Weimer, Maria. Risk Regulation in the Internal Market. Oxford University Press, 2019. http://dx.doi.org/10.1093/oso/9780198732792.001.0001.

Abstract:
This book offers a topical inquiry into the legal and political limits of European Union regulation in the field of risk and new technologies surrounded by techno-scientific complexity, uncertainty, and societal contestation. It uses agricultural biotechnology as a paradigmatic example to illustrate the complex intersection between environmental, public health, economic, and social concerns in risk regulation. The text analyses the drawbacks of the European Union approach to agricultural biotechnology showing that its reductionism, that is, the narrow understanding of the risks associated with genetically modified organisms (GMOs) as well as the exclusion of broader societal concerns related to environmental and social sustainability, has undermined both the legitimacy and effectiveness of EU regulation in this area. Resistance to this approach, however, has also triggered legal innovations prompting us to rethink EU internal market law, including the way in which it manages the tensions between unity and diversity, and between social and economic concerns. This book examines how far the EU can go in harmonizing regulatory approaches to risk. At the same time, it proposes new ways of rethinking EU risk regulation to make it more responsive to different perspectives on risk and technology.

Ambrus, Mónika. The European Court of Human Rights as Governor of Risk. Oxford University Press, 2017. http://dx.doi.org/10.1093/acprof:oso/9780198795896.003.0006.

Abstract:
This chapter analyses the ‘risk dispositief’ of the European Court of Human Rights and explores the ways in which the Court governs risk. It begins with an exploration of the specific features of governing uncertain future events that are adopted by the Court, including the identification of the forms of risk that the Court incorporates in its mode of governance and the manner in which it allocates responsibility for these risks. It then examines the manner in which the Court’s risk dispositief creates new subjectivities and redefine relationships. The Foucauldian concept of governmentality provides the theoretical framework for exploring the Court’s risk dispositief, and provides a tool for analyzing the Court’s techniques of risk governmentality. The ultimate purpose of this enquiry is to ascertain how the Court addresses risk-related complaints and how it conceptualises risk in different contexts.

Abstract:
Findings from five decades of research on risk and resilience in children and youth are highlighted in this chapter, with a focus on positive adaptation in the context of conditions that could pose a significant threat to function or development. The origins of developmental research on risk and resilience are briefly reviewed, followed by definitions of core concepts, and an overview with illustrations of central models that have guided this body of work. Findings on promotive and protective factors for resilience across diverse studies of children and youth show striking consistency, suggesting that fundamental adaptive systems support and protect human adaptation and development in the context of adversity. Exciting new technologies and scientific advances in molecular genetics, neuroscience, and the methods for studying dynamic, interdependent systems have opened new horizons for research on risk and resilience. The rising wave of future resilience science is focused on multiple levels of analysis and their integration, ranging from neurobiological processes of resilience to preparations for surviving large-scale disasters.

Falk, Oren. Violence and Risk in Medieval Iceland. Oxford University Press, 2021. http://dx.doi.org/10.1093/oso/9780198866046.001.0001.

Full text
Abstract:
This interdisciplinary study of violence in medieval Iceland pursues three intertwined goals. First, it proposes a new cultural history model for understanding violence. The model has three axes: power, signification, and risk. Analysis in instrumental terms, as an attempt to coerce others, focuses on power. Analysis in symbolic terms, as an attempt to manipulate meanings, focuses on signification. Analysis in cognitive terms, as an attempt to exercise agency over imperfectly controlled circumstances, focuses on risk. The axis of risk is the model’s major innovation and is laid out in detail, using insights from prospect theory, edgework, and the calculus of jeopardy. It is shown that violence, which itself generates risks, at the same time also serves to control uncertainties. Second, the book tests this model on a series of case studies from the history of medieval Iceland. It examines how violence shapes present circumstances, future status, and past memories, and how it transforms uncertain reality into socially useful narrative, showing how Icelanders’ feud paradigm blocked the prospects of warfare and state formation, while their idiom of human violence domesticated the natural environment. Third, the book develops the concept of uchronia, the hegemonic ideology of the past, to explain how texts modulate history. Uchronia is a motivated cultural memory which vouches for historical authenticity (regardless of factual reliability), maintains textual autonomy from authorial intent, and secures a fit between present society and its own past. In medieval Iceland, as often elsewhere, violence played a key role in the making of uchronia
