Article 24 C of Third Amendment of Constitution Law 1945 is the basis of the Constitutional Court to give the final and binding decision in terms of law examination against Constitution Law 1945. Constitutional Court has a restriction to not examine the nebis in idem case unless there is a different substance of Constitutional Law 1945 which is used as the based of examination. In this paper, there are 12 (twelve) Constitutional Court’s decisions on law re-examination against the Constitutional Law 1945 because using different substance of Constitutional Law 1945 as the based of examination. Based on the research, which has been conducted, there are legal reasoning differences in accepting and deciding the cases which have been decided previously which the Court uses different legal interpretation and construction in deciding the case. Thus, this paper will examine and compare legal reasoning methods which are used in deciding the case.

Pertama, terkait dengan titik singgung kewenangan mengadili sengketa hibah/waris pada dua lembaga peradilan dengan adanya Putusan Nomor 163/PDT.G/2008/PT.SBY, dan kedua, tidak ada amar bersifat condemnatoir pada putusan tersebut. Adanya dua putusan pada dua lembaga peradilan yang saling berlawanan terhadap objek dan subjek yang sama menyebabkan penyelesaian perkara ini belum berakhir hingga kini dan tidak adanya kepastian hukum bagi masyarakat pancari keadilan walaupun perkara ini telah melalui proses panjang (sejak tahun 2005 sampai saat ini di tahun 2017). Untuk menganalisis masalah tersebut, ada dua masalah pokok yang diangkat dalam penelitian ini. Apakah pertimbangan hukum pengadilan negeri dalam menerima dan mengadili perkara ini dapat dibenarkan menurut kompetensi absolut yang dimilikinya? Apakah asas ne bis in idem dapat diterapkan dalam hal pengadilan negeri mengadili perkara yang sudah diputus oleh pengadilan agama? Adapun metode yang digunakan dalam penelitian ini adalah metode penelitian hukum normatif. Hasil penelitian menunjukkan bahwa pokok sengketa yang harus diangkat oleh pengadilan negeri maupun pengadilan agama adalah keabsahan hibah dengan jalan pewarisan. Asas ne bis in idem tidak dapat diterapkan oleh pengadilan negeri dalam mengadili perkara tersebut karena putusan pengadilan agama belum berkekuatan hukum tetap.Kata kunci: hibah, waris, kewenangan, peradilan, pokok sengketa. ABSTRACT Court Decision Number 454/PDT.G/2005/PA.LMG is thought-provoking to examine for two things. Firstly, it is related to the authority tangency point in adjudicating grant/heir disputes at two judicial institutions with the Court Decision Number 163/PDT.G/2008/PT.SBY, and secondly, the ruling of the decision is not condemnatory. Two decisions on two opposing jurisdictions against the same object and subject cause the case to remain unresolved until now. There is no legal certainty for the justice seekers, although the case has gone through a long process (since 2005 until now in 2017). To analyze the problem, there are two main issues elaborated in this study. Could the legal considerations of a district court in accepting and adjudicating cases be justified according to their absolute competence? Could the principle of nebis in idem be applied in the case of a district court adjudicating a case which has been decided by a religious court? This research uses normative legal research methods. The results of the study indicate that the subject of the dispute that should be examined by the district court as well as the religious court is the validity of the grant through inheritance. The district court cannot apply the nebis in idem principle in the proceedings as the decision of the religious court has not been permanently enforced.Keywords: grant, inheritance, authority, judiciary, subject matter dispute.

Putusan MK Nomor 25/PUU-XIV/2016 mencabut frasa "dapat" dalam Pasal 2 ayat (1) dan Pasal 3 Undang-Undang Nomor 31 Tahun 1999 juncto Undang-Undang Nomor 20 Tahun 2001 tentang Perubahan Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi (UU Tipikor). Putusan MK ini menafsirkan bahwa frasa "dapat merugikan keuangan negara atau perekonomian negara" dalam Pasal 2 ayat (1) dan Pasal 3 UU Tipikor harus dibuktikan dengan kerugian keuangan negara yang nyata (actual loss) bukan potensi atau perkiraan kerugian keuangan negara (potential loss). Dalam pertimbangannya, setidaknya terdapat empat tolok ukur yang menjadi ratio legis MK menggeser makna subtansi terhadap delik korupsi. Keempat tolok ukur tersebut adalah (1) nebis in idem dengan Putusan MK yang terdahulu yakni Putusan MK Nomor 003/PUU-IV/2006; (2) munculnya ketidakpastian hukum (legal uncertainty) dalam delik korupsi formiil sehingga diubah menjadi delik materiil; (3) relasi/harmonisasi antara frasa "dapat merugikan keuangan negara atau perekonomian negara" dalam pendekatan pidana pada UU Tipikor dengan pendekatan administratif pada Undang-Undang Nomor 30 Tahun 2004 tentang Administrasi Pemerintahan (UU AP); dan (4) adanya dugaan kriminalisasi dari Aparatur Sipil Negara (ASN) dengan menggunakan frasa "dapat merugikan keuangan negara atau perekonomian negara" dalam UU Tipikor.Constitutional Court Decision No. 25/PUU-XIV/2016 revokes the phrase "may" in Article 2 paragraph (1) and Article 3 of Law No. 31 of 1999 in conjunction with Law No. 20 of 2001 on the amendment of Law No. 31 of 1999 on Eradication of Corruption (Corruption Act). Decision of this Court interpreted the phrase "may be detrimental to the state finance or economy of the state" in Article 2 (1) and Article 3 of Corruption Act must prove real state financial losses (actual loss) not a potential nor estimated financial losses of the state (potential losses). In the consideration of the judgment, at least, there are four benchmarks that become the ratio legis of the Court to shift the substance of the offense of corruption. The Four benchmarks are (1) nebis in idem with the previous Constitutional Court ruling that is Constitutional Court Decision Number 003/PUU-IV/2006; (2) the emergence of legal uncertainty in the formal corruption offense that it is converted into material offense; (3) the relationship/harmonisation between the phrases "may be detrimental to the state finance or economy of the state" in the criminal approach on Corruption Law with an administrative approach to Law No. 30 of 2004 on Governmental Administration (UU AP); and (4) alleged criminalization of State Civil Apparatus (ASN) by using the phrase "may be detrimental to the state finance or economy of the state" in the Anti-Corruption Act.

Hukum adat sebagai aturan yang mengatur perbuatan dan tingkah laku dalam hubungan kemasyarakatan, timbul, tumbuh dan berkembang dalam masyarakat (masyarakat Indonesia), yang dipertahankan sebagai penjaga tata tertib hukum. Dalam hukum adat dikenal istilah delik adat yang artinya segala perbuatan yang bertentangan dengan hukum adat yang jika dilanggar akan mendapatkan reaksi adat atau sanksi adat. Tujuan adanya reaksi adat atau sanksi adat adalah untuk memulihkan keseimbangan yang terganggu antara lain dengan berbagai jalan dan cara, dengan pembayaran adat berupa barang, uang, mengadakan pembersihan (maprayascita) dan lain sebagainya. Namun adakalanya delik adat yang dilakukan seseorang juga sekaligus menjadi delik pidana dalam hukum formal seperti misalnya kasus pencabulan terhadap anak dibawah umur. Sehingga selain pelakunya diberikan sanksi adat oleh desa adat, secara berbarengan dikenai juga sanksi pidana oleh Negara karena kasusnya ditangani Polisi. Sehingga pada akhir cerita ternyata pelakunya dihukum sebanyak 2 (dua) kali terhadap perbuatan yang sama. Jika dikaitkan dengan sebuah asas hukum yang kita kenal dengan asas nebis in idem (diatur di dalam Pasal 76 ayat (1), ayat (2) KUHP) yang artinya seseorang tidak boleh dituntut sekali lagi lantaran perbuatan yang baginya telah diputuskan oleh hakim.

Abstract:
The searches for new antimicrobial compounds to control the lactic acid bacteria in winemaking are based in the increasing global concern about the chemical preservatives restrictions and the development of super-resistant strains continuously exposed to sulfites in wineries for decades. The antimicrobial activity of the nisin as a biopreservative was studied for Bordô (Ives) and Niágara grape wines from Santa Catarina, Brazil. Measurements of antimicrobial activity were made by well-diffusion assays. From the eleven previously assessed strains of nisinsusceptible lactic bacteria (nisin concentration 1000 IU ml-1), four were selected for definitive assays with nisin (100 IU ml-1) dissolved in the wines. Positive results for inhibition were obtained for the four strains selected. Next, the direct inhibitory action was assessed in wines artificially inoculated and then treated with nisin. After 60 days of storage, there was reduction in the total bacterial population as compared to control, especially in Bordô (Ives) wine, while the physic-chemical parameters were not influenced by the nisin treatment. The inhibitory activity of nisin was not affected when it was dissolved in wine in the antimicrobial assays, and its potential utilization as biopreservative should be able to aid on the control of autochthonous microbiota, but further studies are required to conclude more precisely the nisin effects at long term in wines.

The new genus Nefis gen. nov. is described within the tribe Lixini (Coleoptera: Curculionidae) and its systematic position is discussed. The new genus is recognized by short rectangular rostrum, trapezoidal female tergite VIII with truncate apex and long setaceous posterolateral margins, visible 2-segmented labial palpi and protruding sinuate dorsal apex of protibiae. Nefis gen. nov. is close to Larinus Dejean, 1821, Rhinocyllus Germar, 1817, and Bangasternus Gozis, 1882. Three new species are described from Turkey and Afghanistan: Nefis attilai sp. nov., Nefis kabakovi sp. nov. and Nefis korotyaevi sp. nov. Describes the history of the recurring impulse for independence from the St. Kitts-Nevis state on the part of Nevis. Author examines the modern political history of the St. Kitts-Nevis state, in order to discern the motivations of the Nevisian people and politicians for their wish of secession. First, he sketches how Nevis and St. Kitts were historically linked since the 17th c., but that socioeconomic differences developed; as after the decline of sugar and plantation agriculture on both islands, St Kitts developed a largely proletarian rural population, whereas Nevis' population came to consist more of smallholders, resulting in the labour movement having more influence in St Kitts than in Nevis, which also had political repercussions. Nevisian parties favoured secession. Author reconstructs elections, partisan and general political developments in the St. Kitts-Nevis union since the 1950s, describing the long dominance of the St. Kitts-dominated Labour Party, and responses in Nevis. For Nevisian secession there seemed to be popular support. In 1998, however, the required majority on Nevis for secession was not obtained. Author concludes that the Nevisian wish for secession did not stem from any strong nationalistic zeal, or a particularly strong sense of separate identity or ethnicity, but mainly from economic and political reasons.

Approx. 2% of the Neisseria meningitidis genome consists of small DNA insertion sequences known as Correia or nemis elements, which feature TIRs (terminal inverted repeats) of 26–27 bp in length. Elements interspersed with coding regions are co-transcribed with flanking genes into mRNAs, processed at double-stranded RNA structures formed by TIRs. N. meningitidis RNase III (endoribonuclease III) is sufficient to process nemis+ RNAs. RNA hairpins formed by nemis with the same termini (26/26 and 27/27 repeats) are cleaved. By contrast, bulged hairpins formed by 26/27 repeats inhibit cleavage, both in vitro and in vivo. In electrophoretic mobility shift assays, all hairpin types formed similar retarded complexes upon incubation with RNase III. The levels of corresponding nemis+ and nemis− mRNAs, and the relative stabilities of RNA segments processed from nemis+ transcripts in vitro, may both vary significantly.

The Intensive Management Science Partnership: NEBIE Plot Network is a stand-scale, multi-agency research project designed to compare the ecological effects of a range of silvicultural treatments in northern temperate and boreal forest regions of Ontario. The NEBIE plot network was established in 2001 with randomized complete block experiments installed at eight sites. The NEBIE acronym stands for Natural disturbance, and Extensive, Basic, Intensive, and Elite silviculture. Each NEBIE treatment was replicated at least three times at each site, using large experimental units (2-ha plots). The NEBIE plot network provides researchers with an opportunity to conduct long-term scientific studies at multiple scales and disciplines. The operational-scale treatment plots allow assessment of a variety of forest values in a context directly relevant to informing forest planning and management. In this paper, we document the experimental design and describe the sites and silviculture treatments. Information about sampling designs is provided, along with preliminary results, in a companion paper published in this edition of The Forestry Chronicle.

Abstract. The Northeast Greenland Ice Stream (NEGIS) has been suffering a significant ice mass loss during the last decades. This is partly due to increasing oceanic temperatures in the subpolar North Atlantic, which enhance submarine basal melting and mass discharge. This demonstrates the high sensitivity of this region to oceanic changes. In addition, a recent study suggested that the NEGIS grounding line was 20–40 km behind its present-day location for 15 ka during Marine Isotope Stage (MIS) 3. This is in contrast with Greenland temperature records indicating cold atmospheric conditions at that time, expected to favour ice-sheet expansion. To explain this anomalous retreat a combination of atmospheric and external forcings has been invoked. Yet, as the ocean is found to be a primary driver of the ongoing retreat of the NEGIS glaciers, the effect of past oceanic changes in their paleo evolution cannot be ruled out and should be explored in detail. Here we investigate the sensitivity of the NEGIS to the oceanic forcing during the last glacial period using a three-dimensional hybrid ice-sheet–shelf model. We find that a sufficiently high oceanic forcing could account for a NEGIS ice-margin retreat of several tens of kilometres, potentially explaining the recently proposed NEGIS grounding-line retreat during Marine Isotope Stage 3.

Introduction: Information on the prevalence of keratinophilic fungi in West Indies is scanty. Occurrence of keratinophilic fungi in soils of St. Kitts and Nevis has not been investigated previously. Methodology: The prevalence of keratinophilic fungi was investigated in 108 samples of soils of varying habitats from St. Kitts and 55 such samples from Nevis by hair-baiting technique. Fungal growths appearing on the hair baits after four to eight weeks of incubation at room temperature were microscopically examined and cultured on mycological media. Cultures were identified on the basis of colonial and microscopic features. Results: Forty-nine (45%) of the samples from St. Kitts and 38 (69%) from Nevis were positive for keratinophilic fungi. Microsporum gypseum complex, a well-known geophilic dermatophyte, was the most frequently recovered species being present in 15.7% of soils of St. Kitts and 40% of soils of Nevis. The next commonest species recovered was Chrysosporium indicum, represented by 15 (13.9%) isolates from St. Kitts and seven (12.7%) isolates from Nevis. Other infrequently isolated keratinophilic species included Chrysosporium tropicum, Chrysosporium keratinophilum, and unidentified Chrysosporium species. Conclusions: This study is the first of its kind in the islands of St. Kitts and Nevis. A high incidence of M. gypseum complex in the soil of these islands is a noteworthy finding of public health significance.

561 Background: Neuroendocrine bladder cancer (NEBC) is a rare and aggressive variant that is associated with poor survival outcomes. Because NEBC is rare, the molecular features of NEBC remain poorly characterized. Therefore, we characterized NEBC at the molecular level to understand the underlying biology and identify novel therapeutic targets. Methods: Whole transcriptome RNAseq was performed on FFPE cores from 24 NEBCs and 51 conventional muscle-invasive bladder cancers (MIBCs) from Tenon Hospital in Paris. Results: Unsupervised cluster analysis of 75 tumors generated 2 distinct clusters that separated NEBCs from MIBCs. The NEBC tumors were strongly enriched with biomarkers for the characteristic of neuroendocrine or small cell malignancies, including DLL3, SOX2, and EZH2. In addition, E2F1 pathway is significantly enriched due to the impair of RB/p53 pathways. Further, the NEBCs were enriched with the TCGA’s neuronal differentiation genes that were associated with high response rates in patients treated in atezolizumab (anti-PDL1) within the context of the ImVigor 210 trial. Nevertheless, the NEBCs were characterized by suppressed immune pathway gene expression signatures, such as the Th1 pathway, effector T cell lymphocyte, and IFNg that are usually highly enriched in tumors that are sensitive to immune checkpoint blockade. Of candidate mechanisms, the suppressed TGFbpathway activity observed in the NEBCs was the most obvious explanation for sensitivity to checkpoint blockade. Conclusions: NEBCs are distinct from conventional MIBCs by gene expression signature. They are also characterized by overexpression of canonical neuroendocrine markers and inhibition of TGFb pathway activity.

Abstract. The north-east Greenland ice stream (NEGIS) was discovered as a large fast-flow feature of the Greenland ice sheet by synthetic aperture radar (SAR) imaginary of the ERS-1 satellite. In this study, the NEGIS is implemented in the dynamic/thermodynamic, large-scale ice-sheet model SICOPOLIS (Simulation Code for POLythermal Ice Sheets). In the first step, we simulate the evolution of the ice sheet on a 10-km grid for the period from 250 ka ago until today, driven by a climatology reconstructed from a combination of present-day observations and GCM results for the past. We assume that the NEGIS area is characterized by enhanced basal sliding compared to the "normal", slowly-flowing areas of the ice sheet, and find that the misfit between simulated and observed ice thicknesses and surface velocities is minimized for a sliding enhancement by the factor three. In the second step, the consequences of the NEGIS, and also of surface-meltwater-induced acceleration of basal sliding, for the possible decay of the Greenland ice sheet in future warming climates are investigated. It is demonstrated that the ice sheet is generally very susceptible to global warming on time-scales of centuries and that surface-meltwater-induced acceleration of basal sliding can speed up the decay significantly, whereas the NEGIS is not likely to dynamically destabilize the ice sheet as a whole.

Abstract. The Northeast Greenland Ice Stream (NEGIS) currently drains more than 10 % of the Greenland Ice Sheet area and has recently undergone significant dynamic changes. It is therefore critical to accurately represent this feature when assessing the future contribution of Greenland to sea level rise. At present, NEGIS is reproduced in ice sheet models by inferring basal conditions using observed surface velocities. This approach helps estimate conditions at the base of the ice sheet but cannot be used to estimate the evolution of basal drag in time, so it is not a good representation of the evolution of the ice sheet in future climate warming scenarios. NEGIS is suggested to be initiated by a geothermal heat flux anomaly close to the ice divide, left behind by the movement of Greenland over the Icelandic plume. However, the heat flux underneath the ice sheet is largely unknown, except for a few direct measurements from deep ice core drill sites. Using the Ice Sheet System Model (ISSM), with ice dynamics coupled to a subglacial hydrology model, we investigate the possibility of initiating NEGIS by inserting heat flux anomalies with various locations and intensities. In our model experiment, a minimum heat flux value of 970 mW m−2 located close to the East Greenland Ice-core Project (EGRIP) is required locally to reproduce the observed NEGIS velocities, giving basal melt rates consistent with previous estimates. The value cannot be attributed to geothermal heat flux alone and we suggest hydrothermal circulation as a potential explanation for the high local heat flux. By including high heat flux and the effect of water on sliding, we successfully reproduce the main characteristics of NEGIS in an ice sheet model without using data assimilation.

This study aims to verify how the NECIS responds to the needs identified by educators who receive children with Autism Spectrum Disorder (ASD) in pre-school. This is a qualitative, multiple case study using the content analysis of 6 semi-structured interviews. The results show that these educators feel ill-prepared to work with children with ASD. They expect NECIS professionals will perform more targeted and rehabilitative work with the child and point out the limited time that they have to spend with children as one of the main constraints.

Background: Non-enhancing black holes (neBHs) are more common in multiple sclerosis (MS) patients with longer disease durations and progressive disease subtypes. Objective: Our aim was to analyse the added value of neBHs in patients with clinically isolated syndromes (CISs) for predicting conversion to clinically definite MS (CDMS). Methods: Patients were classified based on the presence or absence of neBHs and on the number of Barkhof–Tintoré (B-T) criteria fulfilled. Dissemination in space (DIS) was defined as the presence of at least three of the four B-T criteria. Dissemination in time (DIT)1 was defined by simultaneous presence of enhancing and non-enhancing lesions. DIT2 was defined by simultaneous presence of neBHs and T2 lesions not apparent on T1-weighted images. Results: Focal T2-hyperintense brain lesions were identified in 87.7% of the 520 CIS patients, and 41.4% of them presented at least one neBH. Patients meeting DIS, DIT1, and DIT2 had a significantly higher rate of conversion to CDMS. After adjusting for DIS, only patients who fulfilled DIT1 preserved a significant increase in CDMS conversion. Conclusions: Non-enhancing black holes in CIS patients are associated with a higher risk of conversion to CDMS. However, the predictive value of this finding is lost when added to the DIS criteria.

AbstractThe Northeast Greenland Ice Stream (NEGIS) is an important dynamic component for the total mass balance of the Greenland ice sheet, as it reaches up to the central divide and drains 12% of the ice sheet. The geometric boundary conditions and in particular the nature of the subglacial bed of the NEGIS are essential to understand its ice flow dynamics. We present a record of more than 8000 km of radar survey lines of multi-channel, ultra-wideband radio echo sounding data covering an area of 24 000 km2, centered on the drill site for the East Greenland Ice-core Project (EGRIP), in the upper part of the NEGIS catchment. Our data yield a new detailed model of ice-thickness distribution and basal topography in the region. The enhanced resolution of our bed topography model shows features which we interpret to be caused by erosional activity, potentially over several glacial–interglacial cycles. Off-nadir reflections from the ice–bed interface in the center of the ice stream indicate a streamlined bed with elongated subglacial landforms. Our new bed topography model will help to improve the basal boundary conditions of NEGIS prescribed for ice flow models and thus foster an improved understanding of the ice-dynamic setting.

The pulmonary neuroendocrine cell system comprises solitary neuroendocrine cells and clusters of innervated cells or neuroepithelial bodies (NEBs). NEBs figure prominently during the perinatal period when they are postulated to be involved in physiological adaptation to air breathing. Previous studies have documented hyperplasia of NEBs in cystic fibrosis (CF) lungs and increased neuropeptide (bombesin) content produced by these cells, possibly secondary to chronic hypoxia related to CF lung disease. However, little is known about the role of NEBs in the pathogenesis of CF lung disease. In the present study, using a panel of cystic fibrosis transmembrane conductance regulator (CFTR)-specific antibodies and confocal microscopy in combination with RT-PCR, we demonstrate expression of CFTR message and protein in NEB cells of rabbit neonatal lungs. NEB cells expressed CFTR along with neuroendocrine markers. Confocal microscopy established apical membrane localization of the CFTR protein in NEB cells. Cl− conductances corresponding to functional CFTR were demonstrated in NEB cells in a fresh lung slice preparation. Our findings suggest that NEBs, and related neuroendocrine mechanisms, likely play a role in the pathogenesis of CF lung disease, including the early stages before establishment of chronic infection and chronic lung disease.

The epithelium of intrapulmonary airways in many species harbors diffusely spread innervated groups of neuroendocrine cells, called neuroepithelial bodies (NEBs). Data on the location, morphology, and chemical coding of NEBs in mammalian lungs are abundant, but none of the proposed functions has so far been fully established. Besides C-fiber afferents, slowly adapting stretch receptors, and rapidly adapting stretch receptors, recent reviews have added NEBs to the list of presumed sensory receptors in intrapulmonary airways. Physiologically, the innervation of NEBs, however, remains enigmatic. This short overview summarizes our present understanding of the chemical coding and exact location of the receptor end organs of myelinated vagal airway afferents in intrapulmonary airways. The profuse populations that selectively contact complex pulmonary NEB receptors are compared with the much smaller group of smooth muscle-associated airway receptors. The main objective of our contribution was to stimulate the idea that the different populations of myelinated vagal afferents that selectively innervate intraepithelial pulmonary NEBs may represent subpopulations of the extensive group of known electrophysiologically characterized myelinated vagal airway receptors. Future efforts should be directed toward finding out which airway receptor groups are selectively coupled to the complex NEB receptors.

NERIS is the European platform on preparedness for nuclear and radiological emergency response and recovery. Created in 2010 with 57 organisations from 28 different countries, the objectives of the platform are to: improve the effectiveness and coherency of current approaches to preparedness; identify further development needs; improve ‘know how’ and technical expertise; and establish a forum for dialogue and methodological development. The NERIS Strategic Research Agenda is now structured with three main challenges: (i) radiological impact assessments during all phases of nuclear and radiological events; (ii) countermeasures and countermeasure strategies in emergency and recovery, decision support, and disaster informatics; and (iii) setting up a multi-faceted framework for preparedness for emergency response and recovery. The Fukushima accident has highlighted some key issues for further consideration in NERIS research activities, including: the importance of transparency of decision-making processes at local, regional, and national levels; the key role of access to environmental monitoring; the importance of dealing with uncertainties in assessment and management of the different phases of the accident; the use of modern social media in the exchange of information; the role of stakeholder involvement processes in both emergency and recovery situations; considerations of societal, ethical, and economic aspects; and the reinforcement of education and training for various actors. This paper emphasises the main issues at stake for NERIS for post-accident management.

Abstract:
Rev.esc.adm.negEste artículo, resultado de una investigación, analiza la importancia del capital intelectual en las nuevas empresas de base tecnológica (NEBTs) y su impacto en la gestión de los activos basados en conocimiento. Estas nuevas empresas comparten características comunes que se relacionan con el valor de conocimiento tecnocientífico como un activo crítico. De acuerdo a esta realidad, la comunidad de Madrid ha desarrollado una línea de investigación basada en informes de capital intelectual como un diagnóstico estratégico para las NEBTs. El estudio de tipo cualitativo se llevó a cabo con treinta y cinco NEBTs, en fase de consolidación de los sectores: tecnología de información, agroalimentación, medio ambiente, biotecnología e ingeniería. Las nuevas empresas están localizadas en el Parque Científico de Madrid y en el Parque Tecnológico Leganés. Los resultados ponen de manifiesto la importancia de gestionar los activos intangibles con el fin de acercarse a la investigación y desarrollo (I+D) como un negocio y reconocer la complejidad y la amplitud de los conocimientos necesarios para innovar.

Abstract:
O trabalho tomou como objeto de estudo o trajeto dos Núcleos de Epidemiologia Pesquisa e Informação (NEPI) do antigo Distrito de Saúde Tucuruvi/ Jaçanã, período 1991-1996. Adotou como referência a categoria modelo tecno-assistencial, reconhecendo o objeto de estudo na relação dos sujeitos sociais com a gestão pública e desdobramentos na saúde e com os saberes/práticas nucleares inscritos na realidade estudada. Dois projetos políticos distintos nutriram a trajetória dos NEPIs. Os NEPIs nasceram, em 1991, na gestão Erundina, sob a experiência da distritalizaçâo. Cresceram, até 1993, em torno de experiências fundadas nas tradicionais atividades de vigilância epidemiológica na perspectiva de transitar para a vigilância à saúde. A interrupção formal da municipalização, no início da gestão Maluf, não foi suficiente para desviar a rota de estruturação dos NEPIs. Sobreviveram até 1996, resguardados pelos conteúdos e práticas construídos na gestão anterior. Mesmo limitados rumo à implantação da vigilância à saúde, aperfeiçoaram-se no processamento da informação, mantendo minimamente as atividades clássicas de Vigilância Epidemiológica. As evidências deste trajeto de "sobrevivência" estão demarcadas na Instrução Normativa 003/96, publicada no final da gestão Maluf, que privilegia atividades iniciadas na gestão Erundina. A trajetória destes NEPIs foi inquestionavelmente estruturada pela mudança e resistência de todos e de cada um. No limite de suas forças, ainda que por vezes confusos, mantiveram-se coesos e, num movimento de reação coletiva, não se frtaram a integrar "um novo modo de pensar e agir em saúde".
