Abstract:

La Bosnie-Herzégovine n'est plus en guerre depuis cinq ans. La signature du traité de Dayton-Paris le 14 décembre 1995 a contribué à une amélioration très significative de la situation. Pourtant les problèmes de mise en œuvre de cet accord demeurent nombreux. Pour répondre aux défis posés par la situation locale , la communauté internationale a adopté une approche très ambitieuse d'occupation civile et militaire de la Bosnie-Herzégovine (BiH). Elle vise à rétablir durablement la paix, mais également à consolider les nouvelles institutions mises en place, au besoin par un interventionnisme très lourd confinant au régime de protectorat. L'accord de Dayton comporte un volet militaire et un volet civil. Le volet militaire visait essentiellement à rétablir la paix : il y est parvenu sans difficultés majeures. Le volet civil, beaucoup plus complexe, a pour objectif de permettre à la Bosnie-Herzégovine de réintégrer la communauté des Nations dans un avenir proche. Composé de 9 annexes, il impose un nouveau cadre constitutionnel à la Bosnie-Herzégovine. Les institutions nationales sont "secondées" par des institutions à caractère international destinées à garantir le respect de l'accord de Dayton en particulier dans le domaine essentiel de la protection des droits fondamentaux des personnes. Un des éléments clés du dispositif mis en place par la communauté internationale est la création d'un poste de Haut représentant désigné par les Puissances garantes de l'accord de Dayton réunies au sein du Peace Implementation Council et avalisé par le Conseil de sécurité des Nations Unies. L'annexe X de l'accord de Dayton relative à l'application civile du plan de paix lui attribue des pouvoirs importants. Selon l'article II de cette annexe, il veille au respect des dispositions de l'Accord par les Parties et contribue à la résolution des difficultés d'application de celui-ci. Le Peace Implementation Council lui a reconnu des pouvoirs élargis lors de la réunion de Bonn le 10 décembre 1997. La crise au Kosovo s'est déroulée dans un contexte assez comparable à celui de la Bosnie-Herzégovine. Bien que le Kosovo n'ait jamais été une république autonome de la Yougoslavie, son statut a posé problème dès les années 1970. Le Maréchal TITO a répondu à la contestation dans la province par l'octroi en 1974 d'un large statut d'autonomie dans le cadre d'une réforme d'ensemble de la Constitution yougoslave. Ce statut a été révoqué en 1989 lors de l'arrivée au pouvoir de Slobodan MILOSEVIC, la province était placée sous administration directe de Belgrade. Les résolutions 1 199 du 23 septembre 1998 et 1203 du 24 octobre 1998 adoptées par le Conseil de sécurité, soulignent l'imminence d'une catastrophe humanitaire au Kosovo et l'existence d'une menace pour la paix et la sécurité dans la région. Le non-respect par le gouvernement yougoslave des obligations qu'elles imposaient a conduit la communauté internationale à engager une action coercitive au printemps 1999 close le 9 juin avec le cessez-le-feu accepté par le gouvernement yougoslave. L'adoption de la résolution 1244 parle Conseil de sécurité met un terme à la crise du Kosovo et place la province sous administration directe des Nations Unies avec occupation du territoire par une force multinationale sous l'égide de l'Organisation, la KFOR. La communauté internationale a recouru à une solution très proche de celle adoptée en Bosnie-Herzégovine avec toutefois un régime de contrôle renforcé. La Bosnie-Herzégovine et la Yougoslavie, dont le Kosovo est partie intégrante, ont le monopole de leur souveraineté "externe". Néanmoins, la communauté internationale s'est vu "déléguer", en vertu d'un traité pour la Bosnie-Herzégovine et d'une résolution du Conseil de sécurité des Nations Unies pour le Kosovo, un certain nombre de compétences internes. La souveraineté externe de la Bosnie-Herzégovine et de la Yougoslavie demeurent entière mais la souveraineté interne est limitée dans certains domaines régaliens essentiels comme la police intérieure du territoire, le droit de battre monnaie, le droit de rendre la justice et le droit de légiférer. Si la province de Kosovo demeure partie intégrante de la Yougoslavie, il pourrait être soutenu que la communauté internationale accompagne ce territoire vers une indépendance à terme.

Abstract:

Abstract Differential treatment is a key norm in multilateral environmental agreements. Its main objective is to increase compliance and reduce the free-rider problem by apportioning the costs and benefits of implementation more equitably across the parties in an agreement. The question of how to differentiate those burdens is inextricably linked to national interests, and while in some instances differential treatment is well designed and facilitates cooperation, in other cases a rigid divide—or cleavage—leads to a stalemate and constant conflict. This article studies the consequences of differential treatment as institutionalized under the United Nations Framework Convention on Climate Change (UNFCCC). Previous research has shown that the separation of UNFCCC parties into two opposing groups has deepened the polarization in the negotiations. We identify two causal mechanisms that may have driven this polarization, namely socialization through material incentives and the formation of group identity. We draw on an original dataset that records (dis)agreements between country pairs, coded from negotiation summaries between 1995 and 2013. Using a relational events model, we show that the division of UNFCCC parties into Annex I (with obligations) and non-Annex I (without obligations) is related primarily to material incentives and less to group identity formation. El trato diferenciado es una norma fundamental en los acuerdos ambientales multilaterales. Su principal objetivo es aumentar el cumplimiento y reducir el problema de los oportunistas distribuyendo los costos y los beneficios de la implementación de forma más equitativa entre las partes de un acuerdo. La cuestión de cómo diferenciar esas cargas está inextricablemente vinculada a los intereses nacionales y mientras que en algunos casos el trato diferenciado está bien diseñado y facilita la cooperación, en otros casos, una división rígida o escisión conduce a un estancamiento o un conflicto constante. En este artículo se estudian las consecuencias del trato diferenciado institucionalizado en la Convención Marco de las Naciones Unidas sobre el Cambio Climático (CMNUCC). Investigaciones anteriores han demostrado que la separación de las partes de la CMNUCC en dos grupos opuestos ha profundizado la polarización en las negociaciones. Identificamos dos mecanismos causales que pueden haber impulsado esta polarización; a saber, la socialización a través de incentivos materiales y la formación de la identidad de grupo. Nos basamos en un conjunto de datos original que registra los (des)acuerdos entre pares de países, codificados a partir de resúmenes de negociación entre 1995 y 2013. La question de savoir comment différencier ces « fardeaux » est inextricablement liée aux intérêts nationaux, et bien que dans certains cas, le traitement différencié soit bien conçu et facilite la coopération, dans d'autres cas, une séparation rigide—ou clivage—conduit à une impasse et à un conflit permanent. Cet article étudie les conséquences du traitement différencié tel qu'il est institutionnalisé dans la Convention-cadre des Nations unies sur les changements climatiques (CCNUCC). Une recherche précédente a monté que la séparation des parties de la CCNUCC en deux groupes opposés avait accru la polarisation des négociations. Nous avons identifié deux mécanismes causaux qui peuvent avoir entraîné cette polarisation: la socialisation par incitations matérielles et la formation d'une identité de groupe. Nous nous appuyons sur un jeu de données original retraçant les (dés)accords entre paires de pays, qui ont été codés à partir des résumés des négociations qui sont intervenues entre 1995 et 2013. Les mécanismes des droits de l'homme des Nations Unies continuent de proliférer. De nombreuses décisions sont prises et des rapports volumineux sont publiés. Le présent article examine la manière dont ces mécanismes appliquent le droit international humanitaire, y compris le droit de Genève et le droit de La Haye. Pour ce faire, il se concentre essentiellement sur la pratique des rapporteurs nommés par la Commission des droits de l'homme des Nations Unies pour enquêter sur la situation des droits de l'homme dans certains pays et sur celle des rapporteurs et des groupes de travail spécialisés, auxquels la Commission a confié pour mandat de suivre des types spécifiques de violations graves des droits de l'homme, où qu'elles se produisent. Il s'agit, en particulier, du rapporteur spécial sur les exécutions extrajudiciaires, sommaires ou arbitraires et du représentant du secrétaire général sur les personnes déplacées dans leur propre pays qui, en vertu de leur mandat, sont le plus souvent amenés à examiner des infractions commises dans le cadre de conflits armés. Référence est faite également à deux mécanismes novateurs qui ont fonctionné en El Salvador : la première « commission de la vérité » parrainée par les Nations Unies, et le premier organe de suivi des droits de l'homme établi dans le cadre d'un mécanisme global de surveillance de l'application d'un accord de paix passé sous l'égide des Nations Unies. Le 3 mars 2023 se sont conclues les négociations relatives au troisième accord d'application de la Convention des Nations unies sur le droit de la mer, dite de Montego Bay, dont l'objet est la protection de la biodiversité en haute mer et l'encadrement des activités qui se déploient dans cet espace. Cet accord dit BBNJ ( Biodiversity Beyond National Jurisdiction ) a été formellement adopté le 9 juin suivant par consensus, et doit maintenant être signé et ratifié par les futurs États parties. Se fondant sur la classification développée par Elinor Ostrom faisant de la haute mer et des ressources biologiques qu'elle contient des common-pool resources (biens communs), cet article a pour objet d'analyser les conséquences de l'adoption de ce traité en matière de gouvernance d'un bien commun dont l'exploitation a vocation à produire une ressource financière encore difficilement quantifiable. Abstract:

The UNFCCC hosted its 25th convention, known as COP25, which cannot be considered to be a success among the climate change conferences due to the failure of 175 nations to agree upon the final details of the Paris Agreement proposed in 2015. The aim was to bring together nations across the globe and reduce the global temperature rise to 2°C, which was expected to be around 4.5°C to 6°C. The justifications for the incompetence can be attributed to a variety of aspects, including their inability to implement the intended nationally determined contributions (INDC). Since there is no overall governing body that can ensure strong implementation of the accords, the system needs to be self-regulatory without any vulnerability to international politics. This study develops a series of factors that can be considered for decision making, benefiting and rewarding to assure complete self-governance of these nations on the said climate accord, without making it vulnerable to the political relations among nations. This study uses pre-defined elements of Game Theory in order to achieve the required equilibrium, as a base for understanding decision making and proposing a possible system to create an acceptable result for the member nations.

SommaireComme la Conférence des Nations Unies sur l'environnement et le développement ( CNUED) faisait face à une scission Nord-Sud sur la question des forêts au Sommet de Rio, elle n'a pas réussi à conclure un accord obligatoire dans ce domaine et s'est contentée à la place d'une "Déclaration de principes non juridiquement contraignante mais faisant autorité, pour un consensus mondial sur la gestion, la conservation et l'exploitation écohgiquement viable de tous les types de forêts. "Les Prinâpes directeurs sur les forêts ont été vivement critiqués parce qu'ils étaient mal orientés et inefficaces. De plus, le fait qu'aucune convention n'a été conclue a été considéré comme un échec important du Sommet de Rio.Ce commentaire examine les initiatives touchant les forêts qui ont été prises après la Conférence des Nations Unies, ainsi que U rôle joué par le Canada dans la poursuite d'un dialogue informel ne débouchant pas sur une convention. On soutient que les défis importants auxquels fait face le secteur des forêts concernent le développement et non le droit et que la négociation d'un instrument juridique obligatoire ne devrait pas être considérée comme une condition indispensable à l'accomplissement de progrès en matière de développement durable des forêts. On devrait plutôt juger toutes les formes de négociation et d'entente en fonction de l'importance de leurs contributions à l'utilisation durable des forêts du monde entier. De ce point de vue, les efforts déployés après la conférence sont utiles et pertinents, car il est nécessaire de prendre des mesures pour régler ce grave problème.

Maguelone Girardot, 26 ans, dirige Radio Al-Salam à Erbil (Kurdistan irakien), une radio associative émettant en kurde et en arabe, seul média indépendant, dont les journalistes sont issus de différentes communautés ethniques et religieuses d’Irak et de Syrie. Les programmes de cette radio promeuvent un message de résilience et de dialogue intercommunautaire, avec une attention particulière pour les minorités et les exilés. Auparavant, Maguelone a travaillé auprès des migrants comme volontaire à Paris, à Calais et en Bulgarie, puis auprès de réfugiés syriens au Liban et au Haut-Commissariat des Nations unies pour les réfugiés (HCR), au Maroc. Elle nous raconte les trajectoires complexes de quelques-uns de ces migrants et réfugiés qu’elle a rencontrés à Paris, au Maroc, au Liban et en Irak.

Delonge la aǔtoro elprovas kaj evoluigas la kapablon de Esperanto funkcii kiel perilo por internacia juro kaj diplomatic). La artikolo resumas la historion de interesigo pri tiu fako tra la pasintaj cent jaroj, ekde la elkreo de Esperanto fare de Zamenhof fine de la deknaǔa jarcento, tra evoluigo de la vortprovizo de la lingvo, ĝis ĝia aplikiĝo al juraj demandoj. Asocio de esperantistaj juristoj formiĝis jam en 1905, kaj la unuaj konferencaj prelegoj kaj fakaj artikoloj pri juro datiĝas de tiu periodo. Gravajn internaciajn instru-mentojn, ekde la Statuto de la Ligo de Nacioi en 1920, oni tradukis en Esperanton, kune kun naciaj konstitucioj kaj diversaj traktatoj. La Carto de Unuiĝintaj Nacioj kaj la Uni-versala Deklaracio de Homaj Rajtoj estis eldonitaj de Unuiĝintaj Nacioj en Esperanto. La artikolo priskribas problemojn en la elekto de internaciaj terminoj kaj en la kompare-blo de tekstoj. SOMMAIRE Le développement d'une langue pour le droit international: L'expérience de l'espéranto Pour être acceptable et efficace, le droit international exige non seulement une perspective sur le monde mais aussi un langage précis qui puisse être compris et utilisé par tous. Le latin a joué ce rôle dans le passé. Et pendant deux siècles ce fut le tour du français. Aujourd'hui, les Nations Unies utilisent six langues et l'on a fait peu de progrès vers un accord sur une langue commune qui faciliterait la coopération internationale. L'auteur de cet article a expérimenté et développé la possibilité de l'espéranto à servir de langue véhiculaire pour le droit et la diplomatie internationaux. Cet article donne un aperçu historique à l'intérêt dans ce domaine au cours des cent années passées, commençant par Zamenhof et son développement de l'espéranto à la fin du 19ème siècle, le développement du lexique de la langue et son application à des problèmes légaux. Une association de juristes espérantistes fut formée en 1905: les premiers exposés lors de colloques et les premiers articles publiés sur le droit datent de cette époque. Les principaux instruments internationaux, à commencer par la Convention de la Ligue des Nations en 1920, ont été traduits en espéranto; des constitutions nationales et divers traités furent également traduits à cette époque. La Charte des Nations Unies et la Déclaration universelle des droits de l'homme ont ete publiées par les Nations Unies en espéranto. L'auteur de cet article décrit les problèmes recontrés dans le choix d'une terminologie internationale et dans le rapprochement des textes.

Sous la pression d'une nouvelle pratique de juridiction rampante imposée par le Canada, le Chili et l'Argentine, tentant ainsi d'empêcher la déprédation par de grands armements, des ressources transzones situées dans la haute mer adjacente à leur zone économique exclusive, la grande majorité des États de la planète ont adopté en août 1995, sous l'égide de I'ONU un accord sur les stocks chevauchants et les grands migrateurs. Cet Accord nécessaire vient ordonner des pratiques qui, autrement, seraient vouées à l'anarchie des compétiteurs. Il opère nettement un choix en faveur du riverain, qui dispose des principes de compatibilité et de précaution pour faire valider ses vues en matière de conservation et d'exploitation de ces ressources biologiques. Il valide en quelque sorte les prétentions canadiennes, dont une loi interne prévoit l'usage de la force, en dépit des règles établies par le droit international général. Les États de la Caraïbe qui sont généralement en voie de développement, et qui pour la plupart n'opèrent pas encore en dehors de leur propre ZEE, doivent cependant imaginer en quoi ce nouveau dispositif peut être un facteur de progrès pour l'avenir de leur industrie halieutique. Malheureusement, il semblerait bien, malgré les apparences qui résulteraient de l'instauration d'un « droit compensatoire hauturier », qu'ils ne soient pas en mesure de tirer avantage de cette nouvelle donne juridique mondiale, qui pêche surtout par ses insuffisances propres.

Abstract:

AbstractDevelopment of the UN Framework Convention on Climate Change Negotiations (UNFCCC) is based on the Conference of the Parties meetings. The Paris accord is a political act setting goals to, operationalize the rulebook agreement. The 24th Conference of the Parties to the United Nations Framework Convention on Climate Change in Poland agreed on a set of guidelines for implementing the landmark 2015 Paris Climate Change Agreement. Katowice was a major step forward for operationalizing the Paris Agreement perspective though the negotiations were incomplete. The Article 6 chapter- market and non-market cooperative approaches- is being sent for completion to the next COP in Santiago. The present research has stressed that in COP25, article 6 would increase high level engagement of countries to finalize guidance with a perspective to prepare a decision by the end of the COP.

Abstract:

There has been growing awareness about global warming and sustainable development, especially because of the dependence on non-renewable energy resources and its effect on emissions. This paper analyses the trends in energy consumption and CO2 emissions in BRICS nations for the period 2000-2020. Data shows that though there has been a rise in both energy consumption and emissions, the inter-country trends are quite different after population differences have been included. Therefore per capita trends are equally important because countries with large population need more energy resources to meet the growing needs of people. Analysis of trends in energy intensity and emission intensity shows both to be declining, thereby indicating a move towards greater energy efficiency. A panel data fixed effects model is used to estimate the effect of various factors on the energy and emission intensities. Results show that GCF has a negative relation with both intensities, while the effect of population is positive. Paris Agreement dummy variable shows that average intensities were lower after the implementation of the Paris Climate Accord.

Le 4 Mai 2006, la publication du premier tome du Dictionnaire de la Langue des Signes Mauricienne (MSL) était officiellement lancée par son Hon. S.Bappoo, Ministre de la Sécurité Sociale à l’Ile Maurice. Le 17 Mars 2007, le premier Journal Télévisé Hebdomadaire en MSL interprété par des présentatrices Sourdes voyait le jour sur les chaînes nationales mauriciennes de la Mauritius Broadcasting Corporation. Ces deux évènements majeurs ont participé à la reconnaissance officielle de la MSL par le gouvernement mauricien d’abord, puis par l’ONU. Ils ont été réalisés dans le cadre d’une convention signée entre le gouvernement mauricien, l’INJS de Paris, l’Ambassade de France à Maurice et l’Université de Düsseldorf pour le Développement de la Langue des Signes Mauricienne et ce, pour une durée de 3 ans, de 2005 à 2007. The United Nations has declared that Climate Change is a long-term shift in weather pattern, that could be natural such as variations in the solar cycles. The 1987 Philippine Constitution states that The State shall protect and advance the right of the people to a balanced and healthful ecology in accord with the rhythm and harmony of nature.” In 2020, the Paris Agreement , which is the pinnacle of international law on climate change, orchestrated global climate action over the coming decades. Countries agreed to limit global warming to well below 2ºC above preindustrial times, closer to 1.5ºC. In 2023, at the World Economic Forum, Climate Change has been one of the biggest economic factors playing a vital role globally. This means that aside from the global terrorist threat, Climate Change is now a global threat that raises a global concern that needs an urgent attention. In the Metaphysics perspective, this year will bring out more issues on climate change affecting the productivity of farmers specially in Q3 and Q4. Global business entities face the challenge of incremental pressures to restructure their strategic alignments and capabilities to be in accordance with the sustainable development initiatives of the United Nations. This study endeavours to investigate the mediating role of employees’ green motivations in the relationships of environmental ethics, the institutional environment, and managerial support with the green behaviour of companies in the Malaysian food manufacturing industry. Data were collected using a questionnaire survey completed by 230 respondents to achieve the study objectives. The respondents consisted of CEOs, company managers, marketing managers, human resources department managers, concerned authorities from environmental protection departments, and producers in the Malaysian food manufacturing industry. The study found that environmental ethics, the institutional environment and managerial support play significant roles in motivating employees’ green activities within organisations, while employees’ green motivation substantially contributes to the green behaviour of the company. This study also revealed that employees’ green motivation plays an important mediating role in the relationships of environmental ethics, the institutional environment, and managerial support with the green behaviour of the company. The implications of this study will be important for allowing governments to take instantaneous action for their climate change pledges to the United Nations Framework Convention on Climate Change (UNFCCC) following the Paris Accord of 2015 and the Marrakech Proclamation of 2016.

Ces textes sont cependant l'occasion de s'interroger sur l'impact de ces nouvelles formes d'intervention internationale sur la souveraineté étatique , et plus spécialement, sur la structure constitutionnelle des pays qui n'ont plus le contrôle exclusif de leur processus de production de normes et dont l'exécutif n'opère pas forcément avec le consentement des gouvernés. L'implication active de la communauté internationale dans la sortie de crise en Bosnie-Herzégovine et au Kosovo lui impose un engagement nouveau dans le processus de production de normes juridiques internes. Abstract:

The most relevant factors that affect climate are astronomic cycles ant their effects on planet Earth and Earth’s orbit around the Sun. They have impact on the occurrence of glacial and interglacial periods at generally 100.000-year frequencies, which were affected by orbital shape variations and effects of greenhouse gases.The youngest geological epoch of the geological history of Earth is Holocene (started with warming) that began approximately 11.000 years BP. In that epoch, the shape of Earth’s orbit around the Sun was nearly circular, close to a perfect circle, and the seasonal contrast was less severe, due to decreased tilt of Earth’s axis from the plane of its orbit around the Sun. However, most scientists are arguing that the causes of rapid climate change are rooted in human activity, and not in its internal orbital variations. The main causes of global warming are increased level of carbon dioxide, but also of methane and chlorofluorocarbons in the atmosphere. These gases are responsible for the greenhouse effect, ozone layer depletion in stratosphere and rapid global warming. In order to set up the legal framework of environmental protection, the United Nations Conference on the Human Environment has adopted Stockholm Declaration in June 16, 1972. About twenty industrial states have ratified in 1987 the Montreal Protocol on Substances that Deplete the Ozone Layer, which has undergone many revisions by London Convention (1990), Copenhagen Accord (1992), Vienna Convention (1995), Kyoto Protocol (1997) and the Paris Agreement ‒ an international universal agreement on climate adopted at the 2015 Paris Climate Conference (COP21). Environmental protection in the European Union is provided for by its primary and secondary law, and the most EU environmental regulations were implemented in the Serbian legislation.

Abstract:

In 1962, newly independent African states voted overwhelming in support of United Nations (UN) General Assembly Resolution 1803 (XVII) on ‘Permanent Sovereignty over Natural Resources’ (PSNR). This resolution emerged mainly in response to concerns about the protection of foreign direct investment (FDI) and economic development in developing countries. Although substantial legal scholarship has focused on PSNR, few studies have focused on conceptualising PSNR and investor-state dispute settlement (ISDS) in Africa. This paper intends to fill this important research gap, by conceptualising PSNR as a threepronged principle that protects the rights of the state, investors and citizens. This paper examines the evolution of PSNR in the context of investment law in Africa through a textual analysis of treaty language in African investment treaties and as interpreted in natural resource-related investor-state disputes. This paper also examines the significance of Tanzania’s recently enacted Natural Wealth and Resources (Permanent Sovereignty) Act, 2017 (Sovereignty Act). The paper’s textual analysis reveals that unlike what is envisaged under Resolution 1803, dispute settlement clauses in treaties signed by African states do not provide for the exhaustion of local remedies. This paper argues that to attain ‘sustainable sovereignty’ over natural resources, African states must recognise the core of foreign investment protection law: pacta sunt servanda. Although the ‘new generation’ treaties constitute positive steps, to fully attain transformed development through the sustainable use of natural resources (as envisaged in Agenda 2063) treaty reform must be backed by good governance, informed natural resource investment contracts, the rule of law, and intra-regional investment. En 1962, les États africains nouvellement indépendants ont favorablement et massivement voté la Résolution 1803 (XVII) de l’Assemblée générale des Nations Unies (ONU), sur la « souveraineté permanente des ressources naturelles » (SPRN). Cette Résolution a été adoptée en réponse aux préoccupations concernant la protection des investissements directs étrangers (IDE) et le développement économique des pays en voie de développement. Bien que le SPRN ait fait l’objet d’importantes études juridiques, peu d’études ont porté sur la conceptualisation des SPRN et les accords sur les différends entre investisseurs et États (ADIE) en Afrique. Cet article vise à combler cet important vide dans la recherche en conceptualisant les SPRN comme un principe à trois volets qui protège les droits de l’État, des investisseurs et des citoyens. Cet article analyse l’évolution des SPRN dans le contexte du droit à l’investissement en Afrique par une analyse textuelle du langage des traités dans les traités d’investissement africains et tel qu’interprété dans les différends entre investisseurs et États en relation avec les ressources naturelles. Cet article examine également l’importance de la récente promulgation en Tanzanie de la loi sur les Richesses et Ressources Naturelles (Souveraineté Permanente) de 2017 (Loi sur la Souveraineté). L’analyse textuelle de cet article révèle que contrairement à ce qui est envisagé dans la Résolution 1803, les clauses de règlement des différends contenues dans les traités signés par les États africains ne prévoient pas l’épuisement des recours internes. The objective of the present paper is to draw lessons from policy development on sustainable diets. It considers the emergence of sustainable diets as a policy issue and reviews the environmental challenge to nutrition science as to what a ‘good’ diet is for contemporary policy. It explores the variations in how sustainable diets have been approached by policy-makers. The paper considers how international United Nations and European Union (EU) policy engagement now centres on the 2015 Sustainable Development Goals and Paris Climate Change Accord, which require changes across food systems. The paper outlines national sustainable diet policy in various countries: Australia, Brazil, France, the Netherlands, Qatar, Sweden, UK and USA. While no overarching common framework for sustainable diets has appeared, a policy typology of lessons for sustainable diets is proposed, differentiating (a) orientation and focus, (b) engagement styles and (c) modes of leadership. The paper considers the particularly tortuous rise and fall of UK governmental interest in sustainable diet advice. Initial engagement in the 2000s turned to disengagement in the 2010s, yet some advice has emerged. The 2016 referendum to leave the EU has created a new period of policy uncertainty for the UK food system. This might marginalise attempts to generate sustainable diet advice, but could also be an opportunity for sustainable diets to be a goal for a sustainable UK food system. The role of nutritionists and other food science professions will be significant in this period of policy flux.

The notion of achieving net-zero greenhouse gas emissions gained prominence through the Paris Agreement, a groundbreaking accord reached at the United Nations Climate Change Conference. This agreement was devised to mitigate the impact of greenhouse gas emissions. To execute the net-zero CO2 emission plan, the USDOE has set a new goal to remove gigatons of carbon dioxide (CO2 ) from the atmosphere and durably store it for less than $100/ton of net CO2 -equivalent. Making such a goal a reality requires an accurate estimation of CO2 storage capacity for the successful implementation of Carbon Capture and Storage (CCS) technologies, and the assessment of the impact of CCS to the reduction of CO2 emissions. Hence this paper serves as a template for accurately estimating CO2 storage capacity in depleted saturated oil reservoirs with initial gas cap using three approaches: Volumetric, Production and Correlation-based methods and compares the accuracy of the estimates. A case study was conducted on a depleted VR273_Q combination sand in the Vermillion Basin, Gulf of Mexico (GOM). The deterministic and stochastic (P50) CO2 storage capacity estimates from the Volume-based method are 1.21 million tonnes (Mt) and 1.23 Mt respectively, while the deterministic CO2 storage capacity estimates from the Production and Correlationbased method are 1.32 Mt and 1.41 Mt respectively. All three approaches showed similar results, with little deviations attributed to petrophysical uncertainties arising from data gaps i.e., absence of well logs to key wells. However, these uncertainties are captured by Stochastic (P90) CO2 storage capacity estimates of 1.47 Mt from the Volume-based method. Although the Correlation-based approach slightly overestimates the CO2 storage capacity, it can be used as a starting point for quick estimation as it only requires production data which are readily available on various databases for GOM. Finally, through this paper, opportunities for concerned agencies to make well-informed energy-related policies and business decisions are made possible.

Abstract:

The Treaty of Versailles - the Vision of the Civilization of Peace The Treaty of Versailles, the details of which were ironed out at the Paris Peace Conference, officially brought to an end World War I. The Conference represented the first international debate on the problem of peace. Twenty-seven victorious nations participated. The defeated states of Germany, Austria, Hungary, Turkey and Bulgaria were not allowed to take part in the deliberations – their only role was to sign separate versions of the treaty put before them. Bolshevik Russia was also not invited to the peace conference. On March 3, 1918, the latter signed its own peace accord in Brest with Germany and Austria, Hungary and their allies - Bulgaria and Turkey - thus violating its commitments to the Entente. This was because attendance at the peace conference depended not only on the attitude of the participants to the warring central states, but also on the moral norms recognized as binding in achieving peace. The Treaty was a testament not only to the expectations of its signatories towards their defeated opponents, but also to their intellectual and ethical aspirations with regard to attaining peaceful coexistence. It established many new borders on the map of Europe and introduced a new order on the continent, one that was not only political in form, but also cultural and civilizational. Its foundations were to be built on the values of peace and justice. Therefore, there are grounds for describing the new order created on their basis as the civilization of peace. Wypracowany na paryskiej konferencji pokojowej traktat wersalski zakończył oficjalnie I wojnę światową. Konferencja ta pierwszą międzynarodową debatą poświęconą problemom pokoju. Uczestniczyło w niej 27 zwycięskich państw oraz z nimi sprzymierzonych i stowarzyszonych. Pokonane Niemcy oraz Austria i Węgry, Turcja i Bułgaria nie zostały dopuszczone do obrad - przedstawiono im jedynie do podpisu oddzielne wersje traktatu. Na konferencję pokojową nie zaproszono również bolszewickiej Rosji, która 3 marca 1918 roku podpisała w Brześciu traktat pokojowy z Niemcami i Austrią, Węgrami oraz ich sprzymierzeńcami - Bułgarią i Turcją – łamiąc tym samym porozumienia sojusznicze Ententy. Uczestnictwo w konferencji pokojowej uwarunkowane było bowiem nie tylko stosunkiem do prowadzących wojnę państw centralnych, ale również do norm moralnych, uznanych za obowiązujące w osiąganiu pokoju. Traktat był świadectwem nie tylko oczekiwań jego sygnatariuszy wobec pokonanych przeciwników, ale również ich aspiracji intelektualnych i etycznych, ukierunkowanych na pokojowe współistnienie. Ustanowił wiele nowych granic międzypaństwowych na mapie Europy oraz zaprowadził w jej przestrzeni nowy ład, nie tylko polityczny, ale również kulturowo-cywilizacyjny. .Jego fundament stanowić miały wartości pokoju i sprawiedliwości. Istnieją zatem podstawy, aby tworzony na ich gruncie ład nazwać cywilizacją pokoju.

It is well-recorded that nuclear attacks happened twice in history, in Hiroshima and Nagasaki, but it is often overlooked that nuclear explosions were more frequent, with over 2,000 tests taking place in more than 60 locations worldwide. These special circumstances prompted the General Assembly to adopt a comprehensive ban treaty (CTBT) in 1996, which has yet to enter into force. Borrowing from Kelman’s social conformity theory, this article explains how and why states chose to conform to a non-binding agreement. It argues that, as interested parties developed an anti-testing narrative that seemed simultaneously hopeful and realistic, they stabilized actor’s reaction and catalyzed a shift in attitudes towards nuclear testing from forbearance to an authoritative global moratorium, which accounts for the complete eradication of the atmospheric experiments. C’est un fait bien établi que l’histoire a connu deux attaques nucléaires, à Hiroshima et Nagasaki. Ce que l’on sait moins, c’est que les explosions nucléaires étaient bien plus fréquentes, avec plus de 2 000 tests effectués sur une soixantaine de sites de par le monde. Ces circonstances particulières ont poussé l’Assemblée générale des Nations unies à adopter, en 1996, un traité d’interdiction complète des essais nucléaires (TICE), qui n’est pas encore entré en vigueur. S’inspirant de la théorie du conformisme social de Kelman, cet article explique comment et pourquoi des États ont choisi de respecter un accord non contraignant. Il avance que, à mesure que les parties intéressées développaient un discours anti-essais nucléaires qui paraissait à la fois réaliste et porteur d’espoir, elles ont stabilisé les réactions des acteurs et déclenché un changement des mentalités à l’égard des essais nucléaires, passant de l’indulgence à un moratoire général faisant autorité, ce qui explique la disparition complète des essais atmosphériques. Deze bijzondere omstandigheden hebben de Algemene Vergadering ertoe aangezet om in 1996 een alomvattend verbodsverdrag (CTBT) goed te keuren, dat nog steeds niet in werking is getreden. Aan de hand van de sociale-conformiteitstheorie van Kelman wordt in dit artikel uitgelegd hoe en waarom staten ervoor kiezen zich te conformeren aan een niet-bindende overeenkomst. Het betoogt dat, naarmate de betrokken partijen een narratief tegen kernproeven ontwikkelden dat tegelijk hoopvol en realistisch leek, zij de reactie van de actoren stabiliseerden en als katalysator werkten voor de verschuiving in de houding ten opzichte van kernproeven van gedoging naar een wereldwijd officieel moratorium, wat de volledige uitroeiing van de atmosferische experimenten verklaart. Está bien documentado que los ataques nucleares han sucedido dos veces en la historia, en Hiroshima y Nagasaki, pero en ocasiones pasa desapercibido que las explosiones nucleares han sido más frecuentes, con más de 2.000 ensayos llevándose a cabo en más de 60 emplazamientos a escala mundial. Estas circunstancias especiales llevaron a la Asamblea General a adoptar el tratado de prohibición completa (TPCEN) en 1996, el cual aun no ha entrado en vigor. Basándose en la teoría de la conformidad social de Kelman, este artículo explica cómo y porqué los Estados eligieron conformarse con un acuerdo no vinculante. Se argumenta que a medida que las partes interesadas desarrollaron una narrativa anti-ensayo que parecía esperanzadora y realista a la vez, ello mismo llevó a apaciguar la posible reacción de los actores y a catalizar un cambio en relación a los ensayos nucleares que fuera de la tolerancia a una moratoria global fidedigna, lo cual equivale a una completa erradicación de los experimentos atmosféricos. É ben noto che nella storia siano avvenuti due attacchi nucleari, a Hiroshima e Nagasaki, ma è spesso trascurato che le esplosioni nucleari siano state molto più frequenti, con oltre 2000 test che hanno avuto luogo in più di 60 sedi nel mondo. Queste circostanze speciali hanno indotto l'Assemblea generale nel 1996, ad adottare un trattato di messa al bando globale (CTBT), che deve ancora entrare in vigore. Prendendo spunto dalla teoria della conformità sociale di Kelman, questo articolo spiega come e perché gli Stati hanno scelto di conformarsi a un accordo non vincolante. Sostiene che, dato che le parti interessate hanno sviluppato una narrativa anti-test che sembrava allo stesso tempo speranzosa e realistica, esse hanno stabilizzato la reazione degli attori e catalizzato un cambiamento negli atteggiamenti nei confronti dei test nucleari dalla tolleranza a un'autorevole moratoria globale, che spiega la completa eliminazione degli esperimenti atmosferici. Diese besonderen Umstände veranlassten die Generalversammlung 1996 zur Verabschiedung eines umfassenden Verbotsvertrags (CTBT), der noch nicht in Kraft getreten ist. In Anlehnung an die soziale Konformitätstheorie von Kelman erklärt dieser Artikel, wie und warum Staaten sich dafür entschieden haben, sich einem unverbindlichen Abkommen zu fügen. Er argumentiert, dass je nachdem die beteiligten Parteien ein Anti-Test-Narrativ entwickelten, das gleichzeitig hoffnungsvoll und realistisch erschien, diese die Reaktion der Akteure stabilisierten und eine Verschiebung in der Haltung gegenüber Atomtests von der Duldung zu einem autoritativen globalen Moratorium herbeiführten, was die vollständige Abschaffung der atmosphärischen Experimente erklärt.
