Este trabajo aborda una cuestión importante del Derecho Civil, como es la responsabilidad del deudor por el retraso en el cumplimiento de las obligaciones pecuniarias, entendidas como aquellas que tienen por objeto el pago de una suma de dinero. Las obligaciones pecuniarias son las más difundidas en la experiencia jurídica y merecieron singular atención por parte de nuestro legislador, quien dictó normas especiales para su regulación en el Código Civil boliviano vigente desde 1976. Con el objetivo de precisar el sentido y alcance de los preceptos que regulan la reparación del daño sufrido por el acreedor a causa del retraso en el cumplimiento de la prestación pecuniaria, desentrañaremos el origen del dinero, el principio nominalista, los intereses, la mora del deudor, el daño patrimonial automático y otras cuestiones centrales del derecho de daños, aventurándonos en un apasionante recorrido.

Abstract:
We study the role of self-selection into public service in sustaining honesty in the public sector. Focusing on the world’s least corrupt country, Denmark, we use a survey experiment to document strong self-selection of more honest individuals into public service. This result differs sharply from existing findings from more corrupt settings. Differences in pro-social versus pecuniary motivation appear central to the observed selection pattern. Dishonest individuals are more pecuniarily motivated and self-select out of public service into higher-paying private sector jobs. Accordingly, we find that increasing public sector wages would attract more dishonest candidates to public service in Denmark. (JEL D73, H83, J31, J45)

Od 1 lipca 2018 r. obowiązują przepisy ustawy z 24 listopada 2017 r. o imprezach turystycznych i powiązanych usługach turystycznych, która reguluje prawa podróżnych za "zmarnowany urlop". Ustawa o imprezach turystycznych zastąpiła poprzednią regulację wynikającą z ustawy z dnia 29 sierpnia 1997 r. o usługach hotelarskich oraz usługach pilotów wycieczek i przewodników turystycznych, wprowadzając zdecydowanie szerszy zakres odpowiedzialności przedsiębiorców działających w branży turystycznej, co miało ułatwić poszkodowanym dochodzenie roszczeń. W artykule przybliżono sposób naprawiania szkody za utratę przyjemności z wakacji w poprzednim oraz obowiązującym stanie prawnym. Następnie Autorka przedstawiła przebieg postępowania sądowego, zarówno w sytuacji gdy podróżny zdecyduje się na postępowanie grupowe, jak również gdy indywidualnie wytoczy powództwo. Autorka zwraca uwagę na konieczność właściwego przygotowania się przez podróżnego do procesu cywilnego ze względu na spoczywający na nim ciężar dowodu, omawia także wady i zalety poszczególnych rozwiązań prawnych.

The article is devoted to the awarding of non-pecuniary damages in the European Court of Human Rights (ECHR) practice. The problem of research arises from the lack of criteria that the Court uses for calculating non-pecuniary damages which leads to unfair compensation for the injured party. The article examines ECHR cases and investigates how the Court has substantiated the precondition for a claim for compensation of non-pecuniary damage of a person. The grounds and circumstances which influence the amount of non-pecuniary damages are analyzed. The research proposes to define and introduce a list of criteria based on individual features of a person in recommendations on which ECHR should pay attention in non-pecuniary damages assessment to provide fair compensation to the victim which can help to create transparent mechanism for assessment in its practice

Academics employed in either public or private university in Malaysia may be subject to different contract of service and scheme of employment. Due to this variance, academics receive different employment benefits. Such variation can also create differences and imbalance between universities in the context of workloads assigned to academics in both types of universities. Thus, objective of this article is to analyze employment benefits (pecuniary and non-pecuniary) of academics in Malaysian universities and their satisfaction with the employment benefits that they receive. This article employs a mixed method approach i.e. qualitative and quantitative. For quantitative approach, a survey was conducted among academic staffs in Malaysian public and private universities. Qualitative approach by way of interviews were conducted among management of selected universities. The results show that all academic staff in public and private universities in Malaysia received pecuniary and non-pecuniary benefits. For public universities these benefits are mostly standardized. However, pecuniary and non-pecuniary benefits for academics in private universities are different from public universities and between themselves. The job specification which involves teaching, supervision, research, consultation and administrative works as found in the KPIs of all academics are not similar. It is recommended that to strike a balance between benefits (pecuniary and non-pecuniary) and workloads received by academics, the workloads of academics should be designed to have a particular focus on specification of work such as research and supervision, teaching and administration tracks. Therefore, this article suggests that the relevant authorities consider a new remuneration scheme and benefits based on tracks and yearly staff performance achievement for academics in Malaysia.

Il d.lgs. 25 maggio 2017, n. 90 ha modificato la normativa in materia di riciclaggio, pur mantenendo il limite massimo di tremila euro per i pagamenti in contanti, in assenza di tracciabilità. Tale decreto ha tuttavia modificato la cosiddetta soglia antiriciclaggio, riducendo l'importo da 15.000,00 a 10.000,00 euro. Con riferimento ai pagamenti elettronici non rifiutabili, i decreti - previsti dal co. 5 dell'art. 15 d.l. n. 179/2012 così come modificato dalla l. 208/2015 - non sono stati emanati, nonostante ciò fosse previsto. Il d.lgs. n. 218/2017 attua la Direttiva (UE) 2015/2366 relativa ai servizi di pagamento nel mercato interno e il rispetto delle norme interne al Regolamento (UE) 2015/751 relativo alle commissioni interbancarie sulle operazioni di pagamento basate su carte. La mancata approvazione, nel 2017, dei decreti interministeriali contenenti le sanzioni applicabili in caso di diniego dell'operatore, unitamente alla percezione sociale della disuguaglianza implicita nella norma, rappresenta un chiaro indice della mancanza di efficacia della norma stessa. Ciò merita una riflessione seria, dato che una determinata modalità di pagamento può essere imposta dal legislatore solo se corrisponde a un comportamento sociale consuetudinario che è significativamente e ampiamente riconosciuto. Al contrario, i progetti legislativi in corso sembrano andare nella direzione opposta, dato che includono alcune proposte legislative volte a costruire, in caso di rifiuto dei pagamenti elettronici, una tipologia di reato analoga a quella prevista dall'art. 693 cod pen. ovvero il rifiuto di accettazione della moneta avente corso legale.

Abstract:
The article aims to describe the institution of pecuniary performance in the Polish civil law system, taking into account EU regulations and case law of the Polish Supreme Court. Due to its importance for civil law transactions, pecuniary performance is regulated separately both at the level of general and specific regulations. These regulations are contained in the Civil Code and special laws, including those relating to bank agreements. In particular, the Act recognizes nominalism as the basic principle for providing pecuniary performance in the strictest sense, introduces the possibility of judicial and contractual valorization of such performance and regulates the principles for providing pecuniary performances, including those expressed in foreign currency. The Act also regulates the institution of interest. This applies, in particular, to the title to collect interest, types of interest (ordinary interest; interest for default, including interest for delay in commercial transactions), the amount of interest (including interest specified by the Act if the amount of interest is not otherwise specified), together with the determination of a maximum amount (maximum interest, maximum interest for delay) and the prohibition of anatocism (compound interest), including exceptions to the prohibition. In some cases, however, the statutory regulation turns out to be incomplete, unclear or not in line with the current situation in civil law transactions. For these reasons, courts face the challenge of resolving a dispute on the basis of general regulations, including those concerning the rules of fulfilling the obligation. This applies, in particular, to the issue of the statute of limitations regarding claims for interest, changes in the amount of interest during the term of the obligation and the effectiveness or the rules of performance of loan agreements denominated or indexed to a currency other than the Polish currency, concluded before 21 July 2017.

As society develops, the concept of personality rights and their legal protection gain significance over the years. Naturally, this concept is evolving as society changes, and it should protect new personal interests against infringement. At the same time, there are reported instances of granting legal protection with doubtful legal justification. In Poland, many commentators and scholars point out that the courts, in some cases, seem to use the concept of personality rights as a universal tool in order to compensate for nearly any mental distress. In this paper, I wish to present interesting examples of this "search" for new personality rights as tools to compensate the plaintiffs for non-pecuniary damages, along with some controversial cases of granting non-pecuniary damages based on questionable legal justification. Following, I will attempt to clarify the notion of non-pecuniary loss and examine whether the courts try to expand its meaning to grant legal protection to plaintiffs. My analysis will be based on Polish law, with some comparative remarks. As the problem is complex and varies according to the jurisdiction, this paper provides a general illustration of the issue at hand. It was found, that law on Compensation for Damage Caused in Criminal Proceedings and Administrative Violations eliminates pre-existing problems when courts had problems determining the amount of compensation of non-pecuniary damages in accordance with Civil law article 5. However there are problems with fixed calculation of daily wages in the article 15. of the law on Compensation for Damage Caused in Criminal Proceedings and Administrative violations.The article uses the systemic, dogmatic and comparative method of studying and analyzing normative acts and court rulings.

Purpose – The purpose of this paper is to investigate the connection between university research and technological capital developed by science park (SCP) firms in order to elucidate whether the causal linkage is owing to non-pecuniary research spillovers or pecuniary technology transfer activities. Design/methodology/approach – Two publicly available surveys, one dealing with the research and transfer activities of 45 Spanish universities and another with the patenting activities of 44 Spanish SCPs, are matched in such a way that hypotheses can be tested using regression analysis. Findings – The patenting performance of SCP firms is positively related to the competitive R&D projects undertaken by the universities to which they are affiliated and negatively related to the technology transfer activities carried out by those universities. These findings suggest that the scientific knowledge produced by universities principally contributes to private technology-based firms’ technological capital through non-pecuniary research spillovers, whereas the pecuniary technology transfer agreements remain uncertain or may even prove to be detrimental. Practical implications – Firms that are considering locating or remaining in a university-affiliated SCP should be aware that the university's pecuniary orientation when managing its intellectual capital may become a barrier as regards the firm filling its technological capital shortages. From a university administrator perspective, the complementary or substitute role of technology transfer offices vis-à-vis SCPs should be considered in the light of the selling or revealing approach adopted by the university in order to commercialize and diffuse potential inventions. Originality/value – This study contributes to existing literature by shedding light on the causal linkage between university research and firm innovation, obtaining evidence in favor of an upstream, non-pecuniary and revealing role of universities in support of the accumulation of technological capital amongst SCPs tenant firms.

Based on the analysis of existing doctrinal approaches the author ascertains attributes of these relationships and formulates their definition. The author reveals connection of civil legal relationship (subjective civil rights) with the subject matter of civil law, and for the first time in the literature it is concluded that they have common classification criterion. In the text the main groups of pecuniary relations regulated by different subbranches and institutes of civil law are determined. Abstract:
This paper develops a dynamic two-country neoclassical stochastic growth model with incomplete markets. Short-term credit flows can be excessive and reverse suddenly. The equilibrium outcome is constrained inefficient due to pecuniary externalities. First, an undercapitalized country borrows too much since each firm does not internalize that an increase in production capacity undermines their output price, worsening their terms of trade. From an ex ante perspective each firm undermines the natural “terms of trade hedge.” Second, sudden stops and fire sales lead to sharp price drops of illiquid capital. Capital controls or domestic macro-prudential measures that limit short-term borrowing can improve welfare. (JEL F32, F43, G15, O41)

Abstract:
This paper aims to study the influence of pecuniary and non-pecuniary aspects on entrepreneurship. It attempts to fill a gap in terms of explaining how these aspects determine individual and household choices or constraints regarding entering entrepreneurship as either part time, with participation in labor markets, or as full time, as well as the corresponding supply of entrepreneurial effort. The study searches for insights on the relation between motivations intrinsic in either form of entrepreneurship and their effects on the supply of the entrepreneurial effort. Part-time micro entrepreneurs respond more to non-pecuniary aspects when maximizing their life choices, which divert them from profit maximization. However, full-time micro entrepreneurs are more sensitive to pecuniary factors and their choices regarding utility maximization are more compatible with profit maximization, albeit both groups are part of simple forms of entrepreneurship. The results identify the expectations placed on enterprises run by part-time and full-time entrepreneurial households in terms of their motivation and attitude toward the goal of profit making and consequently, to entrepreneurial supply and performance. Both groups may be relevant from the policy standpoint and employment in developing economies.
