Abstract:
From the late 1960s to the early 1980s, American punk developed as a distinct musical style that reflected the tremendous upheaval in American society during this period. Raw and direct, punk presented an unvarnished view of changing ideas of race, the growth of American suburbia, and the heightened stakes of musical expressions of whiteness and Blackness. Damaged: Musicality and Race in Early American Punk traces the main factors at play in the punk style, including transformations to blues resources, experimental visions of the American musical past, and bold reworkings of the rock and roll and R&B sounds of the late 1950s and early 1960s—all in all, a historically oriented approach to rock that is strikingly different from the common myths and conceptions about punk. Eventually punk became a forum for new versions of older exchanges between the US and the UK, and the style reflected even more changes to American metropolitan areas and a shift from the expressions of older baby boomers to that of younger musicians belonging to Generation X. The book also explores the discourses and contradictory narratives of punk history, which are often in direct conflict with the world that is captured in historical documents and revealed through musical analysis.

The United Nations Compensation Commission (‘UNCC’) is a unique model for liability and compensation of environmental damage in an international context, influencing both jus in bello and jus post bellum. The UNCC provided a legal process that catalogued, assessed, and awarded money to pay to clean and repair the damaged soil, water, coastal ecosystems, and other harms resulting from the 1990–1 Gulf War. Its contributions include integration of environmental law principles into the reparations process; use of advanced techniques for assessment of environmental damage; and use of a multilateral process in a way that balanced confidentiality and transparency. The UNCC environmental programme, viewed as an innovative approach to justice after war, highlights the contribution that the environmental integrity norm can make.

Communication requires interdependent functioning of large portions of the brain, and damage to any of these systems can disrupt effective and appropriate communication. Damage to the right hemisphere or basal ganglia can result in difficulty using or understanding prosodic contours in speech. Prosody includes pitch, loudness, rate, and voice quality, and is used to convey emotional connotation or linguistic intent. A disorder in the comprehension or production of prosody is known as aprosodia; affective aprosodia is a specific deficit affecting emotional or affective prosodic contours. The right hemisphere has been shown to play a critical role in processing emotional prosody and aprosodia syndromes resulting from damage to right hemisphere areas have been proposed. These include an expressive aprosodia resulting from anterior damage and a receptive aprosodia resulting from more posterior damage. Assessment and diagnosis of aprosodia in clinical settings are often perceptually based; however, acoustic analyses of means and ranges of frequency, intensity, and rate provide an instrumented analysis of prosody production. The treatment of aprosodia following stroke has received scant attention in comparison to other disorders of communication, although a few studies investigating cognitive–linguistic and imitative treatments have reported some positive results.

If a party does not pay a sum of money when it falls due, Art 7.4.9 stipulates that the aggrieved party is entitled to interest upon that sum from the time when payment is due to the time of payment whether or not the non-payment is excused. The aggrieved party is entitled to additional damages if the non-payment caused it a greater harm. This commentary explains how the rate of interest is determined as well as the burden of proof relating to the rate at which interest is payable.

This commentary analyses Article 7.4.13 of the UNIDROIT Principles of International Commercial Contracts (PICC) concerning the agreed payment for non-performance. Art 7.4.13 applies where a term of the contract provides that ‘a party who does not perform is to pay a specified sum to the aggrieved party for such non-performance’. According to Art 7.4.13, the aggrieved party is entitled to recover the specified sum from the non-performing party and it can do so irrespective of the harm which it has in fact suffered as a result of the non-performance. However, the specified sum may be reduced to a reasonable amount where it is grossly excessive in relation to the harm resulting from the non-performance and to the other circumstances. This commentary discusses the scope of Art 7.4.13 and the burden of proof relating to payment for non-performance.

Replacement-cost damages are based on the difference between the contract price and the actual or imputed cost of a replacement transaction. Resale-price damages are based on the difference between the contract price payable by a breaching buyer and the price the seller received on resale to a third party. Diminished-value damages are based on the difference between the value of the performance that a breaching seller rendered and the value of the performance that she promised to render. Lost-profit damages are based on the difference between the price a breaching buyer agreed to pay and the seller’s variable costs.

Reactive oxygen and nitrogen species, ROS and RNS, are ubiquitous in living cells. They have beneficial effects but are also the cause of a wide variety of diseases. However adding excessive amounts of reducing agents has a long history of clinical failure. This problem can be overcome by providing a novel ester of D-beta-hydroxybutyrate–R-1,3-butanediol, which is rapidly hydrolyzed to ketone bodies, the metabolism of which leads to the production of NADPH. The free cytosolic [NADP+]/[NADPH] redox potential is the most negative in the cell and sets the potential of the glutathione and ascorbic acid couples. Ketone bodies also act by inhibiting histone deacetylases, activating the transcription factor FOXO3 and increasing the transcription of enzymes involved in the destruction of ROS. Ketone esters would be effective in the treatment of a variety of disparate diseases where ROS play a role, ranging from Parkinson’s disease to radiation sickness and aging.

Longhorn Beetles — Cerambycidae are one of the most easily recognised groups of beetles, a family that worldwide encompasses over 33 000 species in 5200 genera. With over 1400 species classified in 300 genera, this is the sixth largest among 117 beetle families in Australia. These beetles often attack and kill living forest or orchard trees and develop in construction timber (like the European House borer, introduced to WA), causing serious damage. Virtually all Cerambycidae feed on living or dead plant tissues and play a significant role in all terrestrial environments where plants are found. Larvae often utilise damaged or dead trees for their development, and through feeding on rotten wood form an important element of the saproxylic fauna, speeding energy circulation in these habitats. Many species are listed as quarantine pests because of their destructive role to the timber industry. This second of three volumes on Australian Longhorn Beetles covers the taxonomy of genera of the Cerambycinae, with comments on natural history and morphology. One hundred and forty-two Cerambycinae genera are diagnosed and described, an illustrated key to their identification is provided, and images illustrate representatives of genera and of actual type specimens. Axial spondyloarthritis is associated with different types of skeletal damage. Inflammation at the affected sites is linked with both loss of trabecular bone and new bone formation on the cortical side, potentially leading to joint or spine ankylosis. Both aspects of the disease can result in a significant burden for the patient. Bone loss is directly linked to proinflammatory cytokines and activation of osteoclasts. Control of inflammation is therefore the best strategy to prevent loss of bone. The nature of the new bone formation process is less defined. A prominent role for developmental signalling pathways has been proposed. Current therapies have limited or no impact on this process. However, emerging data suggest that early control of disease activity may be part of a window of opportunity to prevent structural damage, as biomechanical factors and instability following inflammation may also play a role.

Imaging techniques play a key role in the assessment of patients with the idiopathic inflammatory myopathies (IIM). Magnetic resonance imaging (MRI) can reveal muscle inflammation similarly to muscle scintigraphy and 18F-Fluorodeoxyglucose positron emission tomography, but is also able to visualize findings of chronic muscle damage such as muscle atrophy or fat replacement. Ultrasonography has a more limited role because it can only depict the superficial muscle layers. Imaging findings are not specific to IIM, but in the appropriate clinical context they support the diagnosis. MRI is also useful to target biopsy to affected muscles, thus increasing biopsy yield. In addition, because different myopathies present with different patterns of muscle involvement, imaging studies can provide differential diagnostic clues. Finally, imaging studies—especially MRI—can be used to monitor the effects of treatment by serially evaluating changes in muscle inflammation and damage.

Psoriatic arthritis is a chronic inflammatory joint disease that can affect both the peripheral and axial skeleton. The clinical presentation of psoriatic arthritis is very heterogeneous and different subforms have been described. Structural damage to the joint is a feared complication of psoriatic arthritis. The severity of joint inflammation and subsequent damage can range from mild to extreme. Over the last decade, insights into the molecular and cellular mechanisms that underlie the skeletal changes in psoriatic arthritis have gradually increased although translational validation of concepts using patient-derived materials still lags behind. Current treatment strategies directed against key mediators of inflammation appear to have good effects on joint destruction, but their short and long-term impact on new bone formation and ankylosis is still unclear. The identification of the role that key growth factors play in the latter process identifies new opportunities for therapeutic interventions.

Since physical education (PE) classes are often obligatory, the number of injuries sustained during physical education classes is high. The most frequently reported type of injury in PE classes changes as children grow older. Young children (under 12 years of age) most often injure their wrist and elbow, while the incidence of injuries in older children (over 12 years of age) is highest in the hand and ankle. PE classes containing activities like gymnastics and ball games result in the most damage, and PE teachers must play a key role in the prevention of PE-related injuries. PE teachers are responsible for creating a safe environment for sports and play, not only by ensuring that protective devices are used properly, but that equipment is in good order. They should also modify rules as well as screen their pupils for any physical limitations.

Mary Zimmerman’s dramatic adaptation of the Metamorphoses (1998) follows the staging of the Odyssey and represents a further instance of her ongoing engagement with the classical world. By filtering the Ovidian myths through a network of allusions (to Rilke, Jung, and Freud, among others) she reminds her audiences of the consolidation of classical myth within the Western tradition. At the same time she uses the play to meditate upon issues such as unbridled greed and capitalism, anorexia, and emotionally damaged ‘rich kids’. Her play is also underpinned by a profound sense of loss and grief. The innate sorrow of the play was heightened still further when audiences came to watch it after the 9/11 attacks, and their response to the play was informed by the horrors and deaths that they had experienced within their own communities.

The perception of pain is a biological mechanism which warns that damage has occurred and protects against further damage, allowing healing to occur. Acute pain often acts as an indicator of injury severity and progression or healing. The same may apply in some with chronic injuries, but in others pain may not correlate with tissue damage and/or may not be a sign that the tissue needs to be protected from mechanical stress. The management of most sports injuries involves early mobilization where possible, and pain management in the treatment of these injuries is important to allow rehabilitation to proceed and to ease distress. Modalities play an important role in this respect, and are discussed elsewhere (Chapter 2.4). Injection therapies are also discussed elsewhere (Chapter 2.6). Thorough counselling of the athlete is a priority to ensure that he/she understands what the pain represents, as this will be likely to affect compliance. For example, a degree of pain during eccentric exercise protocols in the rehabilitation of chronic tendinopathies would be anticipated, and would not contraindicate continuation of a set programme. In contrast, when an athlete is returning to sporting activities after injury, pain that is experienced during the activity would not be acceptable, and the athlete is also advised during this period that conclusions as to the tissue’s reaction to activity should not be drawn until the day after the training session. Athletes should also be taught appropriate self-help strategies to manage their pain and when this involves medication, how and when to take it. Neuroinflammation has long been associated with many neurodegenerative diseases (NDDs). Immune-related genetic and environmental risk factors have recently been identified for NDDs, suggesting that neuroinflammation can play an active role in modifying NDD pathologies. Immune cells that underlie this neuroinflammatory response can have both beneficial and detrimental roles in NDDs. These cells can engage in clearance of debris and provide important survival factors to neighboring neurons. However, these cells can also release inflammatory molecules that promote oxidative stress and excitotoxic damage in surrounding neurons, and aberrantly clear healthy cells and structures from the brain. In turn, the cells within the brain play important roles in determining the phenotype and function of these immune cells, and changes in the interaction among these cells in the context of disease can lead to detrimental immune cell activation. There has been recent interest in developing inflammation-related biomarkers to help diagnose NDDs and immune-targeted therapeutics.

The motor cortex can be seen as a topographic map of the movable body parts, and damage to the cortex or pathways produces correspondingly localized paralysis. However, there are a great many other pathways that link other areas of the cortex to parts of the brain active in the control of movements. These still play a puzzling role in the standard model where the control of movements focuses on cortical contributions to voluntary movements by the corticospinal pathways.

The language and communication impairments that individuals experience following damage to the cerebral cortex vary widely, depending on the extent of involvement and location in the left or right hemisphere. Historically, numerous aphasia syndromes have been described, typically following left hemisphere damage, each with unique characteristics. Other subtle aspects of communication are disrupted in right hemisphere disorders as well. Clinicians who work with individuals with communication disorders recognize patterns of symptoms, administer appropriate assessments, and develop interventions to address the language and communication impairments. Recognized authors from around the world review the extensive literature on the varied aphasia syndromes, acquired dyslexia and dysgraphia, and right hemisphere communication disorders. Starting with a rich historical overview, the book turns to broad perspectives from the World Health Organization model applied in clinical assessment of aphasia. A series of chapters expands on the aphasia syndromes, dyslexia and dysgraphia, and right hemisphere disorders, weaving theoretical perspectives and building neurological foundations that lead to sound clinical approaches to assessment and intervention intended to maximize recovery of language and communication following acquired brain injury. Empirical research apparently suggests that emotions play an integral role in moral judgment. The evidence for sentimentalism is diverse, but it is rather weak and has generally been overblown. There is no evidence that our moral concepts themselves are partly composed of or necessarily dependent on emotions. While the moral/conventional distinction may partly characterize the essence of moral judgment, moral norms needn’t be backed by affect in order to transcend convention. Priming people with incidental emotions like disgust doesn’t make them moralize actions. Finally, moral judgment can only be somewhat impaired by damage to areas of the brain that are generally associated with emotional processing (as in acquired sociopathy and frontotemporal dementia). While psychopaths exhibit both emotional and rational deficits, the latter alone can explain any minor defects in moral cognition.

Armed conflict is inherently destructive of the environment. It can cause serious and irreversible damage and threaten the health and livelihoods of individuals and the planet as a whole. International environmental law (IEL) cannot and is not relegated to peacetime, but continues to apply and interact with international humanitarian law (IHL). Therefore, principles of IEL must play a role before, during, and after conflict. This chapter focuses on general principles of IEL, specifically intergenerational equity and the precautionary principle. It demonstrates that these principles can and should be used to interpret and apply existing IHL for civilian and environmental protection. It concludes with a look at peace agreements and truth commissions, arguing that despite limitations of their past use they can provide fertile ground for building sustainable peace.

The penalty shall be paid to the aggrieved party unless mandatory provisions of the law of the forum provide otherwise. Payment of the penalty to the aggrieved party does not exclude any claim for damages. This commentary explains judicial penalty and the court's discretionary power to determine whether or not to impose a judicial penalty, and mandatory provisions with regard to the beneficiary.
