Abstract:
The textbook contains a systematic presentation of the main institutions of banking law in accordance with the academic discipline "Banking Law", taught at the Department of Banking Law of the Moscow State Law University named after O. E. Kutafin (MSLA). It examines the banking system of the Russian Federation and its structure; the features of credit institutions as subjects of banking law; the legal basis of the national payment system, its relationship with the banking system of Russia; the legal regulation of the deposit insurance system; legislation on bank accounts; the main types of bank loans; currency transactions carried out with the participation of authorized banks, and operations of credit institutions in the securities market. Attention is paid to the ratio of electronic money with electronic means of payment, the mechanism of non-cash payments and the procedure for implementing the institute of payment clearing. The proposed diagrams and tables facilitate the assimilation of the most difficult questions.

Abstract:
This chapter categorizes the many modalities of transnational corruption within two groups — transactional and variance bribery. Transaction bribes are payments routinely and often impersonally made to a public official to secure or accelerate the performance of that official's duties. The payment is not made in order to secure the public official's divergence from a substantive norm. Instead, the payment is made simply to ensure that the public official performs his duty more efficiently, hence the term ‘grease money’ or the euphemism ‘facilitation payment’. Variance bribes involve payments made in order to obtain a favourable result through a deviation from the proper application of a norm. The bribe might be paid in order to suspend the operation of a legal prescription, or in order to have a public official exercise his discretion in a manner favourable to the payer.

Abstract:
This commentary analyses Article 7.4.11 of the UNIDROIT Principles of International Commercial Contracts (PICC) concerning the manner of monetary redress. According to Art 7.4.11, damages are to be paid in a lump sum. However, they may be payable in instalments where the nature of the harm makes this appropriate. Damages to be paid in instalments may be subjected to indexation. This provision was considered to be ‘the mode of payment best suited to international trade’. A lump sum payment enables the parties to settle their dispute, draw a line under their relationship (assuming the contract to have been terminated), and move on to new contractual relationships elsewhere. It also avoids the administrative burdens associated with periodical payments of damages.

This commentary analyses Article 6.1.12 of the UNIDROIT Principles of International Commercial Contracts (PICC) concerning imputation of payments. Art 6.1.12 addresses the problems that arise when the obligor has more than one debt with the same obligee but the sum paid is not sufficient to cover all debts. In that case, the obligee must know which of the several obligations are to be discharged. This commentary discusses the scope of application and taxonomy of Art 6.1.12 with regard to imputation of payments, the obligor's right to impute, the obligee's subsidiary right to impute, imputation by law, applicability of Art 6.1.12 in the case of partial payment, and burden of proof relating to imputation of payments.

This chapter discusses the case of Re Charge Card Services Ltd, which concerned the relationship between a company and a finance house that provided funds to it, pursuant to an invoice discounting agreement, by purchasing trade debts of the company. Under certain circumstances the company was obliged to repurchase trade debts, which it guaranteed would be paid. The accounting and payment system operating between the parties gave the finance house various rights to hold on to monies, make deductions from payments, and exercise set-offs. When the company went into liquidation, it was contended that certain rights of the finance house were void as against the liquidator because they constituted charges over book debts and they had not been registered as required under the Companies Act 1948.

Abstract:
Economic sanctions are court-imposed financial obligations aimed at punishing offenders (fines), funding the government (costs/fees, forfeitures), and compensating victims (restitution). This book examines economic sanctions in the United States, with a focus on the multilevel, multimethod research my students and I conducted in Pennsylvania. The 15 studies described in the book are multiplistic in terms of academic discipline (social psychology, criminology, law), levels of analysis (individual, county, state), actors within the system (victims, offenders, probation officers, district attorneys, judges), type of process involved (imposition, payment, rearrest), and research methods (analyses of state-level computerized archives, coding of county-level paper court and probation records, surveys of individuals, a field-experiment, and follow-up involving probationers). Most of the studies examined the imposition, payment, and effect of paying restitution. Research across methods indicated that offenders are often unable to pay their court-ordered sanctions, that restitution is generally not paid in full, and that both offenders and victims are responsive to procedural justice. Experimental results indicated that randomly assigned probationers delinquent in making payments who received letters informing them of the restitution amounts they owed were more likely to pay restitution and less likely to commit a new crime as compared to randomly assigned delinquent probationers who did not receive letters or who received letters giving them a rationale for payment. Three policy recommendations are made concerning what is fair and effective for victims, offenders, and society: (1) mandating restitution, (2) making fines contingent on ability to pay, and (3) ending the imposition of costs and fees.

This chapter comments on Article 114 of the Rome Statute of the International Criminal Court. Article 114 states that the expenses of the Court and the Assembly of States Parties, including its Bureau and subsidiary bodies, shall be paid from the funds of the Court. Article 114 has been described as an attempt to avoid a practice resulting from the United Nations Convention on the Law of the Sea whereby the Secretary-General pays for meetings of States Parties and other bodies out of the general budget. Thus, should the Secretary-General host meetings, any expenses incurred, for example for Secretariat services, must be paid by the Court, not the United Nations.

Abstract:
Bride price, a payment from the groom to the bride’s family at the time of marriage, is a common cultural practice in many African societies. We examine the relationship between the bride price amount and a range of outcomes using a sample of 317 couples from the Democratic Republic of the Congo. Motivated by common concerns associated with high bride price, we examine whether payment of a higher bride price is associated with earlier marriage and higher fertility; a greater acceptance of domestic violence; decreased ability of the wife to leave her husband; lower-quality marriages; and lower levels of happiness for the wife. We find evidence that women for whom a high bride price was paid are less accepting of domestic violence and are happier.

This commentary analyses Article 7.2.4 of the UNIDROIT Principles of International Commercial Contracts (PICC) concerning judicial penalty. Under Art 7.2.4, where the court orders a party to perform, it may also direct that this party pay a penalty if it does not comply with the order. The penalty shall be paid to the aggrieved party unless mandatory provisions of the law of the forum provide otherwise. Payment of the penalty to the aggrieved party does not exclude any claim for damages. This commentary explains judicial penalty and the court's discretionary power to determine whether or not to impose a judicial penalty, and mandatory provisions with regard to the beneficiary.
