Abstract:
Figures of mobility appear prominently in US-foundational narratives of ‘discovery,’ the ‘Puritan errand,’ and westward expansion; the protagonists of these hegemonic tales of settlement and nation-building are (mostly) European travellers, pioneers, and colonists. By contrast, figures such as pirates, drifters, and fugitives are for the most part absent from canonical narratives of new world beginnings and may be considered as expressing/representing alternative mobilities. Their stories and their representations raise questions of legitimacy and legality – often from a transnational perspective – and imply a critique of the American empire and its concomitant domestic discourses of marginalization. Yet, pirates, drifters, and fugitives also appear as ambiguous figures with regard to US-exceptionalist rhetoric: they may tap their subversive potential, while they are also bound to and complicit with the ideologies they seek to expose. In the context of the so-called New American Studies and the emergent field of Mobility Studies, this volume investigates these figures in a variety of cultural productions (pamphlets, song lyrics, autobiographies, novels, memorials, legal texts, video, television, and film) from the 17th century to the present.

Abstract:
The monograph is devoted to the consideration of one of the urgent problems of political theory and practice — the revolution of freedom and dignity in Tunisia, which opened the way for deep democratic transformations in the Islamic country. This revolution has become a convincing example of new, one might say unprecedented before, opportunities for revolutionary renewal of the world within the framework of the current law and without violence, based on revolutionary legality. For the first time in the Islamic world, the possibility of a certain and sufficiently broad cooperation between revolutionary forces and representatives of the former dictatorial power in the country was shown in practice. The main force in the Tunisian Revolution was the masses of the people, who acted independently in the absence of any universally recognized leaders, political parties and movements. Finally, perhaps the highest achievement of the revolution was the adoption of a new constitution that defined the conditions for the subsequent political development of Tunisia. It is addressed to everyone who is interested in the political development of the modern world. It will be useful for postgraduates and undergraduates studying in the fields of "Political Science" and "Sociology", as well as for university and college teachers.

In the 21st century, governments around the globe are faced with the question on how to tackle new migratory mobilities. Governments increasingly become aware of irregular immigration and are forced to re-negotiate the dilemma of open but secure borders. Rethinking Authority in China’s Border Regime: Regulating the Irregular investigates the Chinese government’s response to this phenomenon. Hence, this book presents a comprehensive analysis of the Chinese border regime. It explores the regulatory framework of border mobility in China by analysing laws, institutions, and discourses as part of an ethnographic border regime analysis. It argues that the Chinese state deliberately creates ‘zones of exception’ along its border. In these zones, local governments function as ‘scalar managers’ that establish cross-border relations to facilitate cross-border mobility and create local migration systems that build on their own notion of legality by issuing locally valid border documents. The book presents an empirically rich story of how border politics are implemented and theoretically contributes to debates on territoriality and sovereignty as well as to the question of how authority is exerted through border management. Empirically, the analysis builds on two case studies at the Sino-Myanmar and Sino-North Korean borders to illustrate how local practices are embedded in multiscalar mobility regulation including regional organizations such as the Greater Mekong Subregion and the Greater Tumen Initiative.

Abstract We live in a pluralist world of transnational law and governance. More than ever before, multiple legal systems and governing authorities at different levels—state, supranational, international—are recognized as applying to, and claiming authority over, the affairs of the same sets of individuals and institutions. Yet our constitutional theories in terms of our conceptual toolkit of law and legitimate authority fail to adequately capture this pluralist state of affairs. This book examines some of the key conceptual and theoretical puzzles which the contemporary state of transnational pluralism poses for our constitutional theories. It offers fresh perspectives on these questions by addressing the plurality of norms and authorities from the viewpoint of legality and legitimacy respectively, proposing novel solutions to how constitutional theory can be pluralized in the light of these perspectives. Our turbulent times are on a steady trajectory of ever-more pluralism of transnational law and governance to tackle the defining social and political problems of our age involving populism, pandemic, and climate change, and this book provides an essential intervention in debates on how to pluralize constitutional theory to understand and, perhaps more importantly, legitimize the tools to address these shared global problems.

Transnational private regulation has brought reforms to forests and factories but rarely of an empowering or transformative kind. This chapter draws out normative implications of the research in this book and highlights paths toward improvement. While not dispensing with supply-chain scrutiny altogether, the chapter calls for revising the rating of corporate responsibility, re-centering the state, and shifting toward “place-conscious” transnational governance. Some elements of this approach can already be seen in a new transnational timber legality regime, which has the potential to overcome the limits of private sustainability standards. The chapter explains the rise of this regime and considers the possibilities for extending the legality framework to labor.

Abstract:
This book examines the place of the concept of constituent power in constitutional history, focusing on the legal and institutional implications that theorists, politicians, and judges have derived from it. It shows that constituent power, even though having historically been associated with extra-legality and violations of the constitutional order, has played important functions in the making of determinations of legal validity. Constitutional courts have employed it to justify their jurisdiction to invalidate constitutional amendments that alter the fundamental structure of the constitution and thus amount to a constitution-making exercise. Some governments have recurred to it to defend the legality of the transformation of the constitutional order through procedures not contemplated in the constitution’s amendment rule but considered participatory enough to be seen as equivalent to ‘the people in action’, and these attempts have sometimes been sanctioned by courts. Commentators and citizens have relied on the theory of constituent power to defend the idea that electors have the right to instruct representatives, and that the creation of new constitutions must take place through extra-legislative entities, such as primary assemblies open to all citizens. Several Latin American constitutions explicitly incorporate the theory of constituent power and allow citizens, acting through popular initiative, to trigger constitution-making episodes that may result in the replacement of the entire constitutional order. Building on these findings, the book ultimately develops a distinction between sovereignty and constituent power and argues that even a constitution-making body can be made legally subject to the conditions arising from a constituent referendum.

This chapter begins by outlining an alternate, ‘interactional’, understanding of the concept of ‘sources of law’, which it takes to refer to processes that are shaped by requirements of legality and through which legal norms are made and remade. This approach does not entail that the law-making methods listed in Article 38 of the International Court of Justice (ICJ) Statute have ceased to matter in international environmental law (IEL)—far from it. The interactional law framework takes seriously what international actors do. The chapter, therefore, explores the law-making processes listed in Article 38 in turn, and then moves on to consider newer processes. The interactional framework and its practice-based understanding of legality illuminate the existence of resilient and relatively stable law-making processes as well as the emergence of new law-making processes.
