Full textProductive capital. The demand for capital either comes from an "autonomous" subsidiary or obtains after the allocation of productive capital by the mother company among its "dependent" subsidiaries. The autonomous capital depends on local costs and demand. The dependent capital is a function of relative costs and of the mother company's propensity to export. Under rationing, the mother company allocates its direct investment according to the absolute or relative earnings of the subsidiary. Without rationing, the investment depends on the goal aimed at -export of capital or assets' purchase- and on the expectations and risk as to the exchange rate. The tests performed are macroeconometric, on us and french data. We have built stocks in real terms. Between 1960 and 1989, the growth of american stocks of outward direct investment in eight OECD countries responds to demands, both of the autonomous (GNPS) or dependent (exports) type. But for France, only the wages can explain the outward investment at the bilateral level over 1970 to 1987. On the contrary, between 1979 and 1991, the analyses of both inward and outward stocks show that outward stocks and French propensity to export share a common trend, the autonomous factors being irrelevant. The inward stock, let alone the EEC, follows both the autonomous and dependent demands

Full textSince 1972. Tunisia has generated several laws about foreign direct investments - FDI. The aim was to develop the economy by creating employment. The advantages consisted in recruiting Tunisian employees, building industries to the foreign investors and giving fiscal exonerations. This incentive allowed the Tunisian industry to develop by sustaining manicuring investments. The textile and the mechanical sector were the two beneficiaries. Some induced effects, such as the national value added, the technological transfer and the foreign currency's gains are the objectives that the Tunisian government wants to reach. This thesis deals with the theoretical effects of foreign direct investments on a host and under develop country; Tunisia’s country case is and empirical model, analyzed from 1972 to 1994. Full textThe majority of the french authors estimate that the " actions directe " must have a legal origin, because they are an exception to the rules of privity of contract and equality of creditors. Although, an historical analysis of it, wich can be compared with the evolution of the legal theory of the xixth and xxth centuries, discloses its doctrinal and judicial origins. As a matter of fact, its real origins can be found in equity and commutative justice. The " action directe " is also what we could call a " correcting technique " of the articles 1165 (privity of contract) and 2092 (equality of creditors) of the french civil code. There is a lot of situations wich characterize in fact this technique. They cans finally be classified in three types : a transfert of value, a logic of indemnity and q spirit of compassion. This analysis allows to disprove an other modern explanation of the " actions directes " drawn out of the concept of " groups of contracts ". It also allows to bring the differents kinds of " actions directes " (in payment, warranty and responsability) together and make easier the search for a common functionning in the legal system

Full textThis master\'s thesis consists of a case study of three payment programs for ecosystem services - PSE, which helped define the role of law should take the implementation and maintenance of these mechanisms. We tried to, first, define some theoretical bases, above all, what is meant by sustainable development and institutional sustainability. Therefore, we chose to demonstrate the conceptual evolution of environmental services for ecosystem services and understand this as a second phase that, highlighting the consequences of this understanding the legal structure of payment for environmental services programs we chose to call it payment for ecosystem services. We then describe the whole evolution of discussions on REDD+, PES example, to emphasize the challenges that the right has with this new concept of ecosystem services. Experience indicates that the success of the analyzed programs are to a large extent the consequence of the idea of promotional function of law and the observation of its features, namely, orchestration, synergy, flexibility and legitimacy that ensure, first of all , institutional sustainability mechanisms, allowing its perfect adaptation to the reality in which it operates and, more than that, allowing the maintenance of these instruments, even in the face of the changing environment in which they live.

Full textMany efforts and tremendous progress has been made in recent years by low- and middle-income countries towards universal health coverage. It is achieved when all individuals have access to quality health care when they need it, without incurring financial hardship. This thesis aims to measure the progress made by low- and middle-income countries in universal health coverage, deduce their determinants, and highlight the effects of universal health coverage on health outcomes. The thesis is organized around three chapters. The first chapter shows the effect of out-of-pocket expenditures on poverty. The analysis aims to show the necessity to move towards universal health coverage by highlighting the effect of out-of-pocket expenditures on poverty. The second chapter aims to show the factors that explain the progress made by some countries in universal health coverage and analyzing the specific effect of government revenue. In addition, this chapter, unlike other studies, deduces the minimum level of government revenue as a share of GDP that low and middle-income countries should mobilize to make significant progress towards universal health coverage. Finally, chapter three examines the effect of progress towards universal health coverage on health status

Full textLa recherche, sous un point de vue axiologique, a cherché à répondre à des questions relatives à droit de propriété rurale ayant pour basilaire le principe nucléaires de fonction sociale. L exigence de l environnement a été souligné dans le but de contribuer à la solution du problème de la réduction des zones protégées par la loi, en particulier les zones de préservation permanent. La recherche d alternatives au conflit vécues par les paysans entre la productivité et la durabilité n exploration de l activité rurale, a été fondée sur le droit fondamental à un environnement écologiquement équilibré, considéré par la Constitution comme une responsabilité de tous, du gouvernement et la société. En utilisant les solutions parmi les politiques publiques, a été identifié le Paiement des Services Écosystémiques (PSE) pour les agriculteurs en tant qu instrument de gestion de l environnement rendue possible grâce à des recettes de ICMS Écologique. Mettez en évidence le base théorique, en le droit Premial, défendu par Norberto Bobbio, en le principe de l égalité et le principe de solidarité dans la perspective de la justice distributive aristotélicienne.
A pesquisa, sob uma perspectiva axiológica, procurou responder questões inerentes ao direito de propriedade do imóvel agrário tendo como ponto nuclear o princípio da função social. O requisito ambiental foi enfatizado com o fim de contribuir para a solução da problemática da redução das áreas legalmente protegidas, em especial das Áreas de Preservação Permanente. A busca por alternativas para o conflito vivido pelo produtor rural entre produtividade e sustentabilidade, na exploração da atividade agrária, teve por base o direito fundamental ao meio ambiente ecologicamente equilibrado, também consignado pelo legislador constituinte como dever fundamental de todos, do Poder Público e da sociedade. Ao recorrer às soluções dentre as políticas públicas, foi identificado o Pagamento pelos Serviços Ambientais (PSA) ao produtor rural, como instrumento de gestão ambiental viabilizado com receitas do ICMS Ecológico. Ressalte-se o suporte teórico, no direito premial, difundido por Norberto Bobbio, no princípio da isonomia e no princípio da solidariedade sob a ótica aristotélica da justiça distributiva.

Full textThis thesis analyzes the relationship between Board characteristics of acquiring Banks and short termStock Market reactions, measured with the Event Study Methodology. We examine if Board structure helps tolower conflict of interests during Mergers and Acquisitions, and creates Shareholder value. Two effects areanalysed. The first one supposes a direct influence of Board characteristics on the acquirer’s abnormal returns.The second one introduces a mediating effect of the premium, considering that Board structure affects itsmembers’ commitment. For both effects, we control some performance determinants relative to transactionand involved banks.Our results indicate that Financial Markets expect that Boards play an important role in acquisitions. Wefind a favourable impact of outside dominated Boards and the absence of duality on the acquirer's abnormalreturns. In addition, by controlling the method of payment, we obtain a significant and positive correlationbetween use of cash and acquirer's returns
