Abstract:
The main argument of this chapter is that the concentration-of-power hypothesis—the idea that reform capacity is higher under power-concentration institutions—only holds, if at all, in societies where interest groups have negligible informal power. Where interest groups have significant power, sharing formal power among several political parties may lead to higher reform capacity than a concentration of power. The chapter shows that reform capacity tends to be low if power-concentration institutions are situated in societies where interest groups are strong enough to threaten to block reforms, but not strong enough for the government to treat them as a permanent interlocutor. The chapter's empirical sections are concerned with labor market reforms in European Union member states, pension reforms and employment-protection reforms in France, and political strikes in the advanced democracies.

Abstract:
The conclusion summarizes the findings of the book, focusing upon the interplays of the field of power. These powers ebb and flow in relation to each other, creating interesting opportunities and ambiguities over time. Civil society holds social power, which is threatening to financial and political elites. In Russia, the result is a return of authoritarian state dominance, similar to the Soviet period, but adapted to modern conditions. However, the field of power need not only be dominated by the state. In the West, growing economic inequality could have a similar constraining effect on the field of power as a whole. Because the field is contingent and relational, there is always the opportunity for civil society to find a moment to exert its power. But if one power dominates the field in Russia indefinitely, then it is likely to produce the same deteriorating conditions that faced its Soviet predecessor.

Abstract:
This chapter explores the tensions between the normative ideal of human rights and the facts of asymmetric power. First, it reconstructs and assesses important power-related worries about human rights. These worries are sometimes presented as falsifying the view that human rights exist, or at least as warranting the abandonment of human rights practice. The chapter argues that the worries do not warrant such conclusions. Instead, they motivate the identification of certain desiderata for the amelioration of human rights practice. The chapter identifies twelve such desiderata. Second, this chapter proposes a strategy for satisfying these desiderata. In particular, it suggests some ways to build empowerment into the human rights project that reduce the absolute and relative powerlessness of human rights holders, while also identifying an ethics of responsibility and solidarity for contexts in which power deficits will not dissolve. Power analysis does not debunk the human rights project. Properly articulated, it is an important tool for those pursuing it.

Abstract:
This chapter traces the relational position of civil society through the history of three key organizations: Baikal Environmental Wave, the Tahoe-Baikal Institute, and the Great Baikal Trail. The development of local environmental civil society around Lake Baikal in the post-Soviet years was conditioned by two important changes. First, the Soviet collapse opened the door to global interaction. Local civil society was inextricably linked to global networks and forces that shaped the course of its development. Second, civil society’s strength and independence shifted along with the status of other power holders in the larger field. In the 1990s, the economy and the state were in crisis and collapse. Civil society was then most free to define itself and take aggressive positions. As the two opposing powers recover in the 2000s, accommodation to economic and political power is preferred.

Abstract:
The Kantian account of political authority holds that the state is a necessary and sufficient condition of our freedom. We cannot be free outside the state, Kantians argue, because any attempt to have the “acquired rights” necessary for our freedom implicates us in objectionable relations of dependence on private judgment. Only in the state can this problem be overcome. But it is not clear how mere institutions could make the necessary difference, and contemporary Kantians have not offered compelling explanations. A detailed analysis is presented of the problems Kantians identify with the state of nature and the objections they face in claiming that the state overcomes them. A response is sketched on behalf of Kantians. The key idea is that under state institutions, a person can make claims of acquired right without presupposing that she is by nature exceptional in her capacity to bind others.

This book explores emergency politics of international organizations (IOs). It studies cases in which, based on justifications of exceptional necessity, IOs expand their authority, increase executive discretion, and interfere with the rights of their rule-addressees. This “IO exceptionalism” is observable in the crisis responses of a diverse set of institutions including the United Nations Security Council, the European Union, and the World Health Organization. Through six in-depth case studies, the book analyzes the institutional dynamics unfolding in the wake of the assumption of emergency powers by IOs. Sometimes, the exceptional competencies become normalized in the IOs’ authority structures (the “ratchet effect”). In other cases, IO emergency powers provoke a backlash that eventually reverses or contains the expansions of authority (the “rollback effect”). To explain these variable outcomes, the book draws on sociological institutionalism to develop a proportionality theory of IO emergency powers. It contends that ratchets and rollbacks are a function of actors’ ability to justify or contest emergency powers as (dis)proportionate. The claim that the distribution of rhetorical power is decisive for the institutional outcome is tested against alternative rational institutionalist explanations that focus on institutional design and the distribution of institutional power among states. The proportionality theory holds across the cases studied in this book and clearly outcompetes the alternative accounts. Against the background of the empirical analysis, the book moreover provides a critical normative reflection on the (anti) constitutional effects of IO exceptionalism and highlights a potential connection between authoritarian traits in global governance and the system’s current legitimacy crisis.

Hobbes’s views on church–state relations go well beyond Erastianism. Rather than claiming that the state holds supremacy over the church, Hobbes argued that church and state are identical in Christian commonwealths. This chapter shows that Hobbes advanced two distinct arguments for the church–state identity thesis over time. Both arguments are of considerable interest. The argument found in De Cive explains how the sovereign unifies a multitude of Christians into one personified church—without, intriguingly, any appeal to representation. Leviathan’s argument is premised on the sovereign’s authorized representation of Christian subjects. Authorization explains why, from Leviathan onwards, full sacerdotal powers are ex officio attributed to the sovereign. In Hobbes’s mature theory, every clerical power, including baptism and consecration, derives from the sovereign—now labelled ‘the Supreme Pastor’. Developments in Hobbes’s account of church personation thus explain Leviathan’s theocratic turn.
