Abstract:
There is perhaps no better setting that exhibits the perennial tension between the Free Exercise Clause and the Establishment Clause than American public schools. The Free Exercise Clause of the First Amendment to the US Constitution ensures that students may retain their religious beliefs, practices, identities, and rights when they enter public schools. The free exercise principle also protects government employees; however, the Establishment Clause of the First Amendment prevents teachers and administrators, as agents of the state, from entangling the public school in religious activities or engaging in school speech that advances or endorses religion. This chapter illustrates how these two principles––free exercise of religion and non-establishment of religion––form the concept known as religious freedom. Attempting to strike this balance are public schools, which are required to serve the entire public, whether religious or not. Those within the school—both teachers and students—may be religious and wish to express their religion or to express their critique of or nonaffiliation with religion. This chapter explores different forms of religious expression for both students and teachers and details the unconstitutional nature of laws that seek to target religion for regulation or fail to accommodate religion in public schools.

Abstract:
The case study developed as part of IIEP‐UNESCO Research Project ‘Open Government: Learning From Experience’ analyses how an open government approach is being applied in Ukraine to resolve the critical issue of non‐transparent school financing through parents’ donations that undermines trust among key educational stakeholders. Developed in 2016, the Open School Platform (OS) is an online tool that allows parents to visualise the school’s budget, needs and expenditures in an easy‐ to‐read format. The study shows that OS has contributed to: improved trust among key stakeholders, improved communication and collaboration between school personnel and local public authorities, and more effective planning. But it also confirms that the use of ICT can lead to inequalities in poor rural communities having low levels of Internet access or computer literacy. It concludes on the importance of open government for shifting to a new paradigm of cooperation and partnership. And it recommends providing access to information in line with the Open Data Charter; ensuring a legal framework for citizen participation; using handy and accessible technological solutions; and following a ‘learning‐by‐doing’ approach to build up social capital for constructive interaction with authorities.

Abstract:
This chapter describes the personality and politics of Murli Manohar Joshi who was the Minister of Human Resource Development (MHRD) during the NDA Government (1998–2004), first truly non-Congress Party Government at the Centre with an idea of India which was starkly at variance with that of Nehru. It also describes the achievements of Joshi such as enacting the Constitutional Amendment to make Right to Elementary Education as Fundamental Right, and launch of Sarva Shiksha Abhiyan (SSA) as well as the controversies which enveloped the NCERT School History textbooks, the National Curricular Framework (NCF), 2000. It briefly outlines the competing schools of pedagogy, critiques NCF, 2000, and its proposal to incorporate education about religions in school curriculum. It also describes the growth of private universities as a result of the liberalization of regulations for deemed universities as well as permissive State Laws, the issue of UGC regulations on private university, and the landmark Supreme Court judgment in Yash Pal case which spawned a powerful New UGC that was a species different from that created by the UGC Act, 1956.
