The first chapter gives a general overview of variables policies under Italian law, and analyzes the causes that led insurance companies to conclude variable life insurance. The second and third chapters, which constitute the central part of this research, deal with unit-linked policies and index-linked. In these two policies the benefits are wholly or partly to be determined by reference to the value, or the income from, property of any description, or by reference to fluctuation in, or in an index of, the value of property of any description. The fourth chapter covers the law applicable to linked insurance policies.

A perception of escalating social disorder and allegations of police corruption and ineptitude have led to a social and political imperative to reform policing. Fundamental to this reform is the modification of the core mission of the police and the operational practices of the uniformed Constable. The core characteristics of policing and the operational practices of the uniformed Constable are determined by the core mission and the operational context of policing. -- Despite an imperative to reform the quality and provision of police services to the community the core mission of the police has not fundamentally altered during the last half century and remains crime control (Zaho, 1996). The core mission of contemporary policing has been criticised for being in direct conflict with basic democratic principles and for being simply unachievable. This thesis will establish that the origins and occurrence of crime, its prevalence and persistence is detennined by social, economic and cultural factors that are beyond the control of the police. It will be argued that long-term successful law-enforcement in a democratic society requires the acceptance, cooperation and approval of the community. Community oriented policing may provide the theoretical framework for internalising normative controls and for enhancing public participation in and sharing responsibility for crime control. -- It will be demonstrated that the strategc shift in policing implicit within the theoretical framework of community policing has significant implications for the reform of police . education and training. Several commentators and various Commissions of Inquiry have recommended upgrading police education and training, and the participation of police in tertiary education. -- The reform of police practice is contingent upon the reform of the core mission and the operational context of policing. The core mission and the operational context of policing is substantially defined, controlled and manipulated by the perceptions, expectations and actions of stakeholders. Directly or indirectly these have been found to be antithetical to alternative models of policing that are service orientated; thus blocking, diluting or redirecting efforts to implement community policing. -- Unless the core mission of the police and the operational context of policing are substantially modified then police education will continue to have a limited impact upon the operational practices of the uniformed Constable.

Full textFor years we have witnessed a continuous evolution of the maritime sector, in the constant attempt to introduce new technologies with the aim of improving the services offered, accelerating the speed of trade and reducing the cost of operations. In order to offer a cutting-edge assistance in a short time, the evolution in terms of Bill of Lading have had particular importance. The Bill of Lading (B / L) is the main document used in maritime transport at an international level, characterized as a receipt of cargo, document of title and proof of contract. Since the 80’s of the last century, there have been several attempts to develop an electronic bill of lading that has the same functionality as the paper one in order to overcome the drawbacks of the traditional document while guaranteeing the same safety levels and effectiveness. Recently, scientific progress and digital innovation have contributed to the introduction of a Blockchain based bill of lading in the shipping sector. Although there is no doubt that the digital in the maritime transport sector can lead to multiple advantages, the actual use of a Blockchain Bill of Lading is still evolving.

Full textThe majority of the research work in sociology that deals with the phenomenon of the police force usually focuses on some major issues: it seeks to describe the function of the police as the provider of social security in a given society, to examine the use of violence through the police in the name of the state monopoly on violence and to investigate the structure of the occupational field of policemen. Some studies also highlight the rootedness of police in occidental cultures. This book aims to contribute to the study of these major questions of police sociology through applying them to different historical and modern examples of police structures in different cultures. 1. Public security: Are there ways to guarantee public order and security in a society where there is no such public in the sense of the police laws? This question was the central point of interest for the essay by Franziska Harnish and Anja Bruhn that deals with the phenomenon of blood feuds. 2. The state: The fact that the police in modern society is bound to a certain state context leads to a question about how police structures differ in various law contexts. While Mathias Graßmann analyzes the features of police in Germany, Björn Schülzke takes a look at the situation in the USA. In his essay on Interpol and Europol, Frederick Sixtus examines police structures that have to function beyond given state borders. 3. Violence: The embodiment of the state monopoly on violence through the police is commonly the central point of interest for sociologers. This interrelation was particularly important for the essay by Christiane Mochan on police and violence. An essay on oprichnina by Julia Fatianova deals with the question about whether this monopoly on violence can also serve to create state terror. 4. Salary: Has being a policeman always been a form of wage labour? Many premodern forms of police structures were not practicing continuous wage payment but regarding premiums. The example of Lictors in Ancient Rome, however, shows that regular payment in the police force is not just a modern phenomenon. Tanja Zischke took a detailed look at the Lictors in her essay provided in this book. 5. The Occident: Many sociologists take it for granted that the police force is an attribute of the Western modernity. Max Weber, for instance, says that oriental cultures have not brought about anything comparable. In this context the essay of Jonas Grutzpalk poses a question about the origins of such essentially oriental police structures as the Saudi-Arabian Mutawa. Saskia Ellenbeck analyzes the functioning of the police in Cambodia, which was formed according to the occidental models, and the way it is perceived in Cambodian society. The aim of this book is to contribute to our knowledge about the police through a comparative study of examples of police forms in different cultures.

Full textThis work addresses the issue of police and focuses on the problem of the new ways of production of social control and public consent in the post-modern societies. Which is the role of proximity police in these transformations? How does population participate to development of the new tendencies? And to what extent is police changing their connection with the central power, to become a real “citizen police”? The answer is based on theoretical work and on fieldwork essentially carried out in Paris and Milan. The sources employed include direct observation, more than 80 interviews and a focus group. The research have been developed in three successive phases. First, I examined the theoretical sources to define the concepts of deviance and social control and to understand the role played by police in modern societies. Second, I concentrated on the proximity police, a model of policing approach early introduced within the two national contexts I have studied. Finally, I reconstructed the new tendencies of police action across the three starting questions. Within the conclusion I specify how the two pillars of police action (control and consent) are translated in the post-modern societies. In a way at the same time new and ancient, police is transforming his traditional identity of power dependent by State, but still does what she has always done: a social selection between individuals to reassure and protect and individuals to exclude and punish

Full textThe objectif of our research project is to verify the postulate that the organisation of the Turkish Police could put into practice an application of the Police de Proximité. The experiment of the Police de Proximité constitute an formidable laboratory in which the Turkish Police can learn new lessons, methods, devices, proceedings. The Police de Proximité is an example of a centralised system compared to the model of Community Policing under the regional and local authorities. Facing the renewal of delinquency and the increased feeling of insecurity, the Turkish police are looking for anachronic solutions in the optical of public order and serious crime, such as terrorism, instead of focusing on preventative measures and public safety. A sustainable and effective change can be achieved by responding to social needs. In France the project of Police de Proximité was supended. But the French government is making enormous efforts to integrate this model into the existing system. Even if there are controversial opinions regarding the extent of the application of the Police de Proximité, the concept has been an inspiration to other important field experiments in this research area. The lessons learned by the French experiment allow us to design a new Turkish concept of the Police de Proximité. In order to implement a public policy of security in Turkey, this reform is dependent upon three successive phases: the political administrative phase, the juridic phase including legal modifications and the operational phase within the organisation of the police. As the French experiment has shown, the mere implementation of the reform is not sufficient to change the system. Success implementation of this reform, is dependent upon the support of politicians and people as well as the determination of the police
