Abstract:
The rapid shift online during the Covid-19 pandemic has put online learning firmly on the agenda of universities everywhere. To realise fully the transformative potential of online learning this book argues the need for an evidence-based design approach. The evidence comes from the experiences of online learners who are professionals: educators, engineers and researchers. Design-based research, survey responses and interviews with these learners will demonstrate that open, online, collaborative learning experiences are not only feasible but effective for building professional community knowledge. This kind of innovative online learning can help universities contribute to the global public good by achieving high quality learning at scale that will widen access to professional education and create more porous boundaries between universities and the wider community, for example in the context of the current policy discussions on the UN SDGs, such climate and inequality. The evidence shows how co-designed, transformative digital education can be mobilised to support, e.g., teachers in crisis contexts, professionals investigating renewable energy solutions, or medics adapting treatments to local conditions, and also scale up professional development in areas where expertise is urgently required. The book concludes that scaled up online learning can enable HE to deliver on the UN SDGs by equipping citizens and communities with the knowledge and skills needed to solve the world’s most pressing problems.

“Interdisciplinary Pedagogies in Higher Education” explores the increasing integration of goals for interdisciplinary learning in American higher education. The chapter begins with working definitions of interdisciplinary learning and the many factors that have led to its proliferation. It then reviews the elaboration of new methods to teach and to assess interdisciplinary learning, emerging models of interdisciplinary problem-solving, and practice-oriented resources and online tools to assist undergraduate, graduate, and professional students and their instructors with interdisciplinary problem-solving and communications in cross-disciplinary and interprofessional contexts. The chapter concludes with the impact of technology, for example, e-portfolios and other digital and technology-enabled tools, and evidence of an emerging body of scholarship of teaching and learning focused on interdisciplinary learning.

In Online Courts and the Future of Justice, Richard Susskind, the world’s most cited author on the future of legal services, shows how litigation will be transformed by technology and proposes a solution to the global access-to-justice problem. In most advanced legal systems, the resolution of civil disputes takes too long, costs too much, and the process is not just antiquated; it is unintelligible to ordinary mortals. The courts of some jurisdictions are labouring under staggering backlogs - 100 million cases in Brazil, 30 million in India. More people in the world now have internet access than access to justice. Drawing on almost 40 years in the fields of legal technology and jurisprudence, Susskind shows how we can use the remarkable reach of the internet (more than half of humanity is now online) to help people understand and enforce their legal rights. Online courts provide 'online judging' - the determination of cases by human judges but not in physical courtrooms. Instead, evidence and arguments are submitted through online platforms through which judges also deliver their decisions. Online courts also use technology to enable courts to deliver more than judicial decisions. These 'extended courts' provide tools to help users understand relevant law and available options, and to formulate arguments and assemble evidence. They offer non-judicial settlements such as negotiation and early neutral evaluation, not as an alternative to the public court system but as part of it. A pioneer of online courts, Susskind maintains that they will displace much conventional litigation. He rigorously assesses the benefits and drawbacks, and looks ahead, predicting how AI, machine learning, and virtual reality will likely come to dominate court service.

Online anarchy? Far from it: as this study convincingly shows, norms matter online. In a tour de force, internet law expert Matthias C. Kettemann analyses the genesis, ontology, and legitimation of rule and rules on the internet. Innovatively, the study establishes the emergence of a normative order of the internet, an order that integrates norms materially and normatively connected to the use and development of the internet at three different levels (regional, national, international), of two types (privately and publicly authored), and of different character (from ius cogens to technical standards). Centrifugal forces contribute to normative redundancies (“normative froth”), real conflicts of norms between regulatory layers and geographically bounded normative spheres (“normative friction”), substantial structural problems (“normative fractures”), and political, commercial, and technological fragmentation of the internet. But these forces of normative disorder can be countered. As the study impressively shows, a normative turn has taken place on the internet. The rules on rule-making that have developed within the normative order of the internet explain, predict, and legitimize the creation of new norms through processes of self-learning normativity. These norms are then assessed for their internal coherence, consonance with other order norms, and consistency with the order’s finality. The normative order of the internet is based on and produces a liquefied system characterized by self-learning normativity. Thus a theory of normativity (“of the law”) that goes back to Kant needs to be fundamentally rethought: with norm-based self-organization as the principle of life that enables the transcendental constitution of normativityon the internet.

Many academic libraries offer print and electronic course reserve services that encourage learning by connecting students and faculty with less expensive and supplementary educational materials. Unfortunately, there are many misconceptions regarding how U.S. copyright law affects course reserve services; as a result, many academic libraries restrict the scope of the services they provide or refrain from pursuing new options, such as media reserves, out of fear of violating the law or being sued for copyright infringement. Copyright and Course Reserves addresses this problem, providing authoritative advice for making print, electronic, and media course reserves available in compliance with U.S. copyright law. It explains options for implementing and sustaining media reserve services through which students and faculty can access online music, sound recordings, and film. Additionally, short examples from a wide range of libraries explore real-world scenarios and current issues related to course reserve services to help readers better understand and apply the information found in the book.
