Il Concilio di Adge (506) decise che si poteva adempiere il precetto festivo soltanto nella propria chiesa parrocchiale. Questa norma si è diffusa nella Chiesa latina e sopravviveva fino al Concilio di Trento (1545-1563), quantunque già in precedenza essa fosse stata indebolita dal diritto consuetudinario che permetteva di soddisfare l’obbligo, in determinate situazioni, anche in altre chiese parrocchiali, e anche, grazie ai privilegi papali, nelle chiese degli ordini mendicanti. Dal Concilio di Trento in poi i fedeli possono essere soltanto invogliati all’adempimento del precetto nella propria chiesa parrocchiale. Inoltre i loro concesso farlo negli oratori semi-privati, semi-pubblici, in alcuni oratori privati, e fuori dei luoghi sacri, partecipando alla Messa celebrata sugli altari portatili. Nella normativa vigente attuale basta partecipare alla Messa celebrata in qualunque luogo, però la celebrazione eucaristica fuori del luogo sacro richiede, per la liceità, il previo consenso dell’Ordinario.
Il precetto festivo viene adempiuto attraverso la partecipazione alla Messa celebrata nel rito cattolico. Dal XIX secolo i cattolici latini e orientali possono adempierlo partecipando alla Messa nel rito diverso dal loro proprio. Mentre il “Direttorio ecumenico” (1967) aveva ammesso anche la possibilità di adempierlo occasionalmente attraverso la partecipazione alla Messa celebrata dai non cattolici, il “Direttorio ecumenico” (1993) attuale ha abrogato espressamente questo privilegio.
La partecipazione alla Messa cattolica celebrata da un sacerdote scomunicato, interdetto, sospeso, se la sua pena è pubblica, adempie il precetto festivo, però un fedele può essere punito con giusta pena per la partecipazione in essa.

L'annalisi dei testi che riguardano la natura e il ruolo della Parola di Dio si concentra sui quttro testi dalla Prima Lettera di s. Giovanni (1,10; 2,5.7.14) perche solo in questa Lettera la parola logos si riferisce alla Parola di Dio. L' esegesi di quattro testi ci da una idea globale sulla natura e sul ruolo della Parola divina.Logos tou Theou appare come la rivelazione portata da Gesu in cui viene sottolineato il motivo soteriologico (1,10; 2,14) e il motivo dell'amore fraterno (2,5.7). La Parola di Dio si identifica con il precetto dell'amore vicendevole che condiziona l'identita cristiana. La Parola si rivela pure come la forza interiore che illumina il credente e che gli fa vincere il Maligno. In questo modo il suo ruolo per la Chiesa e didattico e formatrice.

Obowiązek powstrzymania się od prac według kan. 1247 Kodeksu Prawa Kanonicznego z 1983 roku
Artykuł dokonuje analizy obowiązku powstrzymania się od prac, bazując na Piśmie Świętym, tradycji kanonicznej, poprzednim i aktualnym prawodawstwie dotyczącym analizowanego zagadnienia, które składają się z dokumentów soborów powszechnych, papieży, różnych komisji Stolicy Apostolskiej, jak również opinii ekspertów teologii moralnej i prawa kanonicznego.
Pierwszy rozdział opisuje pochodzenie i rozwój obowiązku, poczynając od trzeciego przykazania Dekalogu i postępowania pierwszych chrześcijan. Należy zauważyć, iż pierwsze prawo cywilne w tej materii zostało wprowadzone przez Konstantyna 1 marca 321 r., a dopiero później przyjęte przez władze kościelne. Zarówno sobory, jak i papieże przypominali chrześcijanom o znaczeniu powstrzymania się od prac w niedziele i święta nakazane.
Drugi rozdział dokonuje analizy prawodawstwa poprzedniego Kodeksu w tej dziedzinie. Kan. 1248 KPK/17 był bardzo precyzyjny, ponieważ wyliczał czynności, od których należało się powstrzymać. Chociaż taki sposób prezentowania obowiązku był jasny, to jednak stracił wymiar teologiczny i eklezjalny.
Trzeci rozdział opisuje aktualne prawodawstwo dotyczące obowiązku, zaczynając od Soboru Watykańskiego II, analizując dokumenty Papieskiej Komisji ds. Rewizji Kodeksu, aby móc interpretować w ich świetle kan. 1247 KPK/83. Rozdział uwzględnia także różne dokumenty Stolicy Apostolskiej opublikowane po promulgacji obecnego Kodeksu.

Il tema della fedelta nella visione deuteronomista non costituisce un argomento a se stante, alla quale vengono dedicate alcune della pericope, ma viene iscritta nei testi di diverso carattere. Dio e presentato come fedele, invece nella prospettiva storica si percepisce prima di tutto l'infedelta passata d'Israele. E proprio per questo, che la fedelta diventa una sfida per il popolo eletto. Nel contesto del patto essa viene espressa nella lealta, che vuol dire rimanere saldamente legati a Dio. La legge cioe la Torah che Mose insegna, diviene dunque l'indicatore della fedelta, della fedelta ancorata nell'alleanza. Per il fondamento di fedelta cosi compresa si trova nel precetto di amore per Dio. Nel Deuteronomio, che ha un carattere parenetico, Mose e presentato come colui che si rivolge ad Israele col grande ardore e attraverso gli ammonizioni e gli insegnamenti lo richiama alla fedelta.

La pena della dimissione dallo stato clericale è la pena espiatoria, massima per i chierici ai quali soltanto può essere applicata. E la pena perpetua per la sua natura. Può essere irrogata mediante processo giudiziario o per mezzo di procedimento amministrativo salvo sempre il diritto di difesa. Può essere comminata nei casi previsti dalla legge universale, cioè: 1) l’apostasia, l’eresia e lo scisma, con prolungata o grave scandalo; 2) la profanazione delle specie consacrate; 3) la consacrazione a scopo sacrilego di una materia senza l’altra nella celebrazione eucaristica o anche di entrambe fuori della celebrazione eucaristica; 4) la violenza fisica contro il Sommo Pontefice; 5) la sollecitazione; 6) il matrimonio anche solo civile con contumacia; 7) il concubinato con contumacia; 8) gli atti contro il sesto precetto del Decalogo fatti con violenza, o minacce, o pubblicamente, o con minori al di sotto dei diciotto anni. E prevista alla Congregazione per il Clero come facoltà speciale di intervenire ai sensi del can. 1399 CIC. In tutti i casi la pena è facoltativa. Tale pena comporta la perdita dei diritti propri dello stato clericale, degli onori e degli uffici ecclesiastici.

AbstractThis paper presents an edition and translation of the poem in the Exeter Book better called Paternal Precepts, not just Precepts, with some commentary. The poem is abstract, and father and son are no dramatis personae. Its instruction is that not only how one thinks and acts, but also how one speaks should be endowed with virtue. The brief introduction of Paternal Precepts directs us into the ten paternal precepts to teach a well-born son. The first precept instructs the son to be virtuous, and to honour his parents and teachers. The second and third precepts direct the son not to keep bad company, and teach that God rewards virtue and punishes complicity in evil. The fourth precept is about loyalty, both to one’s friends and to one’s high principles. The fifth precept is about what is to be avoided: drunkenness, evil thoughts, lies, boasting; and the dangers of loving women. It is important to be a safekeeper of one’s words. The sixth precept is about understanding the concepts good and evil. The seventh precept reflects, in expressive contrasts, on futurity, and that the wise recognize sorrow in joys, whereas a fool fails to see that exultation may be enmeshed in sorrow. The eighth precept is about the theological concepts of God and saints. It ends with the glory of truth. The long ninth precept dwells on the Lord’s commandments, and with terms not entirely clear: ancient writings, perhaps the Scriptures together with the writings of the Church Fathers; ‘forward-looking writings’, that is perhaps prophecies, and native traditions. The long tenth precept embraces sins of words and deeds, truth, wrath, and wisdom.

En el presente estudio analizamos la regulación de la promesa al amparo del CC portugués de 1966 y las implicaciones que comporta para los promitentes. El en texto nos detenemos en el estudio del vigente art. 1.591 CC fruto de la reforma practicada por Lei n. 9/2010, de 31 de maio de 2010 que, aunque se presenta en idénticos términos que el derogado art. 1.591 CC de 1966, lo cierto es que ha suprimido la expresión “de sexo diferente”, equiparando la promesa realizada por pareja heterosexual de la efectuada por pareja homosexual. A continuación, nos ocupamos de los preceptos introducidos por el legislador dedicados: a la regulación en materia de restitución de las donaciones efectuadas a causa de la promesa de matrimonio, en caso de imposibilidad de celebración del futuro vínculo matrimonial [arts. 1.592 y 1.593]. Asimismo, nos detenemos en la obligación de indemnizar [art. 1594 CC] que, aunque no se trata de una disposición innovadora, lo cierto es que se diferencia de los dos preceptos previos en que esta obligación únicamente recae sobre el promitente culpable, mientras que en aquellos otros la obligación de restituir recae indistintamente sobre ambas partes, medie o no “culpa”. También aludimos a las particularidades que presenta este precepto, destacándose: que el alcance de la obligación indemnizatoria sea extensible también a los padres del promitente inocente e, incluso a terceros; la medida del daño resarcible, limitada a los “gastos efectuados” y “obligaciones contraídas” a causa de la promesa y, que la indemnización sea fijada al arbitrio de la autoridad judicial. In questo articolo vengono analizzati i canoni 1341 e 1342 del CIC/1983. Lanalisi viene fatta alla luce dell’attuale interpretazione dottrinale in materia della giusta applicazione delle pene. Canoni sottoposti all’analisi riguardano le competenze e gli obblighi del Ordinario nella fase iniziale dell'applicazine delle pene ecclesiastiche. Si tratta del momento molto importante nel iter dell’applicazione delle pene, e cioè della possibilità e necessità di iniziare il processo penale canonico e scelta del modo di procedere: giudiziale o amministrativo. La prima parte dell’articolo l’autore ha dedicato alla problematica del delitto canonico, della possibilità e della necessità del processo penale canonico. Ordinario prima di avviare vero processo penale (o quello in via giudiziale oppure quello in via amministrativa) deve avere la notizia almeno probabile del delitto. Non basta la notizia di qualsiasi violazione, ma è necessario che il comportamento denunciato sia incluso tra i delitti previsti nel diritto canonico. Soltanto così si può passare all’avvio del primo passo del processo e cioè all’indagine previa. Terminata questa si deve rispondere alle domande se il processo canonico è possibile e se questo processo è anche necessario. Può darsi, che, a causa della prescrizione dell’azione criminale, il processo non sarà possibile anche se ci fossero certe prove del delitto. A quanto pare una eccezione troviamo al riguardo dei delitti riservati alia Congregazine per la Dottrina della Fede. Secondo la concessione data dal Sommo Pontefice nel 2002 i delicta graviores, anche se sono passati in prescrizione, possono essere ripresi sulla fonadata petizione dei vescovi interessati. Alla luce della disposizione del can. 1341 si può dire che applicazione delle pene in Ecclesia diventa extrema ratio, e cioè la via che si puo intraprendere soltanto, quando l’autorità ha fatto inutilmente rifferimento ad altri mezzi di carattere pastorale. Un’altro punto dell’articolo viene dedicato all’analisi delle disposizioni che bisogna tenere conto nel momento della scelta della via giudiziale o amministrativa per applicare le pene. Seguendo le disposizioni del can. 1342 si deve notare che la via giudiziale dell’applicazione delle pene ecclesiastiche è la via normale ed obbligatoria. Ordinario per principio è obbligato di scegliere questo modo di procedere, inoltre la via giudiziale è obbligatoria per l’applicazione delle pene espiatorie perpetue. Obbligo di scegliere la via giudiziale potrebbe risultare anche dalla legge o precetto che vietano l’applicazione delle pene tramite la via amministrativa. Invece la via amministrativa è possibile da scegliere soltanto sotto la condizione, e cioè soltanto nel caso se ci fossero le giuste cause che si opponessro alla via giudiziale. Fermo restando però divieto di scegliere la via amministrativa nel caso diapplicazione delle pene espiatorie perpetue, come pure del divieto previsto nella legge o nel precetto. Come si può vedere dall’analisi dei elementi specifici del processo giudiziale e quello amministrativo, sia l’uno che l’altro possiede i strumnenti neccessari per garantire, che la pena diventi veramente l’applicazione di quello che e veramente „iustum et bonum” in caso concreto. Bisogna notare però che il processo in via giudiziale (grazie alla sua struttura) offre più garanzie per salvaguardare i diritti delle persone e per arrivare alla verità oggetiva. Invece il processo in via amministrativa (grazie alla procedura meno complessa) diventa più breve, più spedito e quindi non sottoposto troppo facilmente alla diffusione, e quindi sembra meglio garantire la salvaguardia di buona fama della persona giudicata.

ABSTRAK Implementasi pendidikan tahap profesi ners adalah peserta didik menerapkan ilmu pengetahuan teori, konsep dan keterampilan teknis yang telah dikuasai pada program akademik pada klien langsung melalui program internship dimana peserta didik dibimbing oleh seorang perawat sebagai preceptor. Keberadaan pendidik klinik/preceptor sangat diperlukan dalam menjamin keterlaksanaan layanan pasien yang berkualitas serta menjamin kompetensi peserta didik. Disamping itu, pendidik klinik/preceptor juga diperlukan untuk mengurangi stres yang mungkin dialami oleh peserta didik sebagai lulusan sarjana keperawatan baru yang belum mengenal dunia kerja sebenarnya serta untuk menjamin bahwa tanggung jawab tidak sepenuhnya berada pada peserta didik, tidak diberikan secara lebih dini atau tidak seharusnya diberikan secara kurang tepat. Metoda pembelajaran pada tahap profesi berfokus pada pelaksanaan pendelegasian kewenangan dari preceptor kepada peserta didiknya. Sedangkan kegiatan evaluasi pada tahap profesi lebih terfokus pada pembuktian bahwa peserta didik telah memiliki kompetensi yang ditetapkan dan disertai dengan kemandirian dalam menjalankan kompetensinya sebagai cerminan kewenangan telah dimiliki. Tujuan dari pelatihan OSCE diharapkan dapat memberi pemahaman tentang evaluasi dengan metode OSCE, sehingga para evaluator dapat mengevaluasi secara objektif sesuai kemampuan mahasiswa. Metode yang akan dilakukan adalah pelatihan OSCE kepada preseptor klinik rumah sakit aliansi. Hasil yang didapatkan pre-tes dengan nilai rata-rata 65, setelah diberikan pelatihan meningkat menjadi 85. Kesimpulan yang didapatkan terjadi peningkatan pemahaman preseptor mahasiswa. The existence of clinical educators/preceptors is very necessary in ensuring the implementation of quality patient services and ensuring the competence of students. In addition, clinical educators / preceptors are also needed to reduce stress that may be experienced by students as new nursing graduates who are not familiar with the real world of work and to ensure that the responsibility is not entirely on the students, is not given earlier or should not be given. given incorrectly. The learning method at the professional stage focuses on implementing the delegation of authority from the preceptor to his students. Meanwhile, evaluation activities at the professional stage are more focused on proving that students have the competencies defined and accompanied by independence in carrying out their competencies as a reflection of the authority they have. The purpose of the OSCE training is expected to provide an understanding of evaluation using the OSCE method, so that evaluators can evaluate objectively according to students' abilities. The method that will be used is OSCE training for clinical precepts of alliance hospitals. The results obtained pre-test with an average value of 65, after being given the training increased to 85. Secure attachment is fundamental to the development of resilience among adolescents. The present study investigated whether meditation and precept practices influence the relationship between attachment and resilience. This study recruited 453 10th–12th-grade boarding school students who completed the Experience of Close Relationship Questionnaire (revised), Resilience Inventory, Inner Strength-Based Inventory, and Precept Practice to assess attachment, resilience, meditation practice, and precepts adherence. The participants’ mean age was 16.35 ± 0.96 years; 87.9% were females, and 89.2% were Buddhists. A parallel mediation model within the structural equation framework was used for an analysis of the indirect effect of attachment on resilience through meditation and precept practices. The indirect effects of attachment anxiety and avoidance on resilience were β = −0.086, 95% CI = −0.125, −0.054, p < 0.001, and β = −0.050, 95% CI = −0.088, −0.021, p = 0.006, respectively. The indirect effect size resulting from meditation was significantly higher than that resulting from observance of the precepts. The parallel mediation model explained the 33% variance of the resilience scores, compared with 23% from the direct effect of attachment anxiety and avoidance only. This work provides evidence that meditation and precepts significantly affect the relationship between attachment and resilience.

Most of the religions of the world are based on some fundamental moral principles of good conduct/virtues and prohibits its followers to do anything which is not good for the welfare of the society as a whole. This fundamental moral principal of good conduct, in Buddhism, is known as Pancha Shila (Five Precepts or Five Virtues). Pancha Shila is the basic assumption of moral activities for both households as well as for renunciates. It forms the actual practice of morality. Each time the precepts are upheld, the moral volitions are strengthened, until morality becomes a habitualtrait through the condition of repetition. For the smooth functioning of a society, every Buddhist has to follow the five moral precepts i.e. abstaining from killing, abstaining from stealing, abstaining from sexual misconduct, abstaining from falsehood, abstaining from taking intoxicants. Jainism, Christianity, Hinduism and Islam too accept such ethical codes with little modification. These are called cardinal virtues. Jaina concept of Pancha Mahavrata is very close to Buddhist concept of Pancha Shila. In Jainism these are; Ahimsa (Abstinence from all injury to life), Satyam (Abstinence from falsehood), Asteyam (Abstinence from stealing), Brahmacharyam (abstinence from self indulgence), Aparigraha (Abstinence from all attachment). Mahatma Gandhi too accepted these five cardinal virtues given by Jainism but he added two more in it which are; Fearlessness and Faith in God. The five precepts of Buddhism offers the moral conducts following which everyone can avoid evil deeds and can contribute in making this world a better world for present and future generations. The precept of abstaining from killing leads to the respect for other’s life. The precept of abstaining from stealing leads to the respect for other’s property. The precept of abstaining from sexual misconduct leads to the respect for one’s own dignity and dignity of other’s especially women. The precept of abstaining from falsehood leads to the respect for honesty. The precept of abstaining from taking alcohol leads to innumerable number of good qualities like respect for a clear mind, respect for modesty of other human beings, respect for money, respect for one’s own dignity, respect for other’s life and so on. The five precepts of Buddhism make a person disciplined, which is one of the most important ingredients for the development of overall personality of a person. A developing country cannot become a developed one unless its citizens are disciplined. If we analyze the five precepts given by Buddhism then, we find that the solution for most of world problems lies in it. If everyone follows five precepts then, I think this world will be transformed into a better place, a place where people have respects for other’s life and property, where everybody’s interest will be taken care of, where people will have an altruistic approach towards society. In short, this world can be transformed into a heaven.

Il Cristo Pantocratore assunto come modello iconografico per rappresentare la sovranità nel Regnum Siciliae in età normanno-sveva, lasciava il posto in età angioina alla paupertas che, per effetto della predicazione francescana accolta dai sovrani napoletani, diventava elemento ineludibile di legittimità del potere regio. In una lettera scritta dal frate francescano Angelo Clareno a Filippo di Majorca, fratello della regina Sancha di Napoli, sono delineati i caratteri del sovrano cristiforme, che esercita il potere in qualità di amministratore del Regno, il cui unico titolare è Cristo: a Deo coronato è solo il sovrano che si fa povero, spogliandosi di ogni brama di potere e volontà di dominio ed usando le ricchezze pubbliche al solo scopo di provvedere alle necessità dei sudditi. La novitas francescana incentrata sul precetto del sine proprio codificato nella Regola di Francesco di Assisi, mutava la rappresentazione e le prospettive della sovranità, introducendo nel diritto pubblico del Regno concetti giuridici destinati ad ampliare la gamma dei significati di proprietas e di dominium. Con sguardo retrospettivo ed in continuità con la tradizione del Regno, l’ultimo re delle Due Sicilie Francesco II di Borbone faceva appello agli antichi diritti del trono di Ruggero e di Carlo III per difendere la legittima sovranità delle Due Sicilie, richiamando così l’immagine del sovrano a Deo coronato la cui condotta politica non poteva che ispirarsi al modello della christiformitas: una prospettiva della sovranità che di lì a poco sarebbe stata travolta dagli eventi rivoluzionari in corso in tutta Europa, dei quali tuttavia potrebbe fornire un’inedita chiave di lettura, proponendosi come momento di riflessione sulla storia italiana ed europea degli ultimi due secoli.

AbstractOver the course of his roughly fifty-year ministry, the Japanese vinaya (ritsu) revivalist priest Eison (also read “Eizon,” 1201–1290) is said to have bestowed the bodhisattva precepts upon some 97,710 people. Many of these conferrals were given en masse, with tens or hundreds (and, according to some records, even thousands) taking precepts (jukai; Chns. shoujie) from Eison together, in single ceremonies. This study places Eison's use of precept-conferral ceremonies in the broader historical context of East Asian, and especially Japanese, Buddhist practice. It then focuses on the particular methods used and innovations introduced by Eison and his vinaya-revival movement, paying close attention to the socio-political roles that precept-conferral ceremonies played in relationships between monks, monasteries, and lay devotees in medieval Japan.

Abstract The discussion of the recognition of human rights by law suffers from the acceptance of three myths: that recognition is provided for in human rights instruments, that there exist moral norms ready to be recognised by law and that recognition is what happens when a legal norm that corresponds to a moral precept is adopted. To counter the first myth, the article undertakes a close reading of the relevant passages of human rights instruments. To counter the second myth, the article observes that there exist few if any universally valid moral norms ready to be recognised by law but an abundance of other moral precepts. To counter the third myth, the article argues that what happens is rather the replication of the content of a moral precept in law. From all these, it follows that there cannot be any necessary connection between moral norms or other precepts and legal human rights. This distinctness of moral precepts and legal human rights, it is argued in conclusion, is apt to strengthen legal human rights protection: it diminishes the influence ‘traditional values’ might otherwise have on this protection.

This article examines whether Pancasila as the sole principle and ideology and state philosophy is reflected in the Indonesian society. Understanding and appreciation of the values of Pancasila ideology are often considered only as a jargon, i.e., in the verbal perspective. Its implementation is neglected due to lack of insight and knowledge about Pancasila and not knowing its basic principles. Pancasila, which consists of five precepts, includes a series of attitudes and knowledge as well as hopes from the struggle of the Indonesian people to gain independence, and is regulated in the Pancasila state. The first precept is about God the Almighty ( Ketuhanan yang Maha Esa ); the second precept is about just and civilized humanity ( Kemanusiaan yang adil dan beradab ); the third precept claims the ‘unity of Indonesia’ ( Persatuan Indonesia ); the fourth precept claims democracy led by wisdom in the representative deliberation; the fifth precept claims social justice for all Indonesian people ( Keadilan sosial bagi seluruh rakyat Indonesia ). Pancasila is the source of all laws in the Constitution of the Republic of Indonesia, which constitutes it as a sovereign and prosperous country supporting the wealth of its people, the divinity in the One and Only, freedom of religion, respect for diversity and pluralism, and building a democratic state. Social problems that often occur in every society usually start from breaking the law, dangers of the extremism doctrine, and criminal acts of corruption that can damage the grassroots of Pancasila. Therefore, to defend the country and strengthen the basic precepts of Pancasila, it is necessary to understand and deepen the practice of Pancasila in the ideology of nationalism and democracy.

The main question that the present paper tries to answer is as fol- lows: since two discordant precepts concerning work were to be found in the New Testament, how did monks behave? One precept treated work as a duty, the other recommended not to care about one’s maintenance. The monks followed in their behaviour either the first or the second precept. As a result of disputes that took place in the fourth century the opinion prevailed that work was the better choice. It is important for us to find out when and under what circumstances that choice was done by the majority of the monastic movement in the East. It is also important to see what arguments were used by the monks of Late Antiquity in order to settle the conflict between the two discordant precepts. This conflict worried many and caused a renewal of a dispute that seemed to have been closed. Two ways of reasoning in favour of monastic work were generally used: monks might and should pray and work at the same time, satisfying both precepts; monks ought to work in order to be able to give alms, and this conferred to work a meaning that went beyond immediate usefulness. Praying and working at the same time was not always feasible in actual practice, but this did not bother authors of ascetic treatises.

This project evaluates a program to better prepare nurse practitioners (NPs) to serve as preceptors/mentors. Currently, many NPs informally precept/mentor NP students without having formalized preparation for the educational role. A training program for NP preceptors/mentors was developed to enhance the NP’s knowledge of the 6 common qualities shown to enhance preceptor effectiveness. The design was a pre- and postintervention survey and was analyzed using a paired t test. Fifteen NPs who were employed at a Level 1 trauma center and 3 NPs from outside primary care practices participated in the project. Each participant completed a pretest, an educational session, posttest, and an evaluation survey. All participants had increased knowledge about the 6 preceptor qualities at the completion of the session, p = .001.

Circa vent’anni anni dopo, il fratello maggiore procede all’alienazione nell’errata convinzione che suo fratello minore gli abbia corrisposto quanto concordato. Invece quest’ultimo era perfettamente a conoscenza di possedere indebitamente la proprietà dell’appartamento. Pertanto, seppur in presenza di un void contract per mancanza della forma scritta ad substantiam (imposta dalla section 2 del LPA), la Corte, al fine di porre rimedio alla frode commessa, nomina il fratello minore constructive trustee dell’appartamento a favore di quello maggiore. Allo stesso modo, questa identifica un classico esempio di “presumed resulting trust”: ipotesi che ricorre qualora la proprietà del bene venga trasferita gratuitamente o ad un prezzo vile da un soggetto ad un altro ed in assenza dell’intenzione del primo di donare così che si presume che il trasferente non abbia inteso spogliarsi del suo beneficial interest. Nel caso in cui la medesima vicenda pendesse innanzi ad un giudice italiano, il trasferimento operato dal fratello maggiore in virtù dell’accordo orale parrebbe integrare i presupposti di un’esecuzione de facto di un contratto nullo per mancanza della forma prescritta dalla legge. Oltre a tale eventualità, un’ulteriore strategia difensiva potrebbe fondarsi sul precetto contenuto all’art. 2037 cod. civ. che impone a colui che abbia ricevuto indebitamente una cosa determinata di restituirla o sulla disciplina di chiusura relativa all’arricchimento senza causa. The author's view Two brothers orally agree that the older, sole owner of an apartment, would sell it to the younger at a pre-established price. About twenty years later, the older brother proceeds with the sale in the mistaken belief that his younger brother has paid him what was agreed. Instead, the latter was perfectly aware that he unduly owned the property in the apartment. Therefore, even in the presence of a void contract due to the lack of the ad substantiam written form (imposed by section 2 of the LPA), the Court, in order to repair to the fraud committed, appoints the younger brother constructive trustee of the apartment in favor of the older. Similarly, this identifies a classic example of “presumed resulting trust” a hypothesis that occurs when the ownership of the asset is transferred for free or at a base price from one person to another and in the absence of the former’s intention to donate so that it is presumed that the transferor did not intend to divest himself of his beneficial interest. In the event that the same question would hang in front of an Italian judge, the transfer made by the older brother by virtue of the oral agreement would appear to integrate the conditions of a de facto execution of a contract that was void due to the lack of the form prescribed by law. In addition to this eventuality, a further defensive strategy could be based on the precept contained in the art. 2037 of the civil code which imposes to a person who has received a certain thing unduly to give it back or on the closing discipline relating to unjust enrichment.

Purpose Evidence has shown that the Five precepts significantly affect the relationship between attachment and resilience; however, little is known whether observing the Five Precepts would help reduce depressive symptoms among those who experience risks. The aim of this study was to examine the moderating role of the Five Precepts in the mediation model relationship among neuroticism, perceived stress, and depression. Patients and methods The study employed a cross-sectional survey design and data were collected from the end of 2019 to September 2022 in Thailand. In all, 644 general participants completed questionnaires on the Neuroticism Inventory (NI), the 10-item Perceived Stress Scale (PSS), Depression Subscale, and the Five-Precept Subscale of the Inner Strength-based Inventory (SBI-PP). Mediation and moderation analyses with 5000 bootstrapping methods were used. Results Among all, 74.2% were female, and the mean age totalled 28.28 years (SD = 10.6). SBI-PP was shown to have a moderation effect on the relationship between NI, PSS and depressive symptoms. The moderating effect between SBI-PP and PSS was significant, whereas SBI-PP and NI was not. The index of moderated mediation from the Five Precepts was significant (b = -0.019 (95%CI -0.029, -0.009)). The moderated mediation model increased the percent variance explaining depressive symptoms to 47.6%, compared with 32.6% from the mediation model alone. Conclusion Observing the Five Precepts offers evidence that it buffers the effect of perceived stress on depression. People with high levels of observing the Five Precepts are less likely to develop depressive symptoms. Implications as well as possible future research are discussed.

A partir da Constituição Federal de 1988, a investidura no emprego público passa por aprovação em concurso público e essa previsão, além de moralizadora, exige planejamento por parte da Administração Pública. consequências administrativas para a investidura em cargos públicos sem concurso público? Este artigo teve como objetivo identificar as implicações jurídicas para a administração pública da contratação sem licitação. Pretendeu-se analisar questões como nepotismo e clientelismo, patrimônio cultural da administração pública; situar as questões relativas aos preceitos constitucionais de contratação de servidores públicos. Os pressupostos do estudo apontam que a contratação de servidores públicos tem como preceito a realização de concurso público, previstos como princípios normativos da moralidade e da legalidade. Para responder aos objetivos do estudo e ao problema identificado, foi realizada uma pesquisa bibliográfica com base nos fundamentos teóricos dos autores. Os resultados mostraram as implicações jurídicas da contratação sem concurso público, mostrando que os preceitos constitucionais preveem a realização de concurso público, com base no direito de concorrência e oportunidade do cidadão ser investido no serviço público. KG y otros, C-297/14, recoge la interpretación del art. 15.1.c) del Reglamento 44/2001, en relación con el art. 16.1 de dicho instrumento, preceptos que contienen el foro de consumidores. Celebrando os quarenta anos de A Hermenêutica do Sujeito — o curso ministrado por Michel Foucault no Collège de France, em 1982 —, este texto propõe-se a estabelecer conexões, gerais e específicas, entre aquele curso e a Educação. É feita uma discussão acerca da perspectiva analítica não metafísica adotada por Foucault, em contraste com o atual discurso pedagógico interpretativo dominante. São discutidos os sentidos que se pode dar a alguns insights daquele curso, em suas relações com a Educação contemporânea. Propondo-se uma diferenciação entre pedagogia e Pedagogia, destaca-se a função subjetivante das práticas pedagógicas na educação escolarizada. Argumenta-se em favor da ontologia histórica, em oposição à ontologia transcendental e recorre-se ao conceito de frame, de modo a ressaltar sua importância e limitações em estudos como este. Discute-se a inversão moderna que colocou ênfase no preceito do “conhece-te a ti mesmo” (gnôthi seautón), deixando em segundo plano o preceito do “cuida de ti mesmo” (epiméleia heautoû), do que resultou a substituição do ideal antigo do sujeito das ações corretas pelo ideal moderno do sujeito dos saberes verdadeiros. Sugere-se que a Educação possa contribuir para suspender a anunciada morte do sujeito ou, pelo menos, mitigar os seus efeitos. Palavras-chave: Foucault; Subjetivação; Pedagogia; Ontologia histórica. Weaves: between Hermeneutics of the Subject and Education Abstract: Celebrating the forty years of The Hermeneutics of the Subject —the course by Michel Foucault at the Collège de France, in 1982—, this text proposes to establish connections, both general and specific, between that course and Education. A discussion is made about the non-metaphysical analytical perspective adopted by Foucault, in contrast to current dominant interpretive pedagogical discourses. The meanings that can be given to some insights from that course are discussed, in their relations with education. Proposing a differentiation between pedagogy and Pedagogy, the subjectivizing function of pedagogical practices in schools is highlighted. We argue in favor of historical ontology, as opposed to transcendental ontology, and we resort to the concept of frame, in order to emphasize its importance and limitations in foucauldian studies. We discuss the modern inversion that placed emphasis on the precept “know thyself” (gnôthi seautón), leaving in the background the precept “take care of yourself” (epiméleia heautoû), which resulted in the replacement of the ideal of the subject of correct actions by the modern ideal of the subject of true knowledge. Background. Preceptorship constitutes an important component of the educational process of training nursing students. The purpose of this study was to assess the knowledge, perceived motivators, and perceived inhibitors to precepting nursing students at the clinical placement sites in the Cape Coast Metropolis of the Central Region of Ghana. Methods. A descriptive cross-sectional study was conducted among 442 nurses and midwives aged 27–56 years with at least three years of work experience. Data were collected with a questionnaire and analyzed using frequency counts, percentages, exploratory factor analysis, and point biserial correlation. Results. The results indicate that the participants had a high knowledge of preceptorship of up to 91.2% (n = 404). A significant proportion of up to 88.2% (n = 390) had an intention to precept nursing students in the near future. The three important perceived motivational factors to precepting nursing students were the learning and professional needs of students, helping students to develop skills, and experience and formal recognition of the role of preceptorship. The main perceived inhibitors to engage in a preceptorship role were lack of preparation for the role, lack of support from faculty and nurse managers, and additional work burden. The results further indicate a significant strong positive correlation between experience and professional recognition of preceptorship and the intention to precept nursing students in the near future (r = 0.99, p = 0.037 ). Conclusions. The nurses and midwives who participated in the study are knowledgeable about preceptorship and have the intention to precept nursing students. Having enough experience on the job and being formally recognized as a preceptor may motivate these professionals to precept nursing students. However, there are critical perceived barriers that need to be addressed, to enable more nurses and midwives with the desire to precept students to engage in the preceptorship role.

Na distinção das artes a prescrição do lume para o “disegno visivo” seguirá preceitos do tratado Da pintura de Alberti. No crescente da construção retórica discursiva, tal proposição é suplantada quando se trata dos lumi da scena, ou seja, “luzes que se vêem”, obtidas pelo fogo, que incidem sobre tintas coloridas, como formas de ornatos materiais, amplificam o relevo e dão a ver os volumes superando, por emulação, as próprias coisas naturais.

O ensino médico é extremamente importante na determinação da qualidade técnica dos futuros profissionais. Embora o Brasil apresente legislação específica sobre o tema, observamos discrepâncias no processo de aprendizado, o que, muitas vezes, compromete a formação dos futuros médicos. Além disso, métodos de ensino tradicionais, baseados fundamentalmente no diagnóstico de problemas, são ainda praticados em várias faculdades. Estes métodos relegam preceitos educacionais e, muitas vezes, colocam os estudantes em papel secundário. Nessa perspectiva, apresentamos um promissor método de ensino médico chamado Preceptoria em um Minuto (One-Minute Preceptor), salientando seu papel voltado ao profissional em formação. Destacamos também a importância deste método por permitir o ensino em tempo relativamente limitado, frente à crescente demanda por atendimentos

Este artículo deviene de un estudio realizado desde el paradigma positivista y enmarcado en una investigación con diseño bibliográfico de base documental. Como conclusión, se establece que el nihilismo como precepto se define como una postura incrédula y ambigua, donde el sinsentido se presenta como la nada y marca la pauta de una presunción incoherente, haciendo énfasis en la transvaloración y la desvaloración al mismo tiempo con la ausencia fatídica de un Dios y la convicción de que la existencia es definitivamente absurda si se trata de los más costosos valores que se puedan reconocer, donde los avances tecnológicos vienen a sazonar e inducir la perdida de los valores necesarios para la vida, invitando a reconstruirlos para esta era.

O presente artigo tem como objetivo principal fazer uma análise ética e jurídica quanto à proteção do direito à vida no Brasil, abordando a construção jurisprudencial do Supremo Tribunal Federal, especificamente quanto aos fundamentos jurídicos utilizados nas decisões decorrentes da Ação Direta de Inconstitucionalidade nº 3.510, da Arguição de Descumprimento de Preceito Fundamental nº 54 e do Habeas Corpus nº 124.306. Para tanto, fora utilizada a pesquisa qualitativa, tendo essa se desenvolvido por meio de levantamento bibliográfico e documental, em livros e artigos científicos que versam sobre o tema, bem como por pesquisa jurisprudencial. Dessa forma, constatou-se que não há um consenso, no que diz respeito ao termo inicial da vida, de modo que se faz fundamental dialogar com a nova realidade decorrente dos avanços biotecnológicos, no processo de construção de preceitos éticos e jurídicos de proteção do embrião e da natureza humana, tendo como referencial a dignidade humana.

Aborda notas atuais sobre a argüição de descumprimento de preceitofundamental, tendo em vista a previsão constitucional e legal e à luz da doutrina e da jurisprudência sobre o tema. Demonstra que a ADPF podeser autônoma ou incidental. Analisa a controvérsia constitucional concretaposta sob julgamento perante o Supremo Tribunal Federal. Trata da necessidade da comprovação da existência de controvérsia relevante sobre preceito fundamental, sob pena de não se admitir e conhecer da argüição. Sustenta também que face ao princípio da subsidiariedade a propositura da ADPF não será admitida quando houver outro meio eficaz de sanar a lesividade. Aborda acerca do entendimento do STF sobre a ADPF como ação constitucional apta a viabilizar a concretização de políticas públicas. Conclui que a jurisprudência do STF vem dando contornos mais nítidos ao instituto, fornecendo uma diretriz confiável sobre a interpretação e aplicação dos preceitos fundamentais previstos na Constituição Federal.

O objetivo neste trabalho foi avaliar os efeitos dos métodos de abate de frangos com eletronarcose e sem insensibilização (conforme preceito do método Halal) e dos cortes unilateral e bilateral na eficiência da sangria. Foram utilizadas 100 aves, fêmeas, abatidas sob Serviço de Inspeção Federal e divididas em dois tratamentos: com e sem insensibilização, submetidas a dois protocolos de manuseio distintos: cortes unilateral e bilateral das artérias e veias carótidas em delineamento inteiramente casualizado. A eficiência da sangria foi avaliada por meio do percentual de sangue escoado por peso corporal dos frangos expelido por meio de cortes unilateral e bilateral dos vasos sanguíneos. Verificou-se maior perda de sangue nos animais abatidos insensibilizados por eletronarcose e, não houve diferença estatística entre os cortes unilateral e bilateral. Conclui-se que, do ponto de vista da eficiência da sangria, o método de abate com eletronarcose não prejudica o escoamento de sangue, atendendo aos preceitos de abate Halal.

A arguição de descumprimento de preceito fundamental 422 pretende que o STF exclua do âmbito de incidência dos artigos 124 e 126 do Código Penal a interrupção da gestação induzida e voluntária realizada nas primeiras 12 semanas. A ação argumenta que os artigos que proíbem o aborto afrontam preceitos fundamentais da Constituição Federal de 1988. Objetivo – Analisar os argumentos apresentados por especialistas, instituições e organizações na audiência pública realizada nos dias 03 e 06 de agosto de 2018 na Primeira Turma do STF para contribuir, de forma dialógica, com a discussão sobre a descriminalização do aborto. Métodos – Neste trabalho, utilizamos o método dialético, através da investigação da contraposição dos argumentos conflitantes no âmbito da referida audiência pública para posterior compreensão do papel dos mesmos na discussão do tema. A audiência pública objeto da pesquisa está disponível no canal do STF no YouTube em quatro vídeos publicados em 06 de agosto de 2018. O trabalho insere-se na área temática 9, Bioética e Política.

This study presents the ideas about setting times for Torah study in the writings of R. Shneur Zalman of Liady (Rashaz) as one of the elements that formed the inclusive concept of mystical experience in the Ḥabad movement. The article argues that in his teachings Rashaz invested common experiences and the precepts of normative, non-mystical Judaism with mystical meanings, and thus proposed a new, inclusive concept of mystical experience. The reinterpretation of the precept of setting times for Torah study in Rashaz's writings was one of the factors that greatly contributed to the re-evaluation of the role of ordinary people in religious life, and to shaping Ḥabad's inclusivist vision of mysticism.
