IN Case C-188/95 Fantask A/S and Others v. Industriministeriet (Erhvervsministeriet) [1997] E.C.R. I-6783 the European Court of Justice provided further guidance on the interpretation of Council Directive 69/335 EEC of 17 July 1969 concerning indirect taxes on the raising of capital (O.J. English Special Edition 1969 (II), p. 412), as most recently amended by Council Directive 85/303/EEC of 10 June 1985 (O.J. 1985 L 156, p. 23), and elaborated its case law concerning Member State remedies and procedural rules. More particularly, it was held that a national rule which would have allowed Danish authorities to escape the duty to refund charges levied in breach of the Directive on the ground of “excusable error” rendered Community law impossible in practice or excessively difficult to enforce (Case 199/82 Amministrazione delle Finanze dello Stato v. San Giorgio [1983] E.C.R. 3595), while a five-year time limit for bringing proceedings under Danish law was upheld as a reasonable limitation period (cf. Case C-208/90 Emmott v. Minister for Social Welfare and the Attorney General [1991] EC.R. I-4269).

In this paper, first we study pointwise slant and pointwise pseudo-slant submanifolds of almost contact metric manifolds and then using this notion, we show that there exist a non-trivial class of warped product pointwise pseudo-slant submanifolds of Sasakian manifolds by giving some useful results, including a characterization.

<p>Language is a powerful tool for communication that many people can use for persuasion. In the courtroom, for example, lawyers use language to persuade the jury that their client is right and should win the case. Though many studies have discussed this issue, how language becomes powerful in the trial opening statement remains underresearched. For this reason, this study addresses a textual analysis on the patterns of language used by a lawyer in the opening statement. Such analysis provides a solid understanding of how language can become persuasive in the courtroom. The data source of this study were taken from the text of the Opening Statement by O.J. Simpson’s Defense Lawyer (Walraven, 1995). Although this text does not seem new regarding the publication date and some articles have discussed this, it is a seminal work, which can represent the construction of language power in the opening statment. To analyse the data collected from this text, the researcher adopted the model developed by Miles and Huberman (1994). This study firstly explores the overview of opening stetement persuasive features. In addition, it presents the finding and discussion which reveal that language power in the courtroom can be reflected in some persuasive features such as metaphor, repetition, and rhetorical question as found in the text of Opening Statements by O.J. Simpson’s Defense Lawyer.</p>

Commission (Case T-102/96, judgment of 25 March 1999, not yet reported) the Court of First Instance of the European Communities favoured a bold construction of the jurisdiction of the Commission and of the concept of joint dominance in merger cases. The judgment is also likely to have implications beyond the context of mergers for the use of Article 82 EC to control oligopolies. The case concerned the proposed merger of the platinum and rhodium operations of Gencor, a South African company, and of Lonrho, a company incorporated under English law. In particular, Gencor and Lonrho sought to acquire joint control of Implats, the South African company that brought together Gencor's activities in the platinum and rhodium sector, and through Implats, of the two South African companies that brought together Lonrho's activities in the same sector. The arrangements were notified to the South African competition authorities and to the EC Commission. The South African authorities did not oppose the merger. The Commission, however, issued a decision (Commission Decision 97/26/EC (O.J. 1997 L 11/30)) pursuant to the EC Merger Regulation (Council Regulation 4064/89 (O.J. [1989] L 395/1)) declaring that the proposed concentration was incompatible with the Common Market because it would lead to the creation of a collective dominant position between the entity arising from the concentration and Amplats, the leading world-wide supplier of platinum metal. Gencor challenged the decision of the Commission before the Court of First Instance.

This study tested the “third-person effect” during the O.J. Simpson double-murder trial. The perceptual component of the third-person effect predicts that people judge themselves to be less susceptible to media influence than other people. Findings from a nationwide telephone survey indicated that respondents' self-perceived knowledge about the legal issues involved in the Simpson trial was correlated with third-person perception of a perceived “neutral” media message. Self-perceived knowledge was not correlated with third-person perceptual bias of a perceived “biased” message. It was suggested that the biased message primed respondents' perceptions of Simpson's guilt or innocence. The relative contributions of various predictors of third-person perception were assessed using regression analysis.

The purpose of this study was to understand the symbolic messaging in hip-hop music as it relates to the lived experiences and realities of Black Americans in the United States. The study examined the song and music video titled “The Story of O.J.,” by hip-hop artist Jay-Z to gain a better understanding of how Jay-Z interpreted the impact of Black Americans’ lived experiences in the United States on their identity and ability to progress economically and socially, regardless of social standing, within subcultures such as sport. Employing a content analysis method, data were collected and analyzed using critical race theory. The results of the analysis of lyrical and video data identified three major themes: (a) battle with Blackness, (b) economic enslavement and financial freedom, and (c) systematic subjugation.

The interaction between the 2 nodular worm species in the pig, Oesophagostomum dentatum (O.d.) and Oesophagostomum quadrispinulatum (O.q.), was studied by comparing the development and distribution of the species following single or mixed infections. The faecal egg excretion levels were assessed at regular intervals from week 3 post-inoculation, and indicated a strong negative impact of the introduction of O.q. on the continued egg excretion of O.d. All pigs were killed 9 weeks after the first inoculations to determine the composition and location of the worm burdens in the large intestine. O.q. was found more anteriorly located in the intestine than O.d., thus confirming previous descriptions. When both species were present, the distribution of O.d. was moved further posteriorly and was more spread out than in single-species infections. There appeared to be no adverse effect of O.d. on the establishment and fecundity of O.q. However, the worm recoveries corroborated the egg excretion observations, namely reduced worm burdens of O.d. if O.q. was introduced, or if O.q. was already present. It is uncertain whether this effect is caused by differences in host reaction against the two species, or whether a more specific competition occurs between the two nodular worm species in pigs.
