Tallarico, Serena. "Quand les esprits troublent les esprits : patients et cliniciens à la rencontre du monde invisible." Thesis, Sorbonne Paris Cité, 2019. http://www.theses.fr/2019USPCD010.
Full textIn the clinical practice, as well as in the scientific literature, there is a vast repertory of diagnostic errors, especially when migrant patients express symptomatology related to spirits, djinns and ali "the night's beings" and/or they say (or who are said) possessed, inhabited, or visited by the invisible world. The purpose of this study is to analyze, explain and prevent the high incidence of acute psychiatrie disorders, mainly psychotic, among migrants. We collected and analyzed the speeches of patients, clinicians, patients and their families and we reproduced a photogram of psycho-medical follow-up. We hypothesized that the spirits's illness would be for the patient the expression of suffering, as well as the pivot of the healing process that passes through a quest for meaning, a negotiation between the present and the past, the individual and the group, the origin country and the new world, the ordinary and the extraordinary, and between all the beings, and the persans who are part of. We have corne to the conclusion that spirits often have a "restorative" function in the psyche of the patients analyzed. The appearance, or possession by the invisible, can also be a source of desire satisfaction and narcissistic healing in the patient's experience, although it is a terrifying experience. This work highlights the need to build the framework and the therapeutic relationship, from the way the patient tells his story

Full textHistory is often told by the victors. Even the history of the defeated is recounted either by the victors or by those survivors amongst the defeated who find themselves seated on the victor’s throne. Such is the case with the history of the Zafinifotsy, or "descendants of silver", to whom this study is dedicated. Identified, by a historiographical tradition, as belonging to a minor branch of Sakalava royalty, defeated by the "descendants of gold", these descendants of silver founded a new kingdom to the north of Madagascar in the middle of the 18th century: the Antankaraña kingdom. However, a number of these descendants of silver committed suicide by drowning themselves in a bay on the northwestern coast of the island. In this region, currently ruled by a monarchy of the descendants of gold (Zafinimena), a cult of possession is practiced to honour the spirits of these drowned nobles of the silver, former rivals of the rulers of gold. Faced with the political and economic crisis that Madagascar has undergone for the last several years, clan groups and political actors negotiate their legitimacy and current position in the post-colonial context of the Malagasy republican state through these dynastic categories of gold and silver. In carrying out royal rituals, the descendants of slaves and the servants of Sakalava royalty claim a conception of loyalty and work that differs from that imposed first by colonisation and then by the postcolonial state. National government representatives, on the other hand, draw on their aristocratic origins, and more generally on the history of kings, to legitimise their controversial power amongst the population. It is the ideology of royal power and social hierarchy mobilised by these actors that this thesis examines.Through the study of oral traditions and ritual activities in the different villages where this cult is performed, I analyse the historical and ritual relations between the dynastic or clan groups participants belong to. In visiting these different sites and, more broadly, the main historical capitals of the Sakalava royalty, I have realised a regressive history of the royal dynasties in question. The regressive history, inspired by the work of Marc Bloch and Nathan Wachtel, has revealed, on the basis of the contradictions emerging from oral traditions and ritual interactions, that these royal dynasties were originally functional and relative categories used to organise royal succession. This framework grants the descendants of gold the power to reign, and the descendants of silver that of legitimising the power of the former. This ambivalent hierarchy between these two categories of nobles is, moreover, shaped by the joking relationships that link the stranger kings of gold to the masters of the earth. It is at particular historical junctures that these structural and contextual categories crystallised into dynastic designations. This process of dynastisation was primarily driven by the descendants of silver who founded the Antankaraña kingdom, i.e. those who, defeated in ancient times, took to the throne of the victor. This ethnographic example therefore represents a concrete case of the "structure of the conjuncture" theorised by Marshall Sahlins. In conclusion, this study shines a new light on the founding and organisational mechanisms of Sakalava royal power, as well as the functional and structural character of these categories of "gold" and "silver", reified into effective dynastic groups in particular historical conjunctures. More generally, this thesis provides insight into the relational and contextual nature of hierarchy and individual and collective identities in Madagascar

Abstract The Bill of Lading (B/L) is the core concept in the contract of the carriage of goods by sea. With a long history, its nature and legal relationship significantly determine the carrier’s rights and interests. Based on the development history of the B/L, this research employs case studies of relevant international conventions and legislations, domestic and international practices to explore the essence and legal relationship of the B/L. The following is a brief introduction of the seven chapters in this study: Chapter one explains the research motives, objectives, methodology and expected results. Chapter two reviews the history and evolution of the Bill of Lading, and also further discusses its position in today’s international trade world. Chapter three introduces the objectives and content of the international conventions related to the Bill of Lading in the past century, and also anticipates its future prospects based on the close examination of the relevant regulatory regimes. Chapter four concludes the value and nature of the Bill of Lading from the perspectives of current theories and practices, attempts to define the Bill of Lading, and reconciles the conflicts between different attributes. Chapter five identifies the three major theoretical functions of the Bill of Lading, further explores the validity of right in rem and the validity of creditor’s right, and discusses the nature of the Received Bill of Lading. Chapter six studies Britain’s The Bills of Lading Act of 1855 and the theories of the issuance of the negotiable document in Taiwan, and redefines the legal relationship of the B/L. Chapter seven summarizes the conclusions from all previous chapters, and drafts The Bill of Lading Act based on Britain’s Act and Taiwan’s The Bill of Exchange Act in order for theoretical and practical references.

We are surrounded by an enormous amount of objects in everyday life. The notion of human-object relationship has been more and more complicated through the development of technology. To date, people have increasingly acquired virtual objects in their daily life. Researchers recently focus on the concept of how people develop emotional relationship to their digital object. However, there is still an open question that how and why people attach to their virtual possessions and what are the characteristics of the attachment. This research explores emotional relationship between individual and their virtual possessions by Grounded Theory. We conducted 24 in-depth interviews with younger adults (under 20-year-old) and elder adults (above 40-year-old) in Taiwan. By understanding usage behaviors and feelings about participants’ important virtual possessions, several findings came out. The findings are presented as materials for building a theory of attachment development to virtual possessions. We found attachment between an individual and their virtual possessions is developed from individual’s extended self. In addition, “sense of possessing” is not a necessary factor for developing attachment but it may effect the strengthen of attachment. Moreover, We observed four types of virtual possessions with their causes of attachment and usage behaviors. Also, the virtual possessions attachment could be influenced by various factors according social value, personal value, technology access and technology knowledge. Several interesting issues and design implications were proposed for designing the attachment to virtual possessions. As a consequence, we hope not only to help designers and researchers create a sustainable and longer lasting virtual product but also an emotionally flourished virtual world.
