Abstract:
Joel Feinberg’s Offense to Others is the most comprehensive contemporary work on the significance of offense in a liberal legal system. Feinberg argues that being offended can impair a person’s liberty, much like a nuisance, and that it is therefore legitimate in principle to regulate conduct because of its offensiveness. In this article, I discuss some overlooked considerations that give us reason to resist Feinberg’s conclusion, even while granting this premise. My key claim is that the regulation of offense can inadvertently increase the incidence of offense, by nurturing offense-taking sensibilities. In the course of defending this claim and spelling out its implications, I explain why concerns about the inadvertent nurturing of offense are now more pressing, given the identity–political character of contemporary offense-based social conflicts, and I discuss why a reluctance to legally regulate offensive conduct need not be insensitive to the identity–political issues that animate those conflicts.

Racial disparity and discrimination in drug offense sentencing continue to concern criminal justice policy makers, practitioners, and researchers. The growth of the drug offender population, coupled with the proliferation of newdrug offenses such as methamphetamine, warrants a new investigation of federal drug offenses. Despite the potential of uniformity under determinate sentencing, some groups of offenders are subject to more severe penalties than others are. This research maintains that variation in sentencing can best be understood through an examination of who is perceived as a “villain” and who is a “victim” in drug trafficking. This study (a) uses a multivariate analysis of federal drug offenses to evaluate regional sentencing differences and its impact on different racial and ethnic groups and (b) explains why Hispanics, more than any other ethnic group, receive the longest drug offense sentence.

The article is devoted to the theoretical definition of the concepts of responsibility, legal responsibility, land offense «responsibility» and «legal responsibility for land offenses». It has been established that a land offense is a socially harmful criminal act or omission that contradicts the norms of land law. Land offenses are considered as negative social phenomena, as they encroach on the land system and law and order, aimed at ensuring the rational use and protection of land and protection of persons using land. It is concluded that legal liability is applied for the commission of the relevant offense: disciplinary or administrative misconduct, criminal offense, civil violation in the field of land relations. All the above indicates that a land offense is a guilty, illegal act or omission that contradicts the legal norms of rational use of land resources, impedes the rights and legitimate interests of landowners and land users, violates the state procedure for land management as the national wealth of our country. It is stated that depending on the specific type of objects, land offenses can be divided into two groups: the actual land offenses and land offenses of environmental orientation. It also identifies a number of important functions that are implemented during prosecution for violations of land legislation. These questions will be relevant for further research. Abstract:
The article is devoted to the study of the mechanism of embezzlement of someone else's property, which is carried out using information technologies in the context of current legislation. The methodological basis was a systematic approach to the study of the mechanism of criminal offenses related to the theft of other people's property and the influence of information technologies. The main role was played by general scientific methods, historical, logical, comparative, generalization and classification, analysis and synthesis, deduction and induction. The following private research methods were used: comparative legal, formal legal, legal modeling. The object of the article is the relations arising in connection with theft in the field of information technologies as one of the most popular types of cybercrime. It is noted that criminal wrongdoing in cyberspace is a very specific category that is constantly evolving along with technological progress. Criminal offenses related to embezzlement of someone else's property using information and communication technologies - fraud, theft, embezzlement and embezzlement - were analyzed. It is noted that the mechanism of the crime as a whole system of circumstances, processes, factors that cause the emergence of carriers of information about the event of a criminal offense, its participants, provides the possibility of planning an investigation, searching for consequences, contributes to the criminal-legal qualification of the offender, acts as an object of forensic knowledge. It is emphasized that the scattering mechanism with the use of information technologies determines the appearance of traces. The mechanism of the criminal offense indicates the nature, essence and content of the functional side of the criminal activity, the regularities of the processes of interaction of the participants of the criminal event with each other and with the surrounding material environment, the regularities that cause the emergence of sources of forensically significant information about the crime and its participants. Further research should be directed to the study of the influence of certain information technologies on the theft of other people's property.

The interest in the problems of the personality of juvenile offenders is primarily explained by the number of offenses and crimes committed by minors. Although an offender’s conduct before and during the crime is the traditional focus of criminal law and sentencing rules, an examination of post-offense conduct can also be important in promoting criminal justice goals. After the crime, different offenders make different choices and have different experiences, and those differences can suggest appropriately different treatment by judges, correctional officials, probation and parole supervisors, and other decision makers in the criminal justice system. Positive post-offense conduct ought to be acknowledged and rewarded, not only to encourage it but also as a matter of fair and just treatment. This essay describes four kinds of positive post-offense conduct that merit special recognition and preferential treatment: the responsible offender, who avoids further deceit and damage to others during the process leading to conviction; the debt-paid offender, who suffers the full punishment deserved (according to true principles of justice rather than the sentence actually imposed); the reformed offender, who takes affirmative steps to leave criminality behind; and the redeemed offender, who out of genuine remorse tries to atone for the offense. The essay considers how one might operationalize a system for giving special accommodation to such offenders. Positive post-offense conduct might be rewarded, for example, through the selection and shaping of sanctioning methods, through giving preference in access to education, training, treatment, and other programs, and through elimination or restriction of collateral consequences of conviction that continue after the sentence is completed.

Joel Feinberg’s magnificent four volume work, The Moral Limits of the Criminal Law, represents a sustained and comprehensive argument regarding what conduct is appropriately regulated through criminal prohibitions and sanctions. Feinberg’s conclusions are essentially those of the Millian liberal: Conduct that causes harm or offense to others may be criminalized, but conduct that is harmful only to the actor or that is a harmless immorality may not be. Feinberg’s governing principle, however, is not Mill’s maximization of utility but is instead respect for individual autonomy. For Feinberg, respect for autonomy delimits the legitimate boundaries of concern with others’ conduct insofar as the concern is expressed through criminal prohibitions.

The scientific article examines the content and essence of the legal qualification of administrative offenses, considers their features, for which there is responsibility in the field of waste management in Ukraine. The issue of qualification, in particular of certain types of offenses, issues of qualification of misdemeanors for which liability is provided in the field of waste management in Ukraine is studied. The aim of the work was to determine the features of qualification and study the practice of registration of materials in bringing to administrative responsibility in the field of waste management in Ukraine. In order to obtain the most reliable scientific results in the writing of the work used a number of general and special legal, theoretical and empirical methods of cognition, supplemented by the principles of dialectics. The use of these methods was mostly complex. The research methodology is based on a comprehensive approach to the analysis of the qualifications of administrative offenses in the field of waste management in Ukraine, which consists in the use of general and special scientific methods due to the specifics of the scientific article. The systematic method was used in the study of conceptual and methodological problems of defining the concepts: "qualification of an administrative offense" and "administrative offense". The formal-legal method was used to clarify the content of certain legal concepts. With regard to the results of the study, the article, based on the analysis of scientific views, considers the concepts and features of the qualification of administrative offenses in the field of waste management in Ukraine. It is determined that the qualification of acts as an administrative offense in the field of waste management in Ukraine is a comprehensive analysis of the content of the General and Special Parts of the Code of Administrative Offenses or other articles of administrative tort law thus correlate general and special offenses. Also, a study of administrative and legal qualifications in the field of liability for violations of waste management rules in Ukraine was conducted. Based on the analysis of current legislation and opinions of scientists, it is concluded that the key to the correct application of administrative law in the field of waste management in Ukraine is, first, to fulfill the purpose of administrative penalties in the context of the current Code. In particular, education of a person who has committed an administrative offense in the field of waste management in Ukraine, in the spirit of compliance with the laws of Ukraine, respect for the rules of coexistence and prevention of new offenses by the offender and others. Secondly, observance by bodies (officials) of the rights of persons involved in proceedings on administrative offenses in the field of waste management in Ukraine.

Abstract At the end of the 20th century, the Soviet Union dissolved its Communist Empire and East and West Germany reunited. These dramatic events were preceded by Soviet consolidation of the world socialist and peace movements with assistance from the European Left, especially in West Germany. On the other side of the Iron Curtain, newly emerged independent peace groups, such as Charter 77, also played a significant role. In the process, West Germany realigned itself with the Soviet Union, diminishing the role of the United States and Great Britain in Europe. This shift was a direct result of the Soviet long-term peace offensive policy, which was originally devised by V. I. Lenin to defeat capitalism worldwide. The Soviet peace offensive sought the creation of a common security system, disarmament, and the withdrawal of U.S. troops and weapons from Europe. As soon as the communist facade disappeared and the image of the enemy faded, many Western policymakers and analysts stopped paying attention to the fact that Russia continued to pursue the same strategic objectives in Europe after the dissolution of the Soviet Union. Russia's long-term strategic and geopolitical interests remained the same. Could Russia, some twenty years later, be closer to fulfilling these goals?

Abstract:
The principle of the offensive in naval warfare has long been studied by scholars of military science. Studies suggest that in order for the principles of war to be practically useful for professionals, they need to be described concretely. The principle of the offensive as described in the Swedish Doctrine for Naval Tactics however, is not. This thesis aims to identify different success factors for naval offensive operations by using a qualitative analysis of Castex’s, Hughes’, and Vego’s naval theories, which when combined may form the principles for a successful offensive. A qualitative case study has been utilised, with literature from the successful Israeli naval offensive in the Yom Kippur-war, and the failed Argentinian naval offensive in the Falklands war; in order to identify which factors are practicable in a modern context. All factors, intelligence, manoeuvre, concentration of force, numerical superiority, qualitative superiority, adaptation to capabilities differences, and command and control, were identified in the Israeli offensive. In the Argentinian offensive, only the manoeuvre factor was identified, due to a lack of sufficient intelligence and command and control. The conclusions are that all factors were useful for a successive offensive action, however, more research is necessary for further generalization.

Abstract:
The purpose of the research was to assess the implementation and management of the Prolific and Priority Offender (PPO) programme, examining the barriers to and enabling factors for managing in partnership, whilst evaluating the settlement between three management models. The research provides evidence for a newer model of management, better suited to deliver on the shared outcomes government requires from its public programmes. Research has shown that although crime is multi-causal, a range of agencies separately intervene into service users’ lives. Collaborative Public Management joins up these interventions to improve crime reduction. The research was theory driven; it proposed that partnerships would require a particular model of management. The research then went looking for Collaborative Public Management (CPM) in mandated crime partnerships with the aim to ascertain the settlement with two other management models: New Public Management (NPM) and Public Administration (PA). Three cases studies have ensued, involving interviews with eighteen managers from a range of partnership agencies, observation of ten partnership management meetings and an analysis of documentary data. The search for CPM was successful, but there has not been a simple linear shift from one model to the next, features of PA and NPM remain but in weaker forms, revealing shiftingtensions, and the overlaying of management forms resulting in the old and new interacting, creating an institutional fusion. Managers were key to successful policy implementation with a focus on performance, building capacity through resource acquisition and networking and realizing structures and knowledge processes. But competent practitioners, a low crime rate, adequate resourcing and a history of partnership were other principal variables. The result is an original piece of research, where the methodology and findings add conceptually and empirically to the current body of knowledge on public policy implementation and which advances theorizing on CPM, whilst also offering an enhanced understanding to improve management practices under partnership conditions.

Ces dernières décennies, les sociétés libres et démocratiques ont été frappées par ce fléau dont l’ampleur ne cesse de croitre. Facilité par la prolifération des médias numériques, en particulier les réseaux sociaux et les plateformes de diffusion de contenus en ligne, le phénomène terroriste s’alimente d’une nouvelle façon. Nonobstant son caractère profondément performatif, capable d’agir sur le monde et d’exhorter à la perpétration d'actes de terrorisme au nom de causes politiques, religieuses ou idéologiques, la propagande demeure une activité expressive entrant naturellement dans la sphère des activités protégées par la liberté d’expression. Pour les législateurs français et canadiens, la difficulté résidera principalement dans la recherche d’un juste équilibre entre le respect de l’ordre public et la sauvegarde de la liberté d’expression, droit considéré comme l’un des plus précieux de l’Homme. What is terrorist propaganda? How can we understand it in all its forms and manifestations? Although seemingly trivial, this phenomenon is an eminently complex reality. In recent decades, free and democratic societies have been hit by this scourge, the scale of which continues to grow. Facilitated by the proliferation of digital media, in particular social networks and online content distribution platforms, the terrorist phenomenon is fueled in a new way. Notwithstanding its profoundly performative character, capable of acting on the world and urging the perpetration of acts of terrorism in the name of political, religious or ideological causes, propaganda remains an expressive activity falling within the sphere of activities protected by freedom of speech. For French and Canadian legislators, the difficulty will mainly lie in finding a fair balance between respect for public order and the protection of freedom of expression, a right considered one of the most precious of human rights. Given the emergence ofthese new legal issues, our thesis will focus on the question of knowing to what extent terrorist propaganda can be criminalized in French and Canadian criminal law, taking into account the restrictions on freedom of expression that this incrimination implies

Over the past twenty years there has been growing recognition that young people who have sexually harmed should not simply be treated as younger versions of adult sex offenders. Changes in terminology and recommended treatment reflect the fact that these young people are still developing and have a range of strengths and needs including harmful sexual behaviour. In acknowledging the harm caused by sexual abuse to victims it is also important to see that many young perpetrators have also been victims of abuse, domestic violence and sexual exploitation. Practitioners and Government reports have asserted that work with these young people should be holistic, but this word ‘holistic’ is used with a range of meanings and emphases. This study identifies broadly accepted meanings of working holistically with young people who have sexually harmed and presents associated benefits, challenges and implications for practice. The study used a mixed methods approach, utilising an initial breadth survey of practitioners across England and Wales before focusing in on a depth study based in one city Youth Offending Team. Key themes from the breadth survey were tested during the fieldwork placement with observations and interviews with professionals within the team and external therapists, social workers and residential staff. Additional interviews included contributions from volunteer panel members, young people and a parent. Grounded theory analysis led to the identification of four main themes of holistic work: seeing the whole young person; working with wider family and peers; working in a multiagency way and using a range of creative methods. Findings are discussed in relation to ‘what works’ and ‘evidence based practice’. Each of these areas contributes benefits and challenges to the work and leads to implications for practice. The study concludes with recommendations for practitioners and policy-makers to make work more holistic and effective.

Since their job is to protect the most important human goods - life and health, doctors often carry the epithet "gods in white". Because of this, it is considered that they cannot make a mistake in the performance of their activity. This understanding, of course, cannot be correct. Necessary for the process of learning and improvement, mistakes are an indispensable part of every human work, including medical work. Although they occur in the performance of every activity, certain errors are more serious than others in terms of their consequences, and society reacts especially negatively when it comes to mistakes that can endanger life and health. In this paper, the author analyses the need and justification of criminal law response to medical error. In the first part of the paper, the author defines medical error, shows its distribution and consequences, and then deals with the controversial issue of the criminal liability of doctors due to medical error. In the central part of the paper, the author deals with the criminal offense of negligent provision of medical assistance, analyzing the provisions of the Criminal Code of Serbia, while giving concluding remarks on this topic.

According to the basic law regulation on the field of economic offenses - the Law on Economic Offenses, the legal consequences of the conviction can occur under certain conditions, but only to the responsible person in the legal entity. According to the same Law, legal consequences can only be prescribed by law, and not by a lower legal act. Contrary to this Law, certain laws prescribe the legal consequences of the conviction for both the legal entity and the entrepreneur. Besides, the legal consequences of a conviction for a economic offense are also predicted by acts of lower legal force. The object of the author's attention is the legal consequences of a conviction for a commercial offense. The author points out, among other things, the contradictions of certain regulations with the current Law on Economic Offenses regarding the legal consequences of conviction. The purpose of the paper is to indicate that legal entities and entrepreneurs can not realize certain rights, and only because certain regulations foresee the legal consequences of the conviction, although they should not be prescribed. Among other things, author concludes that this way of regulating the legal consequences of conviction violates the basic principle - the principle of legal certainty.

The criminal offense of damaging a grave is classified in the domestic criminal legislation as a group of criminal offenses against public order and peace, although it is clear that, in terms of respect for the anthropologically deep-rooted respect for the dead and respect for the traditional values and religious views of citizens, this criminal offense has a lot more complex context and does not represent only an act of disrespect for public order and peace. Every violation of the grave entails a violation of religious, customary and moral norms, which is why (unlike the vast majority of other criminal acts) it also includes other very effective forms of informal behavior control. Considering the subsidiary character of criminal legal protection (ultima ratio), the question arises whether criminal-legal protection of the grave is also needed. The paper examines the justification of the criminal-legal protection of the grave and its positive-legal characteristics, analyzes the existing incrimination in terms of the de lege ferenda proposal, and in a separate part of the paper, the results of the judicial practice research regarding this criminal offense are presented, as well as a comparison with earlier research.

The competition is the key element of the free market economy because the prices cannot be determined according to the supply and demand equilibrium when there is no competition or the competition is violated by conducts against good faith. In this regard, the fraudulent acts between providers and customers and unfair commercial applications constitute tortious acts. The aim of the articles embodying unfair competition of the Turkish Commercial Code (TCC) dated 13.01.2011 and numbered 6102 is to maintain fair, untainted competition for the good of all parties (art. 54/2). The acts and commercial applications against good faith are determined in the article 55 of the TCC in order to protect the competition system. According to the article 62 of the TCC entitled “Criminal Acts”, performing one of these acts intentionally; giving wrong or deceptive information about his personal situation, goods, products, commercial activity and work intentionally in order to make his own offer preferred; deceiving employees, administrators and other assistants to obtain the production and commercial secrets of the employer or clients; not preventing the unfair competition acts of the workers, employees or administrators during their work or not correcting the declarations contrary to facts constitute the unfair competition offence. In our study, at first the notion of unfair competition, then the unfair competition offence –especially focusing on the controversial points- will be examined.

Article 105 of the Constitution guarantees the protection of human rights to property. A criminal offence may be directed at the victim’s property and therefore actions must be taken in criminal proceedings to ensure the protection of the victim’s rights. In carrying out this task, the right of the bona fide owner may be infringed. The article analyses the situation, identifies problems and offers solutions to them. The other circle of persons whose rights to property may be limited during criminal proceedings can be the affected owner of the property – the person whose property may be arrested or confiscated. The article offers a proposition aimed at more effective protection of these rights.

Brazilian Web users are among the most active in social networks and very keen on interacting with others. Offensive comments, known as hate speech, have been plaguing online media and originating a number of lawsuits against companies which publish Web content. Given the massive number of user generated text published on a daily basis, manually filtering offensive comments becomes infeasible. The identification of offensive comments can be treated as a supervised classification task. In order to obtain a model to classify comments, an annotated dataset containing positive and negative examples is necessary. The lack of such a dataset in Portuguese, limits the development of detection approaches for this language. In this paper, we describe how we created annotated datasets of offensive comments for Portuguese by collecting news comments on the Brazilian Web. In addition, we provide classification results achieved by standard classification algorithms on these datasets which can serve as baseline for future work on this topic.

The ability to control the relative optical phase of ultrashort light pulses [1] as well as their duration and time delay [2] offers new capabilities for the study and manipulation of molecular responses. We have recently reported a new experimental method for setting and maintaining the relative optical phases within a sequence of ultrashort light pulses [1]. The initial studies involved fluorescence detected interfermotry measurements on iodine vapor. These measurements were shown to be extremely sensitive to the transition energies and potential energy surface of the excited state. The experimental interferograms have been analyzed in detail and the effect of rotational motion elucidated. By extending the technique to in-quadurate phase-locked pulses a relationship between the interferograms and the linear susceptibility to be obtained directly.

Dual torch welding has great commercial significance because of the potential it offers for higher productivity and lower construction costs as reported by Hammond [1]. But dual torch welding offers an extra layer of complexity because the thermal effect of the trailing torch has significant influence on the cooling behavior of the leading torch. In addition, the cooling behavior of the bead deposited by the trailing torch is expected to be slower than beads deposited with a single torch. This is the last in the series of topical reports that detail the research leading to the development of the optimized welding solutions for X100 line pipe steel.

Future emissions regulations for the natural gas industry are imminent and will be, in some cases, very severe.� One of many possible technologies that may be applied to meet these regulations is an exhaust gas after treatment called Selective Catalytic Reduction or SCR. Application of SCR to 2 stroke cycle internal combustion engines offers a unique set of challenges unlike any other in existing SCR systems. This paper reviews these various challenges in detail, enumerates a functional specification for a �typical� compressor station, evaluates a selection of possible SCR system candidates� and offers some suggestions for a successful application.
