Full textThe research questions the configuration of participatory democracy as a corrective for the shortcomings of representative democracy; in particular, it concerns the study of the mechanisms of citizen participation in the political-administrative choices of the institutions. In the introductory chapter, the work focused on the current condition of contemporary democracies, recovering the notions of radical concepts and liberal constitutionalism; subsequently the somatic characteristics of participatory phenomena were analyzed, in order to reconstruct a legal model of the same based on empirical circumstances; then a survey of the participatory principle in the Italian legal system was carried out: it began with the constitutional provision; then the state and regional regulations were examined, to arrive at the analysis of the consultative phenomena and the outstanding administrative practices; in the final chapter we tried to draw the conclusions of the research, with reference to the existence and content of the principle of citizen participation.

Full textThe research aim was to investigate the experiences of people and families who are experiencing the early stages of dementia, in order to understand which specific helps could be provided to support people, with their particular needs, in this first and delicate phase of the disease. Considering its field of investigation and its object, this research has been particularly suited to the application of the participatory research methodology. The research in the entire research process has actively involved people who have a direct, personal or job-connected experience of the disease. Tools as a semi-structured interview and a diary has been used to investigate the point of view of family caregivers and their elderly relatives with cognitive impairment. The results obtained have been multiple, heterogeneous and allowed us to understand the experiences of the family caregivers and of the subjects who face the disease directly. These results have been divided by different areas and have been organized using concept maps. Six maps have been focusing on the point of view of the caregivers and four maps focusing on the experience of the elderly. The results allowed the researcher to understand different elements: what caring means for the caregivers and what to be assisted means for the elderly with cognitive impairment; the attitudes and emotions of both players about the disease; the role of the family and other significant figures in this situation; the relationship with the services and how families face this problem.

Full textThe recent emergence of many urban practices that, by claiming the right to the city, build conflictual experiences with the aim of redefining urban policies and the pattern of living, show the clash between a management model of a city that responds to neoliberal logic, perceived increasingly distant from the needs of the inhabitants, and a scheme that, by scrambling elements, places the will of the people at the center, enhancing its protagonism not only in terms of demands but also activism. The movements studied here are therefore particularly interesting to understand how, at a historical moment in which participation in institutional politics is at the lowest of historical times, there is the construction of spaces of interaction between individuals who remember the public sphere of Habermasian memory and allow to redesign a a new way of doing politics and being a citizen. The new urbanization phase is also producing extraordinary transformations in lifestyles. The quality of urban life, and the city itself, have become a commodity reserved to those who have the money in a world where consumerism, tourism, the culture and knowledge industry and the continued use of the economy of the show have become the main aspects of the urban political economy and the growing polarization in the distribution of wealth and power are indelibly impressed in the spatial forms of cities, increasingly built by fortified sites, closed communities and privatized public spaces held under continuous surveillance. The right to the city, reaffirmed by the movements here studied, is therefore much more than a right of access, individual or group, to the resources that the city incarnates: it is the right to change and reinvent the city more in accordance with the needs of citizens . Investigating these movements, trying to capture the main characters, modes of action and goals is therefore particularly important for the role they play within the political arena in which the city is defined. Starting from these reflections, this work analyzes two experiences, the Housing Committee of San Siro in Milan and Can Batlló in Barcelona, who through their practices claim the right to the city. The question we have is whether they have changed perspective and have turned from re-active, that is, they are born as a response to individual change events and in opposition to some proactive policies, that is, able to propose modality In fact, we are convinced that only through this passage a social movement can embody the role of an agent of historicity and operate a class re-composition, understood by Touraine, in which the individual, while maintaining his own identity, is recognized in a wider collective identity and capable of affecting dominant cultural models.

Full textThis paper introduces research on young carers in an Italian context. This topic describes the issue of caregiving performed by children. The activities of care begin when one family member has a chronic illness or disability and there are no alternatives for coping with these difficulties. There are many factors associated with the issue of absence of alternatives, such as: few financial resources, a weak informal support network (relatives, friends and neighbors) and insufficient aid from social and health services. Even if the phenomenon has been studied in different countries, it has not been widely investigated in Italy. There are two possible explanations for this lack of research: the Italian welfare system and the concept of childhood. In Italy welfare is familistic. It means that the State has only a residual role in providing resources or services to support citizens. Furthermore, families are mandated to provide care by themselves. One would argue that the work of care is usually associated with adult figures, in particular women, but not with minors. As the new sociology of childhood suggests, this happens because minors are considered without autonomy and their own agency and dependent on adults. . Since they are identified as a hidden group, it makes them hard to reach. In order to overcome this obstacle, a participatory approach has been used in a research on Italian young carers. Its aim was to engage people who are traditionally considered objects of research to enhance the knowledge about this topic. This way the objects of research become actors and acquire the role of co-researchers. This inversion of prospective is possible only by recognizing co-researchers being “experts by experience”, since their “experiential knowledge” comes from experiencing everyday life problems. The co-researchers work together with a researcher in a “Steering group”, which carry out the design of research and analyse the data. Inside a “Steering group”, the co-researchers develop awareness, rework their identity and mature their need for social change. The issue of this research project was analysed with a mixed-method research with three levels of analysis. Firstly, a secondary analysis on Istat data (multipurpose survey on “Aspects of life”- 2015) was useful to understand the characteristics of children and teenagers and to compare foreign verses Italian families and the differences between northern and southern Italy. Secondly, a survey in middle schools in Milan, was helpful to understand the outcomes connected to the child’s role. Lastly, focus groups were organised with young carers, in which the aim was to understand their needs, awareness and the perceptions of young caregivers. Italian young carers have the same characteristics as other young carers world-wide. The phenomenon is hidden and unrecognized. Consequently, young carers and their families lack recognition and welfare provision. The analysis shows the activities that young carers provide in their family: instrumental and care-related. The outcomes are connected to school, peer relations and personal wellness and sometimes to mental health problems.

Full textThis thesis, carried out under the mandate of CTA Milan, shows the results of a participatory research on the process of reconstruction of pre-adoptive history by Italian adult adoptees. According to the participatory model, four experts by experience were involved in a research group (steering group), and work in tandem with the researcher on all the research project. Integrating researcher’ s technical skills with experiential skills of co-researchers, we defined the research question and decided to use semi-structured interviews to collect data. Text analysis of the transcripts of the 16 interviews carried out, was also made in the steering group, according to the literature review and to the personal experience of co-researchers. The interviews analysis shows the whole complexity of the origins’ research process: what is the meaning of origins’ research in the view of adoptees; how Italian adoptees try to find the identity of their birth family; by whom they have been supported during this research process; the relationships with adoptive family, with other people who live adoptive experiences, with the Juvenile Court and social workers. With these results we could learn more about origins’ research and provide significant suggestions on how adopted people could be supported in their experience of research.

Full textThe research explores the issue of the involvement of people with intellectual disabilities in planning social interventions for themselves. The research focuses on the participation experience of young people with intellectual disabilities (from 18 to 35 years) and on the social workers’ role: 42 young people with ID and 15 social workers participated in the focus groups conducted. The research was conducted by adopting the participatory approach: from the definition of the research questions to the return of the results, the research process was shared with three people with intellectual disabilities. The research reveals an in-depth and specific knowledge on the link between participation and self-determination in this field of social work. The data collection also highlighted the difficulties faced by young people with disabilities and social workers in the implementation of helping processes. Research results offer a contribution to the reflection on the methodological challenges proposed by the application of people with disabilities’ right to participate to social workers working in this field. The discussion of the results in the light of the literature on the subject allows to outline a change of approach to social work with people with intellectual disabilities, more focused on their intents and aspirations.

Full textThe purpose of this doctoral thesis is to present the participatory research approach from the theoretical point of view and to show a practical application. The participatory research is an unconventional research approach that involves as co-researchers in the conduction of the research and in the decision-making process those who are usually the object of the research itself. The first part of the thesis is devoted to the theoretical presentation of the participatory research, whose the characteristics, the origins and the principles are outlined. The phases of the research approach are then analyzed and the ethical aspects and dilemmas of the theme of participation are explored. The description starts from international literature in the field of social work, where participatory research is particularly widespread. At the same time, the Relational Social Work Method, a new epistemological framework for Social Work developed in Italy in recent years, is presented. Its founding principles and its operating practices have particular similarities with the characteristics of participatory research and may provide ideas and prompt reflections useful for the researchers who want to implement this approach. In the second part of the dissertation, there is a practical application of the participatory research approach in the field of poverty. The phases of this practical research path, implemented between 2015 and 2017 in the city of Reggio Emilia, are described. Given the purpose of the thesis, the emphasis is placed on the methodological aspects of such experimentation, by describing the research path followed and by highlighting the potentialities and limitations. In conclusion, a description of the usefulness and the added value that participatory research can provide to the field of Social Work and the future of research in this field is given.

Full textThe expectancy of patient living with chronic disease has improved significantly in the recent years due to advances in medical sciences. To address the burden of this growing demand of care, patient engagement is considered crucial as it contributes to improve health outcomes and control healthcare costs. However, many gaps still exist for its implementation starting from the lack of a shared definition and shared guidelines for medical practice based on the direct patients' care experience. In the light of this premises this dissertation will propose a sequential research design generally aimed at improving the knowledge and understanding of patient engagement and its implications for the medical practice and professionalism. To answer the overall aim of this thesis both literature reviews and qualitative methodology were used. Chapter 1 was aimed to set scene and give the readers an overview of the global cultural and societal scenario that justifies the need to deal with the topic of patient engagement. Chapter 2 and 3 consist in in-depth literature reviews aimed at shading light on the concepts featuring the participatory medicine movement and, more specifically, the one of patient engagement. An in-depth qualitative study according to the grounded theory principles was conducted and reported in chapter 4 and was aimed at deepening the heart failure patient’s perspective towards engagement in their care in order to build and experience-based model of this phenomenon. The last two chapters, based on the insights emerged from both the literature analysis and the grounded theory study, were aimed at discussing the implications of patient engagement for the clinical decision making process (chapter 5), and for training health professionals in patient engagement strategies and improving the effectiveness of their communication and relational habits with this aim (chapter 6).

Full textPartecipazione di migranti alle politiche pubbliche per lo sviluppo locale. I casi di Lisbona e Padova Le migrazioni contemporanee in Europa sono fenomeni strutturali che producono effetti significativi nei territori. Legati in primo luogo a variabili economiche e geopolitiche transnazionali, possono difficilmente essere governati, controllati o limitati. Tuttavia, politiche pubbliche a livello comunitario, nazionale e locale avviano misure di accompagnamento delle migliaia di persone che si muovono. Le difficoltà intrinseche incontrate per realizzare i loro obiettivi sono spiegate dall'autore applicando la teoria di Boaventura Sousa Santos (1994, 2000, 2002, 2006) relativa alla fase turbolenta di transizione paradigmatica vissuta dalla modernità occidentale. Letta nella dimensione migratoria, la crisi moderna riproduce la stessa opposizione tra principi regolativi, che danno priorità all'inclusione dei/delle migranti in un ordine sistemico (sociale, politico e territoriale), e principi emancipatori che ne valorizzano l’eterogeneo e articolato contributo alla società europea. Perché la modernità esprime questa ambivalenza nell'approccio europeo alla migrazione internazionale? Quali sono le implicazioni per le politiche pubbliche? Quali sono gli effetti sociali di queste scelte? Grazie a un approfondito lavoro di archeologia ermeneutica, l'autore fa emergere le radici moderne dei modelli egemonici di politica migratoria in Europa. Questi, anche se esprimono un generale dominio dei principi regolativi su quelli emancipatori, presentano tensioni transparadigmatiche che producono sistemi ibridi e che l'autore raggruppa in tre coppie: integrazione <-> intercultura, rappresentazione <-> partecipazione e sviluppo-senza-migranti <-> sperimentazione-con-i/le-migranti. Da questo confronto tra policies contrastanti l'autore spiega, da un punto di vista epistemologico, le diverse misure legislative prodotte da ciascun Paese membro. Permane comunque l’interrogativo: perché, a dispetto di modelli generali moderni, il trattamento legislativo verso gli/le immigrati/e è diverso da Paese a Paese? Per rispondere a questa domanda, l'autore analizza l'adozione di politiche migratorie in due paesi dell'Europa meridionale, Portogallo e Italia. Di questi contesti, sono ricostruiti i conflitti epistemologici, legati al cambiamento di paradigma, in termini di politiche nazionali e in quattro esperienze innovative di governance locale delle aree urbane e peri-urbane di Lisbona e di Padova. Per studiare i contesti nazionali e locali, l'autore ha condotto numerosi interviste, focus group e osservazioni dirette in un lavoro sul campo durato due anni che ha messo a fuoco la partecipazione dei/delle migranti in arene rappresentative per lo sviluppo locale. I risultati svelano l’esistenza di conflitti locali in cui lo scontro tra i principi egemonici e contro-egemonici ricombina forme di inferiorizzazione dei/delle migranti di origine coloniale, mentre emergono pratiche di trasformazione sociale e solidale. In tal senso, lo studio descrive la presenza di fenomeni contraddittori che spesso appaiono ibridati negli organismi comunali: da un lato, l'esistenza di condizioni di subalternità, oggettivazione dell’altro, sofferenza umana, paura e insicurezza; dall’altro, la condivisione di soluzioni innovative nella gestione della governance locale capaci di potenziare le forme di soggettivizzazione dei/delle migranti. Le conseguenze sociali di queste turbolenze comportano esclusione sociale, segregazione politica e frammentazione territoriale che, secondo l'autore, non avvengono solo nella dimensione migratoria ma, attraverso una funzione di derivazione paradigmatica, si estendono ad altri gruppi sociali (giovani, donne, anziani/e, lavoratori/trici precari/e). Che atteggiamento tenere davanti ai conflitti? Cosa può concretamente fare un dottorando per cercare di ridurli? Dopo un'attenta comparazione dei contesti (Messina, 2012), l'autore adotta apertamente l'obiettivo di contribuire a contrastare instabilità, conflitti e violenze. In conclusione, dall'interazione tra attori e attrici emergono meccanismi generici di relazioni sociali (Guerra, 2006) che permettono di individuare le più importanti pratiche di emancipazione e solidarietà locali emerse. Da questo lungo lavoro di analisi di contenuto, l'autore presenta una serie di proposte tecniche, politiche e metodologiche finalizzate alla diffusione di un clima di fiducia e di solidarietà che considera funzionale all'adozione di politiche di risoluzione dei conflitti e di rafforzamento della coesione sociale, politica e territoriale.

Full textParticipatory Budgeting (PB) is probably the most famous and interesting example of innovative local governance for its redistributive and democratic effects. Due to the direct involvement of citizens in the decision-making process, PB is celebrated as an example of direct democracy which can help to deal with the limits of representative democracy. However, on closer analysis, it is possible to identify elements of representation in its functioning, which are taken into little consideration and which could probably modify the prevalent theoretical belief. In fact, as citizens usually participate through their groups and associations, new representatives emerge challenging the traditional channels of political representation in terms of popular approval, consensus, hence legitimacy. This work aims to go beyond the prevailing narrative and propose an original interpretation of the PB’s institutional model as a new and alternative representative democracy, where the main political actors become organizations from the civil society: behind PB there seems to lie a sort of ‘civil’ democracy. Hence, introducing this alternative viewpoint can, not only further questions which are never fully considered in the literature, but also open interesting scenarios in the debate over the crisis of liberal-democratic institutions and the role and the identity of civil society.

La Filosofia del Diritto Processuale cerca la rassegnazione delle dinamiche Processuale in modo che il può servire come spazio democratico per la creazione di diritti dai fenomeni conflittuali degli interessi. La tesi è giustificata nell'incapacità del processo tutelare debitamente alla destra in un periodo di incertezze e produzione incessante di nuove complessità. Ha lo scopo di delimitare una nuova giurisdizione per il processo come una vocazione del nostro tempo, collocata in uno Stato Active-Responsive che centralizza la politica in democrazia partecipativa e in cui i cittadini attivi cercano il riconoscimento e l'emancipazione con il processo civile attraverso la governance processuale. Per questo, usato come metodo l´ermeneutico fenomenologico, con il quale il fenomeno conflittuali degli interessi è stato concepito come naturale alle confluenze dell'essere e del diritto come un adattamento esistenziale per accompagnare le dinamiche dell'esistente. L'ermeneutica fenomenologica delimita nel Processo la comprensione operata dal gioco dialettico-dialogico capace di legittimare democraticamente la norma individuale e di svelare il caso concreto. L'ipotesi della tesi è che la centralità nella giurisdizione evidenzia un sistema basato solo sulla democrazia rappresentativa, cause della predominanza di un'operazione logico-matematica nello diritto (teoria del fatto giuridico) o il predominio della filosofia della coscienza (solipsismo giudiziario) impedendo il potenziale della democrazia partecipativa. Il passaggio dalla giurisdizione al processo mostra che lo Diritto è di più ampio che la Legge e che il conflitto esprime la dinamica umana come una fonte di Diritto Vivente. La genesi dello Diritto è il fenomeno conflittuale di interessi, un riflesso della democrazia partecipativa e la creazione di Diritto Obiettivo Processuale, per l'interpretazione e per la creazione del testo. Le dinamiche processuali è lo spazio per discussione, in modo che penetrino nei vari fenomeni e che abbia come fito la decisione giudiziaria come legittimità procedurale democratica. Gli istituti processuales sono ridefiniti dalla Costituzionalizzazione dello Diritto e dalla democratizzazione della democrazia, con la fusione di orizzonti tra auctoritas (funzione giurisdizionale) e amministrazione di giustizia (o di funzione processuale) potestas, avere come effetto il passaggio necessario dallaGiurisdizione al Processo.
A Filosofia do Direito Processual busca a ressignificação da dinâmica processual para que o Processo possa servir de espaço Democrático para criação de direitos a partir dos fenômenos conflitológicos de interesses. Justifica-se a Tese na incapacidade do processo tutelar devidamente o direito em uma época de incertezas e de produção incessante de novas complexidades. Objetiva-se demarcar uma nova Jurisdição pelo Processo como Vocação de nossos Tempos, posto em um Estado Ativo-Responsivo que centraliza a política na Democracia Participativa e por onde os cidadãos ativos buscam reconhecimento e emancipação com o Processo Civil através da governança processual. Para tanto utiliza-se como Método a hermenêutica fenomenológica, pela qual o fenômeno conflitológico de interesses foi concebido como natural às confluências do ser e o Direito como adaptação existencial para o acompanhar da dinâmica do existir. A hermenêutica fenomenológica demarca no Processo a compreensão operada pelo jogo dialético-dialogal capaz de legitimar democraticamente a norma individual e desvelar o caso concreto. A Hipótese da Tese é a de que a centralidade na Jurisdição evidencia um sistema baseado apenas na Democracia Representativa, ocasionadora do predomínio de uma operação lógico-matematizante no direito (teoria do fato jurídico) ou o predomínio da filosofia da consciência (solipsismo judicial), tolhendo a potencialidade da Democracia Participativa. Já a passagem da Jurisdição ao Processo evidencia que o Direito é mais amplo que a Lei e que a conflitualidade expressa a dinamicidade humana como uma fonte de Direito vivo. A gênese do Direito é o fenômeno conflitológico de interesses, reflexo da Democracia Participativa e da criação de Direito Objetivo Processual, pela interpretação e pela criação do texto. A dinâmica processual é espaço para debates, para que adentrem os vários fenômenos e que tem por fito a decisão judicial como legitimidade democrática processual. Os institutos processuais são ressignificados pela Constitucionalização do Direito e pela democratização da Democracia, com a fusão de horizontes entre auctoritas (função jurisdicional) e pela administração da justiça (ou função processual) potestas, tendo como efeito a necessária passagem da Jurisdição ao Processo.

Full textThe work addresses the issue of equity and non-equity financial instruments that can be issued by a joint stock company, in the light of the provisions introduced by the reform of the company law. The study is intended to provide a systematic classification of these modes of financing compared to dichotomy shares-bonds, also on an accounting prospective, then detecting the resulting implications in terms of the applicable rules. Addressing the debate on the overall placement of hybrids securities compared to traditional forms of financing it goes to the view that all financial instruments cannot be included in a unitary category, but it is necessary to maintain separate the equity financial instruments indicated by art. 2346, paragraph 6, of the Italian Civil Code from the other financial instruments pursuant to Art. 2411, paragraph 3. The distinctive connotation between equity and non-equity financial instruments is not identified in the allocation of administrative rights – which may not be allocated to the holders of the instruments referred to in Article 2346, paragraph 6 - but in the absence or in the presence of an obligation to repay the loan provided to the company. The work also examines various aspects of the discipline of both categories of instruments, focusing mainly on economic rights attributable to them, including the participation in the profits and losses and rights on liquidation. Finally, we examine the predictions recently introduced by dl n . 83/2012 regarding the bonds, in order to assess their impact on the overall discipline of the force. Particular attention is given to the new provisions relating to subordinated debt and / or equity investments that may be issued by unlisted companies, highlighting the critical issues regarding inter alia the possible participation in the profits of the issuer by the bondholders.
