Abstract:
In 1999, Phase II of the National Pollutant Discharge Elimination System engaged operators of small Municipal Separate Storm Sewer Systems (MS4) in the control of runoff from urban areas.  The complex task of urban runoff mitigation has been investigated for several decades, resulting in a large variety of available computing and measurement tools for urban stormwater management.  Unfortunately, these tools may not be available to the MS4 operator in a format that is both concise, and directly applicable.  To address this need, this thesis recommends stormwater model creation and refinement strategies for Phase II MS4s using GIS and Python scripting.  Further recommendations on using a popular discharge measurement technique for model calibration are provided.  This workflow is then demonstrated in a watershed in Blacksburg, Virginia, where a unique MS4 permitting partnership allowed the development of these tools.  Finally, further improvements to the workflow are suggested along with ideas for additional research for stormwater management in Phase II MS4s.

Abstract:
Industrial toxicity has become a major environmental subject over the past decade. Although much research and data have been collected and published for the manufacturing type industries, minimal data is currently available concerning the possible toxics that may be associated with coal mining industry NPDES discharges. Thus, in this report, an environmental toxicity assessment with respective data shall be presented on the three major constituent sectors of the coal mining industry in Southwest Virginia of which includes mines, preparation plants and refuse facilities. The mines category shall include both surface and underground facilities. The preparation plants sector will cover the traditional railroad siding loadout type facilities, along with the modern clean coal processing preparation plants. Valley and side fill configuration, coarse and combined refuse fills and coal refuse impoundments shall be presented in the refuse facility categorization. Reference source data and specific information from a Virginia Coal Association Taxies Monitoring Program study are presented to show that the effects of toxicity in the coal mining associated NPDES effluents are minimal and not a serious problem. The conclusions of this report shall show that through enforcement of better management practices within the coal industry in Southwest Virginia that toxicity can be virtually eliminated in NPDES outfalls.

Abstract:
This research establishes a new patent remedy (injunction) system against future infringements in such a way as to discourage trolling behaviours of non-practising entities (NPEs) without chilling inventors’ incentives to innovate. For this research target, this thesis reviewed the general characteristics of NPEs in the current and past patent system, the current patent remedy laws in different countries (the US, UK and Germany), the patent holdups caused by NPEs’ patent enforcement against manufacturers, and various solutions which have been proposed so far. In doing so, it addresses important findings that the major cause of NPE problems stems from the inherent uncertainty nature of patent, that the courts’ discretion of whether to grant or deny an injunction needs to be clearly defined, and that the new injunction system should skilfully balance the short-term as well as the long-term transaction costs which are caused by NPEs’ patent enforcements. Considering these findings, this thesis proposes a new injunction model, alias a ‘three-tiered remedy system.’ Unlike the present two-tiered system, it divides the remedies into three different types: (1) granting an unqualified injunction against wilful infringers; (2) granting a suspended injunction against innocent infringers; and (3) denying injunctions in exceptional circumstances. The most differentiated feature of this model is to award a suspended injunction as a default remedy in order to mitigate the patent holdup arising from the uncertainty problem of patent. Since the suspension period is determined in proportion to the required time for designing around the infringed patent, this new model can provide a very useful solution to mitigate the harmful effect of NPEs’ patent enforcement without jeopardizing the integrity of exclusive right of patent at the same time.

Abstract:
The purpose of this study was to determine the differences between industrial and municipal executives' practices and perceptions toward the administrative requirements of a water pollution control system as set forth in a National Pollutant Discharge Elimination System permit. This was a descriptive study that utilized a two-part attitudinal survey designed to obtain the perceptions of the executives (N = 171) of all major industries and all major municipalities in the State of Tennessee who had direct responsibility for the administrative requirements of an NPDES permitted water pollution control system. Descriptive statistics were used for the analysis of data with the chi-square formula used for the analysis of the study's three hypotheses. The descriptive analysis of the three hypotheses resulted in the following findings and conclusions: (1) There was no significant difference in what principal executives perceived was the most important administrative requirement of the NPDES permitted water pollution control system ($\chi\sp2$ = 1.44, df = 2). Both categories defined operational problems as the most important administrative requirement. (2) There was a significant difference in what principal executives perceived were the important water quality designated uses achieved by the facility water pollution control system ($\chi\sp2$ = 12.80, df = 6). Industrial respondents perceived "protection of fish and aquatic life" as most important, while municipal executives perceived "domestic and industrial water supply" as most important. (3) There was no significant difference in what principal executives perceived was the direct motivation for the water pollution control system installation, operation, and maintenance ($\chi\sp2$ = 1.65, df = 2). Both categories perceived environmental motivation as the most important reason for the NPDES permit administrative requirements. These findings supported the Clean Water Act regulatory program national objective to "restore and maintain the chemical, physical, and biological integrity of the nation's waters" (Arbuckle, Frick, Hall, Miller, Sullivan, & Vanderver, 1983, p. 83). The major municipal and industrial facility executives in Tennessee were in agreement that their systems were effective in achieving compliance with the administrative requirements of the permit. The researcher recommended future research to identify specific problems resulting from the administrative requirements of the NPDES permit and replications of the study nationally.

Abstract:
Development and population are rapidly increasing in urbanizing areas of North Texas and so is the need to understand changes in storm water runoff flow and its contamination by nutrients, sediment, pesticides and other toxicants. This study contributes to this understanding and has two primary components: first, development of a graphical user interface for a geographic information system and storm water management database, and second, performing a two-scale hydrological modeling approach (the US Corp of Engineers HEC-HMS model and the US Environmental Protection Agency SWMM model). Both primary components are used together as a toolkit to support the storm water management program of the City of Carrollton, located in North Texas. By focusing limited city resources, the toolkit helps storm water managers in the process of compliance with federal regulations, especially the National Pollution Discharge Elimination System permit, and provides guidance for reporting, planning and investigation. A planning example was conducted by modeling potential changes in storm water quality due to projections of land use based on the City of Carrollton's Comprehensive Plan. An additional component of this study is the evaluation of future changes in surface water quantity and quality in the North Central Texas area, specifically in a rural but rapidly urbanizing subbasin area of the greater Lake Lewisville watershed. This was accomplished using the US Corp of Engineers HEC-HMS hydrological model. Precipitation scenarios were derived from years of historically high, medium, and low annual precipitation. Development scenarios were derived from current land use in the Lake Lewisville sub basin, current land use in the city of Carrollton, and from Markov projections based on recent land use change calculated from satellite images of 1988 and 1999. This information is useful for future land use planning and management of water resources in North Texas.

Abstract:
Acid/base and metal ion adsorption properties have been investigated for a range of chemically modified bleached Kraft fibre materials (pulps). The studies were performed via potentiometric titrations, Flame Atomic Absorbtion (and Emission) Spectroscopy, Inductively Coupled Plasma Optical Emission Spectroscopy and Extended X-ray Absorbtion Fine Structure measurements. As a result of a chemical modification procedure, the total concentration of acidic carboxylate groups in the fibre materials ranged between 43 and 590 μmol/g. The preferable surface potential model for modelling the ionic strength dependent acid/base properties of fibre materials with low charge densities, i.e. unmodified fully bleached Kraft fibre materials, was found to be the Basic Stern Model. For fibre materials with high total charge, ≳100 μmol/g, this model resulted in poor fits to data, and for such materials a number of Constant Capacitance Models, one at each ionic strength, must be recommended. With respect to metal ion adsorption, the results have indicated that the unspecific Donnan theory could correctly model the simultaneous adsorption of several metal ions, i.e. K+, Na+, Mg2+, Ca2+ and Cu2+, provided that the salt concentration in the fibre suspension is low. In suspensions of high salt concentration it was, however, found that this very same model strongly underestimated the adsorption of Ca2+ and Cu2+. Here, the Donnan model had to be complemented by specific ion exchange equilibria. These results were corroborated by spectroscopic evidence of specific interactions between Cu2+-ions and fibres. The spectroscopic indication of a complex formed between two fibre surface carboxylate groups and one Cu2+-ion, agree with the specific ion exchange model. It was therefore concluded that specific metal ionfibre interactions cannot be neglected, especially at high salt concentrations. The interactions occurring between the polycation GaO4Al12(OH)24(H2O)127+ and fibre materials were studied by both adsorption and spectroscopic measurements. These indicate that GaO4Al12(OH)24(H2O)127+ is surprisingly stable in fibre suspensions and that intact GaO4Al12(OH)24(H2O)127+- ions are strongly adsorbed onto the fibres. Also for this ion, specific interactions has to be considered, since the strong adsorption registered was too strong to be explained by Donnan equilibria. In the thesis, the stochiometric composition and an equilibrium constant characterising these interactions is presented.

Abstract:
This study sought to observe the trends in physical therapy faculty members over time and to understand how those trends correlated with changes in program outcomes. Accreditation data from 231 programs between 2008 and 2017 was used in a panel analysis using fixed effects and random effects models to estimate the effects that faculty characteristics, program characteristics, and program budgets have on graduation rates, first-time licensure examination pass rates, and the percentage of graduates of color that a program produced. Results show that for a 1% increase in faculty time devoted to scholarship, a program could expect graduation rates to rise by 0.17%. For a one percentage point increase in grant-funded faculty, a program could expect a 1.7% increase in graduation rates. Results also indicated a negative linear relationship between the number of publications and graduation rates. First-time licensure exam pass rates had an association with different variables. For a 1% increase in part-time faculty, a program could expect a 6.4% decline in first-time licensure examination pass rates. Similarly, a 1% increase in tenured faculty was associated with a 1.2% decline in first-time licensure examination pass rates. A 1% increase in faculty of color was associated with an increase in graduates of color by 33%. This research study provides data to better inform interested parties on how changes in faculty makeup and program budgets can impact PT graduation rates, licensure pass rates, and the percentage of graduates of color that a program can realistically expect to produce.

La premiere partie de cette these est consacree a l'etude des structures magnetiques des monopnictures et des monochalcogenures de neptunium. Dans la seconde partie, nous avons etudie les excitations magnetiques des solutions solides de u(ru#1#-#xrh#x)#2si#2. Par la determination des structures magnetiques de npp et de npbi, nous avons termine la serie des monopnictures de neptunium. Tous ces composes ont une structure magnetique avec un vecteur de propagation et des composantes de fourier selon les axes quatre. En utilisant cette propriete, nous avons etabli un modele de type annni qui nous a permis de suivre l'evolution des integrales d'echange avec le pnictogene. Les monochalcogenures de neptunium ont tous une structure antiferromagnetique de type ii. Cependant, nps presente une transition du premier ordre, tandis que la transition magnetique de npse et npte est du second ordre. En utilisant des proprietes de symetrie du cristal, les resultats de spectroscopie mossbauer ainsi que les resultats de diffraction neutronique, nous avons determine des solutions possibles pour les structures magnetiques de nps et npse. Ces solutions sont multi-k et assez compliquees. Pour npte, l'etude du facteur de forme et l'evolution thermique du moment magnetique ont montre que ce compose avait un comportement magnetique tres particulier. Nous avons utilise trois methodes pour etudier les solutions solides de u(ru#1#-#x-rh#x)#2si#2s: chaleur specifique, diffraction elastique et inelastique de neutrons. Par un modele simple, nous avons pu relier la dependance en temperature du gap des excitations antiferromagnetiques a l'anomalie de la chaleur specifique a t#n. Les excitations magnetiques ont ete decrites comme etant dues a un champ cristallin a deux niveaux couples par une interaction anisotrope de type rkky. Nous avons vu aussi que l'evolution du moment magnetique avec la concentration de rhodium est tres particuliere: la temperature de transition decroit, alors que la valeur du moment a basse temperature augmente

We have constructed a family of map. The map is shown to be positive when imposing certain condition on the parameters. Then we show that the constructed map can never be completely positive. After tuning the parameters, we found that the map still remain positive but it is not completely positive. We then use the positive but not completely positive map in the detection of entanglement of a composite bipartite quantum system such as Bound Entangled States (BES) and Negative Partial Transpose Entangled States (NPTES)

In recent years, the business model of Non-practicing entities has become more diversified. In addition to using patent litigation to sue practicing entities to obtain high compensation. Also began strategic cooperation with practicing enti-ties. Initiating a patent infringement lawsuit against competitors of practicing en-tities. The practice entities in cooperation with Non-practicing entities usually in-vested a considerable amount of research and development in the industry tech-nology in which they were employed. The company held a large number of basic patents and standard necessary patents. This type of company had learned the ne-gotiation experience of Non-practicing entities in the process of cooperation. The company's business model had also begun to be transformed into Non-practicing entities. Based on the patent litigation events of Nokia and Apple, this paper con-ducted research on litigation patents and litigation cases in an empirical analysis, trying to put together the trajectory of litigation strategies, Finally, Nokia, Acacia and Apple’s , litigation strategies were compared to analyze the differences in their respective NPE business models. This research found that the litigation patents were mainly laid out in the field of mobile communication, including basic electronic circuits and wireless communication networks, and have high originality and high generality. The av-erage number of claims also showed high value. In terms of litigation strategy, Nokia cooperated with Acacia to design standard patents into a variety of litigation patent portfolios, and handled as many as 24 litigations against 16 competitors. Apple accused the behavior was the vio-lation of anti-monopoly law. Finally, Nokia established a subsidiary and directly filed a lawsuit against Apple. The litigation incident was observed that while the outside world was still slashing the patent business, but Nokia chose to cooperate with it and learned to use essential patents effectively. On the Apple side, it was a countermeasure against the essential patent litigation. The PE of the NPE business was worthy of learning and reflection from domestic enterprises.

Non-practicing entities (NPEs) are often regarded as notorious characters in the intellectual property. They assert patent infringement, bringing massive cost of lawsuits for defendant firms, but end up seeking the nuisance value settlement. Previous studies found that the settlement rate of NPEs wasn’t significantly higher than PEs; however, they haven’t had constructed a comprehensive empirical model to consider in the effects of NPEs types, nor the quality of asserted patents on the settlement rates. In this article, we collected 2,456 patent infringement suits, asserted by either PEs or NPEs, during 2010 and used Firth Logistic Regression model to examine the impact of NPEs types and patent quality, such like MLPs (Most-litigated Patents) rate and number of claims, on the settlement rate, while controlling the fixed effect of judge, plaintiff’s attorney and other conditions. Our result indicates that: (1) Only among the infringement suits asserted by University and Failed Operating Company (both are R&D oriented NPEs), the patent quality is positively correlated with settlement rate. (2) To most of PEs and NPEs, the higher proportion of MLPs within all the asserted patents in one case, the lower settlement rate it may be. However, among the suits by Individual Inventor and Patent Holding Company, the proportion of MLPs ratio within asserted patents is negatively correlated with the settlement rate. It shows that the type of NPEs and the quality of asserted patents do affect the settlement rate of patent infringement lawsuits in different ways.

Taiwanese manufacturers can’t stay away from the wars caused by global NPEs (Non-practicing entities) anymore. For the majority of domestic enterprises focusing on branding, they monitor and apply data mining of patent maps only at the competitors who are producing real products (herein called the term “practicing entities (PEs)” as opposed to “NPEs”). Since lacking experiences dealing with NPEs’ lawsuit attack, export-oriented domestic manufactures usually lose in lawsuit and their brand image being hurt. The damages are difficult to estimate. In view of this, the aim of this thesis provides an empirical study trying to compare with two kinds of plaintiff launched proceedings initiatively between PE competitors and NPEs being proficient in patent litigations but not familiar to Taiwanese brand enterprises. The study concludes that as a PE in launching litigation, the risk is lower if it transfer its patent to NPE or other PE that is not in the same industry and have them initiate the lawsuit. From the perspective of competitive dynamics, domestic enterprises must be more aware of monitoring NPEs’ activity while patent transaction from PEs to NPEs has been found because NPEs’ motivation to launch proceedings will significant increase.
