The article is shortly describing the history of tithes in the Kingdom of Poland and the Polish-Lithuanian Commonwealth. During the 16–18 centuries, the nobility achieved their primary goals: 1. establishing the conversion of tithes in sheaves or grains into money, 2. determining the nobility’s courts as exclusively appropriate in cases about tithes. However, tithes in different parts of Europe were subject to, sometimes similar, changes. Consequently, the article describes the history of tithes in England, France, Germany, and other countries. Consequently, this topic is perceived as interesting for comparative studies, especially about the oneri reali.

Le politiche di sgravi fiscali e di fiscalizzazione degli oneri sociali sono designate per stimolare la crescita e l'occupazione, specialmente nel sud. Esse sono state una costante fonte di dibattito anche in sede UE. In questo lavoro si rivisita il quadro legislativo, quindi si studia l'impatto del cuneo fiscale sull'occupazione regionale per comprendere se esistono effetti differenziati a livello regionale. L'evidenza empirica mostra che il cuneo fiscale sui redditi da lavoro dipendente ha un effetto negativo soprattutto nelle regioni settentrionali, dovuto alla presenza di un sistema di contrattazione di secondo livello piů sviluppato rispetto al mezzogiorno, che induce a meccanismi di resistenza reale salariale che proteggono i redditi dei lavoratori a detrimento dell'occupazione, non soltanto nel breve periodo. Poiché un taglio nella tassazione del lavoro induce effetti occupazionali positivi anche nelle regioni meridionali, sebbene meno accentuati, essa dovrebbe essere valutata positivamente. L'evidenza empirica suggerisce la presenza di effetti differenziati non solo a livello regionale, ma anche settoriale. Questo potrebbe suggerire di focalizzare tali politiche laddove sono maggiormente efficaci, oltre che di promuovere lo sviluppo di una contrattazione di secondo livello anche nel Mezzogiorno per incrementare la sensibilitŕ dei salari lordi rispetto a cambiamenti del cuneo fiscale e della tassazione sul lavoro.

La ricerca analizza le figure degli oneri reali e delle obbligazioni propter rem ed indaga la possibilità per i privati di incidere sulla situazione giuridica complessa del diritto reale creando liberamente oneri e obbligazioni reali non tipizzati dal legislatore, ossia vincoli reali atipici.
I primi tre capitoli mirano rispettivamente ad indagare i caratteri del diritto reale, i casi tipici di o.r. e o.p.r., nonché le caratteristiche e la disciplina di queste figure di matrice dottrinale.
Il quarto capitolo, di carattere conclusivo, cerca di offrire una soluzione al problema di fondo della ricerca, ossia se ai privati sia concesso costituire liberamente oneri e obbligazioni reali al di fuori dei casi tipici previsti dalla legge. Innanzitutto viene esplicitato il significato del numerus clausus e della tipicità dei diritti reali nonché individuato il loro fondamento normativo. Al contempo, si prende atto di come a fronte delle diverse istanze sociali si sia giunti a moltiplicare i modelli di proprietà (proprietà fiduciaria, temporanea, trust, e così via) sino al punto di sgretolarne il concetto unitario fondato sullo schema risalente che vedeva la proprietà fondiaria come intangibile. Qui si inserisce la possibile soluzione offerta dalla ricerca: il progressivo moltiplicarsi delle forme di proprietà e dei diritti reali non implica la scomparsa del numero chiuso e della tipicità delle situazioni reali; inoltre, la mancanza di segnali espliciti di una riserva di legge esclusiva in materia di diritti reali e l’analisi delle norme che disciplinano i diritti reali, lasciano intendere che gli schemi legislativi dei rapporti reali non siano chiusi, ma aperti fino al punto di ammettere l’esistenza di una tipicità più o meno ristretta: una sorta di atipicità relativa che consentirebbe alle obbligazioni reali di trovare la propria fonte in un contratto purché tale possibilità sia prevista dalla legge. Il legislatore avrebbe lasciato nelle norme sui diritti reali alcuni spazi di autonomia che i privati potrebbero colmare costituendo obbligazioni reali volontarie, purché queste non contraddicano il nucleo essenziale del diritto a cui accedono.
Analogamente si inferisce con riguardo agli oneri reali. La ricerca infatti evidenzia che esiste una norma nel nostro ordinamento capace di consentire ai privati la libera costituzione di un vincolo obbligatorio munito di realità – perché opponibile ai terzi – e garantito dal privilegio speciale sul bene in caso di inadempimento, e cioè di una figura del tutto simile a quella ricostruita in dottrina per l’onere reale: l’art. 2645-ter.

La natura giuridica dell'onere reale è questione sulla quale si sono per secoli affannati studiosi di varie branche del diritto: da un estremo all'altro dell'Europa giusprivatisti, giuspubblicisti e canonisti cercavano di carpire l'intima natura di strani vincoli che, nell'ambito dei rispettivi rami del diritto, astringevano i proprietari di beni immobili (o altri titolari di situazioni soggettive giuridicamente tutelate sui beni stessi). Si trattava di imposizioni, di oneri appunto, che inerivano a un bene immobile, ma che, a differenza della somigliante figura di servitù, comportavano lo svolgimento di un'attività da parte del relativo proprietario, a favore di un determinato soggetto o del proprietario di altro fondo: a siffatta caratteristica si deve la frequente designazione delle figure in esame con la locuzione servitutes in faciendo...Non disponibile

Experiments presented in this paper were conducted with the BKH rocket combustor at the European Research and Technology Test Facility P8, located at DLR Lampoldshausen. This combustor is dedicated to study the effects of high magnitude instabilities on oxygen/hydrogen flames, created by forcing high-frequency (HF) acoustic resonance of the combustion chamber. This work addresses the need for highly temporally and spatially resolved visualization data, in operating conditions representative of real rocket engines, to better understand the flame response to high amplitude acoustic oscillations. By combining ONERA and DLR materials and techniques, the optical setup of this experiment has been improved to enhance the existing database with more highly resolved OH* imaging to allow detailed response analysis of the flame. OH* imaging is complemented with simultaneous visible imaging and compared to each other here for their ability to capture flame dynamics.

In order to respond to the demand of accurate miniature inertial navigation systems, ONERA has been working on the design of a vibrating beam accelerometer called the Vibrating Inertial Accelerometer (VIA). The accuracy of the VIA is directly related to the thermoelastic quality factor of its sensitive element, which is a beam made of quartz. In this work, thermo-piezoelectric finite element analyses of the beam are carried out in order to determine its thermoelastic quality factor. These finite element results are compared to the analytical and experimental quality factors. Due to their inherent restrictive assumptions, analytical models overestimate the quality factor while the finite element results are in good agreement with the experimental values. As the finite element model allows to take into account the real geometry of the beam and the piezoelectricity of the material, it allows to quantify more precisely the thermoelastic quality factor.

The control of subsonic high lift induced separation on airfoil may improve the flight envelope of current aircraft or even simplify the complex and heavy high-lift devices on commercial airframes. Until now, synthetic jets have proved a really interesting efficiency to delay or remove even leading-edge located separated areas on high-lift configuration but are not efficient for real scale aircrafts. In case of pressure-like separation (i.e. from trailing-edge), synthetic jets can be replaced by so the called “Vortex Generator Jets” which create strong longitudinal vortices that increase mixing in inner boundary layer and consequently the skin friction coefficient is increased to prevent separation. In this study, numerical simulations were undertaken on a generic three dimensional flat plate in order to quantify the effect of the longitudinal vortices on the natural skin friction coefficient. Both counter and co-rotative devices were tested at different exhaust velocities and distances between each others. Finally co-rotative vortex generators jets were tested on a three dimensional generic airfoil ONERA D. Results show a delay of the separation occurence but this solution does not seem to be as robust as synthetic jets. The study of jets spacing with respect to the efficiency of the devices shows a maximum for a given ratio of spacing to exhaust velocity.

The analysis of heat transfer in engine cavities or blade internal cooling systems is one of the most challenging work for aircraft engines designers for two main reasons. Firstly, the efficiency of such systems has a direct influence on both life and performance of these engines. Secondly, the available tools to predict heat transfer in both solid parts and surrounding cooling gases, i.e. Navier Stokes and conduction codes, are often used independently. An interaction model between the fluid and solid media is generally required and remains a difficult issue in engine configurations. A coupling procedure between a Navier-Stokes code and a conduction solver is therefore the only way to achieve heat transfer predictions in all flow situations. The objective of this work is to present such a procedure, which has been developed at Snecma and based on a Finite Volume Navier-Stokes code and a commercial Finite Element solver. The first application showed in the paper demontrates, with an uncoupled calculation that the Navier-Stokes code MSD, from ONERA, is able to predict heat transfer with an acceptable accuracy. The discretization used in the solid to predict heat conduction is briefly presented. Then the steady state coupling procedure is exposed and validated with an analytical solution. Finally, a conjugate heat transfer computation in a rotor/rotor cavity of a real engine, with rotating solid disks, is described in detail.

Prolactin (PRL) displays several functions in the whole body by binding its receptor (PRL-R). Two main PRL-R isoforms are reported that differ in their capacity to trigger signaling pathways, PRL-R long isoform is the activation receptor, and the short isoform is the inhibitory oner. Although many autoimmune diseases display hyperprolactinemia, the role of each PRL-R isoform expression in autoimmunity remains unknown. This work aimed to correlate PRL-R isoforms expression in human peripheral blood mononuclear cells (PBMCs) of female Systemic Lupus Erythematosus patients and healthy controls. To this end, PBMCs from lupus patients (n=9) and healthy controls (n=5) were enriched by the ficoll-hypaque method. Then, RNA extraction, cDNA synthesis, and real-time PCR were performed to determine mRNA expression. We found that PRL-R long and short isoforms expression from lupus patients display similar expression to healthy controls. However, the PRL-RL/PRL-RS ratio is higher than healthy controls (P-value two-tailed <0,05). Additionally, PRL-RL isoform expression correlates with the short isoform in lupus patients (Spearman r 0,8945; 95% confidence interval 0,6834 to 0,9676; P-value two-tailed <0,0001). However, the expression of neither long and short isoforms correlates with active disease nor disease duration. Similarly, lupus patients display similar PRL-R isoforms expression than healthy controls. Although much work must be done, our data indicate that similar mechanisms may regulate the expression of both PRL-R isoforms in immune cells, and “their expression goes hand by hand”. , ,
