Abstract:
The monograph is a comprehensive study of the current practice of resolving cases on determining the place of residence of children, the procedure for communicating with them separately living parents and other relatives; restriction and deprivation of parental rights; on the departure of children outside the Russian Federation and return within the framework of the Convention on Civil Aspects of International Child Abduction of 1980, the Convention on Jurisdiction, Applicable Law, Recognition and Enforcement and Cooperation in relation to Parental Responsibility and Measures for the Protection of children of 1996.The relations that develop between the child and parents, the child and the court, parents and the court, as well as parents as parties to the process are analyzed. The central place is occupied by the study of the content of the concept of the best interests of the child as a guarantee of the protection of his rights and the vector of development of the current legislation. The cases of abuse of parental rights and improper performance (or non-performance) of parental duties, illustrated by current judicial practice, are considered. The analysis is presented: measures of family legal responsibility, including restriction and deprivation of parental rights in connection with non-execution of a court decision on the upbringing of a child; features of the application of principle 6 of the Declaration of the Rights of the Child in resolving disputes about the place of residence of children; the possibility of taking interim measures in disputes between parents about upbringing; the ratio of legal and psychological categories in child-parent relations in order to apply special knowledge; the procedure for conducting forensic examinations in these categories of cases. Finally, the possibilities of out-of-court settlement of some family disputes, including through mediation, are investigated. For a wide range of readers interested in the rights of the child. It will be useful for students, postgraduates and teachers of law schools.

Abstract:
Parents with disabilities face widespread obstacles arising from social attitudes about disability. Yet having and raising children is highly valuable for many people, with or without disabilities. Common stereotypes are that people with disabilities are less fit than others to be parents and that their children are likely to have worse lives than other children. These stereotypes are reflected in the history of eugenics, in sterilization laws, and in legal decisions about custody and parental rights. Yet justice requires that people with disabilities have access to a fair share of resources to pursue their aims and projects, which may include having children. Parental fitness must be assessed without bias and with the recognition that parenting may be performed in different ways, including adaptive strategies and accommodations. Parents with disabilities can provide special benefits as well, including bonds of proximity, greater patience and self-reliance, and compassion for others.

Abstract:
Most people believe that parents have moral rights and responsibilities regarding their children. These rights and responsibilities undergird the nuclear family and are essential to the flourishing of its members. However, their basis and contents are hotly contested. Do a child’s genetic parents have a right to parent her? Many people’s gut responses affirm the importance of genetic ties, but the moral justification for tying parental rights to genetics is unclear. Parents are permitted to make far-reaching decisions about their children’s medical care, education, religious practice, and discipline. When can parental rights be limited by the interests of the child or of society? Matters are no more settled regarding parental responsibilities. A man who conceives a child through voluntary sexual intercourse is commonly thought to acquire parental responsibilities, even if he took every precaution against conception. Yet sperm donors are widely thought to have no responsibilities toward their progeny. What underlies these disparate judgments? Parents are expected to do a lot for their children. But there are surely limits. Sometimes parents must balance the needs of multiple family members or just want time for themselves. What is the extent of parental responsibilities? This book provides a philosophical account of the foundations of moral parenthood. It explains how parental rights and responsibilities are acquired, what those rights and responsibilities consist in, and how parents should make decisions for their children. In doing so, it provides a set of frameworks to help solve pressing ethical dilemmas relating to parents and children.
