O fim do confronto bipolar evidenciou a necessidade dos Estados de repensar os mecanismos para lidarem com as novas ameaças que, por sua capacidade difusora, não respeitam os limites das fronteiras nacionais. Dentre as novas ameaças, o narcotráfico é um dos principais problemas enfrentados pela região sul-americana, pois ela conglomera os três maiores produtores mundiais de droga - Colômbia, Peru e Bolívia. A questão das drogas na Colômbia é ainda mais preocupante, tendo em vista que o país perpassa por um conflito armado latente, pela atuação das guerrilhas, e pela utilização do tráfico de drogas por estes grupos como fonte de financiamento para a sua luta armada. Soma-se a isso a incisiva presença norte-americana para a resolução dos problemas domésticos colombianos através da "exportação" de sua agenda de segurança à Colômbia, o que desencadeou na militarização do combate às drogas, às guerrilhas e ao terrorismo internacional. Neste cenário, aponta-se como objetivo dessa dissertação discorrer sobre as respostas do Brasil ao tráfico de drogas, ameaça securitizada e combatida militarmente na Colômbia e que tem afetado a fronteira entre os dois países. Pontua-se, no âmbito político e militar, as ações brasileiras para reprimir e coibir às drogas, iniciativas que têm buscado aumentar a presença do Estado brasileiro na região amazônica a fim de manter a segurança e a defesa do território nacional frente às novas ameaças e resguardar a soberania do país em uma região considerada estratégica aos interesses nacionais.
Abstract : The end of bipolar confrontation showed the need for States to rethink the mechanisms to deal with the new threats that, in diffusing capacity, don't respect the limits of national borders. Among the new threats, drug trafficking is a major problem faced by the South American region, because it conglomerates the three largest producers of drug - Colombia, Peru and Bolivia. The issue of drugs in Colombia is even more worrying, given that the country permeates a latent armed conflict, the activities of the guerrillas, and the use of drug trafficking by these groups as a source of funding for their armed struggle. Added to this incisive U.S. presence for the resolution of the Colombian domestic problems through the "export" of its security agenda to Colombia, what triggered the militarization of the war on drugs, the guerrillas and international terrorism. In this scenario, it is pointed out the objective of this dissertation discuss the responses of Brazil to drug trafficking, securitized threat and fought militarily in Colombia and that has affected the border between the two countries. It is pointed out, in political and military scope, Brazilian actions to suppress and restrain drug initiatives that have sought to increase the presence of the Brazilian state in the Amazon region in order to maintain the security and defense of the national territory forward to the new threats and protect the country's sovereignty in a region considered strategic to national interests.

Full textThe doctoral thesis The international drug control regime: formation, evolution and interaction with national policies. The case of drug policy in Spain analyzes the emergence, evolution and characteristics of the contemporary international drug control regime and the policies that states have implemented to fulfill its fundamental postulates. The central idea is iv that this regime is experiencing a process of weakening due to, among other reasons, that a growing number of states deviates from punitive prohibitionism as a central principle for their drug policy formulation and explores alternative ways to manage this phenomenon in their own national contexts. Based on this premise, the study examines how this state practices may contribute to the transformation of the drug control regime developing a set of analytical categories -based on international regimes theory- and a typology of drug policies which are applied to the case of Spain. The first section of the work analyzes the main characteristics and recent developments of illicit drug markets and presents the analytical framework upon which the research is built. The second part studies the emergence, evolution and transformation of the international drug control regime, together with the main characteristics of its national implementation. The third section covers the case study, applying the proposed categories to the analysis of Spanish drug policy. Finally, the last section presents the main conclusions of the research and outlines a set of potential scenarios for the evolution of the international drug control regime.

This work deals with the approach to the treatment of drug addictions and is aimed to evaluate the model of treatment implemented at the Rehabilitation Communities in the State of Ceará, in the framework of the National System of Public Policies – SISNAD, focusing on the analysis of this model in the light of the country´s regulatory framework in effect. The authors discuss the addiction to chemical substances, especially the theoretical content of De León. A quantitative and qualitative approach was applied to the study of three Rehab Communities working in partnership with the Secretary of Health of the State of Ceará through a social subsidy. Data were collected from 53 participants, including both working professionals and beneficiaries, by means of semi-structured interviews with open and closed questions, and deep interviews with six beneficiaries of the program. The quantitative data were submitted to a descriptive and saturation treatment, using an absolute and relative frequency, a simple table and indicators. The qualitative data were analyzed by the discursive analysis technique. We found that there was a change in the perception of the drug user and that only after such change occurs, i.e. when they are seen as patients and not as outlaws, the need for the public authorities to take care of them was put in place. We consider that although this policy is undoubtedly a legitimate model of treatment, on the other hand it is far from being considered a right to healthcare as provided by the Federal Constitution. We have concluded as well that drug addiction can be found in every social class and that such addiction starts with the use of licit drugs or marijuana, even though the very existence of such addiction is only acknowledged by most people when the addict begins to use crack. Furthermore, this model of treatment, in the eyes of both the professionals and drug addicts, meets their needs due to the fact that it is a self-help model and one that offers a community experience. This study showed that even in the absence of a public intervention the Community Rehab centers understand their goals and mission, thus getting close to the standard model.
Este trabalho trata sobre uma abordagem para dependência química. A pesquisa objetiva avaliar o modelo de tratamento em Comunidade Terapêutica no estado do Ceará em interface com o Sistema Nacional de Políticas Públicas - SISNAD, tomando como eixo de análise a aproximação deste modelo com o marco regulatório vigente no país. Tem como marco teórico os autores que discutem e teorizam sobre dependência química e essencialmente o referencial apresentado por De Leon. Foi realizado numa abordagem quantitativa e qualitativa, sendo o campo de estudo composto por três Comunidades Terapêuticas que mantêm parceria com a Secretaria de Saúde do Estado Ceará através de subvenção social. Os dados foram colhidos com a participação de 53 atores, incluindo profissionais e beneficiários, utilizando-se instrumentos de entrevistas semiestruturada com perguntas abertas e fechadas, entrevistas em profundidade com seis usuários do programa. Os dados quantitativos foram submetidos a tratamento descritivo e saturação, usando freqüência absoluta e relativa, tabela simples e indicadores de referência. Os qualitativos foram abordados com técnica de análises discursivas. Observamos que houve uma mudança na percepção do usuário de drogas e que só a partir deste reconhecimento, quando passaram a ser vistos como doentes e não como marginais, foi sendo colocada em pauta a necessidade de atenção pelo poder público. Consideramos que enquanto política pública indiscutivelmente este modelo de tratamento é legítimo, por outro lado, está longe do reconhecimento de ser um direito e da universalização previsto na Constituição Federal. Outra conclusão que chegamos foi que a dependência química atinge todas as classes sociais e que o adoecimento inicia com o uso de drogas lícitas ou maconha, contudo, a percepção que a doença está instalada, na grande maioria só é reconhecida quando chegam ao CracK. E ainda, para os dependentes químicos e profissionais, este modelo de tratamento responde as suas necessidades por ser um modelo de auto-ajuda e de vivência comunitária. O estudo destas Comunidades Terapêuticas revelou-nos que mesmo com a ausência estatal, essas instituições compreendem seus objetivos e missão, aproximando-se do modelo padrão.

This research is about the study of coping with public policies on drugs adopted in Brazil, aiming to present the legal strategies that support the political entities to create confronting programs to crack. In the survey the normative base that supports the drug policy was used, especially the federal government Crack program, it's possible to win, of national extensive and adopted in all the capitals of the states and cities with a population over 200,000 inhabitants. In chapter one the models to confronting drugs were presented - prohibitionist, abolitionist and harm reduction models - in order to support the study of the Crack program, it is possible to win and present strategies to be used in any confrontation program to crack. The protection of social rights under the Federal Constitution of 1988 was analyzedas well as the specific protection to health and social care. The second chapter investigated the legal theory about public policies and the conceptual foundations of public drug policies as well as the controversy over the non-voluntary hospitalization and the first user profile mapping and crack addicts in the country conducted by the Oswaldo Cruz Foundation. Chapter three described the structural axes of the Crack program, it's possible to win, analyzing the dismantling of parts of the program that compromise its full realization, as it is the main topic of the thesis. Finally, in chapter four, proposals for re-articulation of the program were built, in order to contribute to further studies and subsidize possible interventions in public policy drug running. The methodology used in the research is deductive, with the application of documentary research techniques and theoretical framework, investigating the theory that supports the construction of public policies and normative basis and document the Crack program, it's possible to win. The conclusions drawn from the proposed issue presented as dislocation point of the program: the need for prior diagnosis for identifying the public to be served and size of the actions; expansion of the program in order to include cities with less than 200,000 inhabitants; need for civil society participation in planning and program implementation; lack of interest of municipal managers in joining the program; difficulty understanding among the three structural axes of the program: care, authority and prevention; precarious UHS networks - Unified Health System and USSA - Unique System of Social Assistance; need for expansion of the sectors that make up the program; monitoring and evaluating the program and insufficient financial investment for their implementation.
A presente pesquisa versa sobre o estudo de políticas públicas de enfrentamento às drogas adotadas no Brasil, com vista a apresentar estratégias jurídicas que subsidiem os entes políticos a criarem programas de enfrentamento ao crack. Na pesquisa, foram utilizadas bases normativas que estruturam a política de drogas, em especial o programa do Governo Federal Crack, é possível vencer, de amplitude nacional, adotado no Brasil em todas as capitais dos Estados e Municípios com população superior a 200 mil habitantes, a partir de 2010. No capítulo um, apresentaram-se os modelos de enfrentamento às drogas – modelos proibicionista, abolicionista e de redução de danos – a fim de subsidiar o estudo do programa Crack, é possível vencer e apresentar estratégias a serem utilizadas em quaisquer programas de enfrentamento ao crack. Partiu-se de uma análise da proteção aos direitos sociais previstos na Constituição Federal de 1988, bem como a tutela específica à saúde e à assistência social. O segundo capítulo investigou a teoria jurídica acerca das políticas públicas e as bases conceituais que apresentam as políticas públicas de drogas, bem como a polêmica sobre a internação não voluntária e o primeiro mapeamento do perfil de usuários e dependentes de crack no País, realizado pela Fundação Oswaldo Cruz, em 2013. O capítulo três descreveu os eixos estruturantes do programa Crack, é possível vencer, analisando os pontos de desarticulação do programa que comprometem sua plena efetivação, tratando-se do ponto central da tese. Por fim, no capítulo quatro, construíram-se proposições para rearticulação do programa, com a finalidade de contribuir para o aprofundamento dos estudos sobre o tema e subsidiar possíveis intervenções nas políticas públicas de drogas em execução. A metodologia empregada na pesquisa é a dedutiva, com a aplicação das técnicas de investigação documental e análise do referencial teórico, investigando particularmente a teoria que subsidia a construção das políticas públicas e a base normativa e documental do Programa Crack, é possível vencer. As conclusões extraídas do problema proposto apresentam como ponto de desarticulação do programa: necessidade de melhor diagnóstico prévio para identificação do público a ser atendido e definição das ações a serem adotadas; ampliação do programa, a fim de contemplar municípios com menos de 200 mil habitantes; necessidade de participação da sociedade civil no planejamento e na execução do programa, como critério para a sua legitimidade no Estado Democrático de Direito; falta de interesse dos gestores municipais em aderir ao programa; dificuldade de articulação entre os três eixos estruturantes do programa: cuidado, autoridade e prevenção; precariedade das redes do Sistema Único de Saúde – SUS e Sistema Único da Assistência Social – SUAS; necessidade de ampliação dos setores que compõem o programa; monitoramento e avaliação do programa e investimentos financeiros insuficientes para sua execução.

Full textEl Problema Mundial de las Drogas (PMD) es complejo y tiene múltiples aristas. De acuerdo a la Declaración Política del XX Período Extraordinario de Sesiones de la Asamblea General de las Naciones Unidas, celebrada en junio de 1998, el PMD está definido como “El cultivo, producción, fabricación, venta, demanda, tráfico y distribución ilícita de estupefacientes, sustancias sicotrópicas, incluyendo los estimulantes de tipo anfetamínicos, el desvío de precursores y delitos conexos”. En el marco de la cooperación internacional en materia de drogas, se han establecido ciertos principios, los cuales algunos de ellos están consagrados como principios generales del derecho internacional en la Carta de las Naciones Unidas. Estos principios son: - Pleno respeto a la soberanía e integridad territorial de los Estados. - No intervención en los asuntos internos de los Estados. - Respeto a los derechos humanos y libertades fundamentales. Con relación al problema de las drogas, está el principio de la “responsabilidad compartida”, el cual es fundamental para comprender las acciones bilaterales o multilaterales para enfrentar el problema de las drogas en el campo internacional y en el ámbito nacional.

O veio deste trabalho se firma na análise dos pressupostos do estado democrático de direito ante as políticas de controle sobre as drogas consideradas ilícitas. A política criminal de controle às drogas tem se mostrado ineficiente para atingir o fim declarado de proteção à saúde pública, visto que a criminalização do porte, consumo e tráfico de drogas tem gerado consequências negativas para a sociedade (encarceramento em massa, mortes, seletividade, violência e danos à saúde). Parte-se da hipótese de que a instauração de um estado penal de guerra às drogas macula as garantias fundamentais instituídas nas democracias, principalmente contra as classes menos favorecidas da sociedade, sendo necessária a mudança paradigmática desta ideologia, a fim de se instaurar um modelo mais humanitário e eficiente, sem que se recorra ao Direito Penal como a prima ratio para o controle do uso, porte e tráfico de drogas consideradas ilícitas. O objetivo foi conhecer as razões por trás da proibição às drogas, para que a partir de bases constitucionais e democráticas, aliada à criminologia crítica, tragam-se à reflexão as centenas de vidas destruídas na guerra às drogas. Enfim, a necessidade de maior amparo aos direitos humanos e o imprescindível fim à injustiça social instaurado na guerra às drogas inspiraram a construção desta pesquisa. _______________________________________________________________________________________________ ABSTRACT

The criminal policy of drug control is inefficient to achieve the protection of public health, because the criminalization of the possession, consumption and trafficking of drugs generates negative consequences for society (mass incarceration, death, selectivity, violence and damage to health).We started from the hypothesis that the introduction of a criminal state of drug war stains the fundamental guarantees established in democracies, especially against the lower classes of society, and so, is necessary to change the paradigm of this ideology, in order to be established a model more humane and efficient, without resort to criminal law as prima ratio to control the use, possession and trafficking of drugs considered illegal. The objective was to know the reason behind the prohibition of drugs, so that, from constitutional and democratic basis, ally with the critical criminology, emerge reflections about the many lives destroyed in the drug war. In short, there cognized need of wide protection of human rights and the imperative end of social injustice arise from the drug war, inspired the construction of this research.

Full textAbstract The consumption of drugs is an undeniable phenomena in modern societies, around which turn most problems affecting the feeling of security amongst the population. As so,it is extremely important to understand GNR’s role in fighting this issue. In that context, this Research Work aim: to describe the role of GNR fighting the consumption of drugs as and psychotropic substances. This assignment is divided into two main parts, in order to cover its main goals. In the first place a look into the evolution of drugs policies in Portugal, which led to the current drug policy which acts through the legal system of drugs consumption. The second part concerns to the fieldwork, presenting and discussing the results found, conclusions drawn and subsequent recommendations. The method used in the first part lies on the analysis of existent documentation. On the other hand, in the second part it was used the inquisitive method, collecting information through individual interviews, as a way of getting different experience d, point of views and perspectives of those who came across such situations. In this Research Work, it is conclude that role of GNR in fighting drugs and psychotropic substances is of main importance. All of this originates in the legal responsibilities an d is empowered by two decisive factors: the articulation with other existing entities and the formation ministered. This decisive role is characterized by a balanced action as far as the offer and demand which tends to be repressive.

Esta pesquisa tem por objetivo fazer uma análise da política estratégica dos Estados Unidos para a América do Sul, do governo Clinton ao governo Bush. O trabalho versa sobre os principais temas que configuram as abordagens estratégicas norte-americanas para a região, dentro de um contexto mais amplo das mudanças pelas quais passaram a segurança internacional no final da guerra fria. Os Estados Unidos, ao não mais encontrarem no sistema internacional um adversário tradicional ou compatível com seus delineamentos estratégicos, tiveram que redesenhar e redefinir suas prioridades para a segurança nacional. Dessa forma, ameaças transnacionais foram, gradualmente, abordadas como uma das novas prioridades para garantir a segurança nacional do país. Com relação à América do Sul, partindo das estratégias norte-americanas para o Hemisfério Ocidental, os temas elencados nas políticas para a região são: o tráfico de drogas, a promoção da democracia, abertura de mercados, tráfico e produção de drogas, corrupção, lavagem de dinheiro e terrorismo. Estes temas percorreram todos os planejamentos estratégicos do governo Clinton, através de sua agenda multilateral, dentro do contexto da estratégia de Engajamento e Expansão, a qual buscou vincular os países aos temas sensíveis à sua segurança nacional, através de vários encontros Hemisféricos. No caso da América Latina, as Cúpulas das Américas e suas reuniões específicas, como as Reuniões de Ministros de Defesa das Américas, foram meios de se obter esta vinculação política. Estes temas permaneceram presentes no governo George W. Bush, entretanto, a abordagem estratégica para a região enfatizou a possível ligação entre estas questões presentes, como o tráfico de drogas, lavagem de dinheiro e corrupção; ao terrorismo internacional, o qual sobe ao topo das prioridades da política estratégica norte-americana
This research aims to analyze the strategic policy of the United States to South America, from the Clinton administration to the Bush administration. This paper discusses major issues that shape strategic approaches within the U.S. for the region within a broader context of changes which came to international security at the end of the Cold War. The United States, which no longer met in the international system a traditional adversary compatible with its strategic designs, had to redesign and redefine its priorities for national security. Thus, transnational threats have been gradually addressed as one of the new priorities to ensure national security of the country. Regarding South America, departing from North American strategies for the Western Hemisphere, the topics listed in the strategic policies for the region are: drug trafficking, maintenance of democracy, open markets, trafficking and drug production, corruption, money laundering and terrorism. These subjects went through all the strategic plans of the Clinton administration, through its multilateral agenda, within the context of the Strategy of Engagement and Expansion, which sought to bind the countries to sensitive issues to its national security through various hemispheric meetings. In the case of Latin America, the Summits of the Americas and its specific meetings such as the Meetings of Ministers of Defense of the Americas were ways to get this linking policy. These themes remained present under the George W. Bush’s administration, however, the strategic approach to the region emphasized the possible link between these issues in the region, such as drug trafficking, money laundering and corruption, to international terrorism, which rises to the top of the priorities of US strategic policy

Full textEste trabalho procura verificar o desenho institucional e o protagonismo das principais instituições políticas que lidam com refugiados no Brasil, a partir da atuação da centralidade política do Comitê Nacional para Refugiados e da Polícia Federal. Os processos decisórios, os procedimentos burocráticos de controle migratório e de segurança do governo brasileiro a respeito do fenômeno do deslocamento forçado de refugiados. Busca analisar a burocracia e os mecanismos procedimentais voltados aos estrangeiros no que tange aos refugiados. Identificando as dificuldades institucionais, os limites e os desafios para implementação de políticas públicas voltadas aos refugiados. Assim como as parcerias e operações conjuntas com a sociedade civil organizada e a comunidade internacional desde o funcionamento do Comitê Nacional para Refugiados, de 1998 até o ano de 2012. Tanto em relação aos refugiados por elegibilidade quanto àqueles trazidos para reassentamento, particularmente as conexões com a doutrina integral dos direitos humanos e com a política externa brasileira. Evidenciando a falta de coordenação, a fragmentação e a pulverização da política migratória como um todo, e da politica para refugiados de maneira particular, conectados com o passado autoritário do país e a manutenção de mecanismos restritivos para inserção local de estrangeiros.
This work seeks to verify the institutional design and role of the main political institutions dealing with refugees in Brazil, from the action of the political centrality of the National Committee for Refugees and the Federal Police. Decision-making processes, the bureaucratic procedures of migration control and security of the Brazilian government about the phenomenon of forced displacement of refugees. Seeks to analyze the bureaucracy and procedural mechanisms geared to foreigners regarding refugees. Identifying the institutional difficulties, limits and challenges to the implementation of public policies geared to refugees. As well as partnerships and joint operations with organized civil society and the international community since the operation of the National Committee for Refugees from 1998 until the year 2012.Both in relation to refugees for eligibility as those brought to resettlement, particularly connections with full human rights doctrine and Brazilian foreign policy. Highlighting the lack of coordination, fragmentation and pulverization of migration policy as a whole, and refugee policy in a particular way, connected with the authoritarian past of the country and the maintenance of restrictive mechanisms for local insertion of foreign.
