisas realizadas a partir dos aportes teóricos da reação social e, especialmente, da criminologia crítica, foram responsáveis pela deslegitimação daquele discurso e ideologia, revelando a verdadeira e oculta função do sistema penal, sua eficácia invertida: a legitimação e reprodução das assimetrias sociais através do controle social dos extratos mais vulneráveis. A dimensão desta disfunção pode ser medida quando conhecido que cerca de 40% (quarenta por cento), no Brasil, e 60% (sessenta por cento), em Alagoas, dentre todos os encarcerados, experimentam prisão preventiva, número que chama a atenção de criminólogos, mas também de pesquisadores de diversas outras áreas, bem como de uma parcela da sociedade civil, para a opção feita pelo sistema de justiça criminal de privação da liberdade anterior à condenação e, muitas vezes, ao próprio processamento. E, isto, apesar de o discurso declarado ou o conteúdo programático do direito processual brasileiro erigir a presunção de inocência a princípio fundamental, com assento na Constituição Federal e, portanto, como regra que impede o tratamento de culpado àqueles que não tenham sido condenados pela prática de um crime. A partir deste problema, então, realizei a coleta de dados de todos os acórdãos denegatórios de ordem de habeas corpus julgados no período de um ano pela câmara criminal do Tribunal de Justiça de Alagoas, quando estivesse presente no fundamento a necessidade da manutenção da prisão ante a presença dos requisitos autorizadores para decreto; os dados revelaram que a periculosidade do preso, a possibilidade de reiteração delitiva e a gravidade do crime eram os motivos que concentravam a atenção dos magistrados. Desta forma, separei três decisões típicas e, através do método de análise de conteúdo, busquei, para além do conteúdo declarado, aquele outro, não dito, oculto, capaz de revelar o real motivo para o alto número de encarceramento preventivo. Em conclusão, a pesquisa demonstrou que a prisão preventiva tem cumprido uma real função de medida de segurança para imputáveis, considerados perigosos, dando-se elevada importância aos elementos informativos colhidos durante a investigação, posto que a conduta imputada, e reveladora da periculosidade, não é outra senão aquela atribuída pela autoridade policial. Neste sentido, a seletividade policial, realizada, como demonstram os estudos da criminologia crítica sobre os extratos mais débeis e precários da sociedade, é chancelada pela seletividade judicial, que contribui decisivamente para que o sistema penal realize suas reais funções de neutralização e disciplina das classes sociais inferiores

Over the last ten years there has been an increasing focus on procedural justice policing. Interest in this area has grown as studies have established that public perceptions of the police as procedurally just can improve public compliance, cooperation, and satisfaction with law enforcement. However, less is known about the factors that prevent or inhibit police officers from demonstrating procedural justice when dealing with the public. The literature that does exist on procedural justice barriers has proposed a range of issues – from time constraints limiting officers’ ability to demonstrate procedural justice, to procedural justice not being a priority for officers. There is a research gap for a systematic identification of the barriers that may inhibit officers from using procedural justice. When examining police behaviour towards the public, a characteristic of the policing literature is the focus on the operational stage of officers’ careers, to the exclusion of how recruit training may instil these behaviours. Recruit training is where officers learn the knowledge and skills to be an operational officer; knowledge and skills that will adapt and change once they begin to apply them in real-life situations. As yet, there is no in-depth understanding of the effect of recruit training on procedural justice policing, the consequence being that there may be factors in how recruits are prepared for police work that inhibits police demonstrations of procedural justice when they become operational.

Research indicates that states have implemented juvenile justice reforms to enact harsher punishments, to transfer greater numbers and younger juvenile offenders to adult criminal court, and to restrict discretion of the juvenile court judges. Social science studies have found that harsher punishments, transfers to adult criminal court and other measures do not work, but that comprehensive approaches which address the numerous major factors contributing to juvenile offending have been successful. This study examined the legal status of the juvenile justice system by focusing upon ten diverse sample states and analyzed the social science research on factors contributing to juvenile offending and on prevention, treatment, and rehabilitation approaches. The study was accomplished by legal research, qualitative social science research, and analysis of both. Findings indicated: a) state statutes require and allow adult punishment of juvenile offenders, transfer of juvenile offenders to adult criminal court, and direct filing of charges against juveniles in adult criminal court; most states begin these proceedings at age 14, some have no age minimum; b) social science research indicates numerous factors contribute to juvenile offending with most of the factors categorized into the major factors of early antisocial behavior, deviant peers, parents and family, sociomoral reasoning, biological factors, and violence which interact with each other creating a complicated web; and c) prevention, treatment, and rehabilitation efforts should be comprehensive, multidimensional and multimodal addressing the interacting major factors contributing to juvenile offending and the needs of the juvenile, the family, and the home environment. Implications include the need for legislators to access the social science research to craft legislation and programs which are effective. Suggestions for improvement include collaboration within communities and with knowledgeable and committed social science professionals and educators. Areas suggested for further research include education of the public, the media, and stakeholders; long term follow-up on promising programs; design and improvements in approaches based upon the social science research; meeting the needs of the juvenile, the family, and the home environment; and study of how the factors may differ for disabled juveniles.

Medical confidentiality is widely recognised as a concept worth protecting. Problems arise, however, when medical confidentiality conflicts with interests that are equally regarded as important, such as the interests of justice; the interest in criminal prosecution; the interest in crime prevention; or defence rights. In order to develop convincing and workable criteria to balance the competing interests in case of a conflict, the different interests at stake must be clearly defined, and their respective importance assessed. Different ethical approaches to the balancing process will be introduced, followed by an analysis of the law of four legal systems, France, Germany, the UK and the u.s. AIl four legal systems protect medical confidentiality by the means of private law, but only Germany and the U.S. protect medical confidentiality as part of the constitutional right to privacy. In France and Germany, a breach of medical confidentiality by a physician amounts to a criminal offence. Regardless of these differences, all systems agree that medical confidentiality serves both the privacy interests of the patient, and the public interest in protecting public health. Fundamental differences materialise with regard to the recognition of medical privilege, which is recognised in France, Germany, and some States in the U.S., but is rejected by other States in the U.S. and by the UK. While in the U.S., defence rights are regarded as more important than medical confidentiality, the same is not true for France and Germany. All systems agree that medical confidentiality can be outweighed by the interest in preventing a crime that might cause serious harm to a third party, but the criteria according to which the competing interests are balanced, differ. Based on a comparison of the different approaches, criteria for a consistent and morally justified resolution of the conflicts between medical confidentiality and the competing interests will be suggested.

Abstract:
This article analyzes the negative impact of the reforms within the criminal systems in Latin America, both for those who suffer a crime, and those who are accused of having committed such crime. Supprted by empirical data, the author warns how the innovations of the reformed criminal proceedings (for example, the simplified court proceeding or the active role played by prosecutors), by enrolling into an authoritative legalculture, become in practice contrary to their likely design.
El presente artículo analiza la incidencia negativa de las reformas llevadas a cabo en los sistemas penales de América Latina, tanto en relación a quien sufre un delito, como respecto a quien es acusado de haberlo cometido. Sustentado en información empírica, el autor advierte cómo las novedades del proceso penal reformado (por ejemplo, el procedimiento abreviado o el rol activo a desempeñar por los fiscales), al inscribirse en una cultura jurídica autoritaria, devienen en la práctica en formas contrarias a su diseño ideal.

Identity theft and credit and bank card fraud is increasing in America and worldwide. Given the current statistics of its prevalence and practices around the world, many in government are starting to take critical notice due to its impact on a nation’s economy. Limited amounts of research have been conducted regarding the practices of applying the Routine Activities Theory (Cohen & Felson, 1979) to better equip store managers in understanding the critical need for capable and effective point of sale guardianship for in-store prevention of credit or bank card fraud due to identity theft. This research has used qualitative observational studies to investigate the presence of or lack of capable guardianship at point of sales transactions in large department stores where a majority of in-store credit and bank card fraud loss occurs. Findings conclude an overwhelming lack of capable guardianship at retail store POS terminals.

Abstract:
The development of Youth Justice in the UK since the early 1990s has been informed by the belief that the family plays a key role in youth offending. In 1998 the parenting order was introduced, based on the assumption that interventions to improve parenting will have a positive effect upon offending. The availability of the order was extended in 2005, reflecting the view that parents who do not undertake parenting support are being wilfully negligent of their responsibilities and must be made to take the help offered. In this thesis the assumptions justifying the parenting order and its extensions are questioned. Evidence suggests that although parenting is influential, it is one of many factors associated with the onset of or desistence from offending. Furthermore, as this thesis highlights, parents likely to receive parenting orders are often experiencing several personal and environmental 'stressors', creating high levels of need. These situational pressures and high level of need, this thesis argues, are likely to make it difficult for them to be effective in their role, or to gain long term benefit from attending a parenting programme. Furthermore, many parents have histories of unsuccessfully seeking assistance from 'helping agencies', refuting the assumption of wilful neglect. This thesis considers the advantages and limitations of parenting work as a form of crime prevention and specifically looks at the use of the parenting order. An argument is presented for a wider, more holistic approach to parenting work than that offered by the parenting order as a form of crime prevention and for providing assistance to families earlier.

This project involved an evaluation of firefighter involvement in Youth Justice Conferencing to determine whether, and if so how, this program facilitates the prevention of youth misuse of fire. Evaluation comprised quantitative analyses of a decade of Youth Justice Conferencing records and recidivism data, alongside qualitative analysis of program practitioner interviews. Findings revealed that, although there are some areas in need of improvement, Youth Justice Conferencing with firefighter involvement contributes to a reduction in the risk of general recidivism, whilst providing an avenue through which to deliver fire safety education to at-risk groups within the community.

The involvement of youth in justice systems generates high social and economic costs for individuals, their families and communities. Although Victorian crime statistics indicate a decline in youth offending there remains a subgroup who persist, resulting in adverse outcomes. Despite considerable scholarly attention on the factors that contribute to youth contact with justice systems, the application of this knowledge in some instances has failed to reduce such contact and deliver the desired outcomes. This thesis asserts that the factors relat ing to youth contact with justice systems are best understood within the theoretical frameworks of social ecological theory and developmental criminology. A social ecological perspective broadens the understanding of factors associated with youth contact with justice systems and potential intervention opportunities. It is argued that the integration of developmental criminology and social ecological theory within a place based framework will guide understanding and enh ance the efficacy of early intervention strategies. This thesis highlight s the need to consider multiple interacting factors, the value of incorporating developmental data to augment police records and the importance of implementing practice wisdom in the formulation and delivery of developmental prevention strategies. An individual’s exposure to adverse childhood experiences is demonstrated as a critical element associated with the risk of future offending. Findings relating to early contact with police as potentially protective and not necessarily predictive of an ongoing offending trajectory provide new insight. It is argued that a place based approach that incorporat es practice partnerships is critical to delivering effective prevention efforts. Abstract:
Sexual assault has come to the forefront in terms of prevention and education for many social institutions such as college campuses. However, with a growing body of research highlighting the importance and effectiveness of interventions, research examining the impact of rape-related education on altering rape myth acceptance (RMA) among non-student populations is severely lacking. This is a problematic gap given the issue of sexual assault in the United States extends well beyond academia. The current study aimed to fill this gap by employing an experimental design with repeated measures. To detect changes in RMA after a short rape myth education intervention, pretest and posttest RMA scores were generated for all participants by using an altered version of the Updated Illinois Rape Myth Adherence scale. A sample of 137 non-students were surveyed via Amazon's Mechanical Turk and randomly assigned to a treatment (educational intervention) or control (unrelated video content). The treatment video was roughly ten minutes in length and constructed by the author for the purpose of the current research, after a search for a similar informal and accessible, but still research-based, video was not successful. Participants were presented with common rape myths and then provided with information (e.g., accessible research/statistics) with the aim to "debunk" these myths, and ultimately decrease acceptance of myths. Analyses indicate support for a significant change in RMA scores from pretest to posttest in the treatment group, finding support for the use of informal rape myth education in altering immediate RMA scores of a non-student sample. RMA scores were also examined by demographics to determine if within-group differences were present in the sample. No consistent results emerged in both the treatment and control group. Limitations and implications for future research are discussed

ENGLISH ABSTRACT: This study deals with crime prevention within the criminal justice system in response to the current crime situation in the Western Cape. It describes the structure and function of the criminal justice system and assesses crime prevention processes with specific reference to the role of social work within the criminal justice system. It further examines the criminal justice system as practised in the Western Cape, paying specific attention to the role of the police, criminal courts and prisons in the prevention of crime. In line with the nature of the study an exploratory approach was used. The data was collected from both primary and secondary sources. Interviews and observations were the main research techniques used for gathering primary data. Secondary data + was gathered by means of a study of the literature. Structured and unstructured interviews were conducted with social workers, magistrates, police officers, prosecutors, victims, offenders, community workers and other officials of the criminal justice system. These interviews were mainly conducted at Wynberg magistrates' court, Drakenstein Prison (formerly known as Victor Verster Prison) and organisations based in the metro areas and on the Cape Flats. The study was conducted over a period of three years with the interview schedule administered between May and August 2000. A sample of 21 respondents was selected on the basis of a purposive approach and procedure. The comprehensive interview schedule consisted of mainly open-ended and a few closed questions, generating information on the profiles of respondents, crime dynamics in the Western Cape, the sentencing process and prevention strategies, matters related to the criminal justice system and corrections, and the role of community justice in the prevention of crime. The generated qualitative data was analysed and interpreted. The findings suggested the necessity for social work to make a contribution to the prevention of crime in a sensitive and proactive way. The analysis has shown that criminal justice approaches can significantly enhance the process of crime prevention, but that the criminal justice system requires combined strategies and approaches for crime prevention to be effective. It is in this context that the contribution of social work can be much more effective. The recommendations of the study have demonstrated a need for social workers to promote approaches that are premised on a broader understanding of the role of the criminal justice system in the prevention of crime. It is important to state that the study's recommendations for the prevention of .crirne can also be implemented by other role-players, particularly within the criminal justice system.
AFRIKAANSE OPSOMMING: Hierdie ondersoek handeloor misdaadvoorkoming deur die strafregstelsel in reaksie tot die huidige misdaadsituasie in-die Wes-Kaap. Dit beskryf die struktuur en funksie van die stafregstelsel en beoordeel misdaadvoorkomingsprosesse met besondere verwysing na die rol van maatskaplike werk binne die strafregstelsel. Dit ondersoek verder die strafregstelsel soos beoefen in die Wes-Kaap deur veral aandag te gee aan die rol van die polisie, die howe en gevangenisse in die voorkoming van misdaad. Die aard van die ondersoek vereis dat 'n eksplorerende benadering gevolg is. Data is versamel uit primêre sowel as sekondêre bronne. Abstract:

The purpose of this project was to write a grant and locate a funder to provide a commercial sexual exploitation of children (CSEC) prevention course for female youth in the child welfare and/or juvenile justice system. Caregivers and social service professionals will also be included. There is great demand for the proposed program as an increasing number of youth, specifically those involved in the child welfare system and/or juvenile justice system, are at risk for CSEC.

The proposed program will provide education of risk factors that can lead to CSEC as well as how to identify potential victims. The identified youth, caregivers, and social service professionals will attend their respective courses. The youth’s course will be held at Olive Crest in the City of Bellflower, located in Service Planning Area (SPA) 7 of Los Angeles County. The caregivers’ and social service professionals’ courses will be held in probation and Department of Children and Family Services offices within the same area. The Hearst Foundation was chosen as the potential funder.

The actual submission of the grant application was not a requirement of the thesis project.

The Swedish penalty system has created a fierce and lively debate during the past years. Thisdebate originates mostly from the youth discount that offenders between the age of 18 and 20can make use of. There is a clear division between the argumentative sides when it comes tothis particular debate. One side argues for the removal of this criminal discount for youngadults, whilst the other side are against it.The purpose of this study is to examine the different underlying perspectives that theserespective sides have. The method of evaluation I will be using in this study is a descriptiveideaanalysis of constructive ideal types. The theoretical framework that these ideal typesstems from are proportionality, justice, general prevention and individual prevention. Thestudy has displayed that the debate regarding this criminal discount for young adults has hadelements of all four of these attributes. There exists fundamental differences in the underlyingideas when it comes to both sides in this specific discount towards young adults. Theopposition side has clear general prevention ideas behind their arguments, whereas the sidethat are in favor of the discount inherently believes in the ideas that regard proportionality,justice and individual prevention.

This research, affirms that some mechanisms of the transitional justice approaches can be applicable to SIDS conflict; particularly structural conflicts. The fourth principle of the Joinet/Orentlicher Principles of ‘Dealing with the Past’; the right to non-occurrence of conflict, was utilised as a conceptual framework to research the case of Fiji, as it addresses military and institution reforms; both of which are problematic area in Fiji. Focus groups interviews, semi-structured questionnaires and key informant interviews were used to collect data. The overall research question was: ‘How can transitional justice strategies address conflicts that are distinctive to Small Island developing states?’, and the more specific questions related to amnesty, military reform and prevention of coup d’états in the future. The thesis confirms that many respondents and key informants regard amnesty for coups d’état negatively and unjust. A number of key informants also think that amnesty is bad as it sends the wrong signals to the coup perpetrators and to future generations. Respondents felt strongly (78%) that the coup perpetrators should be held accountable as coups are illegal, but they also acknowledged that the military is too strong and praetorian at this stage in Fiji to be held accountable. Findings also indicate that there were mixed views on military reform. A number of other important reforms were also suggested by the respondents to prevent the reoccurrence of coups in Fiji. These include; education to foster a national identity, and reforms to the rule of law as well as to the judiciary. This thesis concludes that transitional justice mechanisms would be applicable to small island developing states but it would need to be tailored to the country’s specific needs. Additionally, if we are to ensure that another coup does not occur in the future, Fiji has to carry out military reform and revive discussions on amnesty, or such discussions will be driven underground and may fester into future conflicts.

Abstract:
The levels of crime and violence in South Africa seem to go hand in hand with the increase in the number of police practitioners. However, despite all the work going into it, “nothing seems to reduce the general trend” (Burger 2007:1). Domestic violence, for instance, is one of the major challenges practitioners are faced with on a daily basis at all levels in South Africa (Bendall 2010:100). Nonetheless, the country has yet to recognise this specific type of violence as a crime in their official crime statistics (SAPS 2010). Domestic violence has, in fact, struggled to become recognised as one of the most serious types of crime in today‟s society. This might be explained in terms of the developments that have occurred – both in international research and in the domestic realm – especially in terms of the ever-changing nuclear family. However, this could also be explained in the way such violence is treated by the South African Police Service. Nonetheless, it appears that a significant amount of research has been undertaken on the nature and impact of domestic violence, including the various responses and strategies to its management. However, it seems as though no-one can come up with a proper solution to this problem. In terms of violence in general, a number of different researchers in the field have suggested possible explanations to the problem. Burton, for instance, explained violence in terms of the neglect of basic human needs, the need for identity and the need for control. This author suggested that if these basic needs are frustrated, violence could be expected to occur, including violence within the family. Moreover, some violent behaviour could be described in terms of a loss of control of the situation and the management thereof. It is especially in these circumstances that conflict management techniques are to be highly recommended. Mediation – or facilitation – collectively referred to as restorative justice – is an example of such a technique. However, the question of whether or not to include mediation has been subject to much discussion amongst scholars in the field. As one of the main roles of the police is to prevent violence, and to protect the citizens from harm, it would be appropriate for the purpose of this study, to focus specifically on the SAPS and their response to cases of domestic violence. Their lived experiences are evaluated in terms of the existing legal framework, as well as in the light of other empirical research.

The core objective of this research is to investigate if access to justice is synonymous to access to the courts, confusing thus by the public subjective right of action, conferred to anyone who claims a material right, as advocated Chiovenda and Liebman. To this end, it takes into account some diagnoses, most of them derived from the “Conselho Nacional de Justiça” (National Council of Justice — CNJ), such as the satisfaction of the society for jurisdictional services at national level and the amount of investments made in support of the judiciary power in recent years, compared to the level of litigation and the quality of response that it gives to the cases constantly brought. Initially, it investigates the concept of Justice, from the foundations built by eminent thinkers, like Aristotle, Hans Kelsen and John Rawls, in order to discover the theoretical and philosophical foundations of the idea of access to justice. Then, in the light of a critical analysis, it finds out that access to justice is not a synonymous to access to the courts, which, despite being an important way for such, is insufficient to the full realization of this jus fundamental guarantee. In this scenario, the possibility of resolving conflicts through alternative, non adversarial means reappears, such as conciliation, mediation and arbitration, ways that, in many situations, provide access to the most resourceful and worthy justice. In tailpiece, it defends a necessary reinterpretation of access to justice, based on the disruption of the old paradigm, adopting as a theoretical framework Thomas Kuhn and Boaventura de Sousa Santos. In this sense, under the consideration that access to justice should imply access to a fair legal system, two relevant aspects receive special attention, namely: access to justice as direct access to the rights and the shared jurisdiction, strengthening, once again, the use of the so-called persuasive means and, moreover, democratic participation for obtainment of goods and values, which together make up the social justice. As a consequence, it is seen that the preventive access to justice avoids litigation, and should be primarily fomented by the Executive and Legislative, each within their competence spheres. It is a qualitative research, of markedly bibliographic nature, but at certain times it makes use of judgments given by the “Supremo Tribunal Federal” (Supreme Federal Court — STF) and other national courts as well as data and reports produced by public and private institutions, and scholars of the subject.
O objetivo nuclear desta pesquisa é o de investigar se o acesso à justiça é sinônimo de acesso ao Poder Judiciário, confundindo-se, deste modo, com o direito subjetivo público de ação, conferido, conforme defenderam Chiovenda e Liebman, a quem pleiteia um direito material. Para tanto, levam-se em consideração alguns diagnósticos, sendo os principais oriundos do Conselho Nacional de Justiça (CNJ), como o da satisfação da sociedade ante a prestação jurisdicional em nível nacional e os relativos aos altos investimentos realizados em prol do Judiciário nos últimos anos, comparativamente ao grau de litigiosidade e da qualidade da resposta que esta função estatal dá às situações que se lhe achegam constantemente. Inicialmente, se investiga o conceito de Justiça, a partir dos alicerces construídos por eminentes pensadores, a exemplo de Aristóteles, Hans Kelsen e John Rawls, o que se fez com o fito de descobrir os fundamentos teórico-filosóficos da ideia de acesso à justiça. Em seguida, à luz de uma análise crítica, descobre-se que o acesso à justiça não é sinônimo de acesso ao Poder Judiciário, o qual, a despeito de ser um importante caminho para tal, afigura-se insuficiente à plena efetivação desta garantia jus fundamental. Nesse cenário, ressurge a possibilidade de se resolver conflitos por vias alternativas, não adversariais, a exemplo da conciliação, da mediação e da arbitragem, meios que em inúmeras situações proporcionam um acesso à justiça mais desembaraçado e digno. Em arremate, defende-se uma necessária releitura do acesso à justiça, fundamentada na quebra do velho paradigma, adotando como referencial teórico Thomas Kuhn e Boaventura de Sousa Santos. Nesse caminhar, sob o influxo de que o acesso à justiça deve implicar acesso a uma ordem jurídica justa, dois aspectos de sumo relevo receberam especial atenção, a saber: o do acesso à justiça como acesso direto aos direitos e o de jurisdição compartilhada, fortalecendo-se, assim, uma vez mais, o uso dos meios ditos suasórios e, ademais, a participação democrática para o auferimento dos bens e valores, que em conjunto conformam a justiça social. Como consequência, verifica-se que o acesso preventivo à justiça evita a litigiosidade, e deve ser prioritariamente fomentado pelos Poderes Executivo e Legislativo, cada qual dentro das suas esferas competenciais. Trata-se de uma pesquisa qualitativa, de cunho marcadamente bibliográfico, mas que em determinados momentos se vale de decisões proferidas pelo Supremo Tribunal Federal e outros tribunais pátrios, além de dados e relatórios produzidos por órgãos públicos e privados, e por estudiosos da matéria.

Abstract:
The reform measures recommended by the Commission of Inquiry into Possible Illegal Activities and Associated Police Misconduct (referred to as the "Fitzgerald Inquiry") radically transformed the face of policing in Queensland. The most significant of these recommendations was the establishment of an external oversight body, the Criminal Justice Commission (CJC), which has independence from executive government and holds the power to investigate not only police but any public servant or politician. Other recommendations included "Whistleblower" legislation, increasing sanctions for serious misconduct, lateral recruitment and promotion by merit rather than seniority. The first main research question tested in this thesis is whether these reform measures have produced improvements in the following areas: the efficiency and effectiveness of the processes for dealing with complaints against police; public confidence in those processes and the public standing of the Queensland Police Service (QPS) generally; standards of police behaviour; the incidence of corrupt conduct; and police attitudes towards reporting misconduct by their fellow officers. These Fitzgerald Inquiry reforms were strategies primarily derived from two schools of thought describing the nature and cause of police corruption: deterrence based theory (including "individual" or "rotten apple" theory) and cultural (also labeled "cultural" or "socialisation") based theory. To date most strategies used to combat police corruption have been underpinned by these theories. A third theory - situational based theory (sometimes titled "environmental" or "opportunity" theory) - which has had success in crime prevention, has been scarcely used in the area of police corruption. However, an extensive body of research has affirmed the effects of situational factors on police behaviour, suggesting the potential for the application of situational crime prevention initiatives in combatting police corruption. The second research question proposed in this thesis is whether situational based theory could also be beneficial in the prevention of police corruption. Data drawn upon to test the first research question were interviews and surveys with police officers, public attitude surveys and statistics from the processing of complaints against police. Although each source has limitations, collectively the data are sufficiently comprehensive - and robust - to defend conclusions about the general direction of the changes which have occurred. These data indicate that the Fitzgerald Inquiry reforms have, at least to some degree, had their intended impact on the QPS. These reforms have contributed to an apparent improvement in public confidence in the complaints system and the QPS generally. Moreover, the available evidence suggests that the Fitzgerald Inquiry reforms have resulted in a weakening of the police code of silence. As far as the specific issue of corruption in the QPS is concerned, it is difficult to draw firm conclusions from existing data sources. However, the weight of the available evidence is that such conduct is less pervasive and occurs at lower levels than was the case in the pre-Fitzgerald Inquiry QPS. It is very difficult to ascertain which reform components were the most effective and which were not helpful at all, as these reform measures were initiated simultaneously. For example, the negative elements of the police culture may have been eliminated or reduced but whether it was the cultural strategies or one of the deterrence based strategies influencing officer behaviour remains unknown. The second main research question the thesis poses is that the use of situational crime prevention techniques has potential for contributing to the prevention of police corruption. A situational analysis of complaints against police data, including the development of a typology for classifying types of police corruption and misconduct, was used as an example of how this may be accomplished in Queensland. The study provides some, albeit limited, support for the hypothesis that situational crime prevention methods are applicable to police corruption. Based upon three years of complaints data, enough homogenous cases were gathered to enable the analysis of four categories of police corruption - Opportunistic Thefts, Driving under the Influence, Assault (while off-duty), and Theft from Employer. Given that this study only used three years of complaints data held by the CJC and more than nine years of data exist, productive situational analyses of many other categories of corruption is probable. This study also illustrated that complaints against police data are being under utilised by the QPS and the CJC. For future research in the situational analysis of complaints data, I recommend improving the gathering of data from complaints files for storage in electronic form to enable situational prevention analysis to be conducted more readily. A geographical example was used to illustrate further how complaints against police data could be more extensively utilised as a prevention tool. This analysis was conducted at an organisation unit level determined primarily by geographical factors. The complaint patterns of units of similar "task environments", as measured by unit size and type of duties performed, were compared in an attempt to identify those units experiencing the presence or absence of "bad apples" or a "negative culture". This study led to the conclusion that a divisional analysis of complaints data can provide information valuable in combatting police corruption. When task environment was held constant, it was possible to identify units experiencing the effects of possible "bad apples" and/or "negative cultures". Once these particular units were identified, intervention strategies to address the units' particular problem could be constructed. Future research in this area would involve ongoing divisional data analysis followed-up by individual assessment of officers identified as "bad apples", or a "compare-and-contrast" procedure to distinguish features requiring correction in units identified as having a "negative culture". The research findings presented in this thesis are that progress has occurred in a number of areas in addressing the problems identified by the Fitzgerald Inquiry, but that there is undoubtedly scope for more to be achieved. Despite the very significant increase in the resources and powers available to investigators post-Fitzgerald, it is still difficult to prove that a police officer engaged in misconduct, or that other officers were aware of this fact and had failed to take action, because of the constraints imposed by evidentiary and legal requirements. Thus, while it is vital to maintain an effective and credible independent complaints investigation system and ensure that there is a proper internal discipline process in place, the scope for increasing the "deterrent power" of the present system is limited. Putting more resources into complaints investigations might make a difference at the margins, but is unlikely to lead to a significant increase in the probability of a complaint being substantiated and a sanction imposed. Investing more resources in investigations has an additional cost in that such resources are then lost to other efforts to combat corruption that may provide more fruitful results in the long term. The value of an occasional substantiation is placed above the ability to engage in a large amount of prevention work. Inevitably then, three clear messages are apparent. First, continued effort must be made to modify the organisational climate of the QPS in terms of commitment to integrity. Recommended strategies to accomplish this end are to continue the recruitment of more educated, female and older officers to reduce police-citizen conflict and the negative elements of the police culture, and also to develop a comprehensive, integrated approach to ethics education for QPS officers at all ranks and positions. Second, other forms of deterrence against misconduct are needed such as the use of covert strategies like integrity testing which could be conducted in conjunction with the CJC. Third, a greater emphasis needs to be placed on developing and implementing preventive strategies. This thesis has shown that valuable prevention strategies can be gained from situational and divisional analysis of complaints data, and a range of proactive management options based upon situational crime prevention theory are recommended. These strategies have application in any police service.

This project examines the protection methods suggested by hackers to guard against online victimization through the lens of Situation Crime Prevention. Data were collected from 85 webpages representing three categories of electronic communications: forums, blogs, and fan pages. The goal of this project was to identify which of the 25 opportunity reduction techniques the hacking community recommend most often, as well as, what level of expertise was associated with the suggested security measures. Results indicate that the technique most recommended by the hacking community was to remove targets with 27% of the total codings. From the results three themes were found: (1) most recommendations are such that implementing the strategies would serve to protect against opportunistic, low-skilled attacks; (2) most recommendations could be considered routine precautions, that when bundled, would secure most people against cyber-theft; and finally, (3) the Situational Crime Prevention framework was not fully realized because much of cyber-theft does not involve direct victim-perpetrator interactions. From these three themes policy recommendation and limitations are presented as well as avenues for future research.

Intimate partner violence (IPV) is an extremely prevalent and concerning social issue, with limited current intervention and prevention strategies. Batterer intervention programs (BIPs) have demonstrated some small effects of programs in reducing offender recidivism, however there is a growing understanding that not all offenders respond similarly to batterer intervention and the problem of IPV persists. Restorative justice programs including impact panels may be an important addition to BIPs, but research is extremely limited on impact panel effectiveness and whether panels are appropriate for IPV or pose additional safety risks to survivors. The current study consists of a naturalistic mixed-methods evaluation of the use of IPV impact panels in the context of batterer intervention. Data collection methods include an ethnographic inquiry of the program setting and participant experiences, archival data analysis of offender responses to the panel (N = 287), and focus groups (k = 4) with survivors, offenders, and BIP providers to investigate the panel's impact on survivors and offenders and generate potential indicators of panel outcomes for survivors and offenders. Findings suggest that panel impacts on survivors include reaching new understandings, healing, and empowerment; panel impacts on offenders include connection with survivor speakers, reaching new understandings, and healing. Implications, limitations, and future aims of this program of research are discussed.

Men’s violence against women includes acquaintance rape, intimate partner violence, sexual assault, and partner stalking and occurs at particularly high rates on college campuses (Fisher, Cullen, & Turner, 2000). Although men are increasingly becoming involved in efforts to prevent these forms of violence, little is known about their motivation and the processes that lead to their involvement. The purpose of this project was to examine how undergraduate male students become social justice allies involved in preventing men’s violence against women. The theoretical frameworks of this study included transformative learning theory (Mezirow, 1997, 2000) and feminist theory (Worell & Remer, 2003). Data were generated from six male social justice ally exemplars nominated for their sustained involvement in prevention work. Eligible and interested participants completed two individual interviews, demographic forms, Social Locations Worksheets (Worell & Remer, 2003), and male social justice ally development timelines. The qualitative data were analyzed using constructivist grounded theory (Charmaz, 2006) by the author and three peer debriefers. Findings provide an initial framework for conceptualizing male social justice ally development, including predisposing factors and shifts in perspective that were critical to their antiviolence work and factors that sustained their involvement. Participants also described integrating their social justice ally work into their identity and connecting with other forms of social activism. These themes provide a framework for understanding how men become invested in preventing men’s violence against women as undergraduate students and implications for ways to engage more men in these efforts.

Dans un contexte d’intensification du travail, sont apparus au-devant de la scène les risques psychosociaux (RPS). Au fil des années, la prévention des RPS et la qualité de vie au travail sont devenus des enjeux de santé publique, et les entreprises privées et publiques s’y intéressent plus que jamais. La littérature nous avait permis d’identifier, au-delà des facteurs de RPS tels que les caractéristiques des postes, la justice organisationnelle comme un prédicteur de santé au travail (Elovainio et al., 2003 ; Robbins et al., 2012). Notre première étude avait pour objectif de mieux comprendre les mécanismes par lesquels les dimensions de justice exercent un effet sur les variables de bien-être et de retrait. Nos résultats ont révélé à ce sujet que les perceptions de justice jouent un rôle médiateur dans la relation entre les caractéristiques des postes et les variables de bien-être telle que la satisfaction, l’attachement, l’épuisement émotionnel et les intentions de retrait, même si la médiation est partielle la plupart du temps. En effet, certaines caractéristiques des postes comme le soutien du supérieur continuent à maintenir un rôle prédictif et direct important, plaçant le supérieur au cœur du dispositif de prévention. Notre seconde étude a porté sur l’introduction des principes de justice au cœur d’une formation aux RPS pour les cadres d’un hôpital. L’évaluation des effets de cette action sur le sentiment de justice des personnels a montré l’utilité de former les supérieurs à la justice. Ainsi, nous avons pu élargir les possibilités d’actions sur le terrain pour prévenir les RPS en rendant incontournables les principes de la justice dans la conception du travail
In the context of intensification of work, psychosocial risks (PSR) have attracted great interest. Over the past few years, PSR prevention and the quality of worklife have become public health issues, and have more than ever drawn both private and public companies' attention. Beyond PSR factors such as job characteristics, the literature helped us identify organizational justice as a predictor of occupational health (Elovainio et al., 2003; Robbins et al., 2012). Our first study’s goal was to gain a better understanding of the mechanisms with which justice dimensions affect well-being and withdrawal variables. Our results revealed that justice perceptions act as a mediator in the relationship between job characteristics and well-being variables such as satisfaction, commitment, burnout (or emotional exhaustion), and withdrawal intentions, even if most of the time the mediation is partial. Indeed, some job characteristics, such as supervisory support maintain an important and direct predictive role, putting management at the center of the prevention system. Our second study focused on the introduction of organizational justice principles at the core of a PSR training course for executive staff in a hospital. Evaluating the effects of this action on the personnel's feelings of justice showed the utility of training the Executive staff in justice principles. Thus, we have been able to extend the scope of PSR prevention in the field by showing the pivotal role the principles of justice play in work design

ENGLISH ABSTRACT: The rights entrenched in the Bill of Rights in South Africa’s final Constitution are, with a few exceptions, guaranteed to citizens and non-citizens alike. South Africa has seen an influx of migrants, asylum seekers and refugees since 1994, and this migratory movement has posed significant challenges to the post-apartheid legal order. This thesis is concerned with the State’s implementation of its constitutional obligations to protect and guarantee the constitutional rights of everyone within the borders of South Africa. It is important that these constitutional obligations do not remain mere aspirations but should translate into reality. Most non-citizens living in South Africa face numerous barriers to accessing justice and the processes that could enable them to realise their rights. The thesis examines the concept of “access to justice” and investigates a number of obstacles encountered by different categories of non-citizens – such as refugees, asylum seekers and documented and undocumented migrants – in trying to access justice and to realise their rights. Against this background, arrest, detention and deportation under the Immigration Act and Refugees Act are examined because these processes have often been abused by State officials to prevent non-citizens from accessing the rights and protections guaranteed in these Acts and the Constitution, and to frustrate the implementation of court orders vindicating the rights of non-citizens. The application of the Immigration and Refugees Acts is discussed through the lens of sections 12(1), 33, 34 and 35(2) of the Constitution which ensure that arrest, detention and deportation are done in a lawful and procedurally fair manner, as opposed to the arbitrariness that most non-citizens experience on a daily basis. Secondly, the thesis also examines access to justice for non-citizens in the context of xenophobia and bias based crimes. The State has in the past failed to respond in a coordinated and timely fashion in the face of violent manifestations of xenophobia. Against this background, the State’s obligation to protect non-citizens from violence from either public or private sources in terms of section 12(1)(c) of the Constitution is discussed and analysed. The role, accessibility and effectiveness of Equality Courts are also examined in light of the Promotion of Equality and Prevention of Unfair Discrimination Act and the cases that were brought before them emanating from xenophobic incidents. The thesis concludes with proposals on areas which require better implementation of existing laws; and areas in which legislative reform is needed.
AFRIKAANSE OPSOMMING: Die regte wat in die Handves van Regte in Suid-Afrika se finale Grondwet veranker is, word op enkele uitsonderings na vir burgers en nie-burgers gewaarborg. Sedert 1994 het Suid- Afrika instroming van migrante, asielsoekers en vlugtelinge beleef, en hierdie verskuiwing het wesenlike uitdagings aan die post-apartheid regsorde gestel. Hierdie tesis is gemoeid met die Staat se implementering van sy grondwetlike verpligting om die grondwetlike regte van almal wat hul binne Suid-Afrika se landsgrense bevind, te beskerm en te waarborg. Dit is belangrik dat hierdie grondwetlike verpligtinge nie blote aspirasies bly nie, maar ’n werklikheid word. Die meeste nie-burgers wat in Suid-Afrika woon staar talle hindernisse in die gesig wat dit vir hulle moeilik maak om toegang tot geregtigheid te verkry en om hul regte te verwesenlik. Questo lavoro ha lo scopo di catalogare e descrivere i meccanismi di controllo preventivo di costituzionalità esistente nella pianificazione patria. Tradizionalmente, è consuetudine di classificare il controllo della costituzionalità delle leggi in due o tre modelli: Americano e austriaci (alcuni aggiunto il modello francese), in vista della provenienza dei controlli: diffuso e concentrato (e preventivo), rispettivamente. Tuttavia, come mostra la ricerca, non vi è alcun modo, al momento, prendere in considerazione questa classificazione sono stagne, nella misura in cui ogni paese si fondono le caratteristiche dei modelli di cui, al fine di adeguarli alla cultura giuridica del posto. In questo corso, si è in un sistema giuridico, i meccanismi (non modelli) per il controllo di costituzionalità. Alcuni sono repressivi (dove il controllo avviene dopo la pubblicazione di atto legislativo), altri sono preventivi (quando il controllo è operato durante il processo legislativo). Un altro significato è ancora lì: quando il controllo è esercitato dalla magistratura e quando non lo è. Così, il lavoro affronterà i meccanismi, giudiziarie e non giudiziarie, il controllo preventivo di costituzionalità trovato in Brasile, cioè, il controllo di costituzionalità condotta dal presidente della Camera dei Deputati, per l'istituzione di commissioni i giustizia, il diritto di veto dei Presidente della Repubblica, l'analisi delle ipotesi di misure costituzionali e il Congresso Nazionale, il controllo effettuato accidentali durante il processo legislativo, il controllo di costituzionalità di preventivo proposto emendamento costituzionale che cercano di abolire una clausola pétrea e la possibilità di controllo dapprima per la Azione di violazione di obblighi fondamentali.
Este trabalho tem o objetivo de catalogar e descrever os mecanismos de controle preventivo de constitucionalidade existentes no ordenamento pátrio. Tradicionalmente, costuma-se classificar o controle de constitucionalidade das leis em dois ou três modelos: americano e austríaco (alguns acrescem o modelo francês), em vista da origem dos controles: difuso e concentrado (e preventivo), respectivamente. Todavia, conforme se busca demonstrar, não há como, atualmente, considerar tal classificação de modo estanque, na medida em que cada país mescla características dos modelos apontados, a fim de adaptá-las à cultura jurídica do lugar. Nesse rumo, tem-se, em um ordenamento jurídico, mecanismos (e não modelos) de controle de constitucionalidade. Alguns são repressivos (em que controle se dá após publicado o ato normativo), outros são preventivos (quando o controle se opera durante o processo legislativo). Outra acepção ainda se vislumbra: quando o controle é exercido pelo Poder Judiciário e quando não é. Desta forma, o trabalho abordará os mecanismos, não-jurisdicionais e jurisdicionais, de controle preventivo de constitucionalidade encontrados no Brasil, quais sejam, controle de constitucionalidade realizado pelo presidente da Câmara dos Deputados, pelas comissões de constituição e justiça, o veto do presidente da República, a análise dos pressupostos constitucionais das medidas provisórias no Congresso Nacional, o controle incidental realizado durante o processo legislativo, o controle preventivo de constitucionalidade de proposta de emenda constitucional tendente a abolir uma cláusula pétrea e a possibilidade de controle prévio pela ação de descumprimento de preceito fundamental.

There are a large number of chemical facilities that emit toxic chemicals in Michigan, and there is a concern regarding toxic chemical exposure to the residents of Michigan counties. However, it is uncertain whether chemical companies that emit toxic chemicals in Michigan are influenced by county demographic factors in deciding whether to engage in voluntary pollution prevention (P2) activities and whether this decision influences U.S. Environmental Protection Agency's (U.S. EPA) Risk-Screening Environmental Indicators (RSEI) scores. Using Bullard's theory of environmental justice, the purpose of this quantitative study was to determine if there was a correlation between chemical-related industry's voluntary P2 participation, U.S. EPA's RSEI scores for chemical-related facilities, and demographic factors in Michigan counties between 2007 through 2011. A cross-sectional design using hierarchical multiple regression analysis was used to study potential environmental inequality in 20 Michigan counties. Publically available data from the U.S. Census Bureau and the U.S. EPA included demographic data, voluntary P2 participation data, and RSEI scores for 20 counties in Michigan. A statistically insignificant correlation was found between voluntary P2 participation and median annual RSEI scores of Michigan industry; while a statistically significant, inverse correlation was found between median annual RSEI scores and educational attainment. The results from this study can be used by policy makers to promote more effective voluntary P2 policy and to create county-specific public education programs promoting toxic chemical awareness that will lead to positive social change in Michigan.
