Abstract:

We recast the Podleś spheres in the noncommutative physics context by showing that they can be regarded as slices along the time coordinate of the different regions of the quantum Minkowski space-time. The investigation of the transformations of the quantum sphere states under the left coaction of theSOq(3)group leads to a decomposition of the transformed Hilbert space states in terms of orthogonal subspaces exhibiting the periodicity of the quantum sphere states.

We study a three-dimensional differential calculus [Formula: see text] on the standard Podleś quantum two-sphere [Formula: see text], coming from the Woronowicz 4D+ differential calculus on the quantum group SU q(2). We use a frame bundle approach to give an explicit description of [Formula: see text] and its associated spin geometry in terms of a natural spectral triple over [Formula: see text]. We equip this spectral triple with a real structure for which the commutant property and the first order condition are satisfied up to infinitesimals of arbitrary order.

AbstractA fibre product construction is used to give a description of quantum line bundles over the generic Podlés spheres obtained by gluing two quantum discs along their boundaries. Representatives of the corresponding K0-classes are given in terms of 1-dimensional projections belonging to the C*-algebra, and in terms of analogues of the classical Bott projections. The K0-classes of quantum line bundles derived from the generic Hopf fibration of quantum SU(2) are determined and the index pairing is computed. It is argued that taking the projections obtained from the fibre product construction yields a significant simplification of earlier index computations.

Abstract:

The separation of powers is a general principle of Brazilian Constitutional law prescribed in article 2 of the Federal Constitution following the model idealized by Montesquieu, Executive, Legislative and Judiciary, each of the powers has its respective characteristics and also has its typical and atypical functions. In the system of separation of powers there is a theory called System of Brakes and Counterweights, where it controls the division of powers and ensures that each one acts within its respective sphere of competence. With the passage of time within the Brazilian scenario has been emerging the so-called Judicial Activism, a phenomenon that arises when the judiciary proceeds to intervene proactively in the sphere of competence of other powers. With this, the present article seeks to show judicial activism, focusing on the exorbitance of the atypical function of the judiciary and how this judicial activism is triggered within the system of separation of powers.

La cláusula “intereses generales” legitima la acción de gobierno y la existencia misma del Estado, así como sus poderes de limitación de las esferas de libertad de los ciudadanos. Sin embargo, nuestro ordenamiento jurídico no ofrece una definición de lo que son los intereses generales. En este estudio se intentan encontrar las características que permiten orientar la acción administrativa hacia la satisfacción de los intereses generales, así como identificar los elementos que construyen el concepto.Palabras clave: Interés general, intereses generales, utilidad pública, interés social, servicio público.Abstract: The concept of general interest is firmly implanted in our Constitution and in our legal texts. The clause "general interests" legitimizes the action of government and the very existence of the State as well as its powers to limit the spheres of freedom of citizens. However, our legal system does not offer a definition of what general interests are. In this study we try to find the characteristics that allow us to orient the administrative action towards the satisfaction of the general interests as well as to identify the elements that construct the concept. A Agenda Ambiental na Administração Pública (A3P) surge com o propósito de estimular a inserção de práticas sustentáveis nos órgãos públicos das três esferas de governo (Federal, Estadual e Municipal) e nos três poderes da república (Executivo, Legislativo e Judiciário). O artigo aborda a implementação de ações sustentáveis, a partir das diretrizes estabelecidas pela A3P, no tocante ao consumo de energia elétrica, água, gestão de resíduos (papel, plástico, pilhas, baterias, lâmpadas fluorescentes e óleo de cozinha), comunicação, ações de conscientização e capacitação, em três setores da Universidade Federal da Paraíba. Os resultados obtidos demonstram que ações pontuais e em menor escala podem ser bastante eficazes na promoção de uma consciência ambiental no cotidiano da administração pública brasileira. The implementation of sustainable actions based on the Environmental Agenda in Public Administration (A3P): an extensionist experience in the university environment A B S T R A C TThe Environmental Agenda in Public Administration (A3P) was created with the purpose of stimulating the insertion of sustainable practices in public bodies of the three spheres of government (Federal, State and Municipal) and in the three branches of government (Executive, Legislative and Judiciary). The text addresses an example of public environmental management through the implementation of sustainable actions, based on the guidelines established by A3P, regarding the consumption of electricity, water consumption, waste management (paper, plastic, batteries, fluorescent lamps and cooking oil), communication, awareness raising and training actions, in three sectors of the Federal University of Paraíba. The results show that timely actions and to a lesser extent can be quite effective in promoting an environmental awareness in the daily life of the Brazilian public administration.Keywords: Public environmental management, sustainable actions, environmental awareness.

Abstract:

Citizen participation has become an important political strategy. A case study of the Barranquilla land-use plan employing Fung and Wright’s theories on countervailing power reveals that the citizen participation promoted to comply with legal requirements was a failure because it was manipulated by the dominant public actor. In societies such as that of Barranquilla, which employs traditional modes of politics, there is little chance of fostering successful participatory processes because there is no countervailing power to offset the established one. The violent context that surrounds the political sphere, low confidence in state institutions, and the convergence of economic and political power prevent the creation of strong and independent countervailing powers. La participación ciudadana se ha convertido en una importante estrategia política. El estudio de caso del plan de usos de terrenos de Barranquilla a través del prisma de las teorías de Fung y Wright sobre el poder compensatorio revela que la participación ciudadana promovida para cumplir con los requisitos legales fue un fracaso porque fue manipulada por el actor público dominante. En sociedades como la de Barranquilla, con sus modos tradicionales de la política, hay pocas posibilidades de fomentar procesos de participación exitosos porque no hay un poder compensatorio que contrarreste el poder establecido. El contexto violento que envuelve la esfera política, la poca confianza en las instituciones estatales y la convergencia del poder económico con el poder social impiden la creación de poderes compensatorios fuertes e independientes.

Piracicaba, Bauru e Rio Claro, cidades médias do interior do estado de São Paulo, passaram por processos de revisão de seus Planos Diretores na primeira década do século XXI que os adequaram às premissas do EC. A análise comparativa desses processos, de novas políticas urbanas e de implantação das Zonas Especiais de Interesse Social (ZEIS) evidencia as limitações dos referidos planos, cujas diretrizes relativas aos interesses imobiliários e fundiários locais remetem a obstáculos no enfrentamento de seus passivos urbanísticos e ambientais, o que afeta, sobretudo, os segmentos mais pobres da população.SOCIOESPATIAL SEGREGATION AND URBAN POLITICS IN MEDIUM-SIZED CITIES IN CONTEMPORARY BRAZIL (2001-2011)ABSTRACTThe “City Statute” (Federal Law 10.257/2001) regulated the chapter about urban politics of Brazil’s 1988 Constitution and widened the powers of the cities to legislate about their territories by making available new tools for urban regulation and order. The cities of Piracicaba, Bauru and Rio Claro, medium-sized cities of the state of São Paulo, passed through processes of revising their Directive Plans in the first decade of the 21st century to adequate their plans to the principles of the Statute. The comparative analysis of these processes, of the implementing of Special Zones of Social Interest (Zonas Especiais de Interesse Social – ZEIS), and of the urban politics evidences the limitations of the Directive Plans. O artigo focaliza as transformações em curso no mundo do trabalho nas sociedades do primeiro e do terceiro mundo. Mergulhadas em profunda crise, estas sociedades têm adotado os processos de flexibilização e terceirização como instrumentos estratégicos, sobre os quais a autorase debruça - tendo a França e sua indústria nuclear como locus privilegiado de análise -, resgatando a saúde como importante dimensão reveladora de contradições sociais e políticas e retomando, como eixo central de discussão e da história deste fim de século XX, a questão da crescente exclusão social. Critique of the Division of Work, Health and Counter-Powers. Annie Thébaud-Mony This article focuses on the on-going transformations taking place in the work sphere in societies of the "first" and "thrid" world. Submerged in a profound crisis, these societies have been adopting the processes of flexibilization and tertiarization as strategical tools. Taking France and its nuclear industry as the privileged locus of analysis, the author reflects upon these processes and tools, rescueing health as an important dimension in revealing social and political contradictions. This is accomplished by restoring the growing process of social exclusion not only as central axis for this discussion but also understanding the history of the end of the xxth century. Abstract:

Resumo: O presente estudo tem por objetivo analisar o controle judicial das políticas públicas. Para tanto, será explanado o conceito doutrinário dessas políticas, bem como a delimitação da seara política na qual se desenvolvem. Uma breve abordagem da divisão dos poderes será necessária, com vistas a melhor definir o que pode ser considerado como ativismo judicial. Sobre este mesmo tema do ativismo, será demonstrado que não existe um consenso em sua classificação, mas que esta depende do tempo e lugar a ser analisado. Uma relevante discussão sobre a Teoria da Reserva do Possível é demonstrada, bem como a possibilidade ou não da sua utilização quando da análise da legitimidade da intervenção judicial na esfera de atuação dos demais poderes da república. Por fim, será estudado o tema da intervenção judicial na atualidade, e suas possíveis consequências para a democracia.Palavras-chave: Políticas públicas; Ativismo judicial; Reserva do possível. Abstract:This study aims to analyze the judicial control of public policies. Thus, the doctrinal concept of these policies will be explained, and the delimitation of political harvest and develops. A brief overview of the division of powers is necessary, in order to better define what can be considered as judicial activism. About this same theme of activism, will be shown that there is no consensus on their classification, but it depends on the time and place to be analyzed. A relevant discussion on the possible Reserve Theory is demonstrated, as well as whether or not their use when analyzing the legitimacy of judicial intervention in the sphere of activities of the other two branches of government. Finally, the subject of judicial intervention at the present time will be studied, and their possible consequences for democracy.Keywords: Public policy; Judicial activism; Possible reserve theory.

Abstract:

Com o surgimento dos direitos de segunda geração ou econômicos, culturais e sociais, o antes inerte Ente Estatal teve que assumir outra faceta (Estado de bem estar social), com a obrigação legal de garantir e implementar ações para eliminar as desigualdades existentes na sociedade, protegendo-se, assim, principalmente, as camadas populacionais mais carentes. Porém, mesmo com exigência legal deste dever, o Estado brasileiro, principalmente, no que se refere ao direito à saúde, foco do presente trabalho, como é de conhecimento público, não está cumprindo adequadamente sua obrigação, sendo que, ano após ano, milhares de pessoas continuam morrendo nas filas de hospitais, na espera de atendimento ou do fornecimento de medicamento, caracterizando-se, assim, verdadeira inconstitucionalidade por omissão estatal. Além disso, o direito à saúde, da forma como está previsto em nosso ordenamento jurídico, suscita diversos questionamentos ao intérprete e aplicador do Direito, tais como o limite e a competência dos entes federativos no seu cumprimento, assim como a partir de que ponto poderá o cidadão exigi-lo, inclusive utilizando-se do Poder Judiciário, nesta efetivação, com a análise do conceito do “mínimo existencial” e da dignidade da pessoa humana, sem a caracterização, nessa situação, da lesão ao princípio da separação dos poderes, previsto no artigo 02º de nossa Lei Maior de 1.988. Por meio deste artigo, se apresentará, primeiramente, o problema da não efetivação real pelo Estado do direito social à saúde, na maioria das hipóteses, pela falta de recursos financeiros disponíveis para tanto, utilizando-se a Administração Pública da tese da “reserva do possível” em sua defesa, e, secundariamente, o ponto principal de nossa discussão, se há ou não a possibilidade de se valer do Poder Judiciário para se cumprir o disposto legalmente, apresentando-se argumentos e requisitos para tornar-se viável a eleição desta via pelo cidadão lesado em seu direito à saúde e, por consequência direta, o direito maior à vida, sem comprometer as políticas públicas nesta seara, evitando-se, assim, a judicialização excessiva, por meio de uma pesquisa doutrinária e jurisprudencial, utilizando-se da metodologia lógico-dedutiva.

A decisão de preservar, ou não, um bem e a escolha do instrumento adequado para isso situam-se, porém, na esfera de discricionariedade do Executivo. O Judiciário, portanto, deve adotar postura deferente aos juízos de mérito da Administração, competindo-lhe zelar pela observância do devido processo legal. Since then, judicial disputes regarding this subject have significantly increased. The decisions about whether and how to protect a historical site belong to the administrative sphere of discretion. Thus, judicial review should defer to administrative decisions, unless the due process clause rests violated. Crisis of the Institutional Separation between Church and State in USA and the Emergence of Conservative Neo-evangelism in the Political Sphere ABSTRACT: This article analyzes the cumulative causes of the progressive decay in the institutional and jurisprudential separation between Church and State in the United States from an interdisciplinary methodological approach, including sociological, economic, historical, and political elements interacting with the American legal system. It reviews the changes in the American civic religion, the plural religious denominationalism facilitating a new religious market, the increasing entanglement between religion and politics, and the role of neo-evangelicalism in the elections and the US policies at domestic and international levels. It includes some changes in the US Supreme Court that facilitates increasing paradoxes in the First Amendment jurisprudence regarding the Free Exercise and Non-Establishment clauses.

Abstract:

RESUMOA crise epidemiológica da covid-19 demonstrou a ineficiência de um plano governamental acerca da saúde pública no Brasil; mais do que isso, ela trouxe consigo um corolário remissivo de uma crise social sem precedentes. Perante o cenário pandêmico da covid-19 e levando em consideração os ancoramentos teórico-metodológicos da teoria crítica e da filosofia social, quero explicitar nesta pesquisa que essa crise social não pode ser debitada unicamente na conta da covid-19, porém ao desarranjo social que ela evidenciou. Daí que, a meu ver, esse estado de crise social decorre da não-efetivação da esfera do “Social” entendido basicamente pelas relações, instituições e práticas sociais (1). Tomarei como referências um dual quadro categorial: (2) a crise nas práticas e relações sociais mediante uma debilitada compreensão do que seja ideologia (quadro político) e a crise institucional entre os poderes (3).Palavras-chave: Filosofia Social. RESUMO Nas jornadas de Junho de 2013 vimos emergir novas formas de midialivrismo e midiativismo em que a linguagem e a experimentação criam outra partilha do sensível. Uma experiência no fluxo e em fluxo, que inventa tempo e espaço, poética do descontrole e do acontecimento. Exprimir o “grito”, como escreveu Jacques Ranciere, tanto quanto tomar posse da palavra é o modo de desestabilizar a partilha do sensível e produzir um deslocamento dos desejos e constituir o sujeito político multidão. A importância das mídias on-line, mídias livres e midiativistas nesse grito desestabilizador nos parecem decisivas na constituição de uma nova forma de experimentar a politica. A multidão capaz de se autogovernar a partir de ações e proposições policêntricas, distribuídas, atravessadas por poderes e potências muitas vezes em violento conflito, constitui uma esfera pública em rede, autônoma em relação aos sistemas midiáticos e políticos tradicionais. Uma análise da experiência de transmissão ao vivo da Midia Ninja, sua relação com os processos do cinema e sua filiação e parte das chamadas revoluções P2P ou revoluções distribuídas em que a heterogeneidade da multidão emerge em sinergia com os processos de auto-organização (autopoiesis) das redes.Palavras-chave: Midiativismo; Midia Ninja; Estéticas; Audiovisual; Redes. ABSTRACT In the June Journeys of 2013 we saw an emergence of new forms of mediactivism in which language and experimentation create another distribution of the sensitive . An experiment on the flow which invents time and space , a poetics of flux and the event. To express the " Scream ", wrote Jacques Ranciere, as much as taking ownership of the word is the way to destabilize the distribution of the sensitive and to produce a displacement of desires and to constitute the multitude as a political actor. The importance of online media , free media and destabilizing mediactivists seems decisive in the architecture of a new form of political experience . A multitude capable of self-government based on polycentric and distributed action, crossed by frequently conflicting powers, constitutes a public networked sphere - autonomous with regard to traditional media and political systems . An analysis of live broadcasting by Media Ninja, its relation with the processes of cinema and its filiation, and part of the so-called P2P revolutions or distributed revolutions in which the heterogeneity of the multitude emerges in synergy with self-organization processes (autopoiesis ) of networks is attempted in this article.Keywords: Mediactivism; Midia Ninja; Aesthetic; Audiovisual networks.
