Abstract:
The mythology of Ancient Greece and Rome has become an inexhaustible source of images, concepts, deep meanings that have received their consideration in many linguistic cultures of the world and are manifested in a special way in each of them. Scientific research analyses the concept of mentality and outlines its main features. The article attempts to record the mental traits of Ukrainians in borrowed phraseological units. The object of the analysis is phraseological units selected from dictionaries, reference books and texts of several languages. The phraseological units soar in the empyrean (have one’s head in the clouds), hurl thunderbolts, lares and penates (return to one’s hearth and home), rise like a phoenix from the ashes, etc., have been analyzed. The article is an attempt to trace such features of the Ukrainian mentality as emotionality, cordocentrysm, anteism, love of freedom, etc., through the example of the studied phraseological units. The actualization of certain ancient images, the selection of mythologists and phraseological units, their transformations, variations, and the creation of new, proper Ukrainian phrases on the basis of borrowings – all this eloquently speaks of the assimilation of ancient motifs in the Ukrainian language. The results of a free associative experiment are indicative, which has made it possible to trace the actualization of the phraseme lares and penates on the modern linguistic soil. 466 respondents aged from 16 to 33 shared their associations. All responses were combined into semantic groups with a common lexical meaning. The survey confirmed the assumption of the presence of specific mental traits of Ukrainians in the internal form of the phraseme-stimulus. The collected and analyzed material makes it possible to assert that phraseological units of ancient origin acquired ethno-national features, adapted to the modern language world model and transmit key features of Ukrainian mentality.

Abstract:
Though there are many seminal works on early Romanticism and Thomas Moore’s poetry, their hymns remain understudied. This article focuses on the genre problem in the hymns by the Lake Poets (S.T. Coleridge, W. Wordsworth, R. Southey) and Thomas Moore, whose poetry is studied in context of English Literature and German Romanticism. The characteristics of the hymn are emotionality, associative composition, abundance of repetitions and parallelisms, archaic grammatical forms of verbs and pronouns, and the use of verb contractions. The combination of genres in hymns results in such variants as the odic hymn, the idyllic and elegiac hymn, the mythological hymn, and even the satirical hymn, with each of them evolving in its own way in the period under study. The odic hymn is represented in “Hymn before Sun-rise, in the Vale of Chamouni” (1802) by S.T. Coleridge and “Hymn. For the Boatmen, as They Approach the Rapids under the Castle of Heidelberg” (1820/1822) and “To the Laborer’s Noon-Day Hymn” (1834/1835) by W. Wordsworth. These poems have such odic features as comparisons and conditional and cause-and-effect syntactic constructions. Coleridge’s hymn going back to the psalms of praise was influenced by German Romanticism, while Wordsworth’s hymns feature religious vocabulary and quotations from the Mass. The mythological hymn comes in two versions – one with idyllic features (“Hymn to the Earth” (1799, publ.1834) by S.T. Coleridge) and the mythological hymn-fragment (“Fragment of a mythological hymn to Love” (1812) by T. Moore). The fist is the translation of Stolberg’s hymn, from which the leitmotif of the Earth as the mother and the nanny of the World is borrowed. The image of the Earth has anthropomorphic features, with the marriage of the Earth and Heaven going back to W. Blake. The myth created by T. Moore is more complex. The creation of the world begins with the marriage of Love and Psyche. Love appears as the masculine principle of the Universe, while Psyche as the feminine one. The plot goes back to the ancient myths of the world creation from the Chaos and marriage of Eros and Psyche. However, T. Moore changed the myth and transformed the heroes into a source of life. “Hymn to the Penates” (1796) by R. Southey combines the idyllic, elegiac, publicistic and hymn features proper. The idyllic features are related to the image of the Penates that turn into a force controlling human lives and the souls of the dead. The childhood memories give rise to the elegiac features. The publicistic features appear in the verses of the people who do not worship the Penates. The composition, repetitions and parallelisms in the satirical “A Hymn of Welcome after the Recess” (1813) by T. Moore go back to the hymn genre; however the main stylistic devices used are irony and metonymy. Summing up, the genre of hymn in the works by the Lake Poets and Thomas Moore undergoes significant transformations, which will be further developed in late Romanism.

Los mitos de origen griego vinculados con la muerte, así como los deseos de alcanzar la inmortalidad y una nueva vida en el Más Allá a través de la eterna perduración del alma, impregnaron la imaginación religiosa romana. Con posterioridad a la muerte, el ser humano se transformaba en una serie de entidades (lemures, manes, larvae, penates, lares) de no siempre fácil identifcación. Desde la óptica romana la muerte requería una serie de honores funerarios bien establecidos para evitar la conversión del fallecido en un fantasma sin descanso y para, de ese modo, apaciguar los componentes malignos o negativos. En la antigua Roma la muerte era un acto social que, en cuanto a los lugares de inhumación, modos de celebración y cultos, no igualaba a los fallecidos, existiendo notables diferencias según la condición social o el estatus del muerto.

Abstract:
This paper provides an analysis of Aeneas' visit to the "parva Troia" in Epirus (Vergil, "Aeneid" 3.294ff.), centered on the theme of "substitutes" and "doubles," and beginning with Andromache, the heroine of this encounter. With Helenus as a substitute for her deceased husband, Hector, Andromache is involved in a sort of levirate marriage. Moreover, she reacts to Aeneas and his companions as if they too were "substitutes," living persons who immediately evoke images of the dead, "doubles" for her lost loved ones (Hector first and foremost, and also Creusa and Astyanax). This makes Andromache perfectly at home in "parva Troia", which is itself a "double," a "substitute" for the city destroyed by the Greeks. Except that, like all "doubles," "parva Troia" is an insubstantial illusion, the effigy of something that no longer exists. This city and its landscape can only be "seen," not actually "inhabited." These Trojan exiles are thus victims of a syndrome very similar to "nostalgia" (a Greek word unknown to the ancient Greeks, dating to the early eighteenth century, and beautifully described in a remarkable passage by Chateaubriand). Helenus and his companions are "too faithful" to their vanished city; their destiny, like that of the dead, has been hopelessly fulfilled. Aeneas, however, is not allowed to become a prisoner of the past. Against his will, he must be "unfaithful" to his former city: he will not rebuild Troy. The companions of Helenus and Andromache suffer from an "excess of identity" (one way to define nostalgia). Aeneas, on the other hand, submits to the almost total loss of his own identity: except for the Penates, a highly significant, sacred part of the lost patria, which will contribute to the formation of his identity in a way similar to Helenus and Andromache's own nostalgic cult of the image of Troy.

Abstract:
The article is devoted to the analysis of the hearth as the most important sacred center of Roman dwelling interior space. It addresses such issues as the role of the hearth in a Roman family’s sacra privata; peculiarities of the ritual practice of paterfamilias, materfamilias and their children. Attention is paid to the pantheon of gods related to the hearth and rituals aimed at their veneration. The relevance of this study lies in addressing the religious component of Roman living space, which, unfortunately, is not a priority for the specialists in Roman history who focus more on social aspects analysis of the space of a Roman house. Historicism and scientific objectivity principles served as a methodological basis for the research, the comparative-historical method was also used. A study of Romans’ home religion made it possible to establish that all significant events in the family were accompanied by rituals at the hearth; they also turned to it for help in the event of a threat; the hearth could warn a family of danger ‒ it could “bleed” or be “overturned”. It is important to note that the sacredness of the hearth is also confirmed by the fact that they should have bring it from home and not light a fire on the spot. The paterfamilias’ daughters and not his wife, were involved in daily rituals at the hearth, probably due to their “purity” which they kept until marriage. Research result is the partial reconstruction of family’s sacred sphere, especially ritual practice. Conducting this reconstruction is very problematic and conditionally due to the lack of sources, but it is important to note that even a partial reconstruction allows us to define the main functions of participants in ritual practice and claim that family’s sacred sphere was primarily associated with the hearth, which was the basis of the ancient Romans’ sacra privata. A busca por alternativas à prisão é antiga, e a vigilância eletrônica surgiu como uma solução tecnológica. O contexto cultural dos Estados Unidos no fim do século XX propiciou o surgimento do monitoramento eletrônico, influenciado também pelo utilitarismo e pela cultura do controle do delito. O monitoramento deve respeitar os princípios do Estado Democrático de Direito (dignidade humana) e estar vinculado aos fins preventivos da pena (prevenção especial positiva). Por si só não reduz a população carcerária e não diminui a reincidência, mas as vantagens econômicas e os bons resultados obtidos por outros países não podem ser desprezados. Assim, a experiência estrangeira revela bons resultados no uso da vigilância junto a programas de acompanhamento social. No Brasil, o monitoramento eletrônico foi introduzido por lei na execução penal e como medida cautelar. Interessante seria que fosse estabelecido como modo de execução da prisão (alternativa aos estabelecimentos penitenciários). Poderia ser previsto ainda para a execução das penas restritivas de direitos que demandam fiscalização, consolidando um sistema alternativo de penas capaz de promover a prevenção e substituir o cárcere para delitos menores. O monitoramento eletrônico restringe direitos fundamentais e, assim, deve ser previsto em lei, limitado à restrição imposta, aplicado se necessário e com a menor visibilidade possível.
The search for alternatives to prison is old, and electronic surveillance has emerged as a technological solution. The cultural context of the United States at the end of the twentieth century has propitiated the emergence of electronic monitoring, also influenced by utilitarism and by the culture of offense control. Monitoring should respect the principles of Democratic Rule of Law (human dignity) and to be linked to the preventive purposes of sentence (positive special prevention). By itself it does not decrease the prison population and it does not reduce recidivism, but the economic gains and the good results obtained by other countries can not be ignored. Thus, foreign experience shows good results in the use of surveillance along with programs of social support. In Brazil, the electronic monitoring was introduced by law in criminal enforcement and as a precautionary measure. It would be interesting if it could be established as a way of prison enforcement (alternative to prisons). It could be also expected to enforce restrictive penalties of rights that require monitoring, consolidating an alternative system of penalties that can promote prevention and replace the prison for minor offenses. The electronic monitoring restricts fundamental rights and thus it should be provided by law, limited to the restriction, applied when it is necessary with the least visibility.

Abstract:
The main goal of this PhD dissertation is analyse the implementation of community sentences in Catalonia from a gender-responsive and criminological approach. For this a mixed methodology is used. Firstly, is carried out a quantitative research in Catalan Probation System based on representative sample of 580 men and women that served a community sentence in Barcelona and Girona in 2017 through a bivariate descriptive analysis disaggregated by gender. Secondly, is carried out a qualitative research in Girona and Barcelona to analyse, on the one hand, the experiences of women serving community sentences and know what works, what does not work and what can be improve and on the other hand, to analyse the experiences of professionals, such as probation officers, supervising and intervening with men and women offenders. For this, 38 semi-structured interviews are analyzed: 23 with women offenders, 11 with probation officers and 4 other professionals from Probation System. This research shows that there are significant gender differences that the Probation System should take into account in order to achieve an implementation of community sentences from a gender-responsive approach. Likewise, once these differences, what works, what does not work and what could be improved are known, a possible gender-responsive design of community sentences, such as unpaid work and training programs, is presented
El principal objectiu d’aquesta tesi doctoral és profunditzar en el coneixement de la execució de les mesures penals alternatives des d’una perspectiva de gènere i criminològica. Per això, s’utilitza metodologia mixta. En primer lloc, es porta a terme una investigació quantitativa sobre una mostra representativa de 580 dones i homes que van finalitzar una mesura penal alternativa a Girona i Barcelona l’any 2017. Es realitza un anàlisi descriptiu bivariat entre la variable gènere i totes les altres variables recollides. En segon lloc, es porta a terme una investigació qualitativa a Girona i Barcelona. Per una banda, s’analitza com experimenten les dones penades el compliment de la mesura penal alternativa i què funciona, què no funciona i què podria millorar segons les mateixes entrevistades. Per altra banda, s’analitza com experimenten les persones delegades i els supervisors d’entitats de treball en benefici de la comunitat la supervisió i la intervenció amb dones i homes penats. Per això, s’analitzen 38 entrevistes semi estructurades en profunditat realitzades a 23 dones penades, 11 persones delegades i 4 supervisors. Aquesta investigació evidencia que existeixen diferències per gènere significatives que el sistema d’execució penal hauria de tenir en compte per aconseguir una execució sensible al gènere i a la diversitat existent. Tanmateix, després de conèixer aquestes diferències, allò que funciona, que no funciona i que podria millorar, es presenta un possible disseny de mesures penals alternatives com els treballs en benefici de la comunitat i els programes formatius, des d’una perspectiva de gènere

El objetivo de esta tesis doctoral es observar si, en la actualidad, en España, los antecedentes penales constituyen un problema en el mercado laboral. Se desarrollan cuatro líneas de investigación: un análisis de la legislación vigente sobre la petición de los certificados de antecedentes penales, un análisis descriptivo de tres fuentes de datos sobre la petición de estos certificados en la práctica, una investigación cualitativa con personas condenadas y una investigación experimental para observar el comportamiento de los responsables de selección de personal. Este trabajo muestra que en España existen una serie leyes que merman las oportunidades laborales de este colectivo. También se expone que, en algunos casos, los empleadores tratan desfavorablemente a las personas cuando observan una señal del paso por el sistema penal. Finalmente se expone que, en ocasiones, las personas con este estigma se autoexcluyen para evitar este potencial rechazo.
The main goal of this PhD dissertation is to analyse the effects of criminal records in the labour market in Spain at the present. With this aim, four lines of research are developed: a study of the current legislation on criminal records certificates, a descriptive analysis using three data sources to observe the magnitude of the petition of these certificates and for which jobs criminal records are asked for, a qualitative research with people with a previous conviction and an experimental research directed to study the behaviour of employers. This work shows that in Spain there are certain laws that restrict the labour market opportunities of people with criminal records. Also, in some cases, employers discriminate against candidates when they detect a mark of a criminal record. Finally, in particular contexts, people with this stigma self-exclude from jobs when they expect that they will be rejected.

El presente trabajo pretende dar una solución al problema de las crisis de las penas privativas de libertad donde, por una parte, de acuerdo con la tendencia a la descriminalización y a la despenalización, se aboga por el establecimiento, ampliación y profundización de las penas sustitutivas, con el objeto de superar la solución simplista e ineficaz de la cárcel como única o preponderante respuesta del sistema penal al complejo fenómeno social de la delincuencia; y por la otra, se asiste al fenómeno de la “hiperinflación penal”, la que trae como consecuencia el aumento del recurso a las soluciones institucionalizadas de carácter segregativo (cárcel), en respuesta a las demandas por mayor seguridad ciudadana que tienen lugar a raíz del incremento de algunas formas de criminalidad. Es así como en nuestro país se establece la ley 20.603 que modifica la ley 18.216 sobre penas sustitutivas a las penas privativas de libertad, ley que como analizaremos, más que solucionar el problema antes señalado, se transforma en una solución paradójica que acarrea respuestas diversas frente a instituciones jurídicas establecidas, como los recursos y los abonos a dichas penas sustitutivas, y lo confronta con el surgimiento de nuevas leyes, como la ley 20.770 y la 20.813 que más que ampliar el abanico de posibilidades sancionatorias diferentes a la cárcel, lo limita e incluso hace nula su aplicación, recurriendo exclusivamente a ésta como la única respuesta penal posible ante la comisión de un hecho ilícito. Se propondrán, a la luz de esta paradoja, soluciones posibles para poder en definitiva, dar cumplimiento a los estándares internacionales respecto a la no utilización de la cárcel como única respuesta al delito

Abstract:
Biological and molecular characteristics of the pathogenic mollicute, Spiroplasma penaei, isolated from the hemolymph of infected Pacific white shrimp, Penaeus vannamei, were investigated. The doubling times of a S. penaei were 6.13 h (2% NaCl) and 3.43 h (no salt) under aerobic conditions, and 6.63 h (2% NaCl) and 3.22 h (no salt) under anaerobic conditions. Small diffuse white colonies with granular centers, surrounded by small satellite colonies that appeared embedded in the agar matrix, were detected on solid M1D medium (2% Noble agar) under aerobic conditions at 28°C. The genome size of the S. penaei was 1778 Kb, as determined by pulsed-field gel electrophoresis using undigested DNA. Reduction of virulence of S. penaei was not detected in serial passage 24 and 76 isolates but passage 131 isolate was attenuated as indicated by the number of surviving shrimp and histological findings of challenged P. vannamei. Toxicity was not detected in supernatant fractions of M1D medium cultures of S. penaei isolates. The most predominant host responses to the S. penaei reference isolate and to serial passage isolates were hemocytic nodules and hemocytic infiltration observed in hematoxylin and eosin-stained histological sections. Transmission electron microscopy of the lymphoid organ of experimentally infected P. vannamei depicted S. penaei without cell wall and free in the cytoplasm of lymphoid organ cells. The lesions observed in histological sections were verified by in situ hybridization using a digoxigenin (DIG)-labeled probe specific to the spiralin gene of Spiroplasma spp. Evolutionary relationship trees, based on five partial DNA sequences of 16S rDNA, 23S rDNA, 5S rDNA, gyrB, rpoB genes and two complete DNA sequences of 16S-23S and 23S-5S ISR, were constructed using the distance-based Neighboring-Joining method with Kimura-2-parameter substitution model. The NJ trees based on all DNA sequences investigated in this study positioned S. penaei in the Citri-Poulsonii clade and corroborates the observations by other investigators using the 16S gene. Pairwise genetic distance calculation between sequences of spiroplasmas showed S. penaei to be closely related to S. insolitum and distantly related to Spiroplasma sp. SHRIMP from China.

En México es recurrente que al querer acceder a una oportunidad laboral, se haga la solicitud de antecedentes penales, lo cual es violatorio a derechos humanos, ya que contrapone diversas leyes tanto del ámbito laboral como penal. Por ello es de suma importancia, que sea eliminada esta costumbre reiterada, debido a que no solo afecta a quien pudiere haber compurgado una pena, sino que trasciende hacia terceros relacionados directamente con el sujeto, estigmatizando no sólo al inidivduo, sino a quien le rodea. Por lo tanto, en el planteamiento de que existe un modelo penitenciario, cuyo objetivo es la readaptación del individuo a la sociedad para que este sea funcional, productivo y feliz,, la sociedad mexicana se encuentra en un conflicto, el cual propicia la discriminación, y funciona como pauta para observar y/o mantener bajo vigilancia a quien cuenta con antecedentes e carácter penal y en el peor escenario no contratar al trabajador, por los motivos y cómo involucra al individuo y a terceros, ya que esta práctica proveniente de una sociedad que desconfía en su propio sistema de justicia y no cree en la reinserción social. Se enfocará en las leyes que son pasadas por alto con esta actividad y cuáles son las que deben ser reformadas, trayendo tres propuestas de importante valor para el Derecho laboral, el sistema de reinserción social, así como la concientización social en materia de Derechos Humanos.
