Abstract:
Intellectual property affects an increasingly large range of social life. Despite the breadth of goods and activities affected by intellectual property schemas, policy-makers, legislators, jurists and even many social theorists have a narrow understanding of the basis for instituting intellectual property rights and understanding their limits: most see intellectual property rights only as a means to create more intellectual goods in society. My dissertation argues that our intellectual property schemas and policies need to be more sensitive to the diversity of values involved in the social meanings of different intellectual goods and activities. Contrary to those who claim that "information wants to be free," I defend a property-based approach to the protection and regulation of intellectual goods. I argue that intellectual property schemas need to do a better job responding to the diversity of value that characterizes intellectual activities and goods. Finally, I argue that context is an important tool for marking out which values are to be promoted in different circumstances and communities.

Abstract:
Classification systems constitute important tools within the field of knowledge organisation. The following bachelor thesis addresses Dewey Decimal Classification (DDC) and discusses the potential of bias in the religion class. Prior to this essay, DDC has been criticised for its biased representations, and for conveying an ethnocentric conception of the world. In this era of globalization, there is a want of classification systems that reflect multicultural societies – in other words, classification systems that consist of pluralistic (world)views. This thesis focuses on the 200’s of DDC, with the purpose of illuminating the degree of religious pluralism therein; more specifically, the thesis answers the following questions: 1) what discourse(s) dominates the religion section of DDC 23?, and 2) which groups and perspectives are being marginalized as a consequence of the dominating discourse(s) within the religion section of DDC 23? In order to answer the questions stated above, the analysis is carried out by means of the theoretical framework by Ernesto Laclau and Chantal Mouffe regarding discourses. In addition to the discourse analysis, a quantitative content analysis is also performed. This mixed methods approach outlines the frequencies and discursive formations of terms occurring in the 200’s, and accordingly generates the following implications: 1) the religion section of DDC 23 is dominated by a Christian discourse, and 2) the groups and perspectives that are being marginalized consists of all religions other than Christianity. Hence, the degree of pluralism within the religion section of DDC 23 is considered to be low.

Mais, vu le dynamisme politique spécifique de l’ère coloniale dans ce pays, nous aborderons également cette période car elle peut nous aider à mieux comprendre l’avènement « précoce » du multipartisme au Sénégal par rapport au reste de l'Afrique, ou du moins d'une bonne partie du continent. Car c’est à partir de cette période que le droit de vote est apparu au Sénégal. Puis à l’indépendance, la situation médiatique va connaître d’importants bouleversements, avec l’apparition des partis uniques et de ce que Mor Faye appelle le « journalisme institutionnel des comptes rendus ». La rupture avec le pluralisme politique, provoquée par la crise de 1962 qui signe la fin de l’exécutif bicéphale au Sénégal, va peu à peu réduire la liberté d’opinion jusqu’à mettre en place un journal unique, une presse d’État. C’est avec la création d’une loi sur la presse en 1979 et le multipartisme naissant ou renaissant, que commencent à s’enraciner les bases du pluralisme médiatique qui va, au fur et à mesure que le pays se démocratise, révolutionner le discours politique et bouleverser le monisme idéologique. C’est ainsi qu’au début des années 1990 se développe, au Sénégal et dans de nombreux pays africains francophones, une sorte de « médiactivisme » qui jouera un rôle déterminant dans la remise en cause des informations diffusées par la presse d’État. Cependant, le développement du pluralisme de la presse au Sénégal soulève, surtout à partir de l’alternance politique en 2000 portant Abdoulaye Wade à la tête du pays, d’énormes interrogations relatives aux pratiques journalistiques et à l’esprit de responsabilité nécessaire pour exercer ce métier
This thesis looks back on the political and media history of Senegal from independence to the present. However, given the specific political dynamism of the colonial era in this country, we will also discuss this period because it can help us better understand the coming "early" multiparty in Senegal compared to the rest of Africa, or unless much of the continent. Since it is from this period that the voting appeared to Senegal. And after independence, the media situation will undergo significant changes, with the emergence of single parti system and what Mor Faye calls "institutional journalism of reviews." The break with political pluralism, caused by the 1962 crisis marks the end of the two-headed executive in Senegal, that will gradually reduce the freedom of opinion to impose a single newspaper, a State press. With the creation of a press law in 1979 and the nascent or reborn multiparty, start to root the basics of media pluralism that will, as and as the country becomes more democratic, revolutionize speech political and ideological monism upset. Thus developed in the early 1990s, in Senegal and in many French-speaking African countries, a form of "médiactivisme" which will play a key role in the questioning of the information published by state media. However, the development of pluralism of the press in Senegal raises, especially after the political change in 2000 Abdoulaye Wade to lead the country, huge questions on journalistic practices and spirit of responsibility necessary to exercise this job

Existant depuis une vingtaine d’années, l’avènement de la presse gabonaise en ligne se présente aujourd’hui comme une source d’information alternative aux médias traditionnels. Dans un système médiatique où la liberté de la presse rencontre encore plusieurs obstacles du fait d’une démocratie balbutiante, les médias numériques gabonais posent à nouveau frais la question du pluralisme de l’information. En période électorale, le rôle de la presse en tant qu’élément de la démocratie mettant en exergue le principe de la contradiction des opinions et de la représentativité médiatique des différences politiques est encore plus souhaité. Et c’est à ce niveau que nous interrogeons la pertinence des médias natifs du web gabonais sur la plus-value de leurs informations en temps d’élection et comparativement à l’existant avec la presse traditionnelle. Analyser les conditions de production des informations de la presse gabonaise en ligne dans une période sensible comme celle des législatives de 2018 au Gabon, et déterminer le niveau de pluralisme informationnel qui en découle est l’objectif principal de notre travail de recherche
For about two decades now, the emergence of online Gabonese press stands nowadays as an alternative source of information to traditional media. In a media system where press freedom still faces numerous obstacles due to a fledgling democracy, Gabonese digital media once again raises the question of information pluralism. During electoral periods, the role of the press as an element of democracy highlighting the principle of conflicting opinions and the media representation of political differences is even more desired. And it is at this level that we question the relevance of native Gabonese web media in terms of the added value of their information during elections compared to what exists with the traditional press. Analyzing the conditions of information production by the Gabonese online press during a period as sensitive as the 2018 legislative elections in Gabon and determining the level of informational pluralism resulting from it is the main objective of our research work

Freedom of speech as a basic right is the starting point of the article. The Inter-American legal framework contributes pondering on the importance plurality and the vast array of information have in the validity of this right and democracy in general. This consideration is done from the standards given by the Commission reports and the Inter-American Court of Human Rights case law. The article ponders on how and how much the exercise of freedom of speech right is affected by the excessive concentrationof personal property and control over the media.
El artículo toma como punto de partida que la libertad de expresión forma parte del corpus de derechos fundamentales que el marco jurídico interamericano para reflexionar sobre la importancia de la pluralidad y la diversidad de la información tienen para la vigencia de este derecho y de la democracia en general. Esta reflexión se realiza a partir de los estándares construidos por los informes de la Comisión y la jurisprudencia de la Corte interamericanas. El texto reflexiona sobre cuánto y cómo afecta, al pleno ejercicio de la libertad de expresión, la excesiva concentración de la propiedad privada y del control de los medios de comunicación.

L'objectif de la recherche est de mettre à l'épreuve une conception pluraliste du fonctionnement et du développement cognitifs. L'exemple choisi est celui de la genèse de la conservation. On rappelle, tout d'abord, les conceptions "unitaires" de la conservation. On présente ensuite une analyse critique de deux controverses : celle qui a opposé Piaget et Bruner sur la nature du processus en jeu dans la résolution des épreuves de conservation ; celle qui surgit à propos d'un décalage génétique postule entre conservation de l'identité et conservation de l'équivalence. Un bilan de ces controverses conduit à postuler deux modes de traitement différents : une analyse des dimensions perceptibles du changement de forme de l'objet et un processus de généralisation fonde sur l'identité qualitative de l'objet. Un modèle pluraliste de la conservation est proposé. Il prévoit que les deux processus peuvent intervenir simultanément, dans le jugement des sujets, mais avec des pondérations différentes selon les sujets et selon les situations. Il suppose, en outre, que l'une des sources du développement réside dans la dynamique du système qui peut être enclenchée lorsque des processus différents entrent en interaction. La contribution expérimentale est composée de sept expériences. Les deux premières vérifient que la conception de Bruner présente une alternative plausible au modèle propose par Piaget. La troisième est une étude longitudinale dont les résultats confirment l'hypothèse de cheminements différents dans le développement de la conservation. Les trois expériences suivantes mettent à l'épreuve l'hypothèse d'une interaction entre les traitements dimensionnels et identité. Deux paradigmes différents sont utilisés. Le premier s'inspire de la théorie de l'intégration de l'information de N. Anderson ; le second utilise une situation de double-tache ou l'épreuve de conservation tient lieu de tache interférente. Les résultats de ces expériences montrent que les jugements des sujets nonconservants sont susceptibles de varier selon le jeu des pondérations entre les deux modes de traitement de l'information. La dernière expérience tend à montrer que l'incertitude du jugement de conservation augmente lorsque la compétition entre les deux modes de traitement de l'information est importante. L'ensemble des résultats est discuté par référence à deux interprétations concurrentes
This research examines a pluralistic approach to cognitive functioning and development. The development of conservation of quantity is used as a test case. First, the "unitary" models of conservation are discussed. Then a critical analysis of two historical controversies follows : one controversy focuses on the nature of the process involved in conservation tasks, and the other focuses on the postulated decalage between identity conservation and equivalence conservation. A synthesis of these controversies leads to two hypothesized information processing modes : (a) an analysis of the object's dimensions that are subject to change and (b) a generalization process based on the object's qualitative identity. A pluralistic model of the development of conservation is proposed. This model states that both processes can be activated simultaneously when subjects make conservation judgments ; however, these processes are activated with different weights for different individuals and for different situations. It is also assumed that one source of cognitive development could be a selforganizing dynamic which is engaged when different processes interact. Seven experiments were conducted. The first three experiments confirm that Bruner's theory is a viable alternative to the Piagetian one. The third experiment is a longitudinal study which shows different pathways for different individuals during the development of conservation. Three further experiments address the issue of interaction between information processing modes. Two different paradigms are used. The first is inspired by N. Anderson's information integration theory ; the second is a dual-task paradigm in which conservation is the interfering task. The results show that nonconserving subjects'judgments tend to vary with the weights given to the two information processing modes described above. The last experiment shows that the uncertainty of judgments increases when competition between both information processing modes is substantial. Possible theoretical interpretations of the results are discussed

El propósito de esta investigación es realizar un análisis acerca de las normas relativas a la propiedad y concentración de los medios de comunicación en Chile. A partir de esto, se busca determinar si existe una obligación estatal de garantizar el pluralismo en el mercado informativo, emparentada con un respectivo reconocimiento constitucional de lo que se denomina “libertad de información”. El trabajo se estructura, en primer lugar, con un marco conceptual que busca concretizar ciertos conceptos usados a lo largo del trabajo, en especial el de “libertad de información” y “pluralismo”. Se procede luego al análisis crítico de diversas normas que se relacionan con tales conceptos, como la Constitución de 1980, la Ley Nº19.733 y el Decreto Ley Nº211. Por último, se esboza el estado de la concentración de los medios de comunicación en el país y sus consecuencias.

Notre recherche part d'un constat : les formations en information et/ou communication transmettent, à travers leurs programmes, des savoirs pluriels. Elles reflètent l'image d'un cadre disciplinaire aux contours imprécis, tant d'un point de vue théorique que de celui des professions auxquelles elles préparent. Notre travail s'articule en trois parties. Après développement de la problématique de recherche, une première partie présente les fondements législatifs et institutionnels de la formation, a travers l'enseignement universitaire et la formation professionnelle continue. Une seconde partie retrace l'évolution historique des sciences de l'information et de la communication, pour en dégager les modelés explicatifs fondateurs et les perspectives théoriques actuelles. Enfin, une troisième partie se consacre a l'analyse des programmes de formation, dont sont extraites les orientations et tendances récurrentes. L’objectif général est de montrer que le champ de l'information - communication est un objet de recherche et d'enseignement interdisciplinaire et transversal, qui conjugue logique des savoirs et logique des pratiques.

From  the  process  of  globalization  of  law,  the  comparative constitutional law has gained a leading role for a better understanding and solving old and new constitutional national and international challenges. Therefore, some assumptions and considerations to take into account are presented for the development of the national constitutional order within the framework of the comparative constitutional law, such as universality and relativism of human rights; the concept of power and constitutional democracy; standards of free elections and judicial independence; freedom of expression, media pluralism and access to public information; the economic,social and cultural rights; the new fundamental rights.

Abstract:
This thesis investigates whether institutional journalism should receive special treatment at the hands of the law. Special treatment encompasses the affording of benefits to and the imposition of liabilities on journalistic institutions and the individuals who work for them. The arguments against special treatment are pragmatic and theoretical: pragmatic arguments emphasise, inter alia, the difficulty of providing a definition of journalism, and theoretical arguments emphasise the difficulty in explaining why special treatment can be coherent. The former can be addressed by describing how special treatment is already afforded to institutional journalism, both liabilities and benefits, to individuals and institutions, and showing that some of the problems foreseen by the pragmatic arguments have not proved as difficult as they appear. The arguments that special treatment is incoherent can be addressed by arguing that the credibility and assessability of institutional journalism still provide a prima facie rationale for special treatment irrespective of the rise of public speech on the Internet, when combined with the integral nature of journalism to democracy. Two basic arguments are advanced why this is so. The first, the free speech values argument, is a consequentialist account that holds that special treatment is appropriate when (or because) institutional journalism contributes to free speech values. It is attractive, but presents difficulties, both when considered in the abstract and when applied to the free speech value of democracy. The second, a rights-based argument, based on the notion that freedoms of speech and of the Press are distinguishable, can be based on either on Dworkin’s theory of rights as trumps or Raz’s theory of rights as interests. Raz’s account is preferable, as it complements the free speech values thesis in explaining the coherence of special treatment.

This thesis explores the variable behavior of bare nouns in Persian. Bare singular nouns realize different grammatical functions, including subject, object and indirect object. They receive different interpretations, including generic, definite and existential readings. However, the task of understanding the reasons for, and limits on, this variation cannot be achieved without understanding a number of pivotal features of Persian sentential architecture, including Information Structure, prosody, word order, and the functions of various morphological markers in Persian. After a brief introduction, chapters 2-3 deal with bare noun objects, firstly comparing them with nominals marked with indefinite morpheme -i suffixed to the noun, and the determiner yek. A bare noun object differs from morphologically marked nominals as it shows properties associated with noun incorporation in the literature (chapter 2). Of particular interest are the discourse properties of these ‘quasi-incorporated’ nominals. With respect to the discourse transparency of Incorporated Nominals, Persian belongs to the class of discourse opaque languages within Mithun’s classification (1984). However, under certain circumstances, Persian bare nouns show discourse transparency. These circumstances are examined in chapter 3, and it is proposed that bare nouns do introduce a number neutral discourse referent. There are no overt anaphoric expressions that could match such number-neutral antecedents in Persian. But covert anaphora lack number features, and hence can serve as means to pick up a number-neutral discourse referent. Also, in case world knowledge tells us that the number-neutral discourse referent is anchored to an atomic entity or to a collection, then an overt singular pronoun or an overt plural pronoun might fit the combined linguistic and conceptual requirements, and may be used to pick up the number-neutral discourse referent. This proposal is phrased within Discourse Representation Theory. In the second half of the dissertation, the interpretation of bare nouns in different positions and with different grammatical functions are discussed. Under the independently supported hypothesis of position>interpretation mapping developed by Diesing (1992), we will see the role of the suffix -ra in indicating that an object has been moved out of VP. Following Diesing, I assume that VP-internal variables are subject to an operation of Existential Closure. In many cases, VP-external –ra-marked objects have a different interpretation to their VP-internal, non-ra-marked, counterparts, because of escaping Existential Closure. For subjects, there is no morphological marking corresponding to –ra on objects, and we have to rely on prosody and word order to determine how a VP is interpreted using theories of the interaction of accent and syntactic structure. We assume that VP-internal subjects exist, under two independent but converging assumptions. The first is prosodic in nature: Subjects can be accented without being narrowly focused; theories of Persian prosody predict then that there is a maximal constituent that contains both the subject and the verb as its head. The second is semantic in nature: Bare nouns require an external existential closure operation to be interpreted existentially, and we have to assume existential closure over the VP for our analysis of the interpretation of objects. So, this existential closure would provide the necessary quantificational force for bare noun subjects as well. It is proposed that both subject and object originate within the VP, and can move out to the VP-external domain. The motivation for these movements are informational-structural in nature, relating in particular to the distinctions between given and new information, and default and non-default information structure.

Risk assessment plays the main role in decision making under risk. Global financial turmoil in 2008 provides us an opportunity to re-examine the nature of investment risk. Under the umbrella of cognitive psychology, cognition bias may be resulted from the differences of experiences and communication means. Hence, in order to catch the whole picture of investment risk we should assess it from pluralistic perspectives. This study surveyed the relevant literatures and identified various natures of investment risk measures. Moreover, a hierarchical risk indicators system was constructed by classifying and coding them. Finally, to be free from the cognition bias and misuse the metadata of the system was also appended.
