Abstract:
This anthology deals with the legal and ethical challenges regarding personalized (precision) medicine and healthcare. It can also be regarded as the final report of a research project on the legal and ethical aspects of personalized medicine. It complements the reported results of the consortium ‘Personalised medicine to predict and prevent Type 1 Diabetes (P4 Diabetes)’ which were briefly presented in the booklet entitled ‘Better, Smarter, Now: Personalised Health – From Genes to Society (pHealth)’, Academy of Finland, Helsinki 2019. The articles of this anthology are not limited to the aspects of predicting and preventing Type 1 Diabetes only, as the name of the consortium would suggest. The list of participating researchers indicates that many-sided medical expertise was represented in the consortium and, in addition, computational data analysis as well as legal and ethical issues were covered by the participating sites of research. A comprehensive examination of the issues of personalized medicine requires multidisciplinary approaches. In this anthology, the legally and ethically oriented mainstream of writings has been complemented with an article of a computer scientist in order to recognize the possibilities and challenges of machine learning when interpreting the patient’s need for help. It is our hope that this anthology would be useful both for the academic community and for the decision-makers in the fields of healthcare and (personalized) medicine. It is also advisable that the anthology would give an impetus for further research activity in these new spheres of medical law and biolaw.

Abstract:
What is the role of civil society and activists in defining and defending the collective good in healthcare, especially in cases where that good seems to be heavily shaped by market dynamics? Presenting conceptual and empirical studies from a variety of healthcare contexts and theoretical perspectives, this book volume addresses this vital question by drawing together multi-disciplinary scholarship from science and technology studies, sociology, organization studies, marketing, and public health. The volume maps three major changes in healthcare over the past decades: the advent of personalized medicine, the marketization of public care systems, and the digitalization of healthcare services. It illustrates the extent to which these are interlinked to produce a seemingly unstoppable move toward individualization in healthcare, highlights the tensions and challenges arising from these interlinkages, and traces how activists react to these tensions to argue for and defend the common good. The volume thus sketches a multi-faceted picture of healthcare activism in the twenty-first century as civil society responds to these dynamics at the crossroads of markets and morals, economic and social justifications, individual and collective, and digital and non-digital worlds. Importantly, the volume also starts to sketch potential solutions for heightening patient voices and broadening participation in healthcare markets in a post-Covid-19 world.

This chapter focuses on the platformization of the health sector. A burgeoning field of online health platforms has emerged, ranging from personal fitness apps to medical platforms that are used by patients, doctors, and researchers. A global industry of health-related platforms is being stacked onto, and interwoven with, the infrastructural core of the ecosystem; developing sectoral health platforms is a potentially lucrative and data-rich area that major operators are keen to invest in. Examining health platforms, the chapter unravels a peculiar double-edged logic in how their benefit is argued: they offer personalized data-driven services to their customers, while simultaneously serving an overarching public interest in medical research, the outcomes of which ostensibly benefit everyone. Using the platform mechanisms as an analytical prism, the chapter scrutinizes three single platforms, which are illustrative of the health sector: 23andMe, PatientsLikeMe, and Parkinson mPower.
