Abstract:
Inside the internet, information becomes something very important and really life. Mobility is so fast and can be downloaded, produced, and then uploaded again. The internet network is one of the most popular information sources today. Many internet users access pornographic websites because these pornographic websites supported by the development of rapid internet. The purpose of this study is to review Pornographic Law related to cyberporn. This criminal act is called Cyberporn. Given the enormous impact that is caused by the act of pornography, especially on the internet site, the government legalized the bill against pornography into pornography law with clear criminal provisions. This research method using normative law research method, with a normative juridical approach related to pornography. In relation to this type of research is a normative legal research, then the source of legal material used is the legislation. In accordance with this type of research, the analysis used is a normative juridical analysis that relies on the ability of legal argumentation, legal interpretation, and legal reasoning related to criminal provisions in pornography law. From the results of research have found that criminal provisions in the law number 44 of 2008 on pornography is quite clear that everyone who access on porn sites on the internet threatened with criminal sanctions. Juridically, criminal provisions in pornography law provide legal certainty is quite clear.

The results of the study refers to Article 34 in conjunction with Article 8 of Law No. 44 Year 2008 on Pornography, (1) that the elements of the crime of pornography consists of Subjective elements that error, which means intentionally or consent was committed and objective elements that act ( be) which means that objects or models that contain pornographic content. (2) In the process of criminal investigations conducted pornography remains based on Criminal Procedure unless otherwise provided in the Act No. 44 of 2008

The provisions concerning the prohibition of pornography are set in the national legal instruments and instruments of international law. Specifically regulated in Law no. 11 Year 2008 About Pornography whose existence was confirmed by the Constitutional Court Decision No. 10-17-23/PUU-VII/2009 who rejected the judicial review of Law no. 44 Year 2008 on Pornography seeing this legislation is still needed to protect public morality. Prohibition of pornography is also in line with the principle of the 2nd Pancasila who want a civilized human being. However, the existence of the rule is not effective in preventing pornography, especially with the internet presence that can expand and facilitate access to pornography. Therefore it is necessary efforts to control pornography in the human form of Pancasila.

As a society known for its rich tribes, cultures, enis, groups, languages, islands, and so on, it is natural that Indonesia is said to be one of the countries on the world's most multicultural planet. The passing of Law No. 44 of 2008 on Pornography as a hard success among Islamism penetrated the national legislation of Indonesia. As a result, the group of people who disagreed and disagreed with the passage of Law No. 44 of 2008 made various resistance efforts to overturn the Law. The resistance they make from protests through demonstration movements, politics, economics, to efforts to take legal routes. As a result, to this day the Law is only as a documentation of Indonesia's national legislation, and almost no longer gets the attention of the public and law enforcement in Indonesia. In connection with that, this paper will read the existence of Law No. 44 of 2008 on Pornography in the perspective of legal sociology, both in the discussion of legal science in general and in discussions of Islamic-Sharia law.

It is critical that the legal and psychological issues surrounding youth sexting, a term derived from the joining of “sex” and “texting,” be considered. Based on current interpretations of the law, minors who engage in sexting can be charged with a felony offense and in some cases be required to register as a sex offender. Yet, when adults share sexually explicit photos of themselves, such behavior is protected under the First Amendment (provided the subject and the recipient of the image are consenting adults). The purpose of the present review is to examine the differential treatment of sexting by minors in the legal system and the controversy surrounding child pornography legislation. A brief history of child pornography legislation is provided, followed by a review of the existing literature on the prevalence and patterns of juvenile sexting. Available case law is summarized, with an emphasis on the consequences of sexting specifically for juveniles. The authors then address the developmental factors relevant to understanding youth sexting behavior. These considerations lead to a discussion of whether it is appropriate to consider adolescents culpable for such behavior and, if so, to what degree and under what circumstances. It is argued that sexting behavior be considered separate from child pornography, and as such, the authors propose that specific legislation be designed to address the unique situations in which sexting behavior occurs. Furthermore, based on developmental science, the authors conclude that juveniles should be considered less culpable for sexting behavior than adults, and recommend that the punishment for minors be more developmentally appropriate.

This Article explores child pornography law in relation to teen sexting conduct. Recently, some teens who engaged in teen sexting have been convicted under child pornography laws and have been required to register as sexual predators. The criminalization of teens for developmentally typical behavior, mimicking the conduct of adults, can result in grave harm to most teens. Furthermore, the application of child pornography laws to teen sexting conduct demonstrates the constitutional overbreadth of the current definition of child pornography. Photographs have an emblematic role in society-capturing and celebrating youth. Moreover, the creation of teen sexting images accompanies a teen's developmental quest for a sexual identity and individuation. Thus, teen sexting images constitute teen sexual speech and are entitled to some degree of constitutional protection, so long as the images are not obscene. The variable obscenity standard of Ginsberg v. New York has since been modified by the Bellotti v. Baird strict scrutiny standard. Thus, any legislation related to teen sexual speech must be narrowly tailored to protect the minor from harm, or further another compelling state interest. This Article tests the author's proposed teen sexting legislation under the Bellotti test.

Since crime on the internet does not adhere to national boundaries, police forces must acquaint themselves with the law enforcement situation in other countries. This article provides the reader with information about the Netherlands. Dutch attitudes towards child pornography will be discussed, as well as Dutch legislation, the organisational structure of the police, the division of labour between police units, and problems Dutch police encounter while combating child pornography on the internet. The Dutch police are confronted with two major problems. First, police officers know too little about the digital sides of contemporary police work, including the more technological facets as well as sociological and criminological characteristics of virtual communities. Secondly, the police must establish new formal as well as informal collaborations on both a national and international level, since internet crime does not fit into existing law-enforcement structures.

ENGLISH ABSTRACT: The advent of a constitutional democracy in South Africa after the first non-racial democratic elections in 1994 and the subsequent adoption of a final constitution in 1996 introduced a legal order based on "democratic values, social justice and fundamental rights". The inception of a constitutional democracy in South African encourages an assessment of the possible constitutional ramifications of pornography, specifically within a discourse on women's interests in equality, human dignity and physical integrity. Under the strong influence of United States First Amendment doctrine, pornography is defined (and protected in the "marketplace of ideas") as a particular mode of expression, thus allowing pornography to be viewed as part of the fabric of an open, free and democratic society. Within this doctrinal context, the recognition and entrenchment of freedom of expression have firmly placed pornography on both the South African constitutional and political agendas. The objective of this study is to address specific aspects of the debate on adult heterosexual pornography (that is, pornography produced for and targeted at the male heterosexual market) in order to establish its constitutionality. This dissertation is not, however, intended as a discourse on pornography as a possible threat to the moral fibre of society, but rather about pornography as an invasion ofwomen's particular constitutional interests in equality, human dignity as well as security in and control over their bodies. To this end, Chapter 2 serves to establish a suitable theoretical framework that is capable of facilitating a woman-centred analysis of adult heterosexual pornography within the ambit of the Bill of Rights in the South African Constitution. Consequently, the merit ofliberal feminism and radical feminist thought is critically assessed against the particular (constitutional and doctrinal) demands presented by a study of this nature. Chapter three - the first in a trilogy which seeks to evaluate the different conceptualisations of pornography in the United States, Canada and South Africa - critically reflects on the obscenity jurisprudence of the Supreme Court of the United States of America as well as radical feminist campaigns in Minneapolis and Indianapolis to re-conceptualise pornography and its harm. Chapter 4 entails a critical reflection on the capacity of Canadian constitutional jurisprudence to address adult heterosexual pornography either as a patriarchal structure which impacts on women's interests in equality, dignity and physical integrity or as a mode of expression which incites gender hatred. Chapter 5 traces the history of South African censorship law as prelude to a critical discussion of the current Films and Publications Act as well as the first decision of the South African Constitutional Court on the possible human rights implications of sexually explicit material. The chapter concludes with proposals for a suitable conception of the (constitutional) harm as well as a legal definition of adult heterosexual pornography for South African law. The constitutional implications of the proposed conceptions of pornography and harm are evaluated in Chapter 6 with specific reference to sections 9, 10 and 12 as well as subsection 16(2)( c) of the South African Constitution. Chapter 7 concludes the present study with some thoughts on the suitability of censorship as legal and political strategy.

Die aanvang van 'n konstitusionele demokrasie in Suid-Afrika moedig inderwaarheid 'n evaluering van die moontlike grondwetlike gevolge van pornografie, spesifiek binne 'n diskoers oor vroue se belange in gelykheid, menswaardigheid en fisiese integriteit, aan. Onder die sterk invloed van die leerstelling van die Amerikaanse Eerste Amendement word pornografie gedefinieer (en beskerm binne die "markplein van idees") as 'n spesifieke vorm van uitdrukking wat gevolglik meebring dat pornografie noodwendig as deel van 'n oop, vrye en demokratiese gemeenskap beskou word. Binne hierdie dogmatiese konteks het die erkenning en . verskansing van vryheid van uitdrukking pornografie stewig op sowel die Suid-Afrikaanse grondwetlike as politieke agendas geplaas. ENGLISH ABSTRACT: With the arrival of the Internet, the availability of pornography, and especially child pornography, has increased tremendously. This rapidly developing technological wonderworld has brought the dark syndicate of sexual exploitation of children to the living room of each home equipped with a computer. In South Africa the right of the child to not be sexually exploited or abused is enshrined in section 28 of the Constitution, 108 of 1996, as well as in several international documents. This thesis analyses the legislative framework in this regard and comes to the conclusion that South African legislation concerned shows much room for improvement. Legislation concerning sexual offences against children makes use of archaic terms that are outdated in the present context. It is also vague, inconsistent and provides insufficient protection to children in this regard. The sexual exploitation of children does not, despite promises made by the South African government in ratifying several international documents, receive high priority in the South African community. This finding is made in view of the examination of certain key concepts to the subject, international documents such as the United Nations Convention to the Rights of the Child, 1989, and the activities of international organisations combating the sexual exploitation of the child. An analysis of the manner in which countries such as the United States of America, Canada, the United Kingdom, Germany and Japan has implemented protection measures against this form of abuse, is also made. Proposals to increase the protection of children in South Africa are submitted in conclusion. Although this new domain needs urgent measures of regulation, it is not an impossible task to govern the Internet. Formulating comprehensive, consistent and effective legislation is a fundamental part in the battle against the sexual exploitation of children. The co-operation of all relevant sectors, including the government, the Internet industry and members of the community, however, remains essential.
AFRIKAANSE OPSOMMING: Die beskikbaarheid van pornografie, en veral kinderpornografie, het met die koms van die Internet onrusbarend toegeneem. Hierdie vinnig ontwikkelende tegnologiese wonderwereld het die seksuele eksploitasie van kinders vanuit die donker onderwereld na die voorkamer van elke huis met 'n rekenaar gebring. In Suid-Afrika word die reg van die kind om teen seksuele uitbuiting en mishandeling beskerm te word in artikel 28 van die Grondwet, 108 van 1996, asook verskeie internasionale dokumente verskans. Hierdie tesis ondersoek die wetgewende raamwerk rakende die groeiende probleem van seksuele eksploitasie op die Internet en vind dat Suid-Afrikaanse wetgewing in hierdie verband nog ver te kort skiet. Wetgewing met betrekking tot seksuele misdade teen kinders maak tans gebruik van arqaise terme wat glad nie meer in vandag se konteks relevant is nie. Dit is voorts ook onsamehangend, onduidelik en verskaf onvoeldoende beskerming aan kinders in hierdie verband. Ten spyte van beloftes deur die Suid-Afrikaanse regering, gemaak tydens die ratifisering van verskeie internasionale dokumente, geniet die aangeleentheid van beskerming van die kind teen seksuele uitbuiting op die Internet nog nie prioriteit in die Suid- Afrikaanse samelewing nie. Hierdie bevinding word gemaak in die lig van die bestudering van definisies van sekere kernbegrippe, internasionale dokumente soos die Verenigde Nasies se Konvensie van die Regte van die Kind, 1989, en die werksaamhede van internasionale organisasies bemoeid met die bekamping van seksuele eksploitasie van die kind. Daar word ook veral aandag gegee aan die wyse waarop lande soos die Verenigde State van Amerika, Kanada, die Verenigde Koninkryk, Duitsland en Japan te werk gegaan het om kinders in die onderskeie lande te beskerm. Voorstelle ten einde die beskerming van Suid-Afrikaanse kinders teen seksuele eksploitasie op die Internet te verbreed, word ter konklusie gegee. Abstract:
The dissertation analyzes obstacles and potential in democracies, specifically Canada, Sweden, and United States, to effectively address empirically documented harms of pornography. Legislative and judicial challenges under different democratic and legal frameworks are compared. Adopting a problem-driven theoretical approach, the reality of pornography’s harms is analyzed. Evidence shows its production exploits existing inequalities among persons typically drawn from other forms of prostitution who suffer multiple disadvantages, such as extreme poverty, childhood sexual abuse, and race and gender discrimination, making survival alternatives remote. Consumption is also divided by sex. A majority of young adult men consumes pornography frequently; women rarely do, usually not unless initiated by others. After consumption, studies show many normal men become substantially more sexually aggressive and increasingly trivialize and support violence against women. Vulnerable populations—including battered, raped, or prostituted women—are most harmed as a result. The impact of attempts to address pornography’s harms on democratic rights and freedoms, specifically gender equality and speech, is explored through the case studies. Democracies are found to provide more favorable conditions for legal challenges to pornography’s harms when recognizing substantive (not formal) equality in law, and when promoting representation of perspectives and interests of groups particularly injured by pornography. State-implemented approaches such as criminal obscenity laws are found less effective. More victim-centered and survivor-initiated civil rights approaches would be more responsive and remedial—a finding with implications for other politico-legal problems, such as global warming, that disproportionately affect disadvantaged populations traditionally largely excluded from decision-making.

Abstract:
Culpable homicide is the unlawful negligent killing of a fellow human being. As such it is in many respects a 'residual' crime being the verdict prosecutors may expect when they are unable to prove the intention to kill when prosecuting for murder. A feature of this was that in the past when defences such as, for instance, intoxication or provocation were raised at murder trials, convictions of culpable homicide were almost automatic. In recent years, under the influence of the 'purist' current in our Criminal law, intoxication has become a defence to culpable homicide and provocation resulting in loss of self-control has also become a defence to culpable homicide. These developments are unacceptable to some writers on criminal law and a move away from the purist approach to the 'traditional' or pragmatic approach is to be expected. Greater emphasis will be placed on practical results than on the achievement of logical consistency. This could result in the law of culpable homicide becoming more socially effective than it is at present.

The purpose of this study is to examine research activity on food waste legislation published in law journals to identify top sources and experts cited by recent scholarship. Searches for "food loss" and "food waste" were conducted in three legal research databases for law journal articles published between January 2013 and January 2018. The core list of selected articles consists of 13 law journal articles. The citations from each of the core articles were collected to form a database, which was analyzed to determine what kinds of resources legal scholars rely on when conducting research in food waste legislation. Government Sources and Primary Law contribute approximately 48% of the citations in the database. News, Nonprofit, and Law Reviews and Journals contribute approximately 31% of database citations. This study provides some insight into the complexity of food law and the facets of agriculture, industry, and society that affect the success of food waste reduction legislation.

Existing and emerging applications of artificial intelligence in armed conflicts and other systems reliant upon war algorithms and data span diverse areas. Natural persons may increasingly depend upon these technologies in decisions and activities related to killing combatants, destroying enemy installations, detaining adversaries, protecting civilians, undertaking missions at sea, conferring legal advice, and configuring logistics. In intergovernmental debates on autonomous weapons, a normative impasse appears to have emerged. Some countries assert that existing law suffices, while several others call for new rules. Meanwhile, the vast majority of efforts by States to address relevant systems focus by and large on weapons, means, and methods of warfare. Partly as a result, the broad spectrum of other far-reaching applications is rarely brought into view. One normatively grounded way to help identify and address relevant issues is to elaborate pathways that States, international organizations, non-state parties to armed conflict, and others may pursue to help secure greater respect for international law. In this commentary, I elaborate on three such pathways: forming and publicly expressing positions on key legal issues, taking measures relative to their own conduct, and taking steps relative to the behavior of others. None of these pathways is sufficient in itself, and there are no doubt many others that ought to be pursued. But each of the identified tracks is arguably necessary to ensure that international law is — or becomes — fit for purpose. By forming and publicly expressing positions on relevant legal issues, international actors may help clarify existing legal parameters, pinpoint salient enduring and emerging issues, and detect areas of convergence and divergence. Elaborating legal views may also help foster greater trust among current and potential adversaries. To be sure, in recent years, States have already fashioned hundreds of statements on autonomous weapons. Yet positions on other application areas are much more difficult to find. Further, forming and publicly expressing views on legal issues that span thematic and functional areas arguably may help States and others overcome the current normative stalemate on autonomous weapons. Doing so may also help identify — and allocate due attention and resources to — additional salient thematic and functional areas. Therefore, I raise a handful of cross-domain issues for consideration. These issues touch on things like exercising human agency, reposing legally mandated evaluative decisions in natural persons, and committing to engage only in scrutable conduct. International actors may also take measures relative to their own conduct. To help illustrate this pathway, I outline several such existing measures. In doing so, I invite readers to inventory and peruse these types of steps in order to assess whether the nature or character of increasingly complex socio-technical systems reliant upon war algorithms and data may warrant revitalized commitments or adjustments to existing measures — or, perhaps, development of new ones. I outline things like enacting legislation necessary to prosecute alleged perpetrators of grave breaches, making legal advisers available to the armed forces, and taking steps to prevent abuses of the emblem. Finally, international actors may take measures relative to the conduct of others. To help illustrate this pathway, I outline some of the existing steps that other States, international organizations, and non-state parties may take to help secure respect for the law by those undertaking the conduct. These measures may include things like addressing matters of legal compliance by exerting diplomatic pressure, resorting to penal sanctions to repress violations, conditioning or refusing arms transfers, and monitoring the fate of transferred detainees. Concerning military partnerships in particular, I highlight steps such as conditioning joint operations on a partner’s compliance with the law, planning operations jointly in order to prevent violations, and opting out of specific operations if there is an expectation that the operations would violate applicable law. Some themes and commitments cut across these three pathways. Arguably, respect for the law turns in no small part on whether natural persons can and will foresee, understand, administer, and trace the components, behaviors, and effects of relevant systems. It may be advisable, moreover, to institute ongoing cross-disciplinary education and training as well as the provision of sufficient technical facilities for all relevant actors, from commanders to legal advisers to prosecutors to judges. Further, it may be prudent to establish ongoing monitoring of others’ technical capabilities. Finally, it may be warranted for relevant international actors to pledge to engage, and to call upon others to engage, only in armed-conflict-related conduct that is sufficiently attributable, discernable, and scrutable.

One of the most exciting elements of this historic legislation is a dedicated $350 million competitive grant program called the Wildlife Crossings Pilot Program. On 7 July 2020, the National Council – the first chamber of the Austrian Parliament – passed a package of legislation introducing a new framework for the methods of allocating federal budgets to research, technology, and innovation (RTI). Its core is the Research Financing Act (RFA), complemented by several amendments to existing laws that are necessary for its implementation. Entry into force was on 25 July 2020, the amendments became effective as of 1 January 2021 (BGBl1. I No. 75/20202). The RFA is the biggest legislative project in the field of RTI policy since 2004 when the Research Funding Agency (FFG) was established (Pichler et al. 2007, pp. 329-336; Stampfer et al. 2010, pp. 775-776). For the first time, budget law regulations are now aligned with the needs of institutions performing or funding RTI (Pichler 2021). This article outlines the background and content of the RFA and concludes with a view on the significance of evaluation within the new system.

The work is devoted to a comprehensive study of medical support, incl. sanatorium-resort treatment of employees of the military prosecutor’s office and members of their families (persons who are dependent on them). It is noted that health care is structurally included in services that, in addition to cash payments and benefits in kind, represent the entire social security system. The main attention in the article is focused on the analysis of the normative legal regulation of the health protection of employees of the military prosecutor’s office, as well as the provision of medical assistance to them (prophylactic medical examination, medical examination, military medical examination, medical and psychological rehabilitation, sanatorium treatment, reimbursement of expenses for drugs and treatment) of proper quality and in the required volume. The key scientific results of the study are the generalization of legal information and scientific knowledge about the procedure for providing medical assistance to employees of the military prosecutor’s office. The main scientific results of the article can be applied to organize training in the discipline «Military law and military legislation». The article will be of interest to persons conducting scientific research on the problems of social protection of servicemen and their families.

The genesis of the Copyright Amendment Bill was in 2009, when the Department of Trade and Industry (DTI) initiated various studies and impact assessments. In July 2015, the DTI published a Draft Copyright Amendment Bill for public comment. The final 2017 version of the Bill was approved by Parliament in 2019 and it was sent to President Cyril Ramaphosa for action in terms of Section 79(1) of the Constitution. Section 79(1) states that “The President must either assent to and sign a Bill passed in terms of this Chapter or, if the President has reservations about the constitutionality of the Bill, refer it back to the National Assembly for reconsideration”. The President referred the Bill back to Parliament for review on 16 June 2020, on constitutionality issues. In response to the President’s reservations, Parliament’s Portfolio Committee on Trade and Industry has invited stakeholders and other interested parties to submit written submissions on certain sections of the Bill by no later than 9 July 2021. The current copyright law is outdated and does not address the digital environment. The Academy of Science of South Africa seeks to take into account the status of the copyright legislation and the anticipated effects of the amendment Bill on different issues and thereafter, provide recommendations to the President.

Abstract:
Facial recognition software (FRS) is a form of biometric security that detects a face, analyzes it, converts it to data, and then matches it with images in a database. This technology is currently being used in vehicles for safety and convenience features, such as detecting driver fatigue, ensuring ride share drivers are wearing a face covering, or unlocking the vehicle. Public transportation hubs can also use FRS to identify missing persons, intercept domestic terrorism, deter theft, and achieve other security initiatives. However, biometric data is sensitive and there are numerous remaining questions about how to implement and regulate FRS in a way that maximizes its safety and security potential while simultaneously ensuring individual’s right to privacy, data security, and technology-based equality. Legal Issues Facing Automated Vehicles, Facial Recognition, and Individual Rights seeks to highlight the benefits of using FRS in public and private transportation technology and addresses some of the legitimate concerns regarding its use by private corporations and government entities, including law enforcement, in public transportation hubs and traffic stops. Constitutional questions, including First, Forth, and Ninth Amendment issues, also remain unanswered. FRS is now a permanent part of transportation technology and society; with meaningful legislation and conscious engineering, it can make future transportation safer and more convenient.

Abstract:
The relatively recent emergence and sustained rise of social protection as a policy agenda in Africa can be understood as either a nationally owned or ‘donor-driven’ process. While elements of both can be seen in different countries at different times, this paper focuses on the pivotal role of transnational actors, specifically international development agencies, as ‘policy pollinators’ for social protection. These agencies deployed a range of tactics to induce African governments to implement cash transfer programmes and establish social protection systems, including: (1) building the empirical evidence base that cash transfers have positive impacts, for advocacy purposes; (2) financing social protection programmes until governments take over this responsibility; (3) strengthening state capacity to deliver social protection, through technical assistance and training workshops; (4) commissioning and co-authoring national social protection policies; (5) encouraging the domestication of international social protection law into national legislation. Despite these pressures and inducements, some governments have resisted or implemented social protection only partially and reluctantly, either because they are not convinced or because their political interests are not best served by allocating scarce resources to cash transfer programmes. This raises questions about the extent to which the agendas of development agencies are aligned or in conflict with national priorities, and whether social protection programmes and systems would flourish or wither if international support was withdrawn.
