Abstract:
This chapter comments on Article of the Rome Statute of the International Criminal Court. Article 91 deals with the content of a request to a State for arrest or surrender of a person wanted by the Court. It consists of four paragraphs, of which the first addresses the contents of the request and any supporting documentation. The two subsequent paragraph distinguish between a request concerning a person for whom a warrant of arrest has been issued (paragraph 2) and one for a person who has already been convicted (paragraph 3). Paragraph 4 provides for consultations between the Court and the State Party.

Abstract:
This chapter comments on Article 27 of the Rome Statute of the International Criminal Court. Article 27 consists two paragraphs that are often confounded but fulfil different functions. Paragraph 1 denies a defence of official capacity, i.e. official capacity as a Head of State or Government, a member of a Government or parliament, an elected representative or a government official shall not exempt a person from criminal responsibility under the Statute. Paragraph 2 amounts to a renunciation, by States Parties to the Rome Statute, of the immunity of their own Head of State to which they are entitled by virtue of customary international law. In contrast with paragraph 1, it is without precedent in international criminal law instruments.

Abstract:
Principle 6 is concerned with the establishment and role of truth commissions, outlined in two paragraphs. The Principle recommends criteria that can be applied ‘to the greatest extent possible’. The first paragraph encompasses three different aspects of the issue: the preliminary ‘decision to establish a truth commission’, the subsequent creation of its ‘terms of reference’, and the related determination of its ‘composition’. In the second paragraph, the term ‘role’ refers to the functional end-goal that a commission is expected to serve: ‘securing recognition of such parts of the truth as were formerly denied’. After providing a historical and contextual background on Principle 6, this chapter discusses its theoretical framework and the ways in which the Principle is exercised in practice.

This chapter comments on Article 48 of the Rome Statute of the International Criminal Court. International organizations require privileges and immunities in order to facilitate their functions. Privileges and immunities are granted to individuals not for their own personal benefit, but to enable the institution to operate with expedience and independence. Article 48 consists of five paragraphs that deal with the privileges and immunities of the Court itself, of its judges and senior officials, its staff, and those who are actually involved in the proceedings, such as counsel, witnesses, and experts. The final paragraph provides for waiver of the immunity.

Abstract:
This chapter discusses Article 2 of the ATT. The article delineates the scope of the ATT, identifying the categories of conventional arms and types of activities that are formally subject to its provisions while specifying certain acts excluded from the treaty’s purview. Paragraph 1 describes the categories of arms to which the provisions of the treaty apply. It is not an exhaustive list, however, as Articles 3 and 4 identify two other categories—ammunition/munitions and parts and components—that are subject to some of the treaty’s provisions. The arms covered in sub-paragraphs (a) to (g) of paragraph 1 (i.e. battle tanks, armoured combat vehicles, large-calibre artillery systems, combat aircraft, attack helicopters, warships, missiles and missile launchers) were derived from the seven categories used in the United Nations Register of Conventional Arms (UNROCA) while an eighth category, small arms and light weapons, was added to the list in the ATT.
