Abstract:

This chapter provides a broad definition of surveillance in relation to health protection, including infections, environmental hazards, and health delivery. Surveillance systems include active, passive, and sentinel surveillance, and guidelines are provided for assessing the quality of surveillance data. Surveillance tools include the statutory notification of diseases, laboratory reporting, and prevalence surveys. In addition, syndromic surveillance, the (near) real-time collection of data has become increasingly used, facilitated by increasing use of digital data collection within health care settings and the availability of other digital data sources (e.g. social media). Other surveillance types include event-based surveillance (e.g. during major sporting events), and environmental surveillance, including food related disease, air pollution and chemical hazards. The chapter finally brings these together in integrated surveillance and the use of such surveillance in health planning and assessment.

This chapter focuses on trade mark protection in the United Kingdom. Trade marks constitute a key component of the system of intellectual property rights. The present law is to be found in the Trade Marks Act 1994, which was introduced in order to enable the United Kingdom to comply with its obligations under the 1988 EC Directive to Approximate the Laws of the Member States Relating to Trade Marks. The chapter discusses the effect of trade marks; the doctrine of passing off; trade marks and information technology; Internet-related trade mark disputes; the uniform dispute resolution rules; and trade marks and Internet search engines.

Abstract:

Principle 23 deals with statutory limitations (prescription, in French) aimed at protecting defendants from stale claims that might be difficult to counter. Statutory limitations refer to legal norms that regulate the effects of the passage of time in domestic systems. In criminal law, they provide for a maximum timeframe, or prescription period, within which criminal proceedings can be instituted or sentences enforced. The passage of time makes the gathering of evidence more difficult and may also reduce the effectiveness of criminal prosecution. Significant delays in criminal action may thus impair the accused’s right to a fair trial. Furthermore, criminal proceedings tend to lose legitimacy as time passes. After providing a contextual and historical background on Principle 23, this chapter discusses its theoretical framework and how the statutory limitations have been applied in practice under multilateral treaties, domestic legislation and case-law. It also examines the practice of United Nations organs.

Abstract:

Using the tools of normative political theory, this book explores the political relationship between exiles and the communities from which they have fled. It makes two central claims. First, exiles have rights and responsibilities in their homelands and are morally required and permitted to play particular roles in the homeland. Second, in playing these roles, exile politics can perform two corrective functions: it can repair defective political institutions at home and it can compensate for institutional shortcomings in the global domain. In short, exiles engage in a ‘politics from below’ and ‘away’ that produces alternative sites of power and can mitigate the several failings of an international system of states in an unequal world. This normative exploration of exile politics has a few implications. It counters an overwhelming focus, in both political philosophy and public discourse, on the consequences of forced migration for receiving societies—a focus that often treats exiles as passive actors. Recognizing the political agency of exiles reveals another side of the migration story, and allows for a more fulsome exploration of what political obligation and membership mean in an increasingly transnational world. Identifying exiles as important domestic and transnational actors also points to the ways third parties ought to enable the different roles exiles play in their communities of origin and in the international domain. And recognizing exile agency highlights the shortcomings of an international system of refugee protection that focuses on exiles’ humanitarian needs but denies them their political rights and agency.

Abstract:

This book on the criminal justice system is uniquely positioned to examine judicial claims to independence, the politics of the judiciary, the rule of law, and the role of the executive in the context of a democratic polity. The authors have mined the British government’s archival vaults to assemble records including official (previously classified) Home Office files and present a ground-breaking narrative. By tracking the relationship between senior judges and the Home Office from the end of the nineteenth century to the modern day, revelations concerning the politics of the judiciary and the separation of powers are unearthed. The book argues that the claims of the senior judiciary to be independent of the executive are invalidated by historical records and the theory and practice of the separation of powers (the ‘Westminster Model’) deeply flawed. Rather, at every material point, civil servants compromised the role of the senior judiciary’s decision-making. Moreover, with the passive endorsement of senior judges, the executive repeatedly misled Parliament as to the authorship and provenance of fundamental rules governing the relationship of the individual to the state in relation to police powers of arrest, detention, and questioning. The book also explores the past and continuing impact of all this to former colonial territories and traces the close liaison between key members of the senior judiciary and the state in reconfiguring the modern criminal process in a way which weakens defence lawyers, pressurizes defendants into pleading guilty, and undermines cardinal adversarial protections.
