Genitori ed educatori hanno cercato di mantenere alta la consapevolezza dei diritti dei bambini e delle famiglie. È fondamentale ribadire il diritto di tutti i bambini di ricevere un'educazione adeguata in contesti in grado di garantire uguaglianza e inclusione. La realtà senza precedenti della pandemia ha offerto l'opportunità di sviluppare nuove strategie e ha messo in luce la centralità di una educazione ecologica, in grado di mantenere connessioni sempe più strette con l'ambiente e gli ambienti di vita.

Del tutto irrilevante è l’intervenuta sostituzione del trustee e il conseguente trasferimento del fondo in trust, in ordine alla responsabilità del pagamento dei tributi già sorti in precedenza che rimane un obbligo dell’ex trustee. Nella fase esecutiva, però, questi potrà eccepire condizioni che impediscono l’esecuzione nei suoi confronti.

Non risponde di bancarotta fraudolenta nemmeno il guardiano, in quanto era estraneo alla gestione del trust e a nulla rilevando che fosse il commercialista della fallita.

A partire dai bilanci dell'esercizio 2009, l'applicazione dello IAS 1 revised richiede al conto economico l'evidenza del total comprehensive income, una misura di performance che si ottiene sommando alla tradizionale figura del profit or loss quei valori non realizzati (segnatamente, variazioni di fair value) che, in precedenza, erano iscritti direttamente a patrimonio netto e quindi non partecipavano alla formazione del reddito di periodo. Con questa ricerca gli autori si pongono l'obiettivo di misurare l'impatto che l'adozione del prospetto di conto economico complessivo ha comportato sulla rappresentazione della performance periodica d'impresa, in Italia e Francia, osservando l'entità e la volatilità del nuovo risultato economico, nonché la sua composizione.

Il Traveling Salesman Problem (TSP) è un problema di ottimizzazione combinatoria che si può formulare nel seguente modo. Siano date n città e i costi per spostarsi da una città all'altra. Il salesman partendo da una delle città, deve compiere un tour in cui visita una ed una sola volta ciascuna città ritornando alla città di partenza. L'obiettivo è minimizzare il costo del tour. Aggiungendo al TSP i cosiddetti vincoli di precedenza, si parla di Traveling Salesman Problem with Precedence Constrains (TSPP), noto in letteratura anche come Sequential Ordering Problem (SOP). Questi vincoli impongono che determinate città possano essere visitate solamente dopo averne visitate delle altre, specificate nei dati del problema. In questa tesi vengono presentati nuovi metodi di risoluzione del TSPP basati sulla Programmazione Dinamica (DP) e sul rilassamento dello spazio degli stati. Tali metodi consentono di calcolare nuovi lower bound in pochi secondi di tempo calcolo. I risultati di calcolo ottenuti su un insieme di problemi test mostrano l’efficienza dei nuovi metodi proposti. Infatti i lower bound proposti dominano o risultano competitivi con i migliori metodi proposti in letteratura, i quali richiedono tempi di calcolo di diversi ordini di grandezza superiori a quelli richiesti dai metodi proposti.

La sordità ereditaria è caratterizzata dal un elevato livello di eterogeneicità genetica. Le società in cui esiste un’accettazione culturale dei matrimoni tra soggetti consanguinei sono dei modelli di studio molto interessanti per lo studio di patologie a trasmissione autosomca recessiva. Ciò vale per la sordità neurosensoriale a trasmissione recessiva e vale per una società quale quella del Qatar. In questo lavoro di tesi analizziamo una coorte di soggetti appartenenti a 18 famiglie qatarine affette da sordità non sindromica. E’ stato selezionato un pannellio di 81 geni, analizzati mediante sequenziamento massivo di nuova generazione. Siamo riusciti a caratterizzare, da un punto di vista molecolare, 9 delle 18 famiglie, trovando variazioni patogenetiche in CDH23, MYO6, GJB6, OTOF, TMC1 e OTOA. In particolare abbiamo descritto 4 nuovi alleli, mentre le restanti variazioni erano già state riportate in letteratura.
Hereditary deafness is characterized by a high level of genetic heterogeneity. Societies in which there is a cultural acceptance of marriages between consanguineous subjects are appropriate study models for the analysis of autosomal recessive pathologies. This applies to the sensorineural hearing loss with recessive transmission and to a society such as that of Qatar. In this thesis work we analyze a cohort of subjects belonging to 18 qatari families affected by non-syndromic hearing loss. We selected a panel of 81 genes, then analyzed by the next generation sequencing. We have characterized, from a molecular point of view, 9 out of 18 families, finding pathogenetic variations in CDH23, MYO6, GJB6, OTOF, TMC1 and OTOA. In particular, we have described 4 new alleles, while the remaining variations had already been reported in the literature.

There are several judgments of the Constitutional Court that have marked important precedents.These precedents contain a normative element, which determines the jurisdictional action in a great number of future acses.In this article, the author develops how the judgment of the case Vásquez Romero has set a precedent of great importance regarding access to the Constitutional Court. The author will analyze the impact of this precedent on the grounds for rejection of the constitutional grievance remedies as they are substantially equal cases.
Son diversas las sentencias del Tribunal Constitucional que han marcado importantes precedentes. Dichos precedentes contienen un elemento normativo, lo que determina la actuación jurisdiccional en un gran número de casos futuros.En el presente artículo, la autora desarrolla como la sentencia del caso Vásquez Romero ha marcado un precedente de gran importancia respecto del acceso al Tribunal Constitucional. La autora analizará el impacto de dicho precedente en la causal de rechazo de los recursos de agravio constitucional por tratarse de casos sustancialmente iguales.

Binding precedents are a tool that not only sustains legal certainty and the right to equality,but also is a unifying path between substantial criteria that is to be applied on similar cases. Even though several jurisdictional bodiesare vested with the power of issuing binding precedents, the lack of specialization in taxmatt ers has enhanced the importance of the binding precedents that the Tax Court issues. The authors highlight the importance of the Tax Court in the development of tax law’s legal framework, thanks to the issuance of binding precedents, as predictability reinforces legal certainty and the right to equality, as well as it reduces the cost of enforcement of tax duties, both for the tax payer and the administration, and has a positive impact on tax collection.
Los precedentes vinculantes sirven tanto como fundamento de la seguridad jurídica y del derecho a la igualdad, cuanto como camino unificador de criterios sustantivos a aplicarse en casos homólogos. Si bien varios órganos jurisdiccionales tienen la facultad de emitir precedentes, su falta de especialización en temas tributarios ha realzado la importancia de los precedentes que emite el Tribunal Fiscal. Las autoras resaltan la importancia que tiene la actuación del Tribunal Fiscal en el desarrollo del marco legal en materia tributaria a través de la emisión de precedentes vinculantes, pues a través de éstos se ve reforzada la seguridad jurídica y el derecho a la igualdad, así como reducidos los costos de cumplimiento de las obligaciones tributarias impactando, además, positivamente en la recaudación fiscal.

This paper aims to examine the issue of overcoming judicial precedents against the principle of legal certainty, that is, the focus of this dissertation is to understand the effect in cases where the court changes an already consolidated position. This perception should avoid the evils of the so called staggered or zigzag jurisprudence , a fact that has always troubled us. To this effect, we analyze in depth the principle of legal certainty, as well as all causes of insecurity. Among those, the legal one consists exactly in this change of jurisprudence. Furthermore, we made a thorough analysis of the theory of judicial precedents, covering all its nuances, both in common and in civil law. We thus concluded that in cases of overcoming judicial precedents, the rule should be the prospective effect except in cases of granting greater protection to fundamental rights
O presente trabalho tem por objetivo analisar a questão da superação do precedente judicial frente ao princípio da segurança jurídica, ou seja, o foco desta dissertação consiste em saber qual deve ser o efeito conferido aos casos em que o tribunal muda o seu posicionamento até então consolidado, evitando com isso os males da chamada jurisprudência cambaleante ou ziguezague, fato este que sempre nos perturbou. Para tanto, analisamos a fundo o princípio da segurança jurídica, bem como todas as causas de insegurança, sendo que uma delas (jurídica) consiste exatamente nesta modificação de jurisprudência. Também analisamos a fundo a teoria dos precedentes judiciais, passando por todos as suas nuances, tanto no common law como no civil law, para ao final concluirmos que nos casos de superação do precedente judicial, a regra deve ser o efeito prospectivo, salvo nos casos de se conceder uma maior proteção aos direitos fundamentais

Il ritorno allo Stato nel 2015 delle funzioni di tutela dei beni librari, in precedenza delegate dallo Stato medesimo alle Regioni, è stato il tema del primo convegno ed è il filo conduttore delle riflessioni raccolte nella prima parte del volume. Esse si concentrano sull’organizzazione delle nuove Soprintendenze archivistiche e bibliografiche e sulle criticità comportate dalla riforma istituzionale. Il restauro, la più complessa tra le attività di conservazione del patrimonio storico, eppure irrinunciabile laddove la degradazione ne precluda la fruizione e ne metta a rischio la trasmissione al futuro, è stato l’argomento del successivo convegno. Beginning with works of architecture ranging from Qingyun Ma’s Father’s House to Robert Morris’s Select Architecture, a series of introductory studios tasked students with the analysis and redesign of an assigned precedent. The precedent was presented as an interlocuter rather than an authority. It guaranteed nothing, and could neither be dismissed nor followed in any straight-forward way. The aim was to present architecture’s history as a series of incomplete acts requiring interpretative reassessment. Students were encouraged to view their work as contributing-to an interpretative context surrounding (yet always exceeding) the precedent. Thus, the studio sought to develop a model of design agency based neither on the inimitable “perfection” of supposed exemplars,nor on the self-expression of the supposedly autonomous designer. Precedents provide an object of analysis and acontext for meaningful action. Rather than decontextualized objects and claims, the redesign is understood in relation to the original—amplifying, qualifying, challenging, criticizing, or undermining.

In architectural education, the use of precedents to inform studio design process is recognized, supported and mandated by many professional architectural accreditation boards. However, the study of precedents in taught history and theory courses may not automatically lead to application in architectural design. Too often, the relationship remains superficial, and primarily visual or formal. The rise of online sources means that websites have become a major source for students’ collections of architectural precedents. Platforms, such as Pinterest, provide a repository of alluring images, allowing access to a burgeoning array of precedents. Such ease of access may however reinforce superficial readings of buildings through images that mitigate against deep analysis. Architectural educators seek to teach students to interrogate examples beyond the immediate image, and to instill critical thinking in order that precedent analysis becomes meaningful when making informed decisions during the design phase. This innovative proposal builds upon architecture’s visual bias by introducing evaluative analysis in the form of a pictorial timeline that seeks to contextualize a specific building within a larger set of precedents as the starting point for a critical framework. This provides students with a tool for critically organising visual knowledge in order to create new design applications. This timeline assignment, which has developed over 4 years, has evolved from a method to select and organize precedents into a comparison tool that can practically shape and define architectural strategies. When this knowledge is transferred to studio design projects, such architectural strategies enable deep evaluation of buildings towards facilitating justified design decisions.

Regional sciences are based on specific research methods, taking into account the analyzed factors and regional breakdown. In most cases, the analyzes fail to take into account the links between the analyzed factors and the geopolitical location of the region. The work presents the possibilities of analysis using precedent modeling, through which analyzes can be performed with respect to geographical links. The aim of our research was to demonstrate the suitability of implementing a precedent model for predicting the development of an increase in Covid positive cases at the level of Czech municipalities. The precedent analysis enables the simplification of a part of the mathematical analytical apparatus into a binary form. The data are presented in a selected time interval limited by the closure of districts at the level of municipalities with extended powers (MEP). The research is based on the research question of whether it can be effectively evaluated using a precedent model of regional disparity. The basic method of research is precedent analysis and subsequent mathematical and statistical analysis, especially the determination of guidelines for the development of precedents at weekly intervals. The result of the presented part of the research is a summary of the MEP according to the potential of the Covid threat. The structure mapping in the presented model identified MEP groups, which are local extremes of the observed values. Thus, municipalities that are potential sources of Covid virus infection and municipalities that are potential sites endangered by the virus were identified.

Brazilian Code of Civil Procedure has been reformulated in 2015 and created new institutes of judicial precedents to allow the Courts of Appeal to decide about similar cases based on one main case, which is considered the paradigm for similar cases that remain suspended. This mechanism aims to avoid legal uncertainty in the lower courts, but, uncertainty can be taken to the Courts of Appeal, since different courts can judge similar legal matter in the opposite way. The identification of similar judicial cases is hard because Courts of Appeal work independently and the number of cases is high. We propose the use of computational intelligence techniques to automatically identify similar judicial precedents. Our hypothesis is that algorithms based on semantic approaches, such as Latent Semantic Indexing and Latent Dirichlet Allocation, perform better than those that use only syntactic approach, as (Okapi) BM25 ranking function. The best-performing model is extended with named entities to verify if its performance increases. The performance of the models is evaluated using similarity metrics and with the assistance of a specialist. We test this approach with the database of judicial precedent of the National Council of Justice. Our approach correctly grouped more than 90% of judicial precedents and found similar precedents with divergent decisions or precedents that should be suspended due to the existence of appeals into superior courts of same subject matter. Models based on syntactic approach presented the best results, as it required lower computational cost and fewer parameter tuning compared to the others.

Precedent-Based learning is related to a very old method of teaching, particularly in the studio setting. Usually it takes the form of precedent analysis. An empirical study was conducted in order to better understand how experienced designers use precedents in the course of a brief design session. Normative theories of learning suggest that success is most likely to be achieved when students learn (1) the principles governing events or phenomenon in a discipline, and (2) ways of applying these principles to specific situations to solve problems of various kinds. We call this the didactic method. In the didactic approach there is a systematic representation of the fundamental principles of knowledge that identify a specific domain upon which a corpus of applications or problem-solving skills can be constructed. In fields that deal with professional practice, for example design, instruction appears to deviate from this pattern in significant ways. Students are rarely given robust principles (ones that hold in different contexts), let alone immutable ones, upon which they can construct designs that can be judged unequivocally or without error. Instead they are given plenty of precedents from which to learn a variety of heuristics. This type of knowledge is fundamentally tacit, situated in a context of extra-domain information, and involving pedagogy that is principally experiential. In architectural curricula, the experiential approach to learning is omnipresent. Descriptions of design instruction, or for that matter, architectural curricula within which such instruction is found, are invariably of an indirect kind. They describe the stylistic or formal attributes of the architecture that is promoted by the particular pedagogy in order to explain its characteristics, principles and techniques [5,7,8,11,19].

Abstract This paper presents a feature-based method to support machining sequence planning. Precedence relations among machining operations are systematically generated based on geometric information, tolerance specifications, and machining expertise. The feature recognition method using Alternating Sum of Volumes With Partitioning (ASVP) Decomposition is applied to obtain a Form Feature Decomposition (FFD) of a part model. Form features are classified into a taxonomy of atomic machining features, to which machining process information has been associated. Geometry-based precedence relations between features are systematically generated using the face dependency information obtained by ASVP Decomposition and the features’ associated machining process information. Multiple sets of precedence relations are generated as alternative precedence trees, based on the feature types and machining process considerations. These precedence trees are further enhanced with precedence relations from tolerance specifications and machining expertise. Machining sequence planning is performed for each of these precedence trees, applying a matrix-based method to reduce the search space while minimizing the number of tool changes. The precedence trees may then be evaluated based on machining cost and other criteria. The precedence reasoning module and operation sequence planning module are currently being implemented within a comprehensive Computer-Aided Process Planning system.

This work deals with the analysis and transfer of design information, expressed in terms of features, from feature-based CAD models to CAPP systems in order to perform process planning. In this paper, we present an integrated system that retrieves design information from a feature-based CAD model, performs feature mapping, identifies interactions between features, generates alternative feature representations and feature precedence relations. The alternative feature representations provides the process planner with more flexibility in terms of process selection and are shown in the form of an AND-OR graph. The feature precedence relations, represented as a directed feature precedence network, assist the process planner in its process sequencing tasks. Feature mapping involves the mapping of design features into equivalent valid machining features. Feature interactions are identified by analyzing part geometry for face adjacency and hence feature adjacency. The interacting features are then analyzed to identify possible alternative feature representations and feature precedence relationships. Procedures for the identification of feature interactions and determination of alternative feature representations and feature precedence relationships are provided. The generated AND-OR graph and the feature precedence network seeks to aid CAPP systems in process sequence generation and serve as a vital step for the integration of design and planning systems.
