Full textIn France, since 2016, introduction to computer programming has been included in compulsory school curricula. The objective of this thesis is to understand the conceptualization process when solving programming puzzles by subjects aged 7 to 15 years old. To this end, we combine the respective contributions of conceptual field theory (Vergnaud, 1991) and the analysis of pupils activity in a TEL environment. We focus on the concept of pattern, in particular during the first confrontations with the loop notion in block programming. We define a pattern as “an entity identifiable within a set because it is repeated identically or with predictable variations” and highlight the essential place of this concept when initiating algorithmic thinking. The didactic approach adopted aims to position the concept of pattern within a conceptual field of basic notions of algorithms, a conceptual field which has as its scope imperative programming in Scratch language at compulsory school level. Within this conceptual field, we deepen the study of programming situations of a virtual robot on a grid which require the use of a loop. Our experimental protocol is backed by the Algoréa online programming competition. We are building methodological tools including a data collection device at three scales, statistical analyzes on large samples, automation of the processing of interaction traces with the EIAH, and qualitative analyzes of screen video recordings. This methodological tool, which makes it possible to combine the precision of qualitative analyzes and statistical robustness, constitutes one of the contributions of this thesis. With this approach, we first carry out an instrumental study of the TEL environmentas defined by Rabardel (1995). Its goal is to distinguish what, in the activity, relates to conceptual mastery and what relates to instrumental mastery of a particular programming environment. We then focus on conceptualization-in-act in the sense of Vergnaud(1991). We identify the schemes implemented by the subject during the programming activity studied, in particular the underlying operational invariants. Our analyzes allow us to identify and document levels of difficulty and recurring errors during the first learning of the loop. One of our research perspectives is to reproduce this approach to carry out investigations on all the concepts covered during the introduction to computer programming at compulsory school level. These results constitute a contribution likely to help elementary and middle school teachers to support their pupils and help them overcome the difficulties encountered when learning fundamental concepts of algorithms

Full textThe goal of this work is to value the philosophical importance of computer science and artificial intelligence, by studying the relations between machine and thought. The arguments raised for and against mechanism in the contemporary philosophy are examined successively. In this case, the theses of mechanical philosophy are based on computer science and on artificial intelligence. According to the strongest of these theses, a machine can think and a mechanical model of thought using ideas in computer science can be designed. With regard to artificial intelligence, the two main points examined are the following : fist, what can be expected from the progress made in this domain, by a philosophical investigation of the relations between machine and thought ? Second, is the parallel often drawn between philosophers as descartes, hobbes, leigniz or la mettrie on the one hand, and the representation of mind according to artificial intelligence on the other hand, a valid one ? On this last point, it is argued that the answer is no. As for computer science, it raises its own questions about machine and thought, questions that are often overlooked, and ignored by the debate on mechanism and artificial intelligence, while they no less deserve philosophical examination. These questions are raised by studying the relations between logic and computer science

Full textLa tesi si propone di affrontare il problema dell'incidenza degli strumenti informatici sulle indagini penali. Dopo aver dato conto dell'emergere sul piano nazionale ed internazionale di una nuova tipologia investigativa - le indagini informatiche -, vengono esaminati i mezzi tipici di ricerca della prova informatica, mettendo in luce le peculiarità che contraddistinguono le ispezioni, le perquisizioni ed i sequestri probatori informatici, nonché l’acquisizione della c.d. copia clone e le intercettazioni informatiche o telematiche. Specifica attenzione è poi rivolta all’individuazione dei tratti comuni che sembrano caratterizzare i mezzi tipici di ricerca della prova informatica, per poi passare a esaminarne i limiti e i profili critici, anche nell’ottica del Cloud Computing. L'analisi si sofferma inoltre sulle investigazioni informatiche atipiche, di cui viene sondata la compatibilità con i diritti fondamentali. Si approfondisce poi la tematica della tendenziale irripetibilità di simili tipologie investigative atipiche e dell'applicabilità alle medesime della disciplina prevista dall’art. 189 c.p.p. Da ultimo, vengono esaminati gli strumenti di cooperazione investigativa internazionale, sia nel quadro della Convenzione del Consiglio d’Europa sulla criminalità informatica, sia in riferimento ai Paesi non firmatari della Convenzione. Chiude il lavoro una riflessione circa la possibile creazione futura di un Tribunale internazionale per i crimini informatici.

Full textI do not have a serene relationship with painting. While it creates a space for self-expression and a sense of belonging to oneself without limits, I fear the immensity of that space. Where to go? By which means? How to overcome hesitations? How to be sure to make the right decisions? Which paths to follow, which leads to explore? The practice of painting is an immersion. Within the studio and at the heart of a painter's work lie a number of unique plastic and mental processes. A dynamic is at stake, allowing a step towards new possibilities where making choices and taking risks are intertwined. There, in the tension between the unanticipated and what is tentatively determined, is where my pictorial work exists. Because of the wandering, the experiments, the breakthroughs but also the failures, I wanted to focus on the difficulties inherent to the painter’s work. What are their causes? How is the creative process impacted and what remedies can artists turn to? The hypothesis of this thesis is that computer and digital processing is a possible answer to the artist’s quest of letting go in his or her pictorial practice. If photography, film or video each have, at some point in their history, questioned their relationship to painting, what about today’s computer-assisted art? How do digital technologies and painting concurrently exist and share the artistic scene? How do they interact? In which particular ways does digital processing relieve the painter and enables a form of letting go? Admittedly, no definition of "painting" as we know it today can be exhaustive. However, we will take a look at how computers – apprehended as tools, but also as a medium for the painter – make it possible to identify the renewed, distorted, yet flagrant presence of painting within new artistic mediums and to redefine it as immaterial and dynamic. The experiments carried out in my artistic work as well as the surveys conducted with painters using computer-assisted techniques, will lead to a broader understanding of the process of letting go but also to experience the limits of the technical alliance

Full textL’ingresso, all’alba del nuovo millennio, della responsabilità penale delle persone giuridiche ha rappresentato una innovazione di non poco momento nel panorama giuridico italiano. Superato il dogma societas delinquere non potest, l’impresa diviene imputabile per i reati commessi, nel suo interesse o a suo vantaggio, da persone ad essa intranee. Altro intervento legislativo di particolare rilievo è dato dalla legge sulla criminalità informatica del 18 marzo 2008 n. 48; con essa si rinnova la disciplina dettata nei primi anni Novanta dello scorso secolo, con la l. 23 dicembre 1993 n. 547. I primi capitoli del presente lavoro mirano a coniugare le tematiche accennate, prendendo spunto dall’introduzione nel d.lgs. 8 giugno 2001 n. 231 dell’art. 24-bis, attraverso il quale la responsabilità dell’ente viene in essere laddove siano commessi crimini informatici. In particolare, delineati nel primo capitolo i profili storico-comparatistici della responsabilità “penale” dell’impresa, nel secondo capitolo viene ricostruito il complesso meccanismo di imputazione elaborato dal legislatore italiano: l’interesse o il vantaggio dell’ente derivante dal reato commesso da un “apicale”, ovvero da un “subordinato”. Segue l’analisi dei modelli di organizzazione, gestione e controllo previsti dagli artt. 6 e 7 d.lgs. n. 231 del 2001, dei quali si espongono ed esaminano la struttura e la funzione. Il terzo capitolo concerne il menzionato art. 24-bis del decreto. Premessi taluni cenni circa l’evoluzione legislativa in materia di criminalità informatica, l’attenzione si focalizza sul contenuto del dettato normativo: i reati presupposto puntualmente individuati, da un lato, e le sanzioni (e misure cautelari) previste, dall’altro lato. Il quarto ed ultimo capitolo ha ad oggetto le disposizioni processuali della l. n. 48 del 2008, con le quali si è proceduto alla tipizzazione dei mezzi di ricerca della prova digitale: ispezione, perquisizione e sequestro di dati informatici. Una innovazione di non poco conto, si diceva, la quale, tuttavia, desta talune perplessità. Poste in luce le molteplici criticità evidenziate dalla dottrina, sono suggeriti alcuni interventi correttivi, necessari per garantire la corretta elaborazione dell’evidenza digitale.
