Abstract:
This research studies the impact of the growth of the sports economy on the limitation of the autonomy of sports organisations, taking into account the driving role of the sovereign power of public orders to fight against corruption. It illustrates the idea according to which the economic governance of sport is based on the specific governance of the International Sports Movement and it verifies how and to what extent the public orders are affecting the regulatory autonomy of sport’s transnational legal orders. The study analyses, firstly, the legal status of the sporting organisations, arguing that the fundamental operational and organisational requirements of sporting organisations have international sources and transnational effects. Secondly, it considers the economic competences of sporting organisations, detecting the limits of sport autonomy due to the exercise of economic activities. Thirdly, it points up the international convergences on managerial transparency and some examples of national and international monitoring of economic activities in sporting organisations, delineating the emergence of a specific international legal framework for economic sports governance. The analysis, finally, identifies the limits of the recent developments at international level, exposing the potential role of the European authorities and the legitimate ways to justify the international limitation of the autonomy of sport. Abstract:
Establishing rules lies at the heart of sport. Furthermore, it can be said that legal order allows only such sporting activity that is carried out according to defined rules. This is mostly followed by foundation of associations and organisations dedicated to particular sport. Acknowledging sport by the public authorities as a space suitable for autonomous arrangement of sports organisations gives special importance to sports rules. However, in order to have autonomy of sports organisations complementary to the role of public authority in the area of sport, it must be grounded in the principles of democracy, solidarity and good management in sport keeping sport independent of any political or economic manipulation including excessive commercialisation. Since contemporary sport is dominantly based on pyramidal structure or federal system based upon recognised sports associations (federations) organised at national and international level by the principle „one sport – one association“, it is quite understandable that sports rules adopted by sports association ranked at international level on the top of the pyramid have monopolistic position as a support for autonomous functioning of whole system of particular sport, as well as considerable limiting factor in making autonomous decisions at lower levels of sports organising. Sports associations use sports rules often followed by serious sanctions to preserve their dominant status. In his paper, the author considers legal nature and legal enforceability of international sports rules at national level for sports organisations, public authorities, as well as judiciary. The author particularly points out to the problem of so-called dynamic addressing to sports rules of international sports associations through statutory provisions of national and lower sports associations and the position of German case-law on impossibility of such way to provide legal obligatoriness of international sports rules at the national level.

Abstract:
European, national and local public policies have a crucial role when it comes to social and economic development. Based on European and national frameworks, local public administration develops and implements local public policies based on the community needs in order to reach a high level of local development. Among other sectors, sport plays a major role in the local development. Our paper aims to outline the role of local public authorities from Oradea, Romania, in supporting high-performance sport at a local level through local public policies. In Oradea a high-performance sport is represented by the Municipal Sports Club; therefore, our analysis focuses on the impact of local public policies on the sports activity of the club. The study methodology is mixed, based on document analysis and individual interviews. Research results show a clear link between the decision of local public authorities to get involved in local sports activity and the achievement of outstanding results by local sports teams. Consistent financial support, high quality sports infrastructure, transparent public-private partnerships, as well as strong partnerships between various local public authorities are the keys to developing performance sport.

Abstract:
Purpose The purpose of this paper is to overcome the traditional general approach to sport policy by taking an entrepreneurial perspective. This helps link the fragmented literatures of entrepreneurship, public policy and sport entrepreneurship in order to develop a new perspective of sport entrepreneurship and public policy. Design/methodology/approach A literature review is conducted that highlights the need for public policy to focus on entrepreneurship in sports contexts. Findings In the past, sport policy focused more on governance and political elements but these can be embedded into a policy entrepreneurship perspective regarding sport. This helps to redefine and bridge the literature on sport entrepreneurship and public policy. Originality/value Most sport policy research has tended to take a more organizational behavior or political science approach. Thus, this paper takes a new perspective by incorporating the nascent sport entrepreneurship literature into public policy debates. This is helpful to public policy planners but also sports managers who need to work together to build better policy initiatives.

This study analyzed changes in access to sports facilities before and after implementation of the long-term planning for the balanced arrangement of public sports facilities in order to derive implications for the efficient supply of sports facilities for the expansion of sports facilities infrastructure. As a result of the analysis of changes in access to sports facilities by city type, the effectiveness of the long-term planning for balancing public sports facilities with the goal of increasing the walking use rate of public sports facilities in all city types and improving access to sports facilities centered on residential areas within the target required time was proven. However, considering the standard deviation, it was confirmed that service blind spots still exist, so it is necessary to prepare countermeasures for this.

This paper describes the results of the Community Service Program on the socialization of cricket to sports teachers. The underlying problem is that there are still many sports teachers who do not know about cricket. One area that lacks knowledge about cricket is Bogor Regency. While this cricket sport has a very large opportunity to support one's achievements. Cricket is a team sport that can be played by all ages, both children, teenagers and the general public. This cricket sport is usually competed in regional and national sports events. Currently, the sport of cricket in Indonesia is in the socialization stage so that the development of cricket is important to be promoted and introduced to all circles, especially to sports teachers. Introduction to sports teachers is very important because cricket needs to be instilled in children from an early age. The purpose of this activity is to provide an overview and rules of the game of cricket to sports teachers in order to get an understanding and practice well according to the theory and rules of the game in the game of cricket.

The physical movement and the athletic movement and, furthermore, the whole of the physical activity, are distinct from other activities due to the organization on the basis of which it is practiced, to the way it is conducted and implemented and to the objectives which it involves. The legal entities in general and the ones of the sports sector in particular have been constituted so as to cover specific social needs, in accordance with the provisions of the applicable regulations and the ones of the Constitution. In Physical Education and Sport there are many interesting legal entities, some governed by Private Law and some by Public Law. This athletic action and particularly the sports contest can be achieved only within a specific framework of rules governing the contest and of rules of law, so as for all the above mentioned issues to be regulated. The physical and the athletic activity, as sports’ manifestations, regulated by legal rules, constitute a specific cognitive field for both the sports science and the legal one. Sports rules are established in order to cover public and private interest in sport in the context of national and international sport activity. Sports rules, as the rules of the game, prevail over ordinary rules of law since they have been specially enacted for specific sports activities. The rules of ordinary law apply in sports for many issues. They may apply directly due to the lack of special sports rules or indirectly by absorption with analogous adaptation and implementation where appropriate.

UKM E-Sport UNHAS is called Electronic Sports Student Activity Unit or commonly E-Sport. E-Sports is the term for video games, with streams of many game genres being played. In order for the student to have easy access to information about her UKM E-Sports, we need a website that can be accessed from any internet-enabled device. The purpose of this study is to design the UKM E-Sport UNHAS website. At the stage of building this sistem, sistem development tools such as data flow diagrams (DFD), context diagrams, entity relationship diagrams (ERD) and flowcharts are used, and PHP and HTML programming languages ​​and MySQL are used as databases. This web-based information sistem design covers many segments of the population. By using the website, visitors from anywhere can see information from this organization. Sport is an important necessity of life that is often underestimated today. Of course, this web-based E-Sports has the specific purpose of raising public awareness that technology is growing.

Omani sport is still searching for new methods to identify its problems and achieve a vision regarding the economic problems in sport, the short-term solutions to revitalize it, and long-term solutions to maintain its stability. It hopes to rise and find an end to its funding problems in order to take off toward international winners’ podiums, especially after the good results achieved lately in several sports. Therefore, the researcher deems it necessary to identify the areas of investment in Omani sport, as potential for investment in the presence of self-finance that covers its financial needs. The researcher used the descriptive method as it is suitable to the nature of the study, and a sample of 273 subjects representing the research population. He used a questionnaire as a data collection instrument, and rank, frequency, percentage in statistical treatment. The main finding of the research was a list of the areas of investment in Omani sport in the following order: launching sports channels, TV streaming, sports professionalism, establishing sporting camps centers, academies of different games, and investment in sporting facilities. The main recommendations were to authorize Omani sporting authorities to launch TV channels to stream their matches, be based on competition with each other, and according to the rules stipulated by the Ministry of Sports Affairs and the Public Authority for Radio and Television

Les activités du sport peuvent devenir un motif de troubles (violence, corruption, financements occultes, illégalités diverses. . . ) alors il est nécessaire d'y rétablir ou d'y maintenir l'ordre. La question que l'on pourrait se poser serait de savoir s'il y a de l'ordre dans le sport, s'agit-il d'un ordre public spécial (ordre public du sport) ou de l'ordre public ( ordre public général)? la plupart des activités sportives aujourd'hui sont organisées par des communautés structurées qui possèdent une relative indépendance (fédérations nationales et internationales). Il semblerait que la notion d'Ordre public n'intéresse que de facon épisodique les activités sportives (violence autour des stades de football, règlementation de police administrative) puisque l'ordre juridique sportif semble capable de contenir les dérèglements au sein de ses communautés. Pourtant celles qui voudraient intégrer efficacement l'ordonnancement juridique francais, doivent se soumettre non seulement à des règles impératives d'organisation issues des communautés du sport mais aussi à des règles d'organisation publique. C'est-a-dire que tout en gardant leur identité communautaire, elles doivent se soumettre à l'ordre public. Les communautés sportives, en intégrant les structures du service public se voient reconnaître une véritable légitimité et une liberté adaptée, renforcée par la mission d'intérêt général qui leur est confiée. Il s'agit finalement de démontrer qu'au travers la règlementation d'activités complexes telles que l'organisation et la pratique du sport on évoque un seul et même concept organisateur et régulateur: l'Ordre public.

Le dopage est indissociable de la logique de compétition : le monde du sport est dans une logique de record. Classiquement, le dopage consiste, pour les sportifs, à améliorer artificiellement leurs performances par l'usage de substances ou méthodes interdites. Cette pratique constitue une forme de tricherie contraire aux valeurs et principes fondateurs du sport de compétition mais est également susceptible de mettre en danger la santé des sportifs. La lutte antidopage trouve son fondement dans l’ordre public sportif et plus précisément dans deux composantes : l’intégrité de la compétition et la protection de la santé des athlètes. En outre, la réglementation antidopage incarne une partie de ce même ordre public sportif de par son caractère impératif dont le non-respect est sanctionné. À cet effet, les organisations antidopage constituent de véritables autorités de police sportives dont l’objet est d’assurer la préservation de l’ordre public sportif. Afin de mener à bien leur mission, les autorités de police antidopage agissent unilatéralement et exercent une contrainte auprès des athlètes au moyen de divers procédés (normatifs, matériels, disciplinaires). Dès lors, au motif de préserver l’ordre public sportif, les organisations antidopage restreignent l’exercice des droits et libertés fondamentaux des compétiteurs que sont notamment le droit à l’intégrité morale et physique, le droit au respect de la vie privée, la liberté d’aller et de venir ou le droit à une procédure équitable. Le dispositif juridique de la lutte antidopage est donc source d’aménagement des droits et libertés fondamentaux. Aussi, au moyen d’une analyse pragmatique, il en ressort que la légitimité et la proportionnalité de ces restrictions interrogent
Fundamental rights and freedoms are often exploited, either to denounce the threats weighing on them, or to affirm their existence in a more or less solemn manner. They are at the heart of an ideological discourse which aims to ensure their promotion, but which at the same time reveals the fragility of the very notion of “fundamental rights and freedoms”. Doping is inseparable from the logic of competition; the world of sport is in a logic of records. Doping consists, for athletes, of artificially improving their performance through the use of prohibited substances or methods; it is a practice which is not only likely to endanger the health of athletes, but which also constitutes a form of cheating contrary to the founding values and principles of competitive sport: fair competition and equality of competitors. If doping has no legal reality and is only sanctioned in sport, doping is present in all spheres of society. How many students, police officers and lawyers take drugs in order to improve their performance or keep up with the required work pace? In sport, the act of doping is initially defined based on a material criterion: the establishment by the results of the analysis of samples taken of the presence of prohibited substances or the use of a prohibited method. However, other behaviors are prohibited in terms of doping even though they do not consist of the ingestion of prohibited substances (failure to comply with localization obligations which weigh on certain athletes, the association, in a professional or sporting capacity, to a person who has been suspended or convicted for committing an anti-doping rule violation, etc.). Sport is therefore subject to a number of more or less restrictive obligations in order to make anti-doping effective. However, certain measures are also protective, as evidenced by the regime of authorization of use for therapeutic purposes in order to preserve the health of the athlete. It seems possible to draw a parallel between the fight against doping and the preservation of public order. Should we agree to cut back on this or that right in order to preserve or achieve this or that higher objective, however laudable it may be? Are restrictions on rights and freedoms within the sports movement as part of the fight against doping necessary and essential? Or, on the contrary, are these restrictions disproportionate, unjustified and therefore liberticidal? Likewise, are the protective measures sufficient and appropriate? Le Tribunal arbitral du sport (TAS), organe de résolution des litiges sportifs par la voie de l’arbitrage, rend des sentences qui, grâce à la pratique du précédent, acquièrent la cohérence nécessaire à la formation d’une jurisprudence. À travers cette jurisprudence, le TAS contribue à l’édification d’un ordre juridique sportif global et autonome. Cette contribution est le résultat d’un double apport, normatif et structurant. D’abord, les règles prétoriennes produites par le TAS et formées essentiellement des principes généraux constamment appliqués par les arbitres, constituent une source de droit à l’intérieur de l’ordre juridique sportif. Certains de ces principes, principalement ceux permettant de protéger la sincérité des compétitions et les droits fondamentaux des athlètes, se démarquent par leur caractère intangible pour former l’ordre public sportif. La mise à l’écart du droit étatique au profit de l’application de ces principes, mais aussi des règlements sportifs, permet d’assurer l’autonomie de l’ordre juridique sportif. Ensuite, ces principes sont un facteur de structuration de l’ordre juridique sportif, dans la mesure où leur intervention favorise la cohérence du système. Cette structuration est le résultat de l’application de ces principes pour contrôler l’exercice par les organisations sportives de leurs compétences réglementaires et disciplinaires et pour délimiter les pouvoirs de chacune des composantes du mouvement sportif. Dans les deux cas, ces principes deviennent des standards communs qui s’imposent à l’ensemble de la communauté sportive
The Court of arbitration for sport (CAS), an arbitration body in sport disputes, passes sentences which, thanks to the practice of the precedent, get enough coherence to constitute a jurisprudence. Through this jurisprudence, CAS contributes in the erection of a global and autonomous sports legal order. This support is the result of a double contribution, normative as well as structuring. First, the pretorian rules generated by CAS and formed mainly by the general principles commonly applied by the judges, constitute a source of law within the sports legal order. Some of these principles, namely those aimed at protecting the fairness of the competitions and the fundamental rights of athletes, stand out with regards to their intangibility to form the sport public order. Discarding state law in favor of the application of these principles as well as of sport regulations, guarantees the autonomy of the sports legal order. Thereafter, these principles are considered as a structuring factor of the sports legal order, in that their intervention favors the coherence of the system. This structuring results from the application of these principles in order to monitor the practices by the sport organizations of their regulatory and disciplinary competences and also to confine the power of each of the components of the sport movement. In both cases, these principles become common standards for the whole sport community to abide by

La Tunisie est dotée aujourd’hui d’un code dit libéral et moderne - du moins a priori - relatif à l’arbitrage interne et international. Néanmoins, la pratique révèle que cette œuvre législative demeure un acquis fragile et inachevé, du fait de l’approche particulièrement originale voire même singulière du législateur tunisien, qui, en introduisant une grande dose de raffinement et de complexité aux dispositions de la loi type, source d’inspiration du troisième chapitre relatif à l’arbitrage international, a contribué à une application souvent erronée par les tribunaux tunisiens et à l’instabilité de la jurisprudence tunisienne. L’objectif essentiel de cette thèse réside dans la mise en exergue des insuffisances et lacunes du code tunisien de l’arbitrage et des difficultés de sa mise en œuvre à la lumière d’une analyse approfondie de la jurisprudence qui s’est développée sous son empire et dans une perspective de la jurisprudence arbitrale comparée
The Tunisian code relative to internal and international arbitration could beyond doubt be described as liberal and modern - at least at first glance - but the essential lies not only on the adoption of a modern legislation, but also on an effective and good enforcement of the law, which must be moreover interpreted by the Tunisian Courts. The practice reveals indeed the fragility of the code, which remains an unfinished act. The remarkable characteristics of Tunisian case law (jurisprudence) are originality and instability, especially the decisions rendered by the Court of Tunis and the Supreme Court (Cour de Cassation). The principal cause is tied up the original and complicated approach of the Tunisian legislator, who has modified Uncitral model law. This attitude causes many problems in the interpretation and application of the Tunisian law of arbitration by Tunisian case law

Aquesta tesi pretén: a) conèixer, definir i limitar el concepte d’instal•lació esportiva d’ús públic de Catalunya, b) identificar, estructurar i ordenar l’ordenament jurídic aplicable a les instal•lacions esportives d’ús públic de Catalunya, c) analitzar el (no) compliment de l’ordenament jurídic i d) en cas d’incompliment: 1) identificar quines normes no es compleixen, 2) identificar (algunes) de la/les possible/es causa/es que l’expliquen i 3) proposar mesures (adequades) per corregir aquest incompliment. Metodològicament la investigació s’estructura en dos blocs. El primer, mitjançant la investigació documental i l’anàlisi de contingut, defineix l’ordenament jurídic aplicable a les instal•lacions esportives d’ús públic de Catalunya. El segon, mitjançant l’anàlisi de contingut i l’anàlisi estadístic d’una enquesta online, respon a la pregunta si es compleix l’ordenament jurídic aplicable a les instal•lacions esportives d’ús públic de Catalunya. Els resultats constaten que cinquanta-cinc, dels seixanta-sis preceptes analitzats, s’incompleixen. Algunes de les causes que poden explicar l’incompliment són: a) quant major és la població on s’ubica la instal•lació esportiva major és el compliment de la norma, b) quant major és el nivell d’estudis del director/a major és el compliment de la norma i c) experiències de gestió de la instal•lació entre 1 i 3 anys compleixen més normes que experiències inferiors a l’any o superiors als 3 anys. Aquesta situació podria millorar-se actualitzant la regulació, facilitant mitjans informatius i d’assessorament específic i oferint formació especialitzada continuada, entre altres.
Esta tesis pretende: a) conocer, definir y limitar el concepto de instalación deportiva de uso público de Cataluña, b) identificar, estructurar y ordenar el ordenamiento jurídico aplicable a las instalaciones deportivas de uso público de Cataluña, c) analizar el (no) cumplimiento del ordenamiento jurídico y d) en caso de incumplimiento: 1) identificar qué normas no se cumplen, 2) identificar (algunas) de la/las posible/es causa/as que lo explican y 3) proponer medidas (adecuadas) para corregir el incumplimiento. Metodológicamente la investigación se estructura en dos bloques. El primero, mediante la investigación documental y el análisis de contenido, define, el ordenamiento jurídico aplicable a las instalaciones deportivas de uso público de Cataluña. El segundo, mediante el análisis de contenido y el análisis estadístico de una encuesta online, responde a la pregunta (no) se cumple el ordenamiento jurídico aplicable a las instalaciones deportivas de uso público de Cataluña. Los resultados constatan que cincuenta y cinco, de los sesenta y seis preceptos normativos analizados, se incumplen. Algunas de las causas que pueden explicar dicha situación son: a) cuan mayor es la población donde se ubica la instalación deportiva mayor es el cumplimiento de la norma y b) cuan mayor es el nivel de estudios del director/a mayor es el cumplimiento de la norma. Esta situación se podría mejorar actualizando la regulación normativa, facilitando medios informativos y de asesoramiento específico y ofrecer formación especializada continuada, entre otras.
The aims of this thesis are: a) to understand and to define the concept of Catalonia public sport facility, b) to identify and to organize the legal order covering Catalonia public sports facilities, c) to analyze the (non) compliance of the legal order, and if this does not occur d) to identify: 1) which regulations are not compliance, 2) the (some) reasons for such incompliance and 3) to design appropriate mechanisms by which to ensure that regulations are obeyed. From a methodological point of view, this research is divided into two different sections. The first section, through desk research and content analysis defines the legal order covering public sports facilities in Catalonia. The second section, through content analysis and statistical analysis of an online survey answers the question whether or not the legal order covering public sports facilities in Catalonia is compliance. The results show that fifty-five, of the sixty-six regulations analyzed, are incompliance. Several interesting implications to be highlighted: 1. The bigger the village, which houses the sport facility, is the more compliance of the regulation. 2. The higher the level of education, of the director, is the more compliance of the regulation. 3. Учинення вболівальниками спортивних команд адміністративних правопорушень, що посягають на громадські (публічні) порядок і безпеку, аморальність під час проведення футбольних матчів, інших спортивних заходів, стали буденністю. Діяльність радикально налаштованих угруповань футбольних фанів, схильних до агресії, насильства й інших суспільно небезпечних діянь, загрожує безпеці звичайних громадян, створює ризик зриву спортивних змагань, що може негативно вплинути на міжнародний імідж держави. Невідповідність нормативно-правового регулювання профілактичної роботи щодо сучасних реалій, неузгодженість дій (або ж взагалі – відсутність координації) між правоохоронними органами, представниками недержавних охоронних організацій, органами місцевої влади, громадськими організаціями й іншими суб’єктами сектору безпеки, що беруть участь у забезпеченні правопорядку під час підготовки та проведення футбольних матчів, негативно впливають на забезпечення правопорядку в нашій державі. Об’єктом кваліфікаційної роботи є суспільні відносини, які виникають у сфері громадської безпеки і порядку під час проведення футбольних матчів. Предметом дослідження є адміністративно – правове забезпечення громадської безпеки і порядку під час проведення футбольних матчів. Методологічну основу роботи складають сукупність філософсько-світоглядних, загальнонаукових принципів і підходів та спеціально-наукових методів пізнання конституційно-правових явищ, використання яких дало змогу отримати науково-обґрунтовані результати. Для проведення дослідження будуть застосовані такі загальнонаукові методи як: аналіз і синтез. Теоретико-Методологічною основою дослідження є діалектичний метод (закон переходу від загального до основного та конкретного і навпаки), а також основані на ньому загальнонаукові методи: (формально-логічний, статистичний, історико-правовий, порівняльно-правовий, структурно-функціональний та інші), а також конкретно-соціологічні (документальний, спостереження, опитування, анкетування, вивчення документів), що забезпечили їх науковість, новизну та достовірність результатів. Основні висновки та положення дослідження ґрунтуються на методі системного аналізу чинного законодавства, міжнародно-правових документів, практики їх застосування і врахування соціально-політичних, демографічних факторів.

Fans committing administrative offenses that violate public (public) order and safety, immorality during football matches and other sporting events became commonplace for fans of sports teams. The activities of radical groups of football fans prone to aggression, violence and other socially dangerous acts, threaten the safety of ordinary citizens, create the risk of disruption of sports competitions, which may adversely affect the international image of the state. Inconsistency of legal regulation of preventive work with regard to modern realities, inconsistency of actions (or in general - lack of coordination) between law enforcement agencies, representatives of non-governmental security organizations, local authorities, public organizations and other actors of the security sector involved in order during the preparation and holding of football matches have a negative impact on law enforcement in our country. The purpose of the work is to highlight the peculiarities of the implementation of the prevention of administrative offenses during the preparation and conduct of football matches based on the analysis of foreign experience and improvement of law enforcement activities of the specified direction. The object of the qualification work is the public relations that arise in the field of public safety and order during football matches. The subject of the study is the administrative and legal provision of public safety and order during football matches. The methodological basis of the work is a set of philosophical-philosophical, general scientific principles and approaches and specially-scientific methods of knowledge of constitutional-legal phenomena, the use of which has allowed to obtain scientifically-based results. For the study will be applied such general scientific methods as: analysis and synthesis. The theoretical and methodological basis of the study is the dialectical method (the law of transition from general to basic and specific and vice versa), as well as general scientific methods based on it: (formal-logical, statistical, historical-legal, comparative-legal, structural-functional and others) , as well as specific sociological (documentary, observation, questioning, questioning, study of documents) that provided their scientific, novelty and reliability of results. The main conclusions and provisions of the study are based on the method of systematic analysis of current legislation, international legal documents, practices of their application and taking into account socio-political, demographic factors.

As athletes invest their time and energy into sport and it becomes a meaningful part of their self-concept they simultaneously develop an athletic identity. This chapter discusses psychological and sociological research on athletic identity development. One robust finding throughout the literature is that often athletes see themselves as athletes more strongly than the public does. The public’s reluctance to acknowledge that athletes with disabilities are real athletes reflects how disability sport is often marginalized. Research shows that sometimes former able-bodied athletes decline to participate in disability sport or seek out a sport different from the one they engaged in when able-bodied. Some athletes claim to be elite disability sport athletes in order to have an “elite” athletic identity. Other athletes with disabilities do not acknowledge disability sport and embrace an elite athlete identity. Within this context, the chapter incorporates relevant theory and psychological processes to identify plausible mechanisms underlying athletes’ decisions about whether to participate in sport and what to call themselves when they do.

This chapter discusses the NCAA's efforts to restore academic respectability to college sports. For decades, the college sports establishment promoted rules of fair play and a level playing field in public, while coaches and boosters surreptitiously sought ways to evade those rules. However, the alarming spate of cheating and fraud in the 1970s and 1980s stirred up efforts at reform. Those efforts, however, did not lead in the direction that might have been anticipated from the overt events. Though related to the scandals, the major turning points of the era had mixed consequences. Changes in the playbook of college sports between 1973 and 1991 were bounded by two major landmarks. The first, the 1973 NCAA legislation putting Division I athletic grants-in-aid (scholarships) on a one-year renewable basis, highlighted the transformation of the student-athletes into athlete-students, whose commercial value could sometimes prompt others to cheat in order to attract and retain them. The second, the 1991 Knight Foundation report, “Keeping Faith with the Student Athlete,” revealed how pervasive the need for ethics reform had become and, in its weak aftereffects, the power the athletic establishment could exert to contain reform and continue the quest for revenue in what had become a high-stakes business.

This chapter deals with the way in which French social scientists study their fellow citizens’ national identity. Following Billig, national identity refers here to the way people feel “emotionally situated” within nations, whatever these emotions are; how and to what extent they believe that being French is part of their personal identity. Over recent decades, social scientists all over the world have investigated the complex feelings citizens have about their nations. In France, however, this issue has been somewhat overlooked. This disparity is a consequence of the political context and the role of social scientists in French public debates, as well as a legacy of Bourdieu’s work which has made them well aware of the power of categorization. As a conclusion, the chapter outlines a research agenda in order to overcome this sociological blind spot.

What is at stake in the modern combatting of hate in liberal democratic societies? This book takes up the question and offers a critical exploration of the basic assumptions, ideals and agendas behind the fighting of hate, as expressed for example through anti-hate speech and anti-hate crime initiatives. Most research on hate crime, on hatred as such, and on the -isms and -phobias with which it is commonly connected (racism, anti-Semitism, homophobia etc.) are written and published in what might be called a “preventionalist” spirit. That is, such studies are undertaken in order to prevent hate or to strengthen the combating of the harms and crimes with which it is associated. This book is different in so far as it insists upon a more theoretically distanced and exploratory approach to the topic of hatred. It asks questions such as: what are the normative presuppositions, the ideological roots, the promises, the limits, and—not least—the blind spots of the modern fighting of hate? When and why did it become necessary or legitimate to fight it? What is the meaning of “hate”? And how does the modern and public use of the term relate to the longer and broader history of the concept? In this book, a group of distinguished scholars explore these questions and offer a range of explanatory and normative perspectives on what is at stake in the awkward relationship between hate and liberal democracy.

AbstractThe Ministry of Education and Culture (MEC) has traditionally been considered as the most central actor and the powerhouse in the education policy field in Finland. While the position of the MEC in the Finnish education policy system seems stable, there have been several organisational changes within the MEC over the past three decades. One of these is the disintegration of the committee system and its replacement by the working groups system, a trend that is part of a more general change from governing to governance since the 1990s. In this chapter we analyse data containing the MEC’s working groups and their members with social network analysis in order to understand the ways in which the working group system affects the MEC and its operation. Our analysis suggests that the MEC is organised rather strongly by departments: early childhood and general education, vocational education and training, higher education and research, culture and arts, and youth and sports. Analysing the network through the individual working group members we observed that, in addition to public officials, individuals representing interest organisations such as labour and trade unions were important links between the working groups.

In fact, social media analysts have attributed much of Twitter's growth to early adopters in the sports world. As a continually expanding global business, sport has to grapple with the challenges of how to harness this uncontrolled medium to best advantage, particularly in times of crisis. This chapter examines the bond between fans and sport in the context of social media in order to examine how this relationship could foster forgiveness for elite athletes who confess to transgressions, thus having enduring implications for the athlete's sport and sport business generally.

This chapter examines the long history between beauty and sports. It elaborates on how sports promotion was shaped by racialized and gendered ideologies about human bodies in the early 1900s. Sports were understood and promoted in order to improve bodies, communities, and societies, so the aesthetic dimension was vital to the public provision of sports. The chapter also considers the ways in which women who played sports were characterized as masculine, while the dominance of men's soccer represented the notion of male physical effort, coordination, individual skill, and competitiveness as beautiful. It explains that education, institutions, and the media created a binary of separate men's and women's sports.

Within the numerous variables, the study of the main important characters, the duration of the advertising, the year or decade of creation, the presence of violence, the context or environment where they were developed, the gender that is predominant (masculine or feminine), or the character's age stand out. The results showed that women still have a secondary role in sport advertisement and that younger and celebrities have the leading role, especially in the football scope, in the majority of the observed videos. The field of public relations (PR) is growing. In the U.S. alone, the PR industry is comprised of more than 7,000 companies bringing in estimated annual revenues of $11 billion, and offering a diverse range of services from media relations to event management (Pozin, 2014). There are many types of media available to PR specialists, and these fit into three broad categories: owned, paid, and earned media. Owned media is defined as communication channels that are within the organization’s control, such as websites, blogs, or email; while paid media refers mostly to traditional advertising, discussed in Chapter 6. Earned media, on the other hand, is generated when content receives recognition and a following outside of traditional paid advertising, often from publicity gained through editorial influence. Critically, earned media cannot be bought or owned, it can only be gained organically, hence the term ‘earned’. Since most of this earned media is gained through PR activities, this chapter will mainly focus on PR and its various techniques. PR is broader in scope than publicity, its goal being for an organization to achieve positive relationships with various audiences (publics) in order to manage effectively the organization’s image and reputation. Its publics may be external (customers, news media, the investment community, general public, government bodies) and internal (shareholders, employees). The three most important roles of PR and publicity in tourism and hospitality are maintaining a positive public presence, handling negative publicity, and enhancing the effectiveness of other promotional mix elements (Morrison, 2002). In this third role, PR paves the way for advertising, sales promotions, and personal selling by making customers more receptive to the persuasive messages of these elements. Ultimately, the difference between advertising and public relations is that public relations takes a longer, broader view of the importance of image and reputation as a corporate competitive asset and addresses more target audiences.

This chapter explores how Presidents John F. Kennedy and Richard Nixon embraced college football during the Cold War to advance their own political agendas. It traces the relationship between college football and the presidency through their friendships with college football leaders and analyzes how they contributed to the politization of the sport. Kennedy used college football to help bolster his fitness program when he tapped the University of Oklahoma’s Bud Wilkinson to direct his President’s Council on Physical Fitness. Wilkinson, who maintained relationships with presidents from both parties during his career, came to symbolize the politicization of the sport and how presidents increasingly sought public figures to improve their image. During Nixon’s 1968 campaign, Wilkinson played a key role in Nixon’s youth outreach efforts and later as a special consultant. Nixon befriended many other coaches, including Woody Hayes, who he eulogized in 1987, as he sought to connect the sport’s toughness with his “Law and Order” politics. By the end of the Cold War, college football had become solidly conservative thanks in large part to these relationships.

The tremendous effects on host nations have sparked global protest and ever fewer citizens approve of the ways in which these events are organized. Chapter 1 illustrates therefore how in the aftermath of 9/11 and the ongoing ‘war on terror’, security has become one of the most important aspects of mega-event organization. Promises of positive security legacies are used to produce Olympic spaces of exception, within which legislation is adapted to the keenest imaginations of security officials in order to implement surveillance practices and the militarization of public space. It also looks at how Olympic security is a mirror of contemporary security politics and security as such has become a spectacle in its own right and securing the Olympics resembles preparing to fight a modern war.

Abstract Chapter 2 argues for the contextual legitimacy of uncivil protest: when there is no communicative justice, protesting publics have to resort to uncivil protests in order to be heard in the public sphere and in order to be able to resist the insensitivity of publics and institutions that ignore them. The chapter argues both against conservative views for which protests are legitimate only if previously authorized and in full conformity with law and order, and against liberal views that allow for civil disobedience but, either for principled or for strategic reasons, allow only for protests that remain civil. The author argues that oppression and radical exclusion call for a politics of confrontation and introduces epistemic activism as a crucial component of such politics. On the author’s view, contexts of oppression and radical exclusion warrant the use of incivility and mild forms of violence for protesting injustice. Elucidating the history of protests in sports, the activism of ACT UP, and the counter-protests of Black Lives Matter, I argue that, under conditions of oppression and radical exclusion, protest movements can legitimately use incivility and mild forms of violence (i.e., those involved in coercive and confrontational, guerrilla protest tactics) while still being committed to the mitigation of violence.

In order to identify existing problems and prospects for the development of the ethno-sports movement in order to further expand the sphere of physical culture and sports in the region, the article analyses the formation and development of ethnic sports in the Sverdlovsk region. The study has been conducted for several years with the employement of such methods as questionnaires and social surveys, the analysis of literature and official documents, the projection method. The survey questions concerned the awareness of students of the Institute of Physical Education regarding the development of ethno-sports in the country and in the region. A low level of awareness of the development of the ethno-sports field among Bachelors of Physical Education was identified, which is a main problem of the subject matter. As a result of the deep research into problems of the promotion of ethnic sports, it was decided to elaborate and implement the pilot project ‘ETHNIC Festival’ aimed at the popularisation of ethnic sports in the city of Yekaterinburg. An analysis of official documents has shown that the region is now actively developing federations for traditional Russian sports, however, they are not very popular among the population. The current activities in the field of ethno-sports are not sufficient to attract the general public to the process. The obtained data indicated the urgency of the popularisation and cultivation of national sport disciplines and competitions. A sociological survey of EthnoFestival participants showed that one of the ways to revive national games and sports is to hold mass events to popularise ethno-culture.

Digitalisation is gradually penetrating all spheres of society The rationale for this study is the unprecedented measures taken by the President and the Government of the Russian Federation to encourage the population to engage in physical education and sport in order to preserve and improve health and increase the life expectancy of Russians. Federal targeted programmes have made it possible to build and commission thousands of modern sports complexes. The study was primarily aimed at the elaboration and implementation of a technique of digital information and diagnostic support of mass health surveillance. The research methodology developed at our University contains three process phases: measurement, calculations, and appraisal. The implementation of these procedures allows both the individual trajectory of the complex development of each subject and the processing of unlimited amounts of information concerning normative test takers. At each stage, digital technologies are used to generate the database, to store it, to process the results obtained and to pass them on to other organisations upon demand, making the achievements of the methodology transparent and open. The scientific novelty of the research lies in the fact that the methodology, by monitoring the dynamics of individual and collective achievements, handles information on all groups of the population in a prompt, reliable and valid manner and is used by us not only to modernise the process of physical education, but also to assess the health-promoting activities of any organisation. Digitisation originated from the Internet and BigData era, entails raising the level of evidence-based decision-making in physical education and sport to a new, modern level.

Examining the links between performance and financial issues has been, and still is, subject of a great number of researches both in the business and in the non-profit environment. In this respect, the world of sports has not been bypassed either, using concepts and / or instruments from accounting, economics or statistic areas in order to analyse a firm or an NGO in the sport industry and his success. The present study represents one of the first attempt to value the Romanian sports federations’ activity which is not based solely on the scores attained following places and medals won by athletes participating in the national and international competition system. And it is intended to identify an appropriate methodology to highlight how efficient the sports federations have been in 2019 year, reporting the results obtained to the resources used, from a domestic perspective (meaning the participation in national sports events and the scores obtained). This paper addresses 12 Romanian sports federations (out of 75 federations on sport branches) and their efficiency, through the lens of several input, output and outcome indicators, using public data gathered from various sources - the Romanian Ministry of Finance, the National Institute of Statistics, the Romanian Ministry of Youth and Sports. Using statistical tools, such as Spearman rank correlation, as well as statistical methods, such as standardization, we developed an efficiency calculation methodology, which could be used to support managerial team to improve and / or reshape federations' activities, if necessary.

Professional sports is rapidly moving in the direction of full commercialization and is a highly profitable business activity worth tens of billions of dollars annually. The professionalization of certain sports disciplines, the multiple increase in the number of transfers and profits in sports, resulted in, inter alia, the emergence of a whole range of new occupations in the sports system. Among them are sports agents who, acting under the authority they have, mediate in sports transfers, or endeavor to bring the sportspersons into a sport organization for the purpose of negotiating the conclusion of an employment contract, or to bring one sports organization in contact with the other for the purpose of negotiating on the conclusion of the transfer agreement. Mediation in sports transfers represents the most common form of activity of sports agents and the typical service they provide to their clients. However, in the conditions of modern sports, sports agents on the contract basis provide their clients with a wide range of other services. These include: representation for the conclusion of various types of contracts, the interpretation of foreign legal regulations (when transferring an athlete abroad), managing client assets, long-term planning of his career, caring for the client's public image, organizing press conferences, etc. The subject of the author's interest in this paper is the consideration of the legal position of sports agents in the negotiations that are being conducted in order to conclude a employment contract or a transfer contract of their clients.

Nowadays, the popularity of football is undeniable compared to any other sport. With the popularity the amounts invested in this sport and implicitly the physical and mental of the football players also increased, thus becoming a true industry. If during the nineteenth century the players practicing this sport did it as amateurs, part-time, after hours, in the twenty-first century football became a professional sport where practitioners make every effort to achieve the highest performance possible. Thus, nowadays football players have game strategies, physical and psychological preparation, various recovery methods, but especially very intense daily workouts. Once this transition from hobby to professional was produced, new activities such as training camps and friendly matches have been introduced and the number of sports competitions has increased, consequently increasing the training frequency and intensity considerably. All these factors mentioned above led to the overuse of the muscular-arthro-kinetic chain, to the need to shorten the recovery period after the effort and to the need for creating new kinetic angles in the football game, thus favouring the emergence of new pathologies. Thus, pain in the pubic symphysis is a condition that is seen more and more often in this sport. Pain in the pubic symphysis is defined as osteitis pubis and is an inflammation of this joint and of the tendons of the corresponding muscles. In general, the main causes of osteitis pubis are: complications after birth, gynaecological or urological post surgery complications, rheumatologic affections and intense sport activities (mechanical overwork, major trauma or repeated minor trauma). In the case of football players the most common causes can be intense sport activities, rheumatic problems of any kind or urological post surgery complications. If we talked about its causes, now we need to talk about the consequences of osteitis pubis. Thus, the overuse of the joint of the pubic symphysis leads not only to the occurrence of pain, but also to changes in the statics and dynamics of the individual. In order to identify the changes mentioned above we will use Podiatry platform - a device for measuring the characteristics of the walk and posture, the quantified definition of each area: through pressure, weight, the area of the support surface, the visualisation of the pressure centre for each foot, the design of the weight centre, measurement of the medio-lateral index, the Romberg analysis. The proposed study tries to compare the indexes of the healthy football to the ones of the players suffering from osteitis pubis. The research was segmented into two parts. In the first part a total of 35 healthy subjects were selected (with adequate somatic indexes and a minimum of 5 years of sport activity in this branch), tested both in static and dynamic, and the data obtained was recorded and used in order to create average values in order to make comparisons with the data obtained in the second part . In the second part football players diagnosed with osteitis pubis were selected (with the same features as those from the first part) and tested in the same way. The results obtained in these athletes will be analyzed and compared with the average value obtained from the healthy individuals. This comparative study will provide information on how to approach the recovery treatment of osteitis pubis, on creating complex, optimal programs which would enable the shortening of the competition reintegration period.

Sports federations as actors are the most mobile in terms of communications with both the state and business. In the Russian practice of state support for sports, budgetary funds constitute the predominant part in the financial support of regional sports federations, which cannot but affect the final volume of their financing – with a limited budget, the more sports federations, the less each of them can receive. In this case, the chosen budget policy can either help in the development of sports or lead to decline. Therefore, the formation of clear and objective rules for obtaining a certain amount of financial support from the state is an important factor in fair competition for resources. This study proposes a model for the distribution of financial resources among sports federations. The model is built on objective, measurable and verifiable indicators that characterize the quantitative and qualitative characteristics of athletes, personnel potential and organizational abilities. All indicators are calculated in relation to each other, and the starting point for calculations is the athlete who is enrolled in the sports school. At the output, the model forms a balanced system, the relationships within which change when the quantitative and (or) qualitative characteristics of the indicators change, as well as a logically sound order of financing for each specific sport.

ABSTRACT The general goal of family and educational environment is to prepare the rising generation for public practice by gaining social experience and building a moral culture of behavior. Although they are different, both institutions are responsible for the upbringing of children. Part of the extracurricular work in physical education and sport are also sports activities organized and conducted by sports clubs in a certain type of sport. The article conducts a study on the impact of training and sports competition activities on the formation of morally responsible behavior in adolescent football players. Certain indicators are derived from each criterion being analyzed in order to determine the moral status of the contestants. The methods of pedagogical research discourse, inquiry, and expert evaluation, applied to two age groups (total respondents – 280 competitors, 22 coaches, 18 referees, and 4 football delegates) during the football championship 7 of the 2021/22 sports competition year in Stara Zagora region. The opinion of the coaches and delegates, the actions of the referees regarding disciplinary control, the behavior of the players before the start, during, and after the end of football matches, numbering 300, have been examined. The statistical methods for processing empirical data for the purpose of analyzing and presenting the results of the study are variational, cor-relational, comparative, and descriptive analyses, Van der Waerden test, and processing of textual information from matches played. The results obtained found positive and statistically analyzed changes in the behavior of the contestants according to the criteria and indicators studied and prove the formative impact of active sports activity on the moral culture of the personality. The inquiry analysis carried out by place of residence shows that the research effect on the behavior of contestants has greater values for those living in larger cities.

Violence at sports events can threaten the safety and security of participants and visitors of sports events, cause material and non-material damage, violate values that are an integral part of sports, have a harmful effect on minors, but also on the quality of services provided before and during the duration of the sports event. In the paper, the author analyzes the security measure проhibition from attendending at certain sports events, which was introduced into the system of criminal sanctions with the aim of protecting public safety at sports events. The author analyzes for which criminal act this measure is imposed in judicial practice, how judicial practice determines the circle of sports events where attendance is prohibited, how this measure is implemented, as well as what consequences arise if the prohibition determined by the imposition of this security measure is violated. One of the first questions that the author analyzes in this paper is the question of whether this security measure can be imposed on participants of sports events such as athletes or sports coaches. In order to answer this question, the author analyzes who can be the perpetrator of the criminal act of violent behavior during at sports event or other public gathering, and due to the obligation to impose the observed security measure on the perpetrators of this act at the sports event.
