Abstract:
Injury from personal watercraft has continued to increase. Prior attempts to delineate patterns of injury and relative frequencies have yielded varied results. We retrospectively reviewed Trauma Registry data and charts of all patients who suffered personal watercraft injury treated at the R. Adams Cowley Shock Trauma Center between August 1996 and January 2001. Patient demographics included mechanism of injury, injuries sustained, and outcomes. Attempts were made to correlate events around the injury and injury pattern. During the study period 24 patients were treated. Mechanisms consisted of direct collision, fails from the watercraft, handlebar straddle injuries, axial loading, and hydrostatic jet injury. Traumatic brain injury was most common occurring in 54 per cent of patients. Spinal injury was also common occurring in 29 per cent of patients. Axial loading from falls while wave jumping seemed to correlate with skeletal injury. Thoracolumbar spine injury were often skeletally unstable requiring either brace or operative fixation. Inexperience and reckless behavior were found to be the greatest contributing factors. Substance abuse did not influence injury.

AbstractAttempts to develop a better understanding of the interaction between the compensation environment and injured workers suggest that the compensation environment may negatively impact on the psychological wellbeing of injured workers. This study offers a complementary perspective to contemporary quantitative studies exploring the psychosocial aspects of workplace injury and disability, and contributes to the growing body of qualitative data on the interaction of personal and environmental factors influencing recovery from work injury. The beliefs and experience of injured workers, as explored through ethnographic interviewing, offer insight to the social meaning and relationships comprised in the compensation environment and reveal the pervasive impact of workplace injury across personal, social and occupational spheres. Poor claims administration and hostile interpersonal interactions are identified as particular sources of frustration and discontent for injured workers. Strong themes of perceived injustice emerge as a potentially valuable area for future research in improving the outcomes of compensable injury.

Abstract:
From within the law school, group personal injury litigation may be approached in various ways. Until very recently it was, indeed, ignored as an irrelevant foreign development: not perhaps ‘it could never happen here’, but at least ‘it hasn’t happened here, yet’. Now that it plainly has happened, it is nonetheless possible to ignore it. The question whether the snail in my ginger beer bottle can give rise to an action is not, in principle, affected by what other people found when they opened theirs; if it is said that in practice it cannot but be affected, the retort would be that the law schools need not concern themselves with the sort of practicalities involved. Indeed, group litigation barely rates a mention in most practitioners’ texts either; so many academics feel excused from considering it all, even as a mere footnote to the general run of cases.
