Abstract:
Bifurcation typically involves the division of arbitral proceedings into separate phases addressing jurisdiction/admissibility and the merits and, less frequently, the division of the merits phase into liability and quantum phases. However, tribunals are not restricted to bifurcating proceedings along these lines. For example, some tribunals have bifurcated proceedings in order to hear certain jurisdictional objections as preliminary issues while reserving other jurisdictional objections to be heard with parties’ arguments on the merits. Others still have ‘trifurcated’ proceedings into separate phases dealing with issues of jurisdiction, liability, and quantum. This chapter discusses factors that may provide guidance for parties in making arguments either for or against bifurcation.

This chapter analyzes rendered awards and pending Energy Charter Treaty (ECT) cases using detailed statistical data on the disputes overall (including the number of cases brought and their outcomes), the parties involved (including the types of investors making use of the ECT, and most frequent respondent states), the underlying investment (including the different energy sectors concerned), and the arbitration rules used. It also discusses a number of issues that often arise in ECT cases. First, the chapter looks at jurisdictional objections regularly raised by respondents, including the provisional application of the ECT under Article 45; the ‘denial of benefits’ clause of Article 17(1); and the definition of an ‘investment’ under Article 1(6). The chapter then analyzes selected merits issues that have been addressed in the ECT awards rendered to date. Finally, this chapter considers the future of the ECT.

Abstract:
Broad government access to personal data held by the private sector, meaning access not tied to any specific account or person, is not acceptable, and it cannot be made acceptable through oversight or governance mechanisms. In considering the merits of bulk collection programs, it helps to have an overarching framework to decompose such programs into their component parts: actors, objectives, actions, and impacts. Although law enforcement and intelligence investigations vary in their objectives and methods, and governance models need to be tailored appropriately, several important principles apply to both. First, there should be no broad or unfettered access. Second, the process for accessing data should include appropriate oversight. Third, there should be transparency. Finally, in a globally connected world, it is important to think about the international implications of surveillance programs.

David Burrell uses the image of a transformative pilgrimage to capture what is at issue when the notion of religious understanding is introduced. This chapter challenges the naturalist’s objection to the very idea of there being a journey in this sense, grants with John Cottingham that the transformation is moral and spiritual, and considers what it could mean for such understanding to be theoretical as well as practical. Further questions arise concerning the “fuel” of this transformative journey, and Levinas claims that it is motivated by desire. This chapter considers the merits of his position and concludes that it offers the shape for a model of religious understanding which can genuinely appeal to an expansive, i.e., nonscientistic, naturalist.

Abstract:
This article describes the rapid development of institutions for the study of qualitative methods in the past decade. It first begins by presenting an overview of the approach to methodology that underpins the idea of qualitative and multimethod work. It then discusses these new organizations, in particular the Organized Section on Qualitative and Multi-Method Research of the American Political Science Association, and the annual Institute for Qualitative and Multi-Method Research. It outlines the patterns of publication, and a conclusion considers briefly the merits of an integrative, versus a separate tracks, approach to coordinating alternative methodologies. The formation of the organizations linked with qualitative/multimethod work reflected the need for methodologists with convergent skills and objectives to have a meaningful forum for dialogue.

Abstract:
Varitel semantics has several resources for dealing with indeterminacy. It gives rise to more determinate contents than informational semantics or consumer-based teleosemantics. The remaining indeterminacy is a virtue: it is what we should expect in simpler systems with fewer interacting components. Some of the non-conceptual representations in our case studies exhibit some features exemplified by concepts: semantically significant constituent structure; unsaturated components; and limited, domain-specific generality. A historical component is needed to bring into view the explanandum to which representational explanation is directed, namely successful and unsuccessful behaviour. We should not expect representational explanation to get a grip, in these simple cases, without some period in which behavioural outcomes have been stabilized. Even a short period of interaction will establish some task functions and contents. Varitel semantics does not reduce misrepresentation to malfunction. Misrepresentation does not imply failure to perform a task function, nor the converse.
