Abstract:
But: Le but est d'analyser les résultats de la chirurgie colo-rectale laparoscopique appliquée aux cancers en terme de faisabilité avec une sécurité suffisante et en terme de survie. Méthode: De mars 1993 à décembre 2000, 103 patients porteurs d'un cancer colo-rectal ont été opérés par laparoscopie. Leurs données ont été relevées prospectivement sur une banque de donnée. Résultats: Quarante-deux femmes et 61 hommes d'un âge moyen de 66.7 ans ont été opérés. Il s'agissait de 9 hémicolectomies droite, 6 hémicolectomies gauche, 35 sigmoïdectomies, 41 résections antérieures basses et 12 amputations abdomino-périnéales. Le taux de conversion était de 14.5%. Des complications postopératoires sont survenues chez 21 patients (20.3%) et ont diminuées avec l'expérience. La mortalité du premier mois était de 0.9%. Tous les cancers (31% stade UICC I, 28% stade II , 37% stade III et 3% stade IV) ont été réséqués en tissu sain avec 19.8 ganglions lymphatiques en moyenne par pièce opératoire. 53.3% des patients sont réalimentés à partir du 2ème jour postopératoire et ils ont quittés l'hôpital en moyenne 12.6 jours après l'intervention. Trois métastases des orifices de trocart, 4 récidives locales et 10 métastases à distance sont survenues après un suivi moyen de 34.5 mois (12-92). Conclusion: La chirurgie laparoscopique du cancer colo-rectal permet une résection oncologique adéquate avec une morbidité acceptable et une mortalité faible. Pour démontrer que le taux de récidive et la survie sont équivalents à ceux de la chirurgie ouverte, des études prospectives randomisées sont encore nécessaires.

Mobile banking applications have been actively used in the financial sector for several years. Such applications significantly facilitate the use of banking services for their users. At the time of active digitalisation, the financial sector also needed reforms and active changes, that is why developers have been actively working on creating first home banking and then mobile banking applications since the end of the last century. Mobile banking applications have come a long way in evolution, so that users can now perform not only simple banking operations, but also many new additional functions making life easier. The development of the technologies used has also led to the emergence of new vulnerabilities, which required the improvement of security systems in such applications. The development path and experience of Ukrainian applications is somewhat different from that of foreign ones, but no less valuable. The development of foreign applications is more standardised and controlled by the government. Such solutions allow for better verification of compliance with security requirements. However, it should not be forgotten that mobile banking was created to facilitate financial transactions remotely, and therefore it should be easy to use by the average user. The article provides a comparative analysis of Ukrainian and foreign banking applications, including: Stanford FCU, Fideuram, N26, Banque populaire du nord, Sparkasse, Monobank, Privat24, Ukrsib-online, Oschadbank, and PUMB. The applications were compared by two groups of criteria, namely security and convenience criteria. The article focuses not only on the aspects in which Ukrainian applications should develop, but also on those in which they have an advantage over foreign apps.

Abstract:
The study is about risks management tools on financial performance of commercial banks in Rwanda, the case study of BPR Plc. The general objective of this research was to assess the contribution of risks management tools on financial performance of commercial banks in Rwanda, taking a case study of BPR. Specific objectives includes to ascertain risks management tools used by BPR in managing its asset; to analyze the financial performance of BPR in Rwanda since 2015 to 2018 and to find the link amid risks management tools and financial performance of commercial banks in Rwanda. The results of this research are useful for academic purpose as reference, to institutions, which will access the findings to address risk issues and improve their control measures against risk. The main theory applied in this research is Agency theory. This research adopted descriptive and correlation research designs and is both qualitative and quantitative research. Forty-two (42) is target population used; census was applied in this research as the sampling technique since the target population is small and data were analyzed using SPSS version 20 to generate frequency tables, charts, and regression analysis. The research revealed that at BPR Plc, use of risk management tools has a great positive relationship with the financial performance of BPR as it is being indicated by the respondents about standard and reports, position limit and rules, investment guideline and strategies whether help in financial performance in BPR, many respondents were in agreement with this statement as it is indicated by a high means and homogeneity in responses as the standard deviations obtained for all items of independent variables were less than one (SD<1). for objective two, it was seen that BPR Plc financial performance increased considerably since 2015 to 2018 as results of risk management tools; for relationship, the results found that risk management tools greatly influence BPR financial performance as justified by P-values which are positive and statistically significant respectively for position limit and rules (p=0.003), standard and reports (p=0.034), investment guideline and strategies (p=0.023) which are less than the significance level (P<0.05) from multiple regression analysis. The conclusion is that risk management tools greatly influence banks financial performance. So far, much is already done by the Bank to overcome and mitigate risk in all BPR operations but there is need to emphasize on new strategies to improve on standards, rules and regulation to enforce risk mitigation. In today’s BPR daily business; technology is increasing, process and procedures are tightened, account manipulation are restricted. This has greatly reduced reputation and financial risk leading to increase in financial performance. The further studies should be carried out on implementation of risk management strategies and financial performance in banking industry.

The outbreak of a new type of coronavirus pneumonia significantly influenced the world’s economy. Small micro-enterprises, as the main mode of operation of the catering enterprises, have experienced four months of winter. They are faced with less income online operation, the effect not beautiful, supply chain difficulties, and many problems such as shortage of cash flow. Hence, If catering businesses don't actively work to strengthen their crisis management skills, they'll suffer substantial losses that could even disrupt their regular business operations. So it is a very important topic to study the current situation of the catering industry.

Abstract This paper examines in the framework of the asset pricing theory how the internationalization of banking operations has influenced the returns and the risk of Canadian chartered banks. Banking statistics reveal that in the last decade the Canadian banks have greatly increased their foreign operations. These statistics also indicate that the development of international banking operations has been more remarkable than that of domestic banking operations. Contrary to some banks' claims, our evidence reveals that average returns on foreign operations have been inferior to those obtained on purely Canadian operations. Moreover, in conformity with the asset pricing theory we have found that the systematic risk of international operations is smaller than that of domestic operations. Our results suggest that Canadian chartered banks have reduced their overall risk in internationalizing their operations.

The stability of each country's monetary system depends on the quality of operations of its Central Bank, as one of the most important institutions. Due to their great importance, central banks hold a special place in scientific analysis. For a Central Bank to successfully achieve its objectives, it has to operate independently of the executive and legislative powers. Through content analysis and the comparative method, this paper analyzes and compares different parameters and indices measuring the independence of the central banks of the Republic of Croatia and the Republic of North Macedonia. Considering that the independence of a Central Bank is inextricably linked with its credibility, this paper conducts research that answers the question - what is the level of legal independence of the Croatian National Bank and the National Bank of the Republic of North Macedonia? It can be said that, in the last decade, both the legal and actual independence of these central banks has reached its peak, but a certain degree of political dependence is still noticeable. There are certain differences in terms of political influence from country to country, but in any case, the syndrome of political dependence in former Yugoslav countries when compared to developed countries is extremely recognizable. The Republic of Croatia, as a member of the European Union, had to harmonize its laws on this issue, so it can be said that there are certain differences compared to other countries in this region. Central banks in countries that once belonged to the same Communist bloc, and which today have different statuses in relation to the European Union, are excellent examples for analyzing the degree of operational independence in relation to state power. The status of the Central Bank in a certain national and economic system depends on the legislation of that country, i.e., the constitutional norms and laws governing the Central Bank.

Democratie Accountability and the Independence of the European Central Bank in an Historical and Comparative Perspective ; Employing a form of methodology which permits the evaluation of the independence of central banks, the comparison of the evolution of the central banks in Britain and in France since the 17th century locates the main focus of debate on the issue of democratie accountability. The application of this method to the European Central Bank, and a comparison with the British and French banks leads to a democratie deficit being identifiable within the European institution. Since a reform of the ECB’s regulations does not appear timely, it is rather by way of a modification of its modes of operation that this weakness may be remedied.

Cette thèse analyse les opérations de crédit et d’émission de billets de la Banque de France, entre 1870 et 1897 et les relations entre l’État républicain et l’institution financière. Elle suppose que la Guerre franco-prussienne (1870-1871) et l’arrivée de Joseph Magnin, républicain, sous la Troisième République (mandat 1881-1897), ont influé sur la politique de la Banque de France. Après la Guerre et alors que l’Europe vit une période de stagnation économique, l’Allemagne et les États-Unis connaissent un développement rapide qui intensifie la concurrence entre les pays. La nomination d’un Gouverneur républicain à la tête de la Banque permet à l’État d’intervenir dans la politique de l’institution, pour permettre l’extension de l’offre de crédit. Néanmoins, beaucoup de dirigeants de la Banque insistent sur le fait qu’elle est encore une société anonyme, au nom de son indépendance. Cette opposition s’observe principalement dans la discussion sur le crédit agricole et l’extension du réseau de la Banque. L’intervention de l’État a aussi joué un rôle important pour le contrôle du désordre du marché résultant de l’échec du Comptoir d’escompte de Paris en 1889. Sous l’initiative du Gouverneur Magnin, l’accumulation de l’or à la Banque et l’augmentation de la monnaie fiduciaire se sont établies. This thesis analyses operations of credit and of issue of banknotes of the Bank of France between 1870 and 1897, and relations between the State and the financial institution. It supposes that the French-Prussian War (1870-1871) and the arrival of Joseph Magnin, republican (term 1881-1897), influenced the policy of the Bank under the Third Republic. After the war, and during a protracted recession in Europe, Germany and US achieved drastic economic growth and competition between countries escalated. The French government intervened the policies of the Bank of France by a republican assuming the post of the Governor of the Bank, and expanded credit facility. However, many executives of the Bank claimed the fact that it was still a private bank based on its independency. This conflict could be seen mainly in the discussion on expansion of agricultural credit and the base network of the Bank. The intervention of the State fulfilled an important role as well for the control of the confusion of the domestic market resulting from the collapse of the Comptoir d’escompte de Paris in 1889. Under the initiative of the Governor, Mr. Magnin, accumulation of gold was implemented and issuance of banknotes increased in the Bank. In 1897, expansion of credit facility was institutionalized in the discussion between the government and parliament on the renewal of the privilege to issue banknotes for the Bank, and after that, the next Governor Pallain further promoted accumulation of gold

De manière générale, le tribunal saisi vérifie sa compétence en analysant le différend, en déterminant les éléments du rapport de droit, en caractérisant les parties en conflit, et en établissant que les exigences de chacune des règles sont satisfaites. Mais, dans le cadre des relations bancaires électroniques, la juridiction exerce sa fonction en tenant compte des facteurs technologiques qui affectent la conclusion et l’exécution et de la relation litigieuse,et en prenant en considération le poids réel et juridique de la banque et du client.Pour que les critères juridictionnels et leurs liens de rattachement soient applicables de manière correcte, logique et équitable, la juridiction se doit appréhender avec un oeil neuf, des notions et concepts aussi variés que l’accord électronique d’élection de for, l’autorité de la banque, l’étendue de la protection des consommateurs, le domicile et la résidence, la notion de l’obligation bancaire, ainsi que le lieu de la conclusion et de la prestation de service, le lieu où se produit le fait dommageable, et le dommage économique
This thesis examines the possibility of applying of relevant French and European rules in the field of litigations arising from electronic banking. The seized court checks its jurisdiction by analyzing disputed subject, identifying the elements of legal relationship, characterizing the parties of the dispute, and establishing that requirements of each rule are met. Once the court exercises its function, it considers the technological factors that may affect the fulfilling way of the legal relationship and dispute over it, as well as taking into account the actual and legal weight of both bank and customer. So that, in order to practice relevant criteria and connecting links in correct, logical and fair way, it is necessary for the court to reconsider it sunderstanding of different aspects of disputed subject. In other words, the court should renew its view on several issues, such as the electronic agreement on jurisdiction, the authority of the bank, the extent of the protection of consumers, the domicile and residence, the concept of bank obligation, the place of signing and fulfilling the contract, the place where the service is provided, as well as the place of occurrence of harmful event and economic damage

La pratique des affaires révèle le succès que connait l’arbitrage comme mode de résolution des différends. Cette forme de justice, promue par d’importantes conventions internationales et régionales, est reconnue et encouragée par de nombreuses législations nationales. Les Républiques arabes syrienne et égyptienne ne sont pas en reste. Elles se sont dotées de textes importants et modernes qui visent à assurer l’efficacité du processus arbitral et à créer un terrain favorable au développement de ce type de règlement des différends. Pourtant en dépit d’un contexte législatif favorable, les opérateurs du secteur bancaire de ces républiques sont encore réticents à recourir à cette forme de justice. Or si ce constat trouve sans doute quelques justifications s’agissant du contentieux né de la mise en œuvre d’opérations purement internes, il est plus surprenant de l’observer s’agissant d’opérations qui se déploient dans l’ordre international. L’objet de l’étude est donc de souligner les perspectives offertes par les nouveaux dispositifs. En premier lieu c’est la question de « l’accès à l’arbitrage » qui se trouve explorée. Au-delà de cette problématique première, il fallait encore examiner la manière dont ces dispositifs nationaux encadrent « la justice arbitrale » au stade de l’instance comme à celui des recours ouverts à l’encontre de la sentence
The practice of business reveals the success of arbitration as a means of resolving disputes. This form of justice, promoted by important international and regional conventions, is recognized and encouraged by many national legislations. The Syrian and Egyptian Arab Republics are not so left behind this way. They have adopted important and modern texts which aimed at ensuring the effectiveness of the arbitration process and creating a favorable environment for the development of this type of dispute settlement. Yet despite a favorable legislative context, banking operators in these republics are still reluctant to resort to this form of justice. Although this resume may be justified in the case of disputes arising from the implementation of so purely internal operations, it is surprising to observe it in the case of operations which are deployed in the international order. The object of the study is therefore to highlight the prospects offered by the new legal provisions. At first, the question of "access to arbitration" is explored. Going beyond this first problem, it was still necessary to examine the way in which these national provisions frame "arbitral justice" at the stage of the proceedings as well as at the level of appeals available against the award

Face à la baisse de l'aide publique au développement et aux enjeux du financement des objectifs de développement durable à l'horizon 2030, la mobilisation des ressources internes reste la seule alternative crédible devant garantir des sources stables pour le budget national. Toutefois, les pays en développement sont confrontés à un faible niveau de mobilisation des recettes fiscales qui demeure en-dessous de 20% du PIB contre 33% au moins dans les pays développés.Parmi les secteurs devant contribuer à l'élargissement de l'assiette fiscale figure le secteur financier qui, de par son importance et ses multiples fonctions dans l'économie, constitue un potentiel fiscal sous-exploité par les pays en développement. Ainsi, l'objectif de cette thèse est d'analyser la contribution du secteur bancaire à la mobilisation des recettes fiscales dans les pays en développement d'une part et d'autre part montrer en quoi la fiscalité pourrait compromettre le niveau de performance des banques. Cette thèse est composée de trois (03) essais.Le premier essai est consacré à l'analyse de l'impact de l'accès aux informations bancaires des contribuables sur les recettes fiscales aussi bien au niveau des impôts directs que des impôts indirects. A partir d'un échantillon de 62 pays en développement sur la période de 1995 à 2016 et en utilisant la méthode des moments généralisés, nous avons montré qu'un accroissement de 1 point de l'indice d'accès aux informations bancaires entraîne une hausse de 1,1 point de pourcentage du taux de pression fiscale. Cet effet est de 2,0 points de pourcentage pour les impôts directs et de 0,98 point pour les impôts indirects. Ces effets sont renforcés dans le cadre de la promotion de la bonne gouvernance et de la participation des pays aux programmes d'assainissement des finances publiques menés généralement par le FMI.Dans le second essai, il est question de l'analyse de la relation entre la fiscalité et l'activité d'intermédiation financière des banques dans les pays membres de l'UEMOA. Ainsi, en appliquant la méthode d'estimation à effet fixe pour un panel de huit (08) pays de l'UEMOA sur la période 2000-2018, nous avons montré que la fiscalité appliquée aux banques exerce un effet d'éviction sur l'intermédiation bancaire dans le cas des pays de l'UEMOA. Ainsi, un accroissement de 1% du montant des impôts sur le bénéfice et les autres prélèvements payés par les banques (sans la taxe sur les activités financières) réduit de 0,24% le crédit accordé au secteur privé.Le troisième essai traite de la problématique de l'imposition des opérations bancaires à la taxe sur la valeur ajoutée (TVA). La TVA, qui est un impôt indirect, représente dans la plupart des pays qui l'ont adoptée, près de la moitié des recettes fiscales collectées par les administrations fiscales. Mais, elle fait l'objet de plusieurs exonérations qui entravent son rendement. Tel est le cas des banques où les opérations sont exemptées de la TVA. Cette exemption qui compromet la neutralité économique de la TVA entraine également des distorsions et des conséquences sur les services bancaires. Malgré ces raisons, certains pays ont introduit dans leur législation la taxation à la TVA des opérations de banque en vue de réduire les distorsions et la TVA rémanente. Ainsi, l'estimation réalisée pour le cas du Togo en utilisant le chiffre d'affaires des banques comme base imposable sur la période 2015-2018 montre que l'imposition à la TVA des opérations de banque pourrait générer, ceteris paribus, des recettes fiscales supplémentaires de 11,1 milliards de FCFA par an, soit 0,3% du PIB comparativement à la taxe sur les activités financières. L'imposition à la TVA des opérations de banque au Togo pourrait contribuer significativement à l'accroissement des recettes fiscales tout en rétablissant le mécanisme normal de fonctionnement de la TVA dans l'économie
Faced with the decline in public development assistance and the challenges of financing the sustainable development objectives by 2030, the mobilization of internal resources remains the only credible alternative to guarantee stable sources for the national budget. However, developing countries are faced with a low level of tax revenue mobilization which remains below 20% of GDP compared to at least 33% in developed countries.Among the sectors expected to contribute to broadening the tax base is the financial sector which, due to its importance and its multiple functions in the economy, constitutes a tax potential that is under-exploited by developing countries. Thus, the objective of this thesis is to analyze the contribution of the banking sector to the mobilization of tax revenues in developing countries on the one hand and on the other hand to show how taxation could compromise the level of performance of banks . This thesis is composed of three (03) essays.The first essay is devoted to analyzing the impact of access to taxpayers' banking information on tax revenues both in terms of direct taxes and indirect taxes. From a sample of 62 developing countries over the period from 1995 to 2016 and using the generalized method of moments, we showed that an increase of 1 point in the index of access to banking information leads to an increase of 1.1 percentage points of the tax pressure rate. This effect is 2.0 percentage points for direct taxes and 0.98 points for indirect taxes. These effects are reinforced within the framework of the promotion of good governance and the participation of countries in public finance consolidation programs generally carried out by the IMF.In the second essay, it is a question of analyzing the relationship between taxation and the financial intermediation activity of banks in WAEMU member countries. Thus, by applying the fixed effect estimation method to a panel of eight (08) WAEMU countries over the period 2000-2018, we have shown that the taxation applied to banks has a crowding out effect on the banking intermediation in the case of WAEMU countries. Thus, an increase of 1% in the amount of taxes on profits and other levies paid by banks (without the tax on financial activities) reduces the credit granted to the private sector by 0.24%.The third essay deals with the problem of imposing value added tax (VAT) on banking operations. VAT, which is an indirect tax, represents in most countries that have adopted it, almost half of the tax revenue collected by tax administrations. But, it is subject to several exemptions which hamper its performance. This is the case for banks where operations are exempt from VAT. This exemption, which compromises the economic neutrality of VAT, also leads to distortions and consequences on banking services. Despite these reasons, some countries have introduced VAT taxation of banking operations into their legislation in order to reduce distortions and residual VAT. Thus, the estimate carried out for the case of Togo using the turnover of banks as a taxable base over the period 2015-2018 shows that the VAT imposition of banking operations could generate, ceteris paribus, tax revenue additional of 11.1 billion FCFA per year, or 0.3% of GDP compared to the tax on financial activities. The imposition of VAT on banking operations in Togo could contribute significantly to increasing tax revenues while restoring the normal functioning mechanism of VAT in the economy

Dans les années 1990, suite aux conséquences jugées néfastes des programmes d’ajustement structurel et de certains projets qu’elle a financés, la Banque mondiale est confrontée à une crise sans précédent. L’institution internationale réagit en s’auto-décrivant comme une « Banque du savoir », expression par laquelle elle revendique que sa valeur première réside dans ses savoirs sur le développement, tout en reconnaissant la nature politique ainsi que la nécessité de transformer ces savoirs. Cette thèse prend pour objet cette auto-description et s’interroge sur la nature actuelle de cette Banque du savoir. À cette fin, des enquêtes ethnographiques, essentiellement en Afrique de l’Ouest, ont été menées sur des savoirs que la Banque mondiale elle-même a identifiés comme un objet de préoccupation : les savoirs embarqués dans ses interventions d’aide au développement (projets, assistances techniques). En discutant principalement la littérature en anthropologie du développement, et en s’appuyant sur des travaux en Sciences, technologies, sociétés, la thèse identifie au cœur de ces interventions ce qu’elle appelle une « expertise comme opération ». Cette expression désigne le fait d’agir, pour les experts de la Banque mondiale (consultants, chefs de projet), en construisant ou en transformant les identités et les problèmes d’entités individuelles ou collectives, à l’aide d’un travail de production et de mobilisation de savoirs sur ces entités, et en faisant souvent en sorte que ces entités se saisissent elles-mêmes des savoirs les concernant. In the 1990s, the World Bank was facing an unprecedented crisis, due to the consequences of structural adjustment programs and of some projects it financed, which were considered harmful by many. The response of the international institution was to describe itself as a “Knowledge Bank”, claiming by this term that its primary value lied in its development knowledge, while acknowledging the political nature and the need to transform this knowledge. This thesis takes up this self-description and investigates the current nature of this Knowledge Bank. To this end, ethnographic studies, mainly in West Africa, were conducted on knowledge that the World Bank itself has identified as one of its prominent concern: the knowledge embedded in its development interventions (projects, technical assistance). By discussing mainly the literature in anthropology of development, and building upon relevant work in Science and technology studies, the thesis identifies an “expertise as operation” at the heart of these interventions. This expression denotes the actions undertaken by World Bank experts (consultants, project managers) to construct or transform the identities and problems of individual or collective entities, through the production and mobilisation of knowledge about them, and often by ensuring that these entities seize upon this knowledge about themselves. The choice made in the thesis to analyse economic interventions (support for the competitiveness of an economic sector, support for the development of entrepreneurship, or research on industrial policies) allows for an in-depth analysis of the much criticized neoliberal and “economicist” policy of the World Bank, so as to show that the politics of the institution cannot be reduced to those aspects, and is primarily embedded in these operations of expertise on identities and problems

L'objet du présent projet de thèse porte sur l'analyse critique des normes de contrôle du risque opérationnel. Il s'agit de mettre en lumière la manière dont le Risk Management mobilise les parties prenantes des organisations pour créer et animer une culture du risque opérationnel. L'approche retenue est la triangulation méthodologique combinant deux recherche-action réalisées au sein d'un établissement bancaire et d'une compagnie d'assurance ainsi que des entretiens semi-directifs et une analyse de contenu sur un ensemble de documents internes à chacun des cas étudiés. Les résultats de la recherche font état de la nécessité de traduire les normes de contrôle prudentiel dans l'organisation et de structurer les nombreux contrôles pour mettre en œuvre une politique de risque effective.Les récentes évolutions règlementaires dans le domaine bancaire et en assurance (Bâle 2 et Bâle 2.5, Bâle 3, Solvabilité 2) tendent à renforcer les dispositifs de contrôle interne et de Risk Management ainsi que la communication d'informations sur ces dispositifs pour une meilleure maîtrise des risques. Ainsi, le règlement CRBF 97-02 parle de filière risque opérationnel, la directive à venir Solvabilité II évoque dans son pilier 2 la nécessité de développer un contrôle interne et un Risk Management tournés vers la prise en compte du risque dans l'organisation et non seulement comme un sujet de provisionnement de fonds propres.Cependant ces efforts n'empêchent pas la survenance et la médiatisation de scandales financiers dont l'ampleur est à la hauteur des montants financiers traités. Ainsi, de nombreux établissements financiers sont touchés par le risque opérationnel. Ce risque est avant tout un risque organisationnel, contingent du facteur humain et prenant de multiples formes (les catégories baloises du risque opérationnel en sont une illustration). Les exemples de survenance de risque opérationnel sont nombreux : les cas de JP Morgan, d'UBS, de Société Générale, de Barclays, de HSBC, de Goldman Sachs en attestent. Toutefois, le risque opérationnel n'est pas seulement le fait de banques de financement et d'investissement et n'est pas uniquement un risque extrême par ses conséquences. Il concerne également les banques de détails et les sociétés d'assurance et est le plus souvent un risque de fréquence et de faible impact (fraudes aux moyens de paiement et fraude à l'assurance par exemple). La réglementation prudentielle comprend un ensemble de normes tendant à inciter les établissements financiers à mieux prendre en compte cette catégorie encore émergente et mal connue de risque (les risques de marchés ou de crédits faisant l'objet de davantage d'études).Nous décrivons et analysons l'influence de ces évolutions normatives sur les dispositifs internes de maîtrise du risque opérationnel (Risk Management opérationnel, contrôle interne) et nous interrogeons la manière dont les établissements financiers structurent leur contrôle des risques, plus particulièrement en ce qui concerne l'effectivité de ces dispositifs. Afin d'éviter de développer des contrôles manquant d'effectivité, il devient essentiel de situer cette régulation prudentielle dans une perspective de structuration des contrôles et de traduction/compréhension de la norme de contrôle
The aim of this thesis is to bring to light the way the Risk management mobilizes the stakeholders of organizations to create and lead a culture of the operational risk.Our research approach is the methodological triangulation, combining two action-research case studies, arising within a banking institution and within an insurance company, as well as semi-directive interviews and an analysis of contents on a set of internal documents in each of the studied cases. The research results state the necessity of translating the standards of prudential control in the organization and of structuring the numerous controls to implement an effective risk mastering policy.The recent statutory evolutions in the banking and insurance sectors (Basel 2 and Basel 2.5, Basel 3, Solvency II) tend to strengthen systems of internal control and Risk Management as well as the communication of information over these devices for a better control of the risks. So, the regulation CRBF 97-02 speaks about operational risk systems, the directive to come Solvency II evokes in its pillar 2 the necessity of developing an internal control and a Risk Management turned to the consideration of the organizational risks.However these efforts do not prevent the emergence and the mediatization of financial scandals the scale of which is as high as the financial handled amounts. So, numerous financial institutions are affected by the operational risk. This risk is before any an organizational risk, a contingent of the human factor and taking multiple forms (the Basel categories of the operational risk).There are numerous examples of extremes operational risks: the cases of JP Morgan, UBS, Société Générale, Barclays, Goldman Sachs give evidence of it. However, the operational risk is not only the fact of corporate and investment banking and is not only an extreme risk by its consequences and in low probability. It also concerns retail banks and insurance companies and is most of the time a risk of frequency and low impact (frauds in payment activities, and fraud in life and non-life the insurance for instance). The prudential regulation include a set of standards tending to incite financial institutions to take into account better this category still emergent and badly known by risk (markets risks or credits risks have being the object of more studies).We describe the influence of these normative evolutions on the internal devices of the operational risk (Operational Risk Management, Internal Control) and we question the sense given by establishments to the information onto the control of the risks, more particularly as regards the effectiveness of these devices. To avoid an informative overload regarding control, it becomes essential to place this prudent regulation in perspective of structuring of the controls and the translation / understanding of the risk control standards

Les résultats obtenus montrent que la crise a changé ces comportements. Au plan de comportement stratégique, les banques européennes s’orientent, en 2012, vers le modèle de banque de «détail pur» alors qu’en 2006 elles se répartissaient sur 3 modèles: «détail pur»; «mixtes»; «marché». Pour les banques de l’Amérique du Nord et de l’Asie-Pacifique, déjà spécialisées dans le «détail pur» en 2006, le restent pour 2012. Au plan de comportement opérationnel, les banques européennes passent d’une focalisation sur la rentabilité vers le renforcement de la suffisance de capital. Les banques nord-américaines et de l’Asie–Pacifique, focalisées sur l’activité en 2006, s’orientent sur la rentabilité en 2012. To do this, we showed, first, that the balance sheet and income statement are good explanatory tools of strategic and operational behavior of banks. Due to the special responsibility of the large banks in this crisis, we used data of the top 200 global banks listed in the 2006 (pre-crisis) and 2012 (post-crisis) classifications, retrieved from the database "The Banker". We used the exploratory factor analysis to discover the latent factors which influence the banks behaviors, in a comparative static logic. The results show that this crisis has actually changed these behaviors. From the strategic positioning perspective, the trend of the European banks after the crisis is the "retail-funded" banking model. In 2006, the positioning was heterogeneous with a "cocktail" of "retail-funded", "wholesale-funded" and "trading" banks. For the North American and Asia-Pacific banks, which was already specialized in the "retail-funded" in 2006, will remain so for 2012. In terms of operational behavior, European banks pass from a strong focus on profitability, before the crisis, to a reinforcement of capital adequacy, after the crisis. The banks of North America and Asia-Pacific, which were focused on the activity, before the crisis, will give more importance to the profitability after the crisis. Against all odds, the flagship of impresario George Wein’s global operation turned out to be a modest success—not for the sweep and aspiration by which we usually evaluate it, but for incisive and animated musicianship. The Sound of Surprise surprised. True, the perception may have been helped by diminished expectations. The piano recitals were gone, as were the crossover artists—Ray Charles, B. B. King—who ensure a certain boisterousness. Instead of three major hall concerts per evening, JVC ‘93 offered two or one. New music was conspicuously absent. Several young mainstreamers were pressed into jam session tableaux, but none received important debuts or showcases.

This chapter traces how the Chinese booksellers in the Chessboard Street neighborhood utilized the tradition of merchant guilds and the Qing government's reform initiative to create their quasi-legal institution in order to regulate and protect what they believed to be banquan/copyright. It illustrates in particular how the Shanghai shuye gongsuo (SBG), a civic organization with no legal jurisdiction or official authorization, enforced its banquan/copyright regulation and punished pirates according to their ideas of morality, norms, and customs. It illustrates how the SBG's rich records not only reveal the daily operation and conflicts in the modern Chinese cultural economy, but also the booksellers' conceptions of property ownership, civility, and trust that were articulated and contested in routine transactions. The chapter also focuses on how the SBG interacted and negotiated with the state's formal legal system after the promulgation of China's first copyright law in 1911. Throughout the 1910s and 1920s, although new legislation regarding the protection of copyright appeared, it was rarely enforced in reality because consistent political upheavals had prevented the Chinese central state from establishing sufficient legal control over its territory.

The government's reaction sparked ANC counter-measures: in response to the state's counter-measures, the ANC in 1953 introduced the M-Plan, a scheme to enable it to continue operating in the event of legal proscription. Nelson Mandela meanwhile encouraged Walter Sisulu to approach Maoist China to inquire about obtaining weapons for a South African armed struggle. The chapter also considers campaigns launched by the Congress Alliance in the mid-1950s, principally those against the Bantu Education Act, the Western Areas removal, and for the Congress of the People. The latter campaign led to the adoption of the Freedom Charter.

Trans-imperial activism could easily translate into forms of trans-politics, as Chapter 5 reveals. In the years after 1908, Pan-Islamism, Ottomanism, and imperial nationalism all brought into sharp relief the many cross-border connections linking the French Empire to territories beyond its frontiers. Moreover, these various movements generated ripple effects that rattled every part of the French Empire. Ottoman expatriate communities were invested in politics back home, entailing that the Young Turk revolution of 1908 was played out in Parisian newspaper offices and banquet halls as events unfolded in Istanbul. French military advances into Morocco occurring at the same time encouraged the formation of radical paramilitary organizations operating from Cairo to Fez that would increasingly spur Pan-Islamic platforms attractive to Algerians and Tunisians. Italy’s invasion of Ottoman Libya in 1911 produced a militarized conflict that spilled over into neighboring French colonies, generating humanitarian campaigns and political debates that were linked to wider international events. These details testified to the imperial and popular politics that grew out of cross-border connections forged through migration and Muslim social networks. The forms of trans-politics that emerged in the early twentieth century exposed the porous nature of imperial borders as well as the emotional and ideological ties that challenged territorialized notions of sovereignty and state jurisdiction. As movements converged and spread, France’s North African empire appeared to be unravelling.

Abstract The wind of change following Portugal's imperial retreat from Africa informs the subject matter of this paper. The changes led South Africa to recalibrate its regional policy and pursue "détente". This diplomatic effort failed after the outbreak of civil war in Angola induced South Africa to invade in support of the FNLA and UNITA, to prevent SWAPO from operating in the country. Cuba successfully countered South Africa's intervention by sending combat troops to bolster the MPLA. South Africa's defeat overlapped with growing ferment over the application of the Bantu Education Act, passed in 1953, which decreed that half of high school subjects in black schools had to be taught in English and the other in Afrikaans. The clause had not been enforced until the mid-1970s. Mass student protests against the language clauses resulted in the Soweto massacre on 16 June 1976.

Corporate Social Responsibility (CSR) has become a significant field of studies to stress the importance of the new role of organizations towards the society for sustainable development. Nowadays, an enormous number of authors have been participating in this field to highlight the responsibility of organizations towards the community, society and the natural environment where they are operating. Despite the growing number of researches related to CSR in the developed countries little empirical studies have been devoted to examine CSR concept and practice in the African countries, the MENA region (Middle-East and North Africa), as well as in the Golf countries. This chapter seeks to study CSR concept and practice in the emerging market economies (EMEs). It will mainly focus on the implementations of CSR by the public banking sector. We will investigate the role of the public banking sector existing in an Arab country in comparison to an Asian country to explain and analyze the similarities and differences of CSR activities in both experiences. In this comparative study we will primarily examine Banque Misr, as one of the oldest and largest public bank in Egypt and the Malayan Banking Berhad (trading as Maybank) as the largest public bank in Malaysia. After a meticulous review of literature, we propose a systemic framework to study CSR practices and policy implementations. We illustrated the CSR as a constant process where all variables are interrelated and are affecting each other in a mutual approach. In this systemic framework we advocated to study all significant variables related to CSR practice as: the history/philosophy development, core-values, CSR adopted definition, motives, key players, approaches, stakeholders focus, sectors of intervention and mechanisms of policy implementations. The chapter concludes that common CSR policies exist between the Malaysian and the Egyptian experience. Nevertheless the Malaysian model has formulated an elaborated and further sophisticated CSR public banking program. Meanwhile, the Egyptian model needs to adopt more global oriented CSR public banking policies, in particular to assure the sustainable development requirements.

These were market research, identifying potential markets, idea evaluation, concept development and setting goals and objectives.In order to progress from the concept development phase, the next requirement in developing a consumer–product relationship is to consider the nature of a food and beverage product. Within this phase, questions need to be addressed, and decisions made, in order to turn a consumer focus (the abstract concept that consumers purchase) into an operational focus. Customers may view a food and beverage product as a quick snack, a night out, a celebration, an indulgent extravagance or an absolute necessity. The nature of the occasion and the expectations from the meal experience is varied. What is one customer’s dining out is another’s eating out. The concepts are what customers purchase, but the food and beverage product, as an amalgamation of the tangible and intangible elements, is what operators construct and provide in order to satisfy the customer requirements. The marketing focus towards food and beverage service delivery tends to identify the product as: a central consumer concept known as the core concept; a surrounding layer of tangible features, and an outer layer of augmentation (see Section 1.3, p. 19 on product augmentation). Placing this framework on a food and beverage product might show that the core product is, for example, a wedding celebration, the tangible product is a full wedding banquet, and the augmented product includes the opportunity to pay by instalments. It is helpful to apply this type of product framework to the development of concepts. This is where frameworks such as the meal experience can be useful.

Six dual fuel Gas Turbine Generators (GTG) are used to generate power in the Banyu Urip oil production facility. The fuel gas system started to experience multiple challenges starting from unreliable Fuel Gas Compressor (FGC), fuel gas valve problem, and off-spec fuel gas due to scale formation at tube-bundle of Acid Gas Removal Unit Wet Surface Air Cooler (AGRU WSAC). Those multiple issues in the fuel gas system caused frequent use diesel fuel for GTG thereby increasing GTG’s operation cost. This paper shares how an integrated approach can deliver significant diesel fuel reductions by thorough surveillance, improving operational procedures and eliminating reliability issues. Root cause analysis was carried out on each issue that caused an upset in the fuel gas system, afterwards action items were assigned to several departments. With excellent collaboration between Engineering, Operations, and Maintenance, the improvement plan was successful. Our result shows a nearly 50% reduction in diesel fuel consumption in 2021 compared to the previous year.

Banyu Urip Acid Gas Treatment Unit consist of Acid Gas Removal Unit (AGRU), Acid Gas Enrichment Unit (AGE), Sulfur Recovery Unit (SRU), and Tail Gas Treating Unit (TGTU) where generic Methyl Diethanolamine (MDEA) solvent is chosen to treat acid gas with 45%-mole CO2 and 1.6%-mole H2S, however the proprietary amines may be substituted in the future with minimal design changes or modifications. As local industry has capability to produce formulated MDEA solvent, ExxonMobil Cepu Limited took the opportunity to perform the feasibility study of utilizing proprietary formulated amine for Banyu Urip AGRU and AGE system. This paper shares Banyu Urip Acid Gas Treatment’s holistic approach for a new solvent change from evaluation into real implementation while minimizing negative impact to existing operations. Several steps were carried out sequentially, starting from process simulation, pre-solvent selection, laboratory and material compatibility check to determine a suitable solvent and continued with field trial and optimization. Field trial was conducted by introducing new solvent into the AGRU and AGE system while the system was running with careful strategy to minimize process interruption. Subsequently, process parameter and field laboratory analysis were closely monitored and assessed to maintain stable operation. Throughout the field trial, all key performance indicator (KPI) parameters were within acceptable limits and no process anomalies, foaming issues, leaks, and other integrity issues identified. Despite amine solvent transition is practical in gas processing, such strategy should be considered from desktop process study to extensive laboratory works prior to field implementation. Good workmanship exhibited by all parties involved in this Field Trial resulted all the works carried out safely without major concerns. In this case, the amine solvent transition process will provide benefit for a continuous supply chain, cost optimization, and support domestic content enhancement and utilization.

Oil and gas fields often operate two or more compressor trains in parallel instead of one big compressor train to optimize reliability and capital investment. These compressor trains are usually designed to be loaded equally in order to avoid excessive design margin, to operate at highest efficiency point, and to prevent any compressor from operating too close to its surge region (McMillan, 1983). However, this configuration means the lowest train’s capacity dictates overall system’s capacity. This paper shares Banyu Urip Central Processing Facility (BU CPF)’s successful strategy to compensate capacity decrease in one of its gas injection train using unbalanced load distribution. Upon implementation of the strategy, BU CPF managed to maintain operations at 100% gas injection capacity even though the capacity of one of the train was limited to 70%, therefore eliminating unplanned downtime or production curtailment.

Abstract Acid Gas Removal Unit (AGRU) is used for fuel gas (FG) production in Banyu Urip Facility, Indonesia. AGRU was operated at the 50% design capacity due to low FG demand with several operation limitations due to AGRU Wet Surface Air Cooler (WSAC) poor performance. This condition led to off-spec fuel gas production with higher H2S and high temperature which adversely impacted fuel gas compressor (FGC) reliability. Consequently, frequent problem in FGC interrupted FG supply to Gas Turbine Generator (GTG) and lead to excessive diesel consumption to substitute FG for electricity generation in the facility. This causes a high operational cost. Additionally, the facility could not be pushed to operate in higher rate for production optimization. The WSAC improvement then became critical to sustain FG supply and reduce operational cost. Debottlenecking study to improve AGRU system performance was performed resulting in several improvement initiatives. Based on the study, significant heat transfer deterioration was observed at the WSAC 1st stage due to higher operating temperature compared to the 2nd stage. In addition to this, some required design improvements were also identified based on learning from historical failures such as water sprayer upgrade to anti-clogging type, motor and fan replacement for better induced draft cooling, and plenum material upgrade for better corrosion resistance. Therefore 1st stage bundle replacement with upgraded design was progressed. Post tube bundle replacement and combine with the chemical treatment, the AGRU WSAC heat transfer performance was increased by 75% and GTG diesel consumption was reduced substantially by ~70%. This contributed to $1M annual operational cost saving with project investment at only $650K. This fit for purpose project is more beneficial compared to the whole WSAC replacement which costs $2.4M. This condition also provided flexibility to run more GTG to produce more power for the facility. Additionally, by allowing more gas to be processed in AGRU, it helped the facility to optimize oil production.

This paper shares the background and evaluation of some potential solution to the problem, which is resulting an integrated short term and long term strategy. After completing a risk analysis approach, since facility modification in the sour gas system will lead to operation upset and unplanned downtime, then compressors and process operating parameters adjustment is chosen as the fastest and effective short term mitigation. The analysis also results a forward plan to perform chemical treatment for cooling water of the AGRU WSAC. This way, it will prevent additional scale formation and therefore prolong life the fuel gas system until AGRU WSAC tube – bundle replacement can be performed.

Automatic spelling correction for a language is critical since the current world is almost entirely dependent on digital devices that employ electronic keyboards. Correct spelling adds to textual document accessibility and readability. Many NLP applications, such as web search engines, text summarization, sentiment analysis, and so on, rely on automatic spelling correction. A few efforts on automatic spelling correction in Bantu languages have been completed; however, the numbers are insufficient. We proposed a spell checker for typed words based on the Modified minimum edit distance Algorithm (MEDA), and the Syllable Error Detection Algorithm (SEDA). In this study, we adjusted the minimal edit distance Algorithm by including a frequency score for letters and ordered operations. The SEDA identifies the component of the word and the position of the letter which has an error. For this research, the Setswana language was utilized for testing, and other languages related to Setswana will use this spell checker. Setswana is a Bantu language spoken mostly in Botswana, South Africa, and Namibia and its automatic spelling correction are still in its early stages. Setswana is Botswana’s national language and is mostly utilized in schools and government offices. The accuracy was measured in 2500 Setswana words for assessment. The SEDA discovered incorrect Setswana words with 99% accuracy. When evaluating MEDA, the edit distance algorithm was utilized as the baseline, and it generated an accuracy of 52%. In comparison, the edit distance algorithm with ordered operations provided 64% accuracy, and MEDA produced 92% accuracy. The model failed in the closely related terms.

The phenomenon of ’slamming’ is often the critical design load for high-performance marine craft. Slamming involves the solid-fluid impact of a hull structure, resulting in large forces acting on the structure due to the large volume of water displaced quickly. Due to its importance in the design and operation of marine craft, the impact of hull sections into water has been the focus of a significant body of research. These studies have primarily focused on rigid shapes, so the effects of hydroelasticity have not been examined in detail. This paper presents a robust and practical methodology for water impacts involving overset meshing and the VOF method using the FLUENT solver. The framework involves a high resolution dynamic overset mesh attached to the body in a coarse static Cartesian background mesh. Results for a simple 2D wedge impact are compared to experimental, analytical, and numerical results and an excellent agreement to the validation material is observed. Finally, a 2D transverse section based on the ORMA60 racing yacht Banque Populaire VIII was studied. This methodology is used to obtain impact force and pressures. It is applicable for designers of high-performance sailing craft to improve the prediction of hydrodynamic loading on their hull-form designs. The work carried out in this study is part of an ongoing PhD investigating existing and proposed structural design configurations for high-speed marine craft and analysing failure mechanisms under slamming events. Various structural configurations will be analysed using the framework outlined in this paper.
