Abstract:

Article 24 C of Third Amendment of Constitution Law 1945 is the basis of the Constitutional Court to give the final and binding decision in terms of law examination against Constitution Law 1945. Constitutional Court has a restriction to not examine the nebis in idem case unless there is a different substance of Constitutional Law 1945 which is used as the based of examination. In this paper, there are 12 (twelve) Constitutional Court’s decisions on law re-examination against the Constitutional Law 1945 because using different substance of Constitutional Law 1945 as the based of examination. Based on the research, which has been conducted, there are legal reasoning differences in accepting and deciding the cases which have been decided previously which the Court uses different legal interpretation and construction in deciding the case. Thus, this paper will examine and compare legal reasoning methods which are used in deciding the case.

ABSTRAKPutusan Nomor 454/PDT.G/2005/PA.LMG menarik untuk dianalisis karena dua hal. Pertama, terkait dengan titik singgung kewenangan mengadili sengketa hibah/waris pada dua lembaga peradilan dengan adanya Putusan Nomor 163/PDT.G/2008/PT.SBY, dan kedua, tidak ada amar bersifat condemnatoir pada putusan tersebut. Adanya dua putusan pada dua lembaga peradilan yang saling berlawanan terhadap objek dan subjek yang sama menyebabkan penyelesaian perkara ini belum berakhir hingga kini dan tidak adanya kepastian hukum bagi masyarakat pancari keadilan walaupun perkara ini telah melalui proses panjang (sejak tahun 2005 sampai saat ini di tahun 2017). Untuk menganalisis masalah tersebut, ada dua masalah pokok yang diangkat dalam penelitian ini. Apakah pertimbangan hukum pengadilan negeri dalam menerima dan mengadili perkara ini dapat dibenarkan menurut kompetensi absolut yang dimilikinya? Apakah asas ne bis in idem dapat diterapkan dalam hal pengadilan negeri mengadili perkara yang sudah diputus oleh pengadilan agama? Adapun metode yang digunakan dalam penelitian ini adalah metode penelitian hukum normatif. Hasil penelitian menunjukkan bahwa pokok sengketa yang harus diangkat oleh pengadilan negeri maupun pengadilan agama adalah keabsahan hibah dengan jalan pewarisan. Asas ne bis in idem tidak dapat diterapkan oleh pengadilan negeri dalam mengadili perkara tersebut karena putusan pengadilan agama belum berkekuatan hukum tetap.Kata kunci: hibah, waris, kewenangan, peradilan, pokok sengketa. ABSTRACT Court Decision Number 454/PDT.G/2005/PA.LMG is thought-provoking to examine for two things. Firstly, it is related to the authority tangency point in adjudicating grant/heir disputes at two judicial institutions with the Court Decision Number 163/PDT.G/2008/PT.SBY, and secondly, the ruling of the decision is not condemnatory. Two decisions on two opposing jurisdictions against the same object and subject cause the case to remain unresolved until now. There is no legal certainty for the justice seekers, although the case has gone through a long process (since 2005 until now in 2017). To analyze the problem, there are two main issues elaborated in this study. Could the legal considerations of a district court in accepting and adjudicating cases be justified according to their absolute competence? Could the principle of nebis in idem be applied in the case of a district court adjudicating a case which has been decided by a religious court? This research uses normative legal research methods. The results of the study indicate that the subject of the dispute that should be examined by the district court as well as the religious court is the validity of the grant through inheritance. The district court cannot apply the nebis in idem principle in the proceedings as the decision of the religious court has not been permanently enforced.Keywords: grant, inheritance, authority, judiciary, subject matter dispute.

Abstract:

Putusan MK Nomor 25/PUU-XIV/2016 mencabut frasa "dapat" dalam Pasal 2 ayat (1) dan Pasal 3 Undang-Undang Nomor 31 Tahun 1999 juncto Undang-Undang Nomor 20 Tahun 2001 tentang Perubahan Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi (UU Tipikor). Putusan MK ini menafsirkan bahwa frasa "dapat merugikan keuangan negara atau perekonomian negara" dalam Pasal 2 ayat (1) dan Pasal 3 UU Tipikor harus dibuktikan dengan kerugian keuangan negara yang nyata (actual loss) bukan potensi atau perkiraan kerugian keuangan negara (potential loss). Dalam pertimbangannya, setidaknya terdapat empat tolok ukur yang menjadi ratio legis MK menggeser makna subtansi terhadap delik korupsi. Keempat tolok ukur tersebut adalah (1) nebis in idem dengan Putusan MK yang terdahulu yakni Putusan MK Nomor 003/PUU-IV/2006; (2) munculnya ketidakpastian hukum (legal uncertainty) dalam delik korupsi formiil sehingga diubah menjadi delik materiil; (3) relasi/harmonisasi antara frasa "dapat merugikan keuangan negara atau perekonomian negara" dalam pendekatan pidana pada UU Tipikor dengan pendekatan administratif pada Undang-Undang Nomor 30 Tahun 2004 tentang Administrasi Pemerintahan (UU AP); dan (4) adanya dugaan kriminalisasi dari Aparatur Sipil Negara (ASN) dengan menggunakan frasa "dapat merugikan keuangan negara atau perekonomian negara" dalam UU Tipikor.Constitutional Court Decision No. 25/PUU-XIV/2016 revokes the phrase "may" in Article 2 paragraph (1) and Article 3 of Law No. 31 of 1999 in conjunction with Law No. 20 of 2001 on the amendment of Law No. 31 of 1999 on Eradication of Corruption (Corruption Act). Decision of this Court interpreted the phrase "may be detrimental to the state finance or economy of the state" in Article 2 (1) and Article 3 of Corruption Act must prove real state financial losses (actual loss) not a potential nor estimated financial losses of the state (potential losses). In the consideration of the judgment, at least, there are four benchmarks that become the ratio legis of the Court to shift the substance of the offense of corruption. The Four benchmarks are (1) nebis in idem with the previous Constitutional Court ruling that is Constitutional Court Decision Number 003/PUU-IV/2006; (2) the emergence of legal uncertainty in the formal corruption offense that it is converted into material offense; (3) the relationship/harmonisation between the phrases "may be detrimental to the state finance or economy of the state" in the criminal approach on Corruption Law with an administrative approach to Law No. 30 of 2004 on Governmental Administration (UU AP); and (4) alleged criminalization of State Civil Apparatus (ASN) by using the phrase "may be detrimental to the state finance or economy of the state" in the Anti-Corruption Act.

Abstract:

Hukum adat sebagai aturan yang mengatur perbuatan dan tingkah laku dalam hubungan kemasyarakatan, timbul, tumbuh dan berkembang dalam masyarakat (masyarakat Indonesia), yang dipertahankan sebagai penjaga tata tertib hukum. Dalam hukum adat dikenal istilah delik adat yang artinya segala perbuatan yang bertentangan dengan hukum adat yang jika dilanggar akan mendapatkan reaksi adat atau sanksi adat. Tujuan adanya reaksi adat atau sanksi adat adalah untuk memulihkan keseimbangan yang terganggu antara lain dengan berbagai jalan dan cara, dengan pembayaran adat berupa barang, uang, mengadakan pembersihan (maprayascita) dan lain sebagainya. Namun adakalanya delik adat yang dilakukan seseorang juga sekaligus menjadi delik pidana dalam hukum formal seperti misalnya kasus pencabulan terhadap anak dibawah umur. Sehingga selain pelakunya diberikan sanksi adat oleh desa adat, secara berbarengan dikenai juga sanksi pidana oleh Negara karena kasusnya ditangani Polisi. Sehingga pada akhir cerita ternyata pelakunya dihukum sebanyak 2 (dua) kali terhadap perbuatan yang sama. Jika dikaitkan dengan sebuah asas hukum yang kita kenal dengan asas nebis in idem (diatur di dalam Pasal 76 ayat (1), ayat (2) KUHP) yang artinya seseorang tidak boleh dituntut sekali lagi lantaran perbuatan yang baginya telah diputuskan oleh hakim.

Abstract:

The searches for new antimicrobial compounds to control the lactic acid bacteria in winemaking are based in the increasing global concern about the chemical preservatives restrictions and the development of super-resistant strains continuously exposed to sulfites in wineries for decades. The antimicrobial activity of the nisin as a biopreservative was studied for Bordô (Ives) and Niágara grape wines from Santa Catarina, Brazil. Measurements of antimicrobial activity were made by well-diffusion assays. From the eleven previously assessed strains of nisinsusceptible lactic bacteria (nisin concentration 1000 IU ml-1), four were selected for definitive assays with nisin (100 IU ml-1) dissolved in the wines. Positive results for inhibition were obtained for the four strains selected. Next, the direct inhibitory action was assessed in wines artificially inoculated and then treated with nisin. After 60 days of storage, there was reduction in the total bacterial population as compared to control, especially in Bordô (Ives) wine, while the physic-chemical parameters were not influenced by the nisin treatment. The inhibitory activity of nisin was not affected when it was dissolved in wine in the antimicrobial assays, and its potential utilization as biopreservative should be able to aid on the control of autochthonous microbiota, but further studies are required to conclude more precisely the nisin effects at long term in wines.

Abstract:

The Ben Nevis volcanic-plutonic Complex was intruded into garnet grade Precambrian metasediments in the Southwest Highlands of Scotland towards the end of the Caledonian Orogeny. A variety of techniques have been applied to the Ben Nevis Complex in order to model its volcanic and plutonic evolution; these include: field mapping, petrography, mineral chemistry, whole rock major and trace element geochemistry and a combined study of the isotopes of neodymium and strontium. Rocks of the volcanic pile are subdivided into the following formations; the Allt a' Mhuillin formation, the Coire na Ciste formation, the Ledge Route formation and the Summit formation, and these overlie a basement of Dalradian schist. Fine grained metasediments of the Allt a' Mhuillin formation were deposited in a lacustrine basin into which entered a series of non-volcanic mass flow units. Non-volcanic deposition was terminated with the entry of the first volcaniclastic lahars of the Coire na Ciste formation into the Ben Nevis basin. Block and ash flows, lava flows and sills are also found in this formation. The Ledge Route formation testifies to a complex period of quiescence, airfall deposition and mass flow movement after which localised flows of lava dominate the overlying Summit formation. A single felsite dyke is found intruding the volcanic pile and is correlated with early members of the Ben Nevis dyke swarm in the northern area of the Ben Nevis Complex. Plutonic rocks of the Ben Nevis Complex are subdivided into the Fine Quartz Diorite, Sgurr Finnisg-aig Quartz Diorite, Coarse Quartz Diorite, Porphyritic Outer Granite and Inner Granite; these were intruded to a high level in the crust. A dextral stress regime operated during the intrusion of the plutonic rocks. Each of the above units was intruded as a series of pulses. Mass balance and qualitative trace element vector modelling (Rayleigh crystallisation) is able to model the geochemical evolution of the Porphyritic Outer Granite using plagioclase, amphibole, biotite and magnetite as the fractionating assemblage. Pyroxene is found as a phenocryst and as a groundmass phase in the quartz diorites with calcic amphibole found mainly as a replacement mineral after pyroxene; however, trace element modelling identifies amphibole as a fractionating phase. Isotopic modelling of the Ben Nevis Complex indicates the involvement of at least three components; these being a mantle source, a lower crustal source with similar isotopic characteristics to the Islay-Colonsay-Basement and, of lesser importance, Dalradian metasediments. No single parental magma can explain the geochemical and isotopic variation of the Ben Nevis Complex.

Abstract:

The thesis has been carried out at Nedis AB in Jönköping. The aim was to develop proposals on approaches that could help the company to continually improve their warehouse operations by eliminating unnecessary operations, making the warehouse more structured and how they better could use the staff's suggestions for improve-ment. The collection of data consists of observations, interviews with a total of nine people from the staff of Nedis AB and a benchmarking conducted at Husqvarna AB. A number of shortcomings and weaknesses in procedures at the warehouse were iden-tified. Packing stations were not standardized and they were seen as poorly structured and messy. Furthermore, procedures for maintenance and cleaning of the warehouse were flawed. There was no one in charge for maintenance, replenishment and clean-ing materials for the packing stations. There were no clear organization for the im-provements efforts in the warehouse, and also a low utilization and management of staff's ideas. The results of this thesis are suggested approaches that can address the weaknesses identified and that can be used to standardize the work of the warehouse of Nedis AB by establishing clear roles and responsibilities, create conditions for participation, structuring and creating procedures to maintain an organized workplace. In order to work towards continuous improvement, we propose a method where Nedis AB can work with visualization of the improvement process. We also suggest that the compa-ny use boards to easily give feedback and better monitor the on-going improvement efforts. If Nedis AB choose to work enthusiastically with the improvement process and to clarify the objectives of the staff, we believe that the proposals presented in this study will help the company achieve its goal to work towards continuous improvement.

Abstract:

This study investigates the possibility of genetic diversity between geographically separated demes of Cercopithecus aethiops on the islands of St. Kitts and Nevis. The island of St. Kitts was represented by two geographic demes, one from the Northern tip of the island and one from the Southern tip of the island. The island of Nevis was considered as one separate deme.
Eight plasma proteins were analyzed with polyacrylamide gel electrophoresis. A preliminary DNA investigation was also completed.
Three of the plasma proteins--transferrin, albumin, and an unidentified protein that migrated faster than albumin--appeared to be monomorphic. Three proteins in the alpha globulin region (between transferrin and albumin) and pseudocholinesterase were polymorphic in the total population. The DNA locus identified by the Human Molecular Fingerprinting #1 probe (locus D1Z2) was also polymorphic in all demes.
The levels of heterozygosity for North Island, South Island, and Nevis were 2.02%, 2.49%, and 2.49% respectively.
North and South Island demes were more similar to each other than either was to the Nevis deme. The South Island deme was more unlike Nevis than the North Island deme. These figures do not provide sufficient genetic evidence to evaluate divergence within the West Indian vervets according to geography.

Dies gilt für Studierende mit Behinderungen oder chronischen Krankheiten in besonderer Weise. Außer klassischer Anforderungen an die Gestaltungsqualität (Usability) solcher Systeme besteht eine an Bedeutung zunehmende Herausforderung in der Gewährleistung gleichberechtigter Teilhabemöglichkeiten dieser stark heterogenen Nutzergruppe an den Studienangeboten der jeweiligen Hochschule. Es ist bekannt, dass behinderte und chronisch kranke Studierende deutlich häufiger ihr Studium vorzeitig abbrechen oder ihre Studienrichtung wechseln (müssen) als nichtbehinderte Studierende. Als Schlussfolgerung daraus befindet sich an der Technischen Universität Dresden ein "Netzwerk Behinderung und Studium" (NEBUS) im Aufbau, welches Studierende von der Studienbewerbung bis zum Übergang ins Arbeitsleben unterstützen möchte."

Abstract:

Les proprietes de biosorption de metaux lourds des colonies de cyanobacteries se developpant spontanement dans les bassins de la station thermale de neris-les-bains ont ete etudiees. Les cyanobacteries identifiees (phormidium sp. , mastigocladus laminosus, gloeocapsa punctata) sont capables de produire un exopolymere abondant dont la composition a ete suivie sur une periode de 20 mois. L'adsorption des metaux intervient des les premieres 15 minutes du contact et apparait comme tres dependante du ph. Cette adsorption est sujette a competition entre les differents metaux ou cations utilises. La possibilite d'utiliser la biomasse thermale immobilisee en colonne dans une matrice de silice pour la recuperation des metaux est demontree. Ces derniers peuvent de plus etre desorbes avec succes sans que la qualite de la colonne ne soit affectee au cours de cycles adsorption-desorption successifs. L'etude physico-chimique de l'exopolymere secrete, et/ou des cellules en solution a permis de mettre en evidence le role preponderant de la capsule dans le phenomene de biosorption observe, et ceci, en raison de la densite de charge anionique elevee qu'elle presente. Cette densite de charge trouve essentiellement son origine au niveau des acides uroniques constitutifs de la fraction polysaccharidique de l'exopolymere dont il a ete etabli que mastigocladus laminosus etait majoritairement a l'origine de la production. Une etude prospective de cette fraction a donc ete initiee afin de pouvoir correler les proprietes de biosorption de la biomasse thermale, aux caracteristiques structurales de l'exopolysaccharide produit. Celui-ci, apres avoir ete debarrasse par voie enzymatique du glycogene contaminant, est soumis a une etude analytique adaptee aux polysaccharides anioniques. Une hydrolyse acide controlee non specifique et une degradation uronique specifique ont permis de preparer toute une serie d'oligosaccharides, confirmant ainsi l'hypothese selon laquelle le polysaccharide exocellulaire serait constitue de l'assemblage de plusieurs motifs de repetition oligosaccharidiques distincts, et renforcant l'idee d'une extraordinaire complexite de ces polymeres bacteriens. La structure chimique detaillee de plusieurs de ces oligosaccharides a ete obtenue mettant en evidence leur originalite

Aus der Einleitung: "Hochschulstudium kann als ein besonderer Nutzungskontext für elektronische Informationssysteme angesehen werden. Dies gilt für Studierende mit Behinderungen oder chronischen Krankheiten in besonderer Weise. Außer klassischer Anforderungen an die Gestaltungsqualität (Usability) solcher Systeme besteht eine an Bedeutung zunehmende Herausforderung in der Gewährleistung gleichberechtigter Teilhabemöglichkeiten dieser stark heterogenen Nutzergruppe an den Studienangeboten der jeweiligen Hochschule. Es ist bekannt, dass behinderte und chronisch kranke Studierende deutlich häufiger ihr Studium vorzeitig abbrechen oder ihre Studienrichtung wechseln (müssen) als nichtbehinderte Studierende. Als Schlussfolgerung daraus befindet sich an der Technischen Universität Dresden ein "Netzwerk Behinderung und Studium" (NEBUS) im Aufbau, welches Studierende von der Studienbewerbung bis zum Übergang ins Arbeitsleben unterstützen möchte."
