Abstract:

This paper investigates a series of Oxford Obligationes texts, all of which can be associated with Richard Billingham. My study is based on eleven of the surviving manuscripts and two early printed texts. I focus on one aspect of their discussion, namely the rule for granting the initial positum of an obligational disputation of the type called positio, and the six restrictions that could be placed on that rule. I explain these restrictions with reference to several sophismata that were meant to illustrate the problems that the restrictions were intended to solve, and in particular, I discuss the fifth restriction ‘not inconsistent with the positum’. I also shed light on the final restriction, which has not always been well understood, namely the restriction ‘wherever there is no obligatio relevant to the positum’.

Zusammenfassung. Der Vortrag auf dem Symposion des BKMT (www.bkmt.de) vom 21.11.2009 stellt das Vorgehen der Positiven Psychotherapie im Umgang mit Geschichten und Lebensweisheiten vor. Positiv leitet sich vom lateinischen Wort „positum” ab. Es bedeutet, das Ganze zu sehen, das Tatsächliche, das Vorgegebene. Auf der Grundlage des transkulturellen Ansatzes, der Weisheiten und intuitive Gedanken des Orients mit den neuen psychotherapeutischen Methoden des Okzidents verknüpft, werden die drei Fundamente erklärt: „Der positive Ansatz: Das Prinzip Hoffnung”, „das inhaltliche Vorgehen: Konfliktinhalt und Konfliktdynamik” und „Therapie und Selbsthilfe: Das Prinzip Beratung”. Der positive Ansatz besteht aus dem positiven Menschenbild und der positiven Symptombildung; das inhaltliche Vorgehen orientiert sich an den vier Qualitäten des Lebens als Ausdruck der Erkenntnisfähigkeit: Körper/Sinne – Leistung (Verstand) – Kontakt/Tradition – Phantasie (Intuition). Therapie und Selbsthilfe basieren auf den fünf Stufen: Beobachtung/Distanzierung – Inventarisierung – situative Ermutigung – Verbalisierung – Zielerweiterung. Ein ausführliches Fallbeispiel demonstriert die Anwendung der vier Formen der Konfliktbewältigung unter Verwendung des Differentialanalytischen Inventars (DAI) von transkulturell unterschiedlich gewichteten Aktualfähigkeiten.

Abstract:

O presente artigo toma a conferência Fenomenologia e teologia, proferida pelo filósofo alemão Martin Heidegger em 1927, como principal fonte teórica e, a partir dela, tece algumas considerações a respeito da positividade e da cientificidade da teologia. A primeira tarefa, nesse sentido, trata justamente de visualizar a teologia como possibilidade de compreensão da fé, mostrando o seu viés fático-hermenêutico, donde a necessidade de, num primeiro momento, ser introduzido à conferência. Daí decorre a necessária compreensão do positum próprio à teologia e quais são suas configurações específicas para que seja qualificado enquanto objeto de uma ciência. Esse movimento compreensivo incide na cientificidade própria da teologia: as características de tal cientificidade se encontram justificadas tanto na conferência quanto no contexto que a circunda.

Abstract:

Objetiva-se neste artigo explicitar a identidade da teologia compreendida como ciência no estudo da religião. Para atingir este objetivo, serão apresentadas as possibilidades de estudos da religião na forma de ciência da religião, de ciências da religião, de ciências das religiões e de teologia. Além disso, explicitar-se-á a teologia como ciência em função de ser constituída por um positum que a torna ciência ôntica, tendo na filosofia – ciência ontológica – seu partner. Em seguida, apresentar-se-á a possibilidade teológica de estudar a religião a partir da filosofia da religião e da teologia fundamental pensadas por Karl Rahner, cujas consequências fundamentais são as formulações da teologia da religião pós-moderna e da teologia das religiões ou do pluralismo religioso. Concluir-se-á que a teologia pode ter assento na Universidade para estudar a religião, ao lado e em diálogo com formas científicas de estudo, caracterizando-se como scientia fidei et amoris da relação entre Deus e o homem.Abstract: The objective of this article is to clearly explain the identity of theology understood as a science in the study of religion. To reach this objective, we will present the possibilities of studies of religion in the form of science of religion, sciences of religion, sciences of religions and of theology. Moreover, we will explain theology as a science because it is constituted by a positum that turns it into an ontical science that has in philosophy – an ontological science – its partner. Then we will present the theological possibility of studying a religion starting with the philosophy of the fundamental religion and theology imagined by Karl Rahner of which the basic consequences are the formulations of the post-modern theology of religion and of the theology of religions or religious pluralism. We will conclude by stating that theology can have a chair at the University to study a religion side by side with scientific forms of study and in dialogue with them, characterizing itself as scientia fidei et amoris of the relationship between God and the human being.

Radices et cursus evolutionis”. In relatione tractabatur non de valoribus iuris, sed de iure ut valore. In Europa ius semper magni aestimabatur, idea iuris animo informata et cogitatione concepta tamen in realitate vitae et conditione humana ad effectum deduci conabatur. Ius lingua exprimitur, traditur et depostulatur, „ius dicitur”, ius tribuitur, ideoque ius in processu ad effectum perducitur. Ius uti instrumentum iustitiae utitur. Problemata quae habitudinem iuris et iustitiae attingunt elucidantur. Advocato dicto Ulpiani „iustitia est constans et perpetua voluntas ius suum cuique tribuens” praesupposita iuris, nempe voluntas iustitiae, exponuntur: sine dominanti in societati voluntate iustos esse ius sensum non habet, cum observantia iuris praescribi non possit. Tensio afficit praxim iuris, nempe ius dependet a generali saltem intentione observandi, simulque exsecutionem observationis praesupponit. V prvi polovici 18. stoletja je bila objavljena serija devetih oziroma desetih latinskih tiskov z naslovom Lakonsko ogledalo Evrope (Laconicum Europae speculum). Podobe z napisi je zasnoval Paul Decker mlajši (1685-1742), Johann Wolfgang Baumgartner (1709-1761) je postavil le tisk za Nizozemca, same bakroreze so izdelali različni bakrorezci (Christian Friedrich Lottes, Johann Georg Pinz, Philipp Andreas Kilian, Andreas Hoffer), uredil in izdal pa jih je Martin Engelbrecht (1684–1756) v Augsburgu okrog leta 1730. Celotni naslov je daljši, Lakonsko ogledalo Evrope, v katerem je brez predsodkov, posmehovanja ali zaničevanja predstavljenih njenih devet posebej uglednih narodov in ljudstev, ki se v določenih lastnostih in znamenjih razlikujejo, vse zaradi radovednosti in zabave (Laconicum Europae speculum: quo IX. illius praecipuae nationes et populi, absque omni praeiudicio, ludibrio et opprobrio, saltem curiositatis et oblectationis gratia, certis characteribus et symbolis discernuntur, ob oculos positum).1 V naslovu je torej pojasnjen tudi razlog za nastanek teh tiskov, izšli so ≫zaradi radovednosti in zabave≪ (curiositatis et oblectationis gratia). Podobno kot ostale razpredelnice ljudstev ti bakrorezi niso bili mišljeni kot predstavitev realnih podob, temveč so bili namenjeni tudi zabavi.

Abstract:

An obligation, in the sense in which it was of interest to medieval logicians from about the early thirteenth century to the end of the scholastic period, is, according to Paul of Venice, a relation limiting one to take some statement affirmatively or negatively. This relation is based on the actions of two individuals: one (the opponent) obligates the other (the respondent) by first putting forward a sentence which the respondent agrees to affirm or deny for a limited time. The sentence the respondent agrees to affirm is called the positum; that which he agrees to deny, the depositum; and his act of agreeing, the admissio. After this relation is established between the opponent and respondent, the opponent proceeds by putting forward a series of sentences to which the respondent replies by granting, denying, or doubting — all in accordance with certain rules the two individuals have previously accepted as governing their exchange. If the respondent at any time grants what is inconsistent with the sentence he agreed to uphold, or responds in a way that violates the accepted rules, the exchange comes to an end. The respondent has failed in his obligation.

Abstract:

The objective of Legal study is for answering questions on what and how it should be as das sollen. However, legal studies are not solely researching validity of rules as das sollen, but also researching whether a legal rule be in force or not, about what should be done or should tend to be prescriptive (Sudikno Mertokusumo, 2011). Therefore, legal research aside from having dogmatic and systematic characters, also should also apprehend asymmetry between das sollen and das sein. This paper essay is researching criminal tax law in General Provision and Procedures Law (UU KUP), as spring of ius positum and it’s legitimate systematic within tax law as well as other law within Indonesia’s legal system. From juridical normative research, there are few conclusions about ambiguity and asymmetry between fundamental principles and their pronounced legal regulations. As well about the absence of a strict (criminal) procedures law as rule of adjudication for application of criminal tax law, provoke ambiguity in operation and how to manifest criminal tax law as das sein. From this vantage point, this research stretched in accordance with criminal tax law effectiveness as a tool to obtain society welfare and harborage.

Abstract:

The paper aims at introducing an innovative tool of the MGS Methodology – namely, a transcultural game which uses a psychosocial approach – to build resilience of participants undergoing group counselling and therapy within the 5-stage method of Positive and Transcultural Psychotherapy (PPT). Armed conflicts, resulting in forced displacement and migration for masses of populations, can have severe consequences in the holistic health of affected people, including their mental health. Practice and studies show that both children and adults are vulnerable and react to trauma and grief by displaying symptoms of acute stress, anxiety, depression, aggression, as well as post-traumatic stress and PTSD, among other disorders. A psychosocial, transcultural game during a group session demonstrates that it is not only an efficient way to reach the masses who need support during a crisis, but also an effective holistic approach that mobilizes the entire being by proactively working with both primary and secondary capacities. Furthermore, it addresses those capabilities as unfulfilled needs or conflict potentials in the four dimensions through key questions during the group debriefing throughout and after the game. The ‘Positum MGS for Group Therapy’ approach consists of a mixed training with PPT concepts and MGS tools and principles. Based on results in the field, it offers to trainers, psychotherapists, psychologists, counsellors, consultants, social workers and other professionals, who are trained in PPT or other psychotherapeutic modalities, an overview to this innovative tool, in order to help groups of children and adults overcome their crisis and recover from trauma.

Abstract:

This research intends to identify the positive emotions of the early Malay leaders in the Malay traditional texts named Hikayat Raja Pasai (HRP), Hikayat Merong Mahawangsa (HMM), and Hikayat Hang Tuah (HHT). The emotions of all the early Malay leaders were identifiable through the authors’ writings in each text. There are two theories to be combined and utilized in this research: Phenomenology of Feeling and Sigmund Freud Psychoanalysis. The three aforementioned traditional texts were used as the main data sources in this research. A checklist based on utilized theories was administered and the data collection method used was an observation; then a checklist table was generated based on the used theories. The results show the positive emotions of the early Malay leaders as observable in the traditional texts. This research may lend valuable insights about the positive emotions of early Malay leaders in the traditional texts to future researchers. The implication of this study is as guidance to the Malay leaders at this time in dealing with emotions.

Penelitian ini bertujuan untuk mengetahui persepsi peternak sapi Madura terhadap pemeliharaan sapi sonok di Kecamatan waru Kabupaten Pamekasan dengan menggunakan metode penelitian deskriptif kualitatif. Teknik pengambilan data yang peneliti gunakan adalah observasi wawancara, kuisioner dan dokumentasi, kepada 50 orang peternak di kecamatan Waru. Hasil penelitian menunjukkan bahwa persepsi peternak yang positp akan dapat meningkatkan motivasinya untuk beternak sapi sonok. Untuk lebih meningkatkan motivasi tersebut, peternak juga harus paham mengenai keuntungan beternak sapi sonok. Persepsi positip akan diikuti oleh motivasi yang kuat untuk memelihara sapi sonok lebih baik. Persepsi peternak juga didukung oleh karakteristik peternak seperti jumlah kepemilikan ternak, umur peternak, pendidikan terakhir, pengalaman usaha beternak, jumlah tanggungan keluarga, motivasi beternak, pendapatan usaha beternak, status penguasaan dan luas kepemilikan lahan, pekerjaan utama peternak dan tujuan pemeliharaan.

On the last Accounting National Symposium at Banjarmasin, a quantitative accounting research approach was still dominating in the paper presentation, eventhough this event had been conducted more than a decade. So, why the quantitative approach or positive paradigm is still strong enough in its position and having a good track of development during the penetration of a qualitative approach? By understanding the positivist accounting researcher’s thought about qualitative approach, a gap could be seen and then used for developing both approaches simultaneously. This research is on the area of an interpretive paradigm and using case study method. By using in-depth interview, data are collected from informan at Gadjah Mada University, Brawijaya University, and Airlangga University. The results, all informan accept the qualitative approach or a multiparadigm accounting research with a certain note, especially regarding to the research stages. Besides, they think about the need for a dialogue between quantitative and qualitative researchers.

Abstract:

With increasing real-time constraints being put on the use of Deep Neural Networks (DNNs) by real-time scenarios, there is the need to review information representation. A very challenging path is to employ an encoding that allows a fast processing and hardware-friendly representation of information. Among the proposed alternatives to the IEEE 754 standard regarding floating point representation of real numbers, the recently introduced Posit format has been theoretically proven to be really promising in satisfying the mentioned requirements. However, with the absence of proper hardware support for this novel type, this evaluation can be conducted only through a software emulation. While waiting for the widespread availability of the Posit Processing Units (the equivalent of the Floating Point Unit (FPU)), we can already exploit the Posit representation and the currently available Arithmetic-Logic Unit (ALU) to speed up DNNs by manipulating the low-level bit string representations of Posits. As a first step, in this paper, we present new arithmetic properties of the Posit number system with a focus on the configuration with 0 exponent bits. In particular, we propose a new class of Posit operators called L1 operators, which consists of fast and approximated versions of existing arithmetic operations or functions (e.g., hyperbolic tangent (TANH) and extended linear unit (ELU)) only using integer arithmetic. These operators introduce very interesting properties and results: (i) faster evaluation than the exact counterpart with a negligible accuracy degradation; (ii) an efficient ALU emulation of a number of Posits operations; and (iii) the possibility to vectorize operations in Posits, using existing ALU vectorized operations (such as the scalable vector extension of ARM CPUs or advanced vector extensions on Intel CPUs). As a second step, we test the proposed activation function on Posit-based DNNs, showing how 16-bit down to 10-bit Posits represent an exact replacement for 32-bit floats while 8-bit Posits could be an interesting alternative to 32-bit floats since their performances are a bit lower but their high speed and low storage properties are very appealing (leading to a lower bandwidth demand and more cache-friendly code). Finally, we point out how small Posits (i.e., up to 14 bits long) are very interesting while PPUs become widespread, since Posit operations can be tabulated in a very efficient way (see details in the text).
