Full textThe analysis of investments in objets d'art and collectors items has been brought back into fashion by works such as those carried out by w. Baumol, w. Pommerehne and b. Frey or v. Ginsburgh, whereas paradoxically this form of property was often put to one side in works dealing with property management. Several reasons could be put forward to account for this phenomenon, particularly the relative secrecy with which transactions were carried out when dealing with this form of property, but this cannot entirely explain away the phenomenon. The aim of this thesis will be first of all to attempt to demonstrate that objets d'art and collectors items should be included within the framework of optimal property management. For that purpose, we will concentrate on the idea of property as well as the management techniques of that property, then we will analyse in detail the different kinds of traditional investments (shares, bonds, real estate) as well as the criteria for the classification of the latter. Finally we will try to demonstrate that objets d'art and collectors items can be valued using the same criteria as for other kinds of assets and that they stand up well to a possible comparison with this latter category. In the second part of this thesis we will illustrate this demonstration by analysing a collector's item, seldom studied from an economic point of view even though it contains extremely interesting specificities : the postage stamp. The first stage is given over to the analysis of the postage stamp's efficiency on the market ; first from the point of view of quality with a survey of its atomicity, its liquidity and its transparency ; then from a quantative point of view with a statistical efficiency test in its weak form. The second stage attempts to evaluate the performances of this asset according to two methods : the first, based on descriptive statistics enabled us to construct a yield indicator entitled tp82, the second has recourse to an explicative model and is based on hedonistic regressions

Full textThe PhD study presented here is part of a general strategy initiated by the Musée de la musique in Paris to integrate archaeometrical approaches in the efforts to historically document musical instruments, as object of use bearing the material testimony of the surrounding musical and cultural demands. Since musical instruments were produced following artisanal practices encompassing oral tradition and transmission, they are rarely associated with accurate early written sources.The aim of this research is to explore the feasibility and the limits of adapting two advanced techniques widely applied on archeomaterials, 14C geochronology and isotope geochemistry, to the issues of modern instrumentarium kept museum collections, essentially dated from the 17th to the late 18th c. Our investigations focused on 14C dating and 87/86Sr isotope ratio measurements applied on linseed oil/colophony varnishes, bearing the material traces of the history of uses. The material corpus was extended to pieces of furniture and horse-drawn carriages mainly from the early 18th c. Indeed, the original varnishes comprising linseed oil and colophony were preserved and the issues of the history of uses are also present. In addition, the corpus includes early gut strings, as a testimony of the musical use of the instrument.The partnership between the Musée de la musique in Paris and the Laboratoire des Sciences du Climat et de l'Environnement (LSCE) combines the museum independent expertise with the sharpest technologies for 14C dating (MICADAS) and Sr isotope measurements (MC-ICP-MS NEPTUNE). This PhD study is based on these two approaches, which also combine historical documentation and the wide range of analysis methods commonly available in museum institutionsThe 14C geochronology study leads to the development of sampling protocols and chemical treatments for analyzing Heritage materials according to their nature. The complex and composite chemical environment of the coatings requires methodological developments to extract the “right” carbon to be dated. The study also provided new insights to deepen the knowledge on the analyzed objects and their uses, such as the impact of some restorations, the reuse of materials or the nature of ingredients.The provenance study using Sr isotope measurements is a feasibility study applied on organic binders, especially colophony. The conservation of the 87/86Sr signature from the bedrocks to the pin resin was validated though isotope analyses applied on a corpus of pine soil/resin couples and pine soil/resin/colophony trios. Selected colophony found in the current market provide 87/86Sr ratio measurements consistent with geochemical maps.This PhD research highlights the different technology limits and the state of advancement in the methodological adaptations of 14C geochronology and isotope geochemistry applied on early oil/colophony varnishes dated from the 17th and the 18th century. It shows the possibility to overcome pitfalls such as the sample size for 14C dating (respecting the integrity of heritage objects) or the reducing of the contamination level for isotope measurements on pine resins. Three articles were published (Durier et al. 2019 Radiocarbon, Durier et al. 2021 Heritage Science, Durier et al. 2022 Techné). The research opens up new perspectives to address the issues of counterfeiting, retouching, maintenance or restoration interventions on musical instruments, and to unravel connection between early centers of production of natural resins and centers of violin making

Not possessing a conventional legal definition, collectible items meet on the one hand a list of assets coming from the tax legislation and on the other hand, the various criteria set by the tax instructions. It is clear that the asset management of collectible items is currently excluded from the patrimonial structures. However, owners of collectible items are regularly confronted with problems relating to the transfer of assets. Thus, it is appropriate to consider the various patrimonial techniques that allow one to reduce the tax burden on the transfer of collectible items

Full textThis research aimed to investigate how social memory and biographical objects are present in the formation of cultural references and identity of the person narrator. It had its justification was based on the need to intensify the reflections on the reading and rereading of biographical objects, relics of the family, and stories that bring these objects as a remembrance. Had the main field of the Elderly Living Center (JRC), in the context of the Group of spinner and weavers of Hidrolândia-GO, community representative of the cultural references of the region studied. The ethnographic field is composed of open interviews with the focus and target biographical objects and oral narratives. Use of anthropological perspective and makes use of theoretical references of the ethnographic method to understand a type of social function with the culture and identity attached to objects in the context of biographical narrated life stories. Trying to understand these stories and interpret them in the construction of cultural references and identity from theoretical benchmarks proposed for: Halbwachs (1990) in his concept of collective memory; Bosi (1994) and the social frameworks of memory of old; Bachelard ( 1988) in their space-time concept as regards the idea of duration, Geertz (1989, 1997) and interpretation in symbolic anthropology. I present four narratives of life and their biographical objects. Analyze and interpret the memories narrated around the social categories: children, family, work / knowledge and crafts; Farm / land and inheritance / honor. Explore also the presence of these objects and memories in ethnographic and literary works that promote the reading and dialogue with the "cultural references" for each person - as producer of cultural - and their connection with the collective identities. I recognize the oral narratives of life stories as intangible assets, an exchange between intersubjective - worlds.
Esta pesquisa teve por objetivo investigar como a memória social e os objetos biográficos se fazem presentes na constituição das referências culturais e identitárias do sujeito narrador. Teve sua justificativa baseada na necessidade de intensificar as reflexões sobre a leitura e releitura de objetos biográficos, relíquias de família, e as histórias que estes objetos trazem em forma de lembrança. Teve como principal campo o Centro de Convivência dos Idosos (CCI), no contexto do Grupo de Fiandeiras e Tecedeiras de Hidrolândia-GO, comunidade representativa das referências culturais da região estudada. O campo etnográfico é composto por entrevistas abertas e orientadas tendo como foco os objetos biográficos e as narrativas orais. Recorro à perspectiva Antropológica e lanço mão de referenciais teóricos do método etnográfico para compreender um tipo de função social com aspectos culturais e identitários inerentes aos objetos biográficos narrados no contexto de histórias de vida. Busco compreender essas narrativas e interpretá-las no processo de construção de referências culturais e identitárias, partindo de referenciais teóricos propostos por: Halbwachs (1990) em seu conceito de memória coletiva; Bosi (1994) e os quadros sociais da memória dos velhos; Bachelard (1988) em sua noção espaço-temporal no que se refere à ideia de duração; Geertz (1989, 1997) e a interpretação na antropologia simbólica. Apresento quatro narrativas de vida e os respectivos objetos biográficos. Analiso e interpreto as memórias narradas em torno das categorias sociais: infância; família; trabalho/ saberes e ofícios; fazenda/terra e herança. Exploro ainda a presença destes objetos e memórias em obras etnográficas e literárias que favoreçam esta releitura e o diálogo com as referências culturais de cada pessoa como produtora de bens culturais e sua conexão com as identidades coletivas. Reconheço as narrativas orais de histórias de vida como patrimônio imaterial, instrumento de intercâmbio intersubjetivo entre - mundos.

Full textThis research is concerned with the epistemological upheavals which affect literary heritage in the digital and multimedia age. The first part of this work explores the origin of the notion of literary heritage in France. It provides a synthetic review of the contexts and discourses which have underpinned this notion through time. Present and past concepts are examined in terms of continuity and discontinuity. The analysis leads to the conclusion that both emerging and traditional understandings blend together creating a dynamic, complex and dialogical trace which through its paradoxes informs the founding archetypical notions of author, literary work and ‘library’. The second part examines the contemporary reception of literary heritage for which the ‘library’ represents not only a record of past literary works but constitutes a stock for future ones given the increasing trend by which the Arts are distributed to the public using the medium of multimedia digital technology. The contemporary receiver conceives and internalizes the literary heritage library in three ways: as a public library, as an internal library, and as a virtual library where heritage corpus and discourses about corpus are regenerated. This receiver knows and uses the public library as a place which is dedicated to the conservation of the collective memory; s/he is also conscious of possessing an internal library where a double conversion takes place: s/he becomes a « reader-subject » and the heritage literature is the reader’s text. This double creative conversion takes a concrete form in the virtual multimodal library where literature can be shared and discussed. This enables the receiver to start up a conversation with other readers and be connected with other discourse communities. Within this framework, new discourses are generated concerning mainstream literary works and their offshoots. We consider then that the original literary work and its offshoots constitute a multimodal semiosphere. As the derived multimodal objects come from different communities, the notion of semiosphere re-interrogates the cultural inherited hierarchies. Nowadays, being cultured does not consist in knowing the contents of the public library but instead involves being invested in the semiosphere. The reader is encouraged to become a multi-skilled receiver navigating from one discourse community and/or community of practice to another. S/he feeds on diversity, ensures prolific communication within the semiosphere between objects and communities and, thanks to expertise in multimedia browsing skills, s/he enhances the development of the semiosphere, i.e. the shared culture

O tema central da tese é o contrato de gestação de substituição. Sua análise está delimitada aos efeitos decorrentes da consideração do seu objeto, se lícito ou ilícito, à luz das regras de direito constitucional e civil do ordenamento brasileiro. O marco teórico é delineado pelas obras de Francisco Cavalcanti Pontes de Miranda – notadamente as noções acerca dos planos do negócio jurídico – e Marcel Mauss – especificamente o Ensaio sobre a dádiva – e a escola de Direito Civil Constitucional – a partir da qual se construiu a análise das categorias que permeiam todo o estudo: dignidade da pessoa humana, autonomia privada e dicotomia entre coisa e pessoa. O objetivo geral foi investigar se o objeto do contrato de gestação de substituição suportaria o conceito de licitude à luz do sistema jurídico de regras e de princípios constitucionais. Consequentemente, três objetivos específicos foram traçados. O primeiro delimitou conceitualmente os termos objeto, licitude e ilicitude na doutrina e na jurisprudência brasileira e constatou que esses conceitos carregam um conteúdo que deve ser adequado com vistas a comportar a nova categoria de contrato – que incorpora aspectos patrimoniais e extrapatrimoniais. O segundo, ao investigar se tais contratos são levados à apreciação do Poder Judiciário, constatou ser afirmativa a indagação. Entretanto, expôs-se que a avaliação feita pelo Poder Judiciário se limita ao reconhecimento ou não da filiação. O terceiro objetivo específico identificou que o Poder Judiciário tem considerado o objeto do contrato de gestação de substituição como lícito, pois se baseia nas diretrizes estabelecidas pela Resolução n. 2.121/2015 do Conselho Federal de Medicina acerca da gestação de substituição gratuita. Diante da situação fática, constatou-se a relativização de conceitos delimitados pela regra jurídica para se alcançar esta ou aquela solução para casos delicados. Nenhuma outra consideração acerca da licitude ou ilicitude do objeto contratual pôde ser estabelecida diante dos casos analisados.
The central theme of the thesis is gestational surrogacy contract. Theanalysis is bounded to the effects arising from the consideration of its object, whether lawful or unlawful according to the rules of constitutional and civil lawof the Brazilian legal system. The theoretical framework is outlined by the works of Francisco Cavalcanti Pontes de Miranda - especially the notions about the legal business plans - and Marcel Mauss - specifically the Essay on the gift - and the school of Constitutional Civil Law - from which it has built an analysis of categories that permeate the whole study: human dignity, personal autonomy and dichotomy between thing and person. The overall objective was to investigate whether the object gestational surrogacy contract would support the concept of legality according to the legal system and constitutional principles. As a result, three specific objectives were outlined. The first conceptually delimited the terms object, legality and illegality in doctrine and Brazilian jurisprudence and found that these concepts carry content that must be appropriate in order to support this new contract category - which incorporates patrimonial and non patrimonial rights. The second, while investigating whether such agreements are taken into account by the Judiciary, it was found an affirmative answer. However, it exposed that the analysis made by the judiciary is limited to the recognition of legitimate filiation. The third specific objective identified that the judiciary has considered the object of gestational surrogacy agreement as lawful contract because it is based on guidelines established by Resolution n. 2.121/2015 of Federal Council of Medicine about the altruistic surrogacy. On the factual situation, there was noted the relativism of concepts delimited by the legal rule in order to be put into perspective of delicate cases. No further consideration about the legality of contractual object could be established before the analysed cases.

Full textThe topic of this research is the Martinican garden. The very one which is a legacy of the garden of the first inhabitants of the island : the Kalinagos. It shall be necessary to seat the garden in its historical, social, economic and ecological context to understand the place it has hold in the construction of society over time. Thus, our approach shall be both historical and anthropological. We shall try to shed light on its role, its symbolism and the customs that turn around the jaden. In our demonstration, we shall try to bring out the paramount role it played in the days of the Kalinas and during slavery; then focus on its importance for the rural societies after 1848 and finally reveal its central place this day and age. A garden which conveys societal values, a jaden of resistance that is center stage in time of crisis hence its importance today. The ecological importance of the jaden shall be enlightened, seeing as it is able to offer solutions to the agricultural issues of our modern societies. We shall prove to what extent the Martinican population has become aware of the importance of having a jaden since the crisis of 2009, which contributed to its come back. We shall also tackle the issue of knowing to what extent it has adapted to our current needs and how it has fell within modernity. Last, we shall present it as an ancient jaden that may be a model for our current society
El asunto de esta investigación es el jardín martiniqueño. El que se inscribe en la continuación del jardín de los primeros habitantes de la isla: los kalinagos. Se tratará de estudiar el jardín en su contexto histórico, económico, social, ecológico para comprender el lugar que tuvo en la construcción de las sociedades a lo largo del tiempo. Nuestro enfoque es, entonces, histórico y antropológico.Trataremos de poner de relieve su papel, sus simbólicas y los usos que giran entorno al "jaden".En nuestra demostración intentaremos poner de realce el papel de primer plano que tuvo en la época de los Kalinas y de la esclavitud, y a continuación veremos la importancia que tuvo para las sociedades campesinas que se instalaron después de 1848, antes de tener el lugar central que hoy ocupa.
