Abstract:
Purpose The purpose of this paper is to examine the mediating role of job satisfaction in the relationship between effort-reward imbalance (ERI) and burnout, turnover intentions, and mental health. Design/methodology/approach Based on a sample of 323 full-time employees in the small developing country in the Caribbean, this survey study tested a mediation model with job satisfaction depicting the relationship between ERI and various outcome variables. The model was compared to a partial mediation model. Findings The structural equation modelling (SEM) results revealed that the partial mediating model was superior to the full mediation model, suggesting that job satisfaction plays only a partial role in mediating the relationships between ERI and burnout, turnover intentions, and mental health. Research limitations/implications The study presents a cross-sectional approach to model testing but the study controlled for CMV statistically using the common latent factor approach within latent SEM procedures. Practical implications Organisations should ensure that employees’ efforts are appropriately and fairly rewarded as a means of reducing negative ERIs which can have adverse consequences on the physical and mental health of employees. Originality/value Using latent SEM procedures and statistical controls for CMV, the study examined job satisfaction as a potential mediator in a popular stressor-strain model.

Abstract:
Purpose Indirect or mediated effects constitute a type of relationship between constructs that often occurs in partial least squares (PLS) path modeling. Over the past few years, the methods for testing mediation have become more sophisticated. However, many researchers continue to use outdated methods to test mediating effects in PLS, which can lead to erroneous results. One reason for the use of outdated methods or even the lack of their use altogether is that no systematic tutorials on PLS exist that draw on the newest statistical findings. The paper aims to discuss these issues. Design/methodology/approach This study illustrates the state-of-the-art use of mediation analysis in the context of PLS-structural equation modeling (SEM). Findings This study facilitates the adoption of modern procedures in PLS-SEM by challenging the conventional approach to mediation analysis and providing more accurate alternatives. In addition, the authors propose a decision tree and classification of mediation effects. Originality/value The recommended approach offers a wide range of testing options (e.g. multiple mediators) that go beyond simple mediation analysis alternatives, helping researchers discuss their studies in a more accurate way.

Abstract:
PurposeThe purpose of this paper is to investigate the mechanism by which uses and gratification (U&G) constructs predict continuance intention to play (ContInt) the augmented reality game Pokémon Go (PG), through multiple serial mediation technique, with enjoyment and flow as mediators. The model also integrates other motivational factors specific to PG, namely, network externality and nostalgia and investigates the process by which they influence ContInt through players’ inherent need-to-collect animated monsters and online community involvement, respectively.Design/methodology/approachThe model was tested using 362 validated responses from an online survey of PG players in Malaysia. Partial least squares structural equation modeling was used to analyse the data. The predictive relevance of the model was tested via partial least squares-Predict.FindingsContInt is influenced through various mechanisms. Enjoyment is the most important mediator, mediating three U&G predictor constructs (achievement, escapism, challenge and social interaction) and the outcome ContInt. Flow did not have any influence on ContInt unless coupled with enjoyment as a serial mediator. Network externality and nostalgia were found to only influence ContInt through mediators, online community involvement and need-to-collect Pokémon Monsters, respectively. Overall, the results show evidence of four indirect-only mediation paths and one complementary partial mediation path.Originality/valueProvides support for an integrated model incorporating psychological, social and gaming motivational factors. While most other studies focus on direct relationships, we focus on indirect relationships through multiple sequential mediation analysis, following the recent modern mediation analysis guidelines. Contrary to previous findings, flow was not an important factor in predicting ContInt for gaming and nostalgia does not link directly to ContInt.

Abstract:
Purpose This study aims to more deeply examine the various types of testing mediations and use the comparison test by using test-based mediation Sobel models and Bayesian approach. The purpose of this study are to apply the traditional (using indirect effect) and Sobel test, extend Yuan and MacKinnon (2009) work on Bayesian mediation analysis. Both analysis methods of mediation (Traditional, Sobel Test and Bayesian estimation) should apply in the research of management, by using structural equation modeling (SEM) in a structural model, with one mediation, one exogenous (independent) and one endogenous variable. The meta-analysis approximation has been used to investigate the job satisfaction as a mediation in the relationship between employee competence and performance (endogenous). Design/methodology/approach Data were collected from ten dissertations of students of the Management Doctoral Program at the Brawijaya University from 2009 until 2013; data were analyzed for the mediation variable of job satisfaction (M) in the relationship between employee competence (X) and employee performance (Y) (Muindi and Obonyo, 2015; Olcer, 2015; Sattar et al., 2015; Khan and Ahmed, 2015). A researcher can determine the mediating variable and whether it is complete or partial or if mediation exists in several ways. Findings The results of the above findings using meta-analysis showed that 60% of previous research states that job satisfaction is a partial mediation on relationship competence of the performance, 10% of previous research states that job satisfaction is a full mediation on relationship competence of the performance and 30% stated that job satisfaction is not pemediasi (pemediasi means Mediation variable) on the relationship between competence and performance. This research found that all three approaches provide similar conclusions for ten previous research. Research limitations/implications The findings showed that the Sobel approach and the Bayesian approach provide results that are more sensitive than the traditional approach. Practical implications In my opinion, the rule to investigate the mediation variable should be completed with the conditions (1) q (theta) is not statistically significant, (2) α (alpha) and β (beta) are significant, and (3) q’ (theta) is significant, and increase when M is include as an additional predictor. This condition called partial mediation. Social implications The traditional method is simpler and easy. The method is less sensitive and is not sufficient for investigating the mediating variables. In general, the method results in a mediation variable, but it cannot be used to determine either partial or complete mediation variables. So, investigation by Baron and Kenny Methods (in Hair et al., 2010), the rule or testing called Sobel Test and another approach such as Bayesian to determine the mediation variable is necessary. Originality/value Various methods for detecting mediating/intervening have been widely used in previous research as a method of measurement using indirect effect (Hair et al., 2010), and calculations have been performed using Sobel test (Baron and Kenny, 1986) and Bayesian approach (Enders, 2013). In this study, I wanted to more deeply examine the various types of testing mediations, and use the comparison test by using the test-based mediation Sobel models and Bayesian approach (Baron and Kenny, 1986; Enders, 2013). The statistical application should not be complicated and difficult, it but must rather be simple and easy, so that it is user-friendly. The traditional method is simpler and easier than the other methods, but how sensitive is it? This research is conducted to investigate this problem. The evaluation of mediating mechanisms has become a critical element of behavioral science research (Enders, 2013), especially in the field of management, not only to assess whether (and how) interventions achieve their effects but also, more, broadly, to understand the cause of behavioral change. Methodologists have developed mediation analysis techniques for a broad range of substantive applications. However, methods for estimating mediation mechanisms with various methods have been understudied. The purpose of this study is to apply the traditional (using indirect effect) and Sobel tests and extend Yuan and MacKinnon’s (2009) work on the Bayesian mediation analysis. Both analyses methods of mediation (traditional and Sobel test and Bayesian estimation) should apply in the research of management, by using structural equation modeling (SEM) in a structural model, with one mediation, one exogenous (independent) and one endogenous variable. The meta-analysis approximation has been used to investigate job satisfaction as the mediation in the relationship between employee competence and performance (endogenous). This study uses software R to complete the mediating effect (Enders, 2013). R is a language and environment for statistical computing and graphics. It is a GNU project which is similar to the S language and environment which was developed at Bell Laboratories (formerly AT&T, now Lucent Technologies) by John Chambers et al. R provides a wide variety of statistical analyses such as SEM and Mediation test. R provides an open source route for participation in that activity. The Bayesian estimation approach provides an R function and a macro that applies the method of mediation analysis.

Abstract:
This study investigates the mediating effect of perceived value in the relationship between team identification and purchase intention towards licensed apparel within two different price settings (market price and 40% above market price). Considering adaptation level theory, cognitive dissonance theory and dual information processing, it is hypothesised that team identification will directly influence purchase intention when the price of a product decreases. Two models (partial mediation and full mediation) were constructed in each price setting and tested using structural equation modelling (SEM). The results indicate that the partial mediation model better fits the data for the 70,000 Won setting and the full mediation model was a better fit for the 90,000 Won setting.

Abstract:
The aim of the present study is to explore, through a mediation model, the relationship among self-esteem, coping strategies, and the risk of Internet addiction in a sample of 300 Italian university students. We submitted the data to a descriptive, mediational comparison between variables (t-test), and correlational statistical analyses. The results confirmed the effect of self-esteem on the risk of Internet addiction. However, we found that the introduction of coping strategies as a mediator gives rise to partial mediation. A low level of self-esteem is a predictor of avoidance-oriented coping that, in turn, affects the risk of Internet addiction.

AbstractWestern mediators have accepted at face value claims as to the general acceptability and voluntariness of Chinese mediation. Their failure to attend to the cultural context in which Chinese mediation practices are embedded has led to a partial and uncritical impression. Abstract:
The impact of loyalty programs on customer retention was investigated in this study. Concomitantly, the mediating effects of brand association and customer satisfaction between loyalty programs and customer retention were also tested in three ways, viz., in parallel, distinct, and sequential through a series of structural models. The study focuses on the Malaysian national car sector, and empirical data was collected from 313 Malaysian national cars users through convenience sampling. This explanatory, quantitative research adopts a questionnaire as a survey instrument, and the collected data was first subjected to normality and reliability assessment followed by confirmatory factor analysis, structural equation modeling using IBM SPSS AMOS 24. Multiple mediation analysis was then conducted, and results were confirmed through bootstrapping. Findings show that there is a significant positive impact of loyalty programs on customer retention. The brand association has a full mediation effect between loyalty programs and customer retention when tested in parallel with customer satisfaction; on the contrary, customer satisfaction demonstrated an insignificant mediation effect. On the other hand, when tested distinctly, brand association showed a partial mediating effect while there was no mediation effect of customer satisfaction. Besides, customer satisfaction and brand association demonstrated sequential partial mediation.

Abstract:
Background: The aim was to examine the mediating role of basic psychological needs and job satisfaction in the relationship between the gender effect on health problems and psychological well-being for health professionals in Europe in 2015. Methods: Two multiple partial mediation analyses were conducted in order to test the partial mediation of both basic needs and job satisfaction, with gender as the independent variable and health problems or well-being, respectively, as the dependent variables, with a sample of health professionals. Results: Women reported lower psychological well-being and more health problems than men. The total effect of gender on both well-being and health problems was found to be significant. Regarding multiple mediation analyses: (a) the effect of gender on well-being was fully mediated by global basic need satisfaction and job satisfaction, such that gender did not present a significant direct effect and (b) the effect of gender on health problems was partially mediated by global basic need satisfaction and job satisfaction, such that the direct effect remained significant. Conclusions: The fulfillment of basic needs for autonomy, competence, and relatedness, as postulated within self-determination theory, was hypothesized to play a mediating role in the relationship between gender and well-being. Since significant gender differences in basic need satisfaction were observed, such a mediator should be controlled in order to achieve a significant relationship between gender and well-being when basic needs comes into play. The current study adds to the research emphasizing the need for satisfaction as a promising mechanism underlying for female health professionals’ well-being.

McLean, M. "A longitudinal analysis of a partial mediation model of employee engagement in a knowledge-intensive firm." Thesis, Nottingham Trent University, 2014. http://ethos.bl.uk/OrderDetails.do?uin=uk.bl.ethos.664737.

Full text
Abstract:
Research interest in employee engagement (EE) has recently intensified. This thesis document (the study) adds to our understanding of EE by conceptually developing and empirically testing a partial mediation model of EE within a smaller knowledge-intensive setting. The study’s aim is to longitudinally examine whether, how and why there were changes in the level and nature of EE and in satisfaction with antecedents of engagement. Linkages between these constructs are explored. An HRM ‘black box’ is thus investigated. The case study organisation, site of the empirical work, is Integrated Environmental Solutions (IES), a world leading high-tech company which supplies software and professional services to the architecture, engineering and construction sector to aid green building design and reduce energy consumption in new and existent buildings. The research methodology in this study adopts a realist stance. Quantitative and qualitative data were gathered between 2008-2010 via three employee surveys, interviews, focus groups and company documents during a period of great market turbulence at IES. The results reveal that overall EE rose to a very high level, contrary to the general trends observed in the UK. Emotional engagement remained high and stable, while both cognitive and behavioural engagement levels significantly improved. Despite a volatile business background, it seems that the strategic company responses to survey feedback via targeted actions and HR interventions sustained (or improved) satisfaction with all antecedents of engagement, apart from that of rewards and recognition. This longitudinal study suggests that four antecedents can be described as fundamental drivers of high engagement within a knowledge-intensive firm during this difficult period: long-term strategic direction and alignment; a strong people-centric culture; job satisfaction and knowledge-sharing. There is a paucity of prior longitudinal academic study into EE, especially in a knowledge-intensive context and in a recession; this study contributes to these knowledge gaps. Further, the study offers conceptual insights into a contextualised partial linkage model of EE and an analysis of how an EE strategy can be implemented in practice. The study thereby advances the limited extant studies, directly contributing to gaps in knowledge, methodological approaches and our understanding of practice. Moreover, implications for professional practice and future research direction are explicated in the study’s conclusions.

Carter, Devin. "Examining the Incremental Validity of Working Memory for Predicting Learning and Task Performance: A Partial Mediation Model." Thesis, Virginia Tech, 2017. http://hdl.handle.net/10919/81312.

Full text
Abstract:
General intelligence (“g”) has long been used as an effective predictor of both learning and job performance. Further, other more specific cognitive abilities have not been able to consistently predict incremental variance in job knowledge and job performance beyond “g”. However, the processes associated with working memory (WM) are important for these outcomes and are not captured by our traditional tests of “g”. This study tested a partial mediation model in which working memory (WM) incrementally predicts task performance above “g” through task knowledge and through a direct effect. Participants were given measures of “g” and WM in a lab. They were then given a learning opportunity and a task that applies this newly learned knowledge in order to tests the effects of WM. Results indicate that WM explains additional variance in both task knowledge and task performance, and the partial mediation model was supported using one of the two WM tasks used.
Master of Science
General intelligence is widely used in personnel selection because it is consistent in predicting the job performance of future employees. Other cognitive abilities have also been examined to determine whether they are able to predict job performance as well as general intelligence. However, most of these other cognitive abilities have come up short. This study hypothesized that working memory (WM) is a cognitive ability that may be able to predict job performance even after controlling for general intelligence. A sample of undergraduates completed tasks that measured general intelligence and WM, and this study examined how well each measure predicted both learning and performance on a relatively novel task. Results indicated that WM was able to predict both learning and performance after controlling for general intelligence.

Wang, Huanhuan. "Partial Mediation and Moderation Effects of Class Peer Norms on the Relations of Teacher Support with Student Aggression and Academic Engagement during Early Adolescence." Scholar Commons, 2017. http://scholarcommons.usf.edu/etd/6777.

Full text
Abstract:
The purpose of this study was to examine the mediation and moderation effects of classroom peer norms (CPN) on the associations of teacher support with student engagement and aggression during sixth grade (first year of middle school). Current literature suggests that early adolescence is a critical developmental period with many changes occurring, including a peak in aggression, decreased academic engagement, increased peer influence, and decreased teacher support. Despite these challenging changes, teachers often serve as a powerful yet “invisible hand” (Farmer, Lines, & Hamm, 2011) that can influence student behaviors directly or indirectly via CPN. However, these two routes of teacher influence have rarely been examined simultaneously. The current study investigated these two routes by examining the partial mediation and moderation effects of CPN on the associations of teacher support with four student behaviors (overt and relational aggression, involved and disruptive behavior) among a diverse sample of 312 students from 32 classrooms across the fall and spring of sixth grade. Students self-reported teacher support (academic, emotional) and engagement (involved, disruptive behavior) and peer-nominated aggression (overt, relational). CPN was computed as a class average of a certain behavior (aggression or engagement). Multilevel modeling was used to test the mediation and moderation effects, considering the nested nature of the data (i.e., students nested within classrooms). Results indicated full mediation effect of CPN on the relations of fall teacher support with spring overt aggression, relational aggression, and disruptive behavior, and a moderation effect on spring involved behavior. Interestingly, the average classroom perception of teacher support showed a significant direct negative effect on relational aggression and disruptive behavior, and a direct positive effect on involved behavior, all of which became smaller and non-significant when CPN was taken into consideration (i.e., when the indirect or mediation effect was considered). In terms of the mediation effects, classes which had high levels of average perception of teacher support in the fall tended to have low disruptive behavior CPN, which was further associated with low levels of individual student disruptive behavior in the spring. The same mechanism applied to overt and relational aggression, except that the significance level of the relations of CPN with overt and relational aggression was marginal (i.e., p < .10). The moderation effect suggests that students who reported high levels of teacher support in the fall (relative to his/her classmates, regardless of the class average) tended to report high levels of involved behavior in the spring only if the fall involved behavior CPN was also high. These findings highlight the importance to investigate both teacher and peer influence within a classroom in order to better understand student behaviors during the first year of middle school. Theoretical and practical implications are discussed, as well as limitations and future directions.

Wu, MeiMei. "Investigating the adoption of banking services delivered over remote channels : the case of Chinese Internet banking customers." Thesis, Loughborough University, 2012. https://dspace.lboro.ac.uk/2134/9387.

Full text
Abstract:
Customers adoption of Internet banking has become a widely-researched topic, although it is fair to state that some research gaps still exist. This research aims to fill some of the research gaps by examining the factors that determine the relevant behaviour of three different categories of Internet banking customers in China (i.e. current users, non-users, and discontinued users), and by developing two conceptual models that are derived from different, but complementary, theoretical approaches. The Decision Making Model and the Service and Relationship Evaluation Model are developed in this research. The Decision Making Model is grounded in the technology acceptance model (TAM) and it incorporates an additional construct of perceived value of using Internet banking. Additionally, the Service and Relationship Evaluation Model is derived from the service quality evaluation and relationship quality evaluation literature. Unlike in most other Internet banking adoption studies, these two conceptual models are used complementarily to deliver a comprehensive understanding of customers Internet banking adoption in China. The models are tested using a sample of 614 Chinese Internet banking customers collected via mall-intercept personal interviews based on questionnaires. Partial Least Square (PLS) path modelling and mediation analysis are applied to test the hypotheses advanced in the two models. The key findings of this research show that perceived value is a major factor for explaining customers Internet banking adoption, thus indicating to the banks that they should reduce costs associated with using Internet banking while providing more (perceived) benefits to customers; the importance of incorporating perceived value in Internet banking adoption model(s) is also demonstrated. The findings also confirm that perceived usefulness and perceived ease of use are important factors that determine the adoption of Internet banking by all categories of customers. Current users and non-users perceptions of their behavioural control over using Internet banking contribute to their adoption of Internet banking, and such control perceptions are shaped by self-efficacy, perceived government support and technological support. Additionally, it is demonstrated that both current users and discontinued users perceived value and perceived service quality of Internet banking have positive associations with their satisfaction with Internet banking, which lead to their Internet banking adoption. Moreover, the findings reveal that current users are more likely to continue with Internet banking if they are affectively committed to their banks; they are less likely to continue with Internet banking if they are calculatively committed to their banks due to the costs associated with leaving the banks. These therefore indicate the importance of establishing high-quality customer-bank relationships and placing less strict switching cost barriers that impose less pressure on their existing customers. This research contributes to the Internet banking adoption literature by (i) identifying the important category of Internet banking discontinued users, apart from current users and non-users; and (ii) using two complementary conceptual models, which are grounded in different theoretical streams, to investigate the relevant adoption behaviour of all three categories of Internet banking customers. It hence delivers a comprehensive understanding of personal customers adoption of Internet banking in China.

Full text
Abstract:
Background Health education programs that are aimed at improving individuals' skills to self-manage are increasingly recognised as a critical component of chronic disease management. Despite the apparent need for such interventions, current studies show inconsistent results regarding program effectiveness, with meta-analyses indicating only marginal effects for some disease groups. A closer examination of these studies however suggests that the magnitude and inconsistency of the findings may be related to the types of outcomes that were assessed rather than specific disease groups. Where self-report measures were used, results tended to be smaller and inconsistent. It is therefore possible that current studies do not adequately reflect program effects because self-report outcomes have a high risk to be confounded by a range of potential biases. Objective The aim of this thesis was to identify and quantify the potential influence of biases in the measurement of change in chronic disease self-management interventions using self-report. Methods The research design targeted the processes that individuals undergo when filling out questionnaires and whether this has an influence on their self-report outcomes. This was achieved by developing a three-group research design. The Health Education Impact Questionnaire (heiQ) was used to collect outcomes data. While pretest questionnaires were identical across groups, three questionnaire versions were randomly distributed at posttest. One of the groups filled out traditional posttest questions (n=331), whereas the other two groups were asked to provide data in addition to posttest questions, with one group providing transition questions (n=304) and one providing retrospective pretest data (n=314). Resulting datasets were further examined for possible confounding effects through response shift and social desirability bias. Through the random allocation of the heiQs it was ensured that data were not influenced by potential intra-group effects. Results The thesis revealed that the design of the posttest questionnaire significantly influenced people's ratings of their posttest levels. In particular, when participants were asked to provide ratings of their retrospective pretest levels in addition to their posttest levels, the latter scores were significantly higher than those of participants who did not perform this additional task. Subsequent analyses however suggested that these differences could neither be explained by response shift nor by social desirability bias. Conclusions This research has provided important insight into the measurement of outcomes of chronic disease self-management interventions. While the threat to the validity of traditional pretest-posttest data due to confounding effects through response shift and social desirability biases could not be supported, the thesis has highlighted that the cognitive task that subjects are asked to perform when providing data at posttest significantly influenced their self-reported outcomes. Given that previous research has predominantly focused on other aspects of validity - such as applying control group designs to circumvent common threats to internal and external validity - this study suggests that more attention must be paid to the design of questionnaires. The thesis concludes that further research, in particular into the influence of cognitive tasks on obtained scores, is important to improve the interpretation of self-report outcomes data derived from participants of self-management interventions.

Current multifaceted crises bring to light the importance of corporate responsibility in our society, thereby challenging a neoliberal tenet summarized by Milton Friedmand’s famous saying (1970): “The social responsibility of business is to increase its profits”.It is in response to these crises and thanks to the active role played by civil society who now condemns certain practices that the concept of corporate social responsibility (“CSR”) has emerged.Today’s challenge is thus to put in place a responsible marketplace between the company and its stakeholders. In the so-called Grenelle I Law, the French legislator specifies that mediation should be a toolto implement CSR.He therefore advocates the development of mediation as a procedural tool to implement CSR as an integral part of substantive law.Mediation, from both a preventive and a remedial perspective, is accordingly an instrument toimplement CSR.The CSR / mediation nexus successfully combines economic efficiency and social, societal and environmental respect

Abstract:
The demand for mediation, in which a neutral third party offers advice for resolving a problem, continues to increase steadily, especially in Europe, where European Directive 2013/11 grants consumers the right to access mediation to resolve disputes with sellers. With a series of six studies, this dissertation offers the first empirical demonstration that recourse to a mediator is a form of customer conciliatory behavior in a service recovery context. Customers with recourse to a mediator look specifically for its neutrality. The mediator’s perceived neutrality then has a moderating effect on the relationship between the service recovery response by the mediator and the customer’s behavioral outcomes (loyalty and positive WOM), which is further mediated by the perceived procedural justice of the mediation process. Finally, the mediation status – external or internal – moderates the effect of the outcome on customer post-mediation loyalty. These findings encourage firms to leverage mediation resources strategically to win back customers, because mediation represents the last chance that the customer gives the firm to positively resolve the service failure

Abstract:
The monograph is a comprehensive study of the current practice of resolving cases on determining the place of residence of children, the procedure for communicating with them separately living parents and other relatives; restriction and deprivation of parental rights; on the departure of children outside the Russian Federation and return within the framework of the Convention on Civil Aspects of International Child Abduction of 1980, the Convention on Jurisdiction, Applicable Law, Recognition and Enforcement and Cooperation in relation to Parental Responsibility and Measures for the Protection of children of 1996.The relations that develop between the child and parents, the child and the court, parents and the court, as well as parents as parties to the process are analyzed. The central place is occupied by the study of the content of the concept of the best interests of the child as a guarantee of the protection of his rights and the vector of development of the current legislation. The cases of abuse of parental rights and improper performance (or non-performance) of parental duties, illustrated by current judicial practice, are considered. The analysis is presented: measures of family legal responsibility, including restriction and deprivation of parental rights in connection with non-execution of a court decision on the upbringing of a child; features of the application of principle 6 of the Declaration of the Rights of the Child in resolving disputes about the place of residence of children; the possibility of taking interim measures in disputes between parents about upbringing; the ratio of legal and psychological categories in child-parent relations in order to apply special knowledge; the procedure for conducting forensic examinations in these categories of cases. Finally, the possibilities of out-of-court settlement of some family disputes, including through mediation, are investigated. For a wide range of readers interested in the rights of the child. It will be useful for students, postgraduates and teachers of law schools.

Abstract:
This chapter considers the question of whether an arbitrator may also adopt a mediation function or whether the dual roles are antithetical. It tests that hypothesis by engaging in a cost-benefit analysis of differing scenarios when mediation is utilized in an arbitral context. The prime comparison is between parallel mediation with a separate neutral and the alternative of a dual-role neutral. The three key points are: there should be much more mediation occurring at the international level, regarding both potential and actual arbitral disputes; a commercially minded arbitrator concerned for the parties’ good faith should encourage mediation where appropriate, in particular, when an adjudicated outcome will not be in the interests of either, usually because the dispute is a small part of a long-term relationship that can risk that relationship no matter who wins; and, while informed party autonomy should always support a dual-role neutral, in most factual permutations, informed parties could be expected to prefer parallel mediation provided there is full cooperation between mediator and arbitrator. The chapter argues that the relative benefits of the use of dual-role neutrals would be greatly outweighed by the costs in fairness and efficiency, and the inevitable need for a sub-optimal design of either or both dispute processes. The benefits would also be separately outweighed by the risks of significant disruption to any ensuing arbitration if a dual-role neutral fails to achieve a settlement.

Abstract:
This chapter discusses the extent to which there is any conflict or harm in the ICC Prosecutor’s involvement in cases undergoing mediation by the international community, most of which are currently in Africa. The ICC Prosecutor’s discretion, as per the Court’s Statute, to hold a prosecution in abeyance in anticipation of the outcomes of mediating efforts which aim at ending a conflict is at best ambivalent. Recent practice suggests that stakeholders engaged in ending long-running African conflicts prefer the Prosecutor to decline to exercise jurisdiction in order to encourage the parties to reach some agreement. For obvious reasons, discussions on such matters are often held confidentially and not in the context of official debates. The African experience with the peace–justice nexus shows that the peace-versus-justice debate has not been resolved in favour of any camp.

Abstract:
Among the “higher” functions, language and its cerebral networks is the most intensively explored through behavioral or clinical studies and, more recently, through functional neuroimaging. From the former studies, several models (only partially congruent) have emerged during the past three centuries regarding the organization and topography of the brain mechanisms of the acoustic, phonological, semantic, syntactic, and pragmatic operations in which psycholinguists have divided the language function. The main task of this chapter is to extract from the vast functional neuroimaging literature of language reliable evidence that would be used to disconfirm the various hypotheses comprising the current language models. Most of these hypotheses concern the anatomical structures that could be considered nodes or hubs of the neuronal networks mediating the above-mentioned linguistic operations. Using the same criteria, the authors present neuroimaging evidence relevant to the issue of the neuronal mediation of sign languages, reading, and dyslexia.

Abstract:
Chapter 1 offers a vista over the terrain of public Islam in Turkey. The chapter delineates four public mediations of Islam in contemporary Turkey: statist/bureaucratic Islam, mass Islam, partisan Islam, and consumerist Islam. After an excursion/excursus in Istanbul’s Taksim Square, it focuses on the Directorate of Religious Affairs and its statist vision of Islam as homogeneous and incontestable. Following this, it describes a rally organized by a right-wing Islamist party in Turkey in protest of the visit of Pope Benedict XVI in 2006. Next, it considers the increasing sway that partisan Islam and the AKP (in Turkish, the Justice and Development Party/Adalet ve Kalkınma Partisi) have on public images of Islam generally. Finally, the chapter concludes with an interview with the editors of a prominent Muslim fashion magazine, which is also a preeminent expression of consumerist Islam.

Alternative dispute resolution (ADR), particularly mediation, plays a key role in reducing the costs of civil disputes by fomenting the early settlement of cases. This chapter discusses ADR processes; advantages or disadvantages of ADR and litigation; the cost of ADR; reference to ADR; and court involvement in ADR. Adjudicative ADR results in the third party neutral deciding the dispute or difference between the parties. Non-adjudicative ADR processes involve moving the parties towards reaching a compromise agreement between themselves. Rules of court require parties to consider using ADR. Sanctions may be imposed on parties who act unreasonably.

Abstract:
"The idea of Internet use as a way to face psychosocial malaise is growing in the scientific literature about Problematic Internet Use (PIU). The present study, assuming the Semiotic Cultural Psycho-social Theory (SCPT) (Salvatore, 2018) as theoretical framework, postulates and emphasizes that the context in which the subject is embedded provide the symbolic resources, which ground the way adolescents perceive, experience, and therefore deal with the material and social world, including the likelihood of using the Internet as a way to facing life problems and difficulties. SCTP adopts the term “Symbolic Universes” (SU) to denote affect-laden assumptions concerning the world which may (or not) promote adaptive responses. Specifically, the present study aimed to test a mediation model in which each Symbolic Universes (i.e. independent variable) is associated with the psychosocial malaise in terms of social anxiety, loneliness, and negative emotions (i.e. mediator variable), which in turn has effects on PIU (i.e. dependent variable). Measures of PIU (GPIUS), symbolic universes (VOC), negative affect (PANAS), social anxiety (IAS), loneliness (ILs) among a total of 764 Southern Italy youths aged from 13 to 19 (mean age =15.05 ± 1.152). A Multiple Correspondence Analysis (MCA) was firstly run to detect SU; a Partial Least Squares Structural Equation Modelling (PLS-SEM) was then performed on R for testing the hypothesized mediation model. The results demonstrated that Symbolic Universes characterized by anomie and unreliability of the social context are associated with adolescents’ PIU though the mediation of social anxiety, loneliness, and negative emotions. Overall, findings suggest that within an anomic and unreliable scenario, PIU might acquire the meaning of a way to face life in an environment that seems meaningless, uncertain, and detrimental. On the plane of intervention, this points to the need for programs that address social and cultural influences in youths’ Internet use."

Abstract:
Aim/Purpose: Board of Directors seek to use their big data as a competitive advantage. Still, scholars note the complexities of corporate governance in practice related to information security risk management (ISRM) effectiveness. Background: While the interest in ISRM and its relationship to organizational success has grown, the scholarly literature is unclear about the effects of Chief Technology Officers (CTOs) leadership styles, the alignment of the governance of big data, and ISRM effectiveness in organizations in the West-ern United States. Methodology: The research method selected for this study was a quantitative, correlational research design. Data from 139 participant survey responses from Chief Technology Officers (CTOs) in the Western United States were analyzed using 3 regression models to test for mediation following Baron and Kenny’s methodology. Contribution: Previous scholarship has established the importance of leadership styles, big data governance, and ISRM effectiveness, but not in a combined understanding of the relationship between all three variables. The researchers’ primary objective was to contribute valuable knowledge to the practical field of computer science by empirically validating the relationships between the CTOs leadership styles, the alignment of the governance of big data, and ISRM effectiveness. Findings: The results of the first regression model between CTOs leadership styles and ISRM effectiveness were statistically significant. The second regression model results between CTOs leadership styles and the alignment of the governance of big data were not statistically significant. The results of the third regression model between CTOs leadership styles, the alignment of the governance of big data, and ISRM effectiveness were statistically significant. The alignment of the governance of big data was a significant predictor in the model. At the same time, the predictive strength of all 3 CTOs leadership styles was diminished between the first regression model and the third regression model. The regression models indicated that the alignment of the governance of big data was a partial mediator of the relationship between CTOs leadership styles and ISRM effectiveness. Recommendations for Practitioners: With big data growing at an exponential rate, this research may be useful in helping other practitioners think about how to test mediation with other interconnected variables related to the alignment of the governance of big data. Overall, the alignment of governance of big data being a partial mediator of the relationship between CTOs leadership styles and ISRM effectiveness suggests the significant role that the alignment of the governance of big data plays within an organization. Recommendations for Researchers: While this exact study has not been previously conducted with these three variables with CTOs in the Western United States, overall, these results are in agreement with the literature that information security governance does not significantly mediate the relationship between IT leadership styles and ISRM. However, some of the overall findings did vary from the literature, including the predictive relationship between transactional leadership and ISRM effectiveness. With the finding of partial mediation indicated in this study, this also suggests that the alignment of the governance of big data provides a partial intervention between CTOs leadership styles and ISRM effectiveness. Impact on Society: Big data breaches are increasing year after year, exposing sensitive information that can lead to harm to citizens. This study supports the broader scholarly consensus that to achieve ISRM effectiveness, better alignment of governance policies is essential. This research highlights the importance of higher-level governance as it relates to ISRM effectiveness, implying that ineffective governance could negatively impact both leadership and ISRM effectiveness, which could potentially cause reputational harm. Future Research: This study raised questions about CTO leadership styles, the specific governance structures involved related to the alignment of big data and ISRM effectiveness. While the research around these variables independently is mature, there is an overall lack of mediation studies as it relates to the impact of the alignment of the governance of big data. With the lack of alignment around a universal framework, evolving frameworks could be tested in future research to see if similar results are obtained. *** NOTE: This Proceedings paper was revised and published in the journal Issues in Informing Science and Information Technology, 18, 41-61. The process of overcoming a conflict in mediation using constructivist ideas is revealed in the study. A mediator’s roles in the frame of the constructivist approach represent the topicality of the study. The mediator’s role is analysed and the emphasis is on the constructivist frame. The mediator’s pedagogical role is in the centre of the study. In the process of the study, the aim was to find out theoretical explanations of the meaning of the constructivist approach in mediation, how it occurs and what is the role of mediator in the mediation process based on dialogue? The methodology of the study comprises a theoretical assessment of the role of the mediator based on a constructivist approach with a purposeful emphasis on a dialogue between parties. The mediator facilitates a dialogical mediation process being also a pedagogue who helps the parties to learn how to keep a dialogue. Analysis of the mediator’s role and the usage of D.A. Kolb’s learning types in the stages of mediation are the main results of the study. The significance of the study implies a substantiation of various roles of the mediator, constructivist approach with the emphasis on the dialogue and implementation of D.A. Abstract:
This study purposes to identify the relationship between gross domestic product (GDP) and natural resources abundance, focusing on the mediator roles of governance indicators for selected 21 MENA and Caspian countries. Governance indicators used in the study are World Bank’s six global governance indicators. Annual panel data for the period of 1996-2012 are used. In this context, the study estimates the impact of crude oil production per capita (independent variable) on GDP per capita (dependent variable) at first, and then hierarchical panel regression analyses are conducted to determine the mediator variable roles of the governance indicators in this relationship. Sobel test is also applied to confirm whether the mediation effect is significant. Results from the pairwise panel regression analyses reveal that crude oil production per capita is negatively associated with all worldwide governance indicators, mostly with control of corruption, voice and accountability and regulatory quality. The progressive improvements of all dimensions of governance indicators, especially control of corruption, rule of law and government effectiveness, seem to promote GDP per capita. Results from the hierarchical regression analysis demonstrate that governance indicators play an important role as a partial mediator in the relationships crude oil production and GDP per capita. This evidence supports that weak governance indicators tend to hinder natural resources abundance to contribute economic growth. Overall findings highlight the increasing importance of policies intending to reduce corruption and violence, together with stimulating legitimacy, transparency and institutional quality for the countries investigated.

The article is devoted to the study of problematic aspects of the implementation of the mediation procedure in Russia. The author noted that mediation on the path of its development in the country encountered a number of obstacles of a moral, ethical, psychological, economic and legislative nature, the solution and settlement of which requires certain efforts both from the side of society and public organizations, and from the state. Using the method of analytical review of theoretical and practical developments of domestic researchers and legislative documents, the article identifies the following problems of mediation: low legal culture of the population; lack of confidence in this service; lack of awareness of society as a whole, and of citizens in particular, about mediation, its advantages as an alternative to the trial method; the position of the parties that do not want to compromise; the difficulty of choosing a mediator - as a highly professional person; mainly the social foundations for the development of mediation and insufficient state support. These problems are interrelated, therefore, their solution requires an integrated approach.

The new legal figure of a "health mediator" is analyzed, the rights and obligations that are normatively regulated, the benefits and the needs for optimization of the regulation. The results of the analysis are summarized and specific conclusions "de lege ferenda" are proposed.

Abstract:
This Helpdesk Report is part mapping of the mediation and peacebuilding actors in Tunisia and part review of the available literature. There are a host of governmental and non-governmental organisations (NGOs) that are involved in the mediation of conflicts and peacebuilding, both in formal and informal ways. There is overlap in the principles and goals of peacebuilding and mediation; many organisations conduct both practices, intermingling them. Local, regional, national and international actors have applied mediation and peacebuilding to many different types of conflict in the past decade in Tunisia, involving varied parties. The case studies included in this rapid review cover conflicts relating to labour and the economy, the environment, basic services, constitutional/political disputes, and women’s rights. They involve local communities, the unemployed national and regional trade unions, civil society organisations (CSOs), national utility and mineral companies, and political parties.
